Scholars increasingly point toward schools as meaningful contexts in which to provide psychosocial care for refugee children. Collaborative mental health care in school forms a particular practice of school-based mental health care provision. Developed in Canada and inspired by systemic intervention approaches, collaborative mental health care in schools involves the formation of an interdisciplinary care network, in which mental health care providers and school partners collaborate with each other and the refugee family in a joint assessment of child development and (...) mental health, as well as joint intervention planning and provision. It aims to move away from an individual perspective on refugee children’s development, toward an engagement with refugee families’ perspectives on their migration histories, cultural background and social condition in shaping assessment and intervention, as such fostering refugee empowerment, equality, and participation in the host society. Relating to the first stage of van Yperen’s four-stage model for establishing evidence-based youth care, this article aims to engage in an initial exploration of the effectiveness of a developing school-based collaborative mental health care practice in Leuven, Belgium. First, we propose a detailed description, co-developed through reflection on case documents, written process reflections, intervision, an initial identification of intervention themes, and articulating interconnections with scholarly literature on transcultural and systemic refugee trauma care. Second, we engage in an in-depth exploration of processes and working mechanisms, obtained through co-constructed clinical case analysis of case work collected through our practice in schools in Leuven, Belgium. Our descriptive analysis indicates the role of central processes that may operate as working mechanisms in school-based collaborative mental health care and points to how collaborative mental health care may mobilize the school and the family-school interaction as a vehicle of restoring safety and stability in the aftermath of cumulative traumatization. Our analysis furthermore forms an important starting point for reflections on future research opportunities, and central clinical dynamics touching upon power disparities and low-threshold access to mental health care for refugee families. Guiding the work of most linguists and philosophers of language today is the assumption that language is governed by rules. This volume presents a different way of viewing the partial regularities that language displays, the way they express norms and conventions. It argues that the central norms applying to language are non-evaluative; they are more like those norms of function and behavior that account for the survival and proliferation of biological species. Specific linguistic forms survive and are reproduced together with (...) cooperative hearer responses because some portion of the time these patterns of production and response benefit both speakers and hearers. What needs to be reproduced, however, for a given language to survive is not specific conceptual rules or inference patterns, but only satisfaction conditions concerning distal objects and properties, and essential elements of hearer response. Thus, the psychological processes that support the use of proper names, of words for kinds, properties and so forth, need to be examined anew, resulting in a fairly uncompromising rejection of conceptual analysis as a tool in philosophy. Further results concern the distinction between the propositional content and the force of a linguistic utterance and a new description of illocutionary acts. It turns out that neither the intentionality of thought nor the intentionality of language is derived from the other. Also, the processes involved in understanding language are best modeled as a form of direct perception of the world parallel, for example, to perception mediated by the natural signs contained in structured light, and results in a radically new description of how children learn language. In this innovative book, Gloria Frost reconstructs and analyses Aquinas's theories on efficient causation and causal powers, focusing specifically on natural causal powers and efficient causation in nature. Frost presents each element of Aquinas's theories one by one, comparing them with other theories, as well as examining the philosophical and interpretive ambiguities in Aquinas's thought and proposing fresh solutions to conceptual difficulties. Her discussion includes explanations of Aquinas's technical scholastic terminology in jargon-free prose, as well as background on medieval scientific (...) views - including ordinary language explanations of the medieval physical theories which Aquinas assumed in formulating his views on causation and causal powers. The resulting volume is a rich exploration of a central philosophical topic in medieval philosophy and beyond, and will be valuable especially for scholars and advanced students working on Aquinas and on medieval natural philosophy. Aim: Streamlining consent for low-risk comparative effectiveness research (CER) could facilitate research, while safeguarding patients' rights. Materials & methods: 2618 adults were randomized to one of seven consent approaches (six streamlined and one traditional) for a hypothetical, low-risk CER study. A survey measured understanding, voluntariness, and feelings of respect. Results: Participants in all arms had a high understanding of the trial and positive attitudes toward the consent interaction. Highest satisfaction was with a streamlined approach showing a video before the medical (...) appointment. Participants in streamlined were more likely to mistakenly think a signature was required. Conclusion: Streamlined consent was no less acceptable than traditional, signed consent. Streamlined and traditional approaches achieved similar levels of understanding, voluntariness and a feeling that the doctor–patient interaction was respectful. (shrink)

There is considerable confusion regarding the ethical appropriateness of using incentives in research with human subjects. Previous work on determining whether incentives are unethical considers them as a form of undue influence or coercive offer. We understand the ethical issue of undue influence as an issue, not of coercion, but of corruption of judgment. By doing so we find that, for the most part, the use of incentives to recruit and retain research subjects is innocuous. But there are some instances (...) where it is not. Specifically, incentives become problematic when conjoined with the following factors, singly or in combination with one another: where the subject is in a dependency relationship with the researcher, where the risks are particularly high, where the research is degrading, where the participant will only consent if the incentive is relatively large because the participant's aversion to the study is strong, and where the aversion is a principled one. The factors we have identified and the kinds of judgments they require differ substantially from those considered crucial in most previous discussions of the ethics of employing incentives in research with human subjects. In recent years, there has been a huge increase in the number of bots online, varying from Web crawlers for search engines, to chatbots for online customer service, spambots on social media, and content-editing bots in online collaboration communities. The online world has turned into an ecosystem of bots. However, our knowledge of how these automated agents are interacting with each other is rather poor. Bots are predictable automatons that do not have the capacity for emotions, meaning-making, creativity, and sociality (...) and it is hence natural to expect interactions between bots to be relatively predictable and uneventful. In this article, we analyze the interactions between bots that edit articles on Wikipedia. We track the extent to which bots undid each other’s edits over the period 2001–2010, model how pairs of bots interact over time, and identify different types of interaction trajectories. We find that, although Wikipedia bots are intended to support the encyclopedia, they often undo each other’s edits and these sterile “fights” may sometimes continue for years. Unlike humans on Wikipedia, bots’ interactions tend to occur over longer periods of time and to be more reciprocated. Yet, just like humans, bots in different cultural environments may behave differently. Our research suggests that even relatively “dumb” bots may give rise to complex interactions, and this carries important implications for Artificial Intelligence research. Understanding what affects bot-bot interactions is crucial for managing social media well, providing adequate cyber-security, and designing well functioning autonomous vehicles. (shrink)

It doesn't follow, however, that it is obvious on this view how these functions should be described individually. ### Marris Bill In June 2015, Labour Member of Parliament (MP) Rob Marris, who topped the ballot for private members’ bills, introduced the Assisted Dying (No. 2) Bill (‘the Marris Bill’) into the House of Commons. The Marris Bill was nearly identical to the Falconer Bill debated in the House of Lords early in the year (Eth 20, 2014–2015), and would permit competent, terminally ill adults with a clear and settled intention to end their life to receive physician assistance to (...) do so. Two doctors must be satisfied that the persons are terminally ill and are reasonably expected to die within 6 months, have the capacity (construed in accordance with the Mental Capacity Act 2005) and have a clear and settled intention to end their lives, which have been reached voluntarily, on an informed basis. The Marris Bill also included one of the amendments approved at Committee Stage of the Falconer Bill, which, in addition to the need for two doctors to be satisfied as to the eligibility criteria, would require all requests to be approved by a judge of the High Court (Family Division). Further to this, the Marris Bill included two new clauses: first, a requirement for High Court Judges to rule on requests within 14 days1 and, second, a requirement for any doctor with doubts about the capacity of a person requesting assistance to refer that person for assessment to ‘an appropriate specialist’.2 The Marris Bill received its second reading in the House of Commons on 11 September 2015, where it was overwhelmingly rejected by 330 votes to 118.3 A large number of those who opposed the Bill did so on the grounds that it had the potential to go beyond its limits and to pressurise the elderly and other vulnerable people, particularly those without family support, to consider …. A large literature has grown up around the proposed use of 'weak measurements' to allegedly provide information about hidden ontological features of quantum systems. This paper attempts to clarify the fact that 'weak measurements' are simply strong measurements on one member of an entangled pair, and that all such measurements thus effect complete disentanglement of the pair. The only thing 'weak' about them is that the correlation established via the entanglement does not correspond to eigenstates of the 'weakly measured observable' (...) for the component system that is subject to the weak measurement. It is observed that complete disentanglement always occurs, whether post-­‐selection is performed before or after the pointer detection. Assertions in the literature that weak measurements leave a system negligibly disturbed are therefore inaccurate, and claims based on those assertions need to be critically reassessed. (shrink)

There is growing interest in political phenomenology in the role that affectivity and emotions play in the political realm. Broadly speaking, it has been suggested that political emotions fall into two sub-categories: political emotions of allegiance and political emotions of antagonism. However, what makes an emotion one of allegiance or one of antagonism has yet to be explored. In this chapter, we show how work done on the phenomenology of emotions, the phenomenology of sociality, and critical phenomenology, can inform our (...) understanding of political emotions. Inspired by frameworks from each of these fields respectively, we introduce three ‘levels’ of phenomenological analysis with regards antagonistic political emotions: (i) the antagonistic character of the emotion, (ii) the antagonistic role in group dynamics, and (iii) a critical reflection on the very notion of antagonistic. Through this three-pronged phenomenological analysis we show how we can better understand, and critique, the conceptualisation of political emotions of antagonism and allegiance as well as show that whether an emotion is considered one of allegiance or antagonism depends on what level of analysis is employed. The Moral Limits of Law analyzes the related debates concerning the moral obligation to obey the law, conscientious citizenship, and state legitimacy. Modern societies are drawn in a tension between the centripetal pull of the local and the centrifugal stress of the global. Boundaries that once appeared permanent are now permeable: transnational legal, economic, and trade institutions increasingly erode the autonomy of states. Nonetheless transnational principles are still typically effected through state law. For law's subjects, this tension brings into focus (...) the interaction of legal and moral obligations and the legitimacy of state authority. This volume incorporates a comprehensive critical analysis of the methodology and substance of the debates in recent legal, political, and moral philosophy, regarding political obligation and the moral obligation to obey the law. The author argues that traditional accounts of political obligation that assume a bounded conception of the polity are no longer tenable. Higgins therefore presents an original theory of the conscientious agent's attitude towards law that accommodates the contemporary social tension between local and global obligations. (shrink)

In view of a resurgence of concern about the measurement problem, it is pointed out that the Relativistic Transactional Interpretation remedies issues previously considered as drawbacks or refutations of the original TI. Specifically, once one takes into account relativistic processes that are not representable at the non-relativistic level, absorption is quantitatively defined in unambiguous physical terms. RTI therefore provides a well-defined terminus to what appears to be a necessary infinite regress concerning ‘absorption’ when only the non-relativistic level is considered. In (...) addition, specifics of the relativistic transactional model demonstrate that the Maudlin ‘contingent absorber’ challenge to the original TI cannot even be mounted: basic features of established relativistic field theories dictate that the ‘slow-moving offer wave’ required for the challenge scenario cannot exist. It is concluded that issues previously considered obstacles for TI are no longer legitimately viewed as such, and that reconsideration of the transactional picture is warranted in connection with solving the measurement problem. In this paper I argue that Care theory has the resources to offer an insightful and original theoretical perspective on issues in medical ethics. The paper begins with a discussion of the sort of theory Care is, and argues that it closely resembles virtue theory. After a discussion of cammon features of Care theories, I respond to a few of the criticisme that have been levied against the theory. The final section of the paper is a discussion of the question (...) of neutrality in public moral discourse. Care theory is not a neutral theory with regard to questions of the nature of the good life for humans, but I argue that this should not preclude Care from playing a part in the public debate over policy decisions. Pervasive though it is in modern life, the concept of self‐esteem is often viewed with distrust. This paper departs from an idea that was recently aired by Richard Smith: that we might be better off without this concept. The meaning of self‐esteem is explored within four ‘homes’: the self‐help industry, social science, therapy and education. It is suggested that the first two use a ‘simple’ concept of self‐esteem that indeed we are better off without. This concept eliminates the distinction between (...) truthfulness and delusion, and relies on a chimera of quantifiability. The much richer concept of situated self‐esteem is explored, and it is argued that low self‐esteem in children should command the attention of educators. Teachers should address this through education and communication, and reject the idea of boosting self‐esteem through a content‐free curriculum. (shrink)

This is a comparison of graduate students attitudes in Spain and the United States on the issue of universal versus relativist ethics. The findings show agreement on fundamental universal values across cultures but differences in responses to behavioral ethics within the context of entrepreneurial dilemmas.

A realist, powers‐based metaphysics is very much on the table in contemporary metaphysics, and is beginning to take hold in philosophy of mind and philosophy of science. On this picture, causality is (roughly) a matter of the powers that things have to effect change(s) in other things. The realist view is at odds with every version of Humeanism, according to all of which causation is not, in the end, about the exercise of powers, but rather, in one way or another, (...) about regular sequences. The chapter has two parts. In the first part the chapter considers how it is that analytic philosophers of social science have been able thus far to side‐step the critique of Humeanism. In the second part, the chapter considers how analytic philosophy of social science might look different, were Humeanism no longer to be its tacit metaphysics. (shrink)

Increasingly in the modern world, incentives are becoming the tool we reach for when we wish to bring about change. In government, in education, in health care, between and within institutions of all sorts, incentives are offered to steer people's choices in certain directions. But despite the increasing interest in ethics and economics, the ethics of the use of incentives has raised very little concern. From a certain point of view, this is not surprising. When incentives are viewed from the (...) perspective of market economics, they appear to be entirely unproblematic. An incentive is an offer of something of value, sometimes with a cash equivalent and sometimes not, meant to influence the payoff structure of a utility calculation so as to alter a person's course of action. In other words, the person offering the incentive means to make one choice more attractive to the person responding to the incentive than any other alternative. Both parties stand to gain from the resulting choice. In effect, it is a form of trade, and as such, it meets certain ethical requirements by definition. A trade involves voluntary action by all parties concerned to bring about a result that is beneficial to all parties concerned. If these conditions were not met, the trade would simply not occur. And as inducements in a voluntary transaction, incentives certainly have the moral high ground over coercion as an alternative. (shrink)

It is generally acknowledged that much contemporary education takes place within a dominant audit culture, in which accountability becomes a powerful driver of educational practices. In this culture, both pupils and teachers risk being configured as a means to an assessment and target-driven end: pupils are schooled within a particular paradigm of education. The article discusses some ethical issues raised by such schooling, particularly the tensions arising for teachers, and by implication, teacher educators who prepare and support teachers for work (...) in situations where vocational aims and beliefs may be in conflict with instrumental aims. The article offers De Certeau's concept of la perruque to suggest an opening to playful engagement for human ends in education, as a way of contending with and managing the tensions generated. I use the concept to recover an idea of solidarity for teacher educators and teachers to enable ethical teaching in difficult times. (shrink)

Too much contemporary bioethical discourse is weak on science, lazily citing and adopting science fiction scenarios rather than science facts in the framing of analyses and policies. We challenge bioethicists to take more seriously the role of providing informed insight into and oversight over contemporary science and its implications and applications. Bioethicists must work harder to understand the fast-changing truths and limits of basic science, and they must incorporate only appropriate and authentic science into their discourse, just as they did (...) in the past when addressing the quandaries of clinical medicine. The field of bioethics is not so old and entrenched that its future is assured. Bioethicists must make themselves useful to society in order to deserve and retain the public's trust. They can best do this by ensuring that decision making and public policy are grounded in facts, not fictions and fantasies. (shrink)

This paper takes a sideways look at the controversial topic of educational assessment, raising the question: what place should the success/failure distinction have in an effective and humane educational system? Though the experience of failure may undermine the self-esteem that is conducive to learning, its possibility is clearly important educationally. Instead of asking whether teachers should be truthful about children’s achievements or dishonestly promote their self-esteem, we need to recognise a certain logical indeterminacy about what young children can do. Given (...) this, it is reasonable to presume in favour of many of their capacities rather than against them, for this is how children develop the confidence to act. This includes the confidence to fail as well as the confidence to succeed. It is argued that both are crucial for learning. (shrink)

It has been three years since we held the Feminism, Legality and Knowledge seminar to respond to our developing frustrations and excitement around feminist legal studies and academic publishing. In the wake of our 25th anniversary in 2018, we critically reflect further on our original intention to stock up on decolonising techniques to mix feminism, legality and knowledge whilst building on previous consideration of our self-proclaimed ‘international’ status. These reflections are prompted by editorial board members’ experiences as participants in the (...) Cardiff Law and Global Justice Centre’s British Academy-funded Global South Socio-Legal Writing Workshops in Accra, Nairobi and Recife in 2018. Following an explanation of the concerns with academic publishing that have prompted this reflection, we provide a narrative of our experiences in each of the three workshops exploring the lessons learned and their impact on our practice as editors and scholars in feminist legal studies. We finish with a renewal of our commitment to decolonise our minds and practices by continuing to struggle to earn the label ‘international’ for the journal now and in future. A brief introduction to the contents of this issue of FLS follows the reflection. (shrink)

Happiness is a large idea. It looms enticingly before us when we are young, delivers verdicts on our lives when we are old, and seems to inform a responsible engagement with children. The question is raised: do we want this idea? I explore a distinction between rich and poor conceptions of happiness, suggesting that many sceptical arguments are directed against the latter. If happiness is to receive its teleological due, recognised in rather the way Aristotle saw it, as a final (...) end that crucially lacks specificity, it must be richly conceived without denying the significance of unhappiness or despair. I suggest that Aristotle's Nicomachean Ethics is ‘completed’ in a distinctively Aristotelian sense by authors like George Eliot and Virginia Woolf. Substantial excerpts are discussed to show how ideas like ‘making others happy’ may be richly conceived. By treating literary examples (poetically articulated, sensually received) as ineliminable reference points in our thinking, we open up a new way of imagining relationships in education. We attend communally, conversationally and often argumentatively to the dramas of human life. This, I argue, is how we grapple with large ideas and bring about ethical learning. (shrink)

To explain how constitutions shape and are shaped by women's lives, the contributors to this volume examine constitutional cases pertaining to women in twelve countries. Analyzing jurisprudence about reproductive, sexual, familial, socio-economic, and democratic rights, they focus constructively on women's claims to equality, asking who makes these claims, what constitutional rights inform them, how they have evolved, what arguments work in defending them, and how they relate to other national issues. Their findings reveal significant similarities in outcomes and in reasoning (...) about women's constitutional rights in these twelve countries, challenging the tradition of distinguishing constitutional jurisprudence depending on whether the country has a written or unwritten constitution, subscribes to civil or common law, is a federal or unitary state, limits constitutional adjudication to the public domain, accords international norms binding or subject to incorporation force, or relies on a specialized or general court to adjudicate constitutional matters.
