This article probes the usefulness of selected theories from Cognitive Linguistics in the context of statutory interpretation. The presumption of legal language is a well-established rule of statutory construction in Polish legal practice that comes from the internationally recognised theory by Jerzy Wróblewski. It rests on a controversial assumption that there are different levels of generality in legal language (i.e. the language of statutes) and a single term may be given different meanings depending on the level of generality that (...) is referred to. The authors use the notion of basic level categorisation from the cognitive theory of prototypes to explain this mechanism. Legal concepts, not unlike ordinary concepts, form hierarchical taxonomies. A single term may denote concepts that are situated at different levels in different conceptual taxonomies. In the absence of special circumstances, a legal term should be given the meaning that resides at a higher level of categorisation in the respective legal taxonomy. This way, the presumption of legal language is found to be justified on both linguistic and psychological grounds. (shrink)

Since his death in 1986, Michel de Certeau's reputation as a thinker has steadily grown both in France and throughout the English-speaking world. His work is extraordinarily innovative and wide-ranging, cutting across issues in historiography, literary and cultural studies, anthropology, sociology, theology, philosophy and psychoanalysis. This book represents the first full-length study of Certeau's thought. It is organized around the central theme of interpretation and alterity, which Ahearne uses to illuminate Certeau's work as a whole. The author also examines Certeau's (...) theory and practice of historiography; his reflection on the relations between changing historical forms of writing, reading and orality; and his distinction between the "strategic" programmes of the politically powerful and the "tactics" of the relatively powerless. Ahearne places Certeau's work in its general intellectual context, relating it to the views of important contemporary thinkers, such as Pierre Bourdieu and Michel Foucault, and demonstrating the decisive importance to Certeau's thought of the writings of the early modern mystics and travellers. This book constitutes an excellent critical introduction to Certeau's work, while also providing a comprehensive and nuanced reading for those already familiar with his thought. (shrink)

Desire is a rich term meaning wish and want, willingness and relish, appetite and lust. This volume is an effort to analyze the concept of desire and its different practical contexts from a morally philosophic point of view. By analyzing multiple definitions and studying underlying motivations, the authors offer a variety of explanations and interpretations. The volume consists of three main parts. The first part, "Desire and Practice," examines desire as a mental state that seeks personal satisfaction. The second part (...) of the volume, "Desire and Moral Life," explores social, cultural, and literary facets of desire. Finally, in the third part, "Business Ethics and Other Contexts," the authors apply praxiological principles to the business world, examining the conflict between frugality and consumerist ideology, the role of intuition in decision-making, and the need for design education as the basis of effective planning. The contributors to this, the newest volume in Transaction's Praxiology series, seek to explore desire in praxiological terms, with an eye toward the three E's of praxiology: ethics, effectiveness, and efficiency. In this essay I will suggest that part of what makes the young Jamaican poet Ishion Hutchinson so remarkable is the fact that much of his work – in this age of “anything goes” post-postmodernism – is clearly modernist poetry, in both structure and effect. This structure will be that explained in my expanded version of Michael Riffaterre’s semiotic theory of poetry, which deals with modernist work. I will suggest that one of the distinctive features of the latter is that (...) a modern poetic text is distinguished by two underlying “matricial” propositions, each of which generates a set of variant images having the same underlying semantic structure. This paradigmatic method of signifying is unique to poetry. Each matrix is reassembled by the reader from a comparison of the images of each set. The matrices are linked syntagmatically in a variety of relations such as negation or difference of scale. This bimatricial relation (subject-sign) has an intertextual counterpart (object-sign) of similar structure but different lexicon. The interpretant of these two complex signs has a sociolectic counterpart of similar lexicon but different structure. The semantic contrast thus established produces innovation, which is the other distinctive feature of modern poetry. It turns out that much of Hutchinson’s innovative work is structured in this way. This paper analyses the paradigms of interpretation and the evolution of the creative processes in music and law. Whether it is matter of a score or a law, the text is reborn through the work of the interpreter who, in dealing with the epistemological problem of the understanding, has to harmonize the purity of the philological reconstruction of the object with the need to actualize its sense. Moving from the creative character of every interpretation—neither the musician can be reduced to (...) a mere executor of a concatenation of musical symbols on the staff as Stravinsky wanted nor the judge may be conceived as a bouche de la loi according to Montesquieu’s theory—this work, after having discussed Gadamer and Betti’s hermeneutical approaches to music and law, focuses on the issue of the limits to the interpreters’ freedom. The interpretation here proposed revolves around improvisation, seen as a typical cultural practice of the aesthetic dimension of music. Improvisation, which from baroque to jazz does not correspond to the realm of absolute freedom, is used as a trait d’union in order to make a comparison with legal experience. This is particularly true with the development of case law, which becomes increasingly problematic especially in the light of “liquid modernity”, where the “polytheism of values” has been gaining strength. Seen from this perspective, the comparison between the judge and the musician in their activity as interpreters of a formalized system of signs highlights the controversial relationship between form and creativity, the accuracy of the text and the requisites deriving from the social context, certainty and justice. In Eco’s work between around 1960 and 1992, “openness” in a modern literary text can mean (a) “permitting more than one interpretation,” and (b) “requiring a good deal of decoding work from the reader,” which is close to my own position. These two aspects of openness are demonstrated using Baudelaire’s Les Chats, in regard to which Eco denies that the text may be cristallin in Lévi-Strauss’s sense, while still requiring constructive effort from the reader. It is apparent that this term (...) is equivalent to Riffaterreʼs textual “monumentality.” Eco does not go into detail about the reader’s work in assembling the text’s global propositional structure. It is left to Riffaterre and myself to detail the various stages of this work, involving comparison of images in order to discover their common underlying generative proposition. In contrast to Riffaterre, I have long suggested that the modern poetic text is built on two such propositions. It is at the stage of relations between text and sociolect that Eco contributes much to modern poetics. Openness (b) seems to be a prerequisite for perceptual change in the reader, produced by contrast between textual structure and its sociolectic context. Riffaterre prefers to remain within the text/intertext/interpretant triad, preventing him from describing the text-sociolect relation, where the propositional innovation of the modernist text takes effect. The modal object calculus is the system of logic which houses the (proper) axiomatic theory of abstract objects. The calculus has some rather interesting features in and of itself, independent of the proper theory. The most sophisticated, type-theoretic incarnation of the calculus can be used to analyze the intensional contexts of natural language and so constitutes an intensional logic. However, the simpler second-order version of the calculus couches a theory of fine-grained properties, relations and propositions and serves as a framework (...) for defining situations, possible worlds, stories, and fictional characters, among other things. In the present paper, we focus on the second-order calculus. The second-order modal object calculus is so-called to distinguish it from the second-order modal predicate calculus. Though the differences are slight, the extra expressive power of the object calculus significantly enhances its ability to resolve logical and philosophical concepts and problems. (shrink)

Józef Tischner’s role in co-shaping the social consciousness of Polish society was significant. His axiology based on phenomenological method concerned both an individual subject and a community. A big part of his reflections was dedicated to the community with which this priest-philosopher felt the special bond. This justifies the searching for connections between Tischner’s philosophical thought and sociological characteristics of the society which he felt responsible for. The article focuses on the period of the communist rule and the so-called socialist (...) reality. Its first objective is to present Tischner’s creative reception of phenomenology, mainly Husserlian one, along with showing how it was specified by his place and time. The other objective of the article is to show how circumstances of living under the communist regime influenced social attitudes and made Poles retentive of Tischner’s thought. (shrink)

By means of a critical reinterpretation of the famous short story by Herman Melville titled “Bartleby, the Scrivener,” I propose a psycho-anthropological explanation of work behaviors, relationships in work environments, and their psychopathological repercussions. The article notably examines behaviors and work relationships connecting them as outcomes of single individuals' efforts to mentalize ideological–cultural models determining them in a given historical moment. A reductively individualistic interpretation is criticized, which is typically present in clinical and work psychology and ascribes to the single (...) person presumed psychical deficits and exclusively looks in his/her personal history for causes of disadaptive behaviors and antecedents of psychopathological formations. The assessment of patients' decision-making capacity (DMC) has become an important area of clinical practice, and since it provides the gateway for a consideration of non-consensual treatment, has major ethical implications. Tests of DMC such as under the Mental Capacity Act (2005) for England and Wales aim at supporting autonomy and reducing unwarranted paternalism by being ‘procedural’, focusing on how the person arrived at a treatment decision. In practice, it is difficult, especially in problematic or borderline cases, to avoid a (...) consideration of beliefs and values; that is, of the substantive content of ideas rather than simple ‘cognitive’ or procedural abilities. However, little attention has been paid to how beliefs and values might be assessed in the clinical context and what kind of ‘objectivity’ is possible. We argue that key aspects of Donald Davidson's ideas of ‘Radical Interpretation’ and the ‘Principle of Charity’ provide useful guidance as to how clinicians might approach the question of whether an apparent disturbance in a person's thinking about beliefs or values undermines their DMC. A case example is provided, and a number of implications for clinical practice are discussed. (shrink)

According to Kant, the supreme principle of morality is: “act only according to that maxim through which you can at the same time will that it become a universal law” (G 4:421). This principle has come to be known as the Formula of Universal Law (“FUL”). Few philosophers believe it succeeds. But, I argue, few philosophers have understood what FUL means. This dissertation offers a full defense of FUL. It is, in fact, the supreme principle of morality—and it can successfully (...) derive a viable theory of permissible action and virtuous willing. Kant was right. Chapter 1 considers FUL’s role in relation to Kant’s subsequent formulations of the Categorical Imperative and the broader architectonic of duty he sets up in the Metaphysics of Morals. I argue that Kant’s formulations are equivalent insofar as they are each expressions of the very same moral principle. And I suggest that FUL’s two tests correspond to Kant’s later distinction between duties of right and duties of virtue. Thus, FUL’s contradiction-in-conception test can be used to derive duties governing permissible action, and FUL’s contradiction-in-the-will test can be used to derive duties governing virtuous willing. This sets up the framework for the remainder of the dissertation. Chapters 2 and 3 together interpret and defend Kant’s account of permissible action. In Chapter 2, I argue that we should fundamentally reconceive of the nature and purpose of Kant’s permissibility criterion. Kant’s contemporary interpreters have adopted too psychologistic an account of the maxim. Kantian maxims have little to do with the motivating principles of actual agents. Relying on Kant’s historical context and his account of maxims in rational agency, I argue that FUL tests means-end principles which describe act-types. When its permissibility test is applied to such principles, it can viably derive general duties. Chapter 3 continues this positive account of Kant’s permissibility test and defends it from common objections. I argue that the contradiction-in-conception test rejects an act-type when it would be inconceivable for all rational agents to be directly governed by the type’s means-end imperative as a universal practical law. So understood, FUL condemns act-types because: (1) they are hypocritically self-serving, (2) they inflict agential harm on other agents, or (3) they inflict self-harm motivated by self-love. I defend FUL’s derivations against such act-types against common criticisms, such as that they are circular or overbroad. Turning to prominent objections against Kant’s account of permissible action, I then argue that FUL correctly rules out all and only impermissible actions. Moreover, its conclusions are both nuanced and normatively defensible. In Chapter 4, I turn to Kant’s virtue ethics. I begin by considering the demands of Kantian virtue. I argue that we should reject accounts on which duties of virtue are merely less restrictive duties governing permissible action. Instead, I argue, they represent genuinely virtue-ethical requirements to promote morally worthy ends, namely, the ends of our own perfection and others’ happiness. I show that all of Kant’s duties of virtue can ultimately be traced back to one of these required ends. Then, I argue that FUL’s contradiction-in-the-will test can successfully derive our positive obligation to set the ends of virtue. I conclude that FUL is successful not only as a standard of permissibility, but also as the supreme principle of virtue. (shrink)

: This is an attempt to clarify a vital ontological aspect of Tiantai teaching created by the sixth-century Chinese Buddhist monk Zhiyi. To do this Tiantai must first be distanced from Mou Zongsan's interpretation of its central pattern of nonduality, a reconstructive theory that refers to both Chinese Buddhism and Confucianism and sees a "two-level ontology" in Chinese philosophical traditions, grounded in both the Chinese Buddhist patterns of "nonduality between the sacred and the profane" and the Kantian distinction between "noumena (...) and phenomena." Part 1 of this article is a critical analysis and evaluation of Mou's theory, concluding that the Buddhist patterns of nonduality and the Kantian distinction are not mutually convertible. Part 2 focuses on Tiantai ontology in the specific context of its soteriological relevance, demonstrating that the ideal of "universally saving all sentient beings" in Tiantai soteriology must presuppose the conception of "nonduality of/between the sacred and the profane," and that the ambiguous ontological status of existing things corresponds to this soteriological doctrine in a manner that can only be expressed by a "paradoxical articulation." The ontological meaning of Tiantai teaching is then specified with regard to Zhiyi's discussion of reality and the diversity of existing things. The three constitutive elements of Tiantai Buddhism—the soteriological doctrine of nonduality, ontological indeterminacy, and paradoxical articulation—are all based on an ideal of universal salvation that excludes a level of "being" transcending the realm of sentient beings. This conclusion directly controverts Mou's metaphysical notion of a "two-level ontology.". (shrink)

A renewed search for legal certainty is a reaction to the preponderance of judge made law, which has been in turn prompted by the democratic deficit of the EU and the impact of Anglo-American law. The problem is that the search is oblivious to both systematic interpretation and the need of re-systematization of law. The paper defines systematic interpretation, relates the definition to standard French and German conceptions, indicates the room for systematic interpretation in Anglo-American laws, and states prima facie (...) reasons for a re-systematization of law as a prerequisite of systematic interpretation. The problem cannot be appreciated outside its proper context. It is a disregard for causation and evaluation. Hence the paper outlines Aristotle’s understanding of causation and evaluation in his presentation of phronesis, reconsiders continental European legal thought in the light of Aristotle’s presentation, and offers policy-oriented jurisprudence as a remedy to the deficit of evaluation and causation in European legal thought. A solution to the problem offers a typology of criteria and clarifies positive and fundamental legal concepts, positive and fundamental criteria of systematization, and the place of criteria in knowledge of law. The usefulness of the criteria is demonstrated by a common approach to the systematization of law and an alternative diagnosis of a defect of systematization diagnosed by an authority in history and philosophy of law rather than legal theory. This paper aims to reexamine Nietzsche’s early interpretation of Heraclitus in an attempt to resolve some longstanding scholarly misconceptions. Rather than articulate similarities or delineate the lines of influence, this study engages Nietzsche’s interpretation itself in its historical setting, for the first time acknowledging the contextual framework in which he was working. This framework necessarily combines Nietzsche’s reading in philology, post-Kantian scientific naturalism, and of the romantic worldviews of Schopenhauer and Wagner. What emerges is not the acceptance of the metaphysical-flux (...) doctrine so much as a natal form of his physiognomic theory ofperspectivism, a naturalistic and anti-teleological conception of flux, and a theory of justice as cosmodicy. A controversy over the pudgala or “person” raged among Indian Buddhists for more than a millennium. Their polemics were at least as much a matter of canonical exegesis as of reasoning and argument, for the “mainstream” Buddhist doctors had to account for—and explain away—the numerous places in scripture where the Buddha speaks of the “person.” The Bhārahārasūtra or “sūtra on the bearer of the burden” was one of the scriptures most frequently quoted and discussed in this connection. The present paper (...) is aimed at presenting a reconstructed Sanskrit version of this sūtra and providing an overview of the doctrinal and argumentative uses that were made of it in the context of the debates about the status of the “person.”. As compared to frequent considerations of the phenomenon as a creative mythological background for a socio-political struggle, Five Percenter teachings shall be discussed as contemporary interpretations of historical models of self-realization in various philosophical, religious, and esoteric systems. By putting the coded system of the tenfold (...) Supreme Mathematics as one of its core teachings in context with the Pythagorean Tetractys, an arrangement of ten points in four lines, the commonalities between the sequence and concepts attributed to the respective numbers will be demonstrated. This book discusses the question of whether legal interpretation is a scientific activity. The law’s dependency on language, at least for the usual communication purposes, not only makes legal interpretation the main task performed by those whose work involves the law, but also an unavoidable step in the process of resolving a legal case. This task of decoding the words and sentences used by normative authorities while enacting norms, carried out in compliance with the principles and rules of the natural (...) language adopted, is prone to all of the difficulties stemming from the uncertainty intrinsic to all linguistic conventions. In this context, seeking to determine whether legal interpretation can be scientific or, in other words, can comply with the requirements for scientific knowledge, becomes a central question. In fact, the coherent application of the law depends on a knowledge regarding the meaning of normative sentences that can be classified as being structured, systematically organized and tendentially objective. Accordingly, this book focuses on analyzing precisely these problems; its respective contributions offer a range of revealing perspectives on both the problems and their ramifications. (shrink)

Aristotle's criticism of Platonic Forms in the Metaphysics has been a major source for the understanding and developments of the theory of Forms in later Antiquity. One of the cases in point is Aristotle's argument, in Metaphysics I 9, 990b22-991a2, against Forms of non-substances. In this paper, I will first provide a careful analysis of this passage. Next, I will discuss how the argument has been interpreted - and refuted - by the fifth-century Neoplatonists Syrianus and Proclus. This interpretation has (...) played an important role in the broader context of the Neoplatonic debates on the range of Plato's theory of Forms, which was one of the traditional problems discussed about the Forms in later Platonism. This paper investigates the representation of the Shijing 詩經 and its hermeneutic traditions in Cao Zhi’s 曹植 poetic writings with regard to the reception and utilization of the Shijing at different stages, especially the early third century CE. Cao Zhi not merely appropriated poetic utterances and literary patterns from particular odes but also presented a variety of Shijing-related interpretations, which show correspondences with different hermeneutic traditions that transcended the boundaries of the four main Shijing schools. This case represents a syncretic (...) mode of the reception and utilization of the Shijing within larger intellectual and cultural contexts. The Cao regime, as the new ruling authority in Northern China around the early third century CE, engaged in gathering dispersed literary scholars and cultural legacies, in which the Shijing-related materials and sources played significant roles. Taking Cao Zhi’s syncretic representation of the Shijing and its hermeneutic traditions as an instantiation of these factors, this paper also aims to invite methodological reflections on the traditional and modern studies of the reception of the Shijing, considering its status with both literal significance and hermeneutic diversity in early and medieval China. The utterance model is a popular basis for theories of interpretation in the contemporary analytic philosophy of literature. This model suggests that interpretation should be constrained by a work's identity‐relevant factors in its context of production because a work, like an utterance, acquires its identity and content in part from its relations with that context. From a descriptive point of view, I argue that the implied author account of interpretation best describes critical practice following the current positions based (...) on the utterance model. That is, people who interpret in accordance with these positions end up interpreting an implied author. (shrink)

I examine the question why in Proclus' view genetic processes provide demonstrative explanations, in light of the interpretation of Aristotle's theory of demonstration in late antiquity. I show that in this interpretation mathematics is not an explanatory science in the strict sense because its objects, being immaterial, do not admit causal explanation. I show further that Proclus can answer this question in the affirmative due to his realist view of mathematical objects and the priority he ascribes to causal relations over logical relations. This book highlights the importance of Ludwig Wittgenstein’s writings on psychology and psychological phenomena for the historical development of contemporary psychology. It presents an insightful assessment of the philosopher’s work, particularly his later writings, which draws on key interpretations that have informed our understanding of metapsychological and psychological issues. Wittgenstein’s Philosophy in Psychology engages with both critics and followers of the philosopher’s work to demonstrate its enduring relevance to psychology today. Sullivan presents a novel examination of Wittgenstein’s later writings by (...) providing historical detail about the uptake, understanding and use of Wittgenstein’s remarks and method in psychology and related areas of social science, examining persistent sources of conceptual confusion and showing how to apply his insights in investigations of collectives, social life, emotions, subjectivity, and development. In doing so, he reveals the value for psychologists in adopting a philosophical method of conceptual investigation to work through and become more reflexive about prominent theories, methods, therapies and practices in their respective, multiple fields and thereby create a resource for future theoretical, empirical and applied psychologists. This work will be of particular relevance to students and academics engaged in the history of psychology and to practitioners interested in understanding the continued importance of Wittgenstein’s work within the practices of psychology. Most historians and philosophers of philosophy and history of mathematics hold one interpretation or the other of the nature of method of analysis and synthesis in itself and in its historical development. In this paper, I am trying to prove – through three points – that, in fact, there were two understandings of that method in Greek mathematics and philosophy, and which were reflected in Arabic mathematical science and philosophy; this reflection is considered as proof also of this double nature (...) of that method. This dissertation articulates and defends a conception of philosophical anthropology by reading Martin Heidegger’s ‘analytic of Dasein’ as an exemplary case of it and developing its account of anxiety and boredom. I define philosophical anthropology in distinction to empirical anthropology, which I argue is concerned with specificity and difference. Anthropology investigates human beings and their societies in their historical specificity, situated in context, thereby contributing to the understanding of the differences between human beings and their societies across the world (...) and throughout history. Philosophical anthropology, however, concerns the commonality between human beings. It questions at a more abstract level, asking what being a human being is like in general, what structures every case of human existence, what is common to all instances of it. It attempts to account for the structures of human existence and generate conceptual frameworks and vocabularies for describing and analyzing human life. I claim philosophical anthropology and empirical anthropology can complement, make use of and relate productively to each other, two sides of the same coin in the investigation of human existence. After outlining my conception of philosophical anthropology, I show how Heidegger engages in it in Being and Time’s ‘analytic of Dasein’ and other texts of the late 1920s that followed shortly after and continue this sort of project. Heidegger himself, emphatically and repeatedly throughout his career, opposed this reading of his work, but I will show that his most significant arguments in support of this opposition are unconvincing. I then critically develop one aspect of his analysis: its account of what I call the ‘revelatory moods’ of anxiety and boredom. Heidegger theorizes a variety of these moods as involving intense, profound experiences of total meaninglessness, with the very significance of the world receding from us. These experiences convey important insights to us about what it means to exist as human beings. In a brief passage, without arguing for it, Heidegger claims that joy is also a revelatory mood in the same sense, despite its seeming very different from anxiety and boredom. I critically develop Heidegger’s account to theorize joy as a revelatory mood, supplementing his analysis and deepening its usefulness as a philosophical anthropology. Heidegger gives us a conceptual framework for analyzing important human affective phenomena, interpreting their existential significance and their function in the context of our lives. I conclude with a corollary investigation into the relevance that my conception of philosophical anthropology might have to Cognitive Science. I argue, drawing on the work of Heidegger, Merleau-Ponty and Mark Rowlands, that philosophical anthropology could aid Cognitive Science in the construction of what Imre Lakatos called a ‘hard core’ – something that has recently been argued to be problematically missing in Cognitive Science. A ‘hard core’ is a set of refutationresistant principles, conceptions or theories around which a coherent scientific research program can take place. I show that the work of philosophical anthropologists could be useful in debating and deciding what needs to be included in Cognitive Science’s hard core. (shrink)

abstract: I provide a novel interpretation of Aristotle's account of the unity of soul, treating it as resolving the apparent incompatibility of the existence of psychic parts and the soul's status as a unifying form. This incompatibility, I contend, rests on a problematic assumption: mereological actualism, or the claim that parts are actually distinct and prior to the whole. Aristotle successfully undermines actualism and formulates an alternative conception of parthood within De Anima 's figure-soul analogy. As triangles are only potentially (...) present within quadrilaterals, so lower psychic parts are potential parts of higher souls. This picture treats a soul not as a mere aggregate of capacities, but as essentially unified and prior to its parts. Finally, I argue that this picture can be illuminated and must be read against the background of his hylomorphic account of the unity of form given in Metaphysics H.6. (shrink)

The article describes and attempts to resolve a problem that arises for interpreters, translators, teachers, linguists, literary critics, and lawyers. Professional interpreters, for example, see themselves as the impartial transmitters of messages. Their dilemma notably arises in legal contexts when judges and prosecutors use language that is technical and belongs to a political system whose traditions are unfamiliar to defendants. In an effort to explain what such concepts as 'habeas corpus' and 'taking the fifth amendment' mean to Spanish-speaking monoglots, for (...) example, interpreters may become independent voices sending a nuanced version of the original message to its recipients. In such cases, and for other reasons, they may breach the principle of impartiality. The dilemma arises through a seeming incompatibility between two principles essential to impartial interpretation: the need neutrally to transmit a message and the need to communicate the content of a message in such a way as to make it comprehensible to an alien auditor. The author argues that these principles are not necessarily inconsistent. Thus whether an interpreter has deviated from the ideal of impartiality can only be decided on a case-by-case basis. The subject of research in this article is the question of the possibility of formalizing the general theory of systems, that is, turning it into a language for describing systems of any nature with unambiguously defined lexical units and rules. To answer this question, the author considers the phenomenon of semantic indeterminacy of languages, which ensures the flexibility of formed lexical constructions due to the multivalence of lexical units. Also the subject of the research is the practice of quoting out (...) of context – a phenomenon, the admissibility of which is conditioned by the isomorphism of lexical constructions, as well as by the creative nature of the cognitive process, in which the result of cognition is unknown in advance, and thus the change of interpretation of the used concepts is inevitable. The conducted research allows us to state that the general theory of systems cannot be exclusively an applied theory, but should be supplemented with an ontological component. In this case, it becomes a philosophical theory, for which full formalization is impossible without loss of functionality. As a result, general systems theory must inevitably retain a certain semantic uncertainty. This uncertainty, however, can be reduced by translation into universality and generalization of concepts. Besides, it is possible and in some cases necessary to formalize separate components of the general theory of systems, in particular, its ontological component - the metaphysics of material existence. . As a discipline, semiotics has gained recognition in many fields. Cultural background plays an important part in the field of the visual art. Given the rich cultural context of the pictorial hybridization Chinese-European in the early Qing dynasty, the pictorial works can be used in studying semiotics. This article addresses a discourse on some semiotic reflections in painting. It focuses on the application of the theory of the semiotic scientist Charles Peirce that has proven to be suitable for (...) analyzing pictorial works. The model chosen as a subject for investigation is a painting in ink on silk titled “Portrait of Qianlong’s Consort with Yongyan as a Child,” painted using Western techniques in the eighteenth century. The analysis of the portrait offers an appropriate basis to develop some semiotic reflections on this work of art by contributing to aesthetic and artistic awareness. Semiotic structures were employed to develop an understanding of the pictorial forms by turning each element into a tool of communication. The semiotic reading of this work is concerned with the visual art education and sensorial message of the painting. (shrink)

The dissertation shows that the arguments advanced by E. D. Hirsch for authorial intention as the criterion of interpretation do not provide a basis for validity in interpretation because the subject-object ontology underlying those arguments is incompatible with the idea of the identity of a text's meaning. The dissertation argues that, inasmuch as Hirsch's model of interpretation presupposes the total separation of meaning and significance and restricts the meaning of the text to the author's intention, it establishes an insurmountable gap (...) between text and interpreter. This dissertation will attempt to show that H.-G. Gadamer's approach to interpretation succeeds where Hirsch's fails in providing a basis for a legitimate and true interpretation. ;For Gadamer, we can only understand a text by assuming that we share a common linguistic horizon. The horizon itself, however, is grounded in the ontological features of the subject-matter of the text. These ontological features, he maintains, manifest themselves in the dialogical character of language and provide a transcendental ground for the possibility of giving a true interpretation of a text. The meaning of a text thus retains an identity, in Gadamer's view, but it is also capable of assuming an indefinite variety of finite expressions for its content. Gadamer accordingly argues that the meaning of a text cannot be legitimately equated with the intentions of its author. ;In Chapter One, the problem of relativity and objectivity in interpretation is presented. In this context, the problem of method and subject-object ontology is discussed. Chapter Two turns to the problem of the identification of meaning with authorial intention. The intentionalist approaches of Knapp, Michaels, Juhl, and Hirsch are criticized. It also delineates Gadamer's approach to the identification of the author. In Chapter Three, the problem of textual identity is discussed in terms of Hirsch's and E. Betti's distinction between meaning and significance. After presenting the dynamic identity of the text in Gadamer, it is argued that textual identity reveals itself in the truth-claim of the text. Chapter Four attempts to articulate how the ontological characteristics of textual meaning can, as Gadamer argues, provide a basis for truthfulness in interpretation. (shrink)

For two thousand years the Mencius was revered as one of the foundational texts of the Confucian canon, which formed the basis of traditional Chinese education. Today it commands considerable attention in current debates on "Asian values" raging in classrooms and boardrooms in both East Asia and the West. This volume, which represents the work of fifteen respected scholars of early Chinese thought and culture, is an especially timely effort to bring the Mencius under fresh scrutiny. Making use of recently (...) excavated manuscripts, the contributors approach the Mencius from novel perspectives, challenge established interpretations, and confront anew issues that continue to attract and divide students of this classic text. This article provides an overview of philosophical interpretations of Dostoevsky, focusing on readings that pay particular attention to his representation of the battle between good and evil, and postulating that said representation constitutes the essence of his works. The analysis maps this history of interpretations as developing within a specific framework: the dispute between interpreters who argue that good triumphs in Dostoevsky’s works and those who maintain that nihilism prevails in the end. In this context, the article submits its (...) own thesis: that a fundamental contradiction haunts the offer, in Dostoevsky’s works, of Christian salvation, and condemns Dostoevsky to defeat at the hands of his nihilists. This paper explores the scholastic debate about antiperistasis, a mechanism in Aristotle’s dynamics described in the first book of Meteorology as an intensification of a quality caused by the action of the contrary one. After having distinguished this process from a homonymous, but totally different, principle concerning the dynamics of fluids that Aristotle describes in his Physics, I focus on the medieval reception of the former. Scholastic commentators oriented their exegetical effort in elaborating a consistent explanation of an apparently paradoxical (...) process like the intensification of a quality by the opposite one. From the fourteenth century onwards, most of the commentators resorted to the theory of the multiplication of species, according to which each entity acts through the emission of simulacra of the objects (species) that spread spherically in the medium. When these rays encounter an obstacle, such as a contrary quality, they are pushed back towards their source. The reflection of the species determined by the surrounding and opposite quality produces a concentration of the first one, which is therefore intensified. Another distinctive feature of the scholastic interpretation of Aristotle’s antiperistasis is the convergence between the discussions on inorganic and organic matter, physical and medical discourse. This convergence found its most significant expression in the adoption of the model described in the first book of Aristotle’s Meteorology to the biological context of Hippocrates’s Aphorisms I, 15. Following Galen’s exegesis of this passage, medieval commentators established a link between physics and medicine substantially extraneous to Aristotle’s theory. (shrink)

Pragmatist reinterpretations of both deliberative‐communicative theory and legal positivism point out the mentalist fallacy entailed by these prevalent models. I argue that pragmatist approaches imply analogous erroneous beliefs since they presuppose as given the shared perception of social contexts. Therefore they take for granted the shared interpretation of social problems and shared selection of common goals. Hence I advance the necessity of inquiring into the possibility conditions for a shared perception of social contexts. This would entail the organization of institutional (...) incentives meant to extend the scope and inclusiveness of the immediate perception of social context expressed by different agents. (shrink)

A recent ontological variant of Cramer’s Transactional Interpretation, called “Possibilist Transactional Interpretation” or PTI, is extended to the relativistic domain. The present interpretation clarifies the concept of ‘absorption,’ which plays a crucial role in TI (and in PTI). In particular, in the relativistic domain, coupling amplitudes between fields are interpreted as amplitudes for the generation of confirmation waves (CW) by a potential absorber in response to offer waves (OW), whereas in the nonrelativistic context CW are taken as generated with (...) certainty. It is pointed out that solving the measurement problem requires venturing into the relativistic domain in which emissions and absorptions take place; nonrelativistic quantum mechanics only applies to quanta considered as ‘already in existence’ (i.e., ‘free quanta’), and therefore cannot fully account for the phenomenon of measurement, in which quanta are tied to sources and sinks. His 'mitigated scepticism' was the original combination of an experimental approach with a searching mind and a rather disenchanted attitude towards the attainment of perfection in knowledge and in the practical world. But my thesis addresses these questions only implicitly. The general (...) picture of the Humean approach to things political and philosophical is depicted against the background of a close examination of two other themes: Hume's development towards a more 'popular' philosophy and the philosophical import of his moral and political theory. The first subject is studied through an analysis of the formal qualities of Hume's philosophical writings; the second, through a discussion of Hume's position on the origin of justice and government and one's obligation to them. The conclusion that my thesis tentatively advances is that both in metaphysics and politics Hume's approach is based upon the attainment of a state of equilibrium between theoretical and practical considerations, and between sceptical and naturalistic tendencies. Hume's desire for balance can only be understood within the intellectual context of eighteenth century thought. This is the reason for the considerable attention that the thesis devotes to the reconstruction of the historical setting within which Hume's thought developed. However, when correctly interpreted, Hume's ideas clearly have a contribution to make to an understanding of a world which is very different from his own. (shrink)

The ArgumentThe political changes in Czechoslovakia and in other Eastern European countries in 1989 are closely related to Jan Patoĉka's philosophy. He was one of the first speakers for the human rights manifesto “Charta 77” and died following his political interrogations in 1978. Vàclav Havel, the president of the ĉSFR, was one of his students. Patoĉka's philosophy is sketched here following his interpretation of Comenius, beginning with an early work of 1932 and until his interpretation of Comenius' The Paradise of (...) the World and the Labyrinth of the Heart in his book Die Philosophic der Erziehung des J. A. Comenius.As a phenomenologist who transcends both Husserl and Heidegger, Patoĉka's conflict with the political system of his country was inevitable. The regime could not put up with his thesis on the “open soul” which, due to its existential openness, can hear the “call of conscience.” Behind this thesis stands Patocka's teaching of the three movements of existence. And out of this follows his “Education of the Turning.” Patoĉka's theory of education leads straight to some nondogmatic conceptions of education such as the “Communication Pedagogics” which dates back to the dialogical education of Martin Buber. Background The concept of “health security” is often used to motivate public health responses, yet the ethical values that underpin this concept remain largely unexamined. The recent Australian responses to COVID-19 serve as an important case study by which we can analyse the pre-existing literature to see what ethical values shaped, and continue to shape, Australia’s response. Methods We conducted a critical interpretive literature review of academic and grey literatures within key databases, resulting in 2,220 sources. After screening for duplicates (...) and relevance, we analysed ninety-six sources. Results First, risk and uncertainty are a leading focus, with a heavy concentration on risks to life and health. Second, free movement, safety, and security were recurringly emphasized, albeit narrowly focused upon the safety of the population. Third, legitimacy was a recurring theme, and it is here that discussions of “health security” figured highly. Conclusion Discussions of harm from government and associated official bodies fail to adequately distinguish between various senses of harm. Moreover, while the literature often discusses the balancing of rights, the steps involved in the weighing of these rights is rarely adequately explained and defended. We suggest that decision-makers should endeavour to clearly identify and defend the values undergirding their decisions in the public sphere. (shrink)

Neoplatonic allegorical interpretation expounds how literary texts present philosophical ideas in an enigmatic and coded form, offering an alternative path to the divine truths. The Neoplatonist Porphyry’s _On the Cave of the Nymphs_ is one of the most significant allegorical interpretation handed down to us from Antiquity. This monograph, exclusively dedicated to the analysis of _On the Cave of Nymphs_, demonstrates that Porphyry interprets Homer’s verse from Odyssey 13.102-112 to convey his philosophical thoughts, particularly on the material world, relationship between (...) soul and body and the salvation of the soul through the doctrines of Plato and Plotinus. The Homeric cave of the nymphs with two gates is a station where the souls descend into genesis and ascend to the intelligible realm. Porphyry associates Odysseus’ long wanderings with the journey of the soul and its salvation from the irrational to rational through escape from all toils of the material world. (shrink)

Nonindexical Context-Dependence and the Interpretation as Abduction Approach Inclusive nonindexical context-dependence occurs when the preferred interpretation of an utterance implies its lexically-derived meaning. It is argued that the corresponding processes of free or lexically mandated enrichment can be modeled as abductive inference. A form of abduction is implemented in Simple Type Theory on the basis of a notion of plausibility, which is in turn regarded a preference relation over possible worlds. Since a preordering of doxastic alternatives taken for (...) itself only amounts to a relatively vacuous ad hoc model, it needs to be combined with a rational way of learning from new evidence. Lexicographic upgrade is implemented as an example of how an agent might revise his plausibility ordering in light of new evidence. Various examples are given how this apparatus may be used to model the contextual resolution of context-dependent or semantically incomplete utterances. The described form of abduction is limited and merely serves as a proof of concept, but the idea in general has good potential as one among many ways to build a bridge between semantics and pragmatics since inclusive context-dependence is ubiquitous. This oddity is explained by the fact that Arnauld, as spokesman for Port-Royal, was called upon to defend one of the most startling and best-documented miracles in history.

I take as my target, however, not either ofthe books from which I drew my opening quotations, but a much earlier article ofMaclntyre's, "Hume on 'Is' and 'Ought'," in which the ideas expressed in the above quotations are foreshadowed. An examination ofaspects ofthis article will enable me to show, if I am right, how Maclntyre goes startlingly astray. That 1959 article set in motion a lively discussion of the interpretation of Hume: no less than six articles, by Atkinson, Flew, Hudson, and Hunter, all contributions to the debate sparked off by Maclntyre, are reprinted in either or both of Chappell (1968) and Hudson (1969).6 I am in broad agreement with the criticisms made of his article by Atkinson and Flew; but I think it instructive to identify, as they failed to do, Maclntyre's fundamental mistake, which, I shall argue at the end ofthis paper, resulted from the very kind ofconfusion against which Hume warned his readers, and warned them in precisely that passage with which Maclntyre was primarily concerned, the famous paragraph about "is" and "ought" at the end of the opening section of book 3 of Hume's Treatise. My identification of Maclntyre's mistake involves putting that "is"-"ought" paragraph in context: in both, ambitiously on my part, the broad context of the Treatise as a whole, and also the more immediate context of the opening sections of book 3. Maclntyre wrote his article less as a contribution to an ongoing discussion of Hume than as a contribution to an ongoing discussion of ethical naturalism. Mid-twentieth century anti-naturalists, as Maclntyre pointed out, often invoked the "is"-"ought" paragraph as putting forward a view which was direct a ancestor oftheir own.
