In our article, we share the lessons we have learned after creating and running a successful legal laboratory over the past seven years at Yale Law School. Our legal laboratory, which focuses on the intersection of law and severe brain injury, represents a unique pedagogical model for legal academia, and is closely influenced by the biomedical laboratory.

In 2016, the Colorado legislature passed an amendment to Colorado’s medical proxy law that established a process for the appointment of a physician to act as proxy decision maker of last resort for an unrepresented patient (Colorado HB 16-1101: Medical Decisions For Unrepresented Patients). The legislative process brought together a diverse set of stakeholders, not all of whom supported the legislation. Following passage of the statutory amendment, the Colorado Collaborative for Unrepresented Patients (CCUP), a group of advocates responsible for initiating (...) the legislative process, coordinated a unique effort to engage these stakeholders in the creation of a set of voluntary guidelines to assist facilities and individual careproviders in the implementation of policies and procedures enabled by the statute. This article delineates the questions and concerns of stakeholders, describes how those issues were addressed within the guidelines, and proposes additional opportunities for research to assess the impact of the legislation in Colorado. In recent years, there has been an increase in environmental awareness in the United States, leading to steady growth in environmentally conscious consumerism. Looking specifically at green home marketing, understanding the consumer behavior of the next generation of homebuyers, Generation Z (GenZ), is important for environmental and business reasons. This study surveyed 116 university students to explore the influence of specific barriers and types of motivation (intrinsic, instrumental, and non-normative) on their perceptions of green homes. Our findings suggest certain barriers (...) have more influence on GenZ consumers than others, with the perceived lack of choice in selecting Green Home Features (GHFs) as the top barrier, followed by a lack of information about GHFs, and then the perceived effort to analyze GHFs. Furthermore, for GenZ consumers, intrinsic and non-normative motivations seem to significantly affect their willingness to buy green homes, whereas instrumental motivation does not. Our findings expand on previous studies on green consumer behavior to provide a new benchmark for understanding GenZ’s consumer behavior, specifically towards green homes. Our results can be used by marketers and policymakers to study future home trends, attract more potential buyers to green homes, and help create a sustainable environment for future generations. Of the various forms of life writing with which the present collection is concerned, I want in this chapter to devote my attention to the genre of the memoir (and so the autobiographical), and its relation to the seemingly sharply contrasting literary genre of the novel (insofar as the former is understood as a mode of writing concerned with the recounting of the facts or reality of a particular human life, and the latter is understood as concerned only with the (...) appearance of such lives, with the essentially unreal or fictional). Of course, the recent interest in what is termed ‘autofiction’ has served to raise once again the question of the distinction between the memoir and the novel; but rather than engage with that discussion, I want here to focus instead on a particular author’s explicit critical response to that distinction, insofar as it has persistently marked the reception of his work. -/- In a recent lecture, the acclaimed novelist Amit Chaudhuri replied to an accusation that has greeted his fiction from the start of his literary career: that since his novels contain people and events drawn from his own life, they are better thought of as thinly disguised memoirs—as not really novels at all. To examine this charge, I want to draw on an account by the philosopher Stephen Mulhall of the work of another celebrated novelist—J.M. In particular, I want to establish the pertinence to Chaudhuri’s lecture of Mulhall’s analogy between aspects of that work and the work of the influential art historian and critic Michael Fried on the history of modernist painting. In so doing, I aim to show that the commitment to the projects of literary modernism and realism which Mulhall finds in Coetzee (and Costello), can also be found in Chaudhuri’s understanding of the sense in which his novels both are, and are not, autobiographical. Interpretations of the ethical significance of the Bhagavadgītā typically understand the debate between Arjuna and Kṛṣṇa in terms of a struggle between consequentialist and deontological doctrines. In this paper, I provide instead a reading of the Gītā which draws on a conception of moral thinking that can be understood to cut across those positions – that developed by Stanley Cavell, which he calls ‘Emersonian Moral Perfectionism’. In so doing, I emphasise how Kṛṣṇa’s consolation of Arjuna can centrally and fruitfully be (...) viewed as concerned with resuscitating the latter’s individuality, thereby allowing Arjuna to overcome an unthinking conformity to the current degenerate state of his society. This leads me to explore the relation between this perfectionist understanding of spiritual reorientation and the Gītā’s religious account of human redemption; and to conclude by suggesting how the text of the Gītā itself might have similar therapeutic designs upon its readers. _In _Diverse Families, Desirable Schools_, Mira Debs offers a richly detailed study of public Montessori schools, which make up the largest group of progressive schools in the public sector._ As public Montessori schools expand rapidly as alternatives to traditional public schools, the story of these schools, Debs points out, is a microcosm of the broader conflicts around public school choice. Drawing on historical research, interviews with public Montessori educators, and ethnographic case studies, Debs explores the forces that pull intentionally diverse, (...) progressive schools toward elitism. At the heart of Debs’s book is a thoughtful analysis of the notion of “fit” between parents and schools—an idea that is central to school choice, which is often marketed as an opportunity for parents to find the perfect fit for their kids. By exploring parents’ varied motivations in choosing these schools and observing how families experience—or fail to experience—a “good fit” _after_ having chosen a particular school, Debs makes an original contribution to the literature on school choice and sheds light on the dilemmas entailed in maintaining diversity in progressive charter and magnet schools. Experiential evidence shows that pain is associated with common meanings. These include a meaning of threat or danger, which is experienced as immediately distressing or unpleasant; cognitive meanings, which are focused on the long-term consequences of having chronic pain; and existential meanings such as hopelessness, which are more about the person with chronic pain than the pain itself. This interdisciplinary book - the second in the three-volume Meanings of Pain series edited by Dr Simon van Rysewyk - aims to better (...) understand pain by describing experiences of pain and the meanings these experiences hold for the people living through them. The lived experiences of pain described here involve various types of chronic pain, including spinal pain, labour pain, rheumatic pain, diabetic peripheral neuropathic pain, fibromyalgia, complex regional pain syndrome, endometriosis-associated pain, and cancer-related pain. Two chapters provide narrative descriptions of pain, recounted and interpreted by people with pain. Language is important to understanding the meaning of pain since it is the primary tool human beings use to manipulate meaning. As discussed in the book, linguistic meaning may hold clues to understanding some pain-related experiences, including the stigmatisation of people with pain, the dynamics of patient-clinician communication, and other issues, such as relationships between pain, public policy and the law, and attempts to develop a taxonomy of pain that is meaningful for patients. Clinical implications are described in each chapter. This book is intended for people with pain, their family members or caregivers, clinicians, researchers, advocates, and policy makers. (shrink)

Published accounts of specific priority-setting projects in healthcare are relatively few. This article chronicles the collaborative efforts of a professional practice lead and a bioethicist to strengthen the priority-setting process for a specific home care service. The project included two features not often reported in other priority-setting projects: the entire “frontline team” was involved for the project’s duration, and a group of parents was canvassed for their views. Informed by both Daniels’s “accountability for reasonableness” approach and challenges levied against it, (...) the article explains the evolution of an assessment procedure, eligibility and priority criteria, and guiding substantive principles and concludes with the “lessons learned” by the project leads. We introduce a computational theory of situated language understanding in which the meaning of words and utterances depends on the physical environment and the goals and plans of communication partners. According to the theory, concepts that ground linguistic meaning are neither internal nor external to language users, but instead span the objective‐subjective boundary. To model the possible interactions between subject and object, the theory relies on the notion of perceived affordances: structured units of interaction that can be used for prediction (...) at multiple levels of abstraction. Language understanding is treated as a process of filtering perceived affordances. The theory accounts for many aspects of the situated nature of human language use and provides a unified solution to a number of demands on any theory of language understanding including conceptual combination, prototypicality effects, and the generative nature of lexical items.To support the theory, we describe an implemented system that understands verbal commands situated in a virtual gaming environment. The implementation uses probabilistic hierarchical plan recognition to generate perceived affordances. The system has been evaluated on its ability to correctly interpret free‐form spontaneous verbal commands recorded from unrehearsed game play between human players. The system is able to “step into the shoes” of human players and correctly respond to a broad range of verbal commands in which linguistic meaning depends on social and physical context. We quantitatively compare the system's predictions in response to direct player commands with the actions taken by human players and show generalization to unseen data across a range of situations and verbal constructions. Heidegger’s philosophy is a significant contribution to understanding the meaning of lived experience. Recognizing this, nurses and other health professionals have taken on the research approach of Heideggerian hermeneutic phenomenology. This requires reading the writing of Heidegger. Philosophers themselves acknowledge this writing is dense, difficult to grasp, uses language for which there is no easy translation, and leaves the reader with more questions than answers. Drawing on commentary from philosophers who seek to read Heidegger and from a research study which (...) interviewed doctoral students who were “reading Heidegger,” we seek to show the nature of the experience of pursuing such a challenging quest. The problem of representing a single localized particle has played a crucial role in the historical development of quantum theories. In particular, the failure to construct a relativistically invariant position eigenstate was a contributing factor in the demise of the so-called relativistic quantum mechanics, in favor of quantum field theories. Nevertheless, non-locality which stems from standard accounts of Single-particle localization still presents itself as a problem in the form of Gerhard Hegerfeldt's eponymous theorem of 1974. Accepting that a link may (...) be maintained between invariance and 'objectivity,' it is shown how Hegerfeldt's paradoxical result arises in relativistic theories from a failure of objectivity of localization-the so-called 'Jericho effect'. In this article, I claim that Sam Mendes' Revolutionary Road is a recent version of the film genre that Stanley Cavell calls the “melodrama of the unknown woman”. Accordingly, my discussion focuses on two key elements of that identification: the film's overriding dramatic and thematic emphasis on conversation; and the central characters’ relation to the wider social and political concerns of America.

This article challenges the historical directionality of women’s knowledge and experience from the global north to the global south. It situates Moroccan feminist literature by Leila Abouzeid and Malika Oufkir within a transnational comparative approach to argue that reversing such flows – northward instead of southward – enables defamiliarising feminist theory as we know it to refamiliarise it for feminist praxis. Drawing on Obioma Nnaemeka’s African feminist philosophy, the article engages in a literary analysis to articulate a theory of ‘chameleon (...) feminism’ for illuminating how global south women’s stories connect rooms, arenas and fields for a praxis of resilience against authoritarianism. As one of the Sloan Foundation's original New Liberal Arts grantees, Williams College has developed a variety of approaches to improve quantitative reasoning and technological literacy, including creating interdisciplinary courses, computer and mathematical workshops, and an STS program. Further development, however, depends critically on what technological literacy may mean in a liberal arts context. Attempts to promote technological literacy, whether in liberal arts settings or not, are likely to founder unless they take account of the complexity and context dependent nature (...) of technological literacy, as well as its history, and its relationship to scientific literacy. English and Literacies: Learning to make meaning in primary classrooms is an accessible resource that introduces pre-service teachers to the many facets of literacies and English education for primary students. Addressing the requirements of the Australian Curriculum and the Early Years Learning Framework, English and Literacies explores how students develop oracy and literacy. Reading, viewing and (...) writing are discussed alongside the importance of children's literature. Taking an inclusive and positive approach to teaching and learning for all students, it explores the creation of texts using spelling, grammar in context and handwriting/keyboarding skills, as well as the need for authentic assessment and reporting. Medical decision making on behalf of unrepresented patients is one of the most challenging ethical issues faced in clinical practice. The legal environment surrounding these patients is equally complex. This article describes the efforts of a small coalition of interested healthcare professionals to address the issue in Colorado. A brief history of the effort is presented, along with discussion of the legal, ethical, practical, and political dimensions that arose in Colorado’s effort to address decision making for unrepresented patients through an (...) extension of the existing Colorado Medical Treatment Decision Act (CRS 15-18). I reconstruct the civic republican foundations of Eugene Debs’s socialist critique of capitalism, demonstrating how he uses a neo-roman conception of freedom to condemn waged labour. Debs is also shown to build upon this neo-roman liberty in his socialist republican objections to the plutocratic capture of the law and threats of violence faced by the labour movement. This Debsian socialist republicanism can be seen to rest on an ambitious understanding of the demands of citizen sovereignty and civic solidarity. While Debs (...) shares some of the commitments of earlier American labour republican critics of capitalism, he departs from them in his thoroughgoing commitment to common democratic ownership of productive property. His socialist republicanism remains valuable today for its ability to illuminate features of plutocratic control, judicial autocracy, and the regime of property best suited to suppressing economic domination. I conclude that Debs not only deserves a prominent place in an emerging radical republican canon but presents a distinctive contrast with many of his Marxist contemporaries and offers a compelling challenge to recent liberal, plebeian, and socialist forms of republicanism. We are living in an age when ‘everything is coming apart at the seams’, as the poet and painter Erna Rosenstein put it. Given this, I analyse the concept of the débâcle formulated and used by the French phenomenologist François-David Sebbah to explore the philosophy of Emmanuel Lévinas. The débâcle connotes catastrophe, fracture, failure, collapse and disintegration, but its semantic range also encompasses the breaking up of ice, escape and ruin. As Sebbah dissects this concept in the context of the (...) philosophy of Lévinas, it comes to tie in with ‘the anonymous rustling of the there is (il y a)’, the abyss of being. Besides discussing the débâcle in the context of Lévinas’s philosophy, I will explore how this concept is relevant to the description of the present, in particular to artistic practices interpretable as revealing the unsteady rhythm of phenomena from which a fragile and unstable structure of meaning emerges. I will also ponder whether thus-conceived the débâcle is perhaps a paradigmatic figure of the present day. (shrink)

This review is a critical discussion of three main claims in Debs and Redhead’s thought-provoking book Objectivity, Invariance, and Convention. These claims are: (i) Social acts impinge upon formal aspects of scientific representation; (ii) symmetries introduce the need for conventional choice; (iii) perspectival symmetry is a necessary and sufficient condition for objectivity, while symmetry simpliciter fails to be necessary.

We examine the impact of Suzumura’s (Economica 43:381–390, 1976) consistency property when applied in the context of collective choice rules that are independent of irrelevant alternatives, neutral, and monotonic. An earlier contribution by Blau and Deb (Econometrica 45:871–879, 1977) establishes the existence of a vetoer if the collective relation is required to be complete and acyclical. The purpose of this paper is to explore the possibilities that result if completeness and acyclicity are dropped and Suzumura consistency is imposed instead. A (...) conceptually similar but logically independent version of the combined axiom that requires the collective decision mechanism to be independent, neutral, and monotonic is employed. In the case of a finite population, we obtain an alternative impossibility theorem if a collective choice rule is assumed to be non-degenerate and a modified no veto requirement is imposed instead of Blau and Deb’s (1977) condition. If the population is countably infinite, the impossibility can be avoided but it resurfaces if our new no veto property is extended to a coalitional variant. (shrink)

Her evocative claim turns on a distinction between a game and the idea of a game, which evolved out of Bernard Suits’s phenomenally underappreciated work The Grasshopper: Games, Life and Utopia. She advances this position by way of a (...) technical argument that employs Suits’s discussion of “prelusory” goals and “lusory” attitudes. The word “lusory” generally means sporty or playful; and in Suits’s sense, it means that when we engage in the play of chess, we must enter the lusory attitude. She uses the notion of a prelusory goal to argue that such goals exist in a game (in this case, a game of chess) but not at all in the idea of the game (in the idea of chess).”. (shrink)

However, if is of degree exactly two, then is always Borel. A deep result of (...) G. Debs implies that contains a Borel cofinal set and this gives a tree-representation of . We show that classical ordinal assignments of Baire-1 functions are actually -ranks on . Richard Janko's acclaimed translation of Aristotle's _Poetics_ is accompanied by the most comprehensive commentary available in English that does not presume knowledge of the original Greek. Two other unique features are Janko's translations with notes of both the _Tractatus Coislinianus_, which is argued to be a summary of the lost second book of the Poetics, and fragments of Aristotle’s dialogue On Poets, including recently discovered texts about catharsis, which appear in English for the first time.

During the years leading up to World War I, America experienced a crisis of civic identity. How could a country founded on liberal principles and composed of increasingly diverse cultures unite to safeguard individuals and promote social justice? In this book, Jonathan Hansen tells the story of a group of American intellectuals who believed the solution to this crisis lay in rethinking the meaning of liberalism. Intellectuals such as William James, John Dewey, Jane Addams, Eugene V. Debs, and W. E. (...) B. Du Bois repudiated liberalism's association with acquisitive individualism and laissez-faire economics, advocating a model of liberal citizenship whose virtues and commitments amount to what Hansen calls cosmopolitan patriotism. Rooted not in war but in dedication to social equity, cosmopolitan patriotism favored the fight against sexism, racism, and political corruption in the United States over battles against foreign foes. Its adherents held the domestic and foreign policy of the United States to its own democratic ideals and maintained that promoting democracy universally constituted the ultimate form of self-defense. Perhaps most important, the cosmopolitan patriots regarded critical engagement with one's country as the essence of patriotism, thereby justifying scrutiny of American militarism in wartime. Rapid industrialization with little regulation stimulated a wide array of critiques of unrestrained capitalism and grassroots movements for economic justice in Europe and North America in the late nineteenth and early twentieth centuries. The article discusses two bioart projects that bring the symbolically core human substances of blood, sweat and tears into technologically mediated relationships with plants and fungi to explore human kinship with other species: Tarah Rhoda’s BS&T (short for ‘blood, sweat and tears’) and OurGlass, and Saša Spačal’s MycoMythologies: Patterning. The article analyses the art projects through the lens of the molecular gaze and different perspectives on kinning, bringing anthropological conceptualizations of kinship together with Haraway’s pathways to connect with other species. (...) How can bioart use technologies to explore interspecies kinship through a molecular gaze? And may such artworks contribute to the toning down of human exceptionality in the face of a precarious future? We find that artworks providing a molecular gaze on interspecies biological processes may risk a decontextualized approach to complex relational processes but may also create new visions of filiation even with biological organisms imagined to be genetically distant from humans, thus spurring awareness of the fragile interrelationships among species. Introduction:To meet and take care of people with dementia implicate professional and moral challenges for caregivers. Using force happens daily. However, staff also encounter challenges with the management in the units. Managing the caretaking function is also significant in how caretakers experience working in dementia care.Purpose:The purpose of this study is to explore the caregiver’s experiences with ethical challenges in dementia care settings and the significance of professional leadership in this context.Method:The design is qualitative, and data appear through narrative interviews. (...) A total of 23 caretakers participated in the study. The transcribed interviews were subjected to a phenomenological-hermeneutical interpretation.Ethical considerations:The respondents signed an informed consent for participation prior to the interviews. They were assured anonymity and confidentiality in the publication of the data. Ricoeur’s method for interpretation ensures anonymity as the researcher relates to the data as one collective text. The study is part of a larger research project in ethics, in its entirety approved in line with the Helsinki Convention.Results:The findings show that the caretakers experienced inadequacy. Some of them described a negative work atmosphere where they experienced that their leaders did not take them seriously. Because of this, informal negative sub-groups functioned as an exclusive debriefing arena. Some of the informants described the opposite experience where the leaders actively supported them.Discussion:The analyses of the findings are discussed in light of the concepts of trust and mistrust in leadership.Conclusion:There is a correlation between the leadership and the caregivers’ experience of being in difficult situations.
