This paper focuses on the link between systems criticism and anti-mathematicism in the French-speaking philosophical literature of the mid-18thcentury. Moving from Condillac’s omissions to the exemplary cases of Diderot and Buffon—as well as considering Formey’s crucial remarks—I reconsider the complex relationship that the authors of the French Enlightenment have with the Newtonian model. Finally, I inquire into the fate awaiting both mathematics and systems in this context after 1750.

For philosophy to criticize the concept of reality requires self-criticism. Throughout history many thinkers that have systematized a critique of both reality and philosophy. In this article we will analyze the Kantian and Hegelian systems by showing the failure in their respective critique to exercise sufficient self-criticism, resulting in unfinished critiques. Going a step further, Tanabe’s proposal was to plunge philosophy into a kind of «absolute disruption» that would drive thought beyond itself by means of an absolute (...) class='Hi'>critique in which being and nothingness are seen to interpenetrate each other, thus opening up the possibility of positing absolute nothingness as «a foundation that is not a foundation.». Scholarly debates on the Critique of Pure Reason have largely been shaped by epistemological questions. Challenging this prevailing trend, Kant's Reform of Metaphysics is the first book-length study to interpret Kant's Critique in view of his efforts to turn Christian Wolff's highly influential metaphysics into a science. Karin de Boer situates Kant's pivotal work in the context of eighteenth-century German philosophy, traces the development of Kant's conception of critique, and offers fresh and in-depth analyses of key parts (...) of the Critique of Pure Reason, including the Transcendental Deduction, the Schematism Chapter, the Appendix to the Transcendental Analytic, and the Architectonic. The book not only brings out the coherence of Kant's project, but also reconstructs the outline of the 'system of pure reason' for which the Critique was to pave the way, but that never saw the light. Heinrich Rickert fut, avec Windelband et Lask, l’un des principaux représentants de l’école néokantienne de Heidelberg, qui se différencie essentiellement de l’école de Marbourg par la façon dont elle redéfinit l’idéalisme transcendantal à partir de la problématique de la validité, héritée notamment de la philosophie de Lotze.Les six articles réunis ici, publiés par Rickert dans la revue Logos entre 1911 et 1932, dessinent les grandes lignes d’une philosophie systématique des valeurs qui ne se veut pas seulement une théorie transcendantale du (...) valoir dans son opposition à l’être, mais aussi, en tant que doctrine des visions du monde, l’élaboration d’une réponse philosophique à la question du sens de la vie. À côté de recherches architectoniques portant sur la détermination et l’articulation des différents domaines axiologiques, mais aussi sur les problèmes généraux liés à la définition de la philosophie comme doctrine des valeurs, ces articles entretiennent une constante polémique à l’endroit de tout intuitionnisme et de toute « philosophie de la vie ». Contre le biologisme qui fait du vivant la valeur absolue et contre la dénonciation intuitionniste de la science comme intellectualisme, l’affirmation de la transcendance des valeurs garantit pour Rickert le droit d’une philosophie scientifique et critique de la culture, qui en appréhende la vie propre en rendant compte de l’articulation des valeurs et de l’effectivité empirique au sein d’un système des valeurs qui reste ouvert sur l’infinie nouveauté et l’inépuisable richesse du monde historique. The aim of this paper is to show that critics of biological explanations of human nature may be granting too much to those who propose such explanations when they argue that the truth of genetic determinism implies an end to critical evaluation and reform of our social institutions. This is the case because when we argue that biological determinism exempts us from social critique we are erroneously presupposing that our social values, practices, and institutions have nothing to do with (...) what makes biological explanations troublesome. My argument is that what constitutes a problem for those who are concerned with social justice is not the fact that particular behaviours may be genetically determined, but the fact that our value system and social institutions create the conditions that make such behaviours problematic. Thus, I will argue that even if genetic determinism were correct, the requirement of assessing and transforming our social practices and institutions would be far from superfluous. Biology is rarely destiny for human beings and the institutions they create. (shrink)

The notion of a migration system is often invoked but it is rarely clearly defined or conceptualized. De Haas recently provided a powerful critique of the current literature highlighting some important flaws that recur through it. In particular, migration systems tend to be identified as fully formed entities, and there is no theorization as to how they come into being and how they break down. The internal dynamics which drive such changes are not examined. Such critiques of migration systems (...) relate to wider critiques of the concept of systems in the broader social science literature, where they are often presented as black boxes in which human agency is largely excluded. The challenge is how to theorize system dynamics in which the actions of people at one time contribute to the emergence of systemic linkages at a later time. This article focuses on the genesis of migration systems and the notion of pioneer migration. It draws attention both to the role of particular individuals, the pioneers, and also the more general activity of pioneering which is undertaken by many migrants. By disentangling different aspects of agency, it is possible to develop hypotheses about how the emergence of migrations systems is related to the nature of the agency exercised by different pioneers or pioneering activities in different contexts. Since the 1970s, debates about Hegel’s Science of Logic have largely turned around the metaphysical or non-metaphysical nature of this work. This debate has certainly issued many important contributions to Hegel scholarship. Yet it presupposes, in my view, a set of oppositions that thwart an adequate assessment of Hegel’s indebtedness to Kant. I hope to show in this paper that Hegel is deeply indebted to Kant, but not to the Kant who is commonly brought into play to argue for the (...) non-metaphysical nature of the Science of Logic. If Kant ’s own Critique of Pure Reason defies oppositions such as that between epistemology and metaphysics, then they cannot be employed to determine the extent to which Hegel’s Logic moves beyond Kant. By focusing instead on the system of pure reason that Kant intended to elaborate, I hope to bring out the ontological thrust of both Kant’s transcendental philosophy and Hegel’s Science of Logic. My paper thus intends to highlight the deep continuity between Kant’s transcendental philosophy and Hegel’s Logic, yet without reducing the latter to the kind of epistemology commonly attributed to Kant. The collective focus of the essays here presented consists of the attempt to overcome the deadlock between metaphysical and non- metaphysical Hegel interpretations. There is no doubt that Hegel rejects traditional and influential forms of metaphysical thought. There is also no doubt that he grounds his philosophical system on a metaphysical theory of thought and reality. The question asked by the contributors in this volume is therefore: what kind of metaphysics does Hegel reject, and what kind does he embrace? Some (...) of the papers address the issue in general and comprehensive terms, but from different, even opposite perspectives: Hegel's claim of a 'unity' of logic and metaphysics; his potentially deflationary understanding of metaphysics; his overt metaphysical commitments; his subject-less notion of logical thought; and his criticism of Kant's critique of metaphysics. Other contributors discuss the same topics in view of very specific subject-matter in Hegel's corpus, to wit: the philosophy of self-consciousness; practical philosophy; teleology and holism; a particular brand of naturalism; language's relation to thought; 'true' and 'spurious' infinity as pivotal in philosophic thinking; and Hegel's conception of human agency and action. A central thinker on the question of the animal in continental thought, Élisabeth de Fontenay moves in this volume from Jacques Derrida’s uneasily intimate writing on animals to a passionate frontal engagement with political and ethical theory as it has been applied to animals—along with a stinging critique of the work of Peter Singer and Paola Cavalieri as well as with other “utilitarian” philosophers of animal–human relations.Humans and animals are different from one another. To conflate them is to be (...) intellectually sentimental. And yet, from our position of dominance, do we not owe them more than we often acknowledge? In the searching first chapter on Derrida, she sets out “three levels of deconstruction” that are “testimony to the radicalization and shift of that philosopher’s argument: a strategy through the animal, exposition to an animal or to this animal, and compassion toward animals.” For Fontenay, Derrida’s writing is particularly far-reaching when it comes to thinking about animals, and she suggests many other possible philosophical resources including Adorno, Leibniz, and Merleau-Ponty.Fontenay is at her most compelling in describing philosophy’s ongoing indifference to animal life—shading into savagery, underpinned by denial—and how attempts to exclude the animal from ethical systems have in fact demeaned humanity. But Fontenay’s essays carry more than philosophical significance. Without Offending Humans reveals a careful and emotionally sensitive thinker who explores the unfolding of humans’ assessments of their relationship to animals—and the consequences of these assessments for how we define ourselves. James Franklin has argued that the formal, mathematical sciences of complexity — network theory, information theory, game theory, control theory, etc. — have a methodology that is different from the methodology of the natural sciences, and which can result in a knowledge of physical systems that has the epistemic character of deductive mathematical knowledge. I evaluate Franklin’s arguments in light of realistic examples of mathematical modelling and conclude that, in general, the formal sciences are no more able to guarantee certainty (...) than the natural sciences. Yet the formal sciences are characterized by a ‘domain-independence’ that is philosophically interesting, and I argue that it is this property that Franklin actually employs to distinguish the formal from the natural sciences. I use Einstein’s ‘principle’/‘constructive’ theory distinction to contrast the domain-independence of physical theories with the domain-independence of formal mathematical theories, and show how both kinds of domain-independence function to generate the domain-independence that is observed in the complex systems sciences. © 1999 Elsevier Science Ltd. Seattle, Prague, Quebec, Nice, Gothenburg, Genoa, Brussels, Barcelona, ≡ All these cities formed the setting of mass globalization protests. In most mass media reports, the presence of thousands of peaceful demonstrators has been outshone by the pictures of radical activists smashing McDonald's and Niketown. In the search for an adequate theological response to today's context of globalization, this article takes precisely this radical activism as a starting–point. In line with those postmodern iconoclasts’ own legitimation, a theological approach to this case (...) leads to the Marxist theory of fetishism and idolatry as it has already been investigated by liberation theologians two decades ago. Surprisingly, a renewed version of this critique of the theologization of economics can be found in No Logo , the trend–setting globalization critique written by the Canadian journalist Naomi Klein. A theological close reading of this best–selling book brings to the light a recurrent use of religious metaphor to characterize the corporate logo as a major aesthetic figure in the context of globalization. In order to understand the aesthetic and theological processes involved, a confrontation with the theological aesthetics of Hans Urs von Balthasar delivers a striking formal parallel between the Church's cross and today's corporate logo. Beyond an at first sight similar theo–aesthetic programme, Balthasar's theological aesthetics however opens up a position which enables us to expose the contemporary global socio–economic system as a subtly inverted Christianity. The book offers a systematic reconstruction of the disagreement between Husserl and Heidegger from the former's perspective, but without falling into any form of Husserlian apologetics. The main thesis is that Husserl's critique of Heidegger's existential analytics as a form of philosophical anthropology entails a deeper fundamental thesis, namely that Heidegger confuses the object of first philosophy (the transcendental determination of the subject) with metaphysics (in the Husserlian sense of the expression). Addressing the Husserl-Heidegger confrontation, this text provides the (...) first systematic reconstruction of Husserl's conception of the system of philosophy from the perspective of his later works, with a special focus on the Cartesian Meditations. At stake in Husserl's critique of Heidegger's philosophy in Being and Time is the refusal to transcendentalize the irrational aspects and nature of our human existence. This first volume addresses Husserl's doctrine of transcendental idealism with the aim of elucidating the distinction between first philosophy, second philosophies and what Husserl calls last philosophy. A reading of Kant’s viewpoint on objectivity is suggested that finds inspiration in the second part of the third Critique, on living systems. It develops the idea that the need to articulate the distinction between objectivity and subjectivity only emerges to the extent that something resists the anticipative procedures of a living, actively engaged being. The possibility of objective knowledge, so it is argued, rests on the possibility of developing an adequate orientation in a phenomenal world, i.e., the possibility (...) of actively distinguishing an “outside” from an “inside”—this not on the basis of an a priori principle, but by taking into account the punctual resistances and disappointments that appear within contingent encounters leading to pleasure and displeasure. We consider negation as a constitutive factor in the emergence of this very basic distinction, as well as in more elaborate and complex differentiations between objectivity and subjectivity. Many different methodological approaches have been proposed to infer the presence of consciousness in non-human systems. In this paper, a version of the theory-heavy approach is defended. Theory-heavy approaches rely heavily on considerations from theories of consciousness to make inferences about non-human consciousness. Recently, the theory-heavy approach has been critiqued in the form of Birch's (Noûs, 56(1): 133-153, 2022) dilemma of demandingness and Shevlin's (Mind & Language, 36(2): 297-314, 2021) specificity problem. However, both challenges implicitly assume an inapt characterization of (...) the theory-heavy approach. I argue that an alternative characterization of the approach, what I call a credence-based theory-heavy approach, avoids these challenges. Theorists can generate interpretations of their theory, at different levels of generality, and operationalize these into theory-informed markers. These theory-informed are assigned a likelihood and are used to assess the probability that a target system is conscious. In providing this characterization, and mapping out the possible ways in which a credence-based theory-heavy approach can be fleshed out, the aim is to situate the theory-heavy approach as a more compelling approach than it is currently being perceived as. Our attention, then, needs to towards remaining challenges such as the consensus problem and the problem of calibrating the likelihoods associated with theory-informed markers. I also explore methodological pluralism and assess how the credence-based theory-heavy approach can benefit from other methodological approaches. (shrink)

Afin de proposer un cadre général pour l'étude de la société transnationale actuellement en émergence, l'article examine de manière critique les principales démarches disciplinaires en cours aujourd'hui. Il souligne l'intérêt d'une approche fondée sur un modèle de type centre/périphérie accompagné de l'hypothèse d'une compétition oligopolistique. Avec ce cadre d'analyse général, la sociologie peut identifier son objet dans le système des liens établis entre les êtres humains par-delà les frontières nationales, que ces liens soient directs ou médiatisés par des institutions (...) transnationales. Une version plus élaborée, et révisée, d'un tel modèle est notamment illustrée par la dynamique de la globalisation culturelle, et par le « système mondial des langues ». (shrink)

For over 20 years, the concept of “food deserts” has served as an evocative metaphor, signifying spatialized patterns of injustice associated with low access to nutritious foods through retail and social exclusion. Yet in spite of its pithy appeal, scholars and activists increasingly critique the food desert concept as stigmatizing, inaccurate, and insufficient to characterize entrenched structural inequities. These well-founded critiques demonstrate a convincing need to reframe approaches to spatialized food injustice. We argue that food desert maps, which aim (...) to visually illustrate food inequality, can reproduce problematic assumptions, stigmas, and inaccuracies that form the crux of scholarly critiques. For example, food desert maps typically overlook community assets and also utilize decontextualized and overdetermined indicators, such as proximity to supermarkets and transportation access. Although we acknowledge the contributions of food desert maps, in this paper we propose a reimagining of food access mapping. To illustrate our argument, we present a course-based food justice mapping study in Providence, Rhode Island. Our project draws inspiration from studies that interrogate the deficit-oriented framing of food deserts, as well as several alternative mapping practices: critical cartography and counter-mapping, community asset mapping, participatory geographic information systems, and radical cartography. We suggest these alternative mapping approaches have potential to move practitioners and viewers beyond the desolate “desert” vantage point and toward a more textured understanding of community food access that inspires engaged exploration. This article raises the issue of the foundation of ethics in the situation of the pluralism of modern and contemporary society. Then , two types of answers to these problems are analyzed: comunitarism as the identitary ethics of an 'ourselves', and contractualism as the ethics of the partners' interests, which present themselves as rival theories in opposition to the universalism of kantian morality. It is however shown , how Kant himself had already worked at different levels of human integration with (...) both models: that of social contract and that of ethical community, and had articulated them in his system. The universal principle of morality , on the other hand, places itself at the meta-level of the profound grammar of the ethos of communities and contracts . Finally, it is observed that Kant´s fundamental ethical texts have not explicitly dealt with the hermeneutical problem of moral judgment in contexts of action. However, some passages of the Grundlegung are analyzed, as well as the Second Part of the Critique of Practical Reason, in which we find precise indications on this issue. It is maintained, that the observed lack of treatment may be bridged by means of widening the scope of the doctrine of reflexive judgment of aesthetic taste of the Third Critique's first part, which appears relevant, not for the foundation of the principle of morality, but for its application, i.e., for moral life.Este artículo plantea el problema de la fundamentación de la ética en la situación del pluralismo de la sociedad moderna y contemporánea. Se analizan luego dos tipos de respuesta a este problema: el comunitarismo como la ética identitaria de un nosotros, y el contractualismo como la ética de los intereses de los socios, los cuales se presentan como teorías rivales frente al universalismo de la moralidad kantiana. Se muestra sin embargo cómo el propio Kant había trabajado ya en distintos planos de la integración humana con los dos modelos del contrato social y de la comunidad ética, y los había articulado en su sistema. El principio universal de la moralidad se ubica en cambio en el meta-nivel de la gramática profunda del ethos de las comunidades y de los contratos . Se observa finalmente que los textos éticos fundamentales de Kant no han tratado de manera explícita el problema hermenéutico del juicio moral en los contextos de acción. Se analizan no obstante algunos pasajes de la Grundlegung y la Segunda Parte de la Crítica de la Razón Práctica, en los que hay indicaciones precisas sobre este problema. Se sostiene que la observada laguna se puede sortear mediante la ampliación de los alcances de la doctrina del juicio reflexivo del gusto estético de la primera parte de la Tercera Crítica, la cual parece relevante, no para la fundación del principio de la moralidad, pero sí para su aplicación, es decir: para la vida moral. This paper challenges the negative attitudes towards labelled proof systems, usually referred to as semantic pollution, by arguing that such critiques overlook the full potential of labelled calculi. The overarching objective is to develop a practice-based philosophical analysis of labelled calculi to provide insightful considerations regarding their proof-theoretic and philosophical value. To achieve this, successful applications of labelled calculi and related results will be showcased, and comparisons with other relevant works will be discussed. The paper ends by advocating for a (...) more practice-based approach towards the philosophical understanding of proof systems and their role in structural proof theory. (shrink)

With the collapse of the bipolar system of global rivalry that dominated world politics after the Second World War, and in an age that is seeing the return of "ethnic cleansing" and "identity politics," the question of violence, in all of its multiple ramifications, imposes itself with renewed urgency. Rather than concentrating on the socioeconomic or political backgrounds of these historical changes, the contributors to this volume rethink the _concept_ of violence, both in itself and in relation to the formation (...) and transformation of identities, whether individual or collective, political or cultural, religious or secular. In particular, they subject the notion of self-determination to stringent scrutiny: is it to be understood as a value that excludes violence, in principle if not always in practice? Or is its relation to violence more complex and, perhaps, more sinister? Reconsideration of the concepts, the practice, and even the critique of violence requires an exploration of the implications and limitations of the more familiar interpretations of the terms that have dominated in the history of Western thought. To this end, the nineteen contributors address the concept of violence from a variety of perspectives in relation to different forms of cultural representation, and not in Western culture alone; in literature and the arts, as well as in society and politics; in philosophical discourse, psychoanalytic theory, and so-called juridical ideology, as well as in colonial and post-colonial practices and power relations. Predictive Sentencing addresses the role of risk assessment in contemporary sentencing practices. Predictive sentencing has become so deeply ingrained in Western criminal justice decision-making that despite early ethical discussions about selective incapacitation, it currently attracts little critique. Nor has it been subjected to a thorough normative and empirical scrutiny. This is problematic since much current policy and practice concerning risk predictions is inconsistent with mainstream theories of punishment. Moreover, predictive sentencing exacerbates discrimination and disparity in sentencing. Although structured risk (...) assessments may have replaced 'gut feelings', and have now been systematically implemented in Western justice systems, the fundamental issues and questions that surround the use of risk assessment instruments at sentencing remain unresolved. This volume critically evaluates these issues and will be of great interest to scholars of criminal justice and criminology. (shrink)

Un système philosophique peut-il se maintenir à travers le temps ? Peut-il renaître après des siècles ? Oui, s'il peut faire l'objet d'une pensée vivante et, donc, personnelle.C'est pourquoi le cardinal Mercier estime que le thomisme authentique est appelé à se rajeunir sans cesse et à prendre la forme d'un néothomisme. Pour renouveller le thomisme, dit le Cardinal, « il ne peut s'agir simplement de retourner en arrière » ; il ne peut être question de considérer la doctrine thomiste comme (...) « une momie ensevelie dans un tombeau et autour duquel nous n'aurions qu'à monter la garde, mais comme un organisme toujours jeune, toujours en activité » ; en l'occurrence, ce qui importe avant tout, c'est esprit » dont la doctrine est animée. Pour saisir exactement l'idée du cardinal Mercier, il faut se référer à l'époque de son enseignement à l'Université de Louvain. En particulier, on doit se rappeler l'importance attachée à l'organisation universitaire de la recherche scientifique, au cours des dernières décades du dix-neuvième siècle, et il est nécessaire de se souvenir de la distinction introduite alors entre la « science faite » et la « science qui se fait » . Le cardinal Mercier n'a pas hésité à appliquer ces vues à la philosophie et dès lors au thomisme, qu'il considérait comme la philosophie vraie . Cependant il ne lui était guère possible, à cette époque, d'établir, à ce point de vue, une nette différence entre les sciences et la philosophie. Depuis lors, les résultats obtenus par la « critique des sciences », ainsi que certaines considérations de la philosophie d'aujourd'hui, sont venus jeter quelque lumière sur ce point capital. Au lieu d'étudier directement le problème, examinons le comportement du philosophe, pour savoir en quoi il diffère de celui de l'homme de science. Dans une étude philosophique se rencontrent régulièrement des références aux philosophes anciens, dont on discute les idées. On remarque que tout philosophe véritable garde indéfiniment son actualité : il ne se trouve jamais entièrement remplacé, annulé, par les penseurs qui le suivent. Assurément, personne ne songerait à prétendre, par exemple, qu'au vingtième siècle il n'y a plus aucun profit à étudier les classiques grecs ; et qui donc s'aviserait de nier que la disparition des œuvres de ces philosophes constituerait une perte irréparable ? A considérer l'histoire, il semble que tout se passe comme si un « colloque philosophique » se poursuivait depuis des siècles. Quelques dizaines de penseurs y prennant une part active. Or, il est remarquable qu'aucun des membres effectifs de ce Symposion ne s'efface jamais, ni ne cède la place à un autre. De fait, le groupe des penseurs déjà réunis voit, de temps à autre, de nouveaux se joindre à eux, mais toujours les derniers venus reconnaissent l'autorité des anciens et ils ne manquent pas de s'expliquer avec eux. Dans le secteur des sciences, il en va tout autrement. Pour s'y mettre au courant, c'est uniquement aux auteurs les plus récents qu'il convient de s'adresser. Les hommes de science du passé n'ont plus qu'une importance historique. Dès lors, on ne s'y réfère pas, on ne discute plus leurs opinions. A la lumière des résultats obtenus grâce à la critique des sciences, il est devenu possible de se faire une idée exacte de la valeur des sciences modernes, de définir la nature de leurs méthodes et la portée de leurs résultats. En conséquence, l'on peut poser le problème de la distinction entre les sciences et la philosophie avec quelque chance d'aboutir à une solution précise et dûment fondée. L'homme de science considère les données d'un point de vue objectif , du « point de vue de Sirius ». C'est notamment ce que fait le physicien lorsqu'il utilise des instruments pour enregistrer les faits et pour noter la régularité de leurs rapports spaciaux et temporels. Tout au contraire, le philosophe s'attache à « intelliger » ces mêmes réalités et à déceler les « significations » qu'elles comportent. Dès lors, en philosophie, un facteur personnel intervient immanquablement, tant en ce qui concerne la richesse des données d'expérience qu'en ce qui concerne la force du regard intellectuel qui les pénètre et les saisit. Ce qui n'autorise nullement de conclure au subjectivisme, bien au contraire. Dès lors, on comprend que tout système philosophique porte la marque de la personnalité « incommunicable » de son auteur et que, pour autant, il demeure irréductible à tout autre, — ce qui entraîne la condamnation de l'éclectisme. En effet, comme la personnalité humaine, tout en demeurant liée à la matière, est essentiellement fonction de l'esprit et, par conséquent de l'activité libre, on comprend que l'œuvre d'un philosophe ne puisse remplacer adéquatement celle d'un autre, même lorsqu'elle lui est de beaucoup supérieure : l'une et l'autre demeurera donc actuelle et chacune vaudra d'être entendue, discutée, fût-ce pour être réfutée. Par ailleurs, on ne voit pas le moyen de prévoir comment la pensée philosophique s'orientera dans la suite. A cet égard, il y a bien des traits communs à l'art et à la philosophie. Cependant la différence demeure profonde, car le propre de la philosophie est de tendre à découvrir la vérité dans sa valeur absolument universelle ; et en cela son activité de recherche rejoint celle de l'homme de science. C'est pourquoi, les différents systèmes ne présentent pas la même valeur philosophique ; et, comme il nous est donné de suivre les échange de vues du grand « colloque philosophique », nous sommes en droit de donner la palme à tel ou tel penseur, par exemple S. Thomas, s'il nous paraît être le meilleur. Il reste, que les autres penseurs se trouvent, eux aussi, d'une manière qui leur est propre, en possession de quelque vérité, même s'ils s'égarent sur les questions fondamentales ; ainsi qu'aimait à le répéter le cardinal Mercier : « dans toute erreur il y a une âme de vérité » Il en résulte que si l'on veut se faire le disciple de S. Thomas, c'est par un effort personnel qu'on doit poursuivre l'œuvre de celui-ci. Sans doute, le thomiste est-il supposé reprendre la structure essentielle du système, l'ensemble des thèses doctrinales, mais c'est pour les faire vivre, à savoir pour les rendre fécondes en les gardant enracinées dans une expérience de base, comme S. Thomas, sans aucun doute, a dû le faire lui-même. C'est à partir de pareille expérience que le Docteur Angélique a abstrait ses dées et qu'il a établi les catégories fondamentales de son système ; et c'est à ces données d'expérience qu'il n'a cessé de se référer, pour éclairer toujours davantage ses idées et en équilibrer le contenu, pour les compléter et, au besoin, les corriger. Il faudrait donc découvrir où se situe cette expérience chez S. Thomas, — par exemple, en rapport avec sa conception si personnelle de l'unité substantielle de l'homme et celle non moins personnelle de la signification de Y esse ; — travail difficile, car S. Thomas se retire modestement derrière l'exposé sincère de sa doctrine, sans fournir la description « phénoménologique » de son expérience personnelle, comme les auteurs actuels se plaisent à le faire ; travail ardu, qui suppose l'étude attentive et scrupuleuse du texte authentique, du milieu doctrinal, des sources littéraires et de la manière dont S. Thomas les utilise. Les résultats de pareille étude permettront de voir se profiler l'expérience qui fut la terre nourricière de la doctrine élaborée par le Docteur Angélique. Il faudra s'efforcer de faire soi-même une expérience analogue, tout aussi personnelle, c'est-à-dire liée étroitement au tempérament de la personne qui la fait, à la formation qu'elle a acquise, dès lors aux conditions de temps et d'espace dans lesquelles elle s'est développée, à l'atmosphère philosophique qu'elle respire, etc. : bref, une expérience réelle, vivante, donc « d'aujourd'hui ». C'est à partir de là que surgira la doctrine et que pourra se construire le système ; comme c'est à partir de là que l'idée thomiste pourra croître, se renouveller, garder sa perpétuelle jeunesse et sa fécondité. This study is an exploration of the Hagar narrative from the perspective of African Womanist Theology. The article focuses on the spirituality of Hagar before and after her captivity (Gn 16). The research takes an Afrocentric perspective and uses a postcolonial lens to comment on the preceding text as well as consider how this story is captured in Judaism, Christianity and Islam. At the core of the article is an attempt at reclaiming the African in Hagar who is largely portrayed (...) in the stories of Sarah and Abraham within a Hebrew perspective which itself is arguably imperial. The aim is to inspire modern African women (and in the diaspora) to reclaim their African spirituality within their stories and experiences. Summarily, the article is a critique of the colonial project, slavery and its legacies in dehumanising and disenfranchising people and African knowledge systems. The article is structured as follows: firstly, it introduces the Hagar and/or Hajar traditions from the perspectives of Judaism, Christianity and Islam. Secondly, it takes a step back to consider Hagar’s identity as an Egyptian princess before she encountered Sarah and Abraham. The article also discusses how Hagar’s past in Egypt had a bearing on her spiritual encounters when she and her son Ishmael and/or Ismail were exiled. Finally, the article concludes with a recommendation for continued reflection on an African spirituality narrative of the Hagar traditions alongside the predominant narratives from Abrahamic religions.Contribution: This article demonstrates that the religious scriptures must be read from liberation perspectives such as the postcolonial paradigm to inspire the recovery of authentic experiences of the oppressed and displaced, and it is an inspiration to African women to reclaim their true identity and spirituality. Focusing on the case of Colombia, this article sets out a sociological examination of constitutions marked by strong, activist judiciaries, by entrenched systems of human rights protection, and by emphatic implementation of global human rights law. Contra standard critiques of this constitutional model, it argues that such constitutions need to be seen as creating a new pattern of democracy, which is often distinctively adapted to structures in societies in which the typical patterns of legitimation and subject formation required for democratic (...) government were obstructed. In polities with such constitutions, legal institutions and norm setters have at times assumed the status offunctional equivalentsfor more typical democratically mandated actors and institutions. In such polities, further, global law assumes essential importance as it creates new sources of normative authorization for legislation and stimulates new lines of articulation between government and society. The article concludes that analysis of such polities, exemplified by Colombia, shows that the common categories of democratic-constitutional analysis are no longer always adequate for understanding current tendencies in democratic formation, and they can easily undermine democracy itself. Il a vu être jugés et condamnés des individus accusés de braquage, d’attentat, d’assassinat, de coups mortels, de viol. A partir de cette expérience, il propose une réflexion sur l’Etat pénal, le pouvoir et la violence. Nos manières de rendre la Justice s’inscrivent dans un système général et a priori paradoxal : pour juger, les procès construisent une narration individualisante des acteurs et des causes de leurs (...) actes ; mais, pour réprimer, ils transforment chaque action interindividuelle en agression contre la «société» ou contre l’Etat. Comment comprendre ce système du jugement et de la répression et ce jeu des catégories pénales? La Loi est souvent présentée comme instaurant le règne de la raison contre les réactions passionnelles. Ne produit-elle pas en réalité des effets de dépossession et du traumatisme? A quelles conditions une sociologie critique pourrait-elle nous donner les moyens d’imaginer un droit moins violent, un Etat moins souverain et une justice plus démocratique? En mêlant récits et analyses théoriques, Geoffroy de Lagasnerie montre que l’institution judiciaire ne forme pas seulement une réponse à la délinquance. La scène du tribunal, où un individu est forcé de comparaître devant des juges, est un miroir grossissant de notre appartenance à l’Etat. Si bien que, au bout du compte, cet ouvrage offre une exploration de notre condition de sujet politique. Adopting a materialist approach to the mind has far reaching implications for many presuppositions regarding the properties of the brain, including those that have traditionally been consigned to “the mental” aspect of human being. One such presupposition is the conception of the disembodied self. In this article we aim to account for the self as a material entity, in that it is wholly the result of the physiological functioning of the embodied brain. Furthermore, we attempt to account for the structure (...) of the self by invoking the logic of the narrative. While our conception of narrative selfhood incorporates the work of both Freud and Dennett, we offer a critique of these two theorists and then proceed to amend their theories by means of complexity theory. We argue that the self can be characterised as a complex system, which allows us to account for the structure of the wholly material self. (shrink)

The aim of this paper is to show that critics of biological explanations of human nature may be granting too much to those who propose such explanations when they argue that the truth of genetic determinism implies an end to critical evaluation and reform of our social institutions. This is the case because when we argue that biological determinism exempts us from social critique we are erroneously presupposing that our social values, practices, and institutions have nothing to do with (...) what makes biological explanations troublesome. My argument is that what constitutes a problem for those who are concerned with social justice is not the fact that particular behaviours may be genetically determined, but the fact that our value system and social institutions create the conditions that make such behaviours problematic. Thus, I will argue that even if genetic determinism were correct, the requirement of assessing and transforming our social practices and institutions would be far from superfluous. Biology is rarely destiny for human beings and the institutions they create. (shrink)

The so-called New Music in Europe after the Second World War was based on the idea of progress, similar to technological progress and related to it, and aimed at a complete rationalization of composing. The ideal of music as autopoiesis, which appeared in the 1950s, became inherent to this development. It supposed a kind of communication on music as a reified object, which opposed music making and listening as communication between partners. Separated from the life-world and conceived as a self-referential (...) system, New Music should represent not only the logical achievement of the historical development of European music, but also the superiority of Western musical thought in the more developed countries over the music cultures of the world. Therefore, the integral serialism, which should rule the musical composition, became a form of symbolic power within the musical field, in correspondence with similar forms of domination within the economic, political and technological fields. However, some European composers rejected this trend and tried to find an alternative to aestheticism by means of political engagement. For instance, the Italian composer Luigi Nono explores the dialectic between subject and object, technological development and critique of technology, avant-garde and critique of progress, globalization and anti-imperialistic resistance. In his strategy, in which Gramsci's and Walter Benjamin's thought played an important role, aesthetics became inseparable from politics. His search for identity as a composer transforms the tragedy of listening into an allegory of human condition. (shrink)

Professor Franklin is correct to say that there are significant areas of agreement between his account of formal science (Franklin, 1994) and my critique of his account. We both agree that the domain-independence exhibited by the formal sciences is ontologically and epistemically interesting, and that the concept of ‘structure’ must be central in any analysis of domain-independence. We also agree that knowledge of the structural, relational properties of physical systems should count as empirical knowledge, and that it makes sense (...) to talk about an empirical ‘science’ of structure. Where we disagree is over the frequency of occasions where ‘practical certainty’ is actually attained: Franklin argues that practical certainty is not uncommon in the formal sciences, while I argue that there are barriers to practical certainty that Franklin fails to appreciate. In Franklin’s response, he briefly presents and offers criticisms of my two main arguments against his central thesis. Franklin asserts that the flaw in my first argument is that it does not appreciate that modern mathematical models exhibit structural stability, and thus that many of their predictions are robust under small variations in input or parameter values (and hence, insensitive to the inevitable gaps between estimates and actual values). Nevertheless, what I had in mind in using the term ‘realistic modelling situations’ were models of fairly complex natural systems, such as the dripping faucet, spruce budworm and ecosystem ecology examples. My objection is not that mathematical models of such systems cannot legitimately and accurately describe structural properties that are genuinely predicable of real-world systems, but simply that for.. Marcuse emphasizes a dialectical relationship between aesthetics and politics. Art promotes liberation through the education of sensibility and critique of reality—the Great Refusal—while still embodying elements of the ideological system of domination. Thus, although art itself cannot change the world, it can move people to social change. In this respect, the Great Refusal serves an important political role in challenging the Establishment. This paper argues for the continued theoretical relevance of the Great Refusal and for its practical possibilities in (...) transforming society. (shrink)

Cet article interroge l’originalité ludique du dispositif sociotechnique conçu par les réseaux socionumériques autour du profil pour organiser les différentes activités en ligne. Alors que les jeux constituent une des activités les plus prisées par les membres du réseau à laquelle ils consacrent un temps important, peu de recherches se sont focalisées sur l’analyse des activités ludiques sur les réseaux socionumériques. Par l’application de cadres conceptuels éprouvés pour analyser les jeux et activités ludiques, il est possible d’interroger la spécificité des (...) modalités de jeux qui sont proposées sur les réseaux socionumériques. Une analyse centrée sur les fonctionnalités offertes par Facebook conduit à interroger de façon critique la nature même de l’activité ludique menée dans le contexte particulier des réseaux socionumériques.This article looks into the distinctively “playful” nature of the socio-technical system that social networking sites construct around user profiles in order to organize different online activities. Although games some of the most popular activities among network members, to which they devote a considerable amount of time, there have been few analyses to date of game-playing on social networking sites. A number of proven conceptual frameworks can be used to analyze online games and game-playing and to examine the particular patterns found on the social networking sites. Based on an analysis of Facebook features, we offer an in-depth discussion of the nature of the game-playing that takes place in the particular context of social networking sites. (shrink)

O presente artigo pretende examinar as linhas gerais da crítica de Condillac à metafísica, tentando indicar os elos entre sua recusa dos grandes sistemas do século XVII e sua concepção de linguagem. Para tanto, parte-se do Tratado dos sistemas, onde essa crítica é empreendida de maneira intensiva e detalhista, para se chegar à teoria dos signos linguísticos, apresentada pelo filósofo no Ensaio sobre a origem dos conhecimentos humanos e retomada em obras subsequentes. A tese fundamental aqui é a de que, (...) aos olhos do abade, se os grandes filósofos da metafísica clássica equivocaram-se ao fundarem seus sistemas em “máximas abstratas” e “suposições da imaginação”, foi por terem sido induzidos a erro devido à própria natureza dos signos linguísticos. Se essa hipótese de leitura estiver correta, tanto esse diagnóstico quanto a chave para solução do problema dependeriam do exame da origem e dos progressos da linguagem, realizado por Condillac no Ensaio.AbstractThis paper intends to examine the general lines of Condillac’s critique of metaphysics, trying to indicate the links between his refusal of the great systems of the seventeenth century and his conception of language. It begins with a short presentation of the Treatise of Systems, where this criticism is undertaken intensively and in detail, and aims to arrive at the theory of linguistic signs presented by the philosopher in the Essay on the Origin of Human Knowledges and resumed in subsequent works. The fundamental thesis here is that, to Condillac, if the great philosophers of classical metaphysics were wrong to base their systems on “abstract maxims” and “assumptions of the imagination,” it was because they were misled by their own nature of the linguistic signs. If this reading hypothesis is correct, both this diagnosis and the key to solving the problem would depend on his examination of the origin and progress of language presented to the reader in his Essay.Key words: Metaphysics; Empiricism; Signs; Language; History of language. This essay enquires into the implications for criminal law of Derrida’s analysis in the Death Penalty seminars. The seminars include a reading of Kant’s Metaphysics of Morals, specifically Kant’s reflections on the sovereign right to punish, which is read in conjunction with the reflections of Freud and Reik on the relation between the unconscious and crime, as well as Nietzsche’s reflections on morality, punishment and cruelty. What comes to the fore in Derrida’s analysis is a system of economic exchange operating (...) on an unconscious level, of which criminal law forms an intrinsic part. Derrida’s analysis of the ‘origin’ of crime in the seminars poses serious questions to the assumption of freedom underlying modern criminal law. The link, which he posits between punishment and political theology, likewise challenges the existing theories and forms of punishment. What the seminars call for, in the name of the Kantian Enlightenment, is a radical break with economic circularity as it operates in respect of crime and punishment. (shrink)

A classic avenue that victims can take to hold a corporation to account and obtain redress for the harms they have suffered is civil litigation. In the past decades, such attempts have been pursued against corporations in the tobacco industry, the pharmaceutical industry, the asbestos industry or industries working with asbestos and, more recently, the extractive industries. However, it is notoriously difficult for victims whose rights have been violated by corporations to obtain effective redress in civil procedures. A rich body (...) of burgeoning scholarly literature and policy documents has addressed the extent to which systematic and institutional factors are obstacles to victims seeking justice for corporate misconduct. In this article, we will not focus on these systemic and institutional factors but on the role of corporate defence lawyers as their functioning also impacts the capacity of victims of corporate wrongdoing to effectuate their rights. We will address the question of what can be expected from a legal-ethical point of view from corporate defence lawyers advising and representing their corporate clients in large-scale civil liability cases. As a partial answer, we will develop a critique of amoral lawyering as a working philosophy in this context. In addition, we will touch upon the feasibility of a possible alternative. (shrink)

In this article I will argue that the philosophy of Benedict Spinoza may assist us in coming to terms with some of the conceptual challenges that the phenomenon of Artificial Intelligence poses on law and legal thought. I will pursue this argument in three steps. First, I will suggest that Spinoza’s philosophy of the mind and knowledge may function as an analytical tool for making sense of the prevailing conception of AI within the legal discourse on Lethal Autonomous Weapons Systems. Then, I will continue the argument with the aid of Spinoza’s political philosophy which partly complicates the picture as it seems to disqualify a normative process grounded directly upon the means stipulated for achieving a robust understanding of AI. Based on these two separate discussions I will conclude by outlining a composite critique – from the twofolded perspective of Spinoza’s ethical and political discussions – of the ongoing negotiations of a new Conventional Weapons Convention protocol on LAWS. This paper aims to introduce, in the context of Latin America, the theoretical epistemic discussion regarding the theme of the ‘common’ as a political principle which substantiates instituting and autonomous processes of government, control and community regulation. The work seeks to relate a democratic scenario of the ‘common’ with the discourses of pluralist and decolonial normativity, in a way that would guarantee not only horizontal communal self-management, but also a legitimate ordering of forms of life, founded on common interest, social (...) relations and interconnected structures. For this purpose the instrument of critical-socio-legal analysis is applied at the intersections with the ‘participative-communitary’ type of legal pluralism. Our proposal is to combine the contemporary meaning of the ‘common’, its relation to the Latin American principles of ‘buen vivir’ (living well) and ‘interculturalidade’ (interculturality), as well as the instituting practice of the ‘common’, that engenders a normativity built ‘from below’, which is in opposition to the traditional positivist and state legal system imposed through colonization in Latin America. Such achievements that, although formalized, are not being successful against institutional ruptures, have ‘cloistered’ the practices of the ‘common’ and made the existence of legal pluralism invisible. Cultural Consultation is a clinical process that emerged from anthropological critiques of mental healthcare. It includes attention to therapeutic communication, research observations and research methods that capture cultural practices and narratives in mental healthcare. This essay describes the work of a Cultural Consultation Service (ToCCS) that improves service user outcomes by offering cultural consultation to mental health practitioners. The setting is a psychiatric service with complex and challenging work located in an ethnically diverse inner city urban area. Following a period (...) of 18 months of cultural consultation, we gather the dominant narratives that emerged during our evaluation of our service. Results: These narratives highlight how culture is conceptualized and acted upon in the day-to-day practices of individual health and social care professionals, specialist psychiatric teams and in care systems. The findings reveal common narratives and themes about culture, ethnicity, race and their perceived place and meaningfulness in clinical care. These narratives express underlying assumptions and covert rules for managing, and sometimes negating, dilemmas and difficulties when considering “culture” in the presentation and expression of mental distress. The narratives reveal an overall “culture of understanding cultural issues” and specific “cultures of care”. These emerged as necessary foci of intervention to improve service user outcomes. Conclusion: Understanding the cultures of care showed that clinical and managerial over-structuring of care prioritises organisational proficiency, but it leads to inflexibility. Consequently, the care provided is less personalised and less accommodating of cultural issues, therefore, professionals are unable to see or consider cultural influences in recovery. (shrink)
