Peschl, Gloria Bottaro, Martina Hartner-Tiefenthaler & Katharina Rötzer. Upshot: This commentary emphasizes the three levels of a teaching methodology designed to scaffold conceptual autonomy and innovation on the part of graduate students with diverse areas of expertise.

Historically the words representation and symbol have had overlapping meanings, meanings that usually disregard the role played by the interpreter. Peirce’s theory of signs accounts for these meanings and also for the role of the interpreter. His theory draws attention to the static and dynamic nature of signs. Sign interpretation can be viewed as a continuous dynamic and evolving process. The static and dynamic nature of signs helps us understand the teaching–learning activity as a process of interpretation on the part (...) of teacher and students. A large proportion of the total global burden of disease is caused by emergency medical conditions. Emergency care research is essential to improving emergency medicine but this research can raise some distinctive ethical challenges, especially with regard to (1) standard of care and risk–benefit assessment; (2) blurring of the roles of clinician and researcher; (3) enrolment of populations with intersecting vulnerabilities; (4) fair participant selection; (5) quality of consent; and (6) community engagement. Despite the importance of research to improve emergency (...) care in low-income and middle-income countries (LMICs) and the widely acknowledged ethical challenges, very little has been written on the ethics of emergency care research in LMICs. This paper examines the ethical and regulatory challenges to conducting emergency care research with human participants in LMICs. We outline key challenges, present potential solutions or frameworks for addressing these challenges, and identify gaps. Despite the ethical and regulatory challenges, conducting high-quality, ethical emergency care research in LMICs is possible and it is essential for global health. (shrink)

Nancy Jecker’s essay Nothing to be Ashamed of: Sex Robots for Older Adults with Disabilities 1 presents a provocative application of the capabilities approach. Her ethical argument for providing access to sex robots for older adults with disabilities proceeds in five parts: 1. Older adults frequently suffer disabilities that impair sexual functioning. 2. The ability to function sexually is linked to central human capabilities, including: the ability to generate a personally meaningful life narrative; be physically, mentally and emotionally healthy; experience (...) bodily integrity; feel and express a range of human emotions; affiliate deeply with others; and reflect on and choose a plan for their life. 3. Society should take reasonable steps to support these human capabilities at a minimal threshold as part of a broader duty to respect human dignity. 4. Providing access to sex robots comprises part of reasonable efforts to support the six capabilities at a minimal threshold. 5. Therefore, society ought to make reasonable efforts to ensure access to sex robots for older adults with disabilities that impair sexual functioning. I am sympathetic to this line of reasoning, having proposed a series of legal reforms that would facilitate sexual expression among older adults with cognitive impairments as well.2 3 …. (shrink)

This Article uses age as an entry point for examining how temporal and methodological issues in egalitarianism make substantive equality an unattractive goal for vulnerability theory. Instead, vulnerability theory should adopt a continuous doctrine of sufficiency, which is a better fit with vulnerability theory’s underlying aims and rhetoric. Instead of evaluating what individuals have in relation to others, sufficiency refocuses the inquiry on whether we have enough throughout the lifecourse. The statue and the lump of clay that constitutes it fail to share all of their kind and modal properties. Therefore, by Leibniz’s Law, the statue is not the lump. Question: What grounds the kind and modal differences between the statue and the lump? In virtue of what is it that the lump of clay, but not the statue, can survive being smashed? This is the grounding problem. Now a number of solutions to the grounding problem require that we substantially (...) revise our view of reality. In this paper, I provide a solution to this problem that does not require such a revision. I then show how my solution to the grounding problem can solve a related problem and answer a related question. The upshot is that the solution I offer is not only non-revisionary, but also fruitful. In ‘Parental Virtues: A New Way of Thinking about the Morality of Reproductive Actions’ Rosalind McDougall proposes a virtue-based framework to assess the morality of child selection. Applying the virtue-based account to the selection of children with impairments does not lead, according to McDougall, to an unequivocal answer to the morality of selecting impaired children. In ‘Impairment, Flourishing, and the Moral Nature of Parenthood,’ she also applies the virtue-based account to the discussion of child selection, and claims that couples with (...) an impairment are morally justified in selecting a child with the same impairment. This claim, she maintains, reveals that the flourishing of a child should be understood as requiring environment-specific characteristics. I argue that McDougall's argument begs the question. More importantly, it does not do justice to virtue ethics. I also question to what extent a virtue ethics framework can be successfully applied to discussions about the moral permissibility of reproductive actions. (shrink)

Although US and European research has documented improvement in earnings quality associated with corporate governance characteristics, the situation in Latin America is questionable, given the business environment in which firms operate, which is characterized by controlling family ownership and weak legal protection. The purpose of this study is to examine the relation between the internal mechanisms of Corporate Governance and Earnings Management measured by discretionary accrual. We use a sample of listed Latin American non-financial companies from the period 2006–2009. Our (...) results show how in the Latin American context the role of external directors is limited and that Boards which meet more frequently take a more active position in the monitoring of insiders, so showing a lower use of manipulative practices. In addition, we find a non-linear relation between insider ownership and discretionary accruals, also pointing to the fact that ownership concentration may be a manipulative practices constrictor mechanism only when the ownership of main shareholders is moderate. The findings have important policy implications since this is, to the best of our knowledge, the first study to analyze the relation between the effectiveness of the government and the earnings management behavior. As policy implications, we document how when a country implements controls aimed at reducing corruption, strengthening the rule of law or improving the effectiveness of government, this leads to a reduction in firm earnings management. The concept of living labor in Marx’s Grundrisse represents the key notion that conceptually ties his early theory of alienation with the drafts of Capital of the 1860s. Through a critique of the formalism that opened space for Marx’s economic writings, I explore living labor, not only as alienated within the capital–laborrelation, but as an absolute, metahistorical exteriority. Furthermore, the interpretive writings of Enrique Dussel on the Grundrisse are contrasted with the reading ofMichael Hardt and Antonio Negri to show how (...) living labor can be understood as ethical excess within the framework of biopolitical production. El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

In this essay we argue that attempts to justify the value of the liberal arts in narrowly instrumental ways are a mistake, one that is likely to miss the central importance of a liberal arts education. Of course, we do not claim here that such instrumental justifications are completely wrong, but that in so far as liberal education is defended primarily in terms of enhanced practical outcomes (better paying jobs, saleable professional skills, higher scores on graduate and professional admissions exams, (...) and so on) advocates will fail to articulate one of the most important reasons for study in the liberal arts. We will characterizeliberal education as a practice of reflecting on, discussing, and evaluating the question of what sort of lives I we should lead. Based on this, we then offer whatwe believe is a more promising, more consistent way of justifying liberal education. (shrink)

We study the origin of quantum probabilities as arising from non-Boolean propositional-operational structures. We apply the method developed by Cox to non distributive lattices and develop an alternative formulation of non-Kolmogorovian probability measures for quantum mechanics. By generalizing the method presented in previous works, we outline a general framework for the deduction of probabilities in general propositional structures represented by lattices (including the non-distributive case).

Divine Simplicity has it that God is absolutely simple. God exhibits no metaphysical complexity; he has neither proper parts nor distinct intrinsic properties. Recently, Jeffrey Brower has put forward an account of divine simplicity that has it that God is the truthmaker for all intrinsic essential predications about him. This allows Brower to preserve the intuitive thought that God is not a property but a concrete being. Truthmaker says that things, broadly construed, are the ontological grounds of truth and, therefore, that things make truths true. Recently, there have been a number of arguments purporting to show that if one embraces Truthmaker, then one ought to embrace Truthmaker Maximalism—the view that all non-analytic propositions have truthmakers. But then if one embraces Truthmaker, one ought to think that negative existentials have truthmakers. I argue that this is false. I begin by arguing that recent attempts by Ross Cameron and (...) Jonathan Schaffer to provide negative existentials with truthmakers fail. I then argue that the conditional—if one embraces Truthmaker, the one ought to embrace Truthmaker Maximalism—is false by considering worlds where very little, if anything at all, exists. The conclusion is that thinking that negative existentials do not have truthmakers, and therefore rejecting Truthmaker Maximalism, need not worry Truthmaker embracers. (shrink)

While most approaches to the semantics of tense have attempted to regiment tense away in a tenseless metalanguage, a good case can be made that this is not without cost. On the other hand, it is pretty clear that attempts to treat tense in a tensed metalanguage introduce serious complications. It is probably not so important which of these positions is correct at this point, as it is that we understand the costs of the respective positions. Perhaps, by having a (...) firm enough grasp on both approaches we afford ourselves a deeper insight into the nature of tense itself. (shrink)

In this paper, I advance a lesser known counterfactual principle of grounding in a new kind of way by appealing to properties and the work they do. I then show that this new way of arguing for this principle is superior to another way, describe some of the work this principle can do, defend my use of this principle, and conclude with remarks on why principles like it are needed.

Through a close examination of philosopher Leopoldo Zea's historicist phenomenology, Mario Saenz offers fresh insights into the role of Mexican intellectuals in the creation of a Latin American "philosophy of liberation". While this philosophy of liberation has been widely recognized as the most intellectual political ideology to emerge from Latin America this century, few scholars have specifically explored the Mexican roots of this intellectual movement. Saenz redresses this imbalance by placing Zea and his contemporary intellectuals firmly within the context of (...) post-revolutionary Mexico, a political and social landscape that fostered criticisms of colonial and neo-colonial structures of dependence. Part of what makes working with modals such a tricky business is that apparent modal forms are deployed in all sorts of ways in language. In this paper I explore an interesting example of an apparent modal—the Blofeld case—which was introduced by Gilles and von Fintel as part of their argument against context of assessment accounts of epistemic modals. I argue that the example is subtle, and that the apparent modal may not be an epistemic modal at all—it could be (...) a scalar modifier that merges or “incorporates” with the matrix verb, weakening the meaning of the matrix verb. If apparent modals are used as scalar modifiers and are subject to movement and incorporation, then the surface language of modality may be throwing us some crafty head fakes. Caution is advised. Bentham's critical statements on the Declaration of Human Rights of the French revolutionaries are supposed to be merely of historical value, as directed against a dated formulation. Against this, it is argued that the essential point of Bentham's argument is valid against any intuitivist interpretation of human rights (that is, against interpretations that take human rights as ultimate, absolute data) but are agreeable with an interpretation that takes Human Rights to be preferred lines of action that are normally conducive to (...) the greatest general hapiness. The relationship between Enlightenment and progress in David Hume is presented and discussed in the context of the Scottish Enlightenment. It is asserted that Hume’s thoughts on progress, although similar to those exposed by some of his contemporaries, are characterized by a sober conception of human action on history. Hume’s political and social philosophy proposes an interesting critical philosophy of history and progress, avoiding the undesirable extremes of naïveté and pessimism.

Standard approaches to ontological simplicity focus either on the number of things or types a theory posits or on the number of fundamental things or types a theory posits. In this paper, I suggest a ground-theoretic approach that focuses on the number of something else. After getting clear on what this approach amounts to, I motivate it, defend it, and complete it.

Whilst there are not yet laws specifically relating to nanotechnology and its products in any country, the technology and its products are not unregulated. Regulatory frameworks created for conventional technologies and products will be expected to apply to nanotechnology and its products. For example, new medicines are regulated in Australia by the Therapeutic Goods Administration. If a new medicine incorporates nanotechnology, then it should still be regulated as a medicine. However, whether the expectation that pre-existing regulatory frameworks will apply is (...) correct and, if so, whether the application of such frameworks is adequate are important issues to be answered. This paper considers these questions, drawing on lessons learnt from significant regulatory reviews undertaken in the United Kingdom, United States and Australia. (shrink)

One of the most gripping intuitions that people have about time is that it, in some sense “flows.” This sense of flow has been articulated in a number of ways, ranging from us moving into the future or the future rushing towards us, and there has been no shortage of metaphors and descriptions to characterize this sense of passage. Despite the many forms of the metaphor and its widespread occurrence, it has been argued that there is a deep conceptual problem (...) in any assumption that time “passes” or “flows.” The idea expressed by the metaphor is supposed to be incoherent. But is the idea expressed by this metaphor really incoherent? In this essay I will argue that, on one understanding of the metaphor, it is not. I’ll argue that the metaphor can be unpacked as representing three features of temporal experience, and while these features together appear to lead to paradox, I will argue that correctly handled they do not. In Necessary Existence, Pruss and Rasmussen give an argument for a necessary being employing a modest causal principle. Here I note that, when applied to highly general and fundamental matters, the principle may well be false (or at least not so obvious).

The “phenomenology of existence” is one of the contemporary currents of philosophy which have developed taking existence as its central concern. The purpose of this article is to present my conception of this fundamental field of phenomenological research. In order to do this, I will analyze phenomenology of existence in the double sense of the genitive or better as a bidirectional phenomenological- existential movement; that is to say, on the one hand, I will explore the sense and scope of phenomenology (...) for existence and, on the other hand, the meaning of existence for the phenomenological existential movement. With the aim of describing this twofold dynamics, I will begin by clarifying certain concepts of the Husserlian method that have frequently either been ignored or misinterpreted and, therefore, have impeded us from understanding the meaning of what the founder of phenomenology called “personal existence.” After this elucidation that takes place at the static level of phenomenology, I will apply some key concepts of genetic phenomenology to existence in order to develop my own account of the existential phenomenology. Given that Maurice Merleau-Ponty (1908–1961) was a pioneer in the study of the most representative Husserlian texts dealing with the major issues of genetic phenomenology–such as time, space, lived body, intersubjectivity and lifeworld—, I will draw from his philosophy to open a dialogue with María Zambrano (1904–1991), as an example of the possibilities offered by a—comparative—phenomenology for the study of existential problems, specifically for the development of a phenomenology of sensing and being sensed that goes beyond of the paradigm of representation.
