In order to assure optimal care of patients with chronic illnesses, it is necessary to take into account the cultural factors that may influence health-related behaviors, health practices, and health-seeking behavior. Despite the increasing number of Romanian Roma, research regarding their beliefs and practices related to healthcare is rather poor. The aim of this paper is to present empirical evidence of specificities in the practice of healthcare among Romanian Roma patients and their caregivers. Using a qualitative exploratory descriptive design, this (...) study is based on data gathered through three focus groups with 30 health mediators in the counties of Iasi and Cluj (Romania). We identified various barriers to access to healthcare for Roma patients: lack of financial resources and health insurance coverage, lack of cognitive resources or lack of personal hygiene, but also important cultural issues, such as the shame of being ill, family function, disclosure of disease-related information, patient’s autonomy, attitudes towards illness and health practices, that should be considered in order to create a culturally sensitive environment in Romanian medical facilities:… The role of the health mediators within the context of cultural diversity is also discussed, as cultural brokers contributing to health care quality among Romanian Roma patients Bridging cultural differences may improve patient–healthcare provider relationships, but may have limited impact in reducing ethnic disparities, unless coupled with efforts of Roma communities to get involved in creating and implementing health policies. Medical communication in Western-oriented countries is dominated by concepts of shared decision-making and patient autonomy. In interactions with Roma patients, these behavioral patterns rarely seem to be achieved because the culture and ethnicity have often been shown as barriers in establishing an effective and satisfying doctor–patient relationship. The study aims to explore the Roma’s beliefs and experiences related to autonomy and decision-making process in the case of a disease with poor prognosis. Forty-eight Roma people from two Romanian counties participated in (...) semi-structured interviews, conducted by a research team from the University of Medicine and Pharmacy of Iasi. Participants were recruited among the chronically ill patients and caregivers. The Roma community opposes informing the terminal patients about their condition, the “silence conspiracy” being widely practiced. The family fully undertakes the right of decision making, thus minimizing the patient’s autonomy. We identified ethical dilemmas concerning autonomy, lack of patients’ real decision-making power, and paternalistic attitudes exerted firstly by the family and, on demand, by the physician. Instead, the Roma patient benefits from a very active support network, being accompanied at the hospital by numerous relatives. The patient’s right to make autonomous decisions promoted in the Western countries and stipulated by the Romanian law has diminished value in the Roma community. For the Roma, the understanding of dignity is not simply individual and personal, but it is closely related to their cultural particularities. Ignoring their cultural values could create conflicts between healthcare providers and community. (shrink)

En “Sur un autoportrait de Rembrandt”, Paul Ricoeur trabaja la identidad del pintor holandés analizando un autorretrato de 1660. En vista de que Ricoeur aborda “la escritura como un capítulo en una teoría general de la iconicidad”, da lugar a entenderlo de modo semejante a como W. J. T. Mitchell propone leer a Jaques Derrida: como “un filósofo de la versión gráfica del giro pictorial”. De sostenerse esta lectura, por una parte, la iconicidad devendría una dimensión irreductible de la comprensión (...) de sí. Por la otra, en el autorretrato de Rembrandt de 1660, el autor “real”, tras disolverse en el personaje “irreal” que retrató, creó la distancia para que en carácter de espectador pueda examinarse autobiográficamente merced a objetivarse en su imagen especular. Y en ese análisis de sí por sí devendría un sí mismo capaz de vivir una vida digna de ser vivida. De ser consiste la argumentación, nuestra hipótesis es que la “identidad narrativa”, largamente trabajada por Ricoeur, quedaría subordinada a, al tiempo que complementaría, lo que damos en llamar aquí la “identidad icónica”. De los escasos estudios filosóficos dedicados a Die vertauschten Köpfe de Thomas Mann se puede concluir que estamos ante una novela sobre la identidad personal, aunque resulta difícil de decidir en qué sentido lo es. Parecemos condenados a recaer en el dualismo cartesiano del que emerge la identidad autorreferencial del cogito, o bien en el reduccionismo neurocientífico o filosófico en el que la identidad personal deviene algo indiscernible. Nuestra hipótesis es que Die vertauschten Köpfe es una novela sobre la identidad (...) personal en el sentido de la "identidad narrativa" defendida por Ricoeur principalmente en Temps et récit III, "L'identité narrative" y Soi-même comme un autre. From what scarce philosophical readings there are of Thomas Mann's Die vertauschten Köpfe, one can conclude that it is a novel about personal identity, even if it is hard to determine in what manner. It would appear that we are condemned to fall back on the Cartesian dualism that yields the cogito's self-referential identity or on the neuroscientific or philosophical reductionism in which personal identity becomes indiscernible. Our hypothesis is that Die vertauschten Köpfe is a novel about personal identity in the sense of "narrative identity" explored by Ricoeur mainly in Temps et récit III, "L'identité narrative" and Soi-même comme un autre. Dada la polaridad entre las teorías "legitimistas" (Weber) e "ilegitimistas" (Arendt) respecto de la violencia en la arena política, en este artículo se explora el aporte de Paul Ricoeur en torno al tema. Puesto que para este autor lo político es la realización de la intención ética, primero se abordará la dimensión ética y moral de la violencia. Después se ingresará en el dominio propiamente político donde Ricoeur defiende una dialéctica "asimétrica" entre los argumentos "ilegitimistas" y "legitimistas" en la cual (...) los primeros adquieren razonabilidad dentro de un concepto "amplio" de violencia próximo al de Arendt. Por último, se abordará la dimensión temporal de la violencia presente en la memoria colectiva y en la historia. Se concluirá con un balance de los méritos y de las cuestiones parcialmente irresueltas en la obra de Ricoeur. Given the polarity between the "legitimist" (Weber) and the "illegitimist" (Arendt) theories of violence in the political field, I will explore the philosophical contributions of Paul Ricoeur to this issue. Since the political field is for the author the accomplishment of the ethical intention, I will first explore the ethical and moral dimension of violence. Secondly, I will enter in the proper political field where we will see Ricoeur defends an "asymmetrical" dialectic between the "legitimist" and "illegitimist" arguments in which the former acquire reasonability within a "broad" concept of violence akin to Arendt's. Thirdly, I will approach the temporal dimension of violence as it appears in collective memory and in history. I will conclude with an account of the merits and partially unresolved questions within Ricoeur's work. (shrink)

A patient suffering from a severe illness that is entering its terminal stage is forced to develop a coping process. Of all the coping patterns, the religious one stands out as being a psychological resource available to all patients regardless of culture, learning, and any age. Religious coping interacts with other values or practices of society, for example the model of a society that takes care of it's elder members among family or in an institutionalized environment or the way the (...) health system offers or not psychological support for a terminally ill patient. Health care providers should have at least some psychological coping patterns training because not all patterns of religious coping are equally effective, and some have been described as increasing the level of stress or producing other negative psychological effects on the patient. This article aims to review the complex models of religious coping that are unanimously accepted in psychooncology, arguments in favor of religious coping, the types of patients that use this model, ethical dilemmas that could be reinterpreted using religious arguments. Finally, we will also discuss the need of Romanian patients to embrace a religious coping in case of an incurable illness, and also the support that they can receive from both curative and palliative health care providers.  . The effective collection and management of personal data of rapidly migrating populations is important for ensuring adequate healthcare and monitoring of a displaced peoples’ health status. With developments in ICT data sharing capabilities, electronic personal health records (ePHRs) are increasingly replacing less transportable paper records. ePHRs offer further advantages of improving accuracy and completeness of information and seem tailored for rapidly displaced and mobile populations. Various emerging initiatives in Europe are seeking to develop migrant‐centric ePHR responses. This paper highlights their (...) importance and benefits, but also identifies a number of significant ethical, legal and social issues (ELSI) and challenges to their design and implementation, regarding (1) the kind of information that should be stored, (2) who should have access to information, and (3) potential misuse of information. Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

In light of the World Anti Doping Agency’s 2013 Code Revision process, we critically explore the applicability of two of three criteria used to determine whether a method or substance should be considered for their Prohibited List, namely its (potential) performance enhancing effects and its (potential) risk to the health of the athlete. To do so, we compare two communities of human guinea pigs: (i) individuals who make a living out of serial participation in Phase 1 pharmacology trials; and (ii) (...) elite athletes who engage in what is effectively ‘unregulated clinical research’ by using untested prohibited or non-prohibited performance enhancing substances and methods, alone or in combination. Our comparison sheds light on norms of research ethics that these practices exacerbate with respect to the concepts of multiplicity, visibility, and consistency. We argue for the need to establish a proper governance framework to increase the accountability of these unregulated research practices in order to protect the human guinea pigs in elite sports contexts, and to establish reasonable grounds for the performance enhancing effects, and the risks to the health of the athlete, of the methods and substances that might justify their inclusion on the Prohibited List. Semantic roles have continued to intrigue linguists for more than four decades now, starting with determining their kind and number, with their morphological expression, and with their interaction with argument structure and syntax. The focus in this volume is on typological and historical issues. The papers focus on the cross-linguistic identification of semantic-role equivalents, on the regularity of, and exceptions concerning change and grammaticalization in semantic roles, the variation of encoding the roles of direction and experiencer in specific languages, presenting (...) evidence for identifying a new semantic role of speech addressee in Caucasian languages, on semantic roles in word formation, and finally a cross-linguistic comparison of the functions and the grammaticalization of the ethical dative in some Indo-European languages. Economic theory teaches that it is in every country’s interest to trade. Trade is a voluntary activity among consenting parties. On this view, considerations of justice have little bearing on trade, and political philosophers concerned with global justice should stay largely silent on trade. According to a very different view that has recently gained prominence, international trade can only occur before the background of an international market reliance practice shaped by states. Trade is a shared activity among states, and all (...) participating states have in principle equal claims to gains from trade. Trade then becomes a central topic for political philosophers. Both views are problematic. A third view about the role of trade in a theory of global justice is then presented, which gives pride of place to a notion of exploitation. Caster Semenya is done with track and field. At 29, her hopes for a continued career as a professional middle-distance runner are dashed. After her case against International Association for Athletics Federation 1 was dismissed by the Court for Arbitration of Sport on 1 May 2019, she has switched to football later in the year.1 Semenya’s case may have come to its legal conclusion, however it has generated an aporia regarding the binary classification in athletics, which has yet to be (...) solved.2 It is time the implications of the fair equality of opportunity principle as a normative basis for the construction of categories in sport are taken seriously to move forward the debate on unfair advantages in sport. Young children are prolific question-askers. The growing ubiquity of voice interfaces (e.g., Apple’s Siri, Amazon’s Alexa), as well as the availability of voice input in search fields, now make it possible for children to ask questions via Internet search when they are able to speak clearly, but before they have learned to read and write, typically between 3 and 6 years of age. The prevalence of voice search makes it important to understand children’s changing conceptions of digital devices as a (...) source of information and the role of technology-mediated question-asking in development. While limited research has focused on young children's use of voice interfaces, reviewing two related bodies of literature sheds light on how this use might unfold. This paper brings together studies of how children look for information, and of how they perceive and understand the informational and social roles of technology, drawing on human-computer interaction research. We conclude by highlighting lines of questioning for future work on younger children’s interaction through voice search. (shrink)

Studying evidence law as part of naturalized epistemology means using the tools and results of the sciences to evaluate evidence rules based on the accuracy of the verdicts they are likely to produce. In this chapter, we introduce the approach and address skeptical concerns about the value of systematic empirical research for evidence scholarship, focusing, in particular, on worries about the external validity of jury simulation studies. Finally, turning to applications, we consider possible reforms regarding eyewitness identifications and character evidence.

In this article, we present ideas related to three key aspects of mindfulness training: the regulation of attention via noradrenaline, the importance of working memory and its various components (particularly the central executive and episodic buffer), and the relationship of both of these to mind-wandering. These same aspects of mindfulness training are also involved in the preparation and execution of movement and implicated in the pathophysiology of psychosis. We argue that by moving in a mindful way, there may be an (...) additive effect of training as the two elements of the practice (mindfulness and movement) independently, and perhaps synergistically, engage common underlying systems (the default mode network). We discuss how working with mindful movement may be one route to mindfulness training for individuals who would struggle to sit still to complete the more commonly taught mindfulness practices. Drawing on our clinical experience working with individuals with severe and enduring mental health conditions, we show the real world application of these ideas and how they can be used to help those who are suffering and for whom current treatments are still far from adequate. The assessment of chronic pain is a highly unmet medical need. Chronic pain is also the subject of a large and costly category of legal claims. Yet, with pain cases, the jury always face a doubt: is the claimant faking or malingering? How can we be assured that the claimant is 'really' in pain? Most recently, several new neuroimaging technologies are promising to solve these questions, by rendering pain visible, measurable and, to some degree, verifiable. The results of these advancements (...) have prompted us to think of pain in a different way, i.e. as an altered brain state in which functional connections are modified, with components of degenerative aspects. But, does this imply the stronger claim that these technologies allow us to 'know', or to literally 'see', the pain of others? Is the pain being objectified by these techniques? And if so, what might the law do differently, or do better? (shrink)

The article considers the philosophical potential of Heraclitean ambiguity and implications for how one might engage philosophically with Heraclitus. While works on Heraclitus most commonly offer new interpretations or dispute or add nuance to established interpretations, this work somewhat sidesteps interpretive disputes to consider the philosophical value and relevance of Heraclitus’s fragments themselves. Specifically, a hermeneutical tool proposed by William Desmond called a “companioning approach,” is supported. Desmond’s companioning approach is considered in the context of Pierre Hadot’s account of the (...) history of hermeneutical practices to show that it merely defines and legitimizes a longstanding hermeneutical activity. Further, a recent work by A. V. Halapsis shows that Heraclitus’s ambiguity may have been a consequence of his anthropological commitments and that he may have intended to allow for something like a companioning engagement. During the last few decades, the historical turn within the tradition of the analytic tradition has experienced growing enthusiasm concerning the procedure of rational reconstruction, whose validity or importance, despite its paradigmatic examples in Frege and Russell, has not always enjoyed a consensus. Among the analytic philosophers who are the frontrunners of this movement, Robert Brandom is one of a kind: his work on Hegel as well as on German Idealism has been increasing interest in, as well as awareness of, (...) Hegel´s possible contributions to some current problems in that tradition, and connecting Hegel scholars to current questions. Thus, this work aims to explore Brandom´s methodology of rational reconstruction, as well as his dialogue with history of Philosophy, mainly exposed in his Tales of the mighty dead (2002). As we will see, Brandom´s distinction between a de dicto and a de re approach intends to present a way of identifying and analyzing a given philosopher´s theoretical (hidden) commitments that can be useful to improve the quality of the dialogue with past philosophers. From such methodological exposition, I to turn to Kierkegaard in order to make explicit some of his ontological commitments and presenting Brandom’s approach as a valuable tool for doing history of philosophy.
