The release of genetically engineered organisms into the shared environment raises scientific, ethical, and societal issues. Using some form of democratic deliberation to provide the public with a voice on the policies that govern these technologies is important, but there has not been enough attention to how we should connect public deliberation to the existing regulatory process. Drawing on lessons from previous public deliberative efforts by U.S. federal agencies, we identify several practical issues that will need to be addressed if (...) relevant federal agencies are to undertake public deliberative activities to inform decision‐making about gene editing in the wild. We argue that, while agencies may have institutional capacity to undertake public deliberative activities, there may not be sufficient political support for them to do so. Advocates of public deliberation need to make a stronger case to Congress about why federal agencies should be encouraged and supported to conduct public deliberations. (shrink)

Pp. xvi + 425. $42.95 hardcover; $17.95 paper. This is an ambitious and important study. I will first offer an overview of the volume to indicate its scope and note some of its major features. I will then respond briefly to some of the major criticisms Smith makes of (...) the argument against contraception advanced by Germain Grisez, Joseph Boyle, John Finnis, and myself. The work contains 8 chapters and 4 appendices. Chapters 3 and 4, as Smith says, "provide an analysis of Humanae Vitae itself and thus constitute the heart of the hook" (p. xi). Since this is so I will first summarize briefly Chapters 1, 2, 5, 6, 7, and 8 and then center atten· tion on the two central chapters and the four appendices. Chapters 1 and 2 provide the context for Humanae Vitae. The first chapter is devoted largely to an account of the so-called " Minority " and "Majority" documents of the Papal Commission for the Study of Problems of the Family, Population, and Birth Rate, while the second seeks to summarize Catholic teaching on Christian marriage prior to the encyclical. This summary draws principally from Pius XI's Casti Connubii and from nn. 47-52 of Vatican II's Gaudium et Spes. Smith takes up in some detail the issue of the" primacy" of procreation, concluding that Gaudium et Spes " seems to sidestep " this issue which, in her judgment, is irrelevant to the question of contraception. She thinks that this central document of Vatican II sent " mixed signals " on the question of contraception, although she believes that several passages " can very plausibly he read to support the position that contraception is portrayed as a violation not only of the procreative good of marriage hut also of the values of conjugal love" (p. 66). Chapter 5 deals with a wide range of theological issues: the biblical foundations for the teaching found in Humanae Vitae, the relevance of the concept of munus for this teaching, the possibility of acting " in good conscience " in a way contrary to its teaching, and the infallibility of the teaching. Of special value is the extended discussion of the con· cept expressed by the Latin term munus. Smith examines the rich meaning of this term in several magisterial documents, including Gaudium et Spes as well as Humanae Vitae. While a munus implies duties, it is essentially a noble, honor-bringing "gift" or "reward," signifying a vocation and sublime honor. Paul VI, in developing the integral vision of marriage in his encyclical, uses this concept to show that God, in giving to spouses the munus of handing on new life, has conferred on them the honor of sharing with him in the work of bring· 156 BOOK REVIEWS ing new life into the world. Smith shows beautifully how the rich theological meaning of this term helps " illuminate and enrich " the teaching of the encyclical. Chapters 6 and 7 investigate the arguments presented by dissenting theologians after Humanae Vitae to justify their repudiation of its teaching. In Chapter 6 Smith considers the views of Charles Curran and Bernard Haering, while in Chapter 7 she examines the proportionalist approach to moral issues developed by Joseph Fuchs, Richard McCormick and others. She provides intelligent criticism both of Curran and Haering and of proportionalist thought, focusing on the repudiation of specific moral absolutes. In Chapter 8 Smith provides a very helpful summary of Pope John Paul II's understanding of the human person, human sexuality and marriage. In particular, she takes up his notion that in marriage and in the act proper rto it man and woman make a " gift " of themselves to one another. Simultaneously to choose to give themselves to each other in the marital act and to contracept is then seen to involve an inner contradiction, a falsification of the " language of the body " (pp. 230258 ). My own reading of the literature on dissent inclines me to concur with the substance of this judgment. Broad historical, cultural, and theological contexts have inevitably been neglected as the (...) issues raised by public dissent have come to be narrowly conceived in terms of academic policy and ecclesisastical law and discipline. The objective of this paper is to explore the larger theological context of the topic of public dissent and in particular to consider Neuhruus' judgment that the "present Roman Catholic preoccupation with church authority is... theologically debased because it fixes attention not upon the truth claims derived from God's self-revelation but upon who is authorized to set the rules for addressing such truths, if indeed they are truths." 1 A Perspective on the Current Debate The attitude of " dissent " as such would normally be expected to occupy only a subordinate place in accounts of the nature of theological thinking. Intellectual inquiries are usually undertaken with a view to affirmation and oonstruction rather than critique and dissent. Despite the volume of literature which it has spawned, the current debate in fact reflects this expectation. Dominican House of Stuaies Washington, D.a. RCENTLY, AN International Congress of moral theology convened in Rome brought together some three hundred academicians. They participated in an open forum devoted to current questions in moral theology and bioethics. Held at the Lateran University, the Congress, "Humanae vita,e: 20 Anni Dopo," was divided (...) into two parts. Although a majority of the presentations concerned the relevance of the Church's teaching on artificial contraception, the membership did devote the second part of the Congress to a sustained discussion of some new issues raised by Donum vitae (1987), the recent instruction of the Congregation for the Doctrine of the Faith on " Respect for Human Life in its Origin and on the Dignity of Procreation." To be sure, both documents emphasize the Church's constant teaching concerning the providence of God in human life and the dignity of the human person. Nevertheless, procedures such as GIFT (gamete intra.-fallopian transfer), LTOT (low tubal ovum transfer ), TOT (tubal ovum transfer) provide the moral theologian with new challenges to interpret the Church's position which insists on identifying the procrea.tive and unitive aspects of Christian marriage. The following article discusses the papal documents from the perspective of a realist moral theology. First of all, I would like to recall a principle which Paul VI, however obliquely, enunciated in the course of Humanae Vitae, for I consider the principle an axiomatic one in the present discussion. At the beginning of section 8 entitled "Pastoral 178 174 ROMANUS CESSARIO, O.P. Directives," we find a statement of theological purpose which should guide all Catholic moral practice. Hence, I would like to quote this text as a way of introducing the meaning of virtue in the Christian moral life. The Church, in fact, cannot have a different conduct toward men [and women] than that of the Redeemer: she knows their weaknesses, has compassion on the crowd, receives sinners; but she cannot renounce the teaching of the law which is, in reality, that law proper to a human Zife restored to its original truth and conducted by the Spirit of God.1 I am especially struck by the phrase " that law proper to a human life restored to its original truth," for I believe it actually describes the kind of life which develops in those who practice the virtues. Yet, before speaking about the implications of a virtue-centered morality for the difficult issues of bioethics, I would like to remark briefly on the way certain contemporary theologians misinterpret what Paul VI calls the " law proper to a human life restored to its original truth." In order to do so I have divided this paper into three parts. Thus, the first section of the paper examines several themes in contemporary moral methodology. The second section provides a general statement about the relationship between moral theology and the sa,cra domrina. Finally, the third section briefly considers why the life of virtue remains the only legitimate means for fulfilling the " law proper to a human life restored to its original truth." First, then, to contemporary themes. I Proportionate Reason and the Ethics of Personal Responsibility In an earlier draft of this paper, I titled this section "St. Ignatius, St. Alphonsus, and St. Elsewhere." Upon reflection, however, it seemed rpreferable simply to signal two or three basic themes which appear in most revisionist moral theology, especially as it has been developed in the United States. Yet they make little use of the Bible in olving these problems. Why? Is it because these bioethical issues are so new it seems unlikely the Bible has much to say about them? Rather it is because many suppose that scholars have shown the Bible's moral teaching to be so historically conditioned that (...) it cannot be normative for" modern man" but only paranetic, i.e. it exhorts and motivates us to do good and avoid evil but provides no concrete norms of good and evil still valid today. Such norms must be supplied by philosophical ethics and the empirical sciences. Consequently, seriously to view the Bible from the perspective of a " historicist " rather than a " classical world view " (as Bernard Lonergan urged us to do 4) we must not leave the concrete moral teaching of the Scripture on the shelf of the pa.st. Instead let's use a hermeneutic by which God's Word revealed in history truly illuminates today's problems. Scripture and the Construction of the Human Person Today we are concerned about problems of artificial human reproduction and of genetic engineering. Does the Bible cast any light on these puzzles? To ask about reconstructing humans, we must first ask how God constructed them. Through much of its history Catholic theology read the Bible through the eyes of Platonism because this seemed to make the Gospel intelligible and credible to the Greco-Roman world. Perhaps it was this Platonic theology that Lonergan was thinking about when he spoke of " the classical worldview " with its neglect of human historicity. Platonism helped theology defend the "primacy of the spiritual" and especially the dignity and immortality of the human spirit. But it also favored a non-biblical dualism which identified the true human person with the soul and considered the body as its tomb.5 If we shelve this Platonic theology and seek a less dualistic, more historicist anthropology, we discover the first chapters of Genesis wonderfully provide such an anthropology as the basis of a moral Instruction or Torah.6 This Torah forms the cove4 Bernard Lonergan, "The Transition from a Classicist World-View to Historical Mindedness" (1966) in Second Collection, ed. by W. This paper briefly reviews highlights from decades of debates in medicine, law, bioethics, psychology and social research about children’s and parents’ views and consent to medical treatment and research. There appears to have been a rise and later a fall in respect for children’s views, illustrated among many examples by a recent book on the zone of parental discretion, which is reviewed. A return to greater respect for children’s views and consent is advocated.

This essay presents a critique of current views of Hugo Grotius which erroneously see him as a major theorist of natural rights and a formative influence upon the rights theory of Thomas Hobbes. Especially singled out for criticism are the misconceptions due to Richard Tuck in a number of writings that discuss the political ideas of Grotius and Hobbes and the relationship between them. In an examination of Hobbes's conception of natural rights, the essay reaffirms its originality and notes its (...) revolutionary potential contrary to the main intention of Hobbes's own political doctrine. Therefore, according to this view it will always be impossible to qualify as morally evil according to its speciesits "object "-the deliberate choice of certain kinds of behavior or specific ads, apart from a consideration of the intention for which the choice is made or the totality of the foreseeable consequences of that act for all persons concerned (VS 79). The encyclical Veritatis Splendor rejects this view of so-called " teleological " ethical theories 2 as incompatible with the exist1 I thank Prof. John M. Consequently, this view finally is judged as incompatible with the Essays in Moral Philosophy, ed. D. R. Cheney (London: Allen & Unwin; New York: Humanities Press, 1971), pp. 223-246. Broad simply identified any "teleological" argumentation with a consequentialist one. So he says (p. 230 of the reprinted essays) : " One characteristic which tends to make an act right is that it will produce at least as good consequences as an alternative open to the agent in the circumstances (... ) We can sum this up by saying that the property of being optimific is a very important right-tending characteristic. I call it teleological because it refers to the goodness of the ends or consequences which the act brings about." Broad, then, goes on to say that a " nonteleological " characteristic of an action would be, for example, the obligation, independent from considering consequences, to perform what one has promised. But already in 1930 Broad had distinguished "teleological" from "deontological " ethical theories; see C. D. Broad, Five Types of Ethical Theory (London: Routledge & Kegan Paul, 1930), pp. 206 ff. Many, today, call non-teleological ethics (in Broad's sense) "deontological "; cf. William K. Frankena, Ethics (Englewood Cliffs, N.J.: Prentice Hall, 1963). The term "teleological ethics" was thus " imported " by German moral theologians, mainly by Bruno Schuller; see his Die Begrundung sittlicher Urteile. Typen ethischer Argumentation in der Moraltheologie, 2nd ed. (Diisseldorf: Patmos, 1980), pp. 282-298 (first published in 1973). According to Schuller, a normative ethic would be "teleological " if it affirms that " the moral character of all the actions and the omissions of man is exclusively determined by its consequences" (282). So he uses "teleological ethics" as synonymous with "consequentialism" (a term in fact created by G. E. M. Anscombe) and even with " utilitarianism." An interrogation of the term 'theory' from the perspective of linguistic discourse Zima offers a new definition of theory from a cultural and sociological perspective, with a view to encountering heterogenerous points of view in critical dialogue.

A questionnaire on the attitudes towards the functions of research ethical committees was sent to members of selected research ethical committees in Wessex and some controls. Almost all respondents felt there was a need for ethical review of research projects; 42 per cent thought there was a need for some training before joining a committee; 67 per cent thought the system could be improved and 47 per cent thought that monitoring or follow-up procedures should be adopted. Ethical committees were thought (...) to be purely advisory, as opposed to mandatory, by 33 per cent, and 63 per cent thought they should restrict their review to ethical problems as opposed to scientific or design problems. Views about the function of non-medical members ranged from 'none at all' to 'very important'. Of the 10 controls who were asked whether they would become a member of an ethical committee if asked, seven said that on balance they would and the reasons stated varied from the view that it was a 'very important committee' to the feeling that it was 'a necessary but irksome job'. Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

Political legitimacy is best understood as one type of a broader notion, which I call institutional legitimacy. An institution is legitimate in my sense when it has the right to function. The right to function correlates to a duty of non-interference. Understanding legitimacy in this way favorably contrasts with legitimacy understood in the traditional way, as the right to rule correlating to a duty of obedience. It helps unify our discourses of legitimacy across a wider range of practices, especially including (...) the many evaluations we increasingly make of international institutions of various sorts, but also including domestic institutions. Justice Stephen J. Field was the champion of a form of liberalism often said to be especially friendly to capitalism, the approach to the Constitution traditionally identified with “Lochnerism,” i.e., a laissez-faire oriented judicial activism. More recently a form of judicial revisionism has arisen, challenging the accepted descriptions of “Lochnerism” and of Field's jurisprudence. This article is an attempt to extend the revisionist approach by arriving at a more satisfactory understanding of the grounding of Field's jurisprudence in the natural rights (...) philosophy. Field, it turns out, orienting around natural rights, was not so unambiguously friendly to capitalism as previous generations of scholars maintained, but his approach is surely friendlier than the constitutional theories that have replaced natural rights since Field's day. This paper explores the philosophical aspects of the "Great Introduction" of Abū Ma'šar, one of the great figures of Arabic astrology and an associate of al-Kindī, the great 9th century philosopher. I argue that the following points of philosophical interest may be found in this text: 1. Astrology is described as a "master science" along the lines proposed by Aristotle, i.e. it provides principles for lower sciences. Also he supplies arguments to ground astrology on methodological grounds, such as the use (...) of empirical evidence and testimony. 2. Abū Ma'šar broadly follows al-Kindī's explanation of how the stars influence the sublunary world, by heating the elements. This agrees with al-Kindī's work "On the Proximate Agent Cause of Generation and Corruption," and I identify some parallels between the two works. 3. Finally, Abū Ma'šarr considers whether human freedom is compatible with this causal account. He holds that human actions do fall under the class of the "possible" and not the "necessary," but only because for him the "possible" is what happens sometimes, not always. Thus he seems tacitly to hold that genuine choice is compatible with causal necessitation. (shrink)

Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience.
