Under what conditions do motherhood penalties emerge in countries undergoing transition from state socialism to capitalism? This analysis identifies the ways managers in global financial firms employ gendered assumptions in constructing and implementing labor practices among highly skilled professional workers in Hungary. Relying on 33 in-depth interviews with employers as well as interviews with headhunting firms, labor and employment lawyers, and analysis of antidiscrimination cases brought before Hungary’s Equal Treatment Authority between 2004 and 2008, we identify several strategies global employers (...) use to shed, demote, and marginalize professional mothers. By demonstrating the salience of motherhood as a status characteristic in the postsocialist labor market, our work contributes to existing scholarship on motherhood penalties. Our work also extends this scholarship by showing how the salience of motherhood is strongly conditioned by state-level arrangements that shape the opportunity context in which employers design and carry out employment practices. The gendered assumptions embedded in the construction of the rational individual are well established in Western feminist thought but inapplicable to describe societies operating on different principles, such as East European state socialism. This article identifies the communist subject as the building block of communist political ideology and argues that this formulation was no less male biased than its counterpart, the rational individual under liberal capitalism. In state socialist Hungary this male bias came to be expressed differently: Women were integrated (...) into society through membership in a social group perceived as relatively homogeneous regarding interests and obligations and with gender-specific qualities and privileges. These qualities were considered inferior to men's since women—because of household responsibilities—were not capable of total devotion to the communist party. The author explores this construction of the female communist subject through a content analysis of classified materials from the archives of the Hungarian Socialist Workers' Party. (shrink)

Generous parental leave policies are popular in a number of countries around the world and are usually seen as a sign of the ‘family friendliness’ of the state. Relying on in-depth interviews with mothers on parental leave in Hungary, the authors argue that the context in which the policies are implemented should be examined when evaluating their consequences. In semi-peripheral, resource-poor Hungary lengthy parental leave policies turn women into an invisible ‘reserve army of labourers’. While their employment is mostly unaccounted (...) for in aggregate statistics, and political discourse suggests that their ‘job’ is to look after children, nevertheless many women do end up doing some work for wages during the almost five years they spend on parental leave. However, given the rigidity of the labour market and rampant discrimination against mothers with small children, their chances of obtaining formal employment are small. They therefore resort to doing ad hoc, temporary, informal work, which is often underpaid and well below their qualifications. Thus generous family policies do not necessarily indicate the ‘women friendliness’ of the state and may not lead to the relatively favourable trade-off between stable public sector work and lower wages suggested recently by comparative researchers. Instead, in this specific context, which combines legacies of state socialism, a backlash against women’s emancipation before 1990 and a peripheral, vulnerable labour market, familialist policies are associated with a high degree of marginalisation for women with small children in which the state is at best complicit, at worst, an active agent. Emotionen sind als erlebte Bewertungen eine Form von Normativität, die intrinsisch im Spüren enthalten ist, also weder explizit gefolgert noch propositional gefasst ist. Geprüft wird in diesem Kapitel, ob Emotionen dadurch als natürliche Grundlage selbst für moralische oder genuine Normativität gelten können und sich diese letztere Form der Normativität daher auf biologisch angelegte Formen von Normativität reduzieren lässt. Diese Diskussion weist insofern Überschneidungen mit den in den vorangegangenen Kapiteln erörterten Fragen auf, als die verschiedenen Formen der Bewertung mit verschiedenen Bewusstseinsstufen (...) in Verbindung gebracht werden und verschiedene Formen des Selbstverhältnisses erfordern. Zudem lässt sich die Diskussion um die natürliche Normativität von Emotionen mit ausgearbeiteten Versuchen verbinden, semantischen Gehalt mentaler Zustände wie zum Beispiel Emotionen auf natürliche Grundlagen zu reduzieren. Bekannt geworden sind diese Ansätze unter dem Stichwort „Teleosemantik“. Ob die Teleosemantik eine tragfähige Theorie ist, um den semantischen Gehalt mentaler Zustände zu naturalisieren, wird in Auseinandersetzung mit an ihr formulierter Kritik und deren Stichhaltigkeit erörtert, insbesondere mit der von Jerry Fodor, Wolfgang Detel, und Daniel Dennett. Der Schluss, welcher aus diesen Diskussionen gezogen wird, lautet dann, dass man sich an lebensweltlichen Praktiken der wechselseitigen Zuschreibung von Bedeutungen und Gedanken orientieren muss, um die normativen Eigenschaften des Geistigen richtig zu verstehen, weil die Normativität mentaler Gehalte relativ zu einer intersubjektiven, sprachlich verfassten Zuschreibungspraxis zu verstehen ist, die historisch gewachsen ist. Dennoch wird im Anschluss daran noch ein der Versuch der Naturalisierung von Geistigem, nämlich von Bewusstsein durch Peter McLaughlin untersucht. Dort wird der Frage nachgegangen, ob Lebewesen einen bestimmten Zweck beziehungsweise Telos haben, und damit Interessen und ein Wohl haben, dem förderlich zu sein, die Funktion phänomenalen Bewusstseins sein könnte, also etwa auch die Funktion von Emotionen. Dabei stoßen wir ein weiteres Mal im Verlauf dieses Buches auf die Renaissance aristotelischer Theorie, denn die Frage, was es heißt, dass ein Lebewesen ein Wohl hat, wird mit Verweis auf den aristotelischen Begriff des ergons versucht zu beantworten. Wie steht es mit dem ergon als dem Wohl eines Lebewesens und damit als Naturalisierungsgrundlage, wenn als charakteristische Tätigkeit des Organismus seine Selbsterhaltung oder Selbstproduktion angesehen wird? Und wie mit naturgegebenen Notwendigkeiten als Naturalisierungsgrundlage? Zum einen wird gezeigt, dass die meisten dieser Versuche im Bemühen um eine Reduktion wiederum normative Begriffe wie Wohl oder Interesse verwenden müssen. Zum anderen wird darauf verwiesen, dass der Mensch sich auf Grund selbst anerkannter genuiner Normen und Werte gegen natürliche Normen wie die der Selbsterhaltung entscheiden kann. (shrink)

Ethical problems regularly arise during daily care in nursing homes. These include violation of patients' right to autonomy and to be treated with respect. The aim of this study was to investigate how caregivers emphasize daily dialogue and mutual reflection to reach moral alternatives in daily care. The data were collected by participant observation and interviews with seven caregivers in a Norwegian nursing home. A number of ethical problems linked to 10 patients were disclosed. Moral problems were revealed as the (...) caregivers acted in ways that they knew were against patients' interest. We used a theoretical interpretation according to Habermas' discourse ethics on the importance of dialogue when deciding moral courses of action for patients. This theory has four basic requirements: communicative competence, equality, self-determination, and openness about motives. (shrink)

The Problem of Political Normativity Understood as Functional Normativity.

Excerpt: 1. Introduction This chapter provides insight into the diverse ethical debates on genetics and epigenetics. Much controversy surrounds debates about intervening into the germline genome of human embryos, with catchwords such as genome editing, designer baby, and CRISPR/Cas. The idea that it is possible to design a child according to one’s personal preferences is, however, a quite distorted view of what is actually possible with new gene technologies and gene therapies. These are much more limited than the editing and (...) design metaphors suggest. Such metaphors are therefore highly problematic phrases in the context of new gene technologies, for two reasons. On one hand, to design a child of choice by modifying the genome would require modifying any gene of choice, which is more than can be done with current gene technologies, such as CRISPR/Cas. On the other hand, a modification of genes would need to be enough to create any characteristic of choice in the future child. The latter presupposes the assumption of genetic determinism. Moreover, the CRISPR/Cas technology can not only be used in a potentially therapeutic manner at the germline level. In addition, there is the (more likely) scenario of a future clinical therapeutic use of these new gene technologies for modifying the DNA sequence of other cells of the body (somatic genome editing). There is also the option of modifying the epigenome, that is, the spatial configuration of DNA (epigenome editing) (see table 1). Like genetics and genome editing, epigenetics has been at the center of recent popular scientific and ethical discourse as well as scientific debates. The concept of epigenetics has given rise to very different notions of inheritability and responsibility for health, which, however, are oftentimes based on scientifically controversial basic assumptions. That there continues to be covert genetic determinism in the form of epigenetic determinism (see table 2) in debates about epigenetics has been pointed out in ethical analyses of epigenetics. Neither genetic determinism nor epigenetic determinism has been confirmed scientifically. It is therefore important to recognize the concepts that are discussed (and sometimes harshly criticized) in debates about genome editing and epigenetics—for example, concepts about the causal role of DNA for our own life course. This importance is based on the fact that if we understand such controversial concepts, we will be able to remain critical when evaluating scientific knowledge and ethical arguments about genome editing and epigenetics. This chapter, therefore, explains some of these concepts. For an ethical analysis of epigenetics as well as of genome editing, it is necessary to understand and critically reflect upon the underlying concepts of genetic determinism and other, related -isms. The following section offers a detailed introduction to these -isms (section 2; see also table 2). Section 3 provides an ethical analysis of genome editing and epigenetics based on the explanations in section 2. Section 3 focuses on inheritability and responsibility, justice, safety, the problem of consent, and the effects of genome editing and epigenetics on embryos and future generations. This section does not discuss in detail further points that can be found in ethical debates about epigenetics as well as in ethical debates about genome editing. These points include (among others): • fear that the findings of epigenetics and that the methods of genome editing are misused—this also with respect to eugenics and enhancement; • naturalness—an issue we mention in passing a few times in the following analysis; • a possible connection between the genome/epigenome and the concept of human dignity, and the derived danger of instrumentalization and infringement of autonomy when intervening in the genome or epigenome. Since current discourse about ethical issues associated with genome editing focuses mainly on germline interventions, which are, for instance, interventions into a human embryo’s genome, we mainly focus on germline interventions when comparing the debates on genome editing and on epigenetics in section 3. Little is know about how the GPs carry out their refusals in practice, how they perceive their refusal to fit with their role as professionals, and how refusals impact patients. Empirical data can inform subsequent normative analysis.

Nietzsche's notion of the Übermensch is one of his most famous. While he himself never defined or explained what he meant by it, many philosophical interpretations have been offered in secondary literature. None of these, however, has examined the significance of the notion for Nietzsche the man, and this essay therefore attempts to address this gap.The idea of the Übermensch occurred to Nietzsche rather suddenly in the winter of 1882-1883, when his life was in turmoil after yet another deep personal (...) setback. The early loss of his father had deprived Nietzsche of a meaningful “mirroring” and a chance to experience realistic, age appropriate disappointment. This left him with a lifelong tendency towards idealisation. It became his proverbial Achilles’ heel and the source of repeated disillusionments and sorrow. The Übermensch may thus have been a culmination of his impulse to create altars and worlds before which he could kneel. Trying to cope with his own vulnerability, Nietzsche evoked an ideal of the Übermensch, a mask of hardness that was designed, if unconsciously, to ward off any future assaults on his fragile self.The double aspect of Nietzsche's personality is explored in this essay. While a highly provocative, belligerent and uncompromising Nietzsche often emerges from his published works, a vulnerable, lonely and sometimes self-pitying Nietzsche lurks in his letters and the accounts of his friends and acquaintances. But could an “ideal of strength”, such as the Übermensch, serve as a protective mask for someone with a sensitive, passionate interior? Nietzsche's descent into madness would suggest that no ideal can be a substitute for human, all too human, compassion. (shrink)

Infants who suffer severe neglect fail to thrive emotionally as well as bodily. The absence of early coexistential structures that provide well-being leads to a narrowing of the child's perceptual and social developmental horizon. What is the nature of these early structures? In this essay, an ontology of well-being or housedness is elaborated through phenomenological reflections on breast-feeding and infant perception. Merleau-Ponty's ontology of the flesh makes a contribution to the ontology of well-being: it gives us a conceptual and evocative (...) language to describe human existence in its pre-verbal, syncretic, and non-dualistic manifestations. It also allows for a re-evaluation and re-interpretation of the results of current research in infant perception. Through the structures of infant perception we perceive the coexistential fit between infants, other human beings, and the world of things. An infant's fundamental housedness in the flesh is taken up and cultivated or destroyed by the child's social and cultural environment. (shrink)

Goethe belongs to the phenomenological tradition for a number of reasons: He shared Husserl's deep mistrust of the mathematization of the natural world and the ensuing loss of the qualitative dimension of human existence; he understood that the phenomenological observer must free him/herself from sedimented cultural prejudices, a process which Husserl called the epoche; he experienced and articulated the new and surprising fullness of the world as it reveals itself to the patient and participatory phenomenological observer. Goethe's phenomenological sensibilities and (...) insights become more apparent when his work is brought into dialogue with Husserl's thinking. In turn Goethe challenges Husserlian phenomenology to a more careful investigation of the natural world and human participation within its order. Both Goethe and Husserl are searching for a science of the qualitative dimension of being. (shrink)

The intent of this chapter is to suspend the belief in the goodness of literacy -- our chirographic bias -- in order to gain a deeper understanding of how the engagement with texts structures human consciousness, and particularly the minds of children. In the following pages literacy (a term which in this chapter refers to the ability to read and produce written text) is discussed as a consciousness altering technology. A phenomenological analysis of the act of reading shows the child’s (...) engagement with texts as a perceptual as well as a symbolic event that builds upon but also alters children’s speech acts. Speaking and reading are both forms of language use, but with different configurations of perceptual and symbolic qualities. Children’s literature uses textual technology and, intentionally or not, participates in structuring children’s pre-literate minds. Some of its forms, such as picture books and early readers, are directly intended to bridge the gap between the pre-literate listener and the literate reader and ease the transition into the literate state. It is my hope that the phenomenological analysis of the experiences of speaking and reading might help us understand more clearly how children’s literature impacts the minds of children. Such an analysis can awaken a critical awareness of the power that letters wield as they shape the reader’s psychological reality, and it can sharpen our sense of wonder about the metamorphosis of language from speaking to writing. In Moral Failure, Lisa Tessman argues against two principles of moral theory, that ought implies can and that normative theory must be action-guiding. Although Tessman provides a trenchant account of how we are thrust into the misfortune of moral failure, often by our very efforts to act morally, and although she shows, through a discussion well-informed by the latest theorizing in ethics, neuroethics, and psychology, how much more moral theory can do than provide action-guiding principles, I argue that the two (...) theses of moral theory that she disputes remain indispensable for ethical theory. This paper addresses the questions raised by the evidence presented that many cardinal psycho-analytic notions bear a strong resemblance to the ideas of Schopenhauer and Nietzsche. In the process, the author considers not only that the 19th century Zeitgeist, given its preoccupation with the unconscious, created a fertile ground for the birth of psychoanalysis, but the influence on the Weltanschauung of Freud, Schopenhauer and Nietzsche of their common German cultural heritage, their shared admiration for Shakespeare and love of Hellenic culture, (...) and the meteoric rise of science. Although influence may not be sharply separated from confluence, the parallels between Freud's concepts and those of Schopenhauer and Nietzsche are too specific to be coincidental. And yet, Freud vehemently denied ever having read these philosophers’ works until “very late in life”. It is suggested that an unconscious sense of guilt may have induced that denial.This study adopts a cross-sectional approach that juxtaposes Freud's cardinal concepts with the ideas of Schopenhauer and Nietzsche. Its tripartite structure has the advantage of observing similarities and differences not only between Freud and the two philosophers, but also between Nietzsche and Schopenhauer. The focal concepts include: the unconscious; ego, id and superego; libido; drives; repression; sublimation; dreams; catharsis; free association; primary and secondary process thinking; Oedipus complex; repetition compulsion; the pleasure principle; mourning and melancholia; a criminal from a sense of guilt; and the death instinct. Le langage égocentré et son dépassement par la parole. Une étude de l’acquisition du langage inspirée de Merleau-PontyDans les notes de travail du Visible et l’invisible, Merleau-Ponty se proposait d’élucider la nature du dépassement de l’être pré-langagier par la parole. Dans ses cours de la Sorbonne, il avait en outre jeté les fondements théoriques d’une confrontation fructueuse entre la linguistique et la psychologie de l’enfant, en ouvrant un dialogue de fond avec la théorie linguistique et avec les recherches psychologiques de (...) son époque sur l’acquisition du langage. Le phénomène de l’acquisition du langage par l’enfant nous fait assister à la transition de l’être pré-langagier à l’être parlant ; nous y trouvons l’occasion d’une mise en relation de l’incarnation perceptive et charnelle avec le corps parlant qui agit dans le champ symbolique.Cette étude reprend le projet de Merleau-Ponty, en s’appuyant sur les résultats récents de la recherche en matière de développement psycho-linguistique afin de mettre à l’épreuve les thèses merleau-pontiennes sur le langage. It is common for religiously motivated actions to be specially protected by law. Many legal theorists have asked why: what makes religion special? What makes it worthy of toleration over and above other non-religious deeply held convictions? The answer I put forward is that religions’ alleged afterlife consequences call for a principle of toleration that warrants special legal treatment. Under a Rawlsian principle of toleration, it is reasonable for those in the original position to opt for principles of justice that (...) accommodate actions with alleged afterlife consequences. And, under a utilitarian principle of toleration, a greater psychological harm is eased by such accommodations. Additionally, this alleged afterlife consequence is found in most of the religions that are thought to warrant some level of special toleration—not only do the Abrahamic religions have alleged afterlife consequences, but many eastern religions do as well, e.g. reincarnation. This is an abstract of a discussion of Martha Minow's article "Equalities" in APA Symposium Eastern Division 1991 .

What significance does the body have in the process of teaching and learning? In what way can the thoughts of a contemporary junior-level teacher in this regard be connected to the theory of the lived body formulated by the French phenomenologist philosopher Maurice Merleau-Ponty, and vice versa? The aim of this paper is to illuminate, enable understanding and discuss the meaning of the body in the learning process, with specific focus on the learning of writing as embodied experience. In the (...) process, the boundaries of learning are also explored. While understanding the significance both of learning as embodied experience and of the boundaries of learning is essential within the educational field, in this paper the discussion is limited to exploring how learning as embodied experience and the boundaries of learning can be viewed by taking Merleau-Ponty’s notions as theoretical starting points. In an attempt to answer the aim and connect the paper’s theoretical point of departure with a voice from a teacher, an interview with a junior-level teacher was conducted. The paper thus offers a theoretical contribution to the field of educational research, but one in which the theory is exemplified by, and connected to, a teacher’s voice. Accordingly, the paper concludes by summarising the common understandings of learning held theoretically by Merleau-Ponty and made real in the activities of the contemporary junior-level teacher. Carolyn Korsmeyer has offered some compelling arguments for the role of disgust in aesthetic appreciation. In the course of this project, she considers and holds up for justifiable criticism the account of emotional conversion proposed by David Hume in “Of Tragedy”. I will consider variant interpretations of Humean conversion and pinpoint a proposal that may afford an explanation of the ways in which aesthetic absorption can depend on and be intensified by the emotion of disgust.

This paper presents results of a qualitative study focussed on reconstructingcurrent reception processes of Tibetan Buddhist teachings and practicesas well as its representatives by the Swiss public since the mid 1990’s. Byexamining public discourses on Tibetan Buddhism in Switzerland, the paperaddresses issues concerning the social construction, representation and (re-)production of cultural and religious difference. It is argued that public receptionand representation of Tibetan Buddhism in the media clearly – even if implicitly– reflects disputes about conceptions of one’s own religious, cultural (...) and nationalidentity as well as about collectively shared values. It is shown that publicdiscourse on Tibetan Buddhism in Switzerland is characterized by opposingtendencies: on the one hand, it is clearly dominated by well-known positiveimages and stereotypes, which might be regarded as elements of an establishedrepertoire of knowledge about Tibet, Tibetans and the “World Religion of Buddhism”and which are reproduced as a matter of course within public discussionson the topic. On the other hand, nevertheless, these dominant topoi arecurrently being questioned by various social actors and on various levels. Theseefforts at deconstructing popular images and perceptions of Tibetan cultural andreligious traditions, however, have relatively small impact on wider social processesof constructing religious and cultural alterity – not nearly as much, forexample, as the construction of an Islamic “Other” culminating in the minaretreferendum of 2009.
