This essay has two parts: 1) a negative or destructive one, which consists of showing that there is no anomaly, even apparent, in the concept of ‘truth’ (and ‘falsehood’), so that the available theories of truth are not justified, either to solve or react to this alleged problem; 2) a positive or constructive one, which consists of proposing a characterization of truth (and falsehood) based solely on the “objective aspect” of this concept. Here, I will associate the concept of ‘truth’ (...) with the concept of ‘existence’, taking them as two different species of a common genus. Along the way, I will critically analyze the theories of truth “available on the market” and argue that truth only has an “objective aspect”. (shrink)

RESUMO De acordo com a teoria das funções de verdade, a verdade/falsidade de uma proposição é computável a partir da verdade/falsidade das suas proposições “internas”: para cada proposição há uma função entre valores de verdade. Aplicada a proposições modais, origina a semântica dos mundos possíveis e, aplicada a proposições normativas, origina uma semântica que reduz os conceitos normativos aos conceitos modais, a semântica modal. Esta redução fica posta em questão com a existência dos chamados ‘paradoxos da lógica deôntica’. Estes não (...) podem ser vistos como meras anomalias, mas devem ser vistos como indícios da incorreção da semântica modal. Em todos eles, a regra da necessitação, assim como o axioma da distribuição, “não batem certo”. Não obstante, o cumprimento/incumprimento das normas já é computável a partir da verdade/falsidade das proposições que expressam os estados de coisas devidos. ABSTRACT According to the theory of truth-functions the truth/falsehood of a proposition is computable from the truth/falsehood of its “internal” propositions: for each proposition there is a function between truth values. Possible world semantics arises from the application of that theory to modal propositions; modal semantics - the reduction of normative concepts to modal concepts - arises from its application to normative propositions. But the ‘paradoxes of deontic logic’, as they are called, undermine such reduction: they cannot be seen as mere anomalies but instead as evidence for the wrongness of modal semantics. In all these paradoxes, the necessitation rule, as well as the distribution axiom, fail. Nevertheless, the fulfillment/nonfulfillment of norms is computable from the truth/falsehood of the propositions which express the required states of affairs. (shrink)

Os casos de fraqueza da vontade (incontinência) são tidos como paradoxais. Há, pelo menos, uma tensão entre tais casos e a lei psicológica que relaciona avaliações e volições: se julgamos que fazer x é melhor do que fazer y, então queremos fazer x; porém, por vezes, julgamos que fazer x é melhor do que fazer y e, ainda assim, queremos fazer y em vez de x. Como noutras propostas, defendo que a incompatibilidade é aparente. Porém, não rejeito que haja verdadeiros (...) casos de fraqueza da vontade. Proponho que, em tais casos, há uma cisão entre a força psicológica e o conteúdo axiológico das avaliações: o que o agente representa como mais valioso não é o que se encontra mais representado como valioso no agente e, portanto, aquilo que tem eficácia causal. Proponho, ainda, que o sistema volitivo desenvolveu um mecanismo de correção de tais anomalias, pelo qual o agente tem a capacidade de determinar volições de acordo com a avaliação do melhor. Regarding the selection of the legislative representatives, the elective system is the system that most democratic organizations have adopted. It has become so present nowadays that we take for granted the identification between elective system and representative democracy. But is this identification a correct one? I argue that it is not, since the meaning of 'representative democracy' has no reference to specific mode of selection of the representatives. And, since democracy and other methods of selection are compatible, it should adopted (...) the best one. The criteria of competence for the exercise of the political power ought to be the adopted method of selection, for it is the best one. I too argue that, in the context of division of labor into public and private labor, this is precisely what public representation aims: to leave to the experts the exercise of public labor. (shrink)

The title of the paper is an allusion to Philip K. Dick’s book Do Androids Dream of Electric Sheep? (which inspired the movie Blade Runner) and aims, at once, to highlight the (possible) relation between Criminal Law and Artificial Intelligence in its two dimensions of criminal protection (hence the reference to ‘electric crimes’) and criminal liability (hence the reference to the androids’ dreams), within the background problem of knowing whether Artificial Intelligence is truly mind. The purpose of this paper is, (...) precisely, to identify whether there is indeed such relation, in those two dimensions, and making use of a mediating concept, the concept of ‘mind (or ‘mentality’). I argue that Artificial Intelligence “specimens” do not have a mind and, therefore, its protection and regulation by Criminal Law is impaired. I conclude by presenting a choice between a total irrelevance model of Artificial Intelligence to Criminal Law and a model in which Artificial Intelligence emerges as object and subject of Criminal Law by analogy with persons. Porventura, o principal problema a enfrentar em Filosofia Normativa é aquele que designarei de ‘problema da compatibilidade’: as normas têm duas características essenciais, a necessidade e a violabilidade, que parecem ser incompatíveis. De acordo com a primeira das características intrínsecas das normas, se p é obrigatório, então p tem de ser verdadeira. De acordo com a segunda das características intrínsecas das normas, mesmo sendo p obrigatório, p pode não ser verdadeira. A capacidade para acomodar esta aparente natureza paradoxal das normas (...) constitui o teste derradeiro de verdade de uma tese em Filosofia Normativa. Defendo que só uma tese passa este teste: a semântica condicional, fortemente inspirada no que Husserl diz nas Investigações Lógicas. Esta tese rivaliza directamente com a semântica dos mundos ideais, surgida a par do desenvolvimento da Lógica Deôntica no século XX. Para a semântica dos mundos ideais, ‘p é obrigatório’ significa ‘p é uma verdade em todos os mundos possíveis que são os ideais’. Como o mundo atual não é um mundo ideal, fica explicado o facto de p poder não ser verdadeira no mundo atual, mesmo havendo necessidade. E se o mundo atual for um mundo ideal? Continua a não haver violabilidade: a verdade de ‘p é obrigatório’ no mundo atual garante a verdade de ‘p’ no mundo atual. Seguindo a semântica dos mundos ideais, as normas são invioláveis em todos os mundos ideais. Nesta dissertação, defendo que o termo ‘necessário’ é ambíguo e que, no contexto normativo, é usado de um modo particular: não designa o conceito modal de necessidade mas o conceito de indispensabilidade. Dizer que p é normativamente necessário é o mesmo que dizer que p é indispensável (para alguma coisa). Ora, é possível que ‘p’ seja indispensável e falsa simultaneamente. (shrink)

This book addresses the European Court of Human Rights’ fairness standards in criminal appeal, filling a gap in this less researched area of studies. Based on a fair trial immediacy requirement, the Court has found several violations of Article 6 of the European Convention on Human Rights at the appellate level by at least eighteen States of the Council of Europe in a vast array of cases, particularly in contexts of first instance acquittals overturning and of sentences increasing on appeal. (...) -/- On the one hand, the book critically engages this case-law with the law revisions it has recently inspired in European countries, as well as with the critiques and difficulties that it continues to raise. On the other hand, it interweaves insight from criminal procedure theory with new discoveries in the field of cognitive sciences (neuroscience of memory, philosophy of knowledge, AI), shedding an interdisciplinary light on the (in)adequacy and limits of the Strasbourg Court’s jurisprudence. In this paper I present a formalization of the theory of ideal concepts applied to the concept of God. It is done within a version of the Simplest Quantified Modal Logic (SQML) and attempts to solve three meta-problems related to the concept of God: the unicity of extension problem, the homogeneity/heterogeneity problem and the problem of conceptual unity.

Em analogia com outras discriminações, como o racismo ou o sexismo, o especismo é concebido como uma forma de discriminação moral com base na espécie. Em grande medida, a discussão contemporânea sobre a importância moral dos animais surgiu e desenvolveu-se em torno da crítica e da defesa do especismo. Este artigo oferece uma visão da discussão filosófica contemporânea sobre o especismo. Após uma breve introdução, apresenta-se uma definição de especismo e caracterizam-se vários tipos de especismo, sendo o Antropocentrismo o mais (...) relevante. Depois, expõe-se um argumento proeminente contra o Antropocentrismo: o argumento dos casos marginais. Por fim, algumas posições antropocêntricas são criticamente discutidas. (shrink)

This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to heart that (...) the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. Ubico indicios de mitos nacionales analizando obras narrativas (de Borges y algunos otros autores), y dichos acerca de Borges, centrándome en cómo se verifica, en la narrativa de Borges, (y también en sus intervenciones públicas y en lo que se dice sobre su figura) la irrupción del peronismo. Propongo un cambio de escala: sin intentar interpretar los grandes momentos constitutivos entendiéndolos como mitos de origen, intento constituir series, de características cuasi-míticas, a partir de poner en relación a breves sintagmas que (...) se reiteran en distintas unidades narrativas. Elementos transversales, que van de un relato a otro. Sintagmas que se analizan tomando al conjunto de la obra de Borges como paradigma, y no sólo relatos aislados. En primer término, exploro ciertas constantes en algunos relatos del período 1945-54. Luego me detengo en una serie de versiones contemporáneas sobre un Borges ciego a quien un joven peronista ayuda a cruzar la calle. En tercer lugar. el tema de la aparición de relatos oníricos, literariamente enunciados, sobre personas con garra de pájaro, vinculándolos a los dilemas morales de la élite intelectual en los tiempos del primer peronismo. En tanto estos conjuntos tienen mucho en común con los mitos al ser reelaboraciones sucesivas de un elemento narrativo, podrían ser abordadas con métodos de análisis míticos propios de la antropología estructural. No obstante, el material utilizado tiene diferencias con las mitologías clásicas: a) tiene versiones orales, pero también escritas; b) hechos ficcionales, pero también históricos; c) admiten un orden cronológico verificable. Por lo tanto, arriesgo aquí una exploración metodológica y teórica más bien experimental, aunque deudora de Lévi-Strauss. Concluyo que en estos dos conjuntos se verifica el funcionamiento un sistema ideológico, que es el de la formación nacional argentina, con sus tensiones y crisis. (shrink)

O presente trabalho objetiva discutir as possíveis contribuições da Hermenêutica Filosófica de Gadamer para a pesquisa em Psicologia. Nessa direção, parte da problematização do modo como o conhecimento é produzido na Psicologia, com realce para a insuficiência do horizonte técnico-científico para aproximar-se dos fenômenos humanos. Recorre à Hermenêutica Filosófica de Gadamer na busca do desvelamento de outras possibilidades para tal fazer. Para tanto, parte da compreensão da hermenêutica, não na função de método, mas compreendida como condição humana originária. Aborda inicialmente (...) o reconhecimento da influência de Heidegger para o desenvolvimento da Hermenêutica Filosófica de Gadamer e, em seguida, tece uma possível articulação entre o horizonte aberto por Gadamer e a pesquisa em Psicologia, enfocando as compreensões do filósofo acerca da compreensão, do jogo e do diálogo. Por fim, ressalta as contribuições abertas pela Hermenêutica Filosófica para descortinar “direcionamentos” inspiradores às pesquisas no contexto da Psicologia na busca de compreender os fenômenos existenciais. Tal caminho, na medida em que não busca conclusões teoréticas e explicativas, ao manter-se na direção da pergunta, realça a dimensão compreensiva e hermenêutica originária da existência como radicalmente singular e possibilita a tessitura de diálogos entre Psicologia e Hermenêutica Filosófica. Sexting has been defined as sending, receiving, or forwarding sexually explicit messages, images, or photos to others through digital platforms, and can assume more consensual or more abusive and violent forms. This study aims to explore the prevalence of abusive sexting in Portuguese adolescents and the psychological characteristics of sexting abusers in terms of emotional and behavioral problems, potential markers of psychopathy, childhood trauma and maltreatment, and different forms of aggression. A cross-sectional study was conducted with 4,281 participants, aged 12–20 (...) years, of whom 204 engaged in abusive sexting behaviors and 182 self-identified as being a non-consensual sexting victim. Abusive sexting was more common among boys and middle adolescents, and abusive sexting victims were more likely to be children of single-parent families. Engaging in abusive sexting and being a victim of abusive sexting were also related to behavioral and emotional problems, callousness, experiences of neglect and abuse in childhood, and various forms of aggression. Implications for future research and intervention are discussed. (shrink)

Any plausibly just market exchange must balance two conflicting moral considerations: non-worseness (Wertheimer, 1999) and euvoluntariness (true voluntariness; Munger, 2011). We propose an analytical theory of just market exchange that partly resolves this conflict.

El artículo propone analizar algunos de los usos y relaciones que se establecen entre las nociones de norma y normatividad, tomadas en un sentido amplio, con los problemas tanto básicos como “aplicados” en el campo psicoeducativo. Para ello, se intentará una aproximación desde una perspectiva crítica y en el marco de los Enfoques Socio Culturales en psicología del desarrollo y educacional. La hipótesis de partida es que la psicología del desarrollo, abordada desde estos enfoques, y aún con mayor fuerza la (...) psicología educacional, poseen un ineludible componente normativo consistente con la caracterización de las prácticas pedagógicas como prácticas de gobierno del desarrollo, como prácticas que producen ciertos cursos de desarrollo subjetivo. Is it possible to combine different logics into a coherent system with the goal of applying it to specific problems so that it sheds some light on foundational aspects of those logics? These are two of the most basic issues of combining logics. Paranormal modal logic is a combination of paraconsistent logic and modal logic. In this paper, I propose two further combinatory developments, focusing on each one of these two issues. On the foundational side, I combine paranormal modal logic (...) with normal modal logic, resulting into a paraconsistent and paracomplete multimodal logic dealing with the notions of plausibility and certainty. On the application side, I combine this logic with Reiter’s default logic, resulting into an inductive and consequently nonmonotonic paraconsistent and paracomplete logic able to represent some key inductive principles. The article intends to analyze Nietzsches concept of conscience (Gewissen), in order to show its connection to the will to power. This relation inscribes in its interior, as derived from it, the bad conscience (schlechtes Gewissen), and thus opens a phenomenological horizon of interpretation of the will to power.

We uncover fundamental dimensions of the process through which organizations embed the practice of fraternity through embarking on an organizational journey in the direction of the common good. Building on the latest encyclical of Pope Francis, _Fratelli Tutti_, about fraternal and social friendship, we offer insight into the understanding of what it means to become a fraternal organization and reflect on the key ethical and paradoxical challenges for organizations aiming at collectively contributing to the common good. We add to previous (...) work by characterizing this journey as a process involving unique ethical challenges that emerge from the paradoxes associated with this process and how this might change the nature of the relationships between organizations and others within the organizational landscape. Mathematics is a critical part of much scientific research. Physics in particular weaves math extensively into its instruction beginning in high school. Despite much research on the learning of both physics and math, the problem of how to effectively include math in physics in a way that reaches most students remains unsolved. In this paper, we suggest that a fundamental issue has received insufficient exploration: the fact that in science, we don’t just use math, we make meaning with it in (...) a different way than mathematicians do. In this reflective essay, we explore math as a language and consider the language of math in physics through the lens of cognitive linguistics. We begin by offering a number of examples that show how the use of math in physics differs from the use of math as typically found in math classes. We then explore basic concepts in cognitive semantics to show how humans make meaning with language in general. The critical elements are the roles of embodied cognition and interpretation in context. Then, we show how a theoretical framework commonly used in physics education research, resources, is coherent with and extends the ideas of cognitive semantics by connecting embodiment to phenomenological primitives and contextual interpretation to the dynamics of meaning-making with conceptual resources, epistemological resources, and affect. We present these ideas with illustrative case studies of students working on physics problems with math and demonstrate the dynamical nature of student reasoning with math in physics. Se plantea un examen de la función histórica retroactiva del psicoanálisis "de niños", examinando sus consecuencias clínicas y teóricas de alcance general, poniendo especial énfasis en como reconstruye las categorías y nociones básicas del psicoanálisis tradicional.This text is an essay destinated to a deep exam of the clinical and teorical consequences of the so called "child psychoanalysis" upon the "main" one, searching particularly how "that" psychoanalysis deconstructs the principal issues of the traditional one.

For more than a century the notion of a pre-established harmony between the mathematical and physical sciences has played an important role not only in the rhetoric of mathematicians and theoretical physicists, but also as a doctrine guiding much of their research. Strongly mathematized branches of physics, such as the vortex theory of atoms popular in Victorian Britain, were not unknown in the nineteenth century, but it was only in the environment of fin-de-siècle Germany that the idea of a pre-established (...) harmony really took off and became part of the mathematicians’ ideology. Important historical figures were in this respect David Hilbert, Hermann Minkowski and, somewhat later, Albert Einstein. Roughly similar ideas can be found also among British theorists, among whom Arthur Eddington, Arthur Milne, and Paul Dirac are singled out. Although largely limited to the period 1870–1940, the paper also considers Max Tegmark’s recent hypothesis of the universe being a one-to-one reflection of mathematical structures. (shrink)

In physics education, equations are commonly seen as calculation tools to solve problems or as concise descriptions of experimental regularities. In physical science, however, equations often play a much more important role associated with the formulation of theories to provide explanations for physical phenomena. In order to overcome this inconsistency, one crucial step is to improve physics teacher education. In this work, we describe the structure of a course that was given to physics teacher students at the end of their (...) master’s degree in two European universities. The course had two main goals: To investigate the complex interplay between physics and mathematics from a historical and philosophical perspective and To expand students’ repertoire of explanations regarding possible ways to derive certain school-relevant equations. A qualitative analysis on a case study basis was conducted to investigate the learning outcomes of the course. Here, we focus on the comparative analysis of two students who had considerably different views of the math-physics interplay in the beginning of the course. Our general results point to important changes on some of the students’ views on the role of mathematics in physics, an increase in the participants’ awareness of the difficulties faced by learners to understand physics equations and a broadening in the students’ repertoire to answer “Why?” questions formulated to equations. Based on this analysis, further implications for physics teacher education are derived. (shrink)
