The Concept of Law is the most important and original work of legal philosophy written this century. First published in 1961, it is considered the masterpiece of H.L.A. Hart's enormous contribution to the study of jurisprudence and legal philosophy. Its elegant language and balanced arguments have sparked wide debate and unprecedented growth in the quantity and quality of scholarship in this area--much of it devoted to attacking or defending Hart's theories. Principal among Hart's critics is renowned lawyer (...) and political philosopher Ronald Dworkin who in the 1970s and 80s mounted a series of challenges to Hart's Concept of Law. It seemed that Hart let these challenges go unanswered until, after his death in 1992, his answer to Dworkin's criticism was discovered among his papers. In this valuable and long-awaited new edition Hart presents an Epilogue in which he answers Dworkin and some of his other most influential critics including Fuller and Finnis. Written with the same clarity and candor for which the first edition is famous, the Epilogue offers a sharper interpretation of Hart's own views, rebuffs the arguments of critics like Dworkin, and powerfully asserts that they have based their criticisms on a faulty understanding of Hart's work. Hart demonstrates that Dworkin's views are in fact strikingly similar to his own. In a final analysis, Hart's response leaves Dworkin's criticisms considerably weakened and his positions largely in question. Containing Hart's final and powerful response to Dworkin in addition to the revised text of the original Concept of Law, this thought-provoking and persuasively argued volume is essential reading for lawyers and philosophers throughout the world. This study is an unusual contribution to the philosophy of mind in that it argues for the sometimes unfashionable view of dualism: that mind and matter are distinct and separate entities as Descartes believed. The author takes as his point of departure the imaginative hypothesis of disembodiment, which establishes the possibility of the mind's being a quite non-material thing. There are clear casual correlations between what is physical and what is mental, and the most serious issue confronting dualism since Descartes (...) has been how such an interaction is possible. Dr Hart sets out to answer this question by showing that the issue is as much about the nature of causation as it is about the natures of mind and matter. (shrink)

This book is a collection of 18 essays portraying a "humanistic" outlook on several contemporary moral problems, and includes such essayists as Kurt Baier, Carl Rogers, B. F. Skinner, Sidney Hook, Abraham Edel, John Somerville, and Corliss Lamont. Although each was requested first to give his own definition of humanism and then to work out one application of it from his particular field or interest, these directions are not always strictly adhered to. Half of the essays had in fact, (...) already been published in some form in The Humanist. The 5 topical headings of the book show the diversity of fields and interests portrayed: Ethics, Religion and the Meaning of Life; The Good Life; The Individual: Law, Morality and Social Organization; Justice and Society; and Death. Although the essays are of unequal philosophical depth and acumen, this variety may be appealing for some uses of this as a text. However, two of the essays in particular stand out for this reviewer: "Ethics Without Religion" by Kai Nielsen, which perceptively outlines the problematic for as well as against an ethics not rooted in religion, and "The Enforcement of Morals" by Ernest Nagel which aptly analyzes the problem of the relation between the spheres of morality and law taking as a focus the noted Hart-Devlin debate of this issue. The thread which Kurtz believes unites all of these essays is their portrayal of a humanistic viewpoint, a viewpoint which he attempts to summarize in his own 14-page introduction, "What is Humanism?" But defining humanism is not an easy task. One must steer between a strictly negative view which defines it only in relation to what it opposes, and a broader but rather indefinite view of it as some form of man-centered philosophy. Although Kurtz wants to be positive in his own definition, he seems unable to move away from a negative and rhetorical presentation in which theism is simply stated to be incompatible with humanism. Moreover, his outline of a humanistic ethics is somewhat superficial. For example, he seems unaware of the problems involved in holding that ethical values are man’s own "creation" and at the same time are normative and objective. Nevertheless, the book may be of some help as a supplementary text to stimulate undergraduate students in discussion and study of the topics treated therein.—B.A.M. (shrink)

This article examines the history of Greek perceptions of Persian wisdom and argues that the presence of foreign wisdom practitioners in the history of Greek philosophy has been undervalued since Diogenes Laertius.

Introduction: IARPT’s Liberal HorizonThe concerns of the Institute of American Religious and Philosophical Thought are worlds apart from the preoccupations that animate the characters in Jane Austen’s novels. This is not to say that IARPT is disinterested in romance, love, and heartbreak. It is to say, rather, that Sense and Sensibility, the title of Austen’s 1811 novel, is (...) a good cover term for the matters that I wish to address. I say this despite the fact that many characters in the novel, especially Fanny Dashwood, are insufferable members of a British ruling class that, along with its wealth-hording, patriarchy-sustaining institution of primogeniture, needed to be expropriated by the working class. I say this despite the fact that the sensibility of the British aristocracy, as is true of all aristocracies, is off-putting. With this proviso, it is precisely the sense and sensibility of the Institute (the love, romance and, perhaps, tragedy) that I wish to survey through a focus on what I take to be its animating existential concerns. I call these orientations existential rather than merely intellectual because they go beyond ideas, professional commitments, and implicate the entire range of life dispositions. These orientations are habit-forming.Constitutive of these orientations are anxieties regarding the meaning and significance of those things for which we live and die. The sheer fact of consciousness, of conscious matter, of matter conscious of its consciousness and the wonder and awe this inspires as we consider the very existence of things is part of our existential ensemble too. For some of us wonder and awe before the groundless gratuity of existence, let’s call this ontological curiosity, compete with death anxiety and its intimations for preeminence in how we imagine the meaning and significance of our life. This is not a binary matter. For some people, perhaps for most, the joy of existence larded as it is with terrible things exceeds, as the case make be, the quiet desperation, sorrow, or terror, and the emptiness at the center of all things. My exploration focuses on the anxieties rather than the curiosity. I take it for granted that the deep source of anxiety is mortality and its various intimations. Our quest for lives of meaning and significance is threatened by the “horrid d’s”1 of death, disease, dread, despair, [End Page 5] and disappointment. Various thinkers have theorized how we cope with this anxiety. Some argue that denial is a dominant way of dealing with death, which they take to be foundational to the other meaning and significance-threatening phenomena.2 Where the answers to these threats provided by traditional religions are found lacking or otherwise no longer credible, denial expresses itself in the form of various immortality projects: typically, the puritanical, maniacal, and methodical pursuit of health and wealth, in consumerism of all kinds, from the hottest new diet, to a Peloton exercise bike, to a Tesla. And then there is the pursuit of fame and celebrity, which many people can no longer distinguish, the hope, captured so well in the theme song for the television series, Fame. “Fame / I’m going to live forever / Baby, remember my name.”3 We want to be remembered. Whether by future generations or, inside the digital clouds of Instagram or TikTok, or, as some would have it, within the consequent nature of God. Of course, for some populations, death is not so easily denied. Death has an in their face immediacy, insistence, and oppugnancy that rips through flesh and leaves its subject not merely anxious but dead. I speak, for example, of the mind-numbing repetitiveness with which police kill Black people. Or the myriad ways, including environmental racism, in which Blacks are subject to premature death. Some thinkers even theorize that death is the existential horizon for Black people in an ontologically distinctive way.4 Thus the March 2020 police-raid killing of Breonna Taylor in her home may be a statistical anomaly but is experienced as a monstrous revelation of the nature of things, of Black social life as social death. In his Exhortation to Philosophy (Protrepticus), the Neoplatonic philosopher Iamblichus famously preserves material culled from lost works of ancient philosophy, including dialogues of Aristotle. He also preserves a work entitled On Wisdom and ascribed to the Pythagorean philosopher Archytas of Tarentum, who was a friend and challenger of Plato. The text On Wisdom is a later Hellenistic production, probably written in the 1st century BCE, but it presents an important piece in the puzzle of reconstructing Pythagoreanism for the Hellenistic and (...) Post-Hellenistic periods. On Wisdom provides ps-Archytas' views on the nature, pursuit, and purposes of philosophy, as well as the division of the parts of knowledge. This article presents the first complete modern translation into English and analysis of this work, whilst also explaining the precise ways in which its first critic, Iamblichus, appropriates its content to Neoplatonic theories. This chapter traces Plato's philosophical responses to the puzzle of Epicharmus' “Growing Argument” in the earlier and middle dialogues of Plato, especially Euthyphro and Cratylus. Plato's approach to this problem is rooted in his metaphysical propositions, including the correlative assumptions of participation of sensibles in Forms and imitation as a vehicle for names to obtain the properties of their governing Forms. By attacking a Sophistical version of the “Growing Argument” given by Cratylus, Plato simultaneously appropriates certain principles of ontological predication (...) given by Philolaus of Croton, thus pitting, in effect, the ideas of one mathematical Pythagorean against those of another. This means that we cannot be satisfied with defining transnational activists through the ways they think. The defining feature of transnationalism in this book is relational, and not cognitive. This emphasis on activism's relational structure means that even as they make transnational claims, transnational activists draw on the resources, the networks, and the (...) opportunities in which they are embedded, and only then - if at all - on more distant transnational links. But we can no more sharply draw a line between domestic and international politics in studying transnational activism than we could ignore local politics in studying its national equivalent. Development projects in Sub-Saharan Africa propose to alleviate hunger in rural areas by introducing new agricultural practices and technologies, yet there is limited empirical evidence of how an agricultural intervention can lead farming households to transition to food security. Research on food security pathways considers agricultural interventions that increase farmers’ income to be particularly effective for reducing food insecurity. Consistent with this stance, Malawian agricultural policy aims to address hunger by encouraging smallholder farmers to intensify and commercialize maize production. This (...) paper explores if smallholders’ market and livelihood orientations do indeed lead them to favor an income pathway to food security. Qualitative analysis of 60 smallholder farmer interviews in Malawi found that, upon achieving improvements in production yields and diversity, rather than commercialize, many farmers re-organized their production and consumption to reduce market dependency. Farmers deployed this strategy to increase their food security, explaining that the choice to self-provision food and farming inputs was both an expression of farming identity and a lived understanding of their marginal position in commodity markets. The author finds that, in failing to consider how production relations affect food access, scholarship inadequately theorizes farm-level food security transitions and reproduces discursive framings of hunger. Food sovereignty narratives more accurately captured what mattered for Malawian smallholders’ food security, suggesting that engagement with this concept could improve scientific understandings of food security transitions. Algernon Sidney was among the most unrelenting partisans of the parliamentary party during the Commonwealth, and died on the scaffold in 1683 for his opposition to Charles II. Sidney's voluminous Discourses Concerning Government was published after his death, but the earlier and more vivid Court Maxims was only recently rediscovered in a manuscript in Warwick Castle. Its dialogue structure presents a lively discussion about the principles of government and the practice of politics, articulating a vital tradition of republicanism in an age of absolutism. By examining single-word reading times (in full sentences read for meaning), we show that (1) function words are accessed faster than content words, independent of perceptual characteristics; (2) previous failures to show this involved problems of frequency range and task used; and (3) these differences in lexical access are related to perceptual fluency. We relate these findings to issues in the literature on event-related potentials (ERPs) and neurolinguistics.
