Empathy remains poorly understood, under-theorized, and subject to conflicting and opportunistic uses. Its systematic role in human experience has not been analyzed and interpreted from top to bottom. In this book, the author attempts to provide such an analysis in the philosophical traditions of hermeneutics, phenomenology, analytic philosophy of language, and psychoanalysis. applying his interpretation of empathy to the philosophical issues of intentionality, the emotions, and the checkered transformations of empathy itself. In doing so the author aims to rescue empathy (...) from the margins of intelligibility and reveal its central role in our understanding of the emotions, the integrity of our relations with others, and human community (“intersubjectivity”). -/- The work draws on both the Anglo-American (“analytic”) tradition of ordinary language philosophy and the continental ones of phenomenology and hermeneutics. This work follows the movement of empathy from the periphery of ethics, aesthetics, and theory of mind to a key place in establishing and maintaining the integrity and emotional equilibrium of dynamic interrelations with other individuals. Beginning with the philosophical infrastructure of the hermeneutics of empathy, this work thoroughly explains the complex architecture of empathy, tracing it downward through the levels of authentic human interrelations, empathy with unexpressed emotions, the empathic penetrability of cognitively impenetrable affect, the first-ever intentional analysis of both the empathizer and the “empathasand” in interrelation, and the hermeneutic infrastructure. The consequences of empathy are exposed in the context of the emotions, cognitive impenetrability, empathy and altruism, and the intentionality of empathy as accessed through language and story telling. Drawing on the multi-method approach of hermeneutics, phenomenology, and story telling, this work demonstrates that empathy forms the foundation for community in ways not clearly appreciated in the on-going debate. In a bootstrap operation that is guided by Heidegger’s call for a “special hermeneutic of empathy,” this work achieves a delicate balancing act of unpacking the rich intellectual traditions from which empathy - the phenomenon itself, not the concept - emerged historically. The result is an exposure of the deep structure of empathy as a fundamentally human capability for creating possibilities of community and human relations. (shrink)

This study takes up the challenge presented to philosophy in a dramatic and urgent way by contemporary medicine: the phenomenon of human life. Initiated by a critical appreciation of the work of Hans Jonas, who poses that issue as well, the inquiry is brought to focus on the phenomenon of embodiment, using relevant medical writing to help elicit its concrete dimensions. The explication of embodiment, aided by critical studies and inquiries into medical phenomena make possible the development of the (...) author’s original phenomenological theory of self, and its concrete relationships with the other self. This study attempts not only to show connections among the works of a number of thinkers in terms of central problems, but to demonstrate the mutual relevance of medicine and philosophy through concrete illustrations and analysis. Understanding the selves, situations and actions of Africans can never be comprehended outside kinship. Local and foreign worldviews are first pigeonholed into culture and defined within kinship realities in Nigeria and Africa. There have been studies on kinship in Africa. However, the findings from such studies portrayed the immutability of African kinship. Thus, as an important contribution to the on-going engagement of kinship in the twenty-first century as an interface between the contemporary Diaspora, this article engaged kinship within international migration. (...) This is a major behavioural and socio-economic force in Nigeria. Methodological triangulation was adopted as part of the research design and primary data were collected through in-depth interviews (IDIs), and life histories of international migrants were documented and focus group discussions (FGDs) were held with kin of returnees. The article found and concluded that while returnees continued to appreciate local kinship infrastructures, the infrastructures were liable to reconstruction primarily determined by dominant support situations in the traditional African kinship networks. It should be evident from the foregoing discussion that one man's natural selection is not necessarily the same as another man's. Why should this be so? How can two theories, which both Matthew and Darwin believed to be nearly identical, be so dissimilar? Apparently, neither Matthew nor Darwin understood the other's theory. Each man's viewpoint was colored by his own intellectual background and philosophical assumptions, and each read these into the other's ideas. The words sounded the same, so they assumed (...) the concepts must als be the same.123As Ghiselin has pointed out, historians attempting to evaluate Darwin's predecessors have been similarly blinded by a preoccupation with words, without regard to their proper context.124 In the case of Matthew, the practice of quoting only brief passages from the appendix to Naval Timber and Arboriculture, without relating them to the rest of his work, has suggested a greater resemblance to Darwin's theory than actually exists.It is clear, both from the use which Matthew made of his ideas and from the philosophical roots of his natural world view, that he could not have arrived at the concept of natural selection by the same thought process which Darwin employed. His discussion of natural selection is presented not as an argument, but as an axiom. No theory is proposed, no evidence marshaled to support it. Natural selection is stated as a fact, a Law of Nature, unquestioned, and presumably, unquestionable.Despite his clamor for recognition as the discoverer of natural selection, Matthew recognized and acknowledged this very fundamental difference between Darwin and himself. In a letter to the Gardener's Chronicle of May 12, 1860, he wrote:To me the conception of this law of Nature came intuitively as a self-evident fact, almost without an effort of concentrated thought. Mr. Darwin here seems to have more merit in the discovery than I have had—to me it did not appear a discovery. He seems to have worked it out by inductive reason, slowly and with due caution to have made his way synthetically from fact to fact onwards; while with me it was by a general glance at the scheme of Nature that I estimated this select production of species as an a priori recognisable fact—an axiom, requiring only to be pointed out to be admitted by unprejudiced minds of sufficient grasp.125In the same letter, Matthew maintained that his ideas had not been accepted because “the age was not ripe for such ideas.”126 Nor, he said, was the present age. He considered the inability of most of Darwin's critics to grasp his theory to be “incurable.” Yet he did not argue that natural selection should be accepted because of the evidence, but rather, that it should be accepted on faith:Belief here requires a certain grasp of mind. No direct proof of phenomena embracing so long a period of time is within the compass of short-lived man. To attempt to satisfy a school of ultra skeptics, who have a wonderfully limited power of perception of means to ends... would be labour in vain.... They could not be brought to conceive the purpose of a handsaw though they saw its action, if the whole individual building it assisted to construct were not presented complete before their eyes... Like a child looking upon the motion of a wheel in an engine they would only perceive and admire... without noticing its agency in... affecting the purposed end.127Here, then, is the final irony. In a passage urging acceptance of Darwin's theory, a theory which was to banish design and purpose from the natural world, we find echoes of Paley and of Providence.Loren Eiseley has lamented the fact that Matthew “did not bring his views into the open, because the amount of ground he was able to cover in a few paragraphs suggests that he might have been able to sustain a longer treatise.”128 Now that the intellectual and historical context of Matthew's ideas are known, this statement is no longer tenable. Matthew was not a scientist, and his books were not written as biological treatises. His discussions of natural selection were not attempts to “cover ground” in advancing a particular scientific theory, but were simply reflections of his own assumptions about the natural world.Furthermore, despite Matthew's acceptance of evolution and natural selection, his biological thought was basically conservative on points where Darwin's was radical. Where Matthew saw a series of stable worlds interrupted by violent upheavals, Darwin saw a continuous process of change in an ever-fluctuating world. Where Matthew conceived of species in terms of Aristotelian classes and essences, Darwin revolutionized our concept of species by treating them as populations. Where Matthew saw a world of design and beauty functioning according to natural laws laid down by benevolent Providence, Darwin abolished design and Providence from nature and ushered in a world which cycles ever onward according to laws of chance and probability.It is not even particularly useful to point to Matthew as evidence that evolution was “in the air” prior to 1859.129 His ideas did not represent the first wave of a coming revolution, but were the product of his own personal philosophical outlook, as expressed in the context of the biological thought of the 1830's. Matthew is important in the history of ideas, not simply because he accepted the concept of evolution or thought of something resembling natural selection, but because he did so without overthrowing, in his own mind, any of the basic philosophical assumptions which had underlain biological science since Aristotle. In recognizing Matthew's failure to do so, we are in a position to appreciate more fully the significance of the Darwinian Revolution. (shrink)

Diversity is both an unavoidable aspect of twenty-first century living and a powerful challenge to older philosophical traditions that still assume as normatively universal a set of values, ways of thinking, institutions, and habits of living that emerged within earlier eras of more homogeneous cultures, less developed technologies, and more accepted forms of linguistic, legal, religious, economic, political, and military domination. Within recent years, new styles of philosophical discourse, including deconstruction, postmodernism, feminism, post-colonialism, and critical race theory, have persuasively challenged (...) these universalistic assumptions to reveal the important human differences they marginalize. Experience-based appreciation of the mutually educative potential of diverse standpoints as well as sober concern about the perils of our present times have led many thinkers to look for contemporary forms of pragmatism and cosmopolitanism as hospitable intellectual gathering places for urgently needed cross-difference conversations that may reflect and give substance to shared visions of democratic diversity. The eight authors in this volume engage in cross-difference conversations with other thinkers from earlier periods and other philosophical traditions, as well as with each other, in order to reconstruct pragmatism and cosmopolitanism in ways that are more attuned to our lived experience of diversity as well as our hopes for a diversity-appreciating democratic future. How should belief in creation affect our theoretical understanding of knowledge? In this essay I argue that traditional views of knowledge, illustrated by Plato and Descartes, cannot do justice to the integral meaning of reality as God’s creation. Making use of two metaphors, the visual metaphor for theoretical knowledge and the biblical one of hearing the divine promise-command to be, I sketch the outlines of a theoretical framework that takes belief in creation as its starting point. My approach is based (...) upon insights of Reformational philosophy and leads to a view in which beliefs and propositions concerning isolated states of affairs are replaced by an emphasis on the concrete situations in which knowing occurs. Important notions like rationality and objectivity lose their central place to responsibility and acknowledgement. I claim that in this way the biblical understanding of reality as God’s creation can be better appreciated than in approaches that take their starting point in Greek and modern philosophical conceptions. I approach environmental ethics here through an appeal to the human capacity for appreciating value wherever it is found, contesting the supposed disunity of person and external world that is arguably at the root of the global disrespect for the natural environment. In the more dominant non-anthropocentric approach attention is drawn to the overarching eco-system equalizing the functional roles of both human and non-human. But this seems self-undermining, as appeal is necessarily made to that human moral and rational consciousness whose (...) regulating role is at the same time being called into question. Drawing on an Aristotelian/Thomist metaphysics, congruent with the African traditional idea of “vital force” running through natural and social reality, I argue that organisms—human or otherwise—are not functional elements in the ecosystem but historically viable co-determinants thereof. The role of the human organism is that of co-determining through narrative and history. Human subjectivity is not, pace Nagel, confined to a species-perspective but there is a supra-biological patterning of experience intending understanding and true value. However, the development of these powers of agency, and sympathy, are stultified by a picture of self-determination as the most absolute independence from the “other”. In contrast, the African traditional value of ubuntu posits a normative development of agency through others that can be unpacked to apply beyond simply social custom. The contribution this cultural tradition brings is enhanced if the metaphysics of “force” or “spirit” is interpreted non-dualistically and without appeal to a supernaturalism. (shrink)

ObjectiveIn Belgium, people with an incurable psychiatric disorder can file a request for euthanasia claiming unbearable psychic suffering. For the request to be accepted, it has to meet stringent legal criteria. One of the requirements is that the patient possesses decision-making capacity. The patient’s decision-making capacity is assessed by physicians.The objective of our study is to provide insight in the assessment of decision-making capacity in the context of euthanasia for patients with psychic suffering caused by a psychiatric disorder.MethodTwenty-two semistructured (...) interviews with psychiatrists and neurologists were analysed with NVivo, a qualitative analysis software to code and organise transcribed data.ResultsDifferent views and approaches regarding decision-making capacity in the context of euthanasia emerged from the data.Most of the physicians have some knowledge of the cognitive ability approach on decision-making capacity. According to this approach, four abilities constitute decision-making capacity: communication, understanding, appreciation and reasoning. We observed differences in the way these abilities are valued in relation to competence. Some physicians take additional elements into consideration when assessing decision-making capacity.Physicians acquired their knowledge on the subject in many different ways. Most of the physicians reported that decision-making capacity was not part of their training.ConclusionWe conclude that physicians assess decision-making capacity in different ways and that personal values and beliefs influence their approach. As such, a common approach in assessing the decision-making capacity of a patient among the interviewed physicians is lacking. Less arbitrariness could be obtained by consistently implementing the cognitive ability approach. (shrink)

Research in education indicates that the Philosophy for Children (P4C) curriculum is instrumental in achieving important educational objectives. And yet, it is precisely this instrumentalist conception of P4C that has been challenged by a second generation of P4C scholars. Among other things, these scholars argue that P4C must remain vigilant toward, and avoid subscribing to 1) developmentalism and 2) a reductive identification of thinking with rationality. On the contrary, they suggest that P4C must ensure that it gives voice to childhood, (...) allowing it to enter a genuine dialogue with adulthood. Scholars who defend a non-reductive and non-instrumentalist approach to P4C, highlight the significance of play in philosophy sessions with children. In this paper I examine the extent to which the philosophical inquiry that takes place in the context P4C can be understood as a playful activity. I submit that Fink’s account of play can help us reach a better understanding of what we mean by play, which in turn can help us examine the compatibility between the activities of P4C and play. In the first part of the paper, I examine some of the basic ideas of P4C and raise the question about the compatibility of philosophical inquiry and play. In the second part of the paper, I engage in a philosophical appreciation of play by drawing on the work of Eugen Fink. In the final part of the paper, I show how play – understood along Fink’s lines – is compatible with philosophical inquiry as practiced in school settings. (shrink)

Umuntu ngumuntu ngabantu is the Zulu version of a traditional African aphorism . Although with considerable loss of culture-specific meaning, it can be translated as: “A human being is a human being through other human beings.” Still, its meaning can be interpreted in various ways of which I would like to highlight only two, in accordance with the grammar of the central concept ‘Ubuntu’ which denotes both a state of being and one of becoming.Firstly, it can be interpreted as a (...) statement of fact about the human condition, i.e. as a descriptive claim about the social nature of human being and personal identity; even the constitutive relation between alterity and identity. Secondly, it can also be interpreted as a value-judgement, i.e. as a normative appreciation of social difference and human diversity; even as an imperative to expose ourselves to others, to encounter the difference of their humanness, in order to fully become our own. The meaning would then be — to paraphrase a translation of Ramose : To be human is to affirm one’s humanity by recognising the humanity of others in its infinite variety of content and form.CONCLUSION :The challenge of a philosophical understanding of the multi-cultural context of apartheid South Africa has still to be met. To meet this challenge is to try and trace the consequences of what it would mean if — to paraphrase Walzer — our crucial commonality is our particularity. Perhaps it will mean accepting that what we are and are becoming, our identity, escapes any reduction to the categories of the ‘self’ and the ‘other’ and eludes a dialectical ‘aufhebung’ of their difference. This may be the case if what we are and are becoming involves the paradox of being and becoming ever more different in the realisation of our self-sameness. Our African aphorism speaks of this paradox and, in so doing, it draws a limit to our philosophical understanding and provides us with a rule of conduct: Umuntu ngumuntu ngabantu! (shrink)

Mu'tazila and Shīʿa (Zaydiyya-Imāmiyya) have common views on many theological issues except the imamate. This issue has been generally accepted by other Islamic scholars rather than Shīʿa and by Western researchers. That in this interaction between the Mu‘tazila and the Shīʿa, the Shīʿa is the side mostly affected. However, it is an issue that should not be overlooked that the Shīʿa partially influenced the Mu'tazila in ʿAlī b. Abī Ṭālib, over the other Companions. In this context, some persons from (...) the Baghdad Mu’tazila School such as Bishr b. al-Muʿtamir (d. 210/825), Jaʿfar b. Mubashir (d. 234/848), Jaʿfar b. Harb (d. 236/850) and al-Iskāfī (d. 240/854) argued that the imamate of Abū Bakr, who was less virtuous, was permissible although they considered ʿAlī as the most virtuous person after the Prophet. In addition, al-ʿAllāf (d. 235/849-850), al-Naẓẓām (d. 231/845), Abū Abdullah al-Basrī (d. 369/979-80) and Qāḍī ʿAbd al-Jabbār (d. 415/1025) along with Abū ʿAlī al-Jubbāʾī (d. 303/916), one of the chiefs of the Basra Mu'tazila School, and Abū Hāshim al-Jubbāʾī (d. 321/933) did not accept the order of caliphate as the order of virtue. This study focuses on the issue of whether the aforementioned affinity between Mu'tazila and Shīʿa affected Mu'tazila, especially in the interpretation of the verses associated with ʿAlī. In the study, the aforementioned problem was examined through the tafsīr al-Kashshāf of the Muʿtazilī mufassir al-Zamakhsharī (d. 538/1144). In addition to the importance of tafsīr, the fact that al-Zamakhsharī took lessons from Shīʿīte/Zaydī persons and he wrote the tafsīr with the support of Zaydī leader al-Wahhās (d. 506/1112) is effective in handling this issue through al-Kashshāf's tafsīr. In the first part of the study, first of all, the interaction between Imāmiyya and Zaydism, which are the two most important branches of Mu‘tazila and Shīʿa, is briefly mentioned. Then, Mu'tazila’s and Al-Zamakhsharī’s view on ʿAlī's position among other caliphs is emphasized. Al-Zamakhsharī, who is from the Basra school of the Mu'tazila, does not consider ʿAlī b. Abī Ṭālib superior to Abū Bakr, unlike al-ʿAllāf, Abū ʿAlī al-Jubbāʾī, Abū Hāshim al-Jubbāʾī and Qāḍī ʿAbd al-Jabbār, who are the leading figures of this school. In fact, the fact that he always observed the order of the caliphate while talking about the merits of the four caliphs supports the possibility that, unlike his predecessors, he accepted the order of the caliphate as the order of virtue. In the second part, it is questioned whether the narrations that al-Zamakhsharī included in his tafsīr of the verses associated with ʿAlī are similar to the narrations of the Shīʿīte/Zaydī/Imāmī tradition and whether he interpreted the verses in parallel with these narrations. In this respect, the tafsīr al-Kashshāf has been examined comparatively with the Sunni and Shiite tafsīrs prior to it. Eventually, while interpreting these verses associated with the Ahl al-bayt (members of the Prophet’s household), al-Zamakhsharī highlights the narrations that appreciate the virtues of ʿAlī b. Abī Ṭālib and his child. However, he also refrains from making comments that would be in line with the Shīʿa's belief in imamate. In particular, his tafsīr of the verse al-Aḥzāb 33/33 in the context of the Prophet’s wives is the greatest indicator of this situation. It has been determined that while al-Zamakhsharī includes the narrations highlighting the virtue of ʿAlī b. Abī Ṭālib and his children, he mostly follows the Sunni commentator al-Thaʿlabī. In particular, it has been seen that al-Zamakhsharī transferred the narration material in the interpretation of the relevant verses from al-Thaʿlabī's commentary almost in the same way. However, it is noteworthy that al-Zamakhsharī differs from him in some details such as linguistically supporting these narrations in some verses such as ʾĀli ʿImrān 3/61 and al-Māʾidah 5/55. An indirect influence can be mentioned because al-Thaʿlabī frequently narrates the narrations supporting the Shīʿītes in places where there is a Sunni-Shīʿīte conflict. Therefore, although there is no evidence that al-Zamakhsharī took these narrations from Shīʿīte sources, it is seen that he brought ʿAlī b. Abī Ṭālib-based narrations in Sunni sources into the fore. Even in the commentary of al-Ḥākim al-D̲h̲us̲h̲amī, al-Zamakhsharī's teacher in the line of Zaydi/Mu'tazili, the lack of Ali emphasis in the interpretation of the aforementioned verses supports our view. An attempt has been made in this paper to trace Gandhi's principle of 'nonviolence' in the context of 'Enlightenment Rationality' on the one hand and 'Globalization' on the other. The ideas of freedom/independence, autonomy, sovereignty, property, maturity/adulthood, public and private, tolerance, scientific rationality, secularism, humanism, democracy, nation/ state, universality of moral actions, humanity as an end in itself, critique of religion, etc., are the most operative terms of European Enlightenment of the 19th century. Though these ideas evolved and developed (...) in Europe, yet they proliferated beyond Europe to other continents and subcontinents. Gandhi appreciated these ideas and like a genius, he interpreted them into indigenous concepts and principles such as truth, simplicity, faith, brahmacharya, purushartha, satyagraha, swaraj, karma, compassion, trusteeship, vegetarianism/fruitarianism and above all nonviolence with the aim of attaining swaraj - victory over one's passions, lusts, greed, etc., and independence and sovereignty of the country. I may point out, though I shall not be in a position to develop it here, that the basic concepts of the Enlightenment were questioned and repudiated by Marx, Engels and Lenin on the one hand and the critical theorists like Adorno, Horkheimer, Marcuse and Habermas on the other. In the era of globalization, the Enlightenment concepts have become almost obsolete. But Gandhi's principles are still valid. These are the only viable principles to resolve moral dilemmas that everybody faces, being constantly confronted by equally valid alternatives in globalization. Hence I'll propose a modest critique of the Enlightenment and the globalization from Gandhi's perspective of nonviolence. (shrink)

This article explores recent questions regarding the interpretation of Vatican II by examining the council's theological and historical relation to what John O'Malley has called ‘the long nineteenth century’. This period, which O'Malley dates from the French Revolution until the end of the pontificate of Pius XII , connotes a time when political and philosophical developments ‘traumatized’ the Church. This sustained trauma left the Church in a defensive position which deeply informed its view of itself and its relation to the (...) world. While a great deal of attention has been directed at examining the council's degree of continuity or discontinuity with the conciliar tradition, not enough has been done to understand its relationship to developments within this more immediate setting. This study argues that a more contextualized appreciation of the Church's efforts to respond to the challenges of the long nineteenth century, expressed especially in the teachings of Vatican I, can illumine key elements of the meaning of Vatican II's documents and the continuity and/or discontinuity that they represent. In this paper, the authors respond to a recent critique of their Journal of Business Ethics article, which provided a meta- analytic review of ethical climate theory research. They review basic principles of meta- analytic research and discuss the methodological context of their work, which was not discussed in the recent reply article. I applaud and elaborate on the contextualism at the heart of Bullot & Reber's (B&R's) theory, challenge two aspects of the appreciative structure they posit (the causal reasoning that allegedly underlies the design stance and the segregation of the component stages), suggest that expert and novice appreciators operate differently, and question the degree to which B&R's final theory is open to empirical investigation.

Unlike Hanafī jurists, most of the jurists maintain that qiyās is permissible (jāʿiz) for the origins (aṣl) in which the qiyās rule is invalid, including ruhsat (permission); kaffarah (expiation) and ḥadd (penalties). Shāfiʿī jurists, Imam al-Shāfiʿī and his followers like al-Juwaynī, argue that Hanafī jurists are contradictory since they apply qiyās in many cases despite their judgment that qiyās is invalid, and on the contrary they defend that these are derived from the literal interpretation techniques out of qiyās format. Nevertheless, (...) Shāfiʿī jurists persist that they rule on the qiyās applications through Islamic jurisprudence inference methods (istinbāt) such as Islamic juristic preference (istiḥsān), even beyond qiyās. In his sense of search effective cause: ʿilla (taʿlil), al-Juwaynī focuses on the proper meaning/suitability (munāsaba). He runs the mechanism of taʿlil even in the presence of the deepest proper meaning. He customizes the formulation of the suitability (munāsaba)/proper meaning for the origins in which the qiyās’ rule is invalid. Kaffarah and ḥadd consequently expand the validity area and minimize the restricted area for qiyās. Al-Juwaynī’s approach agrees to his rational personality as well as the value that he appreciates for qiyās. In this paper, the aim of study is to identify the borders and limitations of qiyās in al-Juwaynī’s thought with discussions about the disagreements between the jurists in the specified areas.Summary: As a general principle, devoting (taʿabbud) is the foundation for jurisprudence for al-Imām al-Shāfiʿī and reasoning (taʿaqqul/taʿlīl) for Abu Hanīfa. Despite this, Abu Hanīfa and Hanafī jurists consider non-qiyās foundations (ma’dul bih ‘anil-qiyās) including the quantified ordinances (muqaddarāt/taqdīrat) and ruhsat (permission) as well as kaffarah (expiation) and ḥadd (penalty) as the banned areas for the analogy (qiyās) and profess that qiyās cannot be applied in these areas. It may be contradictory that they state in one hand that the foundation of rulings is taʿaqqul, and on the other hand, bars the above-mentioned areas for qiyās. On the contrary to their general approach, Shāfiʿī jurists, in particular, argue that it is untrue to absolutely exclude use of analogy in those areas, which are rather open to qiyās. Al-Imām al-Shāfiʿī and one of his followers, al-Juwaynī, describe that Hanafī jurists’ applications do not jibe with their principles so that they do refer the inference methods (istinbāt) (e.g. juristic preference: istiḥsān), furthering qiyās although they take qiyās as illicit in kaffarah and ḥadd. However, Hanafī jurists defend that they are not in a contradiction, and indeed they do not apply qiyās in kaffarah and ḥadd and derive their illations mostly from textual implications (dalālah) that are mostly out of qiyās format such as tanqīh al-maʿnā (isolating ʿilla), istidlāl, and dalālah al-naṣṣ (inferred meaning). As understood from the relevant arguments, applying qiyās in these areas is directly associated with the issue of potentiality for “the analogy in reason.” The type of qiyās that Hanafī jurists consider illicit in kaffarah and ḥadd is the analogical actions made for the reasons. One of the most rationalist representatives of Shāfiʿī uṣūl, al-Juwaynī pronounces that the method to determine ʿilla (cause) is fundamentally the suitability (munāsaba) that can be defined as “rational compatibility.” In his opinion, the ratiocination (taʿlīl) is based on this suitability. According to him, the indications of qiyās will be clear or it becomes practicable even in the presence of low-level, implicit suitability. Al-Juwaynī considers that it is licit to apply the analogy for the kaffarah and ḥadd as well as the non-qiyās foundations, including ruhsat and muqaddarāt or taqdīrat, whether direct or explicit (i.e. the meaning of analogy: qiyās al-maʿnā) or indirect or implicit (i.e. the commonality of analogy: qiyās al-shabah). In this context, one of Juwayni’s concern is “the matter of inherence in textual sources such as naṣṣ or the Qur’ān and the Sunna),” corresponding to the area where the judgment is based on a specific reason by naṣṣ. For him, a number of reasonable meanings can be inferred in these areas when it is critiqued independent of the uttered words. But the inherence mentioned in the texts of naṣṣ, indicates to avoid the use of analogy for making a judgment. Al-Juwaynī asserts that some fractional elaborate or detailed meanings cannot be obtained for physical prayers and only a set of universal meanings can be imagined. He defines that it is permissible to compare the reasons of physical worshipping with each other when any suitable meaning is present. He considers that for the permissibility of qiyās in ruhsat, it is adequate to find a meaning suitable for the judgment, and besides, the commonality of analogy (qiyās al-shabah) is applicable in the area of muqaddarāt or taqdīrat. Nevertheless, a patient’s condition is similar to that of a traveller in terms of ruhsat for not fasting (ṣavm). In al-Juwaynī’s way of thinking, patients should act like travellers for ruhsat to shorten (qaṣr) the prayers (ṣalāh) due to “requiring” as a proper meaning. However, as mentioned by al-Juwaynī, there is a consensus (ʿijmā or ittifāq) on the fact that a patient cannot shorten his or her prayers. Due to this impediment, it is understood that the rule of shortening their prayers (ṣalāh) is permissible for travellers but not for patients (manʿ al-ʿijmā’).In criminal cases, the right of oath before the court is belonging to the defendant, whereas to the claimant in kasāme, an oath method in unidentified murders. Taking an oath from the claimant is merely inherent to the kasāme application. Al-Juwaynī states that this inherence is known by the principle of being inherent to each circumstance (iḥtisās bi-l hāl), and with this aspect, kasāme is a closed area for qiyās. According to al-Juwaynī, contracts are suitable for qiyās because they have conditions such as offers and agreements explicitly stating the quality and quantity, and mutual assent. He describes that these are the reasons unavailable for qiyās with respect to their characteristics. With this, the contracts are among the reasonable sources in one respect and the unreasonable in another respect. Consequently, al-Juwaynī suggests that the analogy loses its functionality or validity in a limited number of the closed areas for qiyās, which are the static devotional judgments (taʿabbud) having no proper meaning, direct or indirect, or explicit or implicit; the areas where the judgment is made inherent to a specific reason by the naṣṣ (ihtisās bi-l-nass) (as in the example that sacrificing a female goat at the age of less than one year is a specific judgment for Burde b. Niyār). The point leads to the judgment is made inherent to a specific reason by the principle of ihtisās bi-hāl; and banned ʿijmā issues (as in the example of ʿijmā that it is agreed on the fact that patients cannot shorten (qaṣr) their prayers (ṣalāh), unlike travellers. Al-Juwaynī sees the application of qiyās as licit based on the availability of suitable meaning in all areas except for the above-mentioned issues. That he minimizes the closed areas for qiyās and widely expands the functionality of analogy is the reflections of the value that he gives to qiyās. (shrink)

The purpose of this study was to examine the perceptions of American history among adolescent Mexican Americans at the eight-grade level in a mid-west town's middle school. This qualitative study shows that multiple contexts influenced the process of teaching and learning history between and among a white teacher and adolescent Mexican Americans at Atkinson Middle School. Those overlapping contexts (the context of the education of minority language students, the context of social studies education, and the school's culture) created (...) a unique totality responsible for shaping the experiences of learning American history by Mexican-American students. These experiences were detrimental for the appreciation by Mexican-American students of American history's potential meanings and significance. (shrink)

The article considers the modern meaning of Kant’s doctrine of war. The author examines the context and content of the key provisions of Kant’s concept of perpetual peace. The author also reviews the ideological affinity between Kant and previous authors who proposed to build alliances of states as a means of preventing wars. It is noted that the French revolution and the wars caused by it, the peace treaty between France and Prussia served as the historical background for the (...) conceptualization of Kant’s project. In the second half of the 20th century, there is a growing attention to Kant’s ethical and political philosophy. Theorists of a wide variety of political and ethical schools, pay attention to Kant’s legacy and relate their own concepts to it. Kant’s idea of war is reconsidered by Michael Doyle, Jürgen Habermas, Ulrich Beck, Mary Kaldor, Brian Orend. Thus, Doyle tracks democratic peace theory back to Kant’s idea of the spread of republicanism. According to democratic peace theory, liberal democracies do not solve conflict among themselves by non-military methods. Habermas, Beck, Kaldor appreciate Kant as a key proponent of cosmopolitanism. For them, Kant’s project is important due to notion of supranational forms of cooperation. They share an understanding that peace will be promoted by an allied authority, which will be “governing without government” and will take responsibility for the functioning of the principles of pacification of international relations. Orend’s proves that Kant should be considered as a proponent of the just war theory. In addition, Orend develops a new area in just war theory – the concept of ius post bellum – and justifies regime change as the goal of just war. (shrink)

El presente trabajo se propone describir e interpretar, en una primera etapa, los mecanismos de canonización literaria de obra y autor en una comunidad cultural específica, la latinoamericana. El caso estudiado es el del escritor argentino Manuel Puig y su obra. La relación interactiva entre contexto cultural, institucionalidad y sistemas de significado social y valoración permite modelar una descripción e intento de explicación de las relaciones de significado entrañadas en la constitución de los repertorios literarios canonizados, sus criterios de selección, (...) su naturaleza ideológica y la manera en que las prácticas sociales asociadas a este proceso se constituyen por un número variable de prácticas discursivas. Para ello se analiza un conjunto ilustrativo de eventos comunicativos y sus instancias textuales, donde se articulan los cánones literarios y sus efectos culturales: posicionamiento, valoración estética, iconización de autor y de discurso, influencia profesional, tematización crítica y académica, entre otros. Se estudia, por tanto, un caso de integración canónica: la del escritor argentino Manuel Puig en el canon literario de habla hispana y el canon literario universal de fines de siglo y se establece un plano de interacción con los parámetros de construcción canónica de la generación previa, la del llamado “boom literario latinoamericano”. This paper aims to initially describe and interpret the mechanisms of work and author’s literary canonization in a specific cultural community, Latin America. The case studied is that of Argentine writer Manuel Puig and his work. The interactive relationship among cultural context, social institutions and systems of social and evaluation meaning allows a description and attempted explanation of the imbued meaning relations in the constitution of the canonized literary repertoires, their selection criteria, ideological nature and the way in which social practices associated with this process are formed by a variable number of discursive practices. To do this, we analyze an illustrative set of communicative events and their textual instances, through which the literary canon and cultural effects are articulated: positioning, aesthetic appreciation, author and discourse iconisation, and professional influence, critical and academic thematization, among others. Thus, we study a case of canonical integration by the Argentine writer Manuel Puig into Hispanic and universal literary canon at the end of the century, and set up an interaction with the parameters of canonical construction from the previous generation, the so-called “Latin American literary boom”. The research is devoted to the morphology that V.N. Ilyin developed in the work Static and Dynamics of Pure Form and other archival texts. Morphology is central to the philosophy of V.N. Ilyin, but it remains an unexplored subject. The article’s author explores the morphology of the philosopher from a historical and philosophical point of view. In addition to apparent influences (G.W. Leibniz, E. Husserl, N. Lossky), the article’s author revealed the connection of V.N. Ilyin’s ideas with the history of (...) Western European philosophy and his attitude to medieval thinkers. The author considered how V.N. Ilyin understood and assessed his modern philosophy and its results by the middle of the twentieth century. V.N. Ilyin especially paid attention to phenomenology and its connection with morphology, analyzing phenomenology's influence on existential philosophy. In addition to phenomenology, V.N. Ilyin highly appreciated the intuitism of H. Bergson and N. Lossky. The third main philosophical direction in the twentieth century for V.N. Ilyin was religious philosophy (Neo-Thomists and followers of H. Bergson), which aimed at creating axiology, a new system of values. V.N. Ilyin sought to combine various philosophical ideas in the project of morphology based on logic and scientific methodology. He stated the need to reform formal logic and create “metalogic” that would be more consistent with the philosophical tasks of the twentieth century. The morphology of V.N. Ilyin is based on the idea of synthesis and focuses on creating universal science. The comparison of various philosophical ideas of the twentieth century with morphology makes it possible to understand better his philosophical worldview, the course of his reflections, and the meaning of the morphological project. About 60 years ago, Tang Junyi 唐君毅, Mou Zongsan 牟宗三, Xu Fuguan 徐復觀, and Zhang Junmai 張君勱 published “A Manifesto for a Reappraisal of Sinology and Reconstruction of Chinese Culture.” In the Manifesto, these major representatives of contemporary New Confucianism tried to rectify Westerners’ biases and reestablish Chinese people’s cultural confidence by upholding the Confucian learning of the heart-mind as the core of Chinese culture. Following the same approach, some prominent scholars today continue the effort of bringing Confucianism to a (...) new epoch through reappropriating metaphysical theories of the heart-mind and human nature of the Zisi 子思–Mencius lineage, which flourished in the Song-Ming 宋明 period. This article critically reflects on this approach and argues that the Confucian learning of the heart-mind and human nature should not be taken so much as a mirror that reflects metaphysical reality than as a lever that directs and uplifts human vision and gongfu 功夫/工夫. In the cultural context today, revealing the gongfu nature of Confucianism can help us appreciate the real value of Confucianism as a constructive resource for global culture. (shrink)

This book is situated within the realm of theological engagement with the sciences with a particular focus on how the nature of ethics is understood through this dialogue. Its purpose is to provide a theological appreciation of the nature of ethics which also takes seriously evolutionary accounts of how ethics came to be. It argues that such a theological metaethic can be interpreted as hopeful and optimistic given the apparent evolution of the moral from the amoral. This work hinges (...) on two different but intertwined levels. One is the level of ethical systems: a particular understanding of Western Christian ethics. This level is framed by another, broader level of metaethics: an overarching understanding of the character of ethics that emerges from reflections on evolutionary theory and its naturalistic context. Matthew Kieran has recently argued that those he calls ‘appreciative snobs’ go wrong by valuing appreciative objects primarily because of their ability to raise the snob’s social status, what I call social contagion snobbery. In this paper, I argue that there are at least two other ways that snobbery commonly manifests itself in appreciative contexts, what I call attitudinal snobbery and contextual snobbery. As it turns out, all three snobs—Kieran’s social-contagion snob, the attitudinal snob, and the contextual snob—represent distinct ways (...) that appreciative judgments can go wrong because of how socio-hierarchical elements figure into the snob’s appreciative judgments. Research seeking a scientific foundation for the theory of art appreciation has raised controversies at the intersection of the social and cognitive sciences. Though equally relevant to a scientific inquiry into art appreciation, psychological and historical approaches to art developed independently and lack a common core of theoretical principles. Historicists argue that psychological and brain sciences ignore the fact that artworks are artifacts produced and appreciated in the context of unique historical situations and artistic intentions. After revealing (...) flaws in the psychological approach, we introduce a psycho-historical framework for the science of art appreciation. This framework demonstrates that a science of art appreciation must investigate how appreciators process causal and historical information to classify and explain their psychological responses to art. Expanding on research about the cognition of artifacts, we identify three modes of appreciation: basic exposure to an artwork, the artistic design stance, and artistic understanding. The artistic design stance, a requisite for artistic understanding, is an attitude whereby appreciators develop their sensitivity to art-historical contexts by means of inquiries into the making, authorship, and functions of artworks. We defend and illustrate the psycho-historical framework with an analysis of existing studies on art appreciation in empirical aesthetics. Finally, we argue that the fluency theory of aesthetic pleasure can be amended to meet the requirements of the framework. We conclude that scientists can tackle fundamental questions about the nature and appreciation of art within the psycho-historical framework. (shrink)

In focusing on indexicals and proper names and on the different ways in which their references are fixed, I illustrate how our linguistic practice rests on context, broadly construed. The following theses are discussed and defended: • There are two main kinds of information: (i) anchored information, i.e. the information one gathers in using and entertaining indexical expressions and (ii) unanchored information, i.e. the information one may gain in hearing a proper name. • Indexical expressions differ from proper names; (...) this difference relies on the differing ways in which extra‐linguistic context enters the scene. • The Kaplanian framework in particular, and the framework of direct reference in general, are best understood and appreciated against the background of a Wittgensteinian conception of language. The present paper reports the results of a vignette- and questionnaire-based research project investigating the influence of Moral Intensity (MI) on decision making in a New Zealand business context. The use of a relatively sensitive research design yielded results showing that – in contrast to previous research – objective manipulations, as well as subjective perceptions, of three of the six MI components were of particular importance in accounting for a comparatively large proportion of the variation in four outcome variables. (...) There were no interactions of appreciable magnitude between MI components, or variations across scenarios. Also, no support was found for a reliable multi-dimensional structure of perceptions of Moral Intensity. Implications of the findings are discussed. (shrink)

The paper discusses the context, substance and likely implications of the European Court of Human Rights’ very recent but, in our view, historic decision in the case of Lautsi v. Italy. The article offers an outline of the case and of the decision’s motivation, a presentation of the responses, and a brief discussion of its relevance to the similar Romanian case. We examine in some detail the objections leveled against the ruling, track the progress of the Court’s relevant jurisprudence (...) on the issue, and suggest some possible consequences. (shrink)

A range of emergent studies have explored the idea of a renewed human-centered society, termed “Society 5.0,” and the role therein, of servant leadership. In this regard, in East Asian cultural contexts, existing scholarship does not yet provide sufficient theoretical and practical guidance for intercultural contexts, such as when a predominantly individualistic UK business culture interacts with generally collectivist Japanese culture. This is an important gap because if Society 5.0 is to be realized then a more in-depth intercultural contextual (...) class='Hi'>appreciation and understanding are required. The study examines the UK/Japan setting and adopts a social constructivist epistemology and case study approach to illustrate dimensions of servant leadership (DSLs) manifesting in the lived experience of a UK business leader in Japan. Connections to business leader training are drawn and the importance of intercultural dyad specificity is highlighted. The study is also important because recent widespread exposure of various global corporate scandals creates a view that many business leaders care only for themselves or organizational profits, especially in individualistic-orientated societies. This original case study research herein commences the process of developing detailed and focal studies on underpinning drivers and raises hope that ethical behavior, as comprised in the DSLs, can potentially manifest in an individualistic UK/collectivist Japan intercultural dyad context. In the context of acknowledging the contrast between Marian devotional life and eucharistic theology, this response to Díaz’s book makes several connections between the two, including a glimpse into Rahner’s own devotional piety. While affirming and approving the overall content of this study by Díaz, the respondent uses a more recent article by Rahner to suggest four topics that might have enhanced the book: 1) how Marian devotion is founded on the doctrine of the communion of the saints; 2) (...) how Mary’s unimportance and marginalized position enhanced her unique acceptance of grace for the sake of all humanity; 3) how Rahner’s emphasis on women’s equality can figure in the present theological conversation about the relevance of Jesus’ maleness; and 4) how there is room inthe church for a variety of individual and cultural approaches to the theology of grace and to the devotional life of the faithful. According to a widely shared intuition, normal adult humans require greater moral concern than normal, adult animals in at least some circumstances. Even the most steadfast defenders of animals' moral status attempt to accommodate this intuition, often by holding that humans' higher-level capacities (intellect, linguistic ability, and so on) give rise to a greater number of interests, and thus the likelihood of greater satisfaction, thereby making their lives more valuable. However, the moves from capacities to interests, and from interests to (...) the likelihood of satisfaction, have up to now gone unexamined and undefended. I argue that context plays a morally significant role both in the formation of an individual's capacities, and in the determination of the individual's interests and potential for satisfaction based on those capacities. Claims about an individual's capacities and interests are typically presented as unconditional; but on closer examination, they are revealed to be contingent on tacit assumptions about context. Until we develop an understanding of how to account for the role of context within our moral theories, attempts to defend special moral concern for human beings based on their superior capacities are less firmly grounded than is commonly thought. To what extent are factors that are extrinsic to the artwork relevant to judgments of artistic value? One might approach this question using traditional philosophical methods, but one can also approach it using empirical methods; that is, by doing experimental philosophical aesthetics. This paper provides an example of the latter approach. We report two empirical studies that examine the significance of three sorts of extrinsic factors for judgments of artistic value: the causal-historical factor of contagion, the ontological factor of uniqueness, (...) and the contextual factor of appreciative environment. We explore the context of appreciation by performing studies in a museum as well as the lab. We found that contagion made a difference to judgments of artistic value in both settings. These results are congruent with previous empirical research as well as recent philosophical work that defends the artistic significance of authenticity. However, uniqueness only made a difference in the lab setting, but not in the museum. This suggests that the context of appreciation may make a difference to judgments of artistic value. Of broader significance, these studies show the value of experimental philosophical aesthetics and the value of doing in situ empirical research on art. (shrink)

This article sets my own acquaintance with Asphodel in the context of her academic and life achievements. In this long life, she has both seen and influenced changes in the work of theology and social attitudes. Her own work has been seminal and inspiring. Her life has been as radical as her writing. The article draws on conversations with others of her acquaintance, as well as her writings. I end by honouring Asphodel as a gevirah, in scriptural terms.
