In an era characterized by fast technological progress that introduces new unpredictable scenarios every day, working in the law field may appear very difficult, if not supported by the right tools. In this respect, some systems based on Artificial Intelligence methods have been proposed in the literature, to support several tasks in the legal sector. Following this line of research, in this paper we propose a novel method, called PRILJ, that identifies paragraph regularities in legal case judgments, to support legal (...) experts during the redaction of legal documents. Methodologically, PRILJ adopts a two-step approach that first groups documents into clusters, according to their semantic content, and then identifies regularities in the paragraphs for each cluster. Embedding-based methods are adopted to properly represent documents and paragraphs into a semantic numerical feature space, and an Approximated Nearest Neighbor Search method is adopted to efficiently retrieve the most similar paragraphs with respect to the paragraphs of a document under preparation. Our extensive experimental evaluation, performed on a real-world dataset provided by EUR-Lex, proves the effectiveness and the efficiency of the proposed method. In particular, its ability of modeling different topics of legal documents, as well as of capturing the semantics of the textual content, appear very beneficial for the considered task, and make PRILJ very robust to the possible presence of noise in the data. The economics of happiness is an influential research programme, the aim of which is to change welfare economics radically. In this paper I set out to show that its foundations are unreliable. I shall maintain two basic theses: (a) the economics of happiness shows inconsistencies with the first person standpoint, contrary claims on the part of the economists of happiness notwithstanding, and (b) happiness is a dubious concept if it is understood as the goal of welfare policies. These two theses (...) are closely related and lead to a third thesis: (c) happiness should be replaced by autonomy as the fundamental goal of welfare economics. To defend my claims I shall show that a hedonic approach to happiness leads to an awkward trilemma. Furthermore, I shall clarify the meaning of and , along with their conceptual relationships. As colleges and universities seek to invigorate ethics education, they need methods to identify where and describe how ethics is already present across their curricula. Meeting this need is complicated by the fact that much ethics education occurs in courses not explicitly focused on ethics or morality. In this paper, we review recent methodological advances before presenting a new Ethics Course Identification Tool (ECIT) that combines application of an expert-derived weighted dictionary and natural language processing methods to identify ethics-related courses (...) based on their titles and course catalog descriptions, even when the terms “ethic” or “moral” are not present. Two studies, the second a pre-registered replication, revealed considerable interrater reliability among experts in ethics education regarding the ethical relevance of courses. Critically, both studies revealed strong correlations between expert judgments and ECIT scores. This empirical evidence points to a shared understanding of ethics education among experts, and it supports the valid use of the ECIT to rapidly and reliably identify ethics-related courses. Based on these findings, we propose that the ECIT can be used both to advance research on trends in ethics education and to help target interventions to improve ethics education at colleges and universities. This monograph examines the relationship between science and democracy. The author argues that there is no clear-cut division between science and the rest of society. Rather, scientists and laypeople form a single community of inquiry, which aims at the truth. To defend his theory, the author shows that science and society are both heterogeneous and fragmented. They display variable and shifting alliances between components. He also explains how information flow between science and society is bi-directional through “transactional” processes. In other (...) words, science and society mutually define themselves. The author also explains how science is both objective and laden with values. Coverage includes a wide range of topics, such as: the ideal of value-free science, the is/ought divide, “thick terms” and the language of science, inductive risk, the dichotomy between pure science and applied science, constructivism and the philosophy of risk. It also looks at the concepts of truth and objectivity, the autonomy of science, moral and social inquiry, perfectionism and democracy, and the role of experts in democratic societies. The style is philosophical, but the book features many examples and case-studies. This study was aimed at predicting individual differences in text reading fluency. The basic proposal included two factors, i.e., the ability to decode letter strings (measured by discrete pseudo-word reading) and integration of the various sub-components involved in reading (measured by Rapid Automatized Naming, RAN). Subsequently, a third factor was added to the model, i.e., naming of discrete digits. In order to use homogeneous measures, all contributing variables considered the entire processing of the item, including pronunciation time. The model, which (...) was based on commonality analysis, was applied to data from a group of 43 typically developing readers (11- to 13-year-olds) and a group of 25 chronologically matched dyslexic children. In typically developing readers, both orthographic decoding and integration of reading sub-components contributed significantly to the overall prediction of text reading fluency. The model prediction was higher (from ca. 37% to 52% of the explained variance) when we included the naming of discrete digits variable, which had a suppressive effect on pseudo-word reading. In the dyslexic readers, the variance explained by the two-factor model was high (69%) and did not change when the third factor was added. The lack of a suppression effect was likely due to the prominent individual differences in poor orthographic decoding of the dyslexic children. Analyses on data from both groups of children were replicated by using patches of colours as stimuli (both in the RAN task and in the discrete naming task) obtaining similar results. We conclude that it is possible to predict much of the variance in text-reading fluency using basic processes, such as orthographic decoding and integration of reading sub-components, even without taking into consideration higher-order linguistic factors such as lexical, semantic and contextual abilities. The approach validity of using proximal vs distal causes to predict reading fluency is discussed. (shrink)

This book engages in an analytical and realistic enquiry into legal interpretation and a selection of related matters including legal gaps, judicial fictions, judicial precedent, legal defeasibility, and legislation. Chapter 1 provides an outline of the central theoretical and methodological tenets of analytical realism. Chapter 2 presents a conceptual apparatus concerning the phenomenon of legal interpretation, which it subsequently applies to investigate the truth-in-legal-interpretation issue. Chapters 3 to 6 argue for a theory of legal interpretation - pragmatic realism - by (...) outlining a theory of interpretive games, revisiting the debate between literalism and contextualism in contemporary philosophy of language, and underscoring the many shortcomings of the container-retrieval view and pragmatic formalism. In turn, Chapter 7, focusing on comparative legal theory, advocates an interpretation-sensitive theory of legal gaps, as opposed to purely normativist ones. Chapter 8 explores the connection between judicial reasoning and judicial fictions, casting light on the structure and purpose of fictional reasoning. Chapter 9 provides an analytical enquiry into judicial precedent, examining a variety of ideal-typical systems in terms of their normative or de iure relevance. No entanto, parece haver um aparente paradoxo entre a própria noção de “interesse” e a ideia de algo “público”: como uma ação ou decisão política pode contemplar a miríade de interesses de grupos e indivíduos diversos? Este artigo delineia alguns aspectos da noção de “interesse” no debate atual sobre comunicação política. Com base em uma pesquisa bibliográfica, (...) este artigo argumenta que, nas últimas décadas, as principais obras sobre o tema têm dedicado menos espaço à noção de 'interesse público' como uma entidade única em favor de uma visão mais nuançada e identitária cultural, noção que contempla a pluralidade de uma esfera pública repleta de novas formas de ativismo e demandas coletivas por espaço, igualdade e visibilidade. Despite the variety of banalities that are often associated with trips and vacations as mass consumption, the study of tourism – due to the commitment of social, economic, political and cultural energy - remains one of the predominant inputs for understanding contemporary society and the new social hierarchies that distinguish it. Tourism, which is increasingly seen as a process that has become integral to social and cultural life, also plays an essential role in the social and spatial dialectic that gives (...) meaning to the places. Focusing tourism through the lens of "productive consumption" developed by Cultural Studies, the paper moves from the assumption that responsible tourism can be analyzed in the broader paradigm of relational goods to explore the role of responsible tourism as a possible way of sustainable and responsible development.A pesar de la variedad de banalidades que a menudo se asocian con los viajes y las vacaciones, como el consumo de masas, el estudio del turismo –debido al compromiso de la energía social, económica, política y cultural– sigue siendo una de las fuentes predominantes para la comprensión de la sociedad contemporánea y las nuevas jerarquías sociales que la distinguen. El turismo, que se está viendo cada vez más como un proceso que forma parte integral de la vida social y cultural, también juega un papel esencial en la dialéctica social y espacial que da sentido a los lugares. Analizando el turismo desde el punto de vista del consumo productivo desarrollado por los estudios culturales, el artículo parte de la asunción de que el turismo responsable puede ser analizado en el paradigma más amplio de bienes relacionales para explorar el papel del turismo responsable como una forma posible de desarrollo sostenible y responsable. Diatoms are important protists that generate one fifth of the oxygen produced annually on earth. These aquatic organisms likely derived from a secondary endosymbiosis event, and they display peculiar genomic and structural features that reflect their chimeric origin. Diatoms were one of the first models of cell division and these early studies revealed a range of interesting features including a unique acentriolar microtubule‐organising centre. Unfortunately, almost nothing is known at the molecular level, in contrast to the advances in other experimental (...) organisms. Recently the full genome sequences of two diatoms have been annotated and molecular tools have been developed. These resources offer new possibilities to re‐investigate the mechanisms of cell division in diatoms by recruiting information from more intensively studied organisms. A renaissance of the topic is further justified by the current interest in diatoms as a source of biofuels and for understanding massive diatom proliferation events in response to environmental stimuli. Si può parlare di una attualità della fenomenologia e, in particolare, della fenomenologia di Edmund Husserl? Negli ultimi decenni, insomma, si è realizzata una “ strana ” parabola, che ha condotto a un suo singolare “ ritorno ”. In un orizzonte post - heideggeriano, la fenomenologia rappresenta la possibilità per la filosofia di non rinunciare al rigore, di interagire positivamente con la ricerca scientifica, di mettere in questione le ipotesi esplicative totalizzanti, metafisiche o scientifiche, in una metodica fedeltà alla manifestatività.

Nell’agenda della fenomenologia non figura la questione uomo- animale. E tuttavia nell’ultima fase della sua riflessione Husserl ha ripetutamente affrontato il tema, nell’ottica di una analisi fenomenologico-trascendentale della costituzione del mondo umano. La fenomenologia husserliana si mostra come una via per interrogare, in maniera non ideologica, a partire dall’esperienza del mondo della vita, i problemi della animalità e dell’umanità, per ripensare differenze e continuità.

In this article the author provides new external evidence demonstrating that the correspondence between the philosopher Seneca and the apostle Paul is a forgery. The author compares archaeological data offered by inscriptions, graffiti and regionarii with information conveyed by the apocryphal letters. The setting of the epistles, as well as information about the duration and damages of the Neronian fire, contrast with the archaeological data, indicating that the text should be considered a forgery. The contribution shows that the forger worked (...) rather in a literary mode. Conversely, the only archaeological date that scholars have brought to support authenticity is probably not a Christian inscription and does not prove anything regarding a meeting between Seneca and Paul or Seneca’s conversion. The origin of the correspondence should instead be traced to the cult of the apostles Paul and Peter during the 3rd and 4th centuries. (shrink)

In recent years, the veracity of the tradition of the martyrdom of the apostles Peter and Paul has been disputed; recently, Brent Donald Shaw denied the historicity of the persecution of Christians. In this article, the author analyzes the texts of Tacitus and Suetonius as well as other texts omitted by Shaw and demonstrates the inconsistency of the hypotheses put forward by negationist scholars from a theoretical and historical point of view.

How the cilium appeared is still such a poorly defined question that current hypotheses range from a symbiotic spirochaete to a cellular eye. In this paper, the whole question is subdivided into a list of problems which are morphological, physiological and temporal. These problems are examined one by one, in order to analyse the most popular exogenous hypothesis of Margulis as well as other recent exogenous and endogenous hypotheses. To overcome fundamental topological and temporal difficulties, a new endogenous hypothesis is (...) expounded, according to which the cilium derives from a cellular peduncle reinforced with microtubules. This hypothesis implies a geometrical rationale for the ninefold symmetry. In the last paragraph the consequences of the various hypotheses are compared. (shrink)

More than many other Austrians, Mises tried to found aprioristic methodology on a well defined and developed epistemology. Although references to Kant are scattered rather unsystematically throughout his works, he nevertheless used an unequivocal Kantian terminology. He explicitly defended the existence of ‘a priori knowledge’, ‘synthetic a priori propositions’, ‘the category of action’, and so forth.

The paper purports to provide an analytical treatment of the truth and legal interpretation issue. In the first part, it lays down a conceptual apparatus meant to capture the main aspects of the legal interpretation phenomenon, with particular attention paid to the several kinds of linguistic outputs resulting from interpretive activities. In the second part, it recalls three different notions of truth, focussing, so far as systemic truth is concerned, on the difference between deductive and rhetorical normative systems. In the (...) third, and last, part, it shows in which ways the phenomenon of legal interpretation encompasses truth-apt entities, leaving the choice between austere and liberal alethic pluralism to the reader. Brouwer's theorem of 1927 on the equivalence between virtual and inextensible order is discussed. Several commentators considered the theorem at issue as problematic in various ways. Brouwer himself, at a certain time, believed to have found a very simple counter-example to his theorem. In some later publications, however, he stated the theorem in the original form again. It is argued that the source of all criticisms is Brouwer's overly elliptical formulation of the definition of inextensible order, as well as a (...) certain ambiguity in his terminology. In a previous study we examined reading, spelling, and maths skills in an unselected group of 129 Italian children attending fifth grade by testing various cognitive predictors; results showed a high degree of predictors’ selectivity for each of these three behaviors. In the present study, we focused on the specificity of the predictors by performing cross-analyses on the same dataset; i.e., we predicted spelling and maths skills based on reading predictors, reading based on maths predictors and so on. Results indicated (...) that some predictors, such as the Orthographic Decision and the Arithmetic Facts tests, predicted reading, spelling and maths skills in similar ways, while others predicted different behaviors but only for a specific parameter, such as fluency but not accuracy, and still others were specific for a single behavior. To interpret these results, we propose a novel model of learning skills separately considering factors in terms of competence, performance and acquisition. Reading, spelling and calculation skills would depend on the development of discrete and different abstract competences. By contrast, overlap among behaviors would be accounted for by defective acquisition in automatized responses to individual “instances”; this latter skill is item specific but domain independent. Finally, performance factors implied in task’s characteristics may contribute to the partial association among learning skills. It is proposed that this new model may provide a useful base for interpreting the diffuse presence of comorbidities among learning disorders. (shrink)

Who or what is morally considerable? That is to say, what merits direct moral consideration—consideration in light of what it is? Mark Bernstein steers a middle course between the extremes he labels “chauvinism” and “deep ecology.” Chauvinists hold that, at most, all human beings are morally considerable. Deep ecologists are either individualists who hold that every living thing is morally considerable or holists who hold that ecosystems but not their constituent parts are considerable in themselves.

In this article, I focus on Johann Nikolaus Tetens’s linguistic theory to make three arguments: (a) this linguistic theory endorses a phonological (contra phonetic) approach to the acoustic sphere of language; (b) the phonological approach is based on the idea that sounds can turn into phonemes (of a properly human language) only when a minimally rational reflection on them is made; and (c) the phonological approach allows us to understand the phoneme as a differential unity, as being composed of structure (...) and function, and as giving a theoretical basis for language learning. In this article we develop a pragmatist-inspired notion of intelligence that should lead to a better understanding of the notion of scientific expertise. The notion of intelligence is drawn from Dewey and is therefore used here in its technical sense. Our thesis is that scientific knowledge is a necessary but not sufficient condition for scientific expertise; intelligence should also be added. Conceived of as the capacity to apply general knowledge to particulars, we reach the conclusion that intelligence is a necessary (...) requirement for scientific experts in the wake of Dewey’s logic of inquiry. In particular, we argue that an all-important task that scientific experts are asked to accomplish, and which puts their expertise to the test, is to transform indeterminate situations into problematic situations, and that such a goal can only be achieved if scientific experts succeed in paying attention to all the contingent and precarious aspects that make the situation they face unique. The successes and failures of the past will contribute to a more speedy solutions of the notational problems of the present times.Questa storia, ovviamente, coinvolge anche le (...) notazioni della logica. Il presente contributo intende proporre un nuovo insieme di simboli per una particolare teoria logica: la Mereologia Formale, in considerazione del fatto che questa teoria, pur avendo avuto trattazioni sistematiche, non ha allo stato attuale ancora raggiunto un sistema di notazioni condiviso dagli studiosi. Tale stato dell’arte è espressione, da un lato, di un legame della teoria al suo nascere con la notazione polacca, e del suo confronto con la Teoria Assiomatica degli Insiemi; dall’altro, del fatto che essa ha ricevuto solo in tempi recenti sistematiche applicazioni alle scienze.94 In tale prospettiva ho ritenuto necessario definire in primo luogo dei criteri attraverso cui procedere alla costruzione del sistema di simboli. In this paper the relationship between Gaia theory and fact/value dualism must be understood from two angles: I shall use Gaia as a case study to show the philosophical limits of dualism, and I shall also use the discussion of fact/value dualism to clarify the contents of Gaia theory. My basic thesis is that Lovelock is right when rejecting the suggestion that he should clear his theory of evaluative considerations. He is right because in his theory facts and moral values (...) are strictly interwoven and therefore cannot be conceptually separated. I shall show this point by arguing that if we dropped the evaluative components from Gaia theory we would not have the same theory cleared of those evaluative components. Instead we would have a theory with a different empirical meaning and different explanatory characteristics. (shrink)
