Many mothers with intellectual disabilities lose their parental rights due to child welfare (CW) concerns. Despite the growing interdisciplinary scholarship on parenting with intellectual disabilities, there is scant research that has explored the discursive practices embedded within CW or family courts involving mothers with intellectual disabilities. The aim of this study is to explore portrayals of mothering with intellectual disability in CW court reports filed in Québec, Canada. A three-level critical discourse analysis was performed, focusing on 10 reports that were (...) retrieved from a publicly available legal database, and their larger discursive societal context. Analysis highlighted unequal power relations as discursive practice underpinned by the following discursive patterns: (1) The ideal caregiver vs the unfit mother (2) Devalued voices of mothers with intellectual disability (3) Professionals as holding authoritative knowledge and (4) Decision-making based on the best interest of the child. Revealing the hidden ideological assumptions embedded in discourse can help to challenge and confront injustice faced by mothers with intellectual disability within the CW system. (shrink)

"The overall aim of this book is to understand the character of moral progress, so that making moral progress may become more systematic and secure, less chancy and less bloody. Drawing on three historical examples - the abolition of chattel slavery, the expansion of opportunities for women, and the increasing acceptance of same-sex love - it asks how those changes were brought about, and seeks a methodology for streamlining the kinds of developments that occurred. Heintz & Scott-Phillips propose that the partner choice ecology of our ancestors required Gricean cognitive pragmatics for reputation management, which caused a tendency toward showing and expecting prosociality that subsequently scaffolded language evolution. Here, we suggest a cognitively leaner explanation that is more consistent with comparative data and posits that prosociality and eventually language evolved along with cooperative breeding.

A number of Jewish women invented a singular way of entering into German culture; singular in that no tradition in Judaism or in Germany had shown them the way. Rahel Varnhagen, one of the first, is the subject of a biography by Hannah Arendt. Varnhagen never wrote a book, only letters and a diary, in which she unsystematically mixed narration and reflection, political and philosophical thoughts. Arendt's biography is true to heterogeneity of this kind: her biographical writing offers no (...) synthesis, jumping from systematic representations to individual experiences, and then to historical events or even social context. Arendt wrote to Jaspers that she had chosen the genre of biography precisely because she could not say what she wanted to in abstracto, meaning philosophic: more precisely, within the frames of Existenzphilosophie. Two things are noteworthy here: 1) the kind of biography that Arendt wrote; and 2) the very fact that she chose—despite Heidegger's well known contempt for it—the biographical genre. In order to give an account of those two things, one has to arrive at an understanding of what it is in the frames of Existenzphilosophie that prevents expression of the predicament of Rahel's existence and makes biography the more appropriate genre in her case. In this essay, I offer an interpretation of Arendt’s biography of the Jewish-German salonnière, Rahel Varnhagen: The Life of a Jewess. Treating the book as a work of political theory, I develop two arguments: First, I contend that Arendt’s study lays the grounds for a political epistemology of marginality and exclusion, making her a standpoint theorist avant la lettre. Second, I argue that Arendt’s book gives us an account of the process of ‘becoming political.’ This helps complement, and to (...) a degree counter, her insistence in more widely read books that political freedom is an exclusively plural experience in the public realm. This insistence sidelines the role played by individual political consciousness in the decision to engage in action, as well as the necessary interaction between the private and the public spheres in becoming a political subject. ABSTRACT The article critically discusses Rahel Jaeggi’s recent philosophical contribution to a critical theory of capitalism. The first part reconstructs Jaeggi’s account of Lebensform, life-form, that builds up the main ontological framework for addressing and problematizing capitalism intended not as an economic system but as a social whole. The second part focuses on the three different theoretical strategies that Jaeggi puts forward to detect and deal with capitalism’s immanent flaws. The third and last part problematizes the metaphysical assumptions and (...) implications of Jaeggi’s understanding of life-form and outlines a more dialectical, or “transactional” notion of form of life, which is inspired by Dewey’s non-reductionist naturalist method of inquiry. Hannah Arendt wrote the following to Karl Jaspers in 1931: “What this all really adds up to—fate, being exposed, what life means—I can’t really say in abstract. Perhaps all I can try to do is illustrate it with examples. And that is precisely why I want to write a biography. In this case interpretation has to take the path of repetition.” This description seems to me to be characteristic of her whole lifework: always illustrate everything with examples, and only use (...) abstract language as a kind of repetition; this is her attitude whether she writes on totalitarianism, on revolution, on anti-semitism, or on assimilation. I have the feeling that in speaking about her view on assimilation, I should avoid quoting her assertions. The only adequate procedure would be to narrate her own stories, the life-story of Rahel Varnhagen, the stories of the first chapter of The Origins of Totalitarianism; and in the first place to recapitulate her polemics. Since it is surely impossible to do this here, I cannot help but sometimes quote her assertions in abstract, her interpretations; but you must know: her stories always leave room for interpretations which are different and more sophisticated than her sometimes very categorical statements. Hannah Arendt is often--but somehow not unfailingly--credited, together with Alasdair MacIntyre, Paul Ricoeur and Charles Taylor, as being one of the central voices in the philosophical turn to the concept of narrative of a generation or more ago. Some have even cited her 1958 The Human Condition as providing a particular impetus for later accounts of narrative. This essay examines what contemporary philosophical accounts of narrative might still owe Arendt, exploring her approach to narrative in theory as well as (...) practice. The first part looks at Arendt's use of philosophical sources from the tradition--Aristotle, Augustine and Hegel--with an eye to how her appropriation of these figures differs from that of contemporary philosophers of narrative. Three of Arendt's typically bold and rich claims about narrative action emerge as important: the notion of action as revealing an agent's own daimon: the condition that such action be revealable within a world or shared public space which has resilience yet vulnerability; and the potential for agents revealed within such a world to discover some form of narrative rebirth in their efforts at storytelling. The second section examines the extent to which Arendt herself allowed those claims to be tested and thought through in her own attempts (in Men in Dark Times, Rahel Varnhagen and elsewhere) at constructing biographical narratives. Competence based education (CBE) and Bildung oriented education (BOE) fare differently when faced with problems that afflict our societies. CBE intends learning as the acquisition of separate competences thought of as objective measurable dispositions and goals to achieve, characterised by motivational states and intellectual and technical skills. By contrast, BOE is holistic and transmission oriented. BOE is understood as a process of interaction between the self and the world in the most general and widest possible way. BOE conceptualises learning as (...) a kind of construction of a meaningful picture of the world in learners’ minds. In this paper, I make a general case in support of BOE and against CBE that draws on Rahel Jaeggi’s conception of a form of life as an organised cluster of practices with a normative character. Forms of life are basic constituents of the social world. I first dissect the notion of form of life and that of immanent critique, which is, according to Jaeggi, the type of critique used by participants in a form of life to overcome problems and crises and make the form of life flourish (Jaeggi, 2022). I then contend––following Jaeggi––that forms of life can be conceptualised as collective problem-solving and learning activities with normative structure and historical character. This is so, because emancipatory forms of life are those that progressively resolve their own problems by learning about social reality through the exercise of immanent critique. Next, I argue that CBE and BOE represent two distinct types of critical attitude which ground respectively to diverse ways to conceive the norm underlying a certain form of life. I contend that CBE is a deviant form of life because its capacity for critical transformation is structurally limited due to a normative failure. This type of failure happens when the norm – and the critique -- is external to the form of life and applies to it from outside. Here the norm aims to be universally applicable because it is conceived as neutral, in line with the so-called “ideal of impartiality” -- that is the idea that there are neutral and impartial criteria by which it is possible to assess forms of life -- or alternatively when the norm assumes the form of an ideal perceived as never perfectly obtained in practice. One mode of the ideal of impartiality is represented by instrumental rationality which is exclusively concerned with the search for efficient means, and which consequently is not concerned with assessing the goals or ends pursued, differently from forms of life’s attitude. Furthermore, instrumental rationality is considered a dominant view because due to its alleged neutrality, it shapes not only the economic field but also those social practices that involve people and institutions (cf. Cruickshank, 2014, Mattei, 2023, Popp Berman 2022). However, the feeling is that neutral (instrumental) rationality allows to evade the question of meaning that social practices and forms of life have for people involved in them, and which have a distinct normative nature. By contrast, the type of rationality that BOE endows learners with is a form of immanent rationality, i.e. a form of rationality which considers contingencies and different contexts and situations which pose different problems to solve. BOE asks for reflection and this, in turn requires the use of historically, culturally and socially situated notions. In immanent critique trade-off procedures are used to strike a balance between the need to preserve the characteristics of a temporally situated form of life to safeguard its identity and the need to change some of them to cope with new problems. I conclude that while CBE does not stimulate the abilities required to heal the pathologies of forms of life and might even hinder their development, BOE is well suited to equip students with these abilities. Then, I describe various theories of normative foundations and the criticisms that such theories have faced, such as ethno- and andro-centrism, imperialism, and the failure to fulfill their own aims. I make my main argument by way of an analogy: theories of knowledge have wrestled with the question of whether a “given”’ could act as a certain (...) foundation for knowledge. The conclusion is often that no given can function in that way, because the given, which supposedly does not require justification, is therefore necessarily unable to justify knowledge. For similar reasons, I argue, nothing can function as a normative foundation for a critical social theory, because any such normative foundation would have to both stand in no need of normative justification but also justify normative social criticism. I conclude by suggesting that more recent critical theory that does not focus on normative foundations can be understood as justifying their critique by appeal to what people do actually want, rather than what they should rationally want. This monograph contrasts two prominent models of education, Competence-Based Education (CBE), more recent and currently dominant in most school systems around the world, and Bildung-Oriented Education (BOE), once the basis of the school systems of Northern Europe. CBE is assessment-oriented and interprets learning as the acquisition of clearly definable and allegedly measurable competences, and is supported by supranational organisations, such as the OECD, which approach education from the perspective of human capital theory. BOE is instead teaching-oriented and characterises learning (...) holistically as aimed at the progressive articulation of a meaningful ‘big picture’ in the student’s mind. Emerged in Northern Europe under the influence of the ideals of the Enlightenment and Neo-Humanism of individual and collective autonomy and responsibility, BOE was subsequently enriched with a hermeneutical approach to teaching and socio-political objectives of emancipation and solidarity originating within Critical Theory. The book first analyses CBE and argues that, in spite of its celebrated ‘scientificity’, it is internally incoherent and unreliable, contributes to structural forms of oppression and injustice, can foster social pathologies, and fails to provide students with the kind of intellectual autonomy they need as both human beings and citizens of our complex post-industrial societies. Then, it introduces BOE and articulates and defends an updated version of it from objections raised by critical theorists, poststructuralists and postcolonial thinkers. It argues that BOE is a coherent and flexible model of education that endows students with autonomy and responsibility, can reduce structural forms of oppression and injustice, and can heal social pathologies. For nursing, the idea of bearing witness is of utmost importance. Nurses are present with persons who experience changes in their health and quality of life and who live intense and profound moments of struggling, questioning, and finding meaning. Nurses are also with persons from moment to moment as their lives unfold, and when joy, serenity, contentment, vulnerability, sadness, fear, and suffering are experienced. In this paper, it is proposed that bearing witness is a moral way of engaging in the (...) nurse–person relationship. Based on Levinas’s ethics of the face, it is claimed that bearing witness is enacting one’s moral responsibility, which arises from the encounter with the other. Drawing on Parse’s human becoming theory, ways of witnessing and bearing witness are defined and discussed. It is suggested that bearing witness is a human‐to‐human way of being‐relating, a mode of human coexistence. Bearing witness is being present and attentive to the truth of another’s experiences. Moreover, in this paper, the ways nurses enact their moral agency and bear witness to others placed in their care, or turn away, are explored. Nurses’ moral agency is located in the constrained moral space of contemporary health care. Hence, the creation of a moral space, which allows nurses to enact their moral responsibility of bearing witness to other persons’ experiences of health and quality of life, is called for. In doing so, it is suggested that the act of bearing witness needs a specific nursing knowledge base and a recognition that being present and being with another is a valuable nursing practice that is utterly meaningful for persons who are living through difficult times. The Hegelian-Marxist idea of alienation fell out of favor during the post-metaphysical rejection of humanism and essentialist views of human nature. In this book Jaeggi draws on phenomenological analyses grounded in modern conceptions of agency, along with recent work in the analytical tradition, to reconceive of alienation as the absence of a meaningful relationship to oneself and others, which manifests itself in feelings of helplessness and the despondent acceptance of ossified social roles and expectations. A revived approach to alienation helps (...) critical social theory engage with phenomena, such as meaninglessness, isolation, and indifference, which have broad implications for issues of justice. By severing alienation's link to a problematic conception of human essence while retaining its social-philosophical content, Jaeggi provides resources for a renewed critique of social pathologies, a much-neglected concern in contemporary liberal political philosophy. For many liberals, the question "Do others live rightly?" feels inappropriate. Liberalism seems to demand a follow-up question: "Who am I to judge?" Peaceful coexistence, in this view, is predicated on restraint from morally evaluating our peers. But Rahel Jaeggi sees the situation differently. Criticizing is not only valid but also useful, she argues. Moral judgment is no error; the error lies in how we go about judging. One way to judge is external, based on universal standards derived from (...) ideas about God or human nature. The other is internal, relying on standards peculiar to a given society. Both approaches have serious flaws and detractors. In On the Critique of Forms of Life, Jaeggi offers a third way, which she calls "immanent" critique. Inspired by Hegelian social philosophy and engaged with Anglo-American theorists such as John Dewey, Michael Walzer, and Alasdair MacIntyre, immanent critique begins with the recognition that ways of life are inherently normative because they assert their own goodness and rightness. They also have a consistent purpose: to solve basic social problems and advance social goods, most of which are common across cultures. Jaeggi argues that we can judge the validity of a society's moral claims by evaluating how well the society adapts to crisis--whether it is able to overcome contradictions that arise from within and continue to fulfill its purpose. In the contemporary globalized economy, multinational companies have come to hold considerable power that may previously have rested with nation states. However, state structures remain relevant. With Brexit, the year 2016 featured an exemplary case in which the ongoing importance of nation states came to the fore. Preceding the British referendum to exit the European Union, discourses of national identity were deployed to promote a vote for the anti-globalization campaign. It is against this background that this research investigates how the (...) relationship between multinational corporations and nation states is constructed in news discourse. The underlying assumption is that news actively construct rather than merely reflects the nature of this relationship. Drawing on Social Actor Analysis and Transitivity as a theoretical framework, this study examines news coverage of the BP oil spill that occurred in the United States in 2010 but was caused by a multinational company headquartered in the United Kingdom. The main research question is ‘How does the media establish a link between multinational corporations and nation states?’. To address this central question, this study investigates how corporate responsibility is assigned, the role of the nation state is portrayed and victim status is allocated in the news. Findings show that the nature of the problem is constructed differently according to diverging national interests or priorities of the two nations represented by the media sources analyzed. The study indicates that the discourse around British nationality emphasized in the political struggle around Brexit was already mobilized extensively in the years leading up to the referendum. What is the problem with capitalism? Is it wrong, unjust, irrational, or bad? Is it evil or dumb—or is it just not working? While critiques of capitalism have become commonplace—particularly since the most recent global economic crisis—it is often unclear what exactly is being condemned. Likewise, the normative presuppositions and criteria of such criticisms have been left unspecified. In this paper, I distinguish between three approaches to the critique of capitalism, distinguishing a functional, a moral, and an ethical argumentative strategy (...) and paying special attention to the distinctive types of argumentation they mobilize. First, I consider the “functional” critique, typically directed against capitalism's straightforward dysfunctions or crises. We will find, however, that this sort of criticism presupposes a normative criterion that is frequently unarticulated, namely: the implied “purpose” of a well‐functioning economic system. Second, I examine a common “moral” critique, that is, that capitalism is premised on exploitation. Yet, the concept of exploitation, too, introduces certain difficulties, since the kind of moral wrong associated with it—unequal exchange—is hardly obvious to everyday observation and must be derived systematically. Third, I introduce and address the “ethical” critique, broadly, that capitalism constitutes a bad form‐of‐life. However, while I object to some of the forms this criticism has taken—in particular, I argue that much “alienation” diagnosis is tainted by nostalgia and naiveté—I nonetheless recommend developing a critique of capitalism as a form‐of‐life that would include ethical and functional criteria. The article discusses a notion of form as reflection in Benjamin and Adorno that can be traced back to early German Romanticism. A reading of Novalis’s Hymns to the Night exemplifies the notion and shows that form-as-reflection amounts to a mimetic relation between Dargestelltem and Darstellendem in a work of art. It is further argued that Husserl’s theory of the image, too, discusses this relation and allows to clarify the account of form in Benjamin and Adorno. The article thus reveals (...) a neglected development of a romantic paradigm of form in 20th century image theory and aesthetics. (shrink)

Dennoch hat die Idee einer generellen Fortschrittsbewegung ihren alten Glanz verloren, ja, sie ruft sogar Skepsis hervor. In aller Munde ist hingegen die Diagnose der Regression. Sie wird diversen Zeiterscheinungen gestellt, vom rechtsautoritären Populismus bis zur Demokratiemüdigkeit. -/- Rahel Jaeggi verteidigt in ihrem Buch das Begriffspaar Fortschritt und Regression als unverzichtbares sozialphilosophisches Werkzeug für (...) die Kritik unserer Zeit. Als fortschrittlich oder regressiv versteht sie nicht nur das Resultat, sondern vor allem die Gestalt gesellschaftlicher Transformationen selbst. Indem sie nach den Erfahrungsblockaden fragt, die regressiven Tendenzen Vorschub leisten, entwickelt sie einen Begriff des Fortschritts, der eurozentrische Verzerrungen ebenso vermeidet wie die Vorstellung einer zwangsläufigen Entwicklungstendenz. Fortschritt, so zeigt sie, ist nicht der Vorlauf zu einem bereits bekannten Ziel, sondern der nie abgeschlossene Prozess der Emanzipation. (shrink)
