One of the challenges of modern healthcare ethics practice is the navigation of boundaries. Practicing healthcare ethicists in the performance of their role must navigate meanings, choices, decisions and actions embedded in complex cultural and social relationships amongst diverse individuals. In light of the evolving state of modern healthcare ethics practice and the recent move toward professionalization via certification, understanding boundary navigation in healthcare ethics practice is critical. Because healthcare ethics is endowed with many boundaries which often delineate concerns about (...) professional expertise and authority, epistemological reflection on the relationship between theory and practice points toward the social context as relevant to the conceptualization of boundaries. The skills of social scientists may prove helpful to provide data and insights into the conceptualization and navigation of clinical ethics qua profession. Empirical ethics research, which combines empirical description (usually social scientific) with normative-ethical analysis and reflection, is a way forward as we engage and reflect upon issues which have implications for practice standards and professionalization of the role. This requires cooperative engagement of the descriptive and normative disciplines to explore our understandings of boundaries in healthcare ethics practice. This will contribute to the ongoing reflection not only as we envision the professional role but to ensure that it is enacted in practice. (shrink)

The Benefit Corporation is the fastest-growing of these new forms. Benefit Corporations are for-profit, but allow the firm to declare a “social purpose/benefit” in its articles of incorporation and permit the firm to pursue the benefit in tandem with increasing shareholder value. This paper first attempts to evaluate how effectively states have implemented this legislation. This paper extrapolates potential problems (...) in the irregularities of visibility and record-keeping across the various states through the analysis of data accessibility and legislative differences. Irregularities in the public rollout of this legislation affect the transparency of Benefit Corporations and, as a result, the ability for stakeholders to hold the firm accountable. Complicating these issues is the fact that Benefit Corporation advocacy is largely centralized in a few third party organizations. This paper examines some of the downfalls of such conflated public/private involvement in implementing successful innovative business structures. (shrink)

This past summer, I was having lunch in Toronto with Dr. Raymond Macken, general editor of the critical edition of the Opera Omnia of Henry of Ghent, and author of the Preface to this excellent translation of several important quodlibetal questions of Henry on a topic that has long proved itself fraught with difficulties for scholars of Henry's thought. Macken held this very work in his hand and said, "English is the new Latin. We must provide more and more (...) translations of Henry's work for students of his ideas." In spite of a veritable renaissance in Latin studies, in the United States in particular, the remark seems as justified as it is melancholic. (shrink)

Scepticism about ought simpliciter is the view that there is no such thing as what one ought simpliciter to do. Instead, practical deliberation is governed by a plurality of normative standpoints, each authoritative from their own perspective but none authoritative simpliciter. This paper aims to resist such scepticism. After setting out the challenge in general terms, I argue that scepticism can be resisted by rejecting a key assumption in the sceptic’s argument. This is the assumption that standpoint-relative ought judgments bring (...) with them a commitment to act in accordance with those judgments. Instead, I propose an alternative account of our normative concepts according to which only ought simpliciter judgments commit one to acting in accordance with those judgments. In addition to answering the sceptical challenge, the proposal offers an independently motivated account of what makes a concept normatively authoritative. (shrink)

The recent philosophy of Quantum Bayesianism, or QBism, represents an attempt to solve the traditional puzzles in the foundations of quantum theory by denying the objective reality of the quantum state. Einstein had hoped to remove the spectre of nonlocality in the theory by also assigning an epistemic status to the quantum state, but his version of this doctrine was recently proved to be inconsistent with the predictions of quantum mechanics. In this essay, I present plausibility arguments, old and new, (...) for the reality of the quantum state, and expose what I think are weaknesses in QBism as a philosophy of science. (shrink)

We invoke the ideal of tolerance in response to conflict, but what does it mean to answer conflict with a call for tolerance? Is tolerance a way of resolving conflicts or a means of sustaining them? Does it transform conflicts into productive tensions, or does it perpetuate underlying power relations? To what extent does tolerance hide its involvement with power and act as a form of depoliticization? Wendy Brown and Rainer Forst debate the uses and misuses of tolerance, an (...) exchange that highlights the fundamental differences in their critical practice despite a number of political similarities. Both scholars address the normative premises, limits, and political implications of various conceptions of tolerance. Brown offers a genealogical critique of contemporary discourses on tolerance in Western liberal societies, focusing on their inherent ties to colonialism and imperialism, and Forst reconstructs an intellectual history of tolerance that attempts to redeem its political virtue in democratic societies. Brown and Forst work from different perspectives and traditions, yet they each remain wary of the subjection and abnegation embodied in toleration discourses, among other issues. This paper examines the general prospects for conceptual role expressivism, expressivist theories that embrace conceptual role semantics. It has two main aims. The first aim is to provide a general characterisation of the view. The second aim is to raise a challenge for the general view. The challenge is to explain why normative concepts are not a species of defective concepts, where defective concepts are those that cannot meaningfully embed and participate in genuine inference. After rejecting existing attempts to answer (...) the challenge, I propose an alternative solution. However, the solution leaves conceptual role expressivism a far less distinctive and interesting position than its proponents claim. I conclude that we should be sceptical about how much expressivists gain by appealing to conceptual role semantics. (shrink)

Whereas the so-called democratization of healthcare due to health wearables and increased access to medical information might suggest a (...) positive shift in the patient-physician relationship, the physician’s ‘need to care’ might be irreplaceable, and robot healthcare workers might be seen as contributing to dehumanized healthcare practices. Background and aims: Recent investigations have highlighted the value of neuropsychological testing for the assessment and screening of Alcohol-Related Brain Damage. The aim of the present study was to evaluate the suitability of the Addenbrooke’s Cognitive Examination and the Repeatable Battery for the Assessment of Neuropsychological Status for this purpose. Methods: Comparing 28 participants with ARBD and 30 alcohol-dependent participants without ARBD we calculated Area Under the Curve statistics, sensitivity and specificity values, base-rate adjusted predictive values, and likelihood ratios for (...) both tests. Results: High levels of screening accuracy were found for the total scores of both the ACE-III and RBANS at multiple cut-off points. Removing participants with a history of polysubstance from the samples improved the diagnostic capabilities of the RBANS substantially, while only minor improvements to the ACE-III’s accuracy were observed. Conclusions: Overall, both the ACE-III and RBANS are suitable tools for ARBD screening within an alcohol-dependent population, though the RBANS is the superior of the two. Clinicians using these tools for ARBD screening should be cautious of false-positive outcomes and should therefore combine them with other assessment methods and more detailed neuropsychological testing before reaching diagnostic decisions. The purpose of this article is to outline a Kantian form of cosmopolitan law and the jurisprudence involved in the creation of a cosmopolitan constitution. This article explores and discusses Kantian cosmopolitan law, the idea of cosmopolitan right, the laws of hospitality and a Kantian approach to constitutional cosmopolitanism. In doing so, the article argues beyond Kant's discussion of constitutionalism, suggesting that a written constitution not only articulates many of Kant's cosmopolitan concerns, but also provides a reasonable ethical foundation for (...) an international society. Throughout this discussion, more particular aspects of Kant's legal conception of cosmopolitanism are examined, focusing on the possibility of an ethical cosmopolitan order based on jurisprudence, the necessity of a minimal consensus bound by constitutional provisions, and the corresponding legal obligations maintained by cosmopolitan law. Decision theory and folk psychology both purport to represent the same phenomena: our belief-like and desire- and preference-like states. They also purport to do the same work with these representations: explain and predict our actions. But they do so with different sets of concepts. There's much at stake in whether one of these two sets of concepts can be accounted for with the other. Without such an account, we'd have two competing representations and systems of prediction and explanation, a dubious (...) dualism. Folk psychology structures our daily lives and has proven fruitful in the study of mind and ethics, while decision theory is pervasive in various disciplines, including the quantitative social sciences, especially economics, and philosophy. My interest is in accounting for folk psychology with decision theory -- in particular, for believe and wanting, which decision theory omits. Many have attempted this task for belief. (The Lockean Thesis says that there is such an account.) I take up the parallel task for wanting, which has received far less attention. I propose necessary and sufficient conditions, stated in terms of decision theory, for when you're truly said to want; I give an analogue of the Lockean Thesis for wanting. My account is an alternative to orthodox accounts that link wanting to preference (e.g. Stalnaker (1984), Lewis (1986)), which I argue are false. I argue further that want ascriptions are context-sensitive. My account explains this context-sensitivity, makes sense of conflicting desires, and accommodates phenomena that motivate traditional theses on which 'want' has multiple senses (e.g. all-things-considered vs. pro tanto). The Abbé Sieyès is usually portrayed as a thoroughly modern thinker and a critic of the nostalgic Classical Republicanism of some of his contemporaries, in favour of a “modern republicanism”, founded upon the division of labour and commercial sociability in a nation composed of equal labourers and producers. But Sieyès’s unpublished manuscripts suggest he, in fact, regarded modern labourers as unskilled “Machines du Travail”, dulled by work and incapable of exercising the duties of citizenship, a critique grounded in a critical (...) account of commercial society as compared to the ideal republican polity. Where most scholars regard this as either a simple contradiction or a passing juvenile nostalgia, this paper argues that, influenced by Jean-Jacques Rousseau, Sieyès consistently sought to counteract the degrading effects of the inequalities generated by commercial society and the division of labour. It was on this basis that Sieyès sought to construct a new political system which would reconcile participatory politics with representative government, enabling all citizens to enjoy a life of Active Citizenship. Based on these insights, this paper reinterprets Sieyès’s political project as an attempt to reconcile the classical conception of citizenship with the demands of a commercial society. (shrink)

Plato argues that four political arts—politics, kingship, slaveholding, and household-management—are the same. His argument, which prompted Aristotle’s reply in Politics I, has been universally panned. The problem is that the argument clearly identifies household-management with slaveholding, and household-management with politics, but does not fully identify kingship with any of the others. I consider and reject three ways of saving the argument, and argue for a fourth. On my view, Plato assumes that politics is identical with kingship, just as he does (...) elsewhere, but he begs no questions because the point of his argument is to identify the public arts of politics and kingship with the private arts of household-management and slaveholding. He does this successfully by answering three reasons why one might distinguish the private from the public arts. His argument leaves room for Aristotle to propose other reasons. One of them—involving differences among men and women and slaves—is unfortunate, but another is more promising. The Aristotelian can assume that political expertise is a matter of know-how gathered by experience of the particular actions which differ in the public and private arts. But Plato might well be right to reject this, and to insist that the essential difference between the expert and non-expert—the dividing line between good and bad rule—is not in experience but in their grasp of their goals. According to the Desiderative Lockean Thesis, there are necessary and sufficient conditions, stated in the terms of decision theory, for when one is truly said to want. What one is truly said to want, it turns out, varies remarkably by context—and to an underappreciated degree. To explain this context-sensitivity—and closure properties of wanting—I advance a Desiderative Lockean view that is distinctive in having two context-sensitive parameters.

When thinking of Plato’s discussions of virtue, many dialogues come to mind, but, assuredly, the Phaedrus does not. The word ἀρετή is used only six times in the dialogue. Unlike other dialogues, the Phaedrus thematizes neither the general concept of virtue nor any of the particular virtues. Given the centrality of virtue to Plato’s ethics and politics, it is surprising to see little reference to virtue in a dialogue devoted to love and to rhetoric, topics that have deep ethical and (...) political significance. -/- I argue that the Phaedrus makes important contributions to our understanding of virtue in Plato despite the infrequency of references. First, the dialogue juxtaposes competing conceptions of virtue: the “urbane” (cf. 227d) capacity to make things conform to one’s happenstance desires, championed by Lysias, and the “manic” capacity to conform oneself to reality, championed by Socrates. After clarifying that enslavement to pleasure-lust is the underlying condition of soul for Lysianic virtue, Socrates reveals that the non-lover’s “virtue” is, in truth, virtue in name only. Rather, true virtue emerges only when the soul becomes harmoniously ordered under reason’s guidance, a condition which is achieved through the soul’s encounter with beauty. Second, in the process of articulating how true virtue comes to be in the soul, Socrates gives grounds for distinguishing it from “self-restraint” (ἐγκράτεια), a condition of soul whose outward aspect may be indistinguishable from that of virtue. While a soul in which reason does not take the reins may act from self-restraint, it does not yet act from virtue. Third, the dialogue gives us resources for seeing how other people, such as artful rhetoricians, can influence one’s cultivation of virtue. At first glance, Socrates’s claim that artful rhetoricians can “hand over” virtue (270b) seems incompatible with his claim that virtue is unteachable (cf. Meno 86d-99e). However, the dialogue offers some resources for seeing that the unteachability of virtue and the capacity for rhetoricians to “hand over” virtue are not, in fact, incompatible. From these three points, we will see that the Phaedrus offers an intellectualist account of virtue reminiscent of what we see in other dialogues. The intellectualist vision here, however, is one that includes a positive role for the subrational elements of the soul rather than one that excludes them from relevance or actively seeks to suppress them. Physical Relativity explores the nature of the distinction at the heart of Einstein's 1905 formulation of his special theory of relativity: that between kinematics and dynamics. Einstein himself became increasingly uncomfortable with this distinction, and with the limitations of what he called the 'principle theory' approach inspired by the logic of thermodynamics. A handful of physicists and philosophers have over the last century likewise expressed doubts about Einstein's treatment of the relativistic behaviour of rigid bodies and clocks in motion in (...) the kinematical part of his great paper, and suggested that the dynamical understanding of length contraction and time dilation intimated by the immediate precursors of Einstein is more fundamental. Harvey Brown both examines and extends these arguments, after giving a careful analysis of key features of the pre-history of relativity theory. He argues furthermore that the geometrization of the theory by Minkowski in 1908 brought illumination, but not a causal explanation of relativistic effects. Finally, Brown tries to show that the dynamical interpretation of special relativity defended in the book is consistent with the role this theory must play as a limiting case of Einstein's 1915 theory of gravity: the general theory of relativity.Appearing in the centennial year of Einstein's celebrated paper on special relativity, Physical Relativity is an unusual, critical examination of the way Einstein formulated his theory. It also examines in detail certain specific historical and conceptual issues that have long given rise to debate in both special and general relativity theory, such as the conventionality of simultaneity, the principle of general covariance, and the consistency or otherwise of the special theory with quantum mechanics. Interpretation, Constraint, and the Prospects of Scientific Realism I explore the interaction between theory-based interpretations of scientific evidence and constraints on theories provided by that evidence. Interpretation is often viewed as a source of error and a reason for scepticism about scientific results. But, I argue, while interpretation does generate epistemic risk, it also points to new sources of evidence that can constrain our theories. This is especially clear in the development of instrumentation that increases the range of our interactions (...) with nature. While the design of such instruments and the interpretation of their outputs are deeply dependent on theory-based interpretations, these outputs can still challenge those very theories. At the same time, theory-guided instrumentation provides us access to aspects of nature that we cannot study with our unaided senses. This access allows us to extend the range of evidence that we collect, and thus increases the constraints on our theories. As a result, theory-guided evidence collection has a positive impact on the prospects of scientific realism since these increasing constraints on our theories provide our only reason for thinking that we may be approaching the development of true theories. Murdoch was a prolific and dynamic thinker, who held expertise and interest in a number of areas including philosophy, politics, morality, art and literature. Her philosophical writings, novels and letters are of significance in conveying her thought on a variety of subjects. The various essays that compose this volume are seen as responding to the breadth of Murdoch’s thinking and also as dealing with the paradoxes that arise out of her concern (...) to trace connections between distinct aspects of experience. The essays of the volume are described and shown to fit together. This paper examines the debate that has arisen in connection with J. L. Schellenberg's work on divine hiddenness. It singles out as especially deserving of attention Paul Moser's proposal that the debate distinguish more clearly between classical theism and Hebraic theisms. This worthwhile proposal, I argue, will be unlikely to exert its full potential influence upon the debate unless certain features of Christian incarnation belief are recognized and addressed in connection with it.

Research suggests that the explicit reasoning we offer to ourselves and to others is often rationalization, that we act instead on instincts, inclinations, stereotypes, emotions, neurobiology, habits, reactions, evolutionary pressures, unexamined principles, or justifications other than the ones we think we’re acting on, then we tell a post hoc story to justify our actions. This is troubling for views of moral progress according to which moral progress proceeds from our engagement with our own and others’ reasons. I consider an account (...) of rationalization, based on Robert Audi’s, to make clear that rationalization, unlike simple lying, can be sincere. Because it can be sincere, and because we also have a desire to be consistent with ourselves, I argue that rationalization sets us up for becoming better people over time, and that a similar case can be made to explain how moral progress among groups of people can proceed via rationalization. Jean-François Lyotard is generally acknowledged as the theoretical spokesperson for postmodernism. In 1979, his seminal work _The Postmodern Condition_ challenged the presumption and orientation of modern political philosophy. In particular, Lyotard repudiated the notion of grand narratives and promoted a postmodern acceptance of difference and variety and a skepticism towards unifying metatheories. Yet _The Postmodern Condition_ is just one work by a prolific author whose life and work involved close theoretical engagement with Kant, Hegel and Marx and who played a (...) prominent role in the events in Paris of May 1968. This study combines a careful reading of Lyotard's texts with a critical review of his theoretical ploys to demonstrate the incapacity of theory. Lyotard's variety of styles, ranging from the incandescent _Libidinal Economy_ to the economical lucidity of _The Differend_, are recognized as posing questions for those who defend the rationality of the _status quo_ and for those who undertake general critiques of society. In this book, Gary Browning takes issue with Lyotard's approach to Hegel and Marx and his generalized notion of social development as proceeding according to a one-dimensional, instrumentalist logic. Nevertheless, Lyotard is shown to be a disturbing theorist who challenged the assumptions of classic theorists of modernity as well as opposing mainstream attitudes prevalent in contemporary political theory.
