Studying evidence law as part of naturalized epistemology means using the tools and results of the sciences to evaluate evidence rules based on the accuracy of the verdicts they are likely to produce. In this chapter, we introduce the approach and address skeptical concerns about the value of systematic empirical research for evidence scholarship, focusing, in particular, on worries about the external validity of jury simulation studies. Finally, turning to applications, we consider possible reforms regarding eyewitness identifications and character evidence.

Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the constraint (...) that a precedent imposes based on the relationship of the precedent court and the instant court. In his recent article "Carnapian Frameworks" (Synthese, 2021), Gabriel Broughton criticizes my discussions of Carnap on ontology and puts forward his own interpretation of what Carnap’s external/internal distinction amounts to. I here first argue that Broughton’s main claims about me are based on a misinterpretation. Then I turn to some issues of broader interest. I argue that Broughton’s own, potentially interesting interpretation of Carnap’s external/internal distinction does not work. Bertrand Russell offered an influential paradox of propositions in Appendix B of The Principles of Mathematics, but there is little agreement as to what to conclude from it. We suggest that Russell's paradox is best regarded as a limitative result on propositional granularity. Some propositions are, on pain of contradiction, unable to discriminate between classes with different members: whatever they predicate of one, they predicate of the other. When accepted, this remarkable fact should cast some doubt upon some of the (...) uses to which modern descendente of Russell's paradox of propositions have been put in recent literature. (shrink)

I would like to discuss the claim that the resources of plural reference and plural quantification are sufficient for the purpose of paraphrasing all ordinary statements apparently concerned with composite material objects into plural statements concerned exclusively with simples.

We criticize attempts to define hope in terms of other psychological states and argue that hope is a primitive mental state whose nature can be illuminated by specifying key aspects of its functional profile.

Two semantic theories of proper names are explained and assessed. The theories are Burge’s treatment of proper names as complex demonstratives and Larson and Segal’s quasi-descriptivist account of names. The two theories are evaluated for empirical plausibility. Data from deficits, processing models, developmental studies and syntax are all discussed. It is concluded that neither theory is fully confirmed or refuted by the data, but that Larson and Segal’s theory has more empirical plausibility.

Groups are ubiquitous in our lives. But while some of them are highly structured and appear to support a shared intentionality and even a shared agency, others are much less cohesive and do not seem to demand much of their individual members. Queues, for example, seem to be, at a given time, nothing over and above some individuals as they exemplify a certain spatial arrangement. Indeed, the main aim of this paper is to develop the more general thought that at (...) a given time, a group is nothing over and above some individual members as they exemplify a certain complex condition. The general conception of groups that emerges is able to accommodate a variety of constraints on a reasonable answer to the question of what are groups. (shrink)

Do mereological fusions have their parts necessarily? None of the axioms of non-modal formulations of classical mereology appear to speak directly to this question. And yet a great many philosophers who take the part-whole relation to be governed by classical mereology seem to assume that they do. In addition to this, many philosophers who make allowance for the part-whole relation to obtain merely contingently between a part and a mereological fusion tend to depart from non-modal formulations of classical mereology at (...) least when it comes to the axiom of Unique Fusion, which states that no two different mereological fusions ever fuse exactly the same objects. This is no coincidence. There are reasons of principle why one’s adherence to classical mereology should exert some pull towards the view that mereological fusions have their parts necessarily. There is, however, no direct route from the combination of classical mereology and propositional modal logic to the hypothesis that the part-whole relation obtains necessarily between a part and a mereological fusion. In order to bridge between a modal formulation of classical mereology and the hypothesis that fusions have their parts necessarily, one needs to strengthen the axiom of Unrestricted Fusion in a way that is agreeable to many philosophers on both sides of the debate. There has recently been much debate about the idea of levying a tax on particular transactions on international financial markets. Economists have argued about how much revenue such an international financial transaction tax would raise and they disagree about what effects it would have on trade volumes, financial stability, and overall growth. Politicians have argued about the feasibility of introducing such a tax internationally and they disagree on its adequacy as a policy response to the current financial and economic crisis. (...) This article contributes to the debate about international financial transaction taxation by bringing the perspective of political philosophy to bear on the politicians’ and economists’ arguments about policy. I shall outline a framework for thinking about justice in finance, and defend the idea of an international financial transaction tax as an instrument for making the international financial system more just. Economic theory teaches that it is in every country’s interest to trade. Trade is a voluntary activity among consenting parties. On this view, considerations of justice have little bearing on trade, and political philosophers concerned with global justice should stay largely silent on trade. According to a very different view that has recently gained prominence, international trade can only occur before the background of an international market reliance practice shaped by states. Trade is a shared activity among states, and all (...) participating states have in principle equal claims to gains from trade. Trade then becomes a central topic for political philosophers. Both views are problematic. A third view about the role of trade in a theory of global justice is then presented, which gives pride of place to a notion of exploitation. Humans, animals, and the environment face a universal crisis: antimicrobial resistance. Addressing AR and its multi-disciplinary causes across many sectors including in human and veterinary medicine remains underdeveloped. One barrier to AR efforts is an inconsistent process to incorporate the plenitude of stakeholders about what AR is and how to stifle its development and spread—especially stakeholders from the animal agriculture sector, one of the largest purchasers of antimicrobial drugs. In 2019, The Wellcome Trust released Reframing Resistance: How to communicate about (...) antimicrobial resistance effectively, which proposed the need to establish a consistent and harmonized messaging effort that describes the AR crisis and its global implications for health and wellbeing across all stakeholders. Yet, Reframing Resistance does not specifically engage the animal agriculture community. This study investigates the gap between two principles recommended by Reframing Resistance and animal agriculture stakeholders. For this analysis, the research group conducted 31 semi-structured interviews with a diverse group of United States animal agriculture stakeholders. Participants reported attitudes, beliefs, and practices about a variety of issues, including how they defined AR and what entities the AR crisis impacts most. Exploration of Reframing Resistance’s Principle 2, “explain the fundamentals succinctly” and Principle 3, “emphasis that this is universal issue; it can affect anyone, including you” reveals disagreement in both the fundamentals of AR and consensus of “who” the AR crisis impacts. Principle 2 may do better to acknowledge that animal agriculture stakeholders espouse a complex array of perspectives that cannot be summed up in a single perspective or principle. As a primary tool to combat AR, behavior change must be accomplished first through outreach to stakeholder groups and understanding their perspectives. (shrink)

This biography of Emil du Bois-Reymond, the most important forgotten intellectual of the nineteenth century, received an Honorable Mention for History of Science, Medicine, and Technology at the 2013 PROSE Awards, was shortlisted for the 2014 John Pickstone Prize (Britain's most prestigious award for the best scholarly book in the history of science), and was named by the American Association for the Advancement of Science as one of the Best Books of 2014. -/- In his own time (1818–1896) du Bois-Reymond (...) grew famous for his groundbreaking research in neuroscience and his provocative addresses on politics and culture. His discovery of the electrical transmission of nerve signals, his innovations in laboratory instrumentation, and his reductionist methodology all helped lay the foundations of modern neuroscience. -/- In addition to describing the pioneering experiments that earned du Bois-Reymond a seat in the Prussian Academy of Sciences and a professorship at the University of Berlin, this book also recounts du Bois-Reymond’s family origins, private life, public service, and lasting influence. In talks that touched on science, philosophy, history, and literature, du Bois-Reymond introduced Darwin to German students (triggering two days of debate in the Prussian parliament), asked on the eve of the Franco-Prussian War whether France had forfeited its right to exist, and proclaimed the mystery of consciousness, heralding the age of doubt. The first modern biography in any language, "Emil du Bois-Reymond" recovers an important chapter in the history of science, the history of ideas, and the history of Germany. (shrink)

We show that a coherent theory of partially ordered connectives can be developed along the same line as partially ordered quantification. We estimate the expressive power of various partially ordered connectives and use methods like Ehrenfeucht games and infinitary logic to get various undefinability results.

Independence‐Friendly logic introduced by Hintikka and Sandu studies patterns of dependence and independence of quantifiers which exceed those found in ordinary first‐order logic. The present survey focuses on the game‐theoretical interpretation of IF‐logic, including connections to solution concepts in classical game theory, but we shall also present its compositional interpretation together with its connections to notions of dependence and dependence between terms.

This paper offers a new version of a historically influential, yet today unpopular, neglected, and on the whole insufficiently developed argument for socialism: socialism makes it possible for people to really act together. This idea of socialist action, combining the claims that there is a particularly valuable form of joint action and that socialism is about making such action possible, played an important role in the history of the labor movement, going back to the early Marx and running through various (...) strands of socialist thought. I shall argue that socialist action should be seen as central to the socialist project, its critique of capitalism, and the institutional alternatives envisaged by it. (shrink)

The topic of this paper is the semantic structure of belief reports of the form 'a believes that p'. it is argued that no existing theory of these sentences satisfactorily accounts for anaphoric relations linking expressions within the embedded complement sentence to expressions outside. a new account of belief reports is proposed which assigns to embedded expressions their normal semantic values but which also exploits frege's idea of using senses to explain the apparent failures of extensionality in the reports.

In NIP theories, generically stable Keisler measures can be characterized in several ways. We analyze these various forms of “generic stability” in arbitrary theories. Among other things, we show that the standard definition of generic stability for types coincides with the notion of a frequency interpretation measure. We also give combinatorial examples of types in NSOP theories that are finitely approximated but not generically stable, as well as ϕ-types in simple theories that are definable and finitely satisfiable in a small (...) model, but not finitely approximated. Our proofs demonstrate interesting connections to classical results from Ramsey theory for finite graphs and hypergraphs. (shrink)

Although stakeholder theory is widely accepted in environmental disclosure research, empirical evidence about the role of stakeholders in firms’ disclosure is still scarce. The authors address this issue for a setting of carbon disclosure. Our international sample comprises the Carbon Disclosure Project Global 500, S&P 500, and FTSE 350 reports from 2008 to 2011, resulting in a total of 1,120 firms with 3,631 firm-year observations. The authors apply Tobit regressions to analyze the relationship between carbon disclosure and the relevance of (...) the following stakeholder groups: government, general public, media, employees, and customers. Our results confirm that in addition to carbon performance, all stakeholders are associated with carbon disclosure. Only one stakeholder group acts as a moderator for the relationship between carbon performance and carbon disclosure. Furthermore, the authors find that carbon performance but not the affiliation to a carbon-intensive industry acts as a moderator between stakeholder relevance and carbon disclosure. (shrink)

For n≥3, define Tn to be the theory of the generic Kn-free graph, where Kn is the complete graph on n vertices. We prove a graph-theoretic characterization of dividing in Tn and use it to show that forking and dividing are the same for complete types. We then give an example of a forking and nondividing formula. Altogether, Tn provides a counterexample to a question of Chernikov and Kaplan.

Moral repair is an important way for firms to heal moral relationships with stakeholders following a transgression. The concept is rooted in recognition theory, which is often used to develop normative perspectives and prescriptions, but the same theory has also propelled a view of moral repair as premised on negotiation between offender and victim(s), which involves the complex social construction of the transgression and the appropriate amends. The tension between normative principles and socioconstructivist implementation begs the question how offending firms (...) should approach moral repair. Addressing this question, we develop a two-level conceptualization of moral repair, distinguishing between procedural and substantive levels of practice, which accommodate normativity and socioconstructivism, respectively. In so doing, we enrich the literature by 1) promoting conceptual clarity, 2) refining understanding of the moral repair process, and 3) suggesting the use of a unified, configurational approach to studying (nonlinear) relations between amends and moral outcomes. This paper is principally devoted to comparing and contrasting poverty of stimulus arguments for innate cognitive apparatus in relation to language and in relation to folk psychology. These days one is no longer allowed to use the term ‘innate’ without saying what one means by it. So I will begin by saying what I mean by ‘innate’. In _Counter-History of the Present_ Gabriel Rockhill contests, dismantles, and displaces one of the most widespread understandings of the contemporary world: that we are all living in a democratized and globalized era intimately connected by a single, overarching economic and technological network. Noting how such a narrative fails to account for the experiences of the billions of people who lack economic security, digital access, and real political power, Rockhill interrogates the ways in which this grand narrative has emerged in (...) the same historical, economic, and cultural context as the fervid expansion of neoliberalism. He also critiques the concurrent valorization of democracy, which is often used to justify U.S. military interventions on the behalf of capital. Developing an alternative account of the current conjuncture that acknowledges the plurality of lived experiences around the globe and in different social strata, he shifts the foundations upon which debates about the contemporary world can be staged. Rockhill's counter-history thereby offers a new grammar for historical narratives, creating space for the articulation of futures no longer engulfed in the perpetuation of the present. (shrink)

Interest shown on the environmental impact of operations of multinational enterprises in developing countries has grown significantly recently, and has fuelled a heated public policy debate. In particular, there has been interest in the environmental degradation of host communities and nations resulting from the operations of multinational oil companies in developing countries. This article examines the issue of environmental costs and responsibilities resulting from oil exploitation and production in the Niger Delta region of Nigeria. The case study is based, in (...) part, upon series of interviews with key stakeholders in the Nigerian oil industry. The article further examines the implications of the current practice and policies of multinational oil companies with respect to environmental impact of oil exploitation. The study’s findings illustrates that it is becoming increasingly apparent to oil companies that pollution prevention pays while pollution does not and under pressure from stakeholder groups, oil companies now routinely incorporate environmental impact assessments into their corporate strategy. In the academic world, peer review is one of the major processes in evaluating a scholars contribution. In this study, we are interested in quantifying the merits of different policies in a peer review process, such as single-blind review, double-blind review, and obtaining authors feedback. Currently, insufficient work has been undertaken to evaluate the benefits of different peer review policies. One of the major reasons for this situation is the inability to conduct any empirical study because data are presently unavailable. (...) In this case, a computer simulation is one of the best ways to conduct a study. We perform a series of simulations to study the effects of different policies on a peer review process. In this study, we focus on the peer review process of a typical computer science conference. Our results point to the crucial role of program chairs in determining the quality and diversity of the articles to be accepted for publication. We demonstrate the importance of discussion among reviewers, suggest circumstances in which the double-blind review policy should be adopted, and question the credibility of the authors feedback mechanism. Finally, we stress that randomness plays an important role in the peer review process, and this role cannot be eliminated. Although our model may not capture every component of a peer review process, it covers some of the most essential elements. Thus, even the simulation results clearly cannot be taken as literal descriptions of an actual peer review process. However, we can at least still use them to identify alternative directions for future study. (shrink)

John Rawls famously claims that ‘justice is the first virtue of social institutions’. On one of its readings, this remark seems to suggest that social institutions are essential for obligations of justice to arise. The spirit of this interpretation has recently sparked a new debate about the grounds of justice. What are the conditions that generate principles of distributive justice? I am interested in a specific version of this question. What conditions generate egalitarian principles of distributive justice and give rise (...) to equality as a demand of justice? My paper focuses on relationalist answers to this question. Advocates of relationalism assume that ‘principles of distributive justice have a relational basis’, in the sense that ‘practice mediated relations in which individuals stand condition the content, scope and justification of those principles’. To say that principles of justice are ‘based’ on and ‘conditioned’ by practice mediated relations is ambiguous. I will here be concerned with advocates of what I call the relationalist requirement , viz. positions which assume that ‘practice mediated relations’ constitute a necessary existence condition for principles of egalitarian distributive justice. Relationalists who endorse this view come in different varieties. My focus is on relationalists that view social and political institutions as the relevant ‘practice mediated relation’. The question at stake, then, is this: Are institutionally mediated relations a necessary condition for equality to arise as a demand of justice? Strong relationalists of the institutionalist cast, call them advocates of the institutionalist requirement , differ in important respects. They argue about what set of institutions is foundationally significant, and they disagree on why only that institutional relation gives rise to egalitarian obligations of justice. My paper engages two ways of arguing for the institutionalist requirement : Julius’s framing argument and Andrea Sangiovanni’s reciprocity argument . The issue at stake are the grounds of egalitarian justice and I will argue that the institutionalist requirement is mistaken. It is not the case that egalitarian obligations of distributive justice arise only between and solely in virtue of individuals sharing a common institution. (shrink)

This remarkable volume portrays one such story of resistance in Romania during the reign of Ceausescu: that of Constantin Noica, one of the country's foremost intellectuals. The book will be of interest to philosophers, non-philosophers alike, and to anyone who seeks to grasp the true meaning of survival under totalitarian conditions.

Based on an analysis of a landmark case Lim Mey Lee Susan v Singapore Medical Council in Singapore where a doctor was professionally disciplined for over-charging a wealthy patient, a judgement upheld by the Singapore High Court, this paper will discuss the notion of an ‘ethical price’ (EP) and its determination with respect to the provision of healthcare services. It will first examine the limitations of a legal approach for setting an ethical limit to pricing. From there, it will argue (...) that Confucian philosophy provides a useful ethical framework to explore EP, with focus on the context of Singapore. The following question is addressed: What is an ethical pricing standard for medical practice from a Confucian perspective? The strengths and limitations of a Confucian value base as regards the determination of an objective EP will be analysed through an examination of the shortcomings of the doctor’s behaviour in the Susan Lim case as well as other case scenarios. The paper will conclude with some practical suggestions on how Confucian-based ideas can be applied to decision-making on pricing and the importance of this for medical professionalism and ethics teaching.
