Quelle place les ordres juridiques romanistes et de common law réservent-ils au sentiment d'équité du juge? Confronté à la rigueur du droit strict, le juge belge, français ou québécois jouit-il de la même latitude que ses confrères anglais ou canadiens pour imposer malgré tout la décision qu'il estime la plus juste? Afin de prendre la mesure de ces diverses "équités judiciaires", l'originalité de la démarche comparative adoptée par l'auteur consiste à prendre appui sur un microphénomène appelant une analyse juridique multidimensionnelle: (...) l'empiétement immobilier, entendu très largement comme l'atteinte au droit réel d'autrui par une construction quelconque. Autour de ce noyau factuel gravite une double démonstration de portée très générale. La première se concentre sur la comparaison approfondie des manifestations du sentiment d'équité des juges romanistes et de common law dans les arcanes du droit positif, au moyen d'instruments aussi divers que l'injonction, l'estoppel, l'abus de droit... Telle était bien l'interrogation de départ. Mais cette première démonstration en appelle une autre, à l'effet que la logique caractérisant le droit des biens décline au profit de logiques propres à des domaines juridiques concurrents. Parmi ceux-ci figurent au premier chef le droit des obligations et plus particulièrement, le droit de la responsabilité civile quasi-délictuelle. One of the most profound and influential studies of this pivotal event, it remains a relevant and stimulating discussion of the problem of preserving individual and political freedom in the modern world. Alan Kahan's translation provides a faithful, readable rendering of Tocqueville's last masterpiece, and includes notes and variants which reveal Tocqueville's sources and include excerpts from his drafts and (...) revisions. Simone Weil (1909-1943) was a defining figure of the twentieth century; a philosopher, Christian, resistance fighter, anarchist, feminist, labor activist and teacher. She was described by T. S. Eliot as "a woman of genius, of a kind of genius akin to that of the saints," and by Albert Camus as "the only great spirit of our time." Originally published posthumously in two volumes, these newly reissued notebooks, are among the very few unedited personal writings of Weil's that still (...) survive today. Containing her thoughts on art, love, science, God and the meaning of life, they give context and meaning to Weil's famous works, revealing a unique philosophy in development and offering a rare private glimpse of her singular personality. Much of this interest has been tied to efforts to draw up national and international plans to deal with a global pandemic. It is common for these plans to state the importance of drawing upon a (...) well-developed ethics framework and we argue that this framework should reflect the values and insights of feminist relational theory. More specifically, we argue that pandemic planning must be squarely situated in the larger realm of public health and that an ethics framework for public health will be one that recognizes the need to pay particular attention to the vulnerability of subpopulations lacking in social and economic power. We propose an ethics framework for public health that builds on the notions of relational personhood (including relational autonomy and social justice) and relational solidarity. Simone Weil is one of the most profound thinkers of the twentieth century. Her writings encompass an extraordinary breadth of subjects, including philosophy, religion, sociology, and politics. A political activist and resistance fighter, her accomplishments are even more astonishing in light of her death in 1943 at the age of thirty-four. Whilst Weil was concerned with deep philosophical questions - the nature of human thought and human faculties, the limits of language, and thought's contact with reality through mediation, (...) science and beauty - the full significance of her work has frequently been obscured by her categorization as a purely religious writer or Christian mystic. Simone Weil: Basic Writings is an expertly edited anthology of her most important writings, presenting Weil's philosophy as it relates to politics, the nature of work, human nature in its duality, necessity, beauty and goodness. D. K. Levy and Marina Barabas have translated all the extracts anew, including translations of important notes and references missing from existing English language editions of Weil's work. Following an extensive introduction by D. K. Levy which places Weil's life and thought in context, each section opens with a short introduction situating the chosen passages within Weil's oeuvre. Simone Weil: Basic Writings is an outstanding starting point for anyone seeking an introduction to Weil's philosophy, and also essential reading for students and scholars of Weil's thought in related disciplines. How, asks Françoise Dastur, can philosophy account for the sudden happening and the factuality of the event? Dastur asks how phenomenology, in particular the work of Heidegger, Husserl, and Merleau-Ponty, may be interpreted as offering such an account. She argues that the "paradoxical capacity of expecting surprise is always in question in phenomenology," and for this reason, she concludes, "We should not oppose phenomenology and the thinking of the event. We should connect them; openness to phenomena must be identified with (...) openness to unpredictability." The article offers reflections in these terms on a phenomenology of birth. (shrink)

In this article, I argue that there is no compelling therapeutic ‘need’ for human nuclear genome transfer to prevent mitochondrial diseases caused by mtDNA mutations. At most there is a strong interest in this technology on the part of some women and couples at risk of having children with mitochondrial disease, and perhaps also a ‘want’ on the part of some researchers who see the technology as a useful precedent – one that provides them with ‘a quiet way station’ in (...) which to refine the micromanipulations techniques essential for other human germline interventions and human cloning. In advance of this argument, I review basic information about mitochondrial disease and novel genetic strategies to prevent the transmission of mutated mitochondria. Next, I address common features of contemporary debates and discussions about so-called mitochondrial replacement. First, I contest the cliché that science-and-technology is fast outpacing ethics. Second, I dispute the accuracy of the term ‘mitochondrial replacement’. Third, I provide a sustained critique of the purported ‘need’ for genetically-related children. In closing, I call into question the mainly liberal defense of human nuclear genome transfer. I suggest an alternative frame of reference that pays particular attention to issues of social justice. I conclude that our limited resources should be carefully expended in pursuit of the common good, which does not include pandering to acquired desires. (shrink)

À partir de l'étude de la constitution et de l'histoire des archives du parlement de Paris et de leur traitement archivistique, ainsi que des multiples collections de copies et d'extraits dont elles ont été l'objet, cet article propose une réflexion sur la manière dont ce fonds d'archives, qui allie une exceptionnelle importance matérielle et historique et une particulière complexité, a pu être traité par les archivistes et utilisé par les chercheurs, ainsi que sur les perspectives qu'il peut ouvrir à la (...) recherche. Ces archives du Parlement illustrent en effet toute la gamme des problèmes de conservation, de traitement, de communication au public et d'exploitation et rendent particulièrement manifeste la complémentarité et l'interpénétration nécessaires, voire la confusion, des approches historique et archivistique ; elles démontrent que la connaissance par les chercheurs de l'histoire du fonds d'archives va bien au-delà de la simple pratique archivistique et contribue à la perception de la documentation comme« source» d'histoire. Suddenly, COVID-19 has changed the world and the way people work. Companies had to accelerate something they knew was imminent in the future, but not immediate and extremely humongous. This situation poses a huge challenge for companies to survive and thrive in this complex business environment and for employees, who must adapt to this new way of working. An effective e-leadership, which promotes companies’ adaptability, is needed. This study investigates the existing knowledge on teleworking and e-leadership; and analyzes the supposed (...) challenges. The literature review shows that companies with effective e-leadership can view teleworking as an opportunity. It is advantageous for not only companies’ productivity but also the environment and people who work remotely. However, a traditional or no leadership can result in some risks. Thriving in remote work environments implies that managers must adjust the companies’ structure, making them less hierarchical, and developing new abilities to establish a strong and trustworthy relationship with their employees to maintain their competitiveness, while retaining a genuine concern for their employees’ well-being. Similarly, successful e-leadership must be able to consolidate and lead effective virtual teams to accomplish organizational goals. This study contributes to the literature and leaders during the pandemic. (shrink)

Introducing the Selected Works of Simone Weil Some of Simone Weil's most important thinking was done through the medium of her notebooks. She used them in several inter-related ways. First, she used them to note things she had read and was researching. Far more often, they were workbooks where she worked through her ideas. Many of the ideas in her completed essays can first be found in her notebooks, and thus the notebooks are invaluable for adding context and (...) nuance along with a sense of development to the reading of those later essays. Finally, her notebooks simply contain Weil's aphoristic writing at its best in its most striking presentation. For that reason alone, the last two notebooks, which she wrote while in New York and London in 1942-43, published in French as "La Connaissance surnaturel" have been read as books of great wisdom. This volume also includes her first notebook from the year 1934, not long after her time in the factory and its subject matter reflects this period in her life. (shrink)

Fragments of painted plaster found in the destruction layer of three first floor rooms in the House of Seals and of one first floor room of the House of the Sword had broken from the ceiling. They allow the restoration of the schema in the room of the House of the Sword and of two of the rooms in the House of Seals, the latter in colour. Composed of bands surrounding a quadrangular field, these décorations, evoking carpets stretched on the (...) ceiling, are richer (costly pigments, gold leaf) and more complex (some fifteen motifs) than those in tombs of the same period, which adopted the same « carpet » composition and which borrowed from the same repertoire, often confirmed by the textiles. Since we know of no other ceiling decoration in habitation rooms, it is unwise to contrast the exuberance of these ceilings with the tomb ceilings. The room that could not be restored had moreover a much more perfunctory decoration. (shrink)

Now that stem cell scientists are clamouring for human eggs for cloning-based stem cell research, there is vigorous debate about the ethics of paying women for their eggs. Generally speaking, some claim that women should be paid a fair wage for their reproductive labour or tissues, while others argue against the further commodification of reproductive labour or tissues and worry about voluntariness among potential egg providers. Siding mainly with those who believe that women should be financially compensated for providing eggs (...) for research, the new stem cell guidelines of the International Society for Stem Cell Research (ISSCR) legitimise both reimbursement of direct expenses and financial compensation for many women who supply eggs for research. In this paper, the authors do not attempt to resolve the thorny issue of whether payment for eggs used in human embryonic stem cell research is ethically legitimate. Rather, they want to show specifically that the ISSCR recommended payment practices are deeply flawed and, more generally, that all payment schemes that aim to avoid undue inducement of women risk the global exploitation of economically disadvantaged women. Most philosophers adopt an etiological conception of functions, but not one that uniformly explains the functions attributed to material entities irrespective of whether they are natural or man-made. Here, I investigate the widespread idea that a combination of the two current etiological theories, SEL and INT, can offer a satisfactory account of the proper functions of both organisms and artifacts.. Making explicit what a realist theory of function supposes, I first show that SEL offers a realist theory of biological functions (...) in which these are objective properties of a peculiar sort. I argue next that an artifact function demonstrates the same objective nature as a biological function when it is accounted for by SEL, but not when it is accounted for by INT. I explain why a dual theory of artifact functions admitting both INT and SEL functions is to be dismissed. I establish that neither INT nor SEL alone can account for all artifact functions. Drawing the conclusion that we need a new etiological theory of function, I show how one can overcome the apparent inevitability of INT for some artifact functions. Finally, I outline a new etiological theory of functions that applies equally to biological entities and to artifacts. (shrink)

_Gravity and Grace_ shows Weil's religious thoughts and ideas, drawn from many sources - Christian, Jewish, Indian, Greek and Hindu - and focusing on suffering and redemption. It brings the reader face to face with the profoundest levels of existence as Weil explores the relationship of the human condition to the realm of the transcendent.

We need to distinguish two sorts of natural kinds, scientific and common NKs, because the notion of NK, which has to satisfy demands at three different levels—ontological, semantic and epistemological—, is subject to two incompatible sets of constraints. In order to prove this, I focus on the much-discussed case of jade. In the first part of the paper, I show that the current accounts are unsatisfactory because they are inconsistent. In the process, I explain why LaPorte’s analysis of “jade” as (...) a vernacular NK-term with an open-texture meaning does not offer a way out. Using a reductio ad absurdum argument, I conclude that according to the main tenets of NK-term theories, today’s “jade” has to be an NK-term, and jade thereby an NK. In the second part of the paper, I argue for this conclusion in a positive manner. First, I present a series of thought experiments demonstrating that today’s “jade” has the specific features of an NK-term. Then, I show that the kind that we presently call “jade” exhibits the typical ontological and epistemological features of an NK. More generally, I expound on why common NKs are more than mere classes, and why categories such as “jade” are useful in many inferences and explanations. (shrink)

We outline a number of ethical objections to genetic technologies aimed at enhancing human capacities and traits. We then argue that, despite the persuasiveness of some of these objections, they are insufficient to stop the development and use of genetic enhancement technologies. We contend that the inevitability of the technologies results from a particular guiding worldview of humans as masters of the human evolutionary future, and conclude that recognising this worldview points to new directions for ethical thinking about genetic enhancement (...) technologies. This, she elaborates, would be "the transcendental of every resistance, whatever kind it be: resistance to power, to the state of things, to history; resistance to destruction, to death, to war; resistance to stupidity, to peace, to bare life.".

Simone Weil's Leçons de Philosophie are derived from a course she taught at the lyce;e for girls at Roanne in 1933-4. Anne Reynaud-Gue;rithault was a pupil in the class; her notes are not a verbatim record but are a very full and, as far as one can judge, faithful rendering, often catching the unmistakable tone of Simone Weil's voice as well as the force and the directness of her thought. The lectures form a good general introduction to philosophy, (...) ranging widely over problems about perception, mind, language, reasoning and problems in moral and political philosophy too. Her method of presentation is a characteristic combination of abstract argument, personal experience and literary or historical reference. Peter Winch points out in his introduction to the book some of the more systematic connections in her philosophical work (and between this philosophical work and her other concerns), and makes a number of suggestive comparisons between Simone Weil and Wittgenstein. The translation is by Hugh Price from the Plon edition of 1959. Dr Price has added some notes to explain references in the text that might be unfamiliar to English speaking students beginning philosophy. (shrink)

Or, la recherche de « l’ordre parfait » à laquelle s’adonnaient les ritualistes a suscité des débats infinis et n’a pu aboutir à construire un édifice aussi solide que ces derniers l’auraient souhaité. Pour l’anthropologue Philippe Descola, (...) ce mélange de fascination pour un système quasi totalitaire et d’incapacité à se mettre d’accord sur sa physionomie réelle caractérise l’ontologie analogiste qui fut celle de la Chine à l’époque où ces traités ont été rédigés (la fin de la période des Royaumes Combattants). C’est la première cause, d’ordre logique, que l’on peut trouver à la fragilité d’un système décrit par Yuri Pines comme « the Universal Panacea ». La deuxième cause est plutôt d’ordre psychologique. Elle trouve sa source dans le doute et l’anxiété provoqués par la pression qu’exerce sur les sujets l’injonction de recréer en soi un ordre idéal et toujours déjà perdu. Cette dernière partie s’appuie sur les travaux récents de deux auteurs, Mark Csikzentmihalyi et Michael David Kaulana Ing, lesquels montrent, à partir d’une analyse détaillée de deux ouvrages normatifs : le Wuxing 五行 (Les Cinq types d’actions vertueuses) et le Liji 禮記 (Livre des rites), comment furent abordées les questions de la faillite du rituel et de la faillibilité humaine, indiquant ainsi la voie vers une sortie possible du fantasme de l’ordre parfait. We study definable sets and functions in such groups, and relate them to the quasi-o-minimal groups introduced in Belegradek (...) et al. . Main results: An essentially periodic group G is abelian; if G is discrete, then definable functions in one variable are ultimately piecewise linear. A work first published in English in 1951, _Waiting on God _forms the best possible introduction to the work of Simone Weil, for it brings us into direct contact with this amazing personality, at once so pure, so ardent, so utterly sincere, yet normally so reserved that only her closest friends guessed the secrets of her inner life. The first part of the book concerns her letters written to the Reverend Father Perrin, O.P., who befriended her at Marseilles and, (...) the only priest she knew, became her intimate friend. The primary objective of The Health Care Ethics Con sultant is to focus attention on an immediate practical problem: the role and responsibilities, the education and training, and the certification and accreditation of health care ethics consultants. The principal questions addressed in this book include: Who should be considered health care ethics consultants? Whom should they advise? What should be their responsi bilities and what kind of training should they have? Should there be some kind of accreditation or certification program (...) to ensure that those who call themselves ethics consultants are in fact qualified to advise, consult, research, and write in health care ethics? The distinguished authors ofthese articles are persons with diverse backgrounds, interests, presumptions, and val ues. Not surprisingly, therefore, diverse responses have emerged to the questions posed. Though the book's chapters are individually authored, they are informed by the group discussions that went on during active workshop sessions, and by knowledge of the contributions of others. All of the chapters meaningfully represent their consensus. This is not to say that there were no disagreements regarding specific details, but rather that there were no fundamental objections on the book's basic content among a panel of authors who share basic premises regarding the role, responsibilities, education, and certifica tion of health care ethics consultants. In January 2008, the Human Fertilisation and Embryology Authority issued two 1-year licenses for cytoplasmic hybrid embryo research. This article situates the HFEA's decision in its wider scientific and political context in which, until quite recently, the debate about human embryonic stem cell research has focused narrowly on the moral status of the developing human embryo. Next, ethical arguments against crossing species boundaries with humans are canvassed. Finally, a new argument about the risks of harm to women egg providers resulting (...) from research involving the creation of humanesque cytoplasmic hybrid embryos is elaborated. Taken together these ethical concerns about the moral status of the human embryo, about the ethics of crossing species boundaries with humans, and about the potential harms to women, provide good reason to eschew humanesque cytoplasmic hybrid embryo research in favor of less ethically controversial means to the laudable end of successful regenerative medicine.
