What are the implications for theory and research in psychology of a hermeneutic perspective that takes practices as its starting point notion? The author addresses this wide-ranging issue by considering a number of specific questions in turn, including, among others, whether the hermeneutic perspective leads to rejecting systematic, quantitative research methods; whether it leads to the conclusion that efforts at theory and research provide us with an understanding of human behavior that is arbitrary; and whether a practices-based perspective points to (...) a way of pursuing inquiry in psychology that is better than proceeding along the lines of mainstream psychology. The answers to these questions include a number of surprises, especially regarding how the hermeneutic perspective contrasts with mainstream psychology and how it differs from social constructionism. Considering recent failed attempts to derive an ethical theory from Georg Lukács’s original formulation of reification, this paper offers an alternative more rooted in Lukács’s theory as a whole. By analyzing his critique of the empty Ought in Kant and Fichte, followed by his advocacy of substantial, materially-grounded Oughts in his late Ontology, I suggest that we can nevertheless find latent possibilities for grounding such values even in his theory of reification. Drawing on recent interpretations of Lukács that emphasize his (...) debt to Neo-Kantianism, Husserl et al, I argue that one of Lukács’s central critiques of reification is precisely its expulsion of substantial values from formal social relationships. This implies, I suggest, a structural demand to reincorporate such values within relations, so that they might reach valid form; I conclude with some suggestions on the ethical demands this might entail. At the same time that social justice concerns are on the rise on college campuses, empathy levels among US college students are falling. Social injustice resulting from organizational decisions and actions causes profound and unnecessary human suffering, and research to understand antecedents to these decisions and actions lacks attention. Empathy represents a potential tool and critical skill for organizational decision-makers, with empirical evidence linking empathy to moral recognition of ethical situations and greater breadth of understanding of stakeholder impact and improved (...) financial success. This study explores the potential relationship between empathy and social justice, using a multifaceted operationalization of social justice, which includes management actions and social sympathies. Using Reidenbach and Robin‘s ( Journal of Business Ethics 7, 871–879, 1988) multi-criteria ethics instrument, we carried out the first empirical test of Robertson and Crittenden‘s (Strategic Management Journal 24, 385–392, 2003) cross-cultural map of moral philosophies to examine what ethical criteria guide business people in Russia and the U.S. in their intention to behave. Competing divergence and convergence hypotheses were advanced. Our results support a convergence hypothesis, and reveal a common emphasis on relativism. Given the recent ethics scandals in the United States, there has been a renewed focus on understanding the antecedents to ethical decision-making in the research literature. Since ethical norms and standards of behavior are not universally consistent, an individual’s choice of referent may exert a large influence on his/her ethical decision-making. This study used a social identity theory lens to empirically examine the relative influence of the macro- and micro-level variables of national culture and peers on an individual’s intention to (...) behave ethically. Our sample consisted of respondents from Germany, Italy, and Japan. The results indicated that both national culture and peers were found to act as significant referents in ethical decision-making dilemmas. Although peers exerted a much stronger influence on an individual’s ethical decision-making, the impact of peers varied depending on the national culture levels of individualism and power distance. This volume examines various points of contact between Marxism and phenomenology. Although these traditions can appear conceptually incompatible, the contributors reveal productive complementarities on themes such as alienation, reification, and ecology, which illuminate and can help to resolve the crises of contemporary capitalism.

Aesthetic attitude theories suggest we must attend disinterestedly to the properties of objects to experience aesthetic delight in them: we view them without regard to their use for us. Bence Nanay’s recent revival of the concept explains it through the distribution of our attention over the many properties of individual objects. While agreeing with Nanay’s approach, I argue such perception presupposes certain intentionality towards the object in the Fregean-Husserlian sense. Whether we see the same object as informative or aesthetically gratifying (...) depends on whether we understand it as, say, a map or as a work of design or art. Furthermore, intending an object as aesthetic means we treat it as internally coherent: its properties are defined in relation to one another, rather than the purposes of a subject. This, I conclude, even affects the presentation of historical or moral values that obviously originate outside the object of aesthetic appreciation. (shrink)

This book focusses on conceptual shifts in the successive formulations of natural law theory by Aquinas, Suárez, Grotius, Pufendorf, and Finnis, and reveals the accumulation of problems, inherent in natural law and theory, which ultimately led to its demise.

This article examines different intellectual-historical approaches to the work of Georg Lukács, arguing that a methodology similar to that of the Cambridge School is, curiously, that most in line with Lukács’s own approach. I begin with some general methodological comments on intellectual history, before showing that a proper appreciation of the discourses within which Lukács was situated is essential to understanding both the specifics and the overall project of History and Class Consciousness. Finally, I argue that situating thinkers like Lukács (...) properly within their time does not reduce them to museum pieces; rather, by seeking to capture the alterity of the past without reducing it to familiarity, we may de-reify our own world-views. The Hungarian theorist Georg Lukács is known for his reintroduction of Hegelian thought to Marxist philosophy—but I argue that his account of the subjectivity of the proletariat owes just as much to the Danish philosopher and theologian Søren Kierkegaard. Despite strong differences in their outlook, their accounts of subjectivity have strong structural similarities. For both, a division of the self against itself produces suffering that leads in turn to a growing consciousness of the roots of the problem; in the end, (...) the self is restored through a relation to itself grounded in the absolute, and thereby becomes capable of freedom. Lukács’s theory of subjectivity is, thus, predicated on changing the orientation of the proletariat towards itself—in ways that are deeply indebted to the peculiar theology of Kierkegaard. (shrink)

Lewis attempts to add what is missing by reinterpreting Engel as (...) a pragmatist. As I see it, he is on the right track. We need to add something more to Engel’s position, and Lewis’s reinterpretation is an intriguing attempt to respond to this need. Nevertheless, I believe Lewis’s article only takes us so far. Something is still missing. In what follows, I identify what is missing, make suggestions about additional steps we can take to remedy the situation, and raise the possibility that pragmatism can be helpful in this venture in ways that Lewis does not consider.It should come as no surprise that it will take a lot to accomplish Engel’s objectives, because those goals are extremely ambitious. For one thing, Engel offered his biopsychosocial model as an alternative framework for all of medicine, not just psychiatry. Furthermore, he believed that it was not enough to augment the technological focus of the biomedical model by simply tacking onto it more humane concern with the patient as a person and more attention to the patient–physician relationship (although he certainly advocated changes along those lines). Engel maintained that psychosocial factors play an intrinsic role in the etiology of disease, its assessment, and treatment. He based his biopsychosocial model on general systems theory because he believed that it provides a framework for dealing with disease in a way that reflects this view.This is where Lewis enters the arena. He endorses Engel’s goal of developing a biopsychosocial approach to medicine and psychiatry, but he takes issue with Engel’s belief that we can reach this goal by following along the lines of general systems theory. Indeed, he claims that Engel’s biopsychosocial model was “doomed from the start” because of this idea. At a later point, I will turn to Lewis’s arguments against employing a systems theory framework. We investigate the cross-cultural relationships between spirituality and ethical decision-making in Norway and the U.S. Data were collected from business students ( n = 149) at state universities in Norway and the U.S. Results indicate that intention to behave ethically was significantly related to spirituality, national culture, and the influence of peers. Americans were significantly less ethical than Norwegians based on the three dimensions of ethics, yet more spiritual overall. Interestingly, the more spiritual were Norwegians, the more ethical was their (...) decision-making. By contrast, the more spiritual were Americans, the less ethical was their decision-making. The research also found that peer influences were more important to Norwegians than to Americans in making ethical decisions. Finally, spiritual people from the U.S. were more likely to use a universalistic form of justice ethics, as opposed to a more particularistic form of justice ethics used by Norwegians. (shrink)

Brouwer defended the view that the autonomy of the individual citizen is furthered by articulated, precise and clear legislation. The question arises whether all kinds of rules can be said to enhance such autonomy. It is argued that a distinction should be drawn between rules that dictate desirable outcomes, on the one hand, and rules that determine the way the game is played, on the other. Rules of the game often reflect the way they were drafted and can be seen (...) as the embodiment of power relations between rule-makers. Rules that dictate outcomes, on the other hand, are often drafted by experts who analyse the goals to be reached. The view is defended that only rules of the game – potentially – enhance the autonomy of the citizen, whereas outcome-rules are potentially manipulative, tending to exclude those who are ill-equipped to realize the prescribed outcomes. The virtues of rules therefore do not merely reside in their clear and precise nature, but are largely derived from their capacity to regulate the relations amongst citizens who were included in the process of rulemaking. The concept of the subject is at the core of many social movements that attempt to empower disadvantaged groups by identifying a basic subjectivity underlying and uniting such groups. Though otherwise supportive of such movements, recent continental philosophers and social theorists such as Althusser, Derrida, and Butler have criticized such notions of subjectivity, arguing that they presuppose false and harmful ideas of unity and substantiality as the ‘true’ essence of these groups. In this paper, I propose that one possibility for (...) resolving this debate can be found in the work of Western Marxists such as Georg Lukács, Theodor Adorno, and Walter Benjamin. I argue that they ground an authentically subjective selfhood on the distinct meaningfulness of individual consciousness. Identifying phenomenological motifs in the way they describe consciousness, I suggest that they define meaning by the way different particular experiences recall or relate to one another. By interpreting the many possible meanings of experience, subjects are able to build up an image of themselves, while collective subjectivity can be grounded on the exegesis of shared experiences. Because such meaningfulness is genuinely sui generis, emerging within consciousness, action in accordance with such images counts as autonomous; at the same time, meaning is sufficiently fluid that there can never be one single correct interpretation of it. Ultimately, the Western Marxists suggest, it is in the constant formulation and reformulation of images of oneself through reinterpretation of one’s experience that constitutes subjective selfhood. Three remarks, which are sometimes made about Freud's distiction between Ego and Id are discussed: 1. This distinction would have no analogy in other psychological concepts. 2. The essence of the "I" would be misjudged here. 3. It would be the rest of an atomising psychology, not yet arriving at the modern views of totality. Although the common parlance concerning psychic "parts" has indeed analogies in the old atomistic-psychological conceptions, these instances, as well as the conflicting drives are and have (...) been always considered in psychoanalysis as expressions of which the person himself is the subject. Especially the concept "Id" must be looked at as equivalent to the biological total, to the concept: Person-Stern. The concept I or Ego, as a special structure of "figure" within this whole, means no split-off part, but is equivalent to what is called elsewhere "durchstrukturiertes Unterganze". Freud entitles a certain intern organisation with the word "Ich". He that thinks the essence of "the" I herewith misjudged, confuses word and concept -- the word I contains a lot of equivocations. That there are conflicts within the person is a basic matter of fact, which is not to be pushed aside in favour of totalitarian dogmatics, this conflict must be expressed in our terminology in some way or other. Terms, by way of comparison borrowed from material situations cannot always be avoided, and need not give any inconvenience, provided reflecting over the import of the terms is practised sufficiently. This article begins by identifying three key features of the traditional approach to defense and shows how these features reflect ideas from our philosophical tradition. It then presents an interpersonal reconceptualization of defense, which is guided by an alternative philosophical perspective based on what Merleau–Ponty referred to as "involved subjectivity." This reconceptualization, or theory of "interpersonal defense," calls for viewing defense primarily as interpersonal behavior, attending to the functional role it plays in ongoing interactions, and recognizing that defensive behavior is (...) a special type of problematic interpersonal pattern. Interpersonal defenses often are quite effective when it comes to avoiding clear-cut versions of feared interaction outcomes, but they make it virtually impossible for clear-cut versions of wished-for outcomes to occur, promote indirect versions of feared outcomes, and lead to highly distorted forms of wished-for consequences. They are characterized by a failure in how individuals integrate their behaviors in the context of interactions in which they are engaged as participants. This is a breach precisely in what the alternative philosophical perspective takes to be the core of human behavior. Defense represents a struggle against the person’s fundamental involvement in the world, and viewing it in this light helps us understand concrete features of the phenomena of interest. Implications of the theory of interpersonal defense for research and practice are discussed, including using discourse analysis to operationalize defensive behavior. The article concludes with the suggestion that the basis for defense involves a "fundamental fault-line" in human nature which concerns a delicate balance between integrating our actions in the contexts that make up our lives and attempting to control constraints of those situations. This is a study of a religious movement with political overtones, the U.S. the Sanctuary movement, which lasted from 1982 to 1992. The movement was com- prised of about 500 congregations that gave shetler to Central American refugees in defiance of the U.S. gov- ernment. In its theology, Sanctuary had folk religious el- ements because, like liberation theology on which it was based, it involved the reinterpretation of scripture, it was oppositional in intent to official religion, it developed a new (...) social structure within the congregation, it utilized the concepts of folk saints and martyrs as well as new li- turgical elements, and it espoused an alternative version of Christ. Are employers utilizing temporary workers as a means to decrease the funds allocated to the training and development of full-time workers? This article examines industry trends in the utilization of contingent workers and training expenditures in an attempt to explain the relation between the two variables. The article also examines the ethical responsibility of organizations to train and develop employees. Data were collected from organizations that participated in a survey soliciting information regarding temporary workers and training expenditures between the years (...) 1980 and 1999. The results suggest that a relation does exist between the variables. Data were also collected from Fortune magazine databases concerning "America's Most Admired Companies" and the "100 Best Companies to Work for". These data suggest that training has an impact on the various attributes of organizations that are included on these lists. (shrink)

To effectively teach the United Nations Sustainable Development Goals to enhance corporate social responsibility, we need to understand the predictors of business student predispositions towards the SDGs. We examine whether location, authoritarianism, religiosity, and individualism influence university business student SDG preferences. Results indicate authoritarian and religious business students emphasize SDGs with an orientation towards the health and economic well-being of their local communities. The results also indicate the most significant factor in predicting SDG preference was university location. Southeastern U.S. students (...) were more supportive of people/prosperity-oriented SDGs, indicating greater concern with the social safety net and basic human needs, whereas Hawaiian students were more supportive of planet-oriented SDGs indicating greater concern for environmental issues. Sustainability managers represent a key stakeholder in implementing and diffusing sustainability initiatives. However, there is a significant gap in the literature examining the impact of greenwashing on sustainability managers. This research examines the effects of greenwashing on sustainability managers' job satisfaction, commitment, turnover intentions, and job performance from a social identity/person–organization (P‐O) fit perspective. Our sample consists of practicing sustainability managers (n = 125) in high‐ (77%) or mid‐level (23%) positions. Results indicate that perceived greenwashing negatively affects the attitudinal outcomes (...) and job performance of sustainability managers. The results also indicate that for sustainability managers whose social responsibility identity is higher than that of their firm, greenwashing has a significant association with lower satisfaction and job performance and higher intentions to leave. However, for managers whose social responsibility identity is lower than that of their firm, employer greenwashing had no effect on the sustainability managers' attitudes, even though they recognized their own poor job performance. The cumulative effect may be a situation in which managers in the best position to enhance a firm's CSR leave the firm, and vice versa. (shrink)

We investigated the ethical behavior of Turkish university students to compare the difference in ethical behavior between business students and non-business students, examine the impact of key contingency variables on how they make decisions when confronted with an ethical dilemma, and investigate the process underlying the ethical behavior of Turkish students. Data were collected from business students at a major private university in Western Turkey. The results indicate that a Turkish student’s peers, marital status, and education level exert a significant (...) effect on their ethical behavior. Further, business students specifically differed from non-business students in their enhanced use of egoism when confronted with an ethical dilemma. In this comparative survey of 191 Egyptian and 92 U.S. executives, we explore the relationship between national culture and ethical decision-making within the context of business. Using Reidenbach and Robin’s (1988) multi-criteria ethics instrument, we examine how differences on two of Hofstede’s national culture dimensions, individualism/collectivism, and power distance, are related to the manner in which business practitioners make ethical decisions. Egypt and the U.S. provide an interesting comparison because of the extreme differences in their economies and related business development. (...) Our results indicate that respondents from the U.S, individualistic and low in power distance, were likely to view the decision making outcome in ethics scenarios as more unethical than the more collectivistic and high power distance Egyptians, when applying ethical criteria based on justice, utilitarianism, relativism, and (contrary to our predictions) egoism. However, we also found that both Egyptians and Americans rely on justice, utilitarianism, and relativism in predicting their intentions to behave ethically, and that Americans substitute egoism for justice, when the behavioral intentions of peers are examined. This article investigates the implications of goal-legislation for legal argumentation. In goal-regulation the legislator formulates the aims to be reached, leaving it to the norm-addressee to draft the necessary rules. On the basis of six types of hard cases, it is argued that in such a system there is hardly room for constructing a ratio legis. Legal interpretation is largely reduced to concretisation. This implies that legal argumentation tends to become highly dependent on expert (non-legal) knowledge.

This book features essays that investigate the nature of legal validity from the point of view of different traditions and disciplines. Validity is a fascinating and elusive characteristic of law that in itself deserves to be explored, but further investigation is made more acute and necessary by the production, nowadays, of soft law products of regulation, such as declarations, self-regulatory codes, and standardization norms. These types of rules may not exhibit the characteristics of formal law, and may lack full formal (...) validity but yet may have a very real impact on people's lives. The essays focus on the structural properties of hard and soft legal phenomena and the basis of their validity. Some propose to redefine validity: to allow for multiple concepts instead of one and/or to allow for a gradual concept of validity. Others seek to analyze the new situation by linking it to familiar historical debates and well-established theories of law. In addition, coverage looks at the functions of validity itself. The discussion considers both international law as well as domestic law arrangements. What does it mean to say that something is valid? Should we discard validity as the determining aspect of law? If so, what does this mean for our concept of law? Should we differentiate between kinds of validity? Or, can we say that rules can be "more" or "less" valid? After reading this book, practitioners, scholars and students will have a nuanced understanding of these questions and more.
