Rousseau's general will is mostly interpreted as promoting social unity at the expense of plurality. Conversely, this article argues that the general will depends on, and preserves, plurality for its formation and legitimacy. The general and the particular are not fixed opposites, for Rousseau, but are interdependent and contextually defined. The Rousseauian universal anticipates Laclau's notion of universality. The absence of any natural foundations for society deprives the universal of any pre-given identity. Likewise, the Laclauian universal names the lack of (...) ultimate ground for society. To prevent either sectarianism or despotism, the universal has to be constructed politically. Rousseau's contingent general will supplements the lack of universality, as diverse groups and individuals construct common values and political objectives that unify them across divisions without suppressing their difference. Due to its originary lack, the general will remains for ever incomplete. That incompleteness conditions the questioning, ambiguity and openness to change characterizing democracy. Jean-Luc Nancy identifies Rousseau as the first to conceive community as a lost state of immediacy and transparency. Rousseau’s conception has allegedly shaped the western ideal of an immanent community. Nancy deconstructs that ideal, arguing that immanence would suppress community; its oneness would block the being-with which enables our ontological being-in-common. This article argues that Rousseau never posits a lost community but actually explores, like Nancy, the political closure of immanence. Man’s distinguishing trait of perfectibility, which renders him finite, always (...) open to change for better or worse, rejects the self-enclosure of immanence as does the constant willing of the general will which defines a community’s political life. Rousseau's paradox of how a multitude wills itself into the status of a sovereign people, by deciding to join the contract before existing as a people, with a general will to make that decision, presupposes the absence of any ultimate social grounds and the contingency of identities and structures. These presuppositions make Rousseau an unacknowledged precursor of Laclau's post-structuralist politics, refuting the view that Rousseau's politics seeks a totally transparent and harmonious state beyond the questioning and ambiguity defining the political. (...) The people's will grounds the social contract's legitimacy but that will lacks any pre-constituted form and clear guidelines for discerning it. It provides a groundless ground. Rousseau's legislator supplements that lack, representing the people in its absence, helping it frame suitable legislation. The people only requires the lawgiving representative because of its constitutive incompleteness: it thus resists full representation. If it already possessed a common will and identity, the lawgiver and the contract would become irrelevant. The undecidability of autonomy/heteronomy, representative/represented, fiction/reality highlighted by Rousseau's legislator affirms the impossibility of political closure as the condition of freedom and change. The people's incompleteness supports rather than jeopardises its sovereignty, allowing it to reconstitute itself in the open-ended quest for democracy. (shrink)

An important and engaging book on a key argument in contemporary debates about free will and moral responsibility.

Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

It is a commonplace that liberalism and religious belief conflict. Liberalism, its proponents and critics maintain, requires the privatization of religious belief, since liberals often argue that citizens of faith must repress their fundamental commitments when participating in public life. Critics of liberalism complain that privatization is objectionable because it requires citizens of faith to violate their integrity. The liberal political tradition has always sought to carve out social space for individuals to live by their own lights. If liberalism requires (...) citizens to violate their integrity, liberals have cause for concern. I seek to rebut this integrity objection to liberalism. I focus on the dominant form of philosophical liberalism: public reason liberalism. I argue that the integrity objection undermines the mainstream conception of public reason liberalism, but not public reason liberalism itself. The paper opens by outlining the structure of public reason liberalism and the integrity objection (§§2 and 3). It then analyses two versions of the objection and argues that the second version is successful against the mainstream conception of public reason (§4). I argue in response that public reason liberalism need not endorse principles of restraint—the civic restrictions on religious expression typically associated with it. I then sketch a conception of public reason liberalism that eschews principles of restraint (§5). This alternative promises to reconcile public reason liberals and their faith-friendly critics by putting the integrity objection to rest. (shrink)

Through a series of empirical studies involving native speakers of English, German, and Chinese, this paper reveals that the predicate “true” is inherently ambiguous in the empirical domain. Truth statements such as “It is true that Tom is at the party” seem to be ambivalent between two readings. On the first reading, the statement means “Reality is such that Tom is at the party.” On the second reading, the statement means “According to what X believes, Tom is at the party.” (...) While there appear to exist some cross-cultural differences in the interpretation of the statements, the overall findings robustly indicate that “true” has multiple meanings in the realm of empirical matters. The paper seeks to develop an account of indexical phenomena based on the highly general theory of structure and dependence set forth by Husserl in his Logical Investigations. Husserl here defends an Aristotelian theory of meaning, viewing meanings as species or universals having as their instances certain sorts of concrete meaning acts. Indexical phenomena are seen to involve the combination of such acts of meaning with acts of perception, a thesis here developed in some detail and contrasted with accounts of (...) indexicals suggested by Frege, Wittgenstein and by the later Husserl himself in his Ideas I. Implications are drawn also for our understanding of the categorial grammar sketched by Husserl in his 4th Logical Investigation, as also for our understanding of the nature of proper names and other candidate indexical expressions. The three young philosophers Kevin Mulligan, Peter Simons and Barry Smith have become well-known in the last few years especially in German-speaking analytical philosophy and phenomenology circles. This is on the one hand as a result of their historical and systematic philosophical work; but it is also because of the provocative way in which they represent their philosophy. Because they often appear in threes, they have become known as the "gang of three" or "three musketeers" or even – and (...) this in an admiring sense – "mafiosi" (Rescher). They are known primarily for the small workshops they have been organizing in uncomplicated Anglo-Saxon manner all over Europe. Their goal has been to show that analytic philosophy as it has been pursued up to now is in need of reform and also that the history of scientific philosophizing is not identical to the history of Anglo-Saxon analytic philosophy. Above all, they have tried to make more well known the Austrian tradition of scientific philosophy, and they can be given credit for having done much to promote the current interest in this tradition, which means: the history of Austrian philosophy of the 19th and early 20th centuries and its historical context in the Austro-Hungarian Empire. Experimental philosophy of consciousness aims to investigate and explain our thinking about phenomenally conscious states. Based on empirical studies, researchers have argued (a) that we lack a folk concept of consciousness, (b) that we do not think entities like Microsoft feel regret, (c) that unfelt pains are widely accepted, and (d) that people do not attribute phenomenally conscious states to duplicated hamsters. In this article, I review these and other intriguing claims about people’s understanding of phenomenal consciousness. In doing so, (...) Black Aliveness, or a Poetics of Being considers aliveness through the aesthetic doings of poems and essays, through the "imagine a black world" imperative that radiates as the operating ethos of the made-text. In such imagining, the matter of black humanity does not have to be argued for; in this state of aesthetic existence, being and becoming can unfurl. One is alive, one is alive, and this aliveness alights an encounter with the unanswerable ethical query, "how to be." Black Aliveness, (...) then, is a practice of reading as if one is in a black world, as if the reading one is a one, in the relational sense, in the philosophical sense of that pronoun, "one" being a word that allows the self to abstract itself in an instance of study. Are philosophers regularly led into error by misleading pictures, grammatical appearances, illusions and fictions? An affirmative answer to this question lies at the heart of the writings of the later Wittgenstein on mind and language. Another affirmative answer was given much earlier by Anton Marty. The two Austrian philosophers think that philosophers regularly succumb to certain temptations which lie in natural language. Many of the examples given by the two philosophers are indeed the same. I set out the similarities between (...) the two accounts of misleading pictures and argue that many aspects of the two accounts can be defended independently of the very different conceptions of the philosophy of Marty and Wittgenstein. Scholarship in experimental jurisprudence has reported surprising findings about various concepts of legal significance: _acting intentionally_, _causation_, _consent_, _knowledge, recklessness_, _reasonableness,_ and _law_ itself. Often, these studies examine laypeople’s ordinary concepts and draw broader conclusions about legal experts’ concepts. This Article questions such inferences, from empirical findings about ordinary concepts to conclusions about the concepts of those with legal expertise. It presents a case study concerning what it means to act _intentionally._ An experiment examines intentionality judgments across four populations (N (...) = 774): laypeople, law students, non-law students, and United States judges. Legal training affected judgments in three ways that are consistent with the acquisition of a distinctive legal concept. This case study supports the Article’s broader claim: Laypeople’s ordinary concepts are not equivalent to experts’ legal concepts. Our aim in this entry is to articulate the state of the art in the moral psychology of personal identity. We begin by discussing the major philosophical theories of personal identity, including their shortcomings. We then turn to recent psychological work on personal identity and the self, investigations that often illuminate our person-related normative concerns. We conclude by discussing the implications of this psychological work for some contemporary philosophical theories and suggesting fruitful areas for future work on personal identity.

There is growing interest in understanding and eliciting division of labor within groups of scientists. This paper illustrates the need for this division of labor through a historical example, and a formal model is presented to better analyze situations of this type. Analysis of this model reveals that a division of labor can be maintained in two different ways: by limiting information or by endowing the scientists with extreme beliefs. If both features are present however, cognitive diversity is maintained indefinitely, (...) and as a result agents fail to converge to the truth. Beyond the mechanisms for creating diversity suggested here, this shows that the real epistemic goal is not diversity but transient diversity. (shrink)
