El objetivo de este artículo es comentar las prácticas que lleva a cabo el equipo docente de la asignatura Epistemología y Metodología de la Investigación en Ciencias Jurídicas (FCEJS-UNSL) –cuya actividad inició en 2012– respecto de la enseñanza del derecho desde una perspectiva compleja. Concebir lo jurídico desde tal enfoque implica considerar la diversidad de las realidades actuales. Asimismo, si se asume que los entornos son múltiples, heterogéneos, no es posible estudiarlos desde un único campo de conocimiento. Adoptar tales miradas (...) epistemológicas necesita de una actitud pedagógica que se adapte al cambio. Por ende, este texto evidenciará las formas en que una asignatura de grado afronta desafíos cotidianos para plantear estrategias que pongan en cuestión el sentido jurídico dominante y, a partir de ello, trascender el positivismo. Por otra parte, a toda la humanidad sorprendió la situación suscitada a partir de la pandemia por COVID-19, que mostró la importancia de asumir una didáctica dinámica. In this paper I analyze the temporal structures that are appropriate to study the notion of point of view. When we analyze the points of view and their structure, it seems clear that we must take into account the time t in which a point of view is attributed to a subject. A two-dimensional temporal logic which combines a modal dimension for possibilities and a temporal one for the flow of time, offers a clear view of the temporary location of (...) a point of view. In this logic, we have histories, thanks to the temporal dimension, and evaluation is in two indices, time and history. These stories can be seen as different scenarios, providing a clear advantage when applying to the analysis of the notion of point of view. The conclusion is that, in order to give a proper approach for the notion of point of view, all these aspects should be combined. (shrink)

Giulia Cavaliere disagrees with claims that ectogenesis will increase equality and freedom for women, arguing that they often ignore social context and consequently fail to recognise that ectogenesis may not benefit women or it may only benefit a small subset of already privileged women. In this commentary, I will contextualise her argument within the broader cultural milieu to highlight the pattern of reproductive advancements and technologies, such as egg freezing and birth control, being presented as the panacea for women’s inequality. (...) While these advancements and technologies can benefit women, I argue medicine is not the best tool to ‘cure’ social problems and should not be co-opted as an agent of social change. Systemic social changes, not just technomedical approaches, are needed to address the root of gender inequality, which is social in nature, not medical. (shrink)

We show a sentence and modal square of opposition and equivalence to be expanded into an hexagon according to oe suggestion from William of Sherwood. This expansión is permittedby two sentence and modal rules.The logical relations of the square allow us to formulate several theorems in order to show a glimpse of the Medieval Logic complexity.

I argue against the tendency in the philosophy of science literature to link abduction to the inference to the best explanation (IBE), and in particular, to claim that Peireean abduction is a conceptual predecessor to IBE. This is not to discount either abduction or IBE. Rather the purpose of this paper is to clarify the relation between Peireean abduction and IBE in accounting for ampliative inference in science. This paper aims at a proper classification—not justification—of types of scientific reasoning. In (...) particular, I claim that Peireean abduction is an in-depth account of the process of generating explanatory hypotheses, while IBE, at least in Peter Lipton's thorough treatment, is a more encompassing account of the processes both of generating and of evaluating scientific hypotheses. There is then a two-fold problem with the claim that abduction is IBE. On the one hand, it conflates abduction and induction, which are two distinct forms of logical inference, with two distinct aims, as shown by Charles S. Peirce; on the other hand it lacks a clear sense of the full scope of IBE as an account of scientific inference. (shrink)

It discusses the existence of fluent time, a controversial concept in many areas, from philosophy to physics. Fluent time is understood as directional time with a past, a present and a future. We experience fluent time in our lives and we adopt a temporal perspective in our ways of knowing and acting. Nevertheless, the existence of fluent time has been debated (...) for both philosophical and scientific reasons, thus creating a rift between the subjective and objective aspects of time. Starting from the basic notion of points of view, or perspectives, this book explores the relationships between objective or external time, as it has been conceptualized by science, and subjective or internal time, which is involved in our lived experiences. It establishes a general framework encompassing the nature, structure and mode of existence of points of view, in which the objective and subjective aspects of time can be integrated. The book mainly addresses researchers and postgraduates in philosophy and logic. Additionally, it offers inspiration for physicists and computer scientists involved in the modeling and simulation of complex behaviors for which the representation of internal time should be considered together with the notion of objective, external time. From our deep interest in the neuroconstructivist framework, we would like to comment on two fundamental aspects of Mareschal et al.'s work: the role of neuroconstructivism for clinical work with people suffering from developmental disorders; and the relation between the process of progressive specialization and the increasing abstraction of representations in development.

In contrast with the development of big theories in the context of social sciences, there is nowadays an increasing interest in the construction of simulation models for complex phenomena. Those simulation models suggest a certain image of social sciences as a kind of, let us say, "patchwork". In that image, an increase in understanding about the phenomena modeled is obtained through a certain sort of aggregation. There is not an application of sound, established theories to all the phenomena of a (...) certain kind, but an aggregation of the structures supposed, and of the results obtained, when particular systems are modeled. The recent case of the "El Farol Bar" problem, and the models built in order to face this problem, are a good example of this. We will analyze that case, trying to make clear what would be implied by the image above mentioned. Special attention will be paid to the need to take seriously the notion of a bounded rationality, linked to the special circumstances generating each decision problem, and to the existence of an irreducible pluralism of models. This essay provides an account of the lived personal experience of immigration at three levels: general aims; relations to place and to other persons; and feelings and sensibility. The account is structured by Charles Peirce's phenomenological categories, but the emphasis is on describing the experience. For the experiential descriptions, the essay also relies on the work of Latin Americans such as Octavio Paz and Mario Benedetti and Anglo Americans such as Henry Thoreau, John McDermott, Jane Addams, and Lara Trout.

In Jurismania, Paul Campos asserts that our legal system is beginning to exhibit symptoms of serious mental illness. Trials and appeals that stretch out for years and cost millions, 100 page appellate court opinions, 1,000 page statutes before which even lawyers tremble with fear, and a public that grows more litigious every day all testify to a judicial overkill that borders on obsessive-compulsive disorder. Campos locates the source of such madness, paradoxically, in our worship of reason and the (...) resulting belief that all problems are amenable to legal solutions. In insightful discussions of a wide range of cases, from NCAA regulations of student-athletes to the Simpson trial, from our most intractable social disputes over abortion and physician-assisted suicide to the war on drugs and the increasingly fastidious attempts to regulate behavior in public spaces, Campos shows that the mania for more law exacerbates the very problems it seeks to remedy. In his final chapter, the author calls instead for a humbling recognition of the limits of reason and a much more modest role for our legal system. Clearly written and laced with a delicious wit, Jurismania gives us a CAT-scan of the American legal mind at work. Understanding positive emotions' shared and differentiating features can yield valuable insight into the structure of positive emotion space and identify emotion states, or aspects of emotion states, that are most relevant for particular psychological processes and outcomes. We report two studies that examined core relational themes (Study 1) and expressive displays (Study 2) for eight positive emotion constructs—amusement, awe, contentment, gratitude, interest, joy, love, and pride. Across studies, all eight emotions shared one quality: high positive valence. Distinctive core relational theme (...) and expressive display patterns were found for four emotions—amusement, awe, interest, and pride. Gratitude was associated with a distinct core relational theme but not an expressive display. Joy and love were each associated with a distinct expressive display but their core relational themes also characterised pride and gratitude, respectively. Contentment was associated with a distinct expressive display but not a core relational theme. The implications of this work for the study of positive emotion are discussed. (shrink)

Emotion regulation is one of the major foci of study in the fields of emotion and emotional development. This article proposes that to properly study emotion regulation, one must consider not only an intrapersonal view of emotion, but a relational one as well. Defining properties of intrapersonal and relational approaches are spelled out, and implications drawn for how emotion regulation is conceptualized, how studies are designed, how findings are interpreted, and how generalizations are drawn. Most research to date has been (...) conducted from an intrapersonal perspective, and the shortcomings of this approach for understanding emotion regulation are highlighted. This book is the second collection of essays on reproductive ethics from Drs. Campo-Engelstein and Burcher. This volume is unique in that it is both timely and includes several essays on new technologies, while also being a comprehensive review of most of the major questions in the field, from racial disparities in reproductive healthcare to gene editing and the possibility of the creation of a transhuman species. The scholars writing these essays are pre-eminent in their fields, and their backgrounds are (...) quite varied, including philosophers, anthropologists, physicians, and professors of law. Reproductive ethics remains an underdeveloped area of bioethics despite the recent technological breakthroughs that carry both great promise and potential threats. Building on the first volume of work from a conference held just over one year ago, this new collection of essays from a conference held April 2017 continues this discussion as well as provides ethical insights and reviews of these emerging technologies. The ethical questions swirling around human reproduction are both old and new, but the conference presentations, and the essays derived from them, focus on new ways of appreciating old arguments such as the ethics of abortion, as well as new ways of seeing new technologies such as CRISPR and mitochondrial transfer. Discussions of reproductive responsibility generally draw heavily upon the principles of nonmaleficence and beneficence. However, these principles are typically only applied to women due to the incorrect belief that only women can cause fetal harm. The cultural perception that women are likely to cause fetal and child harm is reflected in numerous social norms, policies, and laws. Conversely, there is little public discussion of men and fetal and child harm, which implies that men do not (or cannot) cause such harm. (...) My goal in this paper is to begin to fill the void in the academic literature about men’s reproductive responsibility by highlighting the health-related, economic, and social harms men can cause to potential fetuses and children and then examining what it would mean to hold them responsible for preventing these harms. Applying the principles of nonmaleficence and beneficence to men, I conclude that men have a moral duty to use contraception if their behavior—past, current, or future—could harm the potential fetuses and children who result from their unprotected sexual behavior. This article analyzes the meaning of the expression "disenchantment of the world" in the French philosopher Marcel Gauchet’s thought. In order to do so, it seeks to show that, through the thesis of an exit of religion, Gauchet presents the historical development of religion in three distinct stages but successive and interrelated each other, that is to say: The religion of the past as the configurator of the original experience of heteronomy in its most absolute form of the so-called primitive (...) societies or without writing; The historic moment of exit from religion as an event of absolute transition from heteronomous hegemony to autonomy hegemony; and,, finally, the current stage as a "post-religion" moment, in which a metamorphosis of religion is seen in personal belief and, thus, to a transformation of the figure of the Beyond or suprasensible, which entails, in turn, different conceptions and figures of transcendence in the contemporary world. In traversing the Gauchetian thought in its historical-analytical arc, the article shows how the French thinker reflects on the conditions of possibility of the religious and religiosity in the present times. According to Petersen, ‘the individualization argument against NMEF [nonmedical egg freezing]’ states: ‘it is morally wrong to let individuals use technology X [NMEF] – in order to try to handle a problem that is social in nature – if the use of X [NMEF] will somehow work against a social solution to a social problem P [gender inequality in the labor market]’. While there may be individuals making individualisation argument against NMEF, I do not read the scholars he discusses—Karey Harwood,1 (...) 2 Lynn Morgan, Janelle Taylor3 and Angel Petrapanagos4—as making this argument. These scholars agree with the premise of the individualisation argument that NMEF ‘is an individualistic and morally problematic solution to the social problems that women face’, but this does not mean that they agree with the conclusion ‘women should not use NMEF’. In fact, several admit that NMEF can be a good choice for some women; Petropanagos, for example, states ‘individual women may benefit from egg freezing to satisfy their reproductive desires’.4 In this commentary, I argue that Petersen incorrectly reduces these scholars’ positions to the individualisation argument by neglecting three pertinent factors: their feminist orientation, their multifaceted critiques of NMEF and how the rapidly advancing field of reproductive medicine informs their ethical analysis. Moral reasoning typically informs environmental decision-making by measuring the possible outcomes of policies or actions in light of a preferred ethical theory. This method is subject to many problems. Environmental pragmatism tries to overcome them, but it suffers also from some pitfalls. This paper proposes a new method of environmental pragmatism that avoids the problems of both the traditional method of environmental moral reasoning and of the general versions of environmental pragmatism. We call it 'justificatory moral pluralism' - it develops (...) the intuition that normative ethical theories need not be mutually exclusive. This leaves room for important forms of pluralist environmental ethics that do not require a once-and-for-all prior commitment to an ethical theory when deciding about policies or courses of action related to the protection of the environment. Justificatory moral pluralism offers a viable solution to the recurrent conflicts between efficient environmental decisions and the need for moral reasoning. (shrink)

This paper suggests that the focus on abortion legalization in the aftermath of the Zika outbreak is distracting for policy and lawmakers from what needs to be done to address the outbreak effectively. Meeting basic health needs, together with research and development conducive to a vaccine or treatment for the Zika virus should be priorities.

European Journal of Political Theory, Volume 21, Issue 2, Page 368-389, April 2022. Epistemic impairment has been the decisive yardstick when excluding infants from political agency. One of the suggestions to bypass the epistemic requirement of political agency and to encourage the inclusion of infants in representative democracies is to resort to proxies or surrogates who share or advocate interests which may be coincidental with their interests. However, this solution is far from desirable, given that it privileges the political agency (...) of parents, guardians and trustees over other adult citizens. This article offers an alternative to this conceptual frame of reference by making a case for the political agency of infants. Firstly, it maintains that political agency can be understood in terms of the several facets involved in political representation. Secondly, it claims that the all-affected principle can be reformulated as an ‘infant-affected-interests principle’ in light of which infants are members of the class of the represented. Thirdly, it explores the ways through which this political agency can occur without having to resort to alternative conceptions of representation. The conclusion ascertains that infant enfranchisement is highly undesirable and that there are more viable forms to promote infant political agency, such as virtual representation, infant-beneficial principles of political action and ombudspersons for infants. Recently, novel lines of research have developed to study the influence of identity processes in sport-related behaviours. Yet, whereas emotions in sport are the result of a complex psychosocial process, little attention has been paid to examining the mechanisms that underlie how group membership influences athletes’ emotional experiences. The present narrative review aims at complementing the comprehensive review produced by Rees et al. (2015) on social identity in sport by reporting specific work on identity-based emotions in sport. To that end, (...) we firstly overview the different terminology currently used in the field of emotions in groups to clarify the distinct nature of emotions that result from an individual’s social identity. Secondly, we discuss key concepts of social identity to better understand the mechanisms underlying identity-based emotions. Thirdly, we address existing knowledge on identity-based emotions in sport. We close the present narrative review by suggesting future research perspectives based on existing meta-theories of social identity. Evidence from the social psychology literature is discussed alongside existing works from the sport literature to propose a crucial theoretical approach to better understand emotions in sport. Though they may cause your stomach to burn, that is easily remedied by taking a complementary pill that will neutralize your stomach acidity with only some minor and negligible side effects elsewhere. There are also magic pills that promise you happiness, by giving you the power to thrive and the endurance to conquer the world. In 2012, two major professional societies representing Europe and the United States released influential statements that would propel a commercial market for social egg freezing, in which women bank their oocytes for later use in order to avoid compromised fertility that comes with age. While the European Society of Human Reproduction and Embryology condoned SEF based on reproductive autonomy and justice, the American Society for Reproductive Medicine discouraged SEF based on insufficient data and concerns about false hope. In this article, (...) we map the contexts and discursive moves by which the biomedicalization of SEF proceeded since 2012. We compare professional bioethical arguments that made the case to approve SEF in Europe with news and popular media discourse that formed and shaped the commercial marketization of SEF in the United States despite the recommendation of the ASRM. While a statist pronatalist perspective informed the former, a distinctly private labor market recruitment strategy utilizing a Lean In efficiency model of feminism buttressed the latter. (shrink)

The paper looks into a participatory art project developed in two women’s refuges, one in Portugal and the other in England. Addressing liminality after surviving violence, the project constructs a portrait of survivors, utilising feminist pragmatist aesthetics to transfer representational agency to participants. Against a background where women who have experienced domestic violence have often been portrayed in simplistic representations of damaged beauty, the study sought to gain a deeper understanding by holding visual art workshops with participants (Portugal, England) and (...) analysing data from verbal testimonies (England). The paper contributes to a discussion of the practical issues negotiated when establishing a representational power balance between researchers and research participants. It does this by providing a critical discussion of three ethical problems emerging in relation to the project. The first concerns the dominant representation of survivors, the second the need for participants’ anonymity and the third the challenges of inequality in qualitative research. (shrink)
