  4. The Philosophers' Brief in Support of Happy's Appeal.Gary Comstock, Sue Donaldson, Andrew Fenton, Tyler M. John, L. Syd M. Johnson, Robert C. Jones, Will Kymlicka, Letitia M. Meynell, Nathan Nobis, David M. Peña-Guzmán, James Rocha, Bernard Rollin, Jeff Sebo & Adam Shriver - 2021 - New York State Appellate Court.
We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

Erasmianism: idea and reality.M. E. H. N. Mout, Heribert Smolinsky & J. Trapman (eds.) - 1997 - New York: Koninklijke Nederlandse Akademie van Wetenschappen.
Paperback. The book treats two general questions: 1. Whether Erasmanism and Erasmian Humanism existed as a recognizable attitude during the sixteenth and early seventeenth centuries; 2. Whether Erasminism represented a definable middle way between the confessional conflicts of these times. How important was Erasmanism in these respects? The treatment of these two questions is geographically limited to those countries where Erasmus himself was active: Italy, The Netherlands, Holy Roman Empire, Switzerland and England.Erasmanism as a concept has hardly been studied before, (...)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...)

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

So I am very familiar with the medical, legal and – most importantly – ethical or moral issues related to HB 481, the so-called “heartbeat bill” that would effectively ban abortion in Georgia. At least hundreds of other philosophy, ethics and law professors in Georgia teach these ethical debates about abortion: they are also, (...)

The book opens with an article on the chronology and life of St. Thomas, which was written originally in 1920 by the well-known Thomistic scholar, Pierre Mandonnet, for the Revue des sciences philosophiques et théologiques. In a critical study, written in 1932 and reproduced here in its German version, Palémon Glorieux challenges Mandonnet's conclusions with regard to Thomas's Quaestiones disputatae, while in another essay, also appearing in this volume, he advances hypotheses and clarifies certain points about Aquinas's treatise, De regimine (...)

Decembr. usi tua felicitate nauigandi; ita belle nobis flauit ab Epiro lenissimus Onchesmites. hunc si cui boles pro tuo uendito.’ The antonomasia, the euphonic sibilance, and the mannered rhythm are all prominent in Cicero's hexameter. The line is a humorously concocted example of affected and Grecizing narrative. But it is also a line which, Atticus is to suppose, would value; presumably therefore it is meant to (...)

Reply to John altick's rejoinder to Graham and Nobis's review of putting humans first by Tibor Machan.Nathan Nobis - 2007 - Journal of Ayn Rand Studies 8 (2):331-339.
In his reply to the Nobis-Graham review of Tibor Machan's book, Putting Humans First, John Altick defends Machan's and Rand's theories of moral rights, specifically as they relate to the rights of non-human animals and non-rational human beings. Nobis and Graham argue that Altick's defense fails and that it would be wrong to eat, wear, and experiment on non-rational—yet conscious and sentient—human beings. Since morally relevant differences between these kinds of humans and animals have not been identified to (...)

By the standard of popular approval, the South African state has no legitimacy, since only whites are enfranchised and blacks are being denationalized. This institutionalized politicization of ethnicity increasingly erodes the efficiency of private and state institutions alike. Enforced ethnic identities without representative leadership undermine proposed liberal arrangements of negotiated power-sharing as well as the government policy of cooptation. In the absence of political democracy, politicized labor relations substitute for restricted mobilization elsewhere. There are three basic responses to this legitimation (...)

Self-management interventions are a heterogeneous group of interventions that are regarded as important tools for the management of chronic diseases. They consist of a broad range of techniques and are available for a large variety of chronic organic as well as mental conditions or illnesses, which are by definition generally chronic. These interventions aim that the individual concerned takes substantial responsibility for managing the symptoms, treatment, and physical and psychosocial consequences associated with having a chronic medical condition, disability or disease. Tom Regan argues that human beings and some non-human animals have moral rights because they are “subjects of lives,” that is, roughly, conscious, sentient beings with an experiential welfare. A prominent critic, Carl Cohen, objects: he argues that only moral agents have rights and so animals, since they are not moral agents, lack rights. An objection to Cohen’s argument is that his theory of rights seems to imply that human beings who are not moral agents have no moral rights, but (...)

    Complexity Results for Modal Dependence Logic.Peter Lohmann & Heribert Vollmer - 2013 - Studia Logica 101 (2):343-366.
Modal dependence logic was introduced recently by Väänänen. It enhances the basic modal language by an operator = (). For propositional variables p 1, . . . , p n , = (p 1, . . . , p n-1, p n ) intuitively states that the value of p n is determined by those of p 1, . . . , p n-1. Sevenster (J. We offer a relatively simple and straightforward argument that each of us ought to be vegan. We don’t defend this position by appealing to ‘animal rights’ or the view that animals and humans are ‘moral equals’. Rather, we argue that animal agriculture causes serious harms to other animals (such as pain, suffering and death) and these harms are morally unjustified or caused for no good reason. This is true for both ‘factory farming’ and smaller, so-called ‘humane’ farms. We argue that (...)

The widespread practice of ethics consultations raises these questions and more: -/- • (...)
