Resumo: Joseph Raz tornou-se bastante conhecido pelo conceito de razões excludentes, que ele aplicou na análise de uma série de conceitos práticos, como decisões, regras e obrigações. No entanto, a literatura especializada exibe um alto grau de ceticismo quanto à existência de razões excludentes, e até sobre a coerência do conceito. Ao longo de sua obra, Raz sempre focou em duas espécies de razões excludentes: as diretamente motivacionais e as evidenciais. Atribui-se a isso o fato de o conceito ter recebido (...) tantas críticas. Neste artigo, dá-se destaque a uma outra categoria de razões excludentes, negligenciada por Raz: as razões que são excluídas por sua própria natureza. Argumenta-se aqui que essa categoria é capaz de mostrar, não apenas que o conceito não é vazio ou inconsistente, mas também que ele tem um papel importante a desempenhar na elucidação de um importante domínio da moralidade: o domínio das relações afetivas. According to Ronald Dworkin, political obligation is to be justified as an associative obligation through membership in certain political communities. In this regard, I first argue that the concept of an associative obligation cannot help us to account for precise moral obligations. Second, I analyze certain disanalogies between paradigmatic cases of associative obligation and political obligation in order to show the inability of the former to justify the enforcement of a comprehensive obligation such as the latter. Ofereço uma interpretação da dedução da posse jurídica realizada por Kant no §6de sua Doutrina do Direito que demonstra sua completude e coerência com a introduçãoposterior dos conceitos de “vontade universal” e “posse comum originária” como fundamentosda posse jurídica, ainda que ausentes da referida dedução.

O objetivo deste artigo é identificar um ponto nuclear quanto às diferenças entre as teorias do conhecimento de Hume e Kant. Sugiro que Kant seja lido, não contra Hume, como um filósofo que teria procurado refutar seus procedimentos para justificativa de crenças, mas como um filósofo que teria procurado fundar o princípio subjacente a tais procedimentos. Com base em uma análise do propósito das oito regras humeanas que nos permitem saber quando objetos estão em relação de causa e efeito, sugiro (...) que Hume poderia ser um confiabilista. A seguir, argumento que o confiabilismo em questão apenas adiaria o problema relativo à justificativa do princípio da indução ou princípio da uniformidade da natureza. Na sequência, apresento, em linhas gerais, a dedução transcendental dos conceitos puros do entendimento como uma tentativa kantiana de justificativa do princípio da uniformidade. (shrink)

By considering Kant as a contemporary and not above moral responsibility, the authors explore his political theory as the philosophical foundation of human rights, discussing the right to citizenship, social dynamics and the scope of global justice. It is safe to say that the main line of criticism against the reading of Critical Philosophy as Transcendental Semantics is that Kant would be concerned about semantic problems only on Critique of Pure Reason so that such reading would not make sense beyond that work. In this paper, I describe Transcendental Semantics in short words and analyze at length Kant’s theory of concepts on Transcendental Analytic of Critique of Pure Reason in order to make a suggestion: every concept has (...) to attend the demands of Transcendental Semantics to be called a concept in critical sense.A principal linha da crítica contra a leitura da filosofia crítica como semântica transcendental afirma que Kant teria trabalhado sobre problemas semânticos apenas na Crítica da razão pura, assim sendo, não faria sentido ultrapassar esse limite com aquela intepretação. Neste artigo, descrevo a semântica transcendental em poucas palavras e analiso a teoria dos conceitos de Kant na Analítica transcendental da Crítica da razão pura para oferecer a seguinte observação: para atender as demandas da semântica transcendental todo conceito tem de ser chamado de conceito em sentido crítico. According to rule-consequentialism’s moral criterion, a given action is morally right if and only if it complies with an ideal code of rules, regardless of the consequences of that action. Rules are to be assessed by their consequences, not actions. This being so, one of the many accusations that have been made against rule-consequentialism is that it can turn suboptimal decisions into morally right decisions and optimal decisions into morally wrong decisions. After all, in certain circumstances, a rule that has (...) the best consequences overall can require an action that does less good or forbid an action that does more good. This is the core of the original rule-worship objection. However, recently, different versions of rule-consequentialism have been developed in order to address that challenge. This paper focuses on three of them, those offered by Brad Hooker, Susan Wolf, and David Copp. My claim is that their arguments, however ingenious, are unsuccessful, because they are innocuous if the charge is reformulated as it should be. I have two goals in this paper. First, I want to determine whether Kant’s justification for state programs for poverty relief in The Doctrine of Right is based on 1) Kantian duties of virtue, 2) Kantian duties of right, or instead merely on 3) instrumental arguments regarding the preservation of a State as such. I claim that the last alternative is the correct one. Second, I will argue, against Kant himself, that even his merely instrumental arguments for public programs for (...) poverty relief are ruled out by his doctrine of right. My conclusion is that, perhaps surprisingly, the only genuinely Kantian way to provide poverty relief is privately, just as Libertarians have argued. (shrink)

ABSTRACT Many prominent legal philosophers believe that law makes some type of moral claim in virtue of its nature. Although the law is not an intelligent agent, the attribution of a claim to law does not need to be as mysterious as some theorists believe. It means that law-making and law- applying acts are intelligible only in the light of a certain presupposition, even if a lawmaker or a law-applier subjectively disbelieves the content of that presupposition. In this paper, I (...) aim to clarify what type of moral claim would be suitable for law if law were to make a claim to be morally justified. I then argue that legal practice is perfectly intelligible without moral presuppositions - that is, that the law does not necessarily make moral claims. RESUMO Muitos filósofos do direito proeminentes acreditam que o direito levanta algum tipo de pretensão moral em virtude de sua natureza. Embora o direito não seja um agente inteligente, a atribuição de uma pretensão ao direito não precisa ser tão misteriosa como alguns teóricos acreditam que seja. Significa que atos pelos quais fazemos e aplicamos leis são inteligíveis apenas à luz de uma certa pressuposição, mesmo se um legislador ou um aplicador do direito não acreditar subjetivamente no conteúdo dessa pressuposição. Neste artigo, eu busco esclarecer que tipo de pretensão moral seria adequada ao direito se o direito levantasse a pretensão de ser moralmente justificado. Eu então argumento que a prática jurídica é perfeitamente inteligível sem pressuposições morais - isto é, que não é necessário que o direito levante pretensões morais. (shrink)

In A Matter of Principle, Ronald Dworkin discusses the role a political morality should play in decisions about when the law should be obeyed and enforced, and even what law is. Noticing that liberalism was once a quasi-consensus theory in Great Britain and the United States – and, therefore, a natural candidate to that role in those countries – Dworkin argues that the loss of that status is due to an alleged failure of liberal political theorists to identify a kind (...) of egalitarianism as the constitutive principle on which liberalism is based. My aim in this paper is to advance arguments against such an influential claim that a certain egalitarianism would be the constitutive principle of political liberalism. (shrink)

Em Uma Teoria da Justiça, John Rawls explicou o intuicionismo como a doutrina que professa o pluralismo irredutível de princípios morais, princípios estes cujos conflitos não poderiam ser resolvidos de maneira principiológica. Segundo Rawls, não se pode oferecer um argumento abstrato que prove que o pluralismo moral é falso. Mas seria possível mostrarmos aquilo que o intuicionista nega existir: o princípio moral mais fundamental, que sistematiza nossas obrigações morais. Este princípio, de acordo com Rawls, seria o princípio da equidade. Neste (...) artigo, eu argumento que Rawls fracassa diante dos intuicionistas. Meus argumentos se valem de uma análise da aplicabilidade do princípio da equidade ao caso das promessas. Primeiro, eu defendo que o princípio da equidade só poderia explicar obrigações morais em geral se ele pudesse conter em sua fórmula um caso paradigmático das obrigações que ele pretende explicar: justamente as obrigações promissórias. Depois, eu procuro mostrar que as mesmas obrigações promissórias contêm um traço essencial que o princípio da equidade não seria capaz de explicar, mesmo que pudesse explicar obrigações morais em geral: o caráter especial das obrigações para com os destinatários das promessas. No primeiro ponto, a minha investigação expande as críticas de Robert Nozick a uma versão do princípio da equidade apresentada por H.L.A. Hart. No segundo, eu desenvolvo objeções feitas por Stephen Darwall contra a teoria prática das promessas, incluindo a teoria de John Rawls. (shrink)

This paper criticises Kevin Toh’s expressivist reconstruction of H. L. A. Hart’s semantics of legal statements on the grounds that two implications of Toh’s reading are arguably too disruptive to Hart’s theory of law. The first of these implications is that legal statements are rendered indistinguishable from statements of value. The second is that the concept of a rule of recognition is rendered dispensable. I argue for the unacceptability of these consequences from a Hartian standpoint in the first two sections (...) of this paper. The last two sections present an alternative view of Hart’s semantics of legal statements, according to which legal normativity is explained in terms of conformity to patterns of validity that by themselves neither provide objective reasons for action nor entail subjective acceptance of such reasons. As a positive thesis, philosophical anarchism claims that political authority is always at odds with practical rationality insomuch as authoritative directives are best analysed as content-independent reasons. The aim of this paper is to clarify the metaethical assumptions behind such a claim. Since philosophical anarchists reject as irrational the possibility that an agent can follow content-independent reasons issued by another agent, emphasising agents’ responsibility to assess the content of every directive before acting in conformity with it, it is safe to (...) say that philosophical anarchists must be cognitivist in metaethics. At the very least, were there no right or wrong answers to questions such as “what does one have reason to do in these circumstances?”, answers such as “one should follow authoritative directives” would be as good as any other. However, philosophical anarchism requires much more than metaethical cognitivism; indeed, it requires a very specific (and ambitious) type of cognitivism. I intend to show which one. (shrink)

Pretendo defender a compatibilidade da concepção de objeto desenvolvida na Dedução Transcendental das categorias do entendimento da primeira edição da Crítica da Razão Pura com as demandas da filosofia crítica, ainda que pese em contrário o uso da expressão “objeto transcendental” por parte de Kant. Sugiro que o uso de tal expressão guarde justamente uma transição entre o conceito de objeto como coisa em si e o novo conceito de objeto do conhecimento em sentido crítico.

O artigo sugere que o Estado se diferencia de uma máfia sofisticada por sua pretensão de possuir autoridade legítima. Procedemos à análise do significado de tal pretensão, o que nos leva ao paradoxo denunciado pelo “anarquismo filosófico”, segundo o qual autoridade nenhuma poderia ser legítima, já que a obediência a qualquer autoridade implicaria, necessariamente, no abandono da racionalidade prática. Então, apresentamos uma teoria formal da razão prática destinada a resolver o paradoxo anarquista. Por fim, analisamos se, concretamente, poderia haver um (...) argumento em prol da legitimidade da autoridade política que preenchesse as condições formais de legitimidade expostas naquela teoria. Procuro esclarecer e precisar o que seria o pluralismo moral com base em uma caracterização do que julgo ser a forma mais profunda e radical de conflito moral: o conflito entre valores incomensuráveis. A seguir, lido com os limites do papel da sensibilidade moral nos cenários de conflitos práticos. Por fim, introduzo um modelo de racionalidade prática consistente com o pluralismo moral mais radical. Concluo que, longe de significar a abdicação da racionalidade no domínio prático, o pluralismo, uma vez absorvido (...) pela nossa cultura moral e política, traria importantes lições de tolerância para nossa época. Critical Essays, Allen Wood pretende mostrar que Kant não teria provado que a existência não poderia ser um predicado real ou determinante. Em seu artigo “Anselm’s Ontological Arguments”, publicado na revista The Philosophical Review, Norman Malcolm pretende mostrar que Kant não teria provado que a existência necessária não poderia ser um predicado real ou determinante. Lidando com as (...) defesas de Wood e Malcolm para o argumento ontológico contra as críticas de Kant, pretendo sugerir, primeiramente, que o argumento de Kant funciona e, em segundo lugar, que ele não depende dos seus Postulados do Pensamento Empírico. Na verdade, advogo a tese de que o segundo Postulado poderia ser justificado por um apelo às conclusões de Kant sobre a existência, na seção “Sobre a impossibilidade de uma prova ontológica da existência de Deus”. ABSTRACT On Inequality is a short book that skillfully handles a challenging topic. As its title suggests, its focus is a major theme in contemporary theories of justice: equality. Contrary to what one might expect, however, Frankfurt's critique of equality is not grounded in libertarian arguments or an ideal of the minimal state. Rather, it aims to clarify a cluster of alleged conceptual confusions about equality as a constitutive moral value.

Resumen: Ante las críticas insistentes a la distinción entre el empirismo y el racionalismo, se han propuesto alternativas para comprender de manera más adecuada el quehacer de los filósofos modernos. Entre ellas está la distinción entre filosofía especulativa y experimental. Intentaré evaluar la validez de esta distinción para la filosofía moral experimental del siglo XVIII y, en particular, para la propuesta de Hume. Mostraré que si la distinción se entiende en términos excluyentes, resulta inapropiada porque el mismo Hume plantea que (...) la especulación es lo que define a la filosofía. Además, antes que considerarlas como excluyentes, el filósofo escocés propone una conciliación entre la práctica de la experimentación y la teorización. Por último, sostendré que aquello que Hume considera como “falsa filosofía” no puede entenderse como sinónimo de filosofía especulativa.: A persistent criticism of the distinction between empiricism and ra-tionalism has provoked the emergence of new distinctions in order to under-stand modern philosophy in a more adequate way. One of those distinctions is that between speculative and experimental philosophy. My aim is to evalu-ate the validity of this distinction for eighteenth-century experimental moral philosophy in general and for Hume’s thought in particular. I will show that if this distinction is understood in exclusive terms, then it cannot be adequate because Hume himself states that speculation is what defines philoso-phy. Hume also proposes a reconciliation between experimental practice and theoretical activity instead of considering that they are mutually exclusive. Finally, I will make clear that what Hume condemns as “false philosophy” is not a synonym for speculative philosophy. (shrink)

Si bien el propósito de examinar dicha relación es deconstruir el vínculo entre presencia y lenguaje, Blanchot conduce a considerar esa continuidad en términos de una presencia nunca completa ni devenida que (...) se conserva como una discontinuidad, una promesa y una ausencia que deben preservarse. ABSTRACT The article analyzes the relation between writing and presence in the work of Maurice Blanchot and defines the textual grounds of presence in the order of literature, using Michel Foucault's concepts of "literary space" and the "thought of the outside" as theoretical referents. While the objective of examining that relation is to deconstruct the link between presence and language, Blanchot leads us to consider that continuity in terms of a never complete or fulfilled presence that remains as discontinuity, as promise and absence that must be preserved. Many people are worried about the harmful effects of climate change but nevertheless enjoy some activities that contribute to the emission of greenhouse gas (driving, flying, eating meat, etc.), the main cause of climate change. How should such people make choices between engaging in and refraining from enjoyable greenhouse-gas-emitting activities? In this chapter, we look at the answer provided by decision theory. Some scholars think that the right answer is given by interactive decision theory, or game theory; and moreover think (...) that since private climate decisions are instances of the prisoner’s dilemma, one rationally should engage in these activities provided that one enjoys them. Others think that the right answer is given by expected utility theory, the best-known version of individual decision theory under risk and uncertainty. In this chapter, we review these different answers, with a special focus on the latter answer and the debate it has generated. (shrink)

This article analyzes the treatment of vegetative powers in Nicolaus Taurellus’s critical response to Andrea Cesalpino. Taurellus’s interest in this topic derives from larger metaphysical and theological concerns. His concern is that Cesalpino’s view that vegetative powers are due to a divine principle of activity inherent in natural particulars leads to a version of substance monism that is incompatible with the Christian doctrine of creation. Taurellus’s critique can best be understood within the context of his defense of an immaterialist (...) account of the basic constituents of reality, which is connected with an emergentist account of the origin of vegetative powers. Traditionally, the manufacturer/operator of a machine is held (morally and legally) responsible for the consequences of its operation. Autonomous, learning machines, based on neural networks, genetic algorithms and agent architectures, create a new situation, where the manufacturer/operator of the machine is in principle not capable of predicting the future machine behaviour any more, and thus cannot be held morally responsible or liable for it. The society must decide between not using this kind of machine any more (which is not a (...) realistic option), or facing a responsibility gap, which cannot be bridged by traditional concepts of responsibility ascription. Resumo: A obra política de John Locke foi um estudo de como se justifica a existência de um governo baseado na vontade geral, aspirando proteger os direitos naturais de liberdade, igualdade e propriedade. Acredita-se que todo esse pensamento se iniciou não apenas nos seus escritos políticos, mas em O Ensaio Acerca do Entendimento Humano. Tal obra retrata o modo pelo qual se adquire conhecimento, um aspecto fundamente que baseará as premissas da vontade geral e dos direitos naturais do homem nos (...) seus escritos políticos. O Ensaio nem sempre é estudado em conjunto à literatura política de Locke, pois não existe consenso entre os estudiosos a respeito da unidade teórica entre o epistêmico e o político. Nesse sentido, procuro demonstrar que há uma congruência no pensamento de Locke, de modo que está presente um forte elo entre o Ensaio e, sobretudo, o Segundo Tratado Sobre o Governo Civil. (shrink)
