In recent years, countries have begun to establish ministries of transitional justice as part of political transitions from authoritarianism to democracy or from conflict to peace. This may reflect a broader historical trend in the administration of TJ, which has evolved from isolated offices within a particular ministry to ad hoc cross-ministry coordinating bodies to the establishment of dedicated ministries. The reasons for the establishment of specific ministries to pursue TJ, what we call ministerialization, have not attracted scholarly attention. This (...) article explores the causes and likely consequences of this development. In particular, it applies international relations, comparative politics, and public policy theories to explain the phenomenon. Contrary to some TJ literature that is concerned about hegemonic transnational discourse, international actors have played little to no role in shaping how TJ is bureaucratically managed. Rather, based upon fieldwork in Solomon Islands and Tunisia, the article concludes that ministerialization has been the result of domestic policy entrepreneurship. For TJ ministries to become a norm, however, more transnational actors will need to be convinced of the benefits of such an institutional arrangement. (shrink)

Inspired by a mathematical ecology of thearre (M. Dinu) and the eco-grammar systems (E. Csuhaj-Varju et al.), this paper gives a brief analysis of simple cellular automata games in order to demonstrate their primary semiotic features. In particular, the behaviour of configurations in Conway's game of life is compared to several general features of Uexküll's concept of Umwelt. It is concluded that ecological processes have a fundamental semiotic dimension.

Epistemic diversity is widely approved of by social epistemologists. This paper asks, more specifi cally, how much epistemic diversity, and what kinds of epistemic diversity are normatively appropriate? Both laissez-faire and highly directive approaches to epistemic diversity are rejected in favor of the claim that diversity is a blunt epistemic tool. There are typically a number of diff erent options for adequate diversifi cation. The paper focuses on scientifi c domains, with particular attention to recent theories of smell.

: Fate and fatalism have been powerful notions in many societies, from Homer's Iliad, the Greek moira, the South Asian karma, and the Chinese ming in the ancient world to the modern concept of "destiny." But fate and fatalism are now treated with philosophical disdain or as a clearly inferior version of what is better considered as "determinism." The concepts of fate and fatalism are defended here, and fatalism is clearly distinguished from determinism. Prompted by a 2019 essay by Jonathan Moreno in the Hastings Center Report, the Center's board of directors undertook a careful examination of the name of its preeiminent award, the Henry Knowles Beecher Award, which has been given to twenty‐nine individuals who have made lifetime contributions to bioethics. citing new research that revealed that Beecher's earlier experimentation on drugs had involved nonconsenting adults, Moreno urged the Center to reevaluate honoring Beecher through this award. After reviewing the relevant published evidence and (...) holding extensive discussions, the board decided to rename the award. We also took the opportunity to reframe the award to emphasize quality of scholarship and impact on thinking, practice, and policy rather than lifetime achievement. The new name—the Founders’ Award of The Hastings Center—reflects our desire to honor not only the Center's cofounders, Daniel Callahan and Willard Gaylin, but also others who helped found the field of bioethics. With great pride, the Center has announced that Patricia King of the Georgetown University Law Center is the 2021 recipient of the Founders’ Award. Albert Camus and Jean-Paul Sartre were the giants of 20th-century “existentialism”, although neither of them was comfortable with that title. Their famous differences aside, they shared a “phenomenological” sensibility and described personal experience in exquisite and excruciating detail and reflected on the meaning of this experience with both sensitivity and insight. That is the focus of this book: Camus and Sartre, their descriptions of personal experience, and their reflections on the meaning of this experience. They also reflected, worriedly, on the (...) nature of reflection. The thematic problem of the book is the relationship between experience and reflection. In Daubert v. Merrell Dow Pharmaceuticals, Inc., the U.S. Supreme Court made its first major pronouncement on the evaluation of scientific evidence, calling on judges to act as gatekeepers for scientific knowledge and validity, despite lack of scientific training among judges. Daubert offers the science studies community a case study for examining how judges engage in boundary-work and construct scientific validity. In constructing scientific validity under Daubert, judges must evaluate the scientific method behind a particular scientific claim, and will look (...) to the parties' experts and the relevant scientific community for assistance. To combat the oft-cited problem of the battle of the experts, judges may be tempted to obtain assistance from court-appointed neutral experts, an inquisitorial system in the civil law tradition of many European countries. The judicial evaluation of scientific evidence, the resulting construction of scientific validity, and the push for a greater use of court-appointed experts reveal judges' desire to segregate "objective" scientific facts from aspects of the legal process that are infused with adversaries' values. Yet the scientific and judicial construction of validity mixes empirical results and research methods with the personal, political, and institutional values of judges and scientists. (shrink)

What clearly emerges from Hegel's writings is that "Geist" refers to some sort of general consciousness, a single "mind" common to all men. The entire sweep of the Phenomenology of Spirit is away from the "disharmonious" conceptions of men as individuals to the "absolute" conception of all men as one. In the Phenomenology, we are first concerned with the inadequacy of conceptions of oneself as an individual in opposition to others and in opposition to God. This opposition is first resolved (...) in ethics, in the conception of oneself as a member of a family, of a community, of Kant's "Kingdom of Ends," as a citizen of the state, and then in religion, in which one conceives of oneself as "part" of God and a religious community. Absolute consciousness is the explicit recognition of one's identity as universal Spirit. The concept of "Geist" is the hallmark of a theory of self identity--a theory in which I am something other than a person. (shrink)

This article considers the reception of British cytogeneticist C.D. Darlington's controversial 1932 book, Recent Advances in Cytology. Darlington's cytogenetic work, and the manner in which he made it relevant to evolutionary biology, marked an abrupt shift in the status and role of cytology in the life sciences. By focusing on Darlington's scientific method -- a stark departure from anti-theoretical, empirical reasoning to a theoretical and speculative approach based on deduction from genetic first principles -- the article characterises the relationships defining (...) the "disciplinary landscape" of the life sciences of the time, namely those between cytology, genetics, and evolutionary theory. Two papers in this issue address the limits of surrogates’ authority when making life-and-death decisions for dying family members or friends. Using palliative sedation as an example, Jeffrey Berger offers a conceptual argument for bounding surrogate authority. Since freedom from pain is an essential interest, when imminently dying, cognitively incapacitated patients are in duress and their symptoms are not manageable in any other way, clinicians should be free to offer palliative sedation without surrogate consent, although assent should be sought and (...) every effort made to work with surrogates as harmoniously as possible. Ellen Robinson and her colleagues report on the implementation of a policy at Massachusetts General Hospital that supports do-not-resuscitate orders when cardiopulmonary resuscitation is likely to be ineffective or harmful, even if surrogates disagree. The “Doing No Harm” policy at MGH allows for what MGH calls a “medically indicated DNR” and what in some other places is called “a unilateral DNR”—the writing of an order not to provide cardiopulmonary resuscitation, regardless of surrogate disapproval. These kinds of DNR policies have emerged in some hospitals across the country and for much the same reason that Berger provides in his argument regarding palliative sedation. I support the reasoning and the policies in both the Berger and Robinson papers. However, as the authors would most likely agree, the problems they aim to remedy are not simply about the scope of surrogate and professional authority. They are also symptoms of inattention to professional obligations and system failures. (shrink)

The fundamental question in reverse mathematics is to determine which set existence axioms are required to prove particular theorems of mathematics. In addition to being interesting in their own right, answers to this question have consequences in both effective mathematics and the foundations of mathematics. Before discussing these consequences, we need to be more specific about the motivating question.Reverse mathematics is useful for studying theorems of either countable or essentially countable mathematics. Essentially countable mathematics is a vague term that is (...) best explained by an example. Complete separable metric spaces are essentially countable because, although the spaces may be uncountable, they can be understood in terms of a countable basis. Simpson gives the following list of areas which can be analyzed by reverse mathematics: number theory, geometry, calculus, differential equations, real and complex analysis, combinatorics, countable algebra, separable Banach spaces, computability theory, and the topology of complete separable metric spaces. Reverse mathematics is less suited to theorems of abstract functional analysis, abstract set theory, universal algebra, or general topology.Section 2 introduces the major subsystems of second order arithmetic used in reverse mathematics: RCA0, WKL0, ACA0, ATR0 and – CA0. Sections 3 through 7 consider various theorems of ordered group theory from the perspective of reverse mathematics. Among the results considered are theorems on ordered quotient groups, groups and semigroup conditions which imply orderability, the orderability of free groups, Hölder's Theorem, Mal'tsev's classification of the order types of countable ordered groups. Give style to your character, a great and rare art.Nietzsche Gay Science What are we to make of Nietzsche? There has been an explosion of scholarship over the past twenty years, much of it revealing and insightful, a good deal of it controversial if not polemical. The controversy and polemics are for the most part straight from Nietzsche, of course, and the scholarly disputes over what he ‘really’ meant are rather innocuous and often academic compared with what Nietzsche meant with (...) his conscientiously inflammatory rhetoric and hyperbole. We have been treated to extended debates about Nietzsche's politics, his attacks on Christianity and morality, his famed notion of the übermensch and his less lampooned doctrine of the ‘eternal recurrence’. We have recently heard Nietzsche reinterpreted as an analytic philosopher, as a deconstructionist, as a feminist, even as a closet Christian and a liberal. Stephen Aschheim suggests in his recent book that Nietzsche provides us with something like a Rorschach test, inviting readers with amazingly different commitments and ideologies to ‘make their own Nietzsche’. But there is another approach to Nietzsche, something quite different from interpreting him in terms of his various ‘theses’ and positions, unpacking his ‘system’ or repeating unhelpfully that he displayed no such coherence and consistency, something more than finding out ‘who’ Nietzsche is as opposed to what we have made out of him. The simplest way of getting at this alternative approach might be to ask, what Nietzsche would make of us? I grant that this is a bit cryptic, and it invites a variety of unflattering answers. But I think it is very much in the spirit of what he are all about. It is an intimately personal approach to Nietzsche, an approach that will, no doubt, be somewhat different for each and every one of us. But that, too, of course, is just what Nietzsche would have demanded. (shrink)

Because the idea of consensus in contemporary philosophy of science is typically seen as the locus of progress, rationality, and, often, truth, Mill’s views on the undesirability of consensus have been largely dismissed. The historical data, however, shows that there are many examples of scientific progress without consensus, thus refuting the notion that consensus in science has any special epistemic status for rationality, scientific progress (success), or truth. What needs to be developed instead is an epistemology of dissent. I suggest (...) that normative accounts of dissent be used as prototypes for theories of scientific rationality that can also be applied to episodes of consensus. Consensus in this case is to be treated as a special case of dissent, when the amount of dissent approaches zero. My main goal in this paper is to sketch how a normative account of dissent that aims to capture the idea of epistemic fairness can apply to situations of consensus. (shrink)
