Scholars disagree about the proper justification of human rights and which rights qualify as human rights. While some argue for a very limited set of human rights, others defend more comprehensive accounts. In this paper I suggest that a defence of a comprehensive set of human rights can be strengthened by combining constructivist deontological and well-being based teleological justifications. To this end, I discuss two prominent proponents of constructivism and the well-being approach: Rainer Forst and Simon Caney. Forst criticises (...) teleological justifications for grounding human rights in non-universalizable conceptions of the good, such as autonomy, that can reasonably be rejected by others. Constructivism, in contrast, does not rest on any particular idea of the good life and thus allows for greater ethical plurality. I reject this specific criticism, arguing that Caney’s approach ultimately allows for the same plurality. I also highlight that constructivism on its own cannot justify rights of people who are not (yet) able to reason. The well-being approach provides substantive arguments for the rights of these individuals. However, these arguments are made with the framework provided by constructivism. I hold, contra Caney, that Forst’s right to justification is primary in that it is the unavoidable basis from which justice issues can be dealt with in a reasonable way and that the main function of human rights is to protect the equal moral status of persons. I conclude that Forst’s constructivist and Caney’s well-being approach are complementary rather than rivalrous: when combined they provide a more robust justification for a comprehensive set of human rights than considered separately. Although actions of individuals do contribute to climate change, the question whether or not they, too, are morally obligated to reduce the GHG emissions in their responsibility has not yet been addressed sufficiently. First, I discuss prominent objections to such a duty. I argue that whether individuals ought to reduce their emissions depends on whether or not they exceed their fair share of emission rights. In a next step I discuss several proposals for establishing fair shares and also take practical (...) considerations into account. I conclude that individuals should not always be obliged to reduce their emissions to what is their fair share for they may depend on carbon-intensive structures. Instead, they have a Kantian imperfect duty to reduce their emissions ‘as far as can reasonably be demanded of them’. In addition, they should press governments to introduce proper regulation. Simone Weil is one of the most profound thinkers of the twentieth century. Her writings encompass an extraordinary breadth of subjects, including philosophy, religion, sociology, and politics. Gravity and Grace was the first ever publication by the remarkable thinker and activist, Simone Weil. In it Gustave Thibon, the priest to whom she had entrusted her notebooks before her untimely death, compiled in one remarkable volume a compendium of her writings that have become a source of spiritual guidance and wisdom for countless individuals.

Particle indistinguishability has always been considered a purely quantum mechanical concept. In parallel, indistinguishable particles have been thought to be entities that are not properly speaking objects at all. I argue, to the contrary, that the concept can equally be applied to classical particles, and that in either case particles may (with certain exceptions) be counted as objects even though they are indistinguishable. The exceptions are elementary bosons (for example photons).

We demonstrate that the quantum-mechanical description of composite physical systems of an arbitrary number of similar fermions in all their admissible states, mixed or pure, for all finite-dimensional Hilbert spaces, is not in conflict with Leibniz's Principle of the Identity of Indiscernibles (PII). We discern the fermions by means of physically meaningful, permutation-invariant categorical relations, i.e. relations independent of the quantum-mechanical probabilities. If, indeed, probabilistic relations are permitted as well, we argue that similar bosons can also be discerned in all (...) their admissible states; but their categorical discernibility turns out to be a state-dependent matter. In all demonstrated cases of discernibility, the fermions and the bosons are discerned (i) with only minimal assumptions on the interpretation of quantum mechanics; (ii) without appealing to metaphysical notions, such as Scotusian haecceitas, Lockean substrata, Postian transcendental individuality or Adamsian primitive thisness; and (iii) without revising the general framework of classical elementary predicate logic and standard set theory, thus without revising standard mathematics. This confutes: (a) the currently dominant view that, provided (i) and (ii), the quantum-mechanical description of such composite physical systems always conflicts with PII; and (b) that if PII can be saved at all, the only way to do it is by adopting one or other of the thick metaphysical notions mentioned above. Among the most general and influential arguments for the currently dominant view are those due to Schrodinger, Margenau, Cortes, Dalla Chiara, Di Francia, Redhead, French, Teller, Butterfield, Giuntini, Mittelstaedt, Castellani, Krause and Huggett. We review them succinctly and critically as well as related arguments by van Fraassen and Massimi. (shrink)

I show that frequentism, as an explanation of probability in classical statistical mechanics, can be extended in a natural way to a decoherent quantum history space, the analogue of a classical phase space. The result is a form of finite frequentism, in which Gibbs’ concept of an infinite ensemble of gases is replaced by the quantum state expressed as a superposition of a finite number of decohering microstates. It is a form of finite and actual frequentism (as opposed to hypothetical (...) frequentism) insofar as all the microstates exist, in keeping with the decoherence-based Everett interpretation, and some versions of pilot-wave theory. The central claim of this article is that post-truth requires a political and socio-economical perspective, rather than a moral or epistemological one. The article consists of two parts. The first part offers a critical examination of the dominant analyses of post-truth in terms of shifting standards of the origin and the evaluation of facts. Moreover, the claim that postmodernism is the cause of post-truth is examined and refuted. In the second part an alternative perspective is developed, centring around the notion (...) of gatekeepers. Rather than linking post-truth to bullshit and postmodernism, it should be understood as a symptom of a contemporary shift in the gatekeepers of truth and knowledge. Knowledge and truth are always mediated in society through the hands of gatekeeping institutions such as journalism or science. Post-truth is a symptom of a broader transformation of the gatekeeping institutions of our current society. It therefore requires a political philosophy of these institutional shifts and the new risks they involve. (shrink)

One Stoic response to the skeptical indistinguishability argument is that it fails to account for expertise: the Stoics allow that while two similar objects create indistinguishable appearances in the amateur, this is not true of the expert, whose appearances succeed in discriminating the pair. This paper re-examines the motivations for this Stoic response, and argues that it reveals the Stoic claim that, in generating a kataleptic appearance, the perceiver’s mind is active, insofar as it applies concepts matching the perceptual stimulus. (...) I argue that this claim is reflected in the Stoic definition of the kataleptic appearance, and that it respects their more general account of mental representation. I further suggest that, in attributing some activity to the mind in creating each kataleptic appearance, and in claiming that the expert’s mind allows her to form more kataleptic appearances than the amateur, the Stoics draw inspiration from the wax tablet model in Plato’s Theaetetus (190e–196d), where Socrates distinguishes the wise from the ignorant on the basis of how well they match sensory input with its appropriate mental ‘seal’ (σφραγίς). This chapter reaches the following conclusions about laws that enhance punishment for criminal conduct prompted by group hatred or bias:Hatred should not be either a necessary or a sufficient condition for enhanced punishment.Enhanced punishment is justifiable when bias crimes display greater culpability, express disrespect for the victim’s group, or cause either greater psychic harm to the victim or group-specific outrage in the victim’s community.Properly designed bias crime laws do not improperly punish for thoughts or character.Such laws are more defensible if (...) they require that the actor’s primary motive was animus toward the disfavored group.There is no principled reason to require that such laws merely enhance punishment for an already existing parallel crime.Increasing punishment significantly because of bias may violate principles of proportionality. The 1929 encounter between Ernst Cassirer and Martin Heidegger in Davos, Switzerland is considered one of the most important intellectual debates of the twentieth century and a founding moment of continental philosophy. At the same time, many commentators have questioned the philosophical profundity and coherence of the actual debate. In this book, the first comprehensive philosophical analysis of the Davos debate, Simon Truwant challenges these critiques. He argues that Cassirer and Heidegger's disagreement about the meaning of Kant's philosophy is (...) motivated by their different views about the human condition, which in turn are motivated by their opposing conceptions of what the task of philosophy ultimately should be. Simone Weil's Leçons de Philosophie are derived from a course she taught at the lyce;e for girls at Roanne in 1933-4. Anne Reynaud-Gue;rithault was a pupil in the class; her notes are not a verbatim record but are a very full and, as far as one can judge, faithful rendering, often catching the unmistakable tone of Simone Weil's voice as well as the force and the directness of her thought. The lectures form a good general introduction to philosophy, ranging widely (...) over problems about perception, mind, language, reasoning and problems in moral and political philosophy too. Her method of presentation is a characteristic combination of abstract argument, personal experience and literary or historical reference. Peter Winch points out in his introduction to the book some of the more systematic connections in her philosophical work (and between this philosophical work and her other concerns), and makes a number of suggestive comparisons between Simone Weil and Wittgenstein. The translation is by Hugh Price from the Plon edition of 1959. Dr Price has added some notes to explain references in the text that might be unfamiliar to English speaking students beginning philosophy. (shrink)

This paper offers a critical analysis of Stalnaker''s work on presupposition (Stalnaker1973, 1974, 1979, 1999, 2002). The paper examines two definitions of speaker presupposition offered by Stalnaker – the familiar common ground view, and the earlier,less familiar, dispositional account – and how Stalnaker relates this notion to the linguistic phenomenon of presupposition. Special attention is paid to Stalnaker's view of accommodation. I argue that given Stalnaker's views, accommodation is not rightly seen as driven by the presuppositional requirements of utterances, but (...) only by the interests of speakers in eliminating perceived differences among presuppositions. I also consider the revisions which are needed either to the definition of speaker presupposition or to the definition of sentence presupposition in light of the possibility of informative presupposition. In the concluding section, I discuss the ways in which some recent accounts of context and speaker presupposition depart from their Stalnakerian foundations. (shrink)

Education as identity formation in Western-style liberal-democracies relies, in part, on neutrality as a justification for the reproduction of collective individual identity, including societal, cultural, institutional and political identities, many aspects of which are problematic in terms of the reproduction of environmentally harmful attitudes, beliefs and actions. Taking a position on an issue necessitates letting go of certain forms of neutrality, as does effectively teaching environmental education. We contend that to claim a stance of neutrality is to claim a position (...) beyond criticism. In the classroom this can also be an epistemically damaging position to hold. To further explore the problem of neutrality in the classroom, and to offer a potential solution, we will look to the philosophical community of inquiry pedagogy, and advocate for the addition of place-based education; a form of experiential education that promotes learning in local communities in which the school is situated, each with its own history, culture, economy and environment. However, how we understand ‘place’ is fundamental to understanding the potential of place-based education in giving students a ‘sense of place’—how they perceive a place, which includes place attachment and place meaning. To this end, we look to Indigenous understandings of Place and social reconstruction learning to inform place-based pedagogies. Doing so, we hold, opens a pathway to ethical education. (shrink)

We argue that the value of authenticity does not explain the value of self-knowledge. There are a plurality of species of authenticity; in this paper we consider four species: avoiding pretense (section 2), Frankfurtian wholeheartedness (section 3), existential self-knowledge (section 4), and spontaneity (section 5). Our thesis is that, for each of these species, the value of (that species of) authenticity does not (partially) explain the value of self-knowledge. Moreover, when it comes to spontaneity, the value of (that species of) (...) authenticity conflicts with the value of self-knowledge. (shrink)

Michel Foucault's involvement with politics, both as an individual and a writer, has been much commented upon but until now has not been systematically reviewed. Human beings are the cause of many current environmental problems. This poses the question of how to respond to these problems at the national and international level. However, many people ask themselves whether they should personally contribute to solving these problems and how they could (best) do so. This is the focus of this Special Issue on Individual Environmental Responsibility. The introduction proposes a way to structure this complex debate by distinguishing three broad clusters of arguments. The first cluster tackles (...) the kind of ethical theory we need to properly address different aspects of individual responsibility. The second cluster asks what individuals should do from an ethical point of view. The third cluster investigates the role of contextual factors and the limits of demandingness in individual obligations. In this paper, I interview Francesca De Vecchi (Full Professor of Theoretical Philosophy in Vita-Salute San Raffaele University) about her qualitative ontology and its social and normative implications. If at the foundation of our lifeworld there are significantly qualitative experiences, phenomenology can investigate the most important contemporary issues, such as gender disparity, socio-virtuality depersonalizations and political urgencies.

The first impacts of climate change have become evident and are expected to increase dramatically over the next decades. Thus, it becomes more and more pressing to decide who has to compensate those people who suffer from negative impacts of climate change but have neither contributed to the problem nor possess the resources to cope with the consequences. Since the frequently invoked Polluter Pays Principle cannot account for all climate-related harm, I will take a closer look at the much more (...) controversial Beneficiary Pays Principle. It is argued that, appropriately qualified, the Beneficiary Pays Principle can help to identify additional duty-bearers. Based on these results, I briefly comment on three different policy options to generate funds for compensation. (shrink)

This essay considers how ancient Stoic cosmopolitanism – roughly, the claim all human beings are members of the same “cosmopolis”, or universal city, and so are entitled to moral concern in virtue of possessing reason – informs Stoic thinking about how we ought to treat non-human entities in the environment. First, I will present the Stoic justification for the thesis that there are only rational members of the cosmopolis – and so that moral concern does not extend to any non-human (...) part of the natural world – and explore the foundations of these views in Stoic physics. Next, I will show that, like other anthropocentric theories, Stoic cosmopolitanism allows for environmental preservation and protection of non-human entities, so long as these activities ultimately benefit human beings. However, because the Stoics include the appreciation of natural beauty as a component of the happy life, this justification is not as feeble as it might seem. Humans are naturally set up to contemplate the order and complexity of the universe, and so environmental degradation and species loss, in marring this harmonious system, frustrates the achievement of the human goal. After exploring these facets of Stoic philosophy, and assessing to what extent they might justify environmental conservation, I close with a critical appraisal of Stoic theory – specifically, of the claims that (i) only humans possess reason and (ii) only rational creatures are deserving of moral concern. This article argues that pseudoscience lacks an adequate philosophical analysis. Using conspiracy theories as a case study, it is claimed that such an analysis needs to go beyond a mere epistemological approach. In the first part, it is shown that the existing philosophical literature shares the assumption that conspiracy theories are primarily deficient scientific hypotheses. This claim is contested, because such an approach can only understand what conspiracy theories fail to be, but not what they are and why people tend (...) to endorse them. To develop an alternative, the second part starts from recent sociology of science, applied to conspiracy theories, that claims that both true and false theories are in need of a symmetrical social explanation. However, this opens the path to relativism because it does not allow for a significant distinction between scientific and conspiracy theories. In the third section an alternative analysis of conspiracy theories is offered, which does not abandon this distinction. Moreover, it is claimed that the most important element of conspiracy theories is not their truth value but rather their symbolic structures of meaning. The aim of conspiracy theories, and perhaps of pseudoscience in general, is then not to know facts about the world, but rather to offer a meaningful framework within which to live. (shrink)
