My goal in this paper is to argue that the principled approach to hearsay is consistent with the rule of law. I begin by contrasting an instrumental conception of the rule of law with a conception that views the rule of law in primarily normative terms. I then turn my attention to a recent criticism of the Supreme Court of Canada’s principled approach to hearsay and suggest that if Michael Oakeshott’s normative interpretation of the (...) rule of law is adopted, there is no tension between the principled approach to hearsay and the rule of law. In this paper we present a new proposal for defining actual causation, i.e., the problem of deciding if one event caused another. We do so within the popular counterfactual tradition initiated by Lewis, which is characterised by attributing a fundamental role to counterfactual dependence. Unlike the currently prominent definitions, our approach proceeds from the ground up: we start from basic principles, and construct a definition of causation that satisfies them. We define the concepts of counterfactual dependence and production, and (...) put forward principles such that dependence is an unnecessary but sufficient condition for causation, whereas production is an insufficient but necessary condition. The resulting definition of causation is a suitable compromise between dependence and production. Every principle is introduced by means of a paradigmatic example of causation. We illustrate some of the benefits of our approach with two examples that have spelled trouble for other accounts. We make all of this formally precise using structural equations, which we extend with a timing over all events. (shrink)

Among theories of human language comprehension, cue‐based memory retrieval has proven to be a useful framework for understanding when and how processing difficulty arises in the resolution of long‐distance dependencies. Most previous work in this area has assumed that very general retrieval cues like [+subject] or [+singular] do the work of identifying (and sometimes misidentifying) a retrieval target in order to establish a dependency between words. However, recent work suggests that general, handpicked retrieval cues like these may not be enough (...) to explain illusions of plausibility (Cunnings & Sturt, 2018), which can arise in sentences like The letter next to the porcelain plate shattered. Capturing such retrieval interference effects requires lexically specific features and retrieval cues, but handpicking the features is hard to do in a principled way and greatly increases modeler degrees of freedom. To remedy this, we use well‐established word embedding methods for creating distributed lexical feature representations that encode information relevant for retrieval using distributed retrieval cue vectors. We show that the similarity between the feature and cue vectors (a measure of plausibility) predicts total reading times in Cunnings and Sturt’s eye‐tracking data. The features can easily be plugged into existing parsing models (including cue‐based retrieval and self‐organized parsing), putting very different models on more equal footing and facilitating future quantitative comparisons. Controlled natural languages (CNL) with a direct mapping to formal logic have been proposed to improve the usability of knowledge representation systems, query interfaces, and formal specifications. Predictive editors are a popular approach to solve the problem that CNLs are easy to read but hard to write. Such predictive editors need to be able to “look ahead” in order to show all possible continuations of a given unfinished sentence. Such lookahead features, however, are difficult to implement in a satisfying (...) way with existing grammar frameworks, especially if the CNL supports complex nonlocal structures such as anaphoric references. Here, methods and algorithms are presented for a new grammar notation called Codeco, which is specifically designed for controlled natural languages and predictive editors. A parsing approach for Codeco based on an extended chart parsing algorithm is presented. A large subset of Attempto Controlled English has been represented in Codeco. Evaluation of this grammar and the parser implementation shows that the approach is practical, adequate and efficient. (shrink)

Expectation Maximisation (EM) and Latent Dirichlet Allocation (LDA) are two frequently used inference algorithms, for finding an appropriate mixture of latent variables, and for finding an allocation of topics for a collection of documents. A recent insight in probabilistic learning is that Jeffrey’s update rule gives a decrease of Kullback-Leibler divergence. Its logic is error correction. Electroencephalographic monitoring provides critical diagnostic and management information about patients with epilepsy and seizure mimics. Admission to an epilepsy monitoring unit (EMU) is the gold standard for such monitoring in major medical facilities worldwide. In many countries, access can be challenged by limited resources compared to need. Today, triaging admission to such units is generally approached by unwritten protocols that vary by institution. In the absence of explicit guidance, decisions can be ethically taxing and are easy to challenge. In an (...) effort to address this gap, we propose a two-component approach to EMU triage that takes into account the unique landscape of epilepsy monitoring informed by triage literature from other areas of medicine. Through the strategic component, we focus on the EMU wait list management infrastructure at the institutional level. Through the principled component, we apply a combination of the ethical principles of prioritarianism, utilitarianism and justice to triage; and we use individual case examples to illustrate how they apply. The effective implementation of this approach to specific epilepsy centres will need to be customised to the nuances of different settings, including diverse practice patterns, patient populations and constraints on resource distribution, but the conceptual consolidation of its components can alleviate some of the pressures imposed by the complex decisions involved in EMU triage. Are there universally valid moral principles that dictate what's right regardless of what the consensus is within a particular society? Or are moral judgments culturally relative, ultimately dictated by conventions and practices which vary among societies? Practices and Principles takes up the debate between cultural relativists and universalists, and the related debate in political philosophy between communitarians and liberals, each of which has roots in an earlier debate between Kant and Hegel. Rejecting uncritical deference to social practice, I acknowledge the (...) need for standards for judging existing practices; but, I argue, the fact that there are principles we can use to criticize practices does not mean we can ignore social practice when making ethical and legal judgments. While defending principled criticism,I show the important role social practices have both in selecting and applying principles. I show precisely how both principles and practices interact through three case studies: promises, contract law, and the fourth amendment issue of whether an expectation of privacy is reasonable. When we turn to particular instances of ethical and legal judging we find that it is appropriate sometimes to appeal to principles that seem foreign to a culture to criticize aspects of that culture, sometimes to appeal to principles immanent in a culture and its practices, sometimes to defer to expectations arising from practices without subjecting the practices to critical scrutiny. I reject simplifying dichotomies that force us to choose between either practices or principles, universalism or relativism, and liberalism or communitarianism. (shrink)

This article presents an empirical examination of the consequences of the virtual entailment principle proposed by Jean Buridan to resolve the Liar paradox. This principle states that every sentence in natural language implicitly asserts its own truth. Adopting this principle means that the Liar sentence is not paradoxical but false, because its content is contradictory to what is virtually implied. As a result, humans should perceive the Liar sentence the same way as any other false sentence. This solution to the (...) Liar paradox received criticism for making ad hoc claims about the natural language. However, thanks to modern advancements in psychophysiology, it became possible to empirically investigate if the human brain really perceives the Liar sentence like a false sentence. We designed and conducted an experiment to examine brain activity in response to true sentences, false sentences and self-referential sentences. Our results provide support for the Buridan’s hypothesis and show that the Liar sentence is processed by the human brain identically to false sentences, while the Truthteller sentence is perceived identically to true sentences. This agrees with predictions derived from the virtual entailment principle and supports the idea that humans think with the logic of truth—a logic for which the truth is a designated value of its adequate semantics. Satr al-awrah (Hijab /veiling) is one of the obligatory provisions for men and women in Islam. Satr al-awrah, as a religious/jurisprudential term, means covering the parts of the body (awrah) that should be covered by religion. Islamic jurisprudents have disagreed on whether satr al-awrah is a condition of validity for prayer. There are two basic approaches to this issue, one of which belongs to the public (jumhūr including the Hanafī, Shafiī and Hanbalī schools) and the other to the Mālikīs. According (...) to the majority (jumhūr), satr al-awrah is a validity condition of the prayer. Therefore, a prayer performed without fulfilling the satr al-awrah condition is not valid. A prayer performed in this way must be re-performed absolutely within or outside of time. There are two approaches in the Mālikī school regarding whether the satr al-awrah is a condition for the validity of the prayer. The first approach is (partly) the same as the jumhūr. According to the second approach (without any distinction between prayer and outside the prayer), satr al-awrah is a general obligation in Islam and is not a valid condition for prayer.According to the Mālikīs who accept this second view, it is sunnah to comply with the satr al-awrah condition in prayer. On the other hand, in the Mālikī school, awrah is divided into two as ʿawrah mughallaẓa and ʿawrah mukhaffafa in terms of its effect on the validity of prayer. The disagreement about whether the satr al-awrah is a condition of validity for the prayer is related to the ʿawrah mughallaẓa. On the other hand, there is an agreement that the ʿawrah mukhaffafa is not a condition for the validity of the prayer. The disagreement in the classical fiqh doctrine about whether the satr al-awrah is a condition for the validity of the prayer has some jurisprudential consequences. As a matter of fact, according to the majority, whether it is ʿawrah mughallaẓa or mukhaffafa, a prayer performed with an uncovered awrah is not valid and must be re-performed absolutely. In the Mālikī school, there are different opinions depending on whether it is ʿawrah mughallaẓa or mukhaffafa. If the place uncovered on the body is ʿawrah mughallaẓa; According to those who accept the satr al-awrah as a condition for the validity of the prayer, the prayer is not valid and must be re-performed absolutely. After the time has passed, the prayer does not have to be repeated. If the place uncovered on the body is ʿawrah mukhaffafa, according to all Mālikīs, unanimously the prayer is valid. Although it is recommended to reperformed it in time, it is not required to be returned after the time has passed. The following can be said about the practical examples of the disagreement in the classical fiqh doctrine regarding whether the satr al-awrah is a condition for the validity of the prayer, especially in terms of ʿawrah mukhaffafa: According to Mālikīs, who do not accept the validity of the satr al-awrah for prayer, it is valid for women to pray with their heads down, below the knees and with their arms uncovered. Again, according to them, it is valid for men to perform prayers with their thighs/hips (fakhz) uncovered, since it is considered one of the private parts. (shrink)

Background Surgery for intersex infants should be delayed until individuals are able to decide for themselves, except where it is a medical necessity. In an ideal world, this single principle would suffice and such surgeries could be totally prohibited. Unfortunately, the world is not perfect, and, in some places, intersex neonates are at risk of being abandoned, mutilated or even killed. As long as intersex persons are at such high risk in some places, any ethical guidelines for intersex surgeries will (...) need to take these extreme risks of harm into account. Main text I therefore argue for five basic principles that ought to inform ethics guidelines for surgical interventions in intersex children, specifically in contexts in which such children are at risk of significant harm. What I set out to come up with is a set of principles that do not completely prohibit surgery, but only allow it where a strong case can be made for its necessity, in the best interests of the child, and where there is some kind of oversight to prevent misuse. The first principle is that interventions as drastic as these surgeries should only be performed when there is strong evidence that they are beneficial and not harmful. The second principle is that in surgeries should normally only be performed in cases of true medical necessity. Principle three is that surgeries should normally be delayed until such time as the intersex person is mature enough to assent to treatment or decide against it. Principle four is that the conventional ethical requirements regarding truth telling apply equally to intersex children as to anyone else. The final principle is that where physicians or parents think that surgery is in the best interests of the child, the burden of proof lies with them. Conclusion It is hoped that these principles might help medical teams and parents make better decisions about intersex surgeries on children, and they would make such surgeries very rare indeed, if they happen at all. A large proportion of hospital inpatients are affected by cognitive impairment, posing challenges in the provision of their care in busy, fast-paced acute wards. Signs and symbols, known as visual identifiers, are employed in many U.K. hospitals with the intention of helping healthcare professionals identify and respond to the needs of these patients. Although widely considered useful, these tools are used inconsistently, have not been subject to full evaluation, and attract criticism for acting as a shorthand for a routinized response. (...) In order for visual identifiers to be used effectively in acute care settings, thorough consideration must be given to the ethical and legal issues that are engaged in this context, and their potential benefits and harms must be weighed and balanced. This paper proposes a set of legal and ethical principles that can be used to guide the implementation of visual identifiers. Together, these principles provide a framework applicable in the design and implementation phases to systematically identify relevant considerations arising from the use of these tools. We outline some tensions that arise between principles and conclude that selecting a preferred moral framework could help to guide decision-making, as does clarity around the purpose and objectives of the identifier. As Artificial Intelligence (AI) becomes more and more pervasive in our everyday life, new questions arise about its ethical and social impacts. Such issues concern all stakeholders involved in or committed to the design, implementation, deployment, and use of the technology. The present document addresses these preoccupations by introducing and discussing a set of practical obligations and recommendations for the development of applications and systems based on AI techniques. With this work we hope to contribute to spreading awareness on the (...) many social challenges posed by AI and encouraging the establishment of good practices throughout the relevant social areas. As points of novelty, the paper elaborates on an integrated view that combines both human rights and ethical concepts to reap the benefits of the two approaches. Moreover, it proposes innovative recommendations, such as those on redress and governance, which add further insight to the debate. Finally, it incorporates a specific focus on the Italian Constitution, thus offering an example of how core legislations of Member States might contribute to further specify and enrich the EU normative framework on AI. What does it mean to introduce the notion of imagination in the discussion about global justice? What is gained by studying the role of imagination in thinking about global justice? Does a focus on imagination imply that we must replace existing influential principle-centred approaches such as that of John Rawls and his critics? We can distinguish between two approaches to global justice. One approach is Rawlsian and Kantian in inspiration. Discussions within this tradition typically focus on the question whether (...) Rawls's theory of justice (1971), designed for the national level, can or should be applied to the global level. Can and should Rawls's Difference Principle be globalized, as Thomas Pogge argues? Is this proposal superior to Rawls's Law of Peoples (1999)? Another approach to global justice has been developed by Martha Nussbaum in Cultivating Humanity (1997), Poetic Justice (1995), and other work. I will construct her view and critically examine it by looking at her arguments about the relation between empathy, literature, and global justice. At first sight, these two approaches seem to be opposed. The former puts an emphasis on principles, universal reason, and the moral aspects of institutions and their policies, whereas the latter is rather concerned with the relation between imagination and justice, with the particular, and with the individual moral development. But is this necessarily so? I will show that both approaches could benefit from each other's insights to strengthen their own position. Moreover, I will argue for middle way between, or an integration of the two approaches that combines principles and imagination. In this way, we can move towards a more comprehensive account of global justice. (shrink)

Nanoparticles have multifaceted advantages in drug administration as vaccine delivery and hence hold promises for improving protection of farmed fish against diseases caused by pathogens. However, there are concerns that the benefits associated with distribution of nanoparticles may also be accompanied with risks to the environment and health. The complexity of the natural and social systems involved implies that the information acquired in quantified risk assessments may be inadequate for evidence-based decisions. One controversial strategy for dealing with this kind of (...) uncertainty is the precautionary principle. A few years ago, an UNESCO expert group suggested a new approach for implementation of the principle. Here we compare the UNESCO principle with earlier versions and explore the advantages and disadvantages by employing the UNESCO version to the use of PLGA nanoparticles for delivery of vaccines in aquaculture. Finally, we discuss whether a combined scientific and ethical analysis that involves the concept of responsibility will enable approaches that can provide a supplement to the precautionary principle as basis for decision-making in areas of scientific uncertainty, such as the application of nanoparticles in the vaccination of farmed fish. The leading idea of axiomatization is a generalized version of the equivalence principle—the principle of approximative reproducibility. As fundamental concepts we use processes and reproductions of processes. On the universe of processes the point space of events is founded which carries the familiar properties of spacetime topology. Jules Coleman, one of the world's most influential philosophers of law, here expounds his recent views on a range of important issues in legal theory. Coleman offers for the first time an explicit account of the pragmatist method that has long informed his work, and takes on the views of highly respected contemporaries such as Ronald Dworkin and Joseph Raz.

Marian Smoluchowski solved the greatest scientific problem of his time. It was the explanation of the phenomenon of the Brownian motion. In the article, I show that Smoluchowski in fact in this explanation used an ontological interpretation of the causality principle, although in his writings he applied it also in the epistemological interpretation. This is understandable because in the scientific practice some kinds of ontological commitment are required.

The four-principle approach to biomedical ethics is used worldwide by practitioners and researchers alike but it is rather unclear what exactly people do when they apply this approach. Ranking, specification, and balancing vary greatly among different people regarding a particular case. Thus, a sound and coherent applicability of principlism seems somewhat mysterious. What are principlists doing? The article examines the methodological strengths and weaknesses of the applicability of this approach. The most important result is that a sound (...) and comprehensible application of the four principles is additionally ensured by making use of the organizing meta-principle of common morality, which is the starting point and constraining framework of moral reasoning. In Nuu-chah-nulth, the word tsawalk means "one." It expresses the view that all living things - humans, plants, and animals - form part of an integrated whole brought into harmony through constant negotiation and mutual respect for the other. Contemporary environmental and political crises, however, reflect a world out of balance, a world in which Western approaches for sustainable living are not working. In Principles of Tsawalk, hereditary chief Umeek builds upon his previous book, Tsawalk: A Nuu-chah-nulth Worldview, to elaborate (...) an alternative framework for responding to global environmental and political crises and to indigenous peoples' poverty, dispossession, and displacement in the realms of education and politics. These problems, Umeek argues, stem from an historical and persistent failure to treat all peoples and life forms with respect and accord them constitutional recognition. By contrast, the Nuu-chah-nulth principles of recognition, consent, and continuity, embodied in songs, language, and ceremonies, hold the promise of achieving sustainable lifeways in this shared struggle for balance. By weaving together Nuu-chah-nulth and Western worldviews, hereditary chief Umeek creates a new philosophical foundation for building more equitable and sustainable communities. Umeek (E. The disjunction effect (Tversky & Shafir, 1992) occurs when decision makers prefer option x (versus y) when knowing that event A occurs and also when knowing that event A does not occur, but they refuse x (or prefer y) when not knowing whether or not A occurs. This form of incoherence violates Savage's (1954) sure-thing principle, one of the basic axioms of the rational theory of decision making. The phenomenon was attributed to a lack of clear reasons for accepting an (...) option (x) when subjects are under uncertainty. Through a pragmatic analysis of the task and a consequent reformulation of it, we show that the effect does not depend on the presence of uncertainty, but on the introduction of non-relevant goals into the text problem, in both the well-known Gamble problem and the Hawaii problem. The general process view of learning, which guided research into learning for the first half of this century, has come under attack in recent years from several quarters. One form of criticism has come from proponents of the so-called biological boundaries approach to learning. These theorists have presented a variety of data showing that supposedly general laws of learning may in fact be limited in their applicability to different species and learning tasks, and they argue that the limitations are (...) drawn by the nature of each species' adaptation to the particular requirements of its natural environment. The biological boundaries approach has served an important critical function in the move away from general process learning theory, but it is limited in its ability to provide an alternative to the general process approach. In particular, the biological boundaries approach lacks generality, it is in some respects subservient to the general process tradition, and its ecological content is in too many cases limited toex post factoadaptive explanations of learning skills. A contrasting, ecological approach to learning, which can provide a true alternative to general process theory, is presented. The ecological approach begins by providing an ecological task description for naturally occurring instances of learning; this step answers the question:Whatdoes this animal learn to do? The next step is an analysis of the means by which learning occurs in the course of development, answering the question:Howdoes the animal learn to do this? On the basis of such analyses, local principles of adaptation are formulated to account for the learning abilities of individual species. More global principles are sought by generalization among these local principles and may form the basis for a general ecological theory of learning. (shrink)

In order to ground and reinforce his theory of primary goods, J. Rawls introduces the idea of the "Aristotelian principle" in §65 of A Theory of Justice. The article discusses the difficulties entailed by the acceptance of this notion, as well as the limitations of the idea of the good underlying that principle. The objective is to show that the conception of the good presented by Rawls is affected by "moral insufficiency" and to argue in support of the thesis that his approach to the idea of the good overshadows the practical dimension of rationality. In his 1827 work Rationale of Judicial Evidence, Jeremy Bentham famously argued against exclusionary rules such as hearsay, preferring a policy of “universal admissibility” unless the declarant is easily available. Bentham’s claim that all relevant evidence should be considered with appropriate instructions to fact finders has been particularly influential among judges, culminating in the “principled approach” to hearsay in Canada articulated in R. v. Khelawon. Furthermore, many scholars attack Bentham’s argument only for ignoring the realities of (...) juror bias, admitting universal admissibility would be the best policy for an ideal jury. This article uses the theory of epistemic contextualism to justify the exclusion of otherwise relevant evidence, and even reliable hearsay, on the basis of preventing shifts in the epistemic context. Epistemic contextualism holds that the justification standards of knowledge attributions change according to the contexts in which the attributions are made. Hearsay and other kinds of information the assessment of which rely upon fact finders’ more common epistemic capabilities push the epistemic context of the trial toward one of more relaxed epistemic standards. The exclusion of hearsay helps to maintain a relatively high standards context hitched to the standard of proof for the case and to prevent shifts that threaten to try defendants with inconsistent standards. In evolutionary biology, niche construction is sometimes described as a genuine evolutionary process whereby organisms, through their activities and regulatory mechanisms, modify their environment such as to steer their own evolutionary trajectory, and that of other species. There is ongoing debate, however, on the extent to which niche construction ought to be considered a bona fide evolutionary force, on a par with natural selection. Recent formulations of the variational free-energy principle as applied to the life sciences describe the properties of (...) living systems, and their selection in evolution, in terms of variational inference. We argue that niche construction can be described using a variational approach. We propose new arguments to support the niche construction perspective, and to extend the variational approach to niche construction to current perspectives in various scientific fields. (shrink)

While there have long been calls for healthcareethics frameworks and decision-making to include aspects of sustainability, less attention has focused on howresearchethics frameworks could address this. To do this, we first describe the traditional approach to research ethics, which often relies on individualised notions of risk. We argue that we need to broaden this notion of individual risk to consider issues associated (...) with environmental sustainability. This is because research is associated with carbon emissions and other environmental impacts, both of which cause climate change health hazards. We introduce how bioethics frameworks have considered notions of environmental sustainability and draw on these to help develop a framework suitable for researchers. In this paper it will be argued that Beauchamp and Childress' principle-based approach to bioethics has strongly pragmatic features. Drawing on the writings of William James, I first develop an understanding of methodological pragmatism as a method of justification. On the basis of Beauchamp's and Childress' most recent proposals concerning moral justification in the fifth edition of their Principles of Biomedical Ethics (2001), I then discuss different aspects that the principle-based approach and methodological pragmatism have in common.

This book offers fresh perspective on the role of phenomenology in the philosophy of physics which opens new avenues for discussion among physicists, "standard" philosophers of physics and philosophers with phenomenological leanings. Much has been written on the interrelations between philosophy and physics in the late 19th and early 20th century, and on the emergence of philosophy of science as an autonomous philosophical sub-discipline. This book is about the under-explored role of phenomenology in the development and the philosophical interpretation of (...) 20th century physics. Part 1 examines questions about the origins and value of phenomenological approaches to physics. Does the work of classical phenomenologists such as Husserl, Merleau-Ponty or Heidegger contain elements of systematic value to both the practice and our philosophical understanding of physics? How did classical phenomenology influence “standard” philosophy of science in the Anglo-American and other traditions? Part 2 probes questions on the role of phenomenology in the philosophies of physics and science: - Can phenomenology help to solve “Wigner’s puzzle”, the problem of the "unreasonable effectiveness" of mathematics in describing, explaining and predicting empirical phenomena? - Does phenomenology allow better understanding of the principle of gauge invariance at the core of the standard model of contemporary particle physics? - Does the phenomenological notion of “Lifeworld” stand in opposition to the “scientific metaphysics” movement, or is there potential for dialogue? Part 3 examines the measurement problem. Is the solution outlined by Fritz London and Edmond Bauer merely a re-statement of von Neumann’s view, or should it be regarded as a distinctively phenomenological take on the measurement problem? Over the past decades, due to the course towards digitalization of all areas of life, interest in modeling and creating intelligent systems has increased significantly. However, there are now a stagnation in the industry, a lack of attention to analog and bionic approaches as alternatives to digital, numerous speculations on “neuro” issues for commercial and other purposes, and an increase in social and environmental risks. The article provides an overview of the development of artificial intelligence (AI) conceptions toward increasing the (...) human likeness of machines: from the key ideas of A. Turing and J. von Neumann, who initiated the digitalization of society, to discussions about the definition of AI and the emergence of conceptions of strong and weak AI. Special attention is paid to the approach of A. Sloman, to ideas about the architecture and design of complex artificial systems are considered, which make it possible to “emotionally” expand the idea of weak/strong AI. In the article's section on the necessity and possibility of incorporating emotions into the architecture of AI, the authors reveal the goals and methodological limitations for creating an emotional artificial agent. In addition, the article briefly presents the main principles of the authors' architectural approach to the creation of emotional intellectual systems on the example of the cognitive-affective model of architecture, which allow modeling the impact of emotions on the cognitive processes involved in decision-making processes. The described architectural approach to modeling intelligent systems can be used as a conceptual basis for discussing and formulating a strategy for the development of neurocomputing, philosophy of artificial intelligence, and experimental philosophy, for developing innovative research programs, formulating and solving theoretical and methodological problems.
