Se plantea en este ensayo la discutida posición de Sócrates acerca de las leyes de Atenas: tanto la ley democrática y positiva, como la ley tradicional no-escrita. Se argumenta sobre las fuentes que tenemos, especialmente la Apología y el Critón de Platón, y los Memorabilia de Jenofonte. Se concluye que Sócrates no dejó nunca, a lo largo de su dilatada existencia, de intentar persuadir sobre la justicia, sosteniendo que, bajo ningún concepto, era justo hacer daño, ni incumplir las leyes o (...) las órdenes de la autoridad superior (humana o divina). El nominalismo es normalmente asociado con una concepción voluntarista de la ley natural, sobre todo por la asociación de ambas doctrinas en la obra de Guillermo de Ockham. Sin embargo, no existe una conexión necesaria entre tales doctrinas, y para mostrar aquello, se expondrá la doctrina de Thomas Hobbes al respecto. En este autor, el nominalismo filosófico, más extremo que el de Ockham, se encuentra asociado a una concepción totalmente necesitarista de la ley natural, hasta el punto de que puede (...) decirse que en Hobbes existe, en materia moral, una inversión de la doctrina ockhamista. En ambos casos hay recurso a Dios, pero en el caso de Ockham, para suministrar el contenido de la ley natural y, en el caso de Hobbes, para garantizar el carácter obligatorio de ésta. (shrink)

Resumen Para Freud la relación entre violencia y ley parece indisociable, en tanto la instauración de esta última depende de una violencia inaugural, la que en lugar de quedar limitada a este momento inicial continúa activa a través de los propios mecanismos psíquicos que encarnan la función de la ley, de manera tal que la ley se encuentra coludida permanentemente con la misma violencia que intenta regular. Pensamos que este dilema es equivalente al delimitado por Benjamin en Para una crítica (...) de la violencia, ensayo en el que este propone, por medio de la figura de la violencia divina o pura, una vía para interrumpir el papel fundante y conservador de la ley que le cabría a la violencia mítica. Se propone que la interpretación de Lacan sobre el acto de Antígona como trasgresión de la Átē, resulta afín a la idea de Benjamin sobre la superación del compromiso entre violencia mítica y ley que adjudica al acontecimiento de la violencia pura, replicando una crítica a la violencia, esta vez dentro de los márgenes teóricos del psicoanálisis. En ambos casos resulta posible situar un más allá del compromiso entre violencia y ley, el cual permite pensar una refundación de los límites simbólicos que dan soporte a la vida en comunidad.For Freud, the relationship between violence and law seems inseparable, in that the establishment of the law depends on an inaugural violence. However, instead of being limited to this initial moment, this inaugural violence continues active through the psychic mechanisms which embody the function of the law, so that the law is constantly in collusion with the same violence that it tries to regulate. We think that this dilemma is equivalent to that defined by Benjamin in his Critique of Violence, an essay in which he proposes, through the figure of divine or pure violence, a way to interrupt the founding and conservative role of law attributed to mythical violence. It is proposed that Lacan’s interpretation of the act of Antigone as a transgression of Átē is akin to Benjamin’s idea of overcoming the compromise between mythic violence and the law that adjudicates the occurrence of pure violence. Lacan thus provides a critique of violence, this time within the theoretical margins of psychoanalysis. In both cases it is possible consider something beyond the compromise between violence and law, allowing one to think of a refoundation of the symbolic limits that support the law and regulate the bonds of community life. African jurisprudence, like African philosophy, continues to be hotly debated. This article contends that the debate straddles the uniqueness claim which either emphasises the existence or possibility of a peculiar legal framework on the continent, and a historical co-extensional position reiterating that African jurisprudence is a continuum of other legal traditions. The article argues that there is no uniquely African jurisprudence, and that what obtains within the structures of jurisprudence on the continent also exists within various legal traditions elsewhere, and (...) as such can at best be described as ‘jurisprudence in Africa’ rather than ‘African jurisprudence’. It defends this thesis through analytic and comparative explications of the content of natural law theory and legal positivism as experienced on the continent. It concedes that relics of the colonial legal experience create contestations that inform scholars’ calls for a return to traditional legal systems. It concludes that a reconstructive jurisprudence in Africa must take cognisance of the continent’s historical and evolutionary legal experiences, but that a unified or monolithic theory may not be sufficient to address the choice of functional jurisprudence. William Connolly is in error when he remarks that I begin my article with a discussion of scientific accounts that reduce the emotions to a few genetically wired categories and that I suggest that the cultural theorists who are interested in affect are driven in the same reductive direction.

The purpose of my article, “The Turn to Affect: A Critique,” was to show that the theorists whose work I analyzed are all committed to the mistaken idea that affective processes are responses of the organism that occur independently of cognition or intention.1 My aim was not to emphasize the differences among the authors under consideration—differences that, as I noted in my article, of course do exist—but rather to demonstrate that those theorists share certain erroneous assumptions about the separation presumed (...) to obtain between the affect system on the one hand and intention, cognition, and meaning on the other and to lay out the unfortunate consequences of their doing so.If Adam Frank and Elizabeth A. Wilson wish for another kind of essay than the one I have written—an essay that would stress the divergences between the ideas of Silvan S. Tomkins and those of the other affect theorists I consider, especially those of Paul Ekman, in order to show what was distinctive about Tomkins's contributions—let them write it. But in such an essay they will have to acknowledge certain facts about the relationship between Tomkins and Ekman that, in their haste to separate Tomkins's theories from Ekman's, they are in danger of neglecting or misrepresenting. In recent years, emotions have become a major, vibrant topic of research not merely in the biological and psychological sciences but throughout a wide swath of the humanities and social sciences as well. Yet, surprisingly, there is still no consensus on their basic nature or workings. Ruth Leys’s brilliant, much anticipated history, therefore, is a story of controversy and disagreement. The Ascent of Affect focuses on the post–World War II period, when interest in emotions as an object of study began (...) to revive. Leys analyzes the ongoing debate over how to understand emotions, paying particular attention to the continual conflict between camps that argue for the intentionality or meaning of emotions but have trouble explaining their presence in non-human animals and those that argue for the universality of emotions but struggle when the question turns to meaning. Addressing the work of key figures from across the spectrum, considering the potentially misleading appeal of neuroscience for those working in the humanities, and bringing her story fully up to date by taking in the latest debates, Leys presents here the most thorough analysis available of how we have tried to think about how we feel. Socially Responsible Investment (SRI) has grown considerably over the past three decades. One form of SRI, engagement-SRI, is today by far the most practiced form of SRI (in assets managed) and has the potential to mainstream SRI even further. However, lack of formalized engagement procedures and evaluation tools leave the engagement practice too opaque for such a mainstreaming. This article can be considered as a first step in the development of a standard for the engagement practice. By developing an engagement (...) heuristic, this article offers a more transparent engagement dialog. Drawing on Stevenson's and Austin's speech-act theories, this article develops a classification of management's responses to the signaling of allegations and controversies on two dimensions: a factual dimension concerning (dis)agreements on factual claims and an attitudinal dimension concerning (dis)agreements on responsibilities, values, and norms. On the basis of the distinctions this article develops, the authors provide for a synoptic table and offer a next-step heuristic for the engagement process that started with signaling a concern to management. The article uses an engagement logic that, while keeping the exit option for the investor open, allows management to address signaled concerns without having to let down or to opt out at the first setback in the dialog process between investor and investee corporation. La primera parte del artículo recrea los datos históricos fundamentales, la segunda explica su validez para los cristianos y las comunidades de nuestro tiempo.

The last decade has seen rise in technologies that allow humans to send and receive intimate touch across long distances. Drawing together platform studies, digital intimacy studies, phenomenology of touch, and ethics of technology, we argue that these new haptic communication devices require specific ethical consideration of consent. The paper describes several technologies, including Kiiroo teledildonics, the Kissenger, the Apple Watch, and Hey Bracelet, highlighting how the sense of touch is used in marketing to evoke a feeling of connection within (...) the digital sphere. We then discuss the ambiguity of skin-to-skin touch and how it is further complicated in digital touch by remediation through platforms, companies, developers, manufacturers, cloud storage sites, the collection and use of data, research, satellites, and the internet. Lastly, we raise concerns about how consent of data collection and physical consent between users will be determined, draw on examples in virtual reality and sex-robotics, and ultimately arguing for further interdisciplinary research into this area. Discussing authorial power, landscape metaphor and the notions of community and sense of place, this explores the ways in which spatial and cultural analysis have found much common ground in making sense of ourselves and the landscape we inhabit.

We re-examine the geometry lesson in the Meno, focusing on the interaction between interlocutors in the practice of recollection. We appeal to an analogy with interactive memory to suggest how Plato could think that inquiry could be successful even when participants have no awareness of what would satisfy their inquiry. This exposes a feature of recollection that needs no metaphysical assumptions, and which emphasises interaction. This feature, which has escaped the notice of philosophers, is more fundamental to the Meno than (...) a theory of innate ideas. Such a theory may be superimposed on the view about interactive memory we describe for the Meno, but to focus on Plato’s epistemological theory without first understanding what he has to say about the social dimensions of memory is putting the cart before the horse. We discuss how we can simulate language evolution in a relatively complex environment which has been developed in the context of the New Ties project. This project has the objective of evolving a cultural society and, in doing so, the agents have to evolve a communication system that is grounded in their interactions with their virtual environment and with other individuals. A preliminary experiment is presented (...) in which we investigate the effect of a number of learning mechanisms. The results show that the social symbol grounding problem is a particularly hard one; however, we provide an ideal platform to study this problem. (shrink)

This paper explores semi‐formal interactions between SRI‐investors that take the governance route rather than deploy a best‐in‐class logic or exclusionary screening. On the basis of a stakeholder typology of the investor and of the chosen topic of interaction, namely compliance with the core ILO labour conventions, the paper formulates 10 expectations about management reactions to the concerns raised by investors. These expectations cover responsiveness, acknowledgment of positions and general attitude. The expectations are then related to the factual discourse by management (...) responding to such concerns raised by investors. Based on data obtained from the Portfolio21‐correspondence, which is a joint initiative of European investors, it is found that management is very willing to discuss cases but at the same time denies the truth‐value of the allegations. This study investigates how social capital affects managers’ use of corporate resources. We find that for firms located in U.S. counties with a high level of social capital, (i) corporate cash holdings have higher marginal value, (ii) the contribution of capital expenditures to shareholder value is higher, and (iii) acquirers experience higher announcement-period abnormal stock returns. We further find that social capital decreases both over- and under-investment, and thus improves ex post corporate investment efficiency. Our evidence suggests that in communities (...) with a high level of social capital, strong social norms and dense social networks constrain unethical corporate behavior, which induces more efficient use of corporate resources. The origin and early evolution of animals marks an important event in life's history. This event is historically associated with an important variable in Earth history – oxygen. One view has it that an increase in oceanic oxygen levels at the end of the Neoproterozoic Era (roughly 600 million years ago) allowed animals to become large and leave fossils. How important was oxygen for the process of early animal evolution? New data show that some modern sponges can survive for several (...) weeks at low oxygen levels. Many groups of animals have mechanisms to cope with low oxygen or anoxia, and very often, mitochondria – organelles usually associated with oxygen – are involved in anaerobic energy metabolism in animals. It is a good time to refresh our memory about the anaerobic capacities of mitochondria in modern animals and how that might relate to the ecology of early metazoans. (shrink)

Criminal violence is one of the most pressing problems in Latin America and the Caribbean, with profound political consequences. Its effects on social policy preferences, however, remain largely unexplored. This article argues that to understand such effects it is crucial to analyze victimization experiences and perceptions of insecurity as separate phenomena with distinct attitudinal consequences. Heightened perceptions of insecurity are associated with a reduced demand for public welfare provision, as such perceptions reflect a sense of the state’s failure to provide (...) public security. At the same time, acknowledging the mounting costs and needs that direct experience with crime entails, victimization is expected to increase support for social policies, particularly for health services. Survey data from twenty-four Latin American and Caribbean countries for the period 2008–12 show that perceptions of insecurity indeed reduce support for the state’s role in welfare provision, whereas crime victimization strongly increases such preferences. Die in diesem Aufsatz vorgelegten Beobachtungen, die aus einem Projekt am Lehrstuhl für Ethik der Georg-August-Universität Göttingen resultieren, machen noch einen weiteren Punkt geltend, so dass 3) bereits die unterschiedliche Einschätzung rein sachlicher Fragen zu einem Dissens führen kann, der (...) als moralischer empfunden wird. Aus diesen drei Momenten erwächst ein allgemeiner Bedarf an ethischer Handlungsorientierung. As Socially Responsible Investment (SRI) enters the mainstream of professional and institutional investment practice, some perplexities arise. Some SRI market participants are well schooled in finance but are hesitative as to how to apply non-financial criteria in the management of portfolios. Governments too are giving SRI more attention and, in some countries, are discussion whether and how to regulate the SRI market. Advocacy groups are targeting SRI projects through media campaigns using political discourse. Many of the pertinent questions that come (...) with these perplexities are of the philosophical or ethical type and concern legitimisation, demarcation of responsibilities, interpretation of norms and policy formulation. The inclusion of non-financial criteria into investment decision-making leads to a 'puzzle in SRI' for which this article offers a solution. The puzzle arises when the day-to-day implementation of an SRIpolicy coincides with the process of administering justice. Three questions make up that puzzle: (1) what should an investor do when allegations arise about a corporation, (2) what should an investor do when a corporation is brought before a court, (3) what should an investor do when a corporation is found guilty by a court. This article argues, by distinguishing between the rationality of the investor and that of the judge, that allegations, court cases or court verdicts should not be reasons to disinvest from a corporation. This article offers examples from investor practice and points out in which way allegations, court cases and court verdicts make sense for investor behaviour. (shrink)

Asylum-seeking and refugee women (ASRW) are population groups characterized by diverse social, economic and legal backgrounds as well as diverse needs. Their backgrounds of forced migration have a profound impact on their overall health, including their sexual and reproductive health (SRH). In Europe, the SRH needs of ASRW are usually more pressing than those of the host country population. In the context of refugee health, it is important to distinguish between asylum seekers and statutory refugees, as asylum seekers have distinct (...) needs and often limited rights in their host country. Yet both groups face many barriers in accessing national health services. This article addresses the issue of entitlements to health services for asylum-seeking women in Europe, and highlights the wide range of difficulties of both asylum-seeking and refugee women in accessing (sexual and reproductive) health services.
