Yüce Allah, Kurʹân-ı Kerim’de ashâbü’l-yemîn ve ashâbü’l-meymene gibi ifadeler kullanmış ve bu ifadelerle bir takım insanları kast etmiştir. Kastedilen iyi insanların vasıfları bu ifadelerden hemen sonra zikredilmiştir. Bu da Allah’ın sağ tarafa önem atfettiğinin göstergelerindendir. Hal ve hareketleri bakımından sevilen Hz. Peygamber, Müslümanlar için örnek kabul edilmiş ve onun emir ve tavsiyeleri harfiyen uygulanmaya hassasiyet gösterilmiştir. O, sağ taraf ile (...) faziletli ve hayırlı işleri, sol taraf ile de nahoş olan fiilleri yapmış ve bunu teşvik etmiştir. Sahâbe de bunu hem uygulamış hem de sonraki nesillere aktarmaya azami gayret göstermiştir. Daha sonra onun bu yöndeki tavsiye ve uygulamaları fıkıh âlimleri arasında kural haline gelmiştir. Hz. Peygamber’in sağ tarafla ilgili sözleri, uygulamaları ve tavsiyeleri hadisler vasıtasıyla bize aktarılmıştır. Böylece günlük hayatta başta olmak üzere ibadetlerde sağ tarafa ehemmiyet göstermiştir. Bu çalışmada Hz. Peygamber’in sağ tarafı önemsemesinin ve sağ tarafa öncelik vermesinin, beşerî ya da nebevî olup olmaması tartışmasına değinilecektir. Daha sonra Arapça iki kavram olan yemîn ve yesâr kavramlarının tarifi ele alınacak, abdest alırken sağ el ve ayakların önce yıkanmasının, tek kişinin imamın hangi tarafında durmasının ve teşehütte otururken sağ el ve sağ ayağın konumunun hükmü gibi konuların hükmüne işaret edilecektir. This paper presents a methodology to design and implement programs intended to decide cases, described as sets of factors, according to a theory of a particular domain based on a set of precedent cases relating to that domain. We useDialectical Frameworks, a recent development in AI knowledge representation, as the central feature of our design method. ADFs will play a role akin to that played by Entity–Relationship models in the design of database systems. First, we explain how the factor hierarchy (...) of the well-known legal reasoning system CATO can be used to instantiate an ADF for the domain of US Trade Secrets. This is intended to demonstrate the suitability of ADFs for expressing the design of legal cased based systems. The method is then applied to two other legal domains often used in the literature of AI and Law. In each domain, the design is provided by the domain analyst expressing the cases in terms of factors organised into an ADF from which an executable program can be implemented in a straightforward way by taking advantage of the closeness of the acceptance conditions of the ADF to components of an executable program. We evaluate the ease of implementation, the performance and efficacy of the resulting program, ease of refinement of the program and the transparency of the reasoning. This evaluation suggests ways in which factor based systems, which are limited by taking as their starting point the representation of cases as sets of factors and so abstracting away the particular facts, can be extended to address open issues in AI and Law by incorporating the case facts to improve the decision, and by considering justification and reasoning using portion of precedents. In light of the development of “CRISPR” technology, new promising advances in therapeutic and preventive approaches have become a reality. However, with it came many ethical challenges. The most recent worldwide condemnation of the first use of CRISPR to genetically modify a human embryo is the latest example of ethically questionable use of this new and emerging field. Monotheistic religions are very conservative about such changes to the human genome and can be considered an interference with God’s creation. Moreover, these (...) changes could cause perpetual changes to future generations. The Muslim scholars establish their decisions by addressing five foundations of Islamic law i.e. “maqāṣid al sharı̄`a”; the purposes of the law. These are dın̄, nafs, nasl, `aql and māl. To achieve this, the five principles should all be met before approval of an experiment like the Chinese embryo modifications; Qaṣd which is achieved in this case as it aims to protect the embryo from HIV. Yaqın̄ and Ḍarar were not satisfied as they require strong scientific certainty of the procedures, and evidence of safety. Ḍarūra by which the alternatives being compared; in this case more established and proven safe alternatives to protect the HIV transmission from the father are available, so this principle is not met. The final principle is `Urf, by which the social context of using any contemporary technology should be taken in consideration, and clearly this was not achieved. Collectively, germline changes are rejected from an Islamic perspective until the five principles are fulfilled. In the Chinese Twins gene editing case, there was clearly no justification or support for it according to the Muslim Jurisprudence laws. These laws and approaches can serve as an ethical checklist for such controversial research, especially in early stages of the research. (shrink)

Background The number of coauthors in the medical literature has increased over the past 50 years as authorship continues to have important academic, social and financial implications.Aim and method The study aim was to determine the prevalence of honorary authorship in biomedical publications and identify the factors that lead to its existence. An email with a survey link was sent anonymously to 9283 corresponding authors of PubMed articles published within 1 year of contact.Results A completed survey was obtained from 1246 (...) corresponding authors, a response rate of 15.75%. One-third admitted that they had added authors who did not deserve authorship credit. Origin of the study from Europe and Asia , study type as case report/case series and increasing number of coauthors were found to be the associated factors on multivariate analysis. Journal impact factor was also found to be associated with honorary authorship for those who self-reported honorary authorship and 5.60 for those who did not report unjust authorship, p=0.05). In retrospect, 75% of the authors indicated that they would remove unjustified names from the authorship list. Reasons for adding honorary authors were complimentary , to avoid conflict at work , to facilitate article acceptance , and other .Conclusions Honorary authorship is relatively common in biomedical publications. Researchers should comply with the International Committee of Medical Journal Editors’ criteria for authorship. (shrink)

Value Co-Creation plays a major role in engaging knowledgeable individuals in a community via innovation, problem solving, and new service/product development. This study investigates the personal factors that influence individuals’ engagement in value co-creation in Higher Education Institutions through the use of online platforms. Some higher education institutions have successfully established or used appropriate online platforms, such as online forums, web applications, and mobile applications to engage their community in ideation or crowdsourcing as a part of the value co-creation process. On the other hand, some HEIs have failed to engage their community in value co-creation activities, and even if they managed to engage some individuals in value co-creation once, they failed to sustain these individuals’ engagement in value co-creation using online platforms. Using the Stimulus Organism Response framework, this study examines the relationship between relevant personal factors and other motivational factors that provide perceived benefits with value co-creation engagement. Data was collected from 308 respondents at five Malaysian research universities. The software analysis tool Smart PLS is used for data analysis and validation. The results demonstrate that personal factors and perceived benefits as a motivational factor has a significant effect on individual engagement in value co-creation. However, the significance of these findings varies from one individual to another. The implications of these findings are discussed. (shrink)

Philosophy and joke telling do not share the same pedigree, but both can have an allied function and purpose. Philosophy and joke telling can help us to organize, interpret, possibly understand, or, at least, hopefully face and confront the fundamental issues of existence.Let me be more precise about what I mean by using humor and jokes in teaching philosophy. Humor, joke telling, can serve as a narrative playlet to metaphorically illuminate a complex philosophical concept. However, every class should not simply (...) be played for laughs and comedic effect. Rather, through the judicious use of joke telling, the instructor needs to create an atmosphere of “respectful playfulness” which allows students an opportunity to comfortably address some of the complexities, confusions, and conundrums of the human condition. Evolutionary approaches to the emotions have traditionally focused on a subset of emotions that are shared with other species, characterized by distinct signals, and designed to solve a few key adaptive problems. By contrast, an evolutionary psychological approach (a) broadens the range of adaptive problems emotions have evolved to solve, (b) includes emotions that lack distinctive signals and are unique to humans, and (c) synthesizes an evolutionary approach with an information-processing perspective. On this view, emotions are superordinate mechanisms that evolved (...) to coordinate the activity of other programs in the solution of adaptive problems. We illustrate the heuristic value of this approach by furnishing novel hypotheses for disgust and sexual arousal and highlighting unexplored areas of research. (shrink)

A new form of software piracy known as digital piracy has taken the spotlight. Lost revenues due to digital piracy could reach $5 billion by the end of 2005.Preventives and deterrents do not seem to be working – losses are increasing. This study examines factors that influence an individual’s attitude toward pirating digital material. The results of this study suggest that attitude toward digital pirating is influenced by beliefs about the outcome of behavior (cognitive beliefs), happiness and excitement (affective beliefs), (...) age, the perceived importance of the issue, the influence of significant others (subjective norms), and machiavellianism. Given these results, measures can be developed which could alter attitudes toward digital piracy. (shrink)

Companies are expected to monitor sustainable behaviour to help improve performance, enhance reputation and increase chances of survival. This paper examines the relationship between sustainability committees and independent external assurance on the inclusion of sustainability-related targets in CEO compensation contracts. Using a sample of UK FTSE350 companies for 2011–2015 and controlling for governance and firm characteristics, we find both board-level sustainability committees and sustainability reporting assurance have a positive and significant association with the inclusion of sustainability terms in compensation contracts. (...) However, there is no joint impact between the voluntary use of independent external assurance and the role of sustainability committees on CEO compensation contracts. Sustainability-related terms in compensation contracts are more likely to be included, and higher compensation is likely to be paid, when assurance is provided by a Big4 firm and when a company operates in a sustainability-sensitive industry. Our findings highlight the potential of assured sustainability reports in assessing CEO performance in sustainability-related tasks, especially when sustainability metrics are included in CEO compensation contracts. Overall, our results suggest companies that invest in voluntary assurance are more likely to monitor management’s behaviour and be concerned about the achievement of sustainability goals. (shrink)

Despite a proliferation of research on Islam and Muslims in the media, very little work has focused on Muslim women, a much-debated social group that merits special consideration. This article aims to investigate how Muslim women are represented in BBC News website texts using a purpose-built corpus. The research employs analytical tools from the discourse-historical, socio-cognitive, and sociosemantic approaches to critical discourse studies. These are combined with corpus-based methodologies to investigate the semantic macrostructures that tend to be associated with Muslim (...) women and the discursive strategies employed in the representation of the hijab. The study is novel in its exhaustive approach to identifying salient and underreported issues related to Muslim women in news discourse. It also introduces a more integrated analysis that combines manual and automated techniques and tackles the quantification of qualitative results where possible. Findings suggest that Muslim women’s representations are largely restricted in terms of regional coverage. Semantic macrostructures related to conflict and crime are prevalent. The hijab remains a nodal discourse surrounding Muslim women whose function as a descriptive feature is often unclear, raising serious questions about its relevance. A number of recommendations are made for journalists to become cognizant of their own context models when reporting on Muslim women. (shrink)

As international trade and business opportunities grow globally, insight into trading partners’ strategies is essential. One of the major strategies that impact trading partners’ relationships is negotiation strategy employed by each partner. These strategies assume even greater importance when these strategies have ethical content. This study examines the effects of marketing executives’ preferred ethical ideologies, opportunism and Machiavellianism on their perceived appropriateness of unethical negotiation tactics. Utilizing a sample of 995 marketing executives from six countries, cluster analysis and multivariate analysis (...) of variance revealed two types of marketing negotiators: principled and corrupt negotiators. Corrupt negotiators tend to be more Machiavellian, more relativist, more opportunistic and less idealistic than their principled counterparts. Principled negotiators tend to perceive unethical negotiation tactics less favorably than their corrupt counterparts. Implications of these results for practitioners and directions for future research are discussed. (shrink)

This study examined the relationship between urban culture and street vending. Prior research on this topic is limited and inconclusive. Therefore, we have proposed an integrated model to test the positive effect of urban culture on street vending using multiple mediations of consumption patterns, resistance, and microfinance. We tested a sample of 425 responses that reflect the public opinion in Baghdad, Iraq. These responses were collected between September and November 2018. A partial least squares–based structural equation modeling is employed to (...) test the validity of measurement models and the significance of the entire structural model, predictive power, and mediation analysis. We found that resistance mediates the effect of urban culture on street vending; low-income consumption and resistance sequentially mediate the effect of urban culture on street vending, while resistance mediates the effect of a lack of microfinance on street vending. The direct impact of culture on street vending is not significant, and a lack of microfinance positively influences the pervasiveness of trading on streets. This study contributes to the extant literature as it proposed and tested a novel and comprehensive model to analyze the relationship between urban culture and street vending, simultaneously examining the effects of culture, consumption, resistance, and microfinance on street vending. BackgroundA different ethos with respect to the perception of medical ethics prevails in societies in transition such as those in the Arabian Peninsula, which makes it difficult to apply international principles of bioethics in medical practice. This study aimed to develop and psychometrically test an instrument that measures physicians’ awareness of bioethics and medical law and their attitudes towards the practice of medical ethics. Additionally, it examined physician correlates influencing the awareness of bioethics.MethodsFollowing a rigorous review of relevant literature by (...) a panel of experts, a 13-item instrument, the Omani physicians’ bioethics and medical law awareness (OBMLA) questionnaire was developed with the aim of assessing physicians’ awareness of bioethics and medical law. The study tool’s construct validity and internal consistency reliability were examined by exploratory factor analysis (EFA) and Cronbach’s alpha. In a cross-sectional study, the questionnaire was distributed among a random sample of 200 physicians at a tertiary hospital in Muscat, Oman. Participant characteristics that may influence awareness of bioethics and medical law were explored.ResultsThe EFA of the OBMLA questionnaire resulted in three well-loading factors: (1) Physicians’ bioethics practice subscale (2) incentive related bioethics subscale and (3) medical law awareness subscale. Internal consistency reliability ranged between Cronbach’s α: 0.73–0.8. Of the total 200 participants, 52% reported that teaching medical ethics during medical school was inadequate. The overall mean (standard deviation, SD) of the bioethics awareness score and Omani medical law awareness were 27.6 (3.5) and 10.1 (2.1) respectively. The majority of physicians (73%) reported that they frequently encountered ethical dilemmas in their practice and 24.5% endorsed the view that unethical decisions tended to occur in their practice.ConclusionThe study provides an insight into the practice of bioethics, and the awareness of bioethics and medical law among physicians in a teaching hospital in Oman. The OBMLA questionnaire appears to be a valid and reliable tool to assess a physician’s awareness of bioethics and medical law. In this preliminary study, it appears that participants have suboptimal scores on the indices which measure practice and awareness of bioethics and medical law. (shrink)

In Islam, the acquisition of knowledge is a form of worship. But human achievement must be exercised in conformity with God's will. Warnings against feelings of superiority often are coupled with the command to remain within the confines of God's laws and limits. Because of the fear of arrogance and disregard of the balance created by God, any new knowledge or discovery must be applied with careful consideration to maintaining balance in the creation. Knowledge must be applied to ascertain equity (...) and justice for all of humanity. Research in Islam must be linked to the broad ethical base set forth in the Qur'an and the Sunnah. Whether embryonic stem cell research or cloning is ethically acceptable in Islam depends on the benefits derived from such applications. What is most important for the scholars is to adhere to the concepts of compassion, mercy, and benefit to everyone. (shrink)

Authors endure considerable hardship carrying out biomedical research, from generating ideas to completing their manuscripts and submitting their findings and data to a journal. When researchers submit to journals, they entrust their findings and ideas to editors and peer reviewers who are expected to respect the confidentiality of peer review. Inherent trust in peer review is built on the ethical conduct of authors, editors and reviewers, and on the respect of this confidentiality. If such confidentiality is breached by unethical reviewers (...) who might steal or plagiarize the authors’ ideas, researchers will lose trust in peer review and may resist submitting their findings to that journal. Science loses as a result, scientific and medical advances slow down, knowledge may become scarce, and it is unlikely that increasing bias in the literature will be detected or eliminated. In such a climate, society will ultimately be deprived from scientific and medical advances. Despite a rise in documented cases of abused peer review, there is still a relative lack of qualitative and quantitative studies on reviewer-related misconduct, most likely because evidence is difficult to come by. Our paper presents an assessment of editors’ and reviewers’ responsibilities in preserving the confidentiality of manuscripts during the peer review process, in response to a 2016 case of intellectual property theft by a reviewer. Our main objectives are to propose additional measures that would offer protection of authors’ intellectual ideas from predatory reviewers, and increase researchers’ awareness of the responsible reviewing of journal articles and reporting of biomedical research. The development of the Minimalist Program, Noam Chomsky's most recent generative model of linguistics, has been highly influential over the last twenty years. It has had significant implications not only for the conduct of linguistic analysis itself, but also for our understanding of the status of linguistics as a science. The reflections and analyses in this book contain insights into the strengths and the weaknesses of the MP. Among these are, a clarification of the content of the Strong Minimalist Thesis (...) ; a synthesis of Chomsky's linguistic and interdisciplinary discourses; and an analysis of the notion of optimal computation from conceptual, empirical and philosophical perspectives. This book will encourage graduate students and researchers in linguistics to reflect on the foundations of their discipline, and the interdisciplinary nature of the topics explored will appeal to those studying biolinguistics, neurolinguistics, the philosophy of language and other related disciplines. Many question whether Islam and science can be compatible. In the first six hundred years of Islam, Muslims addressed all fields of knowledge available to them with unprecedented zeal and contributed immensely to the knowledge that became the precursor of the Renaissance in Europe. The Tatar invasion in the thirteenth century and the total destruction of Baghdad, the Muslim capital of knowledge and science, followed by the crusades, the ensuing hostility between East and West, and Western colonialism of Muslim countries (...) led to a distrust of all knowledge emanating from the West. Such distrust closed the doors to ijtihad, a dynamic method in Islamic jurisprudence for addressing change, new demands, and new acquired knowledge, even though the Qur'an challenges Muslims to think, contemplate, understand, comprehend, and examine everything around them—tasks that bring humankind closer to God as they find methods to apply God's laws of justice and equity to the benefit of all humankind. Islam is the religion of yusr (ease) and not ‘usr (hardship). The creation of the world was for human benefit and use. Innovation for such beneficial use and application is a must. (shrink)

Досягається це завдяки забезпеченню синхронізації психічних механізмів інтеріоризації та екстраполяції. Доводиться, що таке базове призначення релігійного резонансу позиціонується як головна функція, що реалізовується у процесі спрямування віруючої людини на добровільну зміну власної поведінки відповідно до вимог християнства. Це й сприяє забезпеченню коеволюційних процесів.

This article examines the nature and reproduction of ‘institutional idiocy’, seen as a form of collective cognitive incapacity generated by cultural conditions. It shows idiocy to be active in numerous paths, wearing different clothes and taking dissimilar forms, spreading to the extent that it dominates communities. An empirically driven framework is established for idiocy-dominated communities – communities with access to futile education and fruitless technology. It demonstrates how idiocy-dominated communities disguise and protect their shared idiocy and handle non-idiotic minorities. It (...) explains that idiocy-intense communities are not necessarily chaotic and arbitrarily organised, entailing ‘formulas of life’, ‘identity politics’ and ‘schools of thought’. It describes that a whole community can thoroughly adapt to life without critical thinking, living in an illusion. Whereas previous works have scrutinised individual idiocy, this research goes beyond this to inspect institutional idiocy by presenting idiocy as a system (and ‘ideology’) that constitutes the foundation of groups. While such notions as technocracy and epistocracy detail the domination of cognitive maturity, this article goes in another direction by recording the domination of cognitive immaturity (idiocracy). It avoids thinking about idiocy binarily (idiocy versus intelligence), viewing it as a question of not intellect but behaviour, culture and ‘being-with’. (shrink)
