This article addresses two longstanding challenges for human resource (HR) managers; how far they can and should represent the interests of both management and workers and how they can gain the power to do so. Adopting a Kantian perspective, it is argued that to pursue an ethical human resource management (HRM), HR managers need to go some way to resolving both. Three possible avenues are considered. Contemporary approaches to organisation of the HR role associated with the work of Ulrich are (...) explored as a means of enhancing power, but rejected on the basis of research evidence as unlikely to succeed. Promotion of worker outcomes in the context of developing the link between HRM and performance offers the potential for a more ethical HRM but has not been seized by most HR managers. Finally, implementation of legislative and moral requirements to promote quality of working life is explored through the case of bullying at work. This highlights the boundaries of the HR role in a context of limited power and leads to the conclusion that it is unrealistic to look to HR managers, or at least HR managers alone, to achieve an ethical HRM. In this paper, we identify the way in which various forms of legal personhood can be differentiated from one another by comparing these entities with a—not too farfetched—hypothetical situation in which intelligence spontaneously evolves within the internet: spontaneous intelligence. In these terms, we consider the challenges that may arise where SI as an entity: has no owner, no designer, and no controller; has evolved into existence as a non-human created intelligence; is autonomous; has no physical form; and, although it exists (...) around the world, exists in no particular jurisdiction. Based on this refined notion of SI, we consider issues related to the recognition of such an entity’s legal personhood. By briefly exploring the attribution of legal personality to various entities—including, humans, corporations, artificial intelligence and higher forms of animal life—we differentiate SI from these other forms of intelligence whilst illustrating it shares most characteristics with human intelligence and not, as may intuitively be thought, with various forms of AI. After critically evaluating the classification of these various forms of intelligence, we briefly suggest some ramifications of these differences and suggest that the approach adopted may assist in drawing more effective boundaries between the entities that are already recognised as legal persons, as well as between sub-categories of entities, such as various forms of AI. The paper presents a new approach to the history of analytic philosophy. Instead of exploring different kinds of analysis (Michael Beaney), or to marry analytic philosophy to the analytic / synthetic distinction (Scott Soames), we turn attention to the fact that it was rooted in two different types of logical constructing. The discrepancy between the two concepts of logical constructing produced much unclarity in our understanding of analytic philosophy.

In Human Presence Erickson offers a thoughtful study of some fundamental features of human nature central to a theoretical and therapeutic understanding of human existence. Though the language employed is largely philosophical, interfaces with psychoanalysis and religion are made in order to stimulate dialogue that reaches beyond the traditional boundaries of discipline. It is toward more such dialogue that Human Presence serves as preparation. The author provides a probing contrast between traditional psychoanalysis and existential conceptions of time consciousness and (...) he articulates the issues involved in experience or lived time in their centrality to human self-understanding. The author suggests how both conceptions, the existential and the psychoanalytic, enlarge yet limit awareness and insight. In _The Boundaries of Babel_, Andrea Moro tells the story of an encounter between two cultures: contemporary theoretical linguistics and the cognitive neurosciences. The study of language within a biological context has been ongoing for more than fifty years. The development of neuroimaging technology offers new opportunities to enrich the "biolinguistic perspective" and extend it beyond an abstract framework for inquiry. As a leading theoretical linguist in the generative tradition and also a cognitive scientist schooled in the new imaging (...) technology, Moro is uniquely equipped to explore this. Moro examines what he calls the "hidden" revolution in contemporary science: the discovery that the number of possible grammars is not infinite and that their number is biologically limited. This radical but little-discussed change in the way we look at language, he claims, will require us to rethink not just the fundamentals of linguistics and neurosciences but also our view of the human mind. Moro searches for neurobiological correlates of "the boundaries of Babel" -- the constraints on the apparent chaotic variation in human languages -- by using an original experimental design based on artificial languages. He offers a critical overview of some of the fundamental results from linguistics over the last fifty years, in particular regarding syntax, then uses these essential aspects of language to examine two neuroimaging experiments in which he took part. This book provides reflection on the increasingly blurry boundaries that characterize the human-animal relationship. In the Anthropocene humans and animals have come closer together and this asks for rethinking old divisions. Firstly, new scientific insights and technological advances lead to a blurring of the boundaries between animals and humans. Secondly, our increasing influence on nature leads to a rethinking of the old distinction between individual animal ethics and collectivist environmental ethics. Thirdly, ongoing urbanization and destruction of animal habitats (...) leads to a blurring between the categories of wild and domesticated animals. Finally, globalization and global climate change have led to the fragmentation of natural habitats, blurring the old distinction between in situ and ex situ conservation. In this book, researchers at the cutting edge of their fields systematically examine the broad field of human-animal relations, dealing with wild, liminal, and domestic animals, with conservation, and zoos, and with technologies such as biomimicry. This book is timely in that it explores the new directions in which our thinking about the human-animal relationship are developing. While the target audience primarily consists of animal studies scholars, coming from a wide range of disciplines including philosophy, sociology, psychology, ethology, literature, and film studies, many of the topics that are discussed have relevance beyond a purely theoretical one; as such the book also aims to inspire for example biologists, conservationists, and zoo keepers to reflect on their relationship with animals. To accept that cognition is embodied is to question many of the beliefs traditionally held by cognitive scientists. One key question regards the localization of cognitive faculties. Here we argue that for cognition to be embodied and sometimes embedded, means that the cognitive faculty cannot be localized in a brain area alone. We review recent research on neural reuse, the 1/f structure of human activity, tool use, group cognition, and social coordination dynamics that we believe demonstrates how the boundary between (...) the different areas of the brain, the brain and body, and the body and environment is not only blurred but indeterminate. In turn, we propose that cognition is supported by a nested structure of task-specific synergies, which are softly assembled from a variety of neural, bodily, and environmental components (including other individuals), and exhibit interaction dominant dynamics. This paper explores the contribution that a Husserlian inspired phenomenology can make to environmental philosophy. In particular I argue that Husserl’s phenomenological critique of naturalism liberates thinking from its metaphysical naïveté thereby opening thought to a new conception of nature, while his theory of intentionality can be adapted to provide new directions for developing an account of axiological rationality which is open to claim that there is goodness and value within non-human nature. Such a form of rationality, based in the (...) dialectic of empty and filled intentions, would begin to provide a discourse in which the goodness and value of non-human nature could be registered, expressed, and articulated in a rational manner. By considering the death of the disability activist Engracia Figueroa as the consequence of her wheelchair being damaged by an airline, this article asks whether law could accommodate a definition of legal personhood that encompasses the possibility of bodies augmented by prosthetics, technology, and mobility aids. The use of mobility aids by disabled people and the role of prosthetic penises in so-called ‘gender fraud’ cases offer two useful provocations to consider the ways in which legal personhood, if defined as largely (...) mapping on to an ideal, normative body, is becoming an increasingly inadequate legal concept in the modern age. Drawing on the work of Donna Haraway and the figure of the cyborg, this article argues that a more protean, flexible, and fluctuating understanding of legal personhood would offer both a more accurate and utopian conception of the body in law than the current essentialist approach found in a number of legal areas and particularly in English criminal law. This article argues that the foundational separation between psychoanalysis and experimental psychology was challenged in important ways by psychoanalytic infant researchers. Through a close examination of American psychoanalyst René Spitz, it extends John Forrester’s conception of reasoning in cases outside classic psychoanalytic practices. Specifically, the article interrogates the foundations of reasoning in cases—the individual, language, and the doctor–patient relationship—to show how these are reimagined in relation to the structures of American developmental psychology. The article argues that the staunch separation of (...) experimental psychology and psychoanalysis, reiterated by philosophers and historians of psychology, is flimsy at best—and, conversely, that the maintenance of these boundaries enabled the production of a cinematic case study. Spitz created films that used little language and took place outside the consulting room with institutionalized infants. Yet key aspects of the psychoanalytic case, as put forth by John Forrester, were depicted visually. These visual displays of transference, failure, and interpersonal emotions highlight the foundations of what Forrester means by reasoning in cases. The article concludes that Spitz failed at creating classic psychoanalytic evidence, but in so doing stretched the epistemology of the case. (shrink)

This volume examines themes that complicate the conventional economist's view of the world and thereby provide for a notably more complex, and humane, subject of study than the traditional Homo economicus. Written by economists and philosophers, these essays attempt to place neoclassical economic theory, especially conventional textbook micro-economic theory, in the broader context of other social sciences and modern economics. In doing so, the book aims to find the boundaries of economics and to define more sharply its relationship to (...) other kinds of inquiry. Through the application of Material Engagement Theory to enactivist analyses of social cognition, this paper seeks to examine the role of material culture in shaping the development of intersubjectivity and long-term scalar transformations in social interaction. The deep history of human sociality reveals a capacity for communities to self-organise at radically emergent scales across a variety of temporal and spatial ranges. This ability to generate and participate in heterogenous, multiscalar relationships and identities demonstrates the developmental plasticity of human intersubjectivity. Perhaps (...) human sociality’s most unique feature is this intersubjective plasticity, that is, the ability for diverse collectivities of individuals and groups to adopt and transition between numerous social identities and behaviours with profound rapidity and flexibility. However, the most influential models in the study of social cognition, the Social Intelligence Hypothesis and Theory of Mind, promote a view of intersubjectivity that is rooted in methodological individualism and primarily understood as a capacity for observation and prediction. This approach leads to significant issues when confronted with the diversity and plasticity of hominin social organisation, particularly in regards to the computational burdens and information processing bottlenecks such scalar changes imply for cognitivist models. This paper examines the metaphysical assumptions in computational models of the mind that result in representational apriorism and an epiphenomenal treatment of material culture that hinder our understanding of the evolution and development of social cognition. Specifically, this article critiques the logics of computation, information processing, representationalism, and content within Neo-Darwinian frameworks that obscure and distort the interrelationships of evolutionary, developmental, ecological and cultural processes. Through a synthesis of material engagement and enactivist approaches to social cognition, this article argues that it is possible to explain the emergent and multiscalar dynamics of hominin sociality in terms of ecologically distributed and developmentally plastic interactions between brains, bodies and material culture. Consciousness is one of the most significant scientific problems today. Renewed interest in the nature of consciousness - a phenomenon long considered not to be scientifically explorable, as well as increasingly widespread availability of multimodal functional brain imaging techniques (EEG, ERP, MEG, fMRI and PET), now offer the possibility of detailed, integrated exploration of the neural, behavioral, and computational correlates of consciousness. The present volume aims to confront the latest theoretical insights in the scientific study of human consciousness with the (...) most recent behavioral, neuroimaging, electrophysiological, pharmacological and neuropathological data on brain function in altered states of consciousness such as: brain death, coma, vegetative state, minimally conscious state, locked-in syndrome, dementia, epilepsy, schizophrenia, hysteria, general anesthesia, sleep, hypnosis, and hallucinations. The interest of this is threefold. First, patients with altered states of consciousness continue to represent a major clinical problem in terms of clinical assessment of consciousness and daily management. Second, the exploration of brain function in altered states of consciousness represents a unique lesional approach to the scientific study of consciousness and adds to the worldwide effort to identify the "neural correlate of consciousness". Wilhelm Vischer's 1877 paper on the limits of historical knowledge expressed clearly, effectively, and with moderation what had become a minority viewpoint in his time. Vischer's deep sense and acceptance of the limits of every human enterprise was characteristic of the historical and philological culture of Basle. To the well-born, deeply conservative citizen, the notion of limits had to be fundamental: not only the property and privileges of his class, and the freedom it required in order to pursue its economic (...) and spiritual interests, but the continued existence of his small homeland as an autonomous polity and the survival of Christian religion and morality in a scientific age depended, in his eyes, on respect for boundaries and frontiers. To the champion of the German Empire, on the other hand, limits, zones of autonomy, and particularisms of every kind were obstacles to be overcome. (shrink)

The long-running discourse on respect for human dignity and autonomy in the physician-patient relationship pertaining to persons with dementia (PwDs) is explored deeply in this paper through the use of a real-life case, to highlight the complex interplay between autonomy and best interest when it comes to a PwD's experiential and critical interests. Many scenarios and perspectives are described and applies to the case. However, there are a few perspectives, which are touched upon that could do with further scrutiny. Firstly, (...) it has been argued that rigid adherence to the advance directives of PwDs means that PwDs will be the only people who are not allowed to ever change their minds. This withdrawal of a fundamental freedom hardly accords with respect for human dignity, or for any residual autonomy that these individuals may still enjoy. Secondly, viewing this case through the lens of care ethics, and incorporating the recently proposed conceptual framework of anthropological vulnerability, may reveal valuable insights regarding care provision and caring physician-patient relationships. These perspectives would analyse the role of relational ontology, particularly in relation to significant others, significant communities, and caregivers. (shrink)
