As the gravity of anthropogenic climate change is dawning on humanity, essential political aspects of the climatic situation remain unexplored. This article argues that our entering the Anthropocene amounts to a constitutive moment: a moment in which new principles of coexistence are being declared. Drawing on, as well as critically engaging with, the work of Bruno Latour and Hannah Arendt, I introduce and explicate the metaphor declarations of dependence to make sense of what scientists, activists, academics and journalists are (...) doing, in political terms, when they announce the Anthropocene. Theoretically as well as practically, this metaphor opens for a more helpful understanding of the fraught relationship between science and the public on the issue of anthropogenic climate change. I end by considering the possibility that this metaphor, literally construed, can help us make today the first day in the rest of our lives in the Anthropocene. (shrink)

In times of crisis, connections among people, cultures, and societies seem to be the main antidotes available against the risks of individualism, auto-referentiality, and a revenge culture. Connectivity offers opportunities to nurture human generativity (Santi, 2021) in the service of better futures and cosmopolitan scenarios, contrasting the delusion of autarchical economies, the rhetoric of political nationalism, and the reinforcement of social polarization by way of competition/marginalization, which applies to education as well. The pandemia that occurred in 2020 brought both risks (...) of isolation and opportunities for connection: it has been a paradoxical and even paroxysmal situation that has challenged us to think about forms of dependence, especially in instructional contexts. The stimulus for an inquiry that was carried out with 817 students at the University of Padova was the provocative title of an album by well-known musicians: “Declaration of Dependence.” The aim was to think about dependencies in the form of regular roles such as “study/student” that are important for our human existence, and which were profoundly upset by the “sindemia” (Singer, 2009). Our aspiration was to explore what it means to belong to a thriving university whose over-arching goal is to serve the dependencies of people in a generative community of future horizons. Our efforts led to the drafting of the “Declaration of Dependence,” a shared manifesto by the research group that enumerated a thorough list of the students' self-declared dependencies, and which was later shared with the university community in multiple languages. This led, in turn, to the use of the Declaration to launch multiple focus groups, which discussed these dependencies in a setting devoted to dialogue and the practice of complex thinking. Subsequently, in a workshop carried out in 2020 at the 20th Biennial Conference of the International Council of Philosophical Inquiry with Children (ICPIC) in Tokyo, we opened an international dimension on the reflections that had preoccupied us in the Padova University context. Here, the aim was to reflect on the personal, collective and educational dependencies of the present historical moment through the practice of community of philosophical inquiry, which offers a paradigmatic time and space for sharing, listening, questioning, and gaining perspective. The conference workshop offered an international group of scholars and practitioners from various socio-political contexts the opportunity to deliberate on how the pandemic has impacted both their local and the global community. Considering the new educational and philosophical challenges presented by the pandemic, the group expressed an urgent need to deconstruct established boundaries and return to “origins.” Invoking metaphors taken from the natural world (Roversi et al, 2022), an inquiry into the nature and scope of our fundamental dependencies reminds us that we are part of a socio-cultural ecology that is grounded and nurtured in our relationship with others. A community that understands its dependencies as gifts that call us to the design of a better future could in fact represent a foreshadowing of a better tomorrow. (shrink)

Aging populations have become a major concern in the developed world and are expected to require novel care strategies. Public policies, health-care regimes and technology developers alike stress the need for a more individualized care to meet the increased demand for care services in response to demographic change. Increasingly, care services are offered to individuals with diseases and or disabilities in their homes by means of Personalized Health-Monitoring (PHM) technologies. PHM-based home care is typically portrayed as the key to a (...) cost-effective future care that better can accommodate the needs of an aging population and promote care recipients’ independence. In light of the emerging technology-based home care, this article sets forth to investigate the significance and implications of a strong emphasis on independence in relation to this novel care form. Notions of independence as used by care planners, care providers and technology developers are examined in relation to ICT-based home care and the reasonableness of independence as an aim for future health-care is critically discussed. This paper explores the issue whether feminism needs a metaphysical grounding, and if so, what form that might take to effectively take account of and support the socio-political demands of feminism; addressing these demands I further propose will also contribute to the resolution of other social concerns. Social constructionism is regularly invoked by feminists and other political activists who argue that social injustices are justified and sustained through hidden structures which oppress some while privileging others. Some feminists (Haslanger and Sveinsdóttir, (...) Feminist metaphysics. In E. N. Zalta (Ed.), Stanford encyclopedia of philosophy. Stanford: Stanford University, 2011) argue that the constructs appealed to in social constructivism are real but not metaphysically fundamental because they are contingent. And this is exactly the crux of the problem—is it possible to sustain an engaged feminist socio-political critique for which contingency is central (i.e., that things could be otherwise) and at the same time retain some kind of metaphysical grounding. Without metaphysical grounding it has been argued, the feminist project may be rendered nonsubstantive (Sider, Substantivity in feminist metaphysics. Philosophical Studies, 174(2017), 2467–2478, 2017). There has been much debate around this issue and Sider (as an exemplar of the points under contention) nuances the claims expressed in his earlier writings (Sider, Writing the book of the world. Oxford: Clarendon Press, 2011) and later presents a more qualified account (Sider, Substantivity in feminist metaphysics. Philosophical Studies, 174(2017), 2467–2478, 2017). Nonetheless, I propose the critiques and defences offered by the various parties continue to depend on certain erroneous assumptions and frameworks that are challengeable. I argue that fundamentality as presented in many of these current accounts, which are underpinned by the explicit or implicit ontologies of monism and dualism and argued for in purely rationalist terms which conceive of subjects as primarily reason-responding agents, reveal basic irresolvable problems. I propose that addressing these concerns will be possible through an enactivist account which, following phenomenology, advances an ontology of interdependence and reconceives the subject as first and foremost an organism immersed in a meaningful world as opposed to a primarily reason-responding agent. Enactivism is thus, I will argue, able to legitimize feminist socio-political critiques by offering a non-reductive grounding in which not only are contingency and fundamentality reconciled, but in which fundamentality is in fact defined by radical contingency. My paper proceeds in dialogue with feminists generally addressing this ‘metaphysical turn’ in feminism and specifically with Sally Haslanger and Mari Mikkola. (shrink)

This paper refutes the widespread view that disjunctions of imperatives invariably grant free choice between the actions named by their disjuncts. Like other disjunctions they can also express a correlation with some factual distinction, but as with modalized declaratives used for non-assertive speech acts this needs to be indicated explicitly. A compositional analysis of one such indicator, depending on, constitutes the point of departure for a uniform analysis of disjunctions across clause types. Disjunctions are analyzed as sets of propositional alternatives (...) that correlate with a partition that the speaker may or may not be able to indicate explicitly. Limited distribution phenomena related to negation and negative polarity are usually thought of in terms of affectivity where affective is understood as negative or downward entailing. In this paper I propose an analysis of affective contexts as nonveridical and treat negative polarity as a manifestation of the more general phenomenon of sensitivity to (non)veridicality (which is, I argue, what affective dependencies boil down to). Empirical support for this analysis will be provided by a detailed examination of affective dependencies in Greek, (...) but the distribution of any will also be shown to follow from (non)veridicality. Recent technological developments have considerably transformed the supply, storage, and transportation processes of cadavers, creating new and previously unforeseen ethical challenges regarding cadaver usage. In this study, we analyzed two aspects of the cadaver processing system—cadaver supply and its use in research. Thereafter, we highlighted the major ethical concerns underlying these stages and correlated our search results with the ethical principles outlined in the Declaration of Helsinki (DoH), or Helsinki Declaration. To ensure the reliability and continuity of medical (...) progress, human—especially cadaver—research depends on the ethical priorities as outlined in the DoH: respect for autonomy, privacy/confidentiality, risks/burdens/benefits, and the protection of vulnerable groups. According to our ethics analysis, which also corresponds with the ethics guidelines of the Consensus Panel on Research with the Recently Dead, the most ignored values were respect for autonomy and privacy/confidentiality issues. Based on these ethical concerns, we provide recommendations to address these challenges in anatomy research. (shrink)

Event-related potential components are sensitive to the processes underlying how questions are understood. We use so-called “covert” wh-questions in Mandarin to probe how such components generalize across different kinds of constructions. This study shows that covert Mandarin wh-questions do not elicit anterior negativities associated with memory maintenance, even when such a dependency is unambiguously cued. N = 37 native speakers of Mandarin Chinese read Chinese questions and declarative sentences word-by-word during EEG recording. In contrast to prior studies, no sustained anterior (...) negativity was observed between the cue word, such as the question-embedding verb “wonder,” and the in-situ wh-filler. SANs have been linked with working memory maintenance, suggesting that grammatical features may not impose the same maintenance demands as the content words used in prior work. (shrink)

Sleep strengthens memories by repeatedly reactivating associated neuron ensembles. Our studies show that although long-term memory for a medium number of word-pairs benefits from sleep, a large number does not. This suggests an upper limit to the amount of information that has access to sleep-dependent declarative memory consolidation, which is possibly linked to the availability of reactivation opportunities. Due to competing processes of global forgetting that are active during sleep, we hypothesized that even larger amounts of information would enhance the (...) proportion of information that is actively forgotten during sleep. In the present study, we aimed to induce such forgetting by challenging the sleeping brain with vast amounts of to be remembered information. For this, 78 participants learned a very large number of 640 word-pairs interspersed with periods of quiet awake rest over the course of an entire day and then either slept or stayed awake during the night. Recall was tested after another night of regular sleep. Results revealed comparable retention rates between the sleep and wake groups. Although this null-effect can be reconciled with the concept of limited capacities available for sleep-dependent consolidation, it contradicts our hypothesis that sleep would increase forgetting compared to the wake group. Additional exploratory analyses relying on equivalence testing and Bayesian statistics reveal that there is evidence against sleep having a detrimental effect on the retention of declarative memory at high information loads. We argue that forgetting occurs in both wake and sleep states through different mechanisms, i.e., through increased interference and through global synaptic downscaling, respectively. People sometimes knowingly undermine the achievement of their own goals by, e.g., playing the lottery or borrowing from loan sharks. Are these agents acting irrationally? The standard answer is “yes.” But, in a recent award-winning paper, Jennifer Morton argues “no.” On her view, the norms of practical reasoning an agent ought to follow depend on that agent’s resource context (roughly, how rich or poor they are). If Morton is correct, the orthodox view that the same norms of practical rationality apply (...) to all agents needs revision. I argue that Morton’s arguments fail on empirical and philosophical grounds. What’s at stake? If Morton is correct, poverty relief agencies ought to re-design their incentives so resource-scarce agents can rationally respond to them. If I’m correct, resource-scarce agents do act irrationally in the cases under discussion, and we shouldn’t be shy about saying so. Instead of declaring them rational, we should try to understand the causes of their irrational behavior and help them better succeed by their own lights. (shrink)

There are indications that simple reaction time might have slowed in Western countries, based on both cohort- and multi-study comparisons. A possible limitation of the latter method in particular is measurement error stemming from methods variance, which results from the fact that instruments and experimental conditions change over time and between studies. We therefore set out to measure the simple auditory reaction time (SRT) of 7,081 individuals (2,997 males and 4,084 females) born in Sweden 1959-1985 (subjects were aged between 27 (...) and 54 years at time of measurement). Depending on cut-offs and adjustment for ageing related slowing on SRT, the data suggest that SRT has increased between 3 and 16 ms in the 27 birth years covered in the present sample. The slowing is unlikely to be explained by attrition, as evaluated by comparing the general intelligence × birth-year interactions and standard deviations for both male participants and dropouts, utilizing military conscript cognitive ability data. The present result is consistent with previous studies employing alternative methods, and may result from several synergistic factors, such as possible recent micro-evolutionary trends favouring lower g in Sweden and the effects of industrially produced neurotoxic substances on peripheral nerve conduction velocity. Background Health ministries in Europe are investing increasingly in innovative digital technologies. Older adults, who have not grown up with digital innovation, are expected to keep up with technological shifts as much as other age groups. This is ethically challenging, as it may threaten a sense of dignity and well-being in older adults. Research objective To clarify the phenomenon of sense of dignity experienced in older adults, concerning how their expectations and needs are met within the context of digitally led (...) healthcare in Norway. Research design A Reflective Lifeworld Research design was chosen, and purposive, in-depth interviews were conducted. Participants and research context The participants were 13 adults 75 years and older from Northern Norway, living at home and not receiving consistent assistance. Ethical considerations Followed the principles of the Helsinki Declaration. This study was approved by the Social Science Data Services in Norway (project number 916119). Interviews were conducted carefully within a safe environment chosen by the participants. Findings Older adults experience that using new digital systems in healthcare makes them become dependent with experiences of helplessness. They feel an increased sense of dependency on other people, and that recognition can assail their experience of personal dignity. Older adults not only expect digitally led healthcare to give them a feeling of safety but also experience feeling insecure concerning privacy and loss of possibilities for dialogue with healthcare providers. They are met by demands from society, which they often struggle to achieve. Conclusion The phenomenon of sense of dignity experienced in older adults, concerning how their expectations and needs are met within digitally led healthcare, indicates a sense of feeling lost in the digital world. Further, innovative healthcare lacks focus on ethical performance. This impacts their perception of dignity, as loss of dignity is noticed especially in its rupture. (shrink)

The Declaration of Helsinki and the Council of the International Organization of Medical Sciences provide guidance on standards of care and prevention in clinical trials. In the current and increasingly challenging research environment, the ethical status of a trial design depends not only on protection of participants, but also on social value, feasibility, and scientific validity. Using the example of a study assessing efficacy of a vaccine to prevent human papilloma virus in HIV-1 infected adolescent girls in low resource (...) countries without access to the vaccine, we compare several trial designs which rank lower on some criteria and higher on others, giving rise to difficult trade-offs. This case demonstrates the need for developing more nuanced guidance documents to help researchers balance these often conflicting criteria. (shrink)

Psychological wisdom concepts were reviewed. 304 people aged 18-85 were tested with use of a questionnaire aimed at learning individual wisdom concepts. Popular wisdom concepts take into account broad declarative and procedural knowledge, life experience of a person and the features of his/her character. Explicitly, under a half of respondents take the following wisdom criteria into account : balancing own profits with concern for others and relation to existential problems, such as sense and direction of life. The respondents lack the (...) consciousness that wisdom is associated with: acting for common good, deep and conscious reflection of value system, the consciousness of limited nature of knowledge and logical thinking and developing relativistic and dialectic thinking. 5 clusters were differentiated, representing popular wisdom concept types. In order to verify the hypothesis about the connection between popular wisdom concepts and the value system of the research participants, value questionnaires were used: Scheler’s and Schwarz’s Portrait Value Questionnaire. The hypothesis was confirmed. Popular wisdom concepts are connected with values appreciated by them. (shrink)

One can debate whether one can extract a legal right to healthcare from the Declaration of Independence depending on whether one sees it is a philosophical or as a legal document. The Constitution of the United States of America lists “promote the general welfare” and protect “ourselves and our posterity” as some of its aims. Perhaps this would demand the inclusion of certain basic (...) health services such as immunizations and antimicrobial therapy for every citizen; even for illegal immigrants, in order to protect the public. America must decide whether health care is a privilege or a right! If it is a privilege, one must accept the exclusion of some individuals and the unintended consequences of epidemics. If it is a constitutional right, one must accept paying for that right with increased taxes and the unintended consequences on the economy. But who should pay, how much and for what? (shrink)

Risk communication has been generally categorized as a warning act, which is performed in order to prevent or minimize risk. On the other side, risk analysis has also underscored the role played by information in reducing uncertainty about risk. In both approaches the safety aspects related to the protection of the right to health are on focus. However, it seems that there are cases where a risk cannot possibly be avoided or uncertainty reduced, this is for instance valid for the (...) declaration of side effects associated with pharmaceutical products or when a decision about drug approval or retirement must be delivered on the available evidence. In these cases, risk communication seems to accomplish other tasks than preventing risk or reducing uncertainty. The present paper analyzes the legal instruments which have been developed in order to control and manage the risks related to drugs – such as the notion of “development risk” or “residual risk” – and relates them to different kinds of uncertainty. These are conceptualized as epistemic, ecological, metric, ethical, and stochastic, depending on their nature. By referring to this taxonomy, different functions of pharmaceutical risk communication are identified and connected with the legal tools of uncertainty management. The purpose is to distinguish the different functions of risk communication and make explicit their different legal nature and implications. (shrink)

Improvement in performance after the end of the training session, termed “Offline improvement,” has been shown in procedural learning tasks. We examined whether Offline improvement in learning a novel orthography depends on the type of reading instruction. Forty-eight adults received multisession training in reading nonsense words, written in an artificial script. Participants were trained in one of three conditions: alphabetical words preceded by direct letter instruction (Letter-Alph); alphabetical words with whole-word instruction (Word-Alph); and nonalphabetical (arbitrary) words with whole-word instruction (Word-Arb). (...) Offline improvement was found only for the Letter-Alph group. Moreover, correlation with a standardized measure of word reading ability showed that good readers trained in the Letter-Alph group exhibit greater Offline improvement, whereas good readers trained in the Word-Arb group showed greater Within-session improvement during training. These results suggest that different consolidation processes and learning mechanisms were involved in each group. We argue that providing a short block of direct letter instruction prior to training resulted in increased involvement of procedural learning mechanisms during training. (shrink)

It was widely believed among post-classical thinkers that the classical Mutakallimūn held that the cause of dependence of an effect on a cause was its origination, or a combination of origination and contingency, or its contingency on condition of its origination. Some post-classical thinkers, led by al-Sayyid al-Sharif al-Jurjānī, went further by interpreting Abu’l-Hasan al-Ashʿarī’s denial of the persistence of accidents was a consequence of his view that origination was the cause of dependence. This is because the origination (...) view entailed that the world was no longer in need of the Creator after its origination, and thus, him and his followers sought to deflect this consequence by holding that accidents do not persist, and since the persistence of substances was dependent on those accidents, and accidents do not persist more than one moment, those substances remained in need of the Creator for those accidents after their origination. This article seeks to investigate this analysis of the Shaykh al-Ashʿarī’s view, alongside the leading scholars of his school. After examining the original sources of classical Ashʿarī thinkers, along with the Baṣran Mu’tazila, and the texts of Ibn Sina, it becomes clear that the Ashꜥarīs did not hold that accidents did not persist in order to deflect that purported consequence. Indeed, it becomes clear that they did not hold that origination was the cause of dependence, but rather, that it was contingency. As for the Mu’tazila, they are explicit that the cause of dependence is origination, and that is based on their view on the reality of the nonexistent. Since essences are real in their state of nonexistence, they are not in need of a cause; and everything that obtains for those essences after they come into exist are entailments of that essence; thus, they only stand in need of a cause in their origination, that is, going from nonexistence into existence. Indeed, they are also explicit that effects do not need the Creator after their origination, and they clarified this through a comparison with a builder and a building. Indeed, the classical Ashꜥarīs criticized them for this, just as Ibn Sina did in the Ishārāt wa’l-tanbīhāt, al-Najāt, and al-Shifā. Thus, those post-classical scholars generalized the statement that origination is the cause of dependence to all classical mutakallimūn, and then they interpreted Ashʿarī’s motivation behind the denial of the persistence of accidents in accordance with that. The truth, however, is that his view on accidents is based on contingency, and that is because a substance is possible of persistence and possible of non-persistence, and therefore, it stands in need of cause to determine its state in the subsequent moment. That determination must entail something additional to the substance itself, otherwise, the effect is redundant. That additional property must be an accident, and since it is impossible for an accident to subsist in an accident, it is not possible for an accident to persist, because it is not receptive to the property which entails persistence; meanwhile, it is possible for substances, because they can sustain accidents. Background Older patients are often vulnerable and highly dependent on healthcare professionals’ assessment in the event of acute illness. In the context of ambulance services, this poses challenges as the assessment is normally conducted with a focus on identifying life-threatening conditions. Such assessment is not fully satisfactory in a patient relationship that also aims to promote and protect patient autonomy. Aim To describe ambulance clinicians’ understanding of older patients’ self-determination when the patient’s decision-making ability is impaired. Research design A qualitative (...) design with an inductive approach, guided by descriptive phenomenology. Participants In total, 30 ambulance clinicians, comprised of 25 prehospital emergency nurses, 1 nurse and 4 emergency medical technicians participated in 15 dyadic interviews. Ethical considerations The research was conducted in accordance with the Declaration of Helsinki, and permission was granted by the Swedish Ethical Review Authority. Findings The findings are presented in two themes: (1) Movement between explicit and implicit will; and (2) Contradictions about the patient’s best interests. The clinicians’ interpretations are based on an understanding of the patient’s situation using substitute decision-making in emergency situations and conversations that reveal the patient’s explicit wishes. Sometimes the clinicians collaborate to validate the patient’s implicit will, while they at other times subordinate themselves to others’ opinions. The clinicians find themselves in conflict between personal values and organisational values as they try to protect the patient’s self-determination. Conclusion The results indicate that older patients with an impaired decision-making ability risk losing the right to self-determination in the context of ambulance services. The clinicians face challenges that significantly affect their ability to handle the older patient’s unique needs based on a holistic perspective and their ability to be autonomous. (shrink)

The World Medical Association has announced that a new revision process of the Declaration of Helsinki has been started. This article will identify the criticisms that have been made in the bioethics literature, particularly since the last revision. In addition, criticisms are discussed that were made in the literature even before the last revision and have not fallen silent. The plausibility of the recommendation for a change in the Declaration of Helsinki is examined.

The work of David R. Lachterman, The Ethics of Geometry, subtitled A Genealogy of Modernity, concerns essentially the status of geometry in Euclid’s Elements and in Descartes’s Geometry. It is a remarkable work, at once by the declared breadth of its ambitions and by the very great precision of its analyses, which are always supported by a prodigious philosophical culture. David Lachterman’s concern is to grasp, by way of an in-depth commentary of certain, particularly crucial passages of these two foundational (...) works, the change in geometry’s status from the one to the other, and this, as a sort of symptom of what the Moderns, since Descartes, will always experience as a necessary, inaugural rupture with regard to tradition. This change is underlaid, according to the author, by a profound change in the philosophical ethos, and in particular, in the geometer’s ethos. One must understand ethos, Lachterman explains, in the manner of Aristotle: those characteristic means that human beings have by which to act in the world or to behave in relation to one another, or to themselves. There is thus an “ethics” of geometry, namely, in the manner and the style of doing geometry, of behaving as a mathematician both toward apprentices and toward the veritable nature of the “entities” which are to be taught or learnt, and which give their discipline its name. That there is a difference of ethos between Euclid and Descartes implies, according to Lachterman, that there is also a difference in the source of intelligibility of the “mathematical,” understood in the most general sense. This in turn implies a deeper difference in the mode of being in general: it suffices to note that, in the ancient case, the source of intelligibility of the geometric figure lies in the nature of the figure itself, and that in the modern case, the same source is found in the “strategies” and “tactics” suited to bringing the figure to its visibility or to its embodiment, 315 in order to notice that this change in the mode of access to intelligibility must have had profound repercussions upon philosophical thought. It is in this sense that the author’s design is also, at the same time, not genetic, but genealogical. The break between ancient and modern mathematics pleas in favor of a consideration of the rupture of modern thought relative to ancient thought; thus, implicitly—and it is one of the great merits of this book that it shows this—against all homogenizing levelling, in Heidegger’s fashion, of the history of thought down to the history of “the” discipline of metaphysics. If there is something Heideggerian, in the best sense of the term, in Lachterman’s way of considering ethos as coextensive with modes of being, there is, on the other hand, and we ought to be very glad of it, something anti-Heideggerian in his original manner of bringing out the effective novelty of modern thought. For, according to him, modern thought is no longer to be defined, explicitly or exclusively, by the so-called “metaphysics of subjectivity.” Instead, it is defined by a self-regulated, operative, and constructive productivity of thought—and this as much with regard to itself as to its objects. To put it briefly, whereas ancient thought is rather polarized by the logico-eidetic, modern thought is polarized by a sort of methodical constructivism, the status of which is, in reality, very complex. If Descartes speaks of “the construction of a problem,” while Leibniz speaks of the “construction of an equation,” and Kant of the “construction of a concept,” everything depends—as we might guess—upon the multiple meanings that the term ‘construction’ may take on. Is it to be taken in the sense of an absolute creation, a quasi ex nihilo creation, which would render mathematics divine? Is it the creation of artefacts, or again, is it the methodical exploration of problems posed to thought by the existence of objects or corresponding ideas, themselves supposed to be somewhere in the divine understanding? We already discern the breadth and the depth of the debate, and we sense that the essential will be played out in Lachterman’s commentaries on the famous Cartesian solution of the problem of Pappus—the birth certificate, as we know, of analytic geometry. Court (Shar’iyya) recordings are at the forefront of primary written sources, which contain important documents related to Turkish history, sociology and culture. The court records shed light on city history of the period concerned with rich information and documents. These records are important books in which the documents related to the judicial, administrative, economic, architectural and social structure of a city as well as diplomatic correspondence between the center and the province were recorded. The purpose of this study is to (...) prepare a detailed catalog in addition to the catalog which was made in 1963 and contained only 119 books specifying only the dates covered by the book number. As we have seen in this study, all of the 119 notebooks in the records do not consist of the court registers in the known form. They are the books that include the records of court proceedings, which are different from those of the court, especially after the Tanzimat e.g. Qassam, Enkiha, Zabt al-Da’wa, Permission and so on. The microfilms of the books were presented to the service of researchers in Sivas Ziya Bey Library of Ancient Works. In the Bursa inscription, which dated to 1337/8, the second Ottoman Sultan (Sulṭān) Orhan was titled as the mujahedeen (warrior), the sultan of the veterans, son of veteran of veteran. The fact that Orhan carring these titles shows that since the earliest times, the Ottoman sultans considered themselves as the leader of the religious war against the infidels. Since the first years of the establishment of the Ottoman State, the Sharīʿa ruled on the establishment of administration and for this reason, they established institution of the Shaykh al-Islām(the chief juristconsult). Firstly, by appointing a subaşı(subashi, an Ottoman gubernatorial title) to the conquered places, then it gradually began to establish judicial courts from the smallest areas.In the XVth century, the number of qāḍī increased in parallel with the increase in their jurisdiction as a result of the expansion of the Ottoman Empire, and the proliferation of the administrative units called sancak, (sanjaq, division of a province) and so the failure of oneqāḍīto satisfy court affairs of an entire sanjaq. New districts arose from some of the former large districts. As a result of this in the XVIth century, the administrative system of the sanjaq's Tımar system and at the same time a geographical integrity of the districts/provinces to see the legal work of a qāḍī to pass by the districts and sub-district as a legal caused to occur two legal definitions that is legal and military administrative. Records of qāḍīs, which is called as sicilemerged because it was their duty to record their works and orders issued to them and the answers and the provisions given to them.The courts of Shar’iyyaserved as primary general courts (maḥākim-i ʿumūmiye) until the declaration of the Tanẓīmāt in the Ottoman Empire and heard the suit at legal, criminal, administrative, military, financial and all kinds of cases. Tanẓīmāt period, or rather Maḥmūd II and the period following him, the judicial organs in terms of reorganization was a circuit that was on the scene.In this way, which was occurred in the judicial system, records which were kept in the Meşihat (Mashīkhat) began to diversify depending on this change. Since in the registry books, which we call classical, all correspondence between the central and provincial offices were recorded. A few years ago, these records, with a correct decision, were collected in the Prime Ministry Ottoman Archives and it was preserved and presented to the use of researchers by transferring them into digital. The Sivas Court building as it is known in history is now in the Pāshābeg quarter and known as the Court Bazaar in these days. There is no clear information about when the court was built in Sivas. In time, changes have occurred in cities and we are losing the historical side of them. In addition, the fact that people acted in an unconscious manner that would harm the historical texture was the biggest factor in disappearance of material remains. With the remaining physical materials available, we can only access crumb information and we can only make predictions. In this evaluation, the biggest materials are the documents and notebooks, which are the memory of city dates. However, it is understood from the records that there is a foundation belonging to this court and some of the court's repair and maintenance works were carried out by this foundation. As it is understood from a document dated 14 August 1798, one of the repairs was sponsored by Ḥüseyin Efendī. In an inscription dated 1906, which was found during the renovation of the basement of an apartment building owned by the General Directorate of Foundations in May 2018, the location of the building was previously known as the Sivas Muftī 's Office.In this study, a total of 240 registry books belonging to Sivas were prepared as in a catalog system. In this study, we have seen that a great deal of records have been lost, burnt or destroyed in a certain way through history. The burn marks in the records of 79 is a striking example in this regard. The book number 139, which is not shown in Osman Ersoy's work, is a record book in classical form. An important case in this study is that the register number 206, which is registered to Sivas, belongs to the province of Burdur and it is also a registry book in classical form. This means that every emotion has an object: if I am angry at (...) John for stealing my car, the object of my anger is the fact (or what I take to be a fact) that my car has been stolen by John. If I find out that this is not the case, that my car has not even left the garage, then my anger should vanish along with its justification. 2 The key point here is that anger, like any other emotion, may be reasonable or inappropriate depending on the situation. If there is nothing to be angry about, then it would be irrational for me to cultivate anger simply because I enjoy having this particular emotion. In general, emotional responses are cognitively flawed whenever they are at odds with the properties of their objects. If we want our judgments to be realistic and not delusional, then we must avoid this kind of error.It is curious, then, that Solomon has written an essay in which he categorically declares that "there is nothing wrong with sentimentality." 3 For it would appear that his theory of emotion provides precisely the terms needed in order to specify what is wrong with it.
