The aim of this paper is to re-evaluate the manner in which the Ticking Bomb Scenario (TBS), a thought experiment in philosophical enquiry, has been used in the discussion of the justifiability or otherwise of forward-looking interrogational torture (FLIT). The paper argues that criticisms commonly raised against the thought experiment are often inappropriate or irrelevant. A great many criticisms misunderstand the way in which thought experiments in general, and the TBS in particular, are supposed to work in philosophical (and for (...) that matter scientific) inquiry. The paper is not about the acceptability or otherwise of FLIT per se but rather an attempt to show that thought experiments such as the TBS are useful analytic tools and ought not to be rejected due to their inappropriate use by those engaged in the justifiability or otherwise of FLIT. By rescuing the TBS from its erroneous use the paper seeks to show its proper worth as part of an argumentative device in uncovering conflicting moral intuitions in our search for ethical truths. The utilization of alternative medical therapies and practitioners has increased dramatically in the U.S. in the last two to three decades. This trend seems paradoxical when one considers the rapid advances taking place in biomedical knowledge and technology during this same time period. Observers both inside and outside of the medical profession have attempted to explain the rising popularity of alternative medicine by proposing that it signals a growing sense of dissatisfaction and disenchantment with professional biomedical practices on the part (...) of the lay public. This paper challenges this thesis and offers an alternative explanation, arguing that the rise of alternative medicine is a consequence of the success and expanding influence of biomedicine rather than its failure and declining authority. The argument presented draws primarily on Ulrich Beck’s “risk society” perspective and theory of “reflexive modernization,” with specific attention to his analysis of the “reflexive scientization” process. The application of this perspective allows us to understand the emergence and development of alternative medicine as an unanticipated consequence of the process of reflexive biomedicalization in the late modern era. This chapter shows that science and quasi-science are already largely subject to various forms of "governance," including forms of self-governance. In science, as with other debating societies, governance characteristically begins with the problem of membership and the problem of regulating participation in discussion. The standard solutions to the problem of governance in the external sense recognize the inability of public discussion of the sort "demanded" by Beck to deal effectively with science. The history of particular forms of expertise, such (...) as the expertise of agricultural science, shows quite clearly that establishing credibility is difficult. When Leibig first introduced commercial chemical fertilizers with the backing of "science," the fertilizers had various unexpected and unintended side effects that harmed farmers—this was among the first of the science-made environmental disasters. The interesting thing about this process is the incredible difficulty and fragility of expertise. (shrink)

Increasing attention to existentialist thought by criminologists and other social scientists in recent decades has created an opportunity to envision new possibilities in critical theoretic inquiry that extend well beyond the classical formulations of this tradition. In this essay, I draw on existentialist ideas to outline a critical perspective rooted in recent developments associated with Ulrich Beck's notion of "risk society" and the related theory of reflexive modernization. I argue that, though the detraditionalization consequences of reflexive modernization give greater (...) scope to agency in the risk society, transcendence in the existentialist sense is found in the hermeneutic reflexivity one experiences in high risk practices I call "edgework". Finally, I explore several options for using existential transcendence in hermeneutic reflexivity as a reference for critical analysis and, in doing so, suggest an alternative to Beck's own critical approach—cosmopolitanism—as a foundation for a critical theory of the second modern social order. Transnational corporations have become actors with significant political power and authority which should entail responsibility and liability, specifically direct liability for complicity in human rights violations. Holding TNCs liable for human rights violations is complicated by the discontinuity between the fragmented legal/political structure of the TNC and its integrated strategic reality and the international state system which privileges sovereignty and non-intervention over the protection of individual rights. However, the post-Westphalian transition—the emergence of multiple authorities, increasing ambiguity of borders and jurisdiction (...) and blurring of the line between the public and private spheres—should facilitate imposing direct responsibility on transnational firms. Mechanisms for imposing direct responsibility on TNCs are considered including voluntary agreements and international law. However, I conclude that a hybrid public-private regime which relies on non-hierarchical compliance mechanisms is likely to be both more effective and consistent with the structure of the emerging transnational order. "Biophilia" is the term coined by Edward O. Wilson to describe what he believes is humanity's innate affinity for the natural world. In his landmark book Biophilia, he examined how our tendency to focus on life and lifelike processes might be a biologically based need, integral to our development as individuals and as a species. That idea has caught the imagination of diverse thinkers. The Biophilia Hypothesis brings together the views of some of the most creative scientists of our time, (...) each attempting to amplify and refine the concept of biophilia. The variety of perspectives -- psychological, biological, cultural, symbolic, and aesthetic -- frame the theoretical issues by presenting empirical evidence that supports or refutes the hypothesis. Numerous examples illustrate the idea that biophilia and its converse, biophobia, have a genetic component: fear, and even full-blown phobias of snakes and spiders are quick to develop with very little negative reinforcement, while more threatening modern artifacts -- knives, guns, automobiles -- rarely elicit such a response people find trees that are climbable and have a broad, umbrella-like canopy more attractive than trees without these characteristics people would rather look at water, green vegetation, or flowers than built structures of glass and concrete The biophilia hypothesis, if substantiated, provides a powerful argument for the conservation of biological diversity. More important, it implies serious consequences for our well-being as society becomes further estranged from the natural world. On a now orthodox view, humans and many other animals possess a “number sense,” or approximate number system, that represents number. Recently, this orthodox view has been subject to numerous critiques that question whether the ANS genuinely represents number. We distinguish three lines of critique – the arguments from congruency, confounds, and imprecision – and show that none succeed. We then provide positive reasons to think that the ANS genuinely represents numbers, and not just non-numerical confounds or exotic substitutes for (...) number, such as “numerosities” or “quanticals,” as critics propose. In so doing, we raise a neglected question: numbers of what kind? Proponents of the orthodox view have been remarkably coy on this issue. But this is unsatisfactory since the predictions of the orthodox view, including the situations in which the ANS is expected to succeed or fail, turn on the kind of number being represented. In response, we propose that the ANS represents not only natural numbers, but also non-natural rational numbers. It does not represent irrational numbers, however, and thereby fails to represent the real numbers more generally. This distances our proposal from existing conjectures, refines our understanding of the ANS, and paves the way for future research. (shrink)

The problem that Tallis attempts to address in Freedom: An Impossible Reality (2021) is that science appears to describe the entire world deterministically and that this seems to leave no room for free will. In the face of this threat, Tallis defends the existence of free will by arguing that science does not explain our intentional awareness of the world; and it is our intentional awareness that makes both science and free will possible. Against Tallis, it is here argued that (...) his argument is vulnerable to two criticisms. Firstly, his characterisation of science as apparently deterministic is inaccurate. Secondly, he has not solved the problem he has set himself but rather recast it, so that his conclusion leaves us having to account for free will, not in a deterministic universe, but either as a product of chance or as a miracle. It is here suggested that when we set aside the illusory threat of scientific determinism, we also set aside the temptation of free will (as its spurious answer). That done, we may better focus upon agent’s freedom of action – as discussed by philosophers such as Hobbes, Locke and Hume – the rational capability of an agent to act upon their wishes, given the constraints under which they find themselves. Making good decisions in extremely complex and difficult processes and situations has always been both a key task as well as a challenge in the clinic and has led to a large amount of clinical, legal and ethical routines, protocols and reflections in order to guarantee fair, participatory and up-to-date pathways for clinical decision-making. Nevertheless, the complexity of processes and physical phenomena, time as well as economic constraints and not least further endeavours as well as achievements in medicine and healthcare (...) continuously raise the need to evaluate and to improve clinical decision-making. This article scrutinises if and how clinical decision-making processes are challenged by the rise of so-called artificial intelligence-driven decision support systems (AI-DSS). In a first step, this article analyses how the rise of AI-DSS will affect and transform the modes of interaction between different agents in the clinic. In a second step, we point out how these changing modes of interaction also imply shifts in the conditions of trustworthiness, epistemic challenges regarding transparency, the underlying normative concepts of agency and its embedding into concrete contexts of deployment and, finally, the consequences for (possible) ascriptions of responsibility. Practice Then and Now "Practice theory" has a long history in philosophy, under various names, but current practice theory is a response to failures of projects of modernity or enlightenment which attempt to reduce science or politics to formulae. Heidegger, Oakeshott, and MacIntyre are each examples of philosophers who turned to practice conceptions. Foucault and Bourdieu made similar turns. Practice accounts come in different forms: some emphasize skill-like individual accomplishments, others emphasize the social character or presupposition-like character of the tacit (...) conditions of activities. The Social Theory of Practices problematized the idea of sameness, the idea that participants in an activity had the same tacit possessions, which undermined the idea that practices were collective objects in which individuals participated. Later critics, such as Schatzki and Rouse, emphasized the normative coherence and character of practice, which has a collective aspect. Pickering and others suggested a notion of practices that was de-mentalized and focused on the objects that were part of the practical activity, which provided for the continuity and sociality of practice without collectivizing its mental content. The discovery of mirror neurons suggested a non-collective mode of transmission of practices. The implications of these developments can be seen in connection with ethics, where the conflict between the ethical and the practical can be understood in terms of the intrinsic conflict between the need to behave successfully and our learned ethical intuitions. This article explores how the diversity of board resources and the number of women on boards affect firms' corporate social responsibility (CSR) ratings, and how, in turn, CSR influences corporate reputation. In addition, this article examines whether CSR ratings mediate the relationships among board resource diversity, gender composition, and corporate reputation. The OLS regression results using lagged data for independent and control variables were statistically significant for the gender composition hypotheses, but not for the resource diversitybased hypotheses.
