Entre 1933 et 1945, la SS, qui se voulait l’élite des « soldats politiques » du régime nazi, développa un important programme visant à prodiguer à ses troupes une « instruction idéologique » weltanschauliche Schulung. Cet article donne un aperçu des conceptions et des méthodes de l’instruction idéologique et retrace les évolutions qu’elles subirent dans le contexte des transformations d’ensemble de la SS elle-même. Bien que l’« instruction idéologique » n’ait finalement pas produit les résultats décisifs escomptés par ses (...) promoteurs, elle n’en fournit pas moins un matériau exemplaire pour une étude des méthodes utilisées par les régimes totalitaires pour fabriquer du consentement politique.From 1933 to 1945, the SS, which claimed to be the elite of the Nazi regime’s “political soldiers”, developed a major programme to provide “ideological schooling” for its troops. This article discusses the concepts and methods of “ideological schooling” and how they evolved with the transformations and changing priorities of the SS itself. Although in the end it did not pro- duce the decisive results that the Nazi hierarchy expected, this “ideological schooling” program nevertheless provides a unique source material for a paradigmatic case study of the methods used by totalitarian regimes to manufacture political consent. More than 7% of all German physicians became members of the Nazi SS during World War II, compared with less than 1% of the general population. In so doing, these doctors willingly participated in genocide, something that should have been antithetical to the values of their chosen profession. The participation of physicians in torture and murder both before and after World War II is a disturbing legacy seldom discussed in medical school, and underrecognised in contemporary medicine. Is there something inherent (...) in being a physician that promotes a transition from healer to murderer? In Anglo-American legal theory the lack of morality was often considered as the main problem of Nazi law. Bringing law and morality together thus seems to meet the challenge posed by the Nazi legal system. In this paper I argue that the mere unification of law and morality is not sufficient to cope with the distortions of Nazi law. By discussing the framework of the SS-jurisdiction and the case of the SS-judge Konrad Morgen I try to show that in the (...) Nazi legal system morality is so deformed that in such circumstances a judge’s aiming for justice has equivocal implications. My conclusion is that we should consider law and morality as two distinct normative spheres and approach the issue of Nazi law using a conception of legality that captures basic requirements of a rule-of-law system. Review of Lars Westerlund's _The Finnish SS-Volunteers and Atrocities against Jews, Civilians and Prisoners of War in Ukraine and the Caucasus Region 1941–1943: An Archival Study_.

Konrad Morgen: The Conscience of a Nazi Judge recounts the wartime career of Georg Konrad Morgen (1909–1982), a judge who prosecuted crimes committed by members of the SS in Nazi concentration camps, including Buchenwald, Dachau, and Auschwitz. In 1943, Morgen discovered the existence of gas chambers at Auschwitz-Birkenau. He tried to throw sand in the works by prosecuting concentration camp officials for lesser crimes. He charged the chief of the Auschwitz Gestapo with for 2,000 murders, and even sought an arrest (...) warrant for Adolf Eichmann. Yet he worked within the ethos of the SS and continued to defend its reputation after the war. The book is a moral biography of Morgen, focusing on how he felt, thought, and deliberated about the moral challenges of his unique position. It explores Morgen’s moral and legal reasoning by drawing on his wartime papers as well as his postwar interrogations and testimonies at war-crimes trials. Mit einer virtuellen Welt kann sehr Verschiedenes und Mannigfaltiges assoziiert werden, unter anderem ein weiterer schillernder Begriff: Die Utopie. Sind nun virtuelle Welten allesamt Utopien? Oder müsste man vielmehr umgekehrt die Utopie als eine besondere virtuelle Welt hervorheben? Dass es überhaupt einen engen Zusammenhang zwischen den beiden Begriffen gibt, scheint nicht einmal selbstverständlich: Es gibt ihn sicherlich nicht, wenn man unter einer virtuellen Welt lediglich ein mit Hilfe von Computertechnik generiertes Szenario und unter einer Utopie schlicht und (...) einfach eine der Wirklichkeit unangemessene Wunschvorstellung versteht oder aber die Utopie als die literarische Konzeption einer für ideal befundenen Gesellschaftsform begreift und ideengeschichtlich demgemäß mit Platons „Staat“ beginnen lässt. Damit das begriffliche Verhältnis zwischen den heute durchaus auch im allgemeinen Sprachgebrauch verwurzelten Ausdrücken „Utopie“ und „Virtualität“ untersucht werden kann, soll der Versuch unternommen werden, anschaulich zu machen, wie sie verwendet werden könnten. Der Begriff der ›Welt‹ hat, wenn wir darunter das »Ganze aller Erscheinungen« verstehen, nicht den Status eines Begriffs, dem ein Gegenstand der sinnlichen Anschauung korrespondieren könnte. Er fungiert vielmehr als transzendentale Idee. Eine solche Idee, die Kant in der Kritik der reinen Vernunft als notwendig für die Vereinigung unserer Erfahrung bestimmt, lässt sich »niemals im Bilde ent- werfen« und bleibt »ein Problem ohne alle Auflösung«. Die Antinomien der reinen Vernunft entspringen für Kant gerade daraus, dass man Ideen dieser Art (...) als Begriffe von gegebenen Gegenständen missdeutet. Dass Welt sich gegen eine derartige Vergegenständlichung sperrt, bedeutet jedoch nicht, dass sie überhaupt nicht im Medium der Anschauung zur Darstellung käme. Der Beitrag geht anhand von Kants Kritik der Urteilskraft der Weise nach, wie die Idee der Welt auf Anschauung und Einbildungs- kraft bezogen ist und wie Welt im Medium anschaulicher Darstellung zur Artikulation und Reflexion kommt. This paper considers the possibility of prediction in land use planning, and the use of statistical research methods in analyses of relationships between urban form and travel behaviour. Influential writers within the tradition of critical realism reject the possibility of predicting social phenomena. This position is fundamentally problematic to public planning. Without at least some ability to predict the likely consequences of different proposals, the justification for public sector intervention into market mechanisms will be frail. Statistical methods like regression analyses (...) are commonly seen as necessary in order to identify aggregate-level effects of policy measures, but are questioned by many advocates of critical realist ontology. Using research into the relationship between urban structure and travel as an example, the paper discusses relevant research methods and the kinds of prediction necessary and possible in spatial planning of urban development. Finally, the political implications of positions within theory of science rejecting the possibility of predictions about social phenomena are addressed. (shrink)

This paper discusses the practice of cost-benefit analyses of transportation infrastructure investment projects from the meta-theoretical perspective of critical realism. Such analyses are based on a number of untenable ontological assumptions about social value, human nature and the natural environment. In addition, main input data are based on transport modelling analyses based on a misleading `local ontology' among the model makers. The ontological misconceptions translate into erroneous epistemological assumptions about the possibility of precise predictions and the validity of willingness-to-pay investigations. (...) Accepting the ontological and epistemological assumptions of cost-benefit analysis involves an implicit acceptance of the ethical and political values favoured by these assumptions. Cost-benefit analyses of transportation investment projects tend to neglect long-term environmental consequences and needs among population groups with a low ability to pay. Instead of cost-benefit analyses, impact analyses evaluating the likely effects of project alternatives against a wide range of societal goals is recommended, with quantification and economic valorisation only for impact categories where this can be done in an ontologically and epistemologically defensible way. However, decoupling can only be partial. Environmental sustainability, therefore, requires that, sooner or later, growth in consumption and production must cease. Policies for combining environmental and social sustainability would be sharply at odds with key mechanisms inherent in the capitalist economy. Urban sustainability thus requires profound (...) changes. On the ontological plane, planning theory must move away from anti-realist constructivism and hermeneuticism, towards realism. On the empirical plane, it is necessary to move away from disciplinary tunnel vision towards a critical realist version of interdisciplinarity, within key research fields such as housing research and transportation research. On the political plane, urban sustainability must move from growth to degrowth, from inequality to equality, and from capitalism to eco-socialism. (shrink)

This article argues that there is a fundamental contradiction between a profit-oriented economic system and long-term environmental sustainability. The ‘solutions’ that are proposed by mainstream environmental economists as well as their ‘ecological economy’ colleagues do not solve the central problems, but serve to further highlight the difficulties of changing capitalism towards sustainability. In a profit-oriented economy, capital accumulation is a prime driving force, and non-growth for the economy at large tends to result in serious economic and social crises. On the (...) other hand, a de-coupling of economic growth from resource depletion and environmental degradation is possible only within certain sectors or product types and within relatively short time perspectives. The assumptions of mainstream economists about infinite economic growth (and infinite dematerialisation) represent a false ontology according to which the powers and mechanisms of the natural world are considered totally controllable by humans as if they were mere epiphenomena of the human world. On the other hand, the assumptions of certain ecological economists about the possibility of steady-state capitalism disregard the relation between capital and surplus value, which constitutes a strong mechanism driving the capitalist economy toward limitless growth. This article addresses the moral and legal difficulties sport governing bodies encounter as human rights promoters. The case presented here is the 2023 decision by the International Olympic Committee (IOC) to allow athletes from Russia and Belarus to compete in international sport under neutral colours, after recommending complete exclusion a year before due to the Russian invasion of Ukraine. While IOC’s change of mind was influenced by UN experts on human rights, claiming that the ban discriminated against Russian athletes, the (...) same experts fail to take into account competing human rights elements that could favour the ban. To that end, this article discusses the complexities of prioritizing human rights in an Olympic context and, deriving from that, demonstrates the existence of moral and legal support for upholding the exclusion of Russia. Finally, the analysis of how to prioritize morally and legally between competing human rights offers deliberative material to other sport governing bodies which could be used to carve out preventive measures prior to their next encounter with a similar situation. As a sovereign wealth fund, the $1 trillion Norwegian Government Pension Fund-Global, which is managed by Norges Bank Investment Management on behalf of the welfare of Norway’s citizens, is supposed to be a flagship for socially responsible investments through its Council of Ethics. However, its investment in Delta Topco, the holding company of Formula 1 world championship that, through Formula One Group, brokered a deal with Russia to host a Formula 1 Grand Prix in 2014, raises the question of whether (...) the Oil Fund should enhance its due diligence processes. Although no evidence of corruption related to the race is introduced, the complex relation between financial logic and the world of sports still raises questions about the ethical solidity of the Oil Fund’s investment. Drawing upon reports of the relationship between political economy and sporting events, this paper therefore analyses, in light of the Oil Fund’s ethical guidelines, the complexities of its investment in Delta Topco. As a result, it is argued that a new set of examination methods by the Council of Ethics may be warranted. (shrink)

Based on metatheoretical considerations, this article discusses what kinds of traffic forecasts are possible and what kinds are impossible to make with any reasonable degree of accuracy. It will be argued on ontological and epistemological grounds that it is inherently impossible to make exact predictions about the magnitude of the ‘general’ traffic growth 20-30 years ahead, since many of the influencing factors depend on inherently unpredictable geopolitical trajectories as well as contested political decision-making. Due to the context-dependency of each particular (...) planning situation, it is also hardly possible to make exact, quantitative predictions about the impact of implementing a specific infrastructure project, compared to ‘doing nothing’. Instead of relying on traffic model simulations as the general forecasting and assessment tool in transport planning, we propose to separate the so-called strategic, tactical and operational levels of traffic forecasting into three distinct methodological approaches reflecting the different degrees of openness/closure of the systems at hand: scenario analyses at the strategic level; theory-informed, mainly qualitative analyses supplemented with simple calculations at the tactical level; while more traditional micro-simulations should be applied only at a detailed operational level. The language comprehension system preferentially assumes that agents come first during incremental processing. While this might reflect a biologically fixed bias, shared with other domains and other species, the evidence is limited to languages that place agents first, and so the bias could also be learned from usage frequency. Here, we probe the bias with electroencephalography (EEG) in Äiwoo, a language that by default places patients first, but where sentence-initial nouns are still locally ambiguous between patient or agent roles. Comprehenders (...) transiently interpreted nonhuman nouns as patients, eliciting a negativity when disambiguation was toward the less common agent-initial order. By contrast and against frequencies, human nouns were transiently interpreted as agents, eliciting an N400-like negativity when the disambiguation was toward patient-initial order. Consistent with the notion of a fixed property, the agent bias is robust against usage frequency for human referents. However, this bias can be reversed by frequency experience for nonhuman referents. (shrink)

Introduction Expressions of Managerial ethics as a clinical phenomenon in Nursing Ethics as expressed by nurse managers were investigated. A coherence could be detected between the concepts and phenomena of Managerial ethics and nurse managers as a context. Background Managerial ethics as a new approach has emerged in the perspective and by prioritizing ethics in the organization has provided the basis for creating and promoting individual and organizational effectiveness. Managers’ and staff’s adherence to professional ethics helps hospitals to achieve their (...) intended goals. Aim The present study aimed to explain nurse managers’ experience of managerial ethics. Research design This qualitative study was conducted based on a phenomenological design in 2022. Participants and research context The participants included 20 nurse managers working in hospitals in Arak, Iran. They were selected by the purposive sampling method which continued until data saturation. Data were collected through semi-structured individual interviews (30–90 min); subsequently, the obtained results were analyzed using the Van Manen six-step approach. Ethical considerations The confidentiality and the right of participants to take part or withdraw from the study were observed during this research. Results The results of the present study were able to demonstrate nurse managers’ lived experience of managerial ethics in the form of five themes of professional ethics, people-oriented management, professional empowerment, excellencism, and patient-centered care. Conclusions As evidenced by the obtained results, nurse managers held a positive view of managerial ethics. They were striving to strongly adhere to ethical principles in nursing management since they contribute greatly to the improved quality of nursing services in care and health settings. Therefore, appropriate policy-making and planning for managerial ethics training are indispensable for all nurses and nursing students. (shrink)
