The current U.S. health care system, with both rising costs and demands, is unsustainable. The combination of a sense of individual entitlement to health care and limited acceptance of individual responsibility with respect to personal health has contributed to a system which overspends and underperforms. This sense of entitlement has its roots in a perceived right to health care. Beginning with the so-called moral right to health care, the issue of who provides health care has evolved as individual rights have (...) trumped societal rights. The concept of government providing some level of health care ranges from limited government intervention, a ‘negative right to health care’, to various forms of a ‘positive right to health care’. The latter ranges from a decent minimum level of care to the best possible health care with access for all. We clarify the concept of legal rights as an entitlement to health care and present distributive and social justice counter arguments to present health care as a privilege that can be provided/earned/altered/revoked by governments. We propose that unlike a ‘right’, which is unconditional, a ‘privilege’ has limitations. Going forward, expectations about what will be made available should be lowered while taking personal responsibility for one’s health must for elevated. To have access to health care in the future will mean some loss of personal rights and an increase in personal responsibility for gaining or maintaining one’s health. (shrink)

In this chapter, we explore the issue of assisted dying for individuals with dementia at the nexus of ethics and law. We set out the basic medical realities of dementia and the available data about the desire for the option of assisted dying in the face of dementia. We then describe law and practice with respect to voluntary euthanasia and assisted suicide in jurisdictions that permit at least some assisted dying. We conclude that, because of the peculiar ways in which (...) some of the features of dementia interact with specific legislative provisions, less access to assisted dying for persons with dementia can be realized through the legislation than might have been intended or expected. We then describe draft assisted dying legislation that is before the federal Parliament of Canada. We conclude that, because of the peculiar ways in which some of the features of dementia interact with specific legislative provisions, more access to assisted dying for persons with dementia would be realized, if the legislation was passed as drafted, than might be intended or expected. This exercise reveals that very careful attention needs to be paid to the features of dementia if drafting assisted dying legislation in order to actually achieve the desired law reform effect (whatever that might be). The interplay of common ethical rationales for permitting assisted dying (e.g., autonomy and alleviation of suffering) with common features of dementia (e.g., loss of competence before the terminal phase of the illness, loss of the capacity to communicate before the loss of the capacity to suffer) raises challenges for translating one’s ethical position on assisted dying for individuals with dementia into law. I describe an ethic for business administration based on the social tradition of the Catholic Church. I find that much current thinking about business falters for its conceit of truth. Abstractions such as the shareholder-value model contain truth - namely, that business is an economic enterprise to manage for the wealth of its owners. But, as in all abstractions, this truth comes at the expense of falsehood -namely, that persons are assets to deploy on behalf of owners. This last is (...) "wrong" in both senses of the word - it is factually wrong in that persons are far more than business assets, they are supernatural beings, children of God; and it is morally wrong in that it is an injustice to treat them as the former when they are the latter. I draw upon the social tradition of the Catholic Church to recognize that the business of business is not business, but is instead the human person. Following Church teachings, I describe a person-centered ethic of business based upon eight social principles that both correct and enlarge the shareholder-centered ethic of much current business thinking. Nurses are responsible for the well-being and quality of life of many people, and therefore must meet high standards of technical and ethical competence. The most common form of ethical guidance is a code of ethics/professional practice; however, little research on how codes are viewed or used in practice has been undertaken. This study, carried out in six European countries, explored nurses’ opinions of the content and function of codes and their use in nursing practice. A total of 49 focus (...) groups involving 311 nurses were held. Purposive sampling ensured a mix of participants from a range of specialisms. Qualitative analysis enabled emerging themes to be identified on both national and comparative bases. Most participants had a poor understanding of their codes. They were unfamiliar with the content and believed they have little practical value because of extensive barriers to their effective use. In many countries nursing codes appear to be ‘paper tigers’ with little or no impact; changes are needed in the way they are developed and written, introduced in nurse education, and reinforced/implemented in clinical practice. Legal Reason describes and explains the process of analogical reasoning, which is the distinctive feature of legal argument. It challenges the prevailing view, urged by Edward Levi, Cass Sunstein, Richard Posner and others, which regards analogical reasoning as logically flawed or as a defective form of deductive reasoning. It shows that analogical reasoning in the law is the same as the reasoning used by all of us routinely in everyday life and that it is a valid form of reasoning derived (...) from the innate human capacity to recognize the general in the particular, on which thought itself depends. Knowing Persons is an original study of Plato's account of personhood. For Plato, embodied persons are images of a disembodied ideal. The ideal person is a knower. Hence, the lives of embodied persons need to be understood according to Plato's metaphysics of imagery. For Gerson, Plato's account of embodied personhood is not accurately conflated with Cartesian dualism. Plato's dualism is more appropriately seen in the contrast between the ideal disembodied person and the embodied one than in the contrast between mind (...) or soul and body. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:161 HUME ON RESPONSIBILITY For Hume, to hold a person morally responsible for an action is morally to approve of him or to blame him in virtue of the action. Moreover, as he says in the Treatise of Human Nature, "approbation or blame... is nothing but a fainter and more imperceptible love or hatred." How must an action be related to a person in order for the person to (...) be held morally responsible for the action? Since to hold a person morally responsible for an action is morally to approve of him or to blame him in virtue of the action, and since moral approval or blame is nothing but a fainter and more imperceptible love or hatred, the first stage in answering this question is to attempt to answer the following more general question: How must an action be related to a person in order for the person to be loved or hated because of the action? This question, in turn, requires one to consider some of the main features of Hume's account of the passions of love and hatred. One main feature of Hume's account of these passions is that he distinguishes between the object of love and hatred and their causes. Hume says: As the immediate object of pride and humility is self or that identical person, of whose thoughts, actions, and sensations we are intimately conscious; so the object of love and hatred is some other person, of whose thoughts, actions, and sensations we are not conscious (T 329). Though the object of love and hatred be some person other than one-self, the object is not, strictly speaking, the cause, that is, the sole and 162 sufficient cause. For if the other person were the cause, then he would cause both passions in oneself; and since love and hatred nullify one another, neither could ever exist. The causes of love and hatred are complex and diversified. The ingredients of such causes are as follows: First, there are certain general qualities or circumstances. These may be subdivided as follows: (a) mental qualities: qualities of a person such as virtue, knowledge, wit, tend to produce love; those such as vice, ignorance, dullness, tend to produce hatred; (b) bodily features: beauty, strength, swiftness are conducive to love; their opposites, to hatred; (c) external advantages and disadvantages, such as family position, possessions, clothing, etc., can contribute to the production of love or hatred. But, secondly, these qualities or circumstances, considered in abstraction, cannot cause love or hatred. They must be related to the person who is the object of love or hatred. For example, knowing of a beautiful palace cannot lead one to esteem a particular prince unless the palace is related to him by, for instance, being his property. Thirdly, in order for mental qualities, bodily features, or external advantages or disadvantages to produce love or hatred, they must not only be related to the object of these passions; they must also induce pleasure or displeasure. Without pleasure or displeasure, neither love nor hatred could arise. How, then, do actions figure in the causation of love or hatred? An action can cause pleasure or pain. But, for Hume, an action's production of pleasure or pain is a necessary but not a sufficient condition for the production of love or hatred towards the person whose action it is. In addition, 163 the action must be related to the person. But an action is of relatively short duration. Thus, Hume argues: 'Tis not enough, that the action arise from the person, and have him for its immediate cause and author. This relation alone is too feeble and inconstant to be a foundation for these passions. It reaches not the sensible and thinking part, and neither proceeds from any thing durable in him, nor leaves any thing behind it; but passes in a moment, and as if it had never been. On the other hand, an intention shews certain qualities, which, remaining after the action is perform'd, connect it with the person, and facilitate the transition of ideas from one to the other (T 349).
