Aproximaciones a la escuela francesa de epistemología Los problemas que dominan a la epistemología pueden contextualizarse históricamente como una forma de racionalidad filosófica. La filosofía se ha presentado a lo largo de la historia como un discurso en el que sus diversos componentes (metafísica, ontología, gnoseología, ética, lógica, etc.) se mostraron unidos en el molde de la ?unidad del saber?. En este marco unitario alguna de las formas del saber filosófico detenta usualmente una posición dominante. El énfasis colocado en la (...) unidad del saber filosófico, o en ?la unidad del pensamiento humano?, es una herencia que el pensamiento filosófico recibe de sus raíces mítico-teológicas. Dicha visión se vio sometida, en la historia de la filosofía, a un proceso de secularización por el cual la instancia dominante pasó de la teología a la metafísica y de ésta a la teoría del conocimiento. Entre los siglos XIX y XX, este proceso atestiguó un cambio ulterior, colocando a la epistemología como instancia dominante de la racionalidad filosófica. La sucesión debe verse como una consecuencia de la funcionalización social de los dispositivos de creencias (ideología), lo que provoca que los mismos se conviertan, en determinado momento, en un obstáculo para la producción de nuevos conocimientos. De esta manera, los nuevos conocimientos, para desarrollarse, se ven forzados a provocar reestructuraciones en el campo filosófico, ya sea mediante el reemplazo de la instancia dominante, la incorporación o creación de nuevas formas de saber filosófico -tal el caso de la epistemología-, o de la marginalización relativa de otras. Se trata de en un proceso complejo (que no es ni lineal, ni biunívoco), en el que cabe no obstante discernir un esquema de la sucesión temporal de las formas filosóficas que dominan la pretendida ?unidad del pensamiento humano? (filosofía). El que acabamos de describir es un proceso lento de sustitución y reemplazo en el tipo de garantías que se le exige elaborar a la filosofía. Algunos momentos, como el ocaso de las garantías de la fe, acaecido con el surgimiento de la filosofía moderna, podrían parecer a primera vista contrajemplos para esta concepción de la evolución del saber filosófico. Podría creerse, en efecto, que con la constitución de esferas autónomas de discurso (teología, ciencia, filosofía), del discurso filosófico se desgajó en un discurso de una naturaleza diferente: la ciencia. Sin embargo, una mirada más atenta revela un paisaje diferente, puesto que esta transformación estuvo acompañada, primero, por la aparición de una nueva instancia dominante de la unificación del conocimiento filosófico. Se trata de la búsqueda de una nueva clase de garantías, las del origen y el fundamento del conocimiento, es decir, las de la gnoseología o teoría del conocimiento, en el interior de la cual se verificó finalmente un nuevo desplazamiento, con la constitución, a fines del siglo XIX y principios del siglo XX, de la ?filosofía de la ciencia? o epistemología. Este modelo para la conceptualización del desarrollo del discurso filosófico tiene la ventaja de permitirnos pensar la relación que la epistemología guarda con la instancia de saber filosófico dominante en el seno de la cual se desarrolla: la de la gnoseología. A partir de las relaciones que la epistemología guarda con la temática de las garantías del conocimiento podemos apresar, en un esquema heurístico que será complejizado de diversos modos en este libro, la diferencia entre las tesis características de la epistemología anglosajona y de la epistemología francesa. De acuerdo con en este esquema heurístico, el rasgo más característico de la epistemología anglosajona es su sujeción, en la mayor parte de su desarrollo, a la teoría del conocimiento, lo que se revela en la persistencia de algunos aspectos de la filosofía de la representación y en la reproducción de la oposición idealista entre sujeto y objeto como dos polos cuya armonía debería establecerse, filosóficamente, en términos de la verdad. En su lugar, la epistemología francesa se propuso el estudio de los mecanismos de producción de los conocimientos. La epistemología, desde esta perspectiva, ya no fue vista primordialmente como el estudio de los fundamentos del conocimiento científico, sino como la teoría de las condiciones y las formas de la práctica científica y la historia de esta práctica, tal como aparece en las distintas ciencias concretas. Expresado de otra manera, el contraste se podría establecer mediante la observación de que mientras los anglosajones hacen filosofía de la ciencia como una extensión de la lógica, los franceses la hacen como una extensión de la historia de la ciencia, es decir, encontrando en la historia el laboratorio del epistemólogo. Ahora bien, según veremos, el campo de la epistemología francesa ha cobijado una buena cantidad de debates que tienen que ver primordialmente con dos tendencias en tensión: la que enfatiza la autonomía de lo epistemológico y aquella que destaca la determinación social del pensamiento. Los trabajos de este libro esperan problematizar este y otros ejes, explorando las perspectivas de los ?clásicos? de la escuela francesa en epistemología (Bachelard, Canguilhem, Althusser, Foucault, etc.), las relaciones entre los mismos y los diálogos que cabe establecer entre estos y otras corrientes de pensamiento. Preserving dignity during the dying process requires reviewing the roles of those involved in the treatment, care methods and decision-making. This article examines the participation and responsibility assigned to nurses regarding decision-making in the final stages of life, as laid out in the Rights to and Guarantee of Dignity for the Individual During the Process of Death Act. This text has been analysed on the levels of socio-cultural practice and discourse practice, using the critical discourse analysis methodology. The results show (...) that, although the law is another result of the social trend of patient empowerment, the responsibility of the nurses is not recognised, and they are left out of the decision-making process in the final stages of life. Based on published works and unpublished materials, this article analyses how cybernetics was received by two Spanish thinkers exiled in Mexico: José Gaos (1900–1969) and Eduardo Nicol (1907–1990). This reception is particularly intriguing especially when considering the substantial presence and social impact that Norbert Wiener had in Mexican society because of his friendship with Arturo Rosenblueth. Gaos and Nicol are the first philosophers to develop a complex and original diagnosis of cybernetics in Mexico. It will be shown how the exiled (...) thinkers take on the philosophical implications of this science in the light of their respective theoretical projects, and finally, it will be defended how the critical perspective they develop is particularly significant for Mexico’s political and academic context since it illuminates some negative aspects of cybernetics that Wiener did not foresee and that had not been reported there until then. En este artículo se presentan las reflexiones epistemológicas del filósofo Francisco Fernández Buey (1943-2012), las cuales, han estado continuamente presentes en la obra del autor al menos desde la publicación en 1991 de La ilusión del método, y culminan en su obra póstuma Para la tercera cultura (2013) en una apuesta por la complementariedad entre ciencias positivas y reflexión humanística. Partiendo de un marxismo heterodoxo tanto en el plano ético-político como en el epistemológico, Fernández Buey apuesta por una idea de (...) ciencia alejada del positivismo, a la vez que critica las filosofías contrarias a aquella en la medida en que la consideran como un conocimiento meramente reductor de una realidad que no puede ser aprehendida por la ciencia. Desde el concepto de dialéctica de Manuel Sacristán; el reconocimiento a la figura de Einstein como ejemplo de científico que no renuncia a otros modos de conocimiento; y la reflexión sobre la filosofía de la ciencia en la segunda mitad del siglo XX, el autor nos muestra la necesidad de un diálogo entre cultivadores de la ciencia y las humanidades para afrontar los desafíos del siglo XXI. Es mi intención como Editor recién estrenado de los Anales de la Cátedra Francisco Suárez hacer lo posible para que la revista siga siendo un foro de referencia en la reflexión filosófica sobre los problemas que plantea la organización política de la convivencia social. Han sido precisamente esa determinación y ese criterio los que han inspirado la elección del tema al que está dedicada la Sección Monográfica de este número: el populismo.Hasta hace relativamente poco, el populismo parecía un fenómeno singular (...) hasta la extravagancia, geográficamente remoto e ideológicamente tan extremo que lo normal era decretar su irrelevancia práctica. Sin embargo, tras la gran recesión iniciada en 2008, hemos asistido a una asombrosa irrupción populista. El populismo se ha manifestado de un modo especialmente intenso allí donde, en cierto sentido, era endémico; se ha extendido, con mayor o menor ímpetu y con distintas máscaras, por todos los rincones de Europa, hasta poner en peligro la continuidad del proyecto de integración europeo; y, como colofón, ha terminado afectando a países teóricamente vacunados frente al virus populista y considerados auténticas luminarias democráticas, como es el caso de los Estados Unidos y de Gran Bretaña, que han terminado sucumbiendo a los cantos de sirena populistas. Todas esas circunstancias justificaban, por sí solas, una indagación filosófica sobre el fenómeno populista. (shrink)

Foucault plantea que no hay una sola racionalidad desde la que sean pensables todas las dimensiones de la actual complejidad, por el contrario, la comprensión del presente abre el espacio al análisis histórico de las instituciones sociales y de sus procesos, por medio de dispositivos teórico-metodológicos desarrollados por el enfoque divergente del autor, que amplía la reflexión de los procesos de construcción, reconstrucción y modificación de las representaciones y las identidades sociales. Uno de los ejes de análisis es el (...) sentido común, por ello surge la pregunta ¿cómo el sentido común ordena la palabra? y ¿qué hay de amenazante en las palabras de las personas? Aunado, el análisis del discurso saca a la luz el juego de su poder de afirmación de dominios de objetos. Otro eje es el poder, instrumento conceptual para entender, pensar y ordenar el mundo social, a los sujetos y a sus prácticas sociales y culturales. Poder, productor de conocimiento y realidad, que determina las vías por las cuales se construyen las verdades aceptadas en una época determinada. Foucault lo propone como un poder productor, creador de un régimen de verdad que desarrolla un pensamiento sistematizador y racional, lo mismo que creador de subjetividades. (shrink)

Todo lo que compete al ámbito familiar es fundamental para una correcta vertebración social. Debido a ello, es preciso abordar integral e integradoramente los diferentes aspectos de la política familiar; así, desde los fundamentos de la protección familiar y su importancia dentro del conjunto de instrumentos de políticas de articulación social hasta las claves demográficas que explican y condicionan el futuro de España en el campo de la educación, del empleo, de la seguridad social y del diálogo social, merecen un (...) tratamiento adecuado y especializado. La protección social de la familia es, en la actualidad, no sólo oportuna sino también necesaria. Y ello por varias razones: en primer lugar, por su relevancia social e instrumental -la familia es fuente de solidaridad frente a las crisis económicas y crisis de valores-; en segundo lugar, por la alta valoración de ella que revelan todas las encuestas –lo que se interpreta como satisfacción por su concreto funcionamiento interno y como célula que fundamenta nuestro sistema social-; en tercer lugar, por la necesidad del reconocimiento social de la maternidad como garantía de futuro –pues de la maternidad no debieran derivarse efectos negativos para la vida personal de la mujer (ni en calidad, ni en oportunidades), lo que lleva a la necesidad de compatibilizar la esfera laboral y familiar-. Y, por último, por la necesidad de compensación pública de las cargas familiares. Además, no debe obviarse el hecho de que todo ello va asociado a los fuertes cambios que afectan a la familia como la aparición de nuevos problemas que van erosionando la institución familiar. Tales son, entre otros, la feminización de la pobreza, la aparición de familias reconstituidas, el rápido crecimiento del número de hogares de personas solas, el fuerte incremento cuantitativo de familias monoparentales, el aumento de divorcios, la caída de la natalidad y el envejecimiento de la población. Todo ello justifica el empeño investigador y preservador de la familia. En esta línea heurística y axiológica, el objetivo de este libro es ofrecer un panorama completo de los principales aspectos que hoy son considerados más relevantes en el ámbito de la protección de la familia teniendo como meta el que los análisis sectoriales confluyan de forma integradora hacia la consideración de la familia como unidad integral con entidad propia. Why are we still intrigued by Nietzsche? This chapter argues that sustained interest stems from Nietzsche’s challenge to what we might call the ‘staticism’ inherent in our ordinary experience. Staticism can be defined, roughly speaking, as the view that the world is a collection of enduring, re-identifiable objects that change only very gradually and according to determinate laws. The chapter discusses Nietzsche’s rejection of remnants of staticism in Hegel and Schopenhauer (1). It outlines why Nietzsche deems belief in any variant (...) of the staticist picture as problematic (2); and examines his adualistic-dialetheic stance towards, for example, first-person and third-person descriptions in the philosophy of mind (3). The paper gives an overview of primate research and the economic-ethical 'lessons' we can derive from it. In particular, it examines the complex, multi-faceted and partially conflicting nature of (non-) human primates. Our closest living relatives, the chimpanzees and bonobos, apparently walk on two legs: a selfish and a groupish leg. Given evolutionary continuity and gradualism between monkeys, apes and humans, human primates seem to be bipolar apes as well. They, too, tend to display a dual structure: there seems to (...) be a pro-social and a self-interested side to our species and a bipolar tension seems to exist between competition and cooperation respectively between self-interest and the common good. We are apparently at the same time Homines oeconomici and Homines culturali. Our inner ape tries to combine self-interested and common good motives. Based on de Waal's Russian doll model, the essay investigates the evolutionary origins of morality and 'eusociality'. With the help of selected case studies stemming from behavioural sciences/economics, the paper illustrates examples of empathy, altruism, reciprocal fairness, pro-social and other-regarding preferences, inequity aversion and altruistic punishment in (non-)human primates. Beside this selfless and groupish side, the paper also reflects on the self-interest and egoistic nature of (non-)human primates and the behavioural and cognitive differences between monkeys, apes and humans. Presupposition, vagueness, and oddness can lead to some sentences failing to have a clear truth value. The homogeneity property of plural predication with definite descriptions may also create truth-value gaps: The books are written in Dutch is true if all relevant books are in Dutch, false if none of them are, and neither true nor false if, say, half of the books are written in Dutch. We study the projection property of homogeneity by deploying methods of general interest to identify (...) truth-value gaps. Method A consists in collecting both truth judgments and, independently, falsity judgments. The second method, employed in experiment series B and C, is based on one-shot ternary judgments: completely true vs. completely false vs. neither. After a calibration of these methods, we use them to demonstrate that homogeneity projects out of negation, the scope of universal sentences and the scope of non-monotonic quantifiers such as exactly two, to some extent. We assess our results in light of different theoretical approaches to homogeneity—approaches based on presuppositions, scalar implicatures, and something like supervaluations, respectively. We identify free parameters in these theories and assess various variants of them based on our results. Our experimental paradigms may be of broader significance insofar as they can be applied to other phenomena which result in the failure of a sentence to have a definite truth value. (shrink)

This essay addresses one of the central questions in the ongoing debate about just war theory: are soldiers morally responsible for serving in unjust wars? Francisco de Vitoria addressed this question in the sixteenth century using the concepts of invincible and vincible ignorance. He excused soldiers serving in unjust wars, if they did not know the war was unjust and if they did not have the means to overcome their ignorance; if they had the means, they were morally culpable. In (...) modern just war theory, ignorance is still used both to blame and excuse military service in unjust wars. This essay identifies ten different ways that scholars have used ignorance to argue about the moral responsibilities of soldiers. It then applies the different meanings of ignorance to soldiers serving in Western nations and, using Vitoria’s means tests, evaluates if modern soldiers do indeed have the means to overcome their ignorance. Since many soldiers do have the means, invincible ignorance should no longer be used as an excuse for their service in unjust wars; furthermore, soldiers may, in fact, be morally culpable for serving in them. This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

This essay confronts Ray Brassier’s vindication of nihilism with other two important but frequently underexamined philosophical attempts to overcome nihilism: Hans Jonas’ and Keiji Nishitani’s. By putting these different takes on nihilism into dialogue, it explores some blind spots in Brassier’s position, as well as some of the practical consequences, for our current planetary situation, of undertaking a radical divorce between the normative and the natural that results from his radical nihilism. The article opts for a more moderate acceptance and (...) eventual self-overcoming of nihilism, according to which, even if natural entities are indifferent to human reasons and meanings, this does not entail that nature is bereft of a human-independent normative dimension. In other words, the essay argues that care must be taken not to confuse criticisms of an anthropocentric conception of reasons and meanings with the belief that meaning is completely absent from the natural world. Thus, the central contention of the article is that, given our current climate and ecological catastrophe, one of the most pressing tasks of contemporary philosophy is to understand normativity in non-anthropocentric ways, so that humans are no longer considered as the only entities that respond to normativity. Such an attitude conceives humans as estranged normative creatures amidst a meaningless, indifferent natural world, toward which they would have no ethical responsibilities. The essay finishes by suggesting ways in which to develop an account that does not fall into this ethical vacuum. (shrink)

Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

Whether or not conscious recollection in autobiographical memory is affected in schizophrenia is unknown. The aim of this study was to address this issue using an experiential approach. An autobiographical memory enquiry was used in combination with the Remember/Know procedure. Twenty-two patients with schizophrenia and 22 normal subjects were asked to recall specific autobiographical memories from four lifetime periods and to indicate the subjective states of awareness associated with the recall of what happened, when and where. They gave Remember, Know (...) or Guess responses according to whether they recalled these aspects of the event on the basis of conscious recollection, simply knowing, or guessing. Results showed that the frequency and consistency of Remember responses was significantly lower in patients than in comparison subjects. In contrast, the frequency of Know responses was not significantly different, whereas the frequency of patients’ Guess responses was significantly enhanced. It is concluded that the frequency and consistency of conscious recollection in autobiographical memory is reduced in patients with schizophrenia. (shrink)

Si observamos con detenimiento la realidad, veremos que no hay efecto sin fin, de modo que la subordinación de todos los agentes se lleva a cabo en función de los fines para los que están dispuestos, pues todo lo que se realiza, se realiza en vista de un fin. Sin embargo, el materialismo racionalista, empirista e idealista, sólo acepta que hay un bien útil o deleitable y rechaza el bien honesto y al negar la finalidad en la que lo imperfecto (...) se subordina a lo perfecto, no sólo se excluye a Dios, sino que, una vez que una persona muere, no hay más que la descomposición del cuerpo quedando descartada la trascendencia. Por otra parte, la negación del principio de finalidad también afecta el primer principio práctico que es la sindéresis con lo que se compromete el orden moral. Esa es la razón por la que vemos importante recuperar el pensamiento de santo Tomás de Aquino y algunas de sus implicaciones en torno al principio de finalidad, ya que, al presentar la universalidad, evidencia e importancia del principio de finalidad, santo Tomás demuestra la apertura del hombre a la trascendencia y el orden moral que se requiere para alcanzarla. The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). In recent years, there has been increasing concern about unethical conduct within corporate business, not least because of the scandalous behavior of former chief executives at top blue chip companies such as Enron, Worldcom, Parmalat, and Volkswagen. These scandals have not only threatened the privileged position of senior corporate employees but also the solvency of the companies they manage and lead. The high profile cases of corporate crime and corruption that occurred in the early 2000s together with the 2008 Wall (...) Street bailouts and the growth in criminal prosecutions since have raised the profile of business ethics to an unprecedented level. Greater public sensitivity toward and awareness about the unlawful and immoral conduct of firms in the United States and elsewhere, has created demand for organizations to become more accountable and socially responsible and prompted greater regulatory scrutiny. It has also served to highlight the embryonic and delimited state of research and scholarship on business ethics, where the focus has tended to remain on leadership. A neglected, though important, line of ethical enquiry concerns followership. Corporate wrongdoing would be less formidable and extensive if it was not aided and abetted. Two key questions arise. First, what prompts followers to support rather than oppose bad leaders? Second, what can be done to stem or at least curtail their allegiance to bad leaders? (shrink)

Conceptual engineering is the method for assessing and improving our concepts. Some have recently claimed that the implementation of such method in the form of ameliorative projects is truth-driven and should thus be epistemically constrained, ultimately at least (Simion 2018; cf. Podosky 2018). This paper challenges that claim on the assumption of a social constructionist analysis of ideologies, and provides an alternative, pragmatic and cognitive framework for determining the legitimacy of ameliorative conceptual projects overall. The upshot is that one should (...) not ameliorate for the sake of truth or knowledge, in the case of ideologies—at least, not primarily. (shrink)

En su obra La rebelión de los genes, Manuel Zapata Olivella plantea una teoría del mestizaje en la que se concilia este concepto con la diversidad y la alteridad. El mestizaje no implica exclusión de la otredad ni eliminación de la diversidad. La diversidad no es subsumida en una sola identidad y la otredad no es una perspectiva ajena al sí mismo, sino constitutiva de su idiosincrasia. El otro es parte del sí mismo y el reconocimiento de tal (...) situación constituye un proceso desalienador y descolonizador. Para explorar este planteamiento, en primer lugar, examinamos las concepciones de colonialismo y alienación, teniendo como eje articulador la categoría de idiosincrasia. Seguidamente, examinamos la relación entre diversidad y mestizaje en la teoría de Zapata Olivella. Luego, analizamos la relación entre su concepto de mestizaje y la alteridad. Finalmente, estudiamos el horizonte normativo de la descolonización y la desalienación. (shrink)

On its ‘broad-spectrum’ version, it is expected to be appropriately applicable to any of our representation-involving cognitive activities, with major consequences for our whole cognitive life. This paper is about the theoretical foundations of conceptual engineering thus characterised. With a view to ensuring the actionability of conceptual engineering as a broad-spectrum method, it addresses the issue of how best to construe the subject matter of conceptual engineering and successively (...) defends the theses that conceptual engineering should be: (i) About concepts, (ii) psychologically theorised, (iii) as multiply realised functional kinds. Thereby, I claim to theoretically secure and justify the maximum scope, flexibility, and impact for the method of conceptual engineering on our representational devices in our whole cognitive life—in other words, a broad-spectrum version of conceptual engineering. El problema de la exclusión social –situación de quienes encuentran cerrado el acceso a los bienes y servicios que permiten un básico desarrollo de la personalidad– constituye un desafío para la legitimidad del sistema social y las normas penales. Principalmente porque ello supone que en una misma sociedad hay individuos con estatus de persona –ciudadanos “normales”, incluidos– y otros que, por estar privados de los derechos asociados al estatus, están total o parcialmente excluidos del mismo. De cara a evitar su (...) instrumentalización penal se propone, en los delitos más conectados con la noción de ciudadanía que con la de dignidad, la atenuación o exclusión de la pena por disminución de la exigibilidad. Si el delito no se explica sólo por déficit de motivación del sujeto, sino también por un déficit de socialización imputable al propio sistema social, lo que tiene lugar es una especie de corresponsabilidad. The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

Partiendo del intenso impacto que está teniendo el big data y el resto de tecnologías conexas en nuestra existencia personal y social, el presente artículo busca, en primer lugar, realizar una aproximación a la naturaleza del conocimiento que los datos masivos generan desde el concepto foucaultiano de saber-poder, como también desentrañar el modo en que dicho conocimiento es utilizado para legitimar decisiones que se toman en la incertidumbre. En segundo lugar, intentará analizar qué novedad supone dicho saber en relación a (...) su más inmediato precedente: la estadística y, por último, tendrá como fin examinar el tipo de poder que surge de dicho saber, en relación especialmente con las ideas, de nuevo en la estela de Michel Foucault, acerca del poder pastoral y la conducción a través de la verdad confesada. The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

William Molyneux was born in Dublin, studied in Trinity College Dublin, and was a founding member of the Dublin Philosophical Society (DPS), Ireland’s counterpart to the Royal Society in London. He was a central figure in the Irish intellectual milieu during the Early Modern period and – along with George Berkeley and Edmund Burke – is one of the best-known thinkers to have come out of that context and out of Irish thought more generally. In 1688, when Molyneux wrote the (...) letter to Locke in which he posed the now famous question about a man born blind made to see, he was an active member of the DPS and was on familiar terms with several other key figures in Irish philosophy at the time. For the most part, Irish thinkers in the seventeenth and eighteenth centuries answered “no” to Molyneux’s question of whether a blind man made to see could distinguish, by sight alone, between a cube and a sphere.
