This essay attempts to examine the difficult question of sex scandals both in public school settings and in the academy. It raises issues over the way authority in the classroom is unequally exercised by both male and female teachers in terms of power and seduction. However, the Law remains explicit when it comes to judging who is at fault within a-student relationship that collapses into the bedroom. The ethics that surround such sexual affairs is raised through the psychoanalytic and (...) philosophical writings of Jacques Lacan. The essay ends by offering a surprised perspective over the question whether an ethics of diabolical evil is possible, given that such affairs are differentiated as post-Oedipal relationships where age differentiations have become blurred. Firms located in communities in which people are, on average, more trusting enjoy some benefits in terms of the power of CEO contracts. We present two pieces of empirical evidence to support this claim: (1) higher average trust in a county is associated with “flatter” executive contracts and (2) when an exogenous shock occurs (such as a scandal involving an important social institution), both trust and contracting move in similar directions. We obtain the first result in a panel specification and (...) the second in a “difference-in-difference” specification that uses the revelation of sex scandals involving the Catholic Church across different U.S. localities. The leader integrity literature has described how professional behavior influences perceptions of integrity, yet behavior in leaders’ personal lives potentially affects those perceptions. The present paper examined how personal life behavior affects leaders. We assessed high profile political sex scandals to explore the research questions of how indiscretions in personal life affect leaders and how leaders recover from public revelations of sexual indiscretions. The results revealed that whether politicians survived the scandal depended on the degree to which the indiscretion (...) deviated from accepted norms, the degree to which the behavior departed from the politician’s expressed values, the leader’s political power, and whether the leader fully engaged in atonement under conditions when denying the allegations is not possible. These components were inter-related such that atonement was possible if the behavior was neither too extreme nor out of character and the leader had sufficient political power. The model was then tested with a sample of business executives engaged in sex scandals, finding support for its elements. (shrink)

In 2014, a large archive of hacked nude photos of female celebrities was released on 4chan and organized and discussed primarily on Reddit. This paper explores the ethical implications of this celebrity nude photo leak within a frame of gendered privacy violations. I analyze a selection of a mass capture of 5143 posts and 94,602 comments from /thefappening subreddit, as well as editorials written by female celebrities, feminists, and journalists. Redditors justify the photo leak by arguing the subjects are privileged (...) because they are celebrities; that the celebrities are at fault for failing to appropriately protect their information; and that the only person ethically responsible for the leak is the hacker. The popular press primarily took a feminist perspective, linking the photo leak to institutionalized sexism and misogyny. I argue that the Reddit participants frame the privacy violations within a context of geek masculinity, in which references to masturbation and pornography and casually misogynist language are used to signify a normative masculine self. Privacy violations are de-emphasized when the victims are women and gender or feminist concerns are rejected. Entitlement to viewing women’s bodies and male sexual desire are prioritized over ethical concerns over privacy violations. The paper contributes to understanding how privacy violations are normatively gendered and reinforced by gender inequality. (shrink)

A review of the literature on corporate governance serves to demonstrate the applicability of many governance solutions to the university setting. Based on a review of university scandals, most of which are recent but some of which took place decades ago, it is possible to categorize them as follows: sex scandals, drugs, cheating, hazing, admissions and diplomas, on-the-job consumption, athletics, and murder. Several examples are provided in the paper, along with their impact on various stakeholders. The paper then (...) discusses a variety of solutions designed to either preempt the activities potentially leading to scandal, to deter them or to punish perpetrators. Some of these involve structural changes, institutional policies and procedures, fines, terminations, and sanctions. Sexual reproduction is the dominant reproductive mode in eukaryotes but, in many taxa, it has never been observed. Molecular methods that detect evidence of sex are largely based on the genetic consequences of sexual reproduction. Here we describe a powerful new approach to directly search genomes for genes that function in meiosis. We describe a “meiosis detection toolkit”, a set of meiotic genes that represent the best markers for the presence of meiosis. These genes are widely present in eukaryotes, function (...) only in meiosis and can be isolated by degenerate PCR. The presence of most, or all, of these genes in a genome would suggest they have been maintained for meiosis and, implicitly, sexual reproduction. In contrast, their absence would be consistent with the loss of meiosis and asexuality. Sex is not merely a way one can slur kinds of criticism one doesn’t like by tarnishing its proponents (for teaching sexual, transgressive material to shock, pervert, or in the extreme case—as in this instance—literally seduce students) though it can sometimes function in this way. For sex comes up in anecdotes told by cultural critics to one another, and when it comes up, it comes up in the same way it does in “tabloid” coverage. The anecdote about sex is never really just about sex, about who did or didn’t (French) kiss, suck, and/or fuck whom: it is rather a story about something in the pedagogical relation that has gone wrong, about a connection that has gone off track. In April 2004 the Irish Government commissioned Judge Maureen Harding Clark to compile a report to ascertain the rate of caesarean hysterectomies at Our Lady of Lourdes Hospital in Drogheda, Republic of Ireland. The report came about as a result of complaints by midwives into questionable practices that were mainly (but not solely) attributed to one particular obstetrician. In this article we examine the findings of this Report through a feminist lens in order to explore what a feminist reading of (...) the Report and the events that led to the inquiry will bring to light. We consider how sex and gender feature in the Lourdes case, draw attention to the deeply gendered asymmetries of power and privilege that existed between the men and women at the centre of this inquiry, and explore the impact such asymmetries had on this particular situation. Hobbes could not have written Paradise Lost: the longest of his few references to the story of Adam and Eve drains their relationship of drama and complexity; most aspects of human sexuality he addresses only in classifying them as off limits because of their indecency, neglecting topics in some respects germane to the clarification of his philosophy; and his original English verse amounts to one line for each of that epic's twelve books. This short poem nonetheless represents an intriguing persuasion (...) to love written in his extreme old age. Moreover, his treatment of “LUST” in The Elements of Law takes a significantly non-judgmental form by the standards of his time, though not marking so substantial an innovation as Simon Blackburn takes it to be. Focusing on the issue of the sexual abuse of children, I discuss the question of the relationship between changes in sexual politics and how we think about drives in the context of their relation to neoliberalism. This subject is so emotionally charged that a rational ediscussion of that which goes beyond our comprehension is almost impossible. Any doubt of an easy solution moves the doubter himself or herself into the domain of abuse. The sets of complex interrelated issues associated with (...) child sexual abuse deny any simple description or critique. I therefore approach the topic from three fronts which initially may seem quite separate but which will enable a new perspective and facilitate thinking about it. The first part of this article historicizes the topic. Here I present Ian Hacking’s (1996) work on knowledge, power and truth, which elucidates the crusading nature that the fight against sexual abuse has assumed. I then invoke Foucault’s reconstruction of the production of sexuality in the family in order to replace a position of straightforward moral disgust with the issue of power in the context of sexuality and drive construction. Hacking and Foucault serve as the conceptual bases for reviewing the infamous case of the Belgian child abuser Dutroux. 1 In the third part of the article my analysis is in the first instance focused on a theoretically informed critique of the news media, in particular European and German media. This Eurocentric study has global implications. Its aim is to make a first attempt to demonstrate a relationship between sex scandals and the demands and opportunities of the global free markets. During the past decades, the culture industries have multiplied media spectacles in novel spaces and sites, and spectacle itself is becoming one of the organizing principles of the economy, polity, society, and everyday life. An Internet-based economy has been developing hi-tech spectacle as a means of promotion, reproduction, and the circulation and selling of commodities, using multimedia and increasingly sophisticated technology to dazzle consumers. M edia culture proliferates ever more technologically sophisticated spectacles to seize audiences and augment their power and (...) profit. The forms of entertainment permeate news and information, and a tablodized infotainment culture is more and more popular. New multimedia that synthesize forms of radio, film, TV news and entertainment, and the mushrooming domain of cyberspace, become spectacles of technoculture, generating expanding sites of information and entertainment, while intensifying the spectacle-form of media culture. Political and social life is also shaped more and more by media spectacle. Social and political conflicts are increasingly played out on the screens of media culture, which display spectacles like sensational murder cases, terrorist bombings, celebrity and political sex scandals, and the explosive violence of everyday life. M edia culture not only takes up expanding moments of contemporary experience, but also provides ever more material for fantasy, dreaming, modeling thought and behavior, and constructing identities. Of course, there have been spectacles since premodern times. Classical Greece had its Olympics, thespian and poetry festivals, its public rhetorical battles, and bloody and violent wars. Ancient Rome had its public offerings of bread and circuses, its orgies, its titanic political battles, and the spectacle of Empire with parades and monuments for triumphant Caesars and their armies, extravaganzas put on display in the 2000 film Gladiator.. The charge of hypocrisy has been made in connection with several recent events—namely, the pair of "sex scandals" involving, respectively, Rep. Mark Foley and Sen. Larry Craig, the former, a Republican member of the House from Florida and the latter a Republican senator from Idaho. Foley was accused of sending sexually suggestive messages to teenage boys who had been or who were at the time congressional pages, and Craig was arrested for lewd conduct in a men's bathroom and pleaded (...) guilty to a lesser charge of disorderly conduct. Both Foley and Craig faced immediate calls for resignation by their critics on the other side of the aisle. Both were also criticized by members of their own party. For simplicity, the Democratic critics of Foley and Craig are called "progressives" while their Republican critics are called "conservatives." There are, however, significant logical differences between the criticisms of Foley and Craig by progressives and the similar criticisms of them by conservatives. Since conservatives are generally more critical of sexual indiscretion, their criticisms of Foley and Craig are generally consistent with their own values. Since, however, progressives are generally more tolerant of sexual indiscretions, their criticisms of these men are often inconsistent. Specifically, some progressives find Foley and Craig blameworthy for hypocrisy over acts which, had they been committed by progressives, they would not see as blameworthy. This is why progressives shift the criticism to a different level—namely, that these men are hypocritical. Since Foley and Craig had been champions of "family values," progressives cannot consistently criticize them for their sexual indiscretions. The criticism has to be that, since these men had violated their own conservative standards of morality, they are hypocritical. (shrink)

Plato’s work offers insights into the corrosive impact of eros, insights central for contemporary politics. The article combines an in-depth reading of Plato with a case study, arguing for the relevance of communism. This is because love also establishes a relationship of subordination to the object of desire, which can subjugate and entrap the lover in his or her feelings. Such instrumentalization of eros in communism was promoted by adherents being supposed to love the sufferers. The obligation that to understand (...) and help the sufferers one must become a sufferer turned suffering into an autopoietic system. The acceptance of such instrumentalization of love was rendered possible first by a sense of guilt due to the system of passionate interests (Tarde and Latour), connected to the rise of capitalism as a solution for the period of civil wars, and then by the liminal conditions that emerged, especially in eastern Europe, after two world wars; conditions that were purposefully perpetuated through staging a sacrificial system, paralysing social life. The character of such liminal leaders can be analysed through the figure of the trickster, developed by anthropologists, complementing Weber’s notion of charisma. While communism disappeared as a force, contemporary political life is increasingly reduced to a politics of victimhood and suffering, where the search for the good life is replaced by the double negation of eliminating all suffering from the world – an effort that only produces the opposite result, while public reality becomes torn apart by sex scandals, confirming Foucault’s insight about the investment of desire and enslavement to sexuality. There have been remarkable evolutions in the Nigerian gospel music industry for the past decades. These revolutions have led to the emergence and survival of various modern and controversial musical cultures/traditions, modes and performances including worldliness and paganism in the industry. In view of these relatively nefarious musical cultures, a good number of scholars and observers tend to arguably redefine and brand Christian communication in general and Nigerian gospel music in particular. It is in following this premise that this paper (...) examines the phenomenon of religiosity and worldliness in the Nigerian gospel music industry. Based on observations and secondary data, the paper argues that the Nigerian gospel music industry is just a vivid reflection of the country’s gloomy socio-religious landscape, characterized by the emergence/prevalence of fake ministers and various ubiquitous instrumentalities that perpetrate spiritual bareness in the country. Aspects of religiosity observed in some Nigerian gospel songs include controversial rhythms, imitations/adaptations of worldly songs, lyrical emphasis on prosperity at the detriment of spirituality/salvation, gospel artists being associated with sex scandals and occult practices. Since the turn of the millennium South Korea has continued to grapplewith transgressions that shook the nation to its core. Following the serial killings of Korea's raincoat killer, the events that led to the dissolution of the United Progressive Party, the criminal negligence of the owner and also the crew members of the sunken Sewol Ferry, as well as the political scandals of 2016, there has been much public debate about morality, transparency, and the law in South Korea. Yet, (...) despite its prevalence in public discourse, transgression in Korea has not received proper scholarly attention. Transgression in Korea challenges the popular conceptions of transgression as resistance to authority, the collapse of morality, and an attempt at self- empowerment. Examples of transgression from premodern, modern, and contemporary Korea are examined side by side to underscore the possibility of reading transgression in more ways than one. These examples are taken from a devotional screen from medieval Korea, trickster tales from the late Choson period, reports about flesheating humans, newspaper articles about same- sex relationships from colonial Korea, and films about extramarital affairs, wayward youths, and a vengeful vigilante. Bringing together specialists from various disciplines such as history, art history, anthropology, premodern literature, religion, and film studies, the context- sensitive readings of transgression provided in this book suggest that transgression and authority can be seen as forming something other than an antagonistic relationship. In The Decline and Fall of the Catholic Church in America, the sociologist David Carlin offers insightful explanations for why Catholicism began to unravel in the 1960s. Facing the aftershocks of Vatican II, the collapse of their cohesive urban neighborhoods, and the onslaught of the cultural revolution, American Catholics experienced a “perfect storm” from which they have yet to recover. Carlin sees little reason for optimism about the future. Among other things, he notes thebishops’ “appallingly poor” handling of the sex (...) abuse scandal and their tolerance of homosexuality in the seminaries. By Sanitsuda Ekachai. Edited by Nick Wilgus. Bangkok: Post Books, 2001. 192 pp. Sanitsuda Ekachai, editorial columnist and features section editor of the Bangkok Post, writes this book in the Menckanian tradition of muckraking journalism. A collection of columns from the past decade, the book has an angry goal—the reform of a (...) corrupt Thai Buddhist sangha. Somehow, however, the author manages to accomplish the task without an angry or bitter tone. One suspects that this is because she has the goods. In thirty-six short features and twenty-one even shorter editorials, Ekachai paints a damning picture of a corrupt Theravada Buddhist sangha that has lost touch with both its religious tradition and its lay constituency.She presents overwhelming evidence of the corruption. She tells several well-publicized stories of sexual scandals involving bhikkhus and mentions a dozen more. She carefully tallies the possessions of rich bhikkhus and richer temples. She makes clear the unrepentant patriarchy of the authoritarian Buddhist hierarchy and reminds us of the un-Buddhist character of a sangha that will not allow the ordination of bhikkhunis. And she argues that the root cause of much of this drifting from Buddhist ideals is a buying into the consumerism that has gripped much of modern Thai culture.This last point—consumerism—is important. If the book has a theme—always a tall order for a collection of articles—it is the economic enslavement of Thai culture and the sangha to capitalistic values. Of course, the West is the culprit here. Since Thailand, strictly speaking, has never been colonialized, the West managed to corrupt Thailand (or Siam as some prefer) simply by being in the area. As one of Ekachai's key informants, Sulak Sivaraksha succinctly put it, "Siam is culturally and intellectually colonized because the country identifies itself closely with the West" (161). [End Page 181]A close second as a theme, however, is patriarchy. Patriarchy, not Buddhism, is the root of the gender imbalance in the sangha. The Buddha embraced (a bit reluctantly to be sure) the order of bhikkhunis and made it clear his reluctance was an upayic or strategic matter, not a question of the spiritual status of women. Women are as able as men when Enlightenment is the question. Patriarchy is also at the root of Thailand's shameful sex industry—one in thirty women in Thailand is a prostitute. The culture is at fault here, a culture that sees women as objects rather than persons.Sivaraksha ties consumerism and patriarchy together when he says, "In a consumer society, the seeking for endless sensory pleasures and possessions has become the ultimate quest while Buddhism teaches about letting go" (75). The combination of testosterone-blocking celibacy and baht- driven greed has been too much for the modern bhikkhus of Thailand.Not all bhikkhus, however. Ekachai's book rises above the level of pure muckraking through the simple expedient of offering hope. She tells a dozen or more stories of enlightened (small "e") bhikkhus who are taking steps at reform. By "ordaining" (and thereby protecting) endangered trees in a forest. By teaching the dhamma instead of occultism. By showing economic restraint in the face of runaway rapaciousness. These are inspiring stories of bhikkhus named Buddhadasa, Dhammapitika, Udompatanakorn, Kutajitto, Supajarawat,Visalo, and Kabilsingh. Hope is personalized in these reformers.Reading between the lines, one can imagine a response to Ekachai's overwhelming case: the traditional Thai sangha is organized to serve rural village folk. Although the traditional village still exists in Thailand, it is becoming an endangered species in the face of the urbanized juggernaut. The sangha simply hasn't discovered the keys to reaching a changed constituency. Reading between the lines, one suspects that the author would wholeheartedly agree with this defense. Only she wouldn't consider it a defense but a reason, and a well-known reason at that. Her rejoinder would be that the current leadership must know it is out of touch, but still refuses any move... In my paper I argue that developments within legal ethics—specifically a return to emphasizing the importance of precepts for governing communities capable of forming virtue and for protecting the vulnerable—can contribute to discussions in theological ethics regarding the rule of precepts for the church’s formation of its members in virtue. This concern is especially timely given the recent sex abuse scandals in Protestant and Catholic churches, which have raised wide-spread concerns about the capacity of churches to form character and (...) protect the vulnerable. I consider how this understanding of the relationship between the role of precepts and the community, drawn from legal professional ethics, has important analogical similarities to Aquinas’s description of the virtue of religion. I then consider how Francisco Suárez, SJ, develops Aquinas’s theory to explain how rules are developed within the community, not simply imposed from above, and serve to protect the vulnerable. It is not quite that something has been occluded in contemporary debate and that this something is sexuality. It is more accurate to say that, from a psychoanalytic perspective, the agon of sexuality—and particularly of the drives—is right at the heart of trauma, and that this, especially in the recent alliance of psychoanalysis and history, causes a certain awkwardness. One of the strengths of contemporary trauma theory lies in its articulation of a nuanced and subtle historicity, read through both psychoanalysis and literature, which allows the humanities to reconnect with historical violence, without (supposedly) falling into the pitfalls of a naive historicism [see Caruth]. The awkwardness comes because sexual antagonism is both clearly historical (the violence is well documented) and structurally necessary to psychoanalytic theories of trauma. The two, the historical and the psychic, are clearly not analogues, but they remain stubbornly and infuriatingly intertwined. 4Faced with this theoretical tangle, two options present themselves. The first is to privilege historical trauma over sexual trauma. Persons who commit crimes involving sexual abuse of children exploit their victims in several ways. Sex offenders use their power and authority over vulnerable children to whom they have easy access. Teachers, coaches, clergy, family members and childcare workers have been exposed as sex offenders. The Pennsylvania State University football coach, Jerry Sandusky, is now in prison for his many crimes. The widespread cover up of sexual abuse by Catholic priests in the USA and other countries is a horrendous scandal. (...) It is not surprising that law enforcement, mental health professionals, victims and their families are outraged. It is no surprise that radical interventions such as chemical or surgical castration are a response to the public pressure to protect children from molestation.I agree with Professor John McMillan's thoughtful discussion and nuanced analysis of surgical castration.1i He concludes that surgical castration of sex offenders is ethically permissible if these conditions are met: Castration should be requested by the sex offender. Informed consent from a competent sex offender is required. Consent to castration must not be coerced via threats or inducements.He also says that “castration might be useful for the reconfiguring of a life that has gone badly awry.”To supplement his discussion I will describe a state law in Texas2 that permits voluntary surgical castration for repeat child molesters while they are incarcerated as …. Background Comprehensive commercial surrogacy became legal in India in 2002, and many foreigners, including individuals and same-sex couples, sought Indian surrogacy services due to their affordability. Numerous scandals resulted, with increasing calls for the government to eliminate the exploitation of women in lower social strata. In 2015, the Indian government decided to exclude foreign clients and commercial surrogacy remained legal for local Indian couples only. Furthermore, to eliminate exploitation, the concept of altruistic surrogacy was introduced in 2016. In 2020, (...) some restrictions within altruistic surrogacy practice were removed. Controversy remains, however, in various sectors, not least because surrogacy is a relatively new concept in India. In this paper, the advantages and disadvantages of both altruistic and commercial surrogacy in the Indian context are considered, and more appropriate policy concerning surrogacy practices is suggested. Methods This paper is based on fieldwork conducted in India from 2010 to 2018. Interview surveys were conducted among doctors, policy makers, activists, former surrogates, and brokers. Government documents and media reports were also important sources. Results Surrogacy for commercial purposes began in India in 2002, and stakeholders within the commercial surrogacy industry became well established. It was found that such stakeholders were strongly opposed to altruistic surrogacy as introduced in 2016. It was also found that women in lower social strata still sought some form of financial compensation from their reproductive labor. Controversies surrounding altruistic surrogacy continue within Indian society. Conclusion Policies and practices aimed at eliminating exploitive need to consider the Indian context carefully. Any surrogacy practice might potentially be exploitive, and the distinction between commercial and altruistic surrogacy is too simplistic to be useful, with more nuanced understanding required. It is of critical importance that investigation continues on how to eliminate the exploitation of Indian surrogate mothers throughout the process, regardless of monetary compensation. The entire surrogacy process should be managed with sensitivity, particularly in relation to the well-being of the mother and child. (shrink)

In this article, we build on the stakeholder-politics literature to investigate how corporate scandals transform political contexts and give impetus to the contentious movements of fringe stakeholders against multinational corporations (MNCs). Based on Adut’s scandal theory, we flesh out three scandal-related processes that directly affect political-opportunity structures (POSs) and the generation of social movements against MNCs: convergence of contention toward a single target, publicization of deviant practices, and contagion to other organizations. These processes reduce the obstacles to collective actions (...) by fringe stakeholders by pushing corporate elites to be more sensitive to their claims, by decreasing MNCs’ capability to repress contentious movements, by forcing the targeted MNCs to formalize a policy to monitor and eradicate the controversial practices, and by helping fringe stakeholders find internal and external allies to support their claims. This conceptual model of scandals as catalysts of contentious actions contributes to a better understanding of stakeholder politics by unveiling the role of the political context in the coordination of fringe stakeholders. We analyze whether companies involved in a security class action suit (SCAS) exhibit differential capital structure decisions, and if the information revealed by a corporate scandal affects the security issuances and stock prices of industry peers. Our findings show that before a SCAS is filed, companies involved in a scandal show a greater amount of security offerings than their peers and, due to equity mispricing, are more likely to use equity as a financing mechanism. Following a SCAS filling, these companies (...) exhibit a decreasing amount of total external finance raised and lower levels of book and market leverage. Industry peers' issuance patterns exhibit significant contagion, with reduced debt and equity issuance following the SCAS filing. Corporate scandals also have meaningful negative effects on stock prices and bond ratings. Similar to capital structure, we document contagion at the industry level with peers' share prices yielding negative returns as well. (shrink)

This chapter develops an alternative to the dominant articulation of human existence on the basis of classical phenomenology, arguing that Edmund Husserl's phenomenological inquiries into the structures of embodiment provide a very different and more fruitful starting point for the investigation of sexual difference than the ideas of social gender and biological sex. The ways of classifying sex and gender characteristics mark them out on several different conceptual bases, and thus their categories may not correspond or coincide. Moreover historical and (...) biological inquiries indicate that the dimorphic notion of sex is prescriptive and constructive. Finally the sex/gender paradigm is dominated by the explanatory framework of causes and effects. The phenomenological analysis shows that the causal-functional framework is inadequate for the investigation of the plurality of the bodily existence and sexual difference as a dimension of this existence. In the light of the explication of the concepts of sex and gender, and the phenomenological analysis of embodiment, the sex/gender paradigm cannot offer a basis for a comprehensive philosophy of sexual existence.
