It is becoming widely recognized that dissemination of research results to participants is an important action for the conclusion of a research study. Most research institutions have standardized consent documents or templates that they require their researchers to use. Consent forms are an ideal place to indicate that results of research will be provided to participants, and the practice of inserting statements to this effect is becoming more conventional. In order to determine the acceptance of this practice across Canada we (...) conducted an assessment of 121 institutional consent document templates from 65 institutions looking for language that endorsed results dissemination to participants. About half of the documents we examined had language included which stated that results should be made available. Documenting capacity assessments and identifying substitute decisionmakers in healthcare facilities is ethically required for optimal patient care. Lack of such documentation has the potential to generate confusion and contention among patients, their family members, and members of the healthcare team. An overview of our research at the Ottawa Hospital and issues that influence the consistency of documentation in the Canadian context are presented here, as well as ideas for the mitigation of these issues and ways to encourage better documentation.

Ethics consultation services provide support to staff, patients, and family members who find themselves in morally difficult situations in healthcare settings. Not unlike other clinical consultation services, ethics consultation activities should be well documented. Good documentation allows for evaluation of the consultation process and the ability to refer back to consults when needed, and provides data for future research in healthcare ethics (HCE).In our exploration of existing HCE documentation systems, we identified two main points of interest. First, HCE information documentation (...) systems are powerful tools for providing information on ethics consultation services. These documentation systems can be used to produce detailed reports on various HCE activities both institutionally and cross-institutionally. Second, our findings indicate greater agreement in the language and terminology of HCE needs to be established. Cultivation of such common language is needed in order to develop a standard healthcare ethicists can use to document and categorize consults. Standardization of language would allow data to be readily comparable and lead to more consistency in documentation of ethics consultations. Ultimately, standardization of documentation can also constitute a standard of practice for HCE in general. The development of such standards is essential for any developing profession, and will be required for HCE as it moves in towards professionalization in Canada. (shrink)

Two philosophers, Robert Spaemann and Henri Gouhier, have identified a similarity between Fénelon and Kant in the prominence of motive in their thought: disinterestedness in Fénelon's pure love and in Kant's good will. Spaemann emphasizes their common detaching of the ethical in terms of motivation from the context of happiness. In this article I explore further similarities and differences under the topics of perfectionism, pure love, good will, happiness, and disinterestedness, as these are pertinent to their thought. On perfectionism there (...) appears a stark contrast; on pure love over against good will, on happiness, and on disinterestedness, however, there seems a balance between likenesses and differences. Then the question of ability to ‘do otherwise’ is discussed, which has held a fascination for many in regard (...) to free choice. Our ability to learn to choose rationally is key here, to becoming able to choose well and (hence) freely, freedom being understood realistically. A developed rationality is necessary for maximal free choice, and (as argued here) is also key to the justification of the practice of holding persons responsible for their actions – a practice which is both necessary (socially indispensable) and capable of being justified, on both moral and pragmatic grounds. Lockdown measures in response to the COVID-19 pandemic involve placing huge burdens on some members of society for the sake of benefiting other members of society. How should we decide when these policies are permissible? Many writers propose we should address this question using cost-benefit analysis, a broadly consequentialist approach. We argue for an alternative non-consequentialist approach, grounded in contractualist moral theorising. The first section sets up key issues in the ethics of lockdown, and sketches the apparent appeal of addressing (...) these problems in a CBA frame. The second section argues that CBA fundamentally distorts the normative landscape in two ways: first, in principle, it allows very many morally trivial preferences—say, for a coffee—might outweigh morally weighty life-and-death concerns; second, it is insensitive to the core moral distinction between victims and vectors of disease. The third section sketches our non-consequentialist alternative, grounded in Thomas Scanlon’s contractualist moral theory. On this account, the ethics of self-defence implies a strong default presumption in favour of a highly restrictive, universal lockdown policy: we then ask whether there are alternatives to such a policy which are justifiable to all affected parties, paying particular attention to the complaints of those most burdened by policy. In the fourth section, we defend our contractualist approach against the charge that it is impractical or counterintuitive, noting that actual CBAs face similar, or worse, challenges. (shrink)

Blackshaw and Hendricks have recently developed and defended the impairment argument against abortion, arguing that the immorality of giving a child fetal alcohol syndrome (FAS) provides us with reason to believe that abortion is immoral. In this paper, we forward two criticisms of the impairment argument. First, we highlight that, as it currently stands, the argument is very weak and accomplishes very little. Second, we argue that Blackshaw and Hendricks are fundamentally mistaken about what makes giving a child FAS immoral. (...) The development of technologies for gene editing in the wild has the potential to generate tremendous benefit, but also raises important concerns. Using some form of public deliberation to inform decisions about the use of these technologies is appealing, but public deliberation about them will tend to fall back on various forms of heuristics to account for limited personal experience with these technologies. Deliberations are likely to involve narrative reasoning—or reasoning embedded within stories. These are used to help people discuss (...) risks, processes, and fears that are otherwise difficult to convey. In this article, we identify three forms of collective narrative that are particularly relevant to debates about modifying genes in the wild. Our purpose is not to privilege any particular narrative, but to encourage people involved in deliberations to make these narratives transparent. Doing so can help guard against the way some narratives—referred to here as “crafted narratives”—may be manipulated by powerful elites and concentrated economic interests for their own strategic ends. This paper explores the role of ideology in attempts to influence public policy and in business representation in the EU–China solar panel anti-dumping dispute. It exposes the dynamics of international activity by emerging-economy multinationals, in this case from China, and their interactions in a developed-country context. Theoretically, the study also sheds light on the recent notion of ‘liability of origin’, in addition to the traditional concept of ‘liability of foreignness’ explored in international business research, in relation to firms’ market and (...) political strategies and their institutional embeddedness in home and host countries. Through a qualitative analysis of primary and secondary materials and interview data with key protagonists, we provide a detailed evolution of the case, the key actors involved and their positions, arguments and strategies. This illustrates the complexities involved in the interaction between markets and ideologies in the midst of debates regarding different forms of subsidy regimes for renewable energy, free trade versus protectionist tendencies by governments, and the economic and sustainability objectives of firms and societies. The case shows how relative newcomers to the EU market responded to overcome a direct threat to their business and became, with support from their home government, active participants in the public debate through interactions with local commercial partners and non-governmental organisations. Firms adopted relatively sophisticated strategies to reduce their liabilities vis-à-vis host-country institutions and local stakeholders, including collective action, to increase their legitimacy and reputation, and counter ideologically based attacks. Recent revisions in child support and paternity establishment legislation enacted under the 1996 welfare reform act, the Personal Responsibility and Work Opportunity Reconciliation Act, significantly alter the American welfare state's relationship to men's fathering. Through a critical review of prior research and social service literature, the authors argue that PRWORA actively constructs fatherhood not only through state policies that maintain males as “breadwinners” but also through state-sponsored social service programs that seek to influence men's identities as fathers. PRWORA's policies and (...) their accompanying discourses simultaneously reproduce and undermine gender hierarchy yet tacitly maintain structural race and class inequalities. (shrink)

Many popular business strategies, such as re-engineering, core competency, and value engineering, may achieve short-term profits by antagonizing workers and alienating customers. We contend that self-actualized companies must create an ethical business environment grounded in three ethical principles. To suggest these principles, which characterize all "volitionist companies", we first review two typical problems and the questionable ways that some companies resolved them. Then, we discuss these principles and compare "volitionism" to three well- known normative ethical theories. In this article, we aim to map out the complexities which characterise debates about the ethics of vaccine distribution, particularly those surrounding the distribution of the COVID-19 vaccine. In doing so, we distinguish three general principles which might be used to distribute goods and two ambiguities in how one might wish to spell them out. We then argue that we can understand actual debates around the COVID-19 vaccine – including those over prioritising vaccinating the most vulnerable – as reflecting disagreements (...) over these principles. Finally, we shift our attention away from traditional discussions of distributive justice, highlighting the importance of concerns about risk imposition, special duties, and social roles in explaining debates over the COVID-19 vaccine. We conclude that the normative complexity this article highlights deepens the need for decision-making bodies to be sensitive to public input. (shrink)

This article addresses gender differences in laughter and smiling from an evolutionary perspective. Laughter and smiling can be responses to successful display behavior or signals of affiliation amongst conversational partners—differing social and evolutionary agendas mean there are different motivations when interpreting these signals. Two experiments assess perceptions of genuine and simulated male and female laughter and amusement social signals. Results show male simulation can always be distinguished. Female simulation is more complicated as males seem to distinguish cues of simulation yet (...) judge simulated signals to be genuine. Females judge other female’s genuine signals to have higher levels of simulation. Results highlight the importance of laughter and smiling in human interactions, use of dynamic stimuli, and using multiple methodologies to assess perception. (shrink)

This is the concern that positing such elusive narrators gives rise to absurd imaginings (Gaut 2004: 242; Carroll 2006: 179-180). -/- Friends of the implied cinematic narrator reply that the questions critics raise about the workings of the implied cinematic narrator are "silly ones" to ask. -/- I examine how the "absurd imaginings" problem arises for all the central (...) arguments for the elusive cinematic narrator and discuss why the questions critics pose about this narrator are legitimate ones to ask. This article conducts a mixed-method content analysis of Chinese and American news media coverage of Google DeepMind’s Go playing computer program, AlphaGo. Drawing on humanistic approaches to artificial intelligence, combined with an empirically rigorous content analysis, it examines the differences and overlap in coverage by the Chinese and American press in their accounts of AlphaGo, and its historic match with Korea’s Lee Sedol in March, 2016. The event was not only followed intensely in China, but also made the front page (...) of The New York Times. This article finds that the Chinese press was more likely than the American press to frame AlphaGo as non-threatening, which the authors attribute to cultural differences and the two countries' different understandings of Go. In addition to quantitatively identifying similarities and differences in the framing of AlphaGo, this paper also investigates the underlying and evolving contestations over what constitutes the “human” and the “machine.” It concludes by discussing the implications of the study’s findings as well as outlining avenues for further research. Hobbes, in his political writing, is generally understood to be arguing for absolutism. I argue that despite apparently supporting absolutism, Hobbes, in Leviathan, also undermines that absolutism in at least two and possibly three ways. First, he makes sovereignty conditional upon the sovereign’s ability to ensure the safety of the people. Second and crucially, he argues that subjects have inalienable rights, rights that are held even against the sovereign. When the subjects’ preservation is threatened they are no longer obliged to (...) obey the sovereign. Third, there is also a possible limitation on the absolute power of the sovereign in the form of restrictions Hobbes puts in place on what laws he may legitimately make. Finally, Hobbesian absolutism is compared to the absolutism of Carl Schmitt. This exercise demonstrates the limitations that Hobbes places on the power and authority of the sovereign. (shrink)

Nissen and Bullemer's serial reaction time task has proven to be a useful model task for exploring implicit sequence learning. Neuropsychological research indicates that SRT learning may depend on the integrity of the basal ganglia, but not on medial temporal and diencephalic structures that are crucial for explicit learning. Recent neuroimaging research demonstrates that motor cortical areas , prefrontal, and parietal cortex also may be involved. This paper reviews this neuropsychological and neuroimaging research, but finds it lacking specific links between (...) structure and function. In order to promote better functional hypotheses, the second part of the paper examines the function of these brain areas from a broader perspective. Neuroimaging and neuropsychological research with human subjects, as well as neurophysiological and lesion research with animals, suggests a number component operations that these brain mechanisms may contribute to learning in the SRT task. This paper focuses on the debate over two central claims regarding cinematic narration: the claim that there are implicit cinematic narrators and the thesis that when we watch movies, we imagine seeing the events and characters in the film fiction. I examine what a consideration of the indeterminate nature of fictional narration, that is, what is specified by the fiction about how we come to imagine the story events, can contribute to the debate on these issues. It is argued that (...) consideration of fictional indeterminacy can be used to show that positing an implicit cinematic narrator is not only unnecessary, but is also incompatible with appreciating the film fiction. While the opposite result is reached regarding the claim about imagined seeing: considerations of indeterminacy suggest that we can suppose, without absurdities, that audiences at the movies sometimes engage in imagined seeing.
