In this paper I examine the counterfactual test for legislative intention as used in Riggs v. Palmer. The distinction between the speaker's meaning approach and the constructive interpretation approach to statutory interpretation, as made by Dworkin in Law's Empire, is explained. I argue that Dworkin underestimates the potential of the counterfactual test in making the speaker's meaning approach more plausible. I also argue that Dworkin's reasons for rejecting the counterfactual test, as proposed in Law's Empire, are either too weak or (...) unsound. A deeper reason for rejecting the counterfactual test as a method for the speaker's meaning approach is proposed in this paper. The difference between the counterfactual test and other tests for legislative intention which seem also to make use of counterfactual conditions in explained. (shrink)

Gillian Brock attempts to reconcile cosmopolitanism with nationalism in Global Justice: A Cosmopolitan Account . She claims that her cosmopolitanism leaves room for legitimate nationalism. I argue that her cosmopolitanism is not only a theory of global justice, but also a general theory of justice, according to which what justice may demand of us is fundamentally global in nature. As such, Brock's cosmopolitanism cannot accommodate nationalism in the overall structure of what justice may demand of us, but has to relegate (...) it to the discretionary space left open after what justice may demand of us globally has been met. This does not amount to much of a reconciliation or a particularly moderate cosmopolitanism, contrary to Brock's claim. More important, I argue, Brock's cosmopolitan theory of justice need not follow from the more fundamental view of moral cosmopolitanism. (shrink)

This article gives an account of what Ronald Dworkin calls ‘the protestant attitude’ towards law. Dworkin’s protestantist claim that the interpretive attitude towards law is to be taken not only by judges, but also by ordinary citizens is explained and defended. The account of Dworkin’s protestantism about law in this article is not based on his more general protestantist view about the interpretation of social practices, but, rather, on the nature of authoritative statements of the law in Dworkin’s theory of (...) law as integrity. Protestantism is thus shown to be an integral part of the theory of law as integrity. It is also argued in this article that protestantism about law can accommodate the idea that legal deliberation is an authoritative and public process while leaving room for a significant role for citizens in the development of law. This work offers a timely philosophical analysis of interrelated normative questions concerning immigration and citizenship in relation to the global context of multiple nation states. This monograph opens with an examination of the aid industry and the claims of leading practitioners that the industry is experiencing a crisis of confidence due to an absence of clear moral guidelines. The college athletics environment within the USA is ethically complex and often controversial. From an academic standpoint, athletes are often viewed as a privileged class receiving undue benefit. Yet closer inspection reveals that student athletes are at risk psychologically, physically, and intellectually in ways that undermine development and flourishing. This reality stands in troubling contrast to the prosocial, virtue-based goals expressed by university mission statements. Given the role of sport in many university business models, college athletics invites scrutiny from a (...) business ethics standpoint. Using a humanistic leadership perspective (Pirson in: Humanistic management: protecting dignity and promoting well-being, Cambridge University Press, Cambridge, 2017), we organize our analysis around three challenges facing the college athletics system: (1) navigating the tension between claiming college athletes are amateurs rather than professionals; (2) defining the ethical edge between winning and winning fairly; and (3) moderating the insatiable drive to win while protecting student athlete well-being. We then articulate three strategies for successfully addressing these challenges: leadership role modeling, putting structural supports in place and holding people accountable. We argue that humanistic leadership and a ‘balanced motivational drive mindset’ (Lawrence and Nohria in: J Bus Ethics 128:383–394, 2002, https://doi.org/10.1007/s10551-014-2090-2 ; Pirson 2017) could help move college athletics from an economistic model toward a more humanistic model that prioritizes the dignity and well-being of its participants, particularly student athletes. In the context of the well-recognized dialogue between faith and film culture, this article considers Ang Lee's award-winning and controversial film, Brokeback Mountain . Against the misinterpretations and ideological rhetoric that coopted the film, it effects a close reading of the narrative, tracing the development of the film's central theme, the constitutive vocation of the human being to give and receive love, an experience touched by human sinfulness and divine grace. After analyzing the film's masterful adaptation of the short story (...) on which it is based, its complex use of metaphorical language and its rich, expressive soundtrack, the article concludes with a consideration of the epilogue of the film as representing a breakthrough of grace and as an expression of the redeeming power of love. In an award-winning essay, Shu-Shan L ee discusses scholarly commentary about obedience to the emperor, focusing on public and hidden records of protest. The thesis of Lee’s essay is that the relationship between authority and subject in imperial Confucianism was built on a conditional obligation of obedience, despite traditional accounts of it as absolute. On his account, the obligation of obedience should be conceived through the rubric of imperial Confucianism as being conditional on fulfillment of reciprocal obligations. As part of (...) my response, I suggest that there is a third way to understand the obligation of obedience through the Confucian lens, which is less transactional than reciprocal obligation, while also providing a plausible alternative to absolute obligation as the correct understanding of imperial Confucian thinking about obedience to the emperor. David Lewis—famously—never tasted vegemite. Did he have any knowledge of what it's like to taste vegemite? Most say 'no'; I say 'yes'. I argue that knowledge of what it’s like varies along a spectrum from more exact to more approximate, and that phenomenal concepts vary along a spectrum in how precisely they characterize what it’s like to undergo their target experiences. This degreed picture contrasts with the standard all-or-nothing picture, where phenomenal concepts and phenomenal knowledge lack any such degreed structure. (...) I motivate the degreed picture by appeal to (1) limits in epistemic abilities such as recognition, imagination, and inference, and (2) the semantics of ‘knows what it’s like’ expressions. I argue that approximate phenomenal knowledge cannot be explained merely via determinable or vague phenomenal concepts. I develop a framework for systematizing approximate knowledge of phenomenal character. And I explain how my view challenges some standard assumptions about the acquisition conditions, requirements for mastery, and referential mechanisms of phenomenal concepts. (shrink)

In this paper, I claim that live uterus donors ought to be considered for the possibility of compensation. I support my claim on the basis of comparable arguments which have already been applied to gamete donation, surrogacy, and other kinds of organ donation. However, I acknowledge that there are specificities associated with uterus donation, which make the issue of incentive and reward a harder ethical case relative to gamete donation, surrogacy, and other kinds of organ donation. Ultimately, I contend that (...) while reimbursement for the costs incurred by live uterus donors should be treated as a necessary ethical minimum, how much further we ought to remunerate uterus donations remains an open question. Both Watts and Beit-Hallahmi are enthusiastic about attachment theory as an important contribution to the psychology of religion, but they raise very different criticisms regarding other aspects of the book. I respond to Beit-Hallahmi by defending my assertion that a scientific approach to psychology of religion need not lead to the conclusion, nor rest on the premise, that the beliefs under study are ontologically false. I argue further that this "veridicality trap" has deep roots in prevailing, deeply mistaken assumptions about (...) how the mind/brain works, and show how an evolutionary approach clearly exposes such reasoning as fallacious and offers a powerful, alternative perspective on the problem. In response to Watts, I defend evolutionary psychology against the charge that it is not sufficiently empirical, and argue that the computational cognitive approach he prefers should be seen as complementary to an evolutionary approach rather than an alternative to it. Enactivism advances an understanding of cognition rooted in the dynamic interaction between an embodied agent and their environment, whilst new mechanism suggests that cognition is explained by uncovering the organised components underlying cognitive capacities. On the face of it, the mechanistic model’s emphasis on localisable and decomposable mechanisms, often neural in nature, runs contrary to the enactivist ethos. Despite appearances, this paper argues that mechanistic explanations of cognition, being neither narrow nor reductive, and compatible with plausible iterations of ideas like (...) emergence and downward causation, are congruent with enactivism. Attention to enactivist ideas, moreover, may serve as a heuristic for mechanistic investigations of cognition. Nevertheless, I show how enactivism and approaches that prioritise mechanistic modelling may diverge in starting assumptions about the nature of cognitive phenomena, such as where the constitutive boundaries of cognition lie. It is increasingly common in cognitive science and philosophy of perception to regard perceptual processing as a probabilistic engine, taking into account uncertainty in computing representations of the distal environment. Models of this kind often postulate probabilistic representations, or what we will call probabilistic states,. These are states that in some sense mark or represent information about the probabilities of distal conditions. It has also been argued that perceptual experience itself in some sense represents uncertainty (Morrison _Analytic Philosophy_ 57 (1): (...) 15 48, 2016 ). In this article, we will first consider three models of sensory activity from perceptual neuroscience, namely signal detection theory (SDT), probabilistic population codes (PPC), and sampling. We will then reflect on the sense in which the probabilistic states introduced in these models are probabilistic representations. To sharpen this discussion, we will compare and contrast these probabilistic states to credences as they are understood in epistemology. We will suggest that probabilistic representation, in an appropriately robust sense, can be understood as a form of analog representation. In the last part of the paper, we apply this to the issue of whether conscious experience represents uncertainty—we will interpret this as the claim that there are phenomenal features of experience that serve as analog probabilistic representations. Individualistic traditions of autonomy have long been critiqued by feminists for their atomistic and asocial presentation of human agents. Relational approaches to autonomy were developed as an alternative to these views. Relational accounts generally capture a more socially informed picture of human agents, and aim to differentiate between social phenomena that are conducive to our agency versus those that pose a hindrance to our agency. In this article, I explore the various relational conceptualizations of autonomy profferred to date. I critically (...) review some of the ongoing internal disputes within the relational autonomy literature, and conclude the article by taking stock of the value of relational autonomy despite these unresolved debates. Harry (bio)Scientists overwhelmingly agree that climate change is anthropogenic, caused by our greenhouse gas emissions.1 Given the evidence that exists, we should be able to convince ourselves to change the everyday behaviors resulting in these emissions. If we hope to save ourselves, other animals, plants, and the environment from a devastating future, then why would we continue to use fossil fuels?The answer here is (...) not an easy one. And yet, the ancient Greek philosopher, Aristotle, provides us with a possible cause. In his most famous work on ethics,2 Aristotle argued that being weak-willed, suffering from what he called, “akrasia,” is the reason we do things that we know we shouldn’t do. It is a condition that results when desire wins over reason. For example, I eat a chocolate bar when I know I should eat a salad because my desire for chocolate wins over what I have reasoned to be best for my health. Simply put, reason might be what distinguishes us from other animals and plants, but it is not always our most powerful faculty. It stands both to experience and to reason, then, that rational decision might not be what is going to get us out of this climate crisis. Then, what is?In this special issue, we hear from five contemporary scholars of the 18th–19th century German philosopher, F.W.J. Schelling, an oft-called “protean thinker” whose prolific, sometimes creative, and diverse works spanned over seventy years. A onetime roommate of Hegel and Hölderlin, Schelling’s works are lesser-known outside specialist circles, and yet one finds that his prescient insights continue to have much to offer. This is especially true vis-à-vis the climate crisis, as Schelling was the first post-Kantian philosopher to take nature seriously. He eschewed the modern, Kantian, and post-Kantian trend to focus on [End Page 1] ipseity, the self, and on what we as humans can rationally know. Instead, he returned to metaphysics and argued for a wholistic conception and experience of life—all life. For Schelling, humans are rational as an expression of nature, rather than as an exception to nature. As John Sallis put it so well as he argued for the Platonic influence in Schelling: “For what Schelling rewrites within the text of modern philosophy is a discourse on nature.”3 Sallis then reminds us that in Schelling’s 1809 text, Philosophical Investigations of the Essence of Human Freedom (“Die Freiheitschrift”), he openly criticizes post-Cartesian philosophy generally for its exclusion of nature; “All modern European philosophy since it began with Descartes has this common defect, that nature does not exist for it and that it lacks a living ground.”4 Schelling’s intention was to resolve the defect, and because of his efforts in this regard, his work has something to say to us about our relationship to the environment.The idea to think about what Schelling can offer us in our current climate crisis is hardly new. In 2014, the North American Schelling Society (NASS), hosted by Bruce Matthews and Bard College, thematized its third international conference on “Schelling in the Anthropocene,” asking scholars to think beyond modern philosophy’s legacy of the human/nature divide and to discuss Schelling’s contribution to the anthropogenic environmental crisis we currently face. Since then, published work on this topic includes: Bruce Matthews’s, “Schelling in the Anthropocene,”5 Christopher Lauer’s, “Confronting the Anthropocene,” 6 and Vincent Lee’s, “Schelling and the Sixth Extinction.”7 Other journals have published special issues on related topics, including McGrath et al. This paper presents a critical appraisal of the recent turn in comparative religious ethics to virtue theory; it argues that the specific aspirations of virtue ethicists to make ethics more contextual, interdisciplinary, and practice-centered has in large measure failed to match the rhetoric. I suggest that the focus on the category of the human and practices associated with self-formation along with a methodology grounded in “analogical imagination” has actually poeticized the subject matter into highly abstract textual studies on normative voices (...) within traditions, largely in isolation from considerations of socio-historical context, political and institutional pressures, and the lived ethics of non-elite moral actors. Moral thinking and communication are critical competencies for confronting social dilemmas in a challenging world. We examined these moral competencies in 70 college students and graduates from Taiwan, the United Kingdom, and the United States. Participants were assessed through semi-structured written interviews, Facebook group discussions, and a questionnaire. In this paper, we describe the similarities and differences across cultural groupings in (1) the social issues of greatest importance to the participants; (2) the factors influencing their approaches to thinking about social (...) issues and communicating with others; and (3) the characteristics of their moral functioning in terms of moral awareness, moral judgment, moral discourse, and moral decision-making. The apparent chasm between two camps in metaphysics, analytic metaphysics and scientific metaphysics, is well recognized. I argue that the relationship between them is not necessarily a rivalry; a division of labour that resembles the relationship between pure mathematics and science is possible. As a case study, I look into the metaphysical underdetermination argument for ontic structural realism, a well‐known position in scientific metaphysics, together with an argument for the position in analytic metaphysics known as ontological nihilism. ABSTRACTIn the Timaeus, Plato explicitly defines time as “the moving image of eternity”. This proposition affirms actually that time reflects the eternal that embodies the rational and lawful principle – namely the logos of proportionality – in the motion and change of visible objects in the universe. In other words,time determines the principle that every mutable being must follow to participate in the rational and nomological order of existence; the absolute logos which is given by God is hence intrinsic to (...) time. This idea of time is echoed by the theories of Augustine and Husserl. Both philosophers inherited some of Plato’s metaphysical views, and each of them developed a distinctive theory of the relations between Being, time, and the absolute logos. In the following essay, I argue for an alternative anthropocentrism that, eschewing failed appeals to traditional moral principle, takes (a) as its point of departure the cognitive, perceptual, emotive, somatic, and epistemic conditions of our existence as members of Homo sapiens, and (b) one feature of our experience of/under these conditions particularly seriously as an avenue toward articulating this alternative, the capacity for aesthetic appreciation. To this end, I will explore, but ultimately reject philosopher Allen Carlson's ecological aesthetics, and I (...) will adopt with modification aspects of the work of Ronnie Hawkins, Val Plumwood, and Donna Haraway. My central claim is that, equipped with a better understanding of our interdependent relationship to/within human and nonhuman nature, an understanding made especially available to those who occupy situations imbued by subjugation, we can come to understand our human-centeredness not as a justification of entitlement, but as an opportunity for critical self-reflection upon those actions which endanger the ecological conditions of human and nonhuman being. I suggest, then, that developing criteria for an aesthetic appreciation ground in such a centeredness can make a vital contribution to a more ecologically defensible moral and political activism. Because many involuntarily childless people have equal interests in benefitting from assisted reproductive technologies like in vitro fertilization as a mode of treatment, we have normative reasons to ensure inclusive access to such interventions for as many of these people as is reasonable and possible. However, the prevailing eligibility criterion for access to assisted reproductive technologies—'infertility'—is inadequate to serve the goal of inclusive access. This is because the prevailing frameworks of infertility, which include medical and social infertility, fail to precisely (...) capture and unify the relevance of certain involuntarily childless experiences as warranting assisted reproductive technology (ART) treatment. I argue that the least we can do for those who have an interest in accessing ARTs is to conceptualize involuntarily childless experiences in dialogue with interactionist and ecological models of disability, to outline a unified and more inclusive eligibility criterion.
