This paper presents the case of the post-crisis discursive defence of shadow banking in the Netherlands to argue, first, that there is a need to dust off older elite theories and adapt them to post-democratic conditions where there are no widely shared ‘political formulas’ to secure mass support for elite projects. Second, that temporality should be taken more seriously; it is when stories fail that elite storytelling can be observed in practice. As new ‘political formulas’ are minted and become established, (...) elites can again hope to withdraw from the political scene and leave policy-making to the self-evidence of output legitimacy and/or the perpetuum mobile of There-Is-No-Alternative. This suggests that elite theory should replace an epochal reading of post-democracy with a more conjunctural one. (shrink)

Department of Geography and Planning, University of Amsterdam, The Netherlands There is a growing sense of dissatisfaction among political philosophers with the practical sterility and empirical inadequacy of the discipline. Post-Rawlsian philosophy is wrestling with the need to construct a ‘contextualized morality’ that is sensitive to the particularities and complexities of actual moral reasoning but does not succumb to the temptations of relativism. We argue that this predicament is due to its inability to take the pluralism of our moral universe, (...) the multi-layeredness of our social reality, the indeterminacy of our normative principles and the complexity of our practical reasoning seriously. To incorporate these properties of the ‘human condition’ we have constructed a complex evaluative framework, balancing moral, ethico-political, prudential and realist criteria. We argue that political philosophy new style is well advised to adopt such a framework and to position itself, as a true ‘art’, between political philosophy old style and the social sciences. Thus political philosophy is better equipped to deal with the big tradeoffs of today, rekindle our utopian hopes and regain political bite. Since the late 1980s, social scientists have argued that advanced economies have undergone a process of financial concentration that is resulting in a growing unevenness of the accessibility of capital. Households, small and medium-sized businesses as well as non-standard economic activities have increasing difficulties in finding funds. There are both sound economic and compelling moral reasons to address this issue. In order to ensure a more equal accessibility of capital, the author proposes a mandatory levy on the surpluses of mainstream (...) pension funds to fund an alternative financial infrastructure as a first step to redressing unevenness. The underlying rationale is that “financial pluralism” is the key to a more even accessibility of capital. (shrink)

The author offers a conceptual investigation of the tension between openness and protection in well-developed welfare states. Because of a combination of demographic tendencies and labor market shortages, a growing number of European welfare states is currently exploring market-led immigration policies. However, the level of protection these welfare states offer seems hard to reconcile with the low threshold markets that are needed to incorporate newcomers. The author argues that the “solution”lies not so much in a clear political choice for either (...) but rather in the coordinated institutionalization of differentiated citizenship rights. The author illustrates this case with examples taken from the Dutch context, claiming further that the particular combination of corporatist welfare arrangements and the tradition of lenient enforcement in the Netherlands provides a “natural”habitat for the kind of regime pluralism that differentiated citizenship requires. We show that a first category homogeneous zero-dimensional Borel set X can be embedded in as an ideal on ω if and only if X is homeomorphic to X × X if and only if X is Wadge-equivalent to X × X. Furthermore, we determine the Wadge classes of such X, thus giving a complete picture of the possible descriptive complexity of Borel ideals on ω. We also discuss the connection with ideals of compact sets.

So‐called nudge policies utilize insights from behavioral science to achieve policy outcomes. Nudge policies try to improve people's decisions by changing the ways options are presented to them, rather than changing the options themselves or incentivizing or coercing people. Nudging has been met with great enthusiasm but also fierce criticism. This paper provides an overview of the debate on the ethics of nudging to date. After outlining arguments in favor of nudging, we first discuss different objections that all revolve around (...) the worry that nudging vitiates personal autonomy. We split up this worry into different dimensions of autonomy, such as freedom of choice, volitional autonomy, rational agency, and freedom as nondomination. We next discuss worries that nudging is manipulative, violates human dignity, and prevents more important structural reform. Throughout, we will present responses that proponents of nudging can muster. On the whole, we conclude that the objections fail to establish that the nudge program as a whole should be rejected. At the same time, they give us important guidance when moving towards an ethical assessment of nudges on a case‐by‐case basis. Towards the end, we provide some possible ways forward in debates around the ethics of nudging. (shrink)

Nach Platon „vermittelt“ die Philosophie als Kunst der Dialektik durch Dialog zwischen Begriffen und Disziplinen. Um dies zu zeigen, wird hier eine Lektüre von Platons Symposion vorgestellt, in der das Verhältnis der Disziplinen mit Wissens- und Erziehungsanspruch in Platons Zeit beleuchtet wird. Jede Rede des Symposions ist wie eine Stellungnahme in einem Dialog zu verstehen, so dass das Gesamtwerk als sieben Reden zu lesen sind, die dialogisch aufeinander verweisen. Die Grundannahme dieser Lektüre besagt, dass den einzelnen Reden verschiedene Wissenschaften oder (...) Künste zuzuordnen sind, die einen Wissens- und Erziehungsanspruch vertreten, und dass der in der Rede vorgestellte und verteidigte Liebesbegriff jeweils der dieser Disziplin entsprechende ist. Die unterschiedliche Begriffsbestimmung in den einzelnen Wissenschaften und Künsten nehmen indirekt aufeinander Bezug, widersprechen sich und ergänzen sich. Die Fragen, welche Platon im Symposion diskutiert, betreffen nicht nur die Erkenntnistheorie, Ideenlehre, Rolle des Dialogs für die Philosophie, Fragen der Erziehung und der Kreativität, sondern auch ein Problem, das sich durch die bereits in Platons Zeiten aufkommende Ausdifferenzierung der Disziplinen und Wissenschaften ergibt. Welcher der Disziplinen mit Wissens- und Erziehungsanspruch kommt der Führungsanspruch in Bezug auf die Jugend und damit die Gesellschaft sowie das Wissen zu? Das Angebot Platons um diese Frage zu beantworten und die unterschiedlichen Begriffsbestimmungen und Begriffsangebote zu vereinen, besteht in einer komplizierten Konstruktion. Ein Teil der Antwort bezieht die Philosophie (Eros, Sokrates) und den philosophischen Dialog, für den der Eros unabdingbar ist, direkt mit ein. Im philosophischen Dialog sollten die Begriffsmerkmale ausfindig gemacht werden, die für einen Begriff und seine Bedeutung unabdingbar ist. Dieser Dialog wird aber nicht ausschließlich zwischen Diotima und Sokrates geführt. Er hat ebenso wie die dialogisch aufeinander bezogenen Reden der gesamten Schrift eine Vorbildfunktion. Dieser indirekte Dialog, der durch Abstimmung der Reden zueinander „geführt“ wird, enthält einen weiteren Tel der Antwort. Der eigentliche „Dialog“ muss aber schließlich zwischen der Leserin und dem „Symposion“ stattfinden. (shrink)

The history of twentieth-century American psychology is often depicted as a history of the rise and fall of behaviorism. Although historians disagree about the theoretical and social factors that have contributed to the development of experimental psychology, there is widespread consensus about the growing and declining influence of behaviorism between approximately 1920 and 1970. Since such wide-scope claims about the development of American psychology are typically based on small and unrepresentative samples of historical data, however, the question rises to what (...) extent the received view is justified. This paper aims to answer this question in two ways. First, we use advanced scientometric tools to quantitatively analyze the metadata of 119.278 papers published in American journals between 1920 and 1970. We reconstruct the development and structure of American psychology using co-citation and co-occurrence networks and argue that the standard story needs reappraising. Second, we argue that the question whether behaviorism was the ‘dominant’ school of American psychology is historically misleading to begin with. Using the results of our bibliometric analyses, we argue that questions about the development of American psychology deserve more fine-grained answers. (shrink)

Nudges have been criticized for working ‘in the dark’, influencing people without their full awareness. To assess whether this property renders nudging an illegitimate policy tool in liberal democracies, we argue that in scrutinizing nudge transparency, we should adequately divide our focus between nudging techniques, the nudgers employing them, and the nudgees subjected to them. We develop an account of what it means for nudgees to be ‘watchful’, a disposition that enables them to resist and circumvent nudges. We argue that (...) such ‘watchfulness’ should be cultivated if we want to implement nudges in legitimate, accountable, and democratic ways. (shrink)

This chapter critically analyses the ethical and political dimensions of supposedly subtle and non-coercive interventions that aim to ‘prevent crime’ through environmental designs making certain public spaces less attractive for specific groups. Examples include benches designed to discourage sleeping (targeted at homeless people), high-pitched noises or classical music played to deter lingering (targeted at youngsters), and specific lighting to prevent aggression (targeted at nightlife). While these interventions may appear less problematic than more traditional exclusionary measures, they raise ethical and political (...) worries that come into view clearly when we analyse them as instances of nudging, on the one hand, and niche construction and affective scaffolding, on the other. Employing this approach reveals how these exclusionary environmental designs not only risk reinforcing problematic stereotypes and social inequalities and discipline rather than prevent crime, they also can alienate specific groups, constitute affective injustices, and inflexibly reduce the diverse purposes public spaces potentially have. The chapter argues that environments are never neutral as they inevitably support and encourage some bodies, behaviours, moods, and emotions while suppressing and discouraging others. (shrink)

Health-promoting nudges have been put into practice by different agents, in different contexts and with different aims. This article formulates a set of criteria that enables a thorough ethical evaluation of such nudges. As such, it bridges the gap between the abstract, theoretical debates among academics and the actual behavioral interventions being implemented in practice. The criteria are derived from arguments against nudges, which allegedly disrespect nudgees, as these would impose values on nudgees and/or violate their rationality and autonomy. Instead (...) of interpreting these objections as knock-down arguments, I take them as expressing legitimate worries that can often be addressed. I analyze six prototypical nudge cases, such as Google’s rearrangement of fridges and the use of defaults in organ donation registration. I show how the ethical criteria listed are satisfied by most—but not all—nudges in most—but not all—circumstances. (shrink)

One of the most pervasive criticisms of nudges has been the claim that they violate, undermine or decrease people’s autonomy. This claim, however, is seldom backed up by an explicit and detailed conception of autonomy. In this paper, we aim to do three things. First, we want to clear up some conceptual confusion by distinguishing the different conceptions used by Cass Sunstein and his critics in order to get clear on how they conceive of autonomy. Second, we want to add (...) to the existing discussion by distinguishing between ‘autonomy’ as the ability to set your own ends and ‘autocracy’ as the ability to actually realize those ends. This will allow for a more careful ethical evaluation of specific nudge interventions. Third, we will introduce the idea of ‘perimeters of autonomy’ in an attempt to provide a realistic account of personal autonomy and we will argue that it can alleviate most of the worries about nudging being autonomy-undermining.
