The precipitous and medically contraindicated reduction or “tapering” of opioids for patients with chronic pain due to serious medical conditions has caused needless suffering and, increasingly, suicide. Physicians could be liable for wrongful death based on negligent tapering of opioids.

Workplace exposure to SARS-CoV-2 has sickened workers and, subsequently, their family members. Family members might be able to recover from the employer in a negligence action using “take-home” liability theory.

Physicians’ fear of criminal prosecution for prescribing opioid analgesics is a major reason why many chronic pain patients are having an increasingly difficult time obtaining medically appropriate pain relief. In Ruan v. United States, 142 S. Ct. 2370 (2022), the Supreme Court unanimously vacated two federal convictions under the Controlled Substances Act. The Court held that the government must prove that the defendant knowingly or intentionally acted in an unauthorized manner.

The emerging field of synthetic biology aims to engineer novel biological entities. The envisioned future bio-based economy builds largely on “cell factories”: organisms that have been metabolically engineered to sustainably produce substances for human ends. In this paper, we argue that synthetic biology’s goal of creating efficient production vessels for industrial applications implies a set of ontological assumptions according to which living organisms are machines. Traditionally, a machine is understood as a technological, isolated and controllable production unit consisting of parts. (...) But modified organisms, or hybrids, require us to think beyond the machine paradigm and its associated dichotomies between artificial and natural, organisms and artefacts. We ask: How may we conceptualise hybrids beyond limiting ontological categories? Our main claim is that the hybrids created by synthetic biology should be considered not as machines but as metabolic systems. We shall show how the philosophical account of metabolism can inform an ontology of hybrids that moves beyond what we call the “machine ontology”, considering that metabolism enables thinking beyond the dominant dichotomies and allows us to understand and design lifeforms in a bio-based economy. Thus, the aim of this paper is twofold: first, to develop the philosophical ontology of hybrids, and second, to move synthetic biology beyond the problematically limiting view of hybrids. (shrink)

ABSTRACT I propose a division of the literature on natural kinds into metaphysical worries, semantic worries, and methodological worries. I argue that the latter set of worries, which concern how classification influences scientific practices, should occupy centre stage in philosophy of science discussions about natural kinds. I apply this methodological framework to the problems of classifying chemical species and nanomaterials. I show that classification in nanoscience differs from classification in chemistry because the latter relies heavily on compositional identity, whereas the (...) former must consider additional properties, namely, size, shape, and surface chemistry. Sharply in focus in the United States right now is the disproportionate COVID‐19 infection, hospitalization, and mortality rates of Black, Indigenous, Hispanic, and Pacific Islanders living in the United States in contrast to White people. These COVID‐19 disparities are but one example of how systemic racism filters into health outcomes for many Black, Indigenous, and other People of Color (BIPOC). With these issues front and center, more attention is being given to the ways that White medical professionals contribute to these (...) disparities, including their socialization to ignore or deny inequities. As such, the present study sought to understand how educating White health‐care pre‐professionals about systemic racism might influence their understanding of and responsibility for disrupting White supremacy. Data were drawn from 49 White‐identified nursing students who participated in a mapping project that uncovered instantiations of systemic racism in the United States. Participant written reflections were analyzed using thematic analysis. Findings revealed that mapping projects can develop White people's knowledge and understanding of systemic racism. We introduce the construct, transformative dissonant encounters, to describe how this project precipitated shifts in world view necessary for White people to confront systemic racism. Implications for nursing educators, psychological researchers, and antiracist activists are discussed. (shrink)

Recent years have witnessed an escalation in corporate social reporting (CSR) by UK companies (Gray, Kouhy and Lavers 1995). Whilst some elements of CSR reporting are required by law, much of it represents voluntary reporting. By investigating the non‐mandatory reporting of two aspects of social responsibility, corporate community involvement (CCI) and environmental impact, this paper seeks to explore why companies choose to make such disclosures. It specifically asks whether companies are primarily motivated by the strategic need to manage their reputation (...) and legitimacy rather than by the recognition of their ethical accountability, which is the stated purpose of reports produced by cutting edge companies (Clarke 1998). The COPE Inventory is the most frequently used measure of coping; yet previous studies examining its factor structure yielded mixed results. The purpose of the current study, therefore, was to validate the factor structure of the COPE Inventory in a representative sample of over 2,000 adults in Slovakia. Our second goal was to evaluate the external validity of the COPE inventory, which has not been done before. Firstly, we performed the exploratory factor analysis with half of the sample. Subsequently, we (...) performed the confirmatory factor analysis with the second half of the sample. Both factor analyses with 15 factor solutions showed excellent fit with the data. Additionally, we performed a hierarchical factor analysis with fifteen first-order factors and three second-order factors which showed good fit with the data. Moreover, the COPE Inventory’s external validity was evaluated using consensual qualitative research analysis on data collected by in-depth interviews. Categories of coping created using CQR corresponded with all COPE first-order factors. Moreover, we identified two additional first-order factors that were not present in the COPE Inventory: self-care and care for others. Our study shows that the Slovak translation of the COPE Inventory is a reliable, externally valid, and well-structured instrument for measuring coping in the Slovak population. (shrink)

Managers tasked with organizational change often face irreconcilable demands on how to enact justice—situations we call _justice conundrums_. Drawing on interviews held with managers before and after a planned large-scale change, we identify specific conundrums and illustrate how managers grapple with these through three prototypical paths. Among our participants, the paths increasingly diverged over time, culminating in distinct career decisions. Based on our findings, we develop an integrative process model that illustrates how managers grapple with justice conundrums. Our contributions are (...) threefold. First, we elucidate three types of justice conundrums that managers may encounter when enacting justice in the context of planned organizational change (the justice intention-action gap, competing justice expectations, and the justice of care vs. managerial-strategic justice) and show how managers handle them differently. Second, drawing on the motivated cognition and moral disengagement literature, we illustrate how cognitive mechanisms coalesce to allow managers to soothe their moral (self-) concerns when grappling with these conundrums. Third, we show how motivated justice intentions ensuing from specific justice motives, moral emotions, and circles of moral regard predict the types of justice conundrums managers face and the paths they take to grapple with them. While the use of archives is common as a research methodology in the history and philosophy of science, training in archival methods is more often encountered as part of graduate-level training than in the undergraduate curriculum. Because many HPS instructors are likely to have encountered archival methods during their own research training, they are uniquely positioned to make effective pedagogical use of archives in classes comprised of undergraduate science students. Further, because doing this may require changing the way HPS instructors (...) think about the aims and varieties of archival research, archivists themselves can be valuable resources in developing archives-based learning activities for science students in HPS classrooms. In this article, we describe an archives-based learning activity developed for a population of primarily pre-medical students in a healthcare ethics class and discuss the pedagogical benefits of this activity. This activity was developed via a collaboration between an HPS instructor and an education archivist. Our hope is that this discussion may serve both as a proof of concept for the use of archives-based learning activities as tools for teaching HPS to science students, and as an argument for the unique benefits that archival engagement can impart to science students. Buytendijk (1887–1974) entwickelte in seinen Forschungen der 1920er und 1930er Jahre in Abgrenzung zum Behaviorismus eine antireduktionistische Zugangsweise auf Verhaltensexperimente. So bezog er in seinen Experimentalpraktiken explizit die subjektive Erfahrung des Versuchsleiters mit ein. Damit entwarf Buytendijk eine Wissenschaftstheorie, die methodologisch auf die Phänomenologie, Hermeneutik wie auf gestalttheoretische Ganzheitskonzepte zurückgriff, quantitative Datenerhebungen aber dennoch nicht aufgab. Vielmehr untersuchte Buytendijk auf der Grundlage des Biotheoretikers Jakob von Uexküll (1864–1944) in seinem physiologischen Institut in Groningen konkret (...) die These einer „Tier-Umwelt-Einheit“. Der vorliegende Beitrag ermittelt anhand der institutionellen Rahmenbedingungen und zweier Experimente (1924 und 1931), inwiefern Buytendijk seine Aussage, dass das Tier „mit und in seiner Umwelt geboren [ist]“, die zugleich sein wissenschaftsphilosophisches Konzept stützte, zu verifizieren wusste. ABSTRACT This article aims to investigate the imperial element in the poetry of Joseph Brodsky through the lenses of post-colonial studies. Its ambiguity, informed by Brodsky’s experience as a poet in exile, as well as his personal cultural frame, echoes that of his poetic precursors. Thus, we briefly trace the history of the connection between Russian poetry and the imperial narrative, which began with the inception of the Russian Empire itself in the 18th century. Then, we explore the nuance of (...) the concept of empire in Brodsky’s works through the analysis of the poems Post aetatem nostram (1970), Torso (1972) and On the Independence of Ukraine (1991). As we understand it, both the chauvinistic content of the latter poem and the positive and nostalgic aspect of empire to Brodsky reveal the longevity and the strength of the Russian imperial narrative in the country’s national literature. This is the text of the Lindley Lecture for 2015 given by Julia Annas, an American philosopher.

In this paper we analyze relations between _ontology_ in anthropology and philosophy beyond simple homonymy or synonymy and show how this diagnosis allows for new interdisciplinary links and insights, while minimizing the risk of cross-disciplinary equivocation. We introduce the ontological turn in anthropology as an intellectual project rooted in the critique of dualism of culture and nature and propose a classification of the literature we reviewed into first-order claims about the world and second-order claims about ontological frameworks. Next, rather than (...) provide a strict definition of _ontology_ in anthropological literature, we argue that the term is used as a heuristic addressing a web of sub-concepts relating to interpretation, knowledge, and self-determination which correspond to methodological, epistemic, and political considerations central to the development of the ontological turn. We present a case study of rivers as persons to demonstrate what the ontological paradigm in anthropology amounts to in practice. Finally, in an analysis facilitated by a parallel between the first- and second-order claims in anthropology, and _ontology_ and meta-_ontology_ in philosophy (respectively), we showcase the potential for contribution of ontological anthropology to contemporary philosophical debates, such as ontological gerrymandering, relativism and social _ontology_, and vice versa. Habitat dioramas depicting ecological relations between organisms and their natural environments have become the preferred mode of museum display in most natural history museums in North America and Europe. Dioramas emerged in the late nineteenth century as an alternative mode of museum installation from taxonomically arranged cases. We suggest that this change was closely connected to the emergence of a biogeographical framework rooted in evolutionary theory and positing the existence of distinct biogeographical zones. We tie the history of dioramas to (...) earlier visual resources such as the thematic images that Wallace introduced to illustrate his 1876 Geographical Distribution of Animals. These images were unique in their time because each of them simultaneously depicted animals from several different taxa, rather than only one, as well as the ecological relations between animals and their habitats. Both, visually and with respect to their function within biogeography, these images presaged the habitat dioramas that came shortly afterwards. Not coincidentally, Wallace explicitly advocated the use of dioramas for museum display in ongoing debates on museum reform. Wallace 's suggestions were put into practice by committed evolutionists such as Gottlieb von Koch who pioneered the diorama installation in the Grand Ducal Museum in Darmstadt in 1906. As in Wallace 's illustrations, Koch's dioramas were designed to respresent biogeographical zones. This paper explores the function of these visual displays of biogeographical relations. It argues that, in both the scientific and public realms, biogeogaphical zones were defined and constructed by visual means; recourse to visual representation was more than a method of communication. This paper argues that there is something deeply wrong with the attempt to give rule-following explanations of broadly rational activities. It thus supports the view that rational norms are part of the ”bedrock’ and it challenges the widespread strategy of attempting to explain an individual’s rational or linguistic abilities by attributing to her knowledge of a theory of some kind. The theorist who would attempt to attribute knowledge of norms to an individual in order to explain her ability to act (...) rationally is presented with a dilemma: either she is committed to a explanatory regress or she destroys the normative nature of these rational practices or activities, thus making it pointless to attribute knowledge of the norms to an individual who participates in these practices. The appeal to tacit or implicit knowledge does not help in avoiding the basic dilemma. (shrink)

The politics of precarity have emerged on the contemporary scene of critical theory with great social force in recent years. This paper looks at the risks and obstacles of positing precariousness and vulnerability as the basis of a universal ethics while also arguing for the socially transformative potential of such a model. More broadly, it considers the crucial question of what stands in the way of human relation and ethical life in an age of neoliberalism and biopolitics, and posits an (...) ethics of resemblance grounded in the commonality of flesh and in the at once singular and universal experience of loss. In multi‐stakeholder networks, actors from civil society, business and governmental institutions come together in order to find a common solution to a problem that affects all of them. Problems approached by such networks often affect people across national boundaries, tend to be very complex and are not sufficiently understood. In multi‐stakeholder networks, information concerning a problem is gathered from different sources, learning takes place, conflicts between participants are addressed and cooperation is sought. Corporations are key actors in many networks, because (...) the problems addressed are frequently related to business activities. The aim of this article is to conceptualise multi‐stakeholder networks by proposing a problem‐centred stakeholder definition. From an analysis of several case studies, a life cycle model is deduced that distinguishes seven phases: initiation, acquaintance, first and second agreement, implementation, consolidation and institutionalisation. As an approach to public engagement, deliberation has the potential to pursue a range of goals identified by public participation theorists including the opportunity to substantively inform policy processes, increase the public’s knowledge and understanding of public issues and create or restore loss of public trust and confidence in public institutions. Baum and colleagues (2009) offer several important take-home messages for policy makers and public health leaders about the value of engaging with the public about ethically challenging, value-laden and resource (...) intensive policy issues such as pandemic response planning. During the past thirty years in the social sciences, there has been a wide-ranging discussion of “class politics” in capitalist modernity. Several distinct threads have developed, largely in isolation from each other. The authors suggest that the various accounts implicitly rely on different definitions of class politics and propose a way to classify them. The classification is based on two questions: first, whether changes in the strength of the left depend on the working class specifically or on cross-class dynamics and, (...) second, whether emergent class differences in politics are largely spontaneous or constructed. The authors use this classification to assess the prospects for testing the empirical implications of different accounts and point to the more general insights potentially offered by each approach. A partir de la investigación narrativa y mediante entrevistas abiertas nos propusimos recuperar y analizar lo que los adultos memoran de ese tiempo. Sintetizamos los resultados del trabajo de campo, que ubican al disciplinamiento, al miedo y al respeto como los tópicos de mayor (...) recurrencia e intensidad, como asimismo a los sentidos otorgados a estos recuerdos. Esbozamos finalmente lo que se olvida o se silencia. This article makes an analysis of Mabel Shaw's understanding of African spirituality and Christian theology that emerged while she worked as a missionary teacher for the London Missionary Society in Northern Rhodesia. It argues that post-colonial writing on missionary activity has tended to emphasize the negative aspects of the missionary movement, the consequence of which has been a failure to recognize the achievement of women such as Shaw. The freedom that the London Board of the LMS gave to their field (...) workers allowed Shaw to create a Boarding School for girls at Mbereshi that won Shaw acclaim as an educational practitioner. An instinctive belief in natural theology combined with a strong sense of the presence of God in loving action was critical in forming and shaping the practical application of her faith. While professionally it is apparent that Shaw `hit the glass ceiling' with her being overlooked as a candidate to become Mission Station Head she provides an impressive example of a woman who challenged perceptions of theology and denominational allegiance. Her radical thought on issues surrounding Christian spirituality had implications for the Christian movement as it became an agent of change in Central Africa. (shrink)
