This paper presents in outline Luigi Ferrajoli’s axiomatic and general theory of law, as developed in his lifelong work Principia Iuris . The first section focuses on the three main aspects of the theory: the methodological, the theoretical and the pragmatic, which respectively represent the theory’s syntax, semantics and its pragmatics. Ferrajoli identifies three deontic gaps of norms: firstly, the one between their validity and efficacy ; secondly, the one between their justice and validity ; and finally, and most importantly, (...) the one between validity and existence (i.e. normative force). The presence of such gaps is, according to Ferrajoli, the extraordinary innovation that entrenched constitutions have brought into modern legal systems, by establishing norms that are superior to statutes and case law. In this sense, all normative phenomena (except for the constitution itself) can be conceived both as norms and as facts. In the second section the role of juridical science is briefly discussed. “Dalla filosofia dell’azione alla filosofia della mente” è stato il percorso di alcuni filosofi di nazionalità varia degli anni 1980 – come Paul Churchland negli Stati Uniti o Ansgar Beckermann in Germania – che prima si sono interessati agli aspetti più teorici nella filosofia dell’azione, come il modo di funzionamento delle azioni e la loro spiegazione scientifica, e che poi, con l’arrivo e la diffusione dei personal computers e delle scienze cognitive, hanno ampliato e approfondito questo interesse di ricerca e (...) si sono dedicati alla filosofia della mente più in generale e in particolare alla spiegazione scientifica e filosofica del mentale. Sandro Nannini faceva parte di questo movimento ed è stato uno tra gli inizialmente pochi filosofi italiani che si sono occupati di questi argomenti; successivamente ne è diventato uno dei maggiori specialisti in Italia, proponendo una sua particolare versione di naturalizzazione del mentale. Subordinata agli interessi teorici è stata la sua iniziativa accademica di fondare e promuovere il primo dottorato italiano di ricerca in Scienze Cognitive. Il presente volume tratta dell’opera di Sandro Nannini in contributi che sono riflessioni più o meno specifiche sulle differenti tappe del suo percorso, affrontando temi come l’analisi dell'azione, il libero arbitrio, la discussione di Nannini di vari classici della filosofia, la tendenza del naturalismo a dissolvere la filosofia in un enciclopedismo empirico e la sfida dei qualia e della fenomenologia all’approccio naturalistico alla mente. Il volume contiene inoltre un saggio dello stesso Sandro Nannini, nel quale espone l’ultimo sviluppo della sua filosofia della mente nonché le risposte agli interventi degli altri autori: Mario De Caro, Sara Dellantonio, Rosaria Egidi, Roberta Lanfredini, Christoph Lumer, Paolo Parrini, Pietro Perconti, Claudio Pizzi, Emanuela Scribano e Giuseppe Varnier. Åsa Burman has recently introduced the important notion of telic power and differentiated it from deontic power in an attempt to build a bridge between ideal and non-ideal social ontology. We find Burman’s project promising but we argue that more is to be done to make it entirely successful. First, there is a palpable tension between Burman’s claim that telic power can be ontologically independent of deontic power and her examples, which suggests that these forms of power share the same (...) basis. Second, it is not completely clear how telic power helps non-ideal social ontologists explain oppression, since Burman thinks that both forms of power are transparent to social agents. We offer solutions to both problems. First, we question the thesis that telic power can exist without deontic power. Burman contends that this is possible because some social roles involving telic power can exist independently of institutions, which are––in her opinion––the source of deontic power. Against Burman, we suggest that all social roles involve deontic power, whether or not they are institutional. Second, we argue that while the exercise of deontic power requires a mutual recognition of the social roles of the interacting agents and, therefore, an acceptance of the associated norms, the exercise of telic power does not require acceptance of the relevant norms. This is why invoking telic power is useful in explaining how oppression and injustice can arise. Lastly, we suggest that the relation between teleological normativity and telic power has not been fully clarified by Burman and requires a deeper analysis. (shrink)

This book reexamines the birth of quantum mechanics, in particular examining the development of crucial and original insights of Bohr. In particular, it gives a detailed study of the development and the interpretation given to Bohr's Principle of Correspondence. It also describes the role that this principle played in guiding Bohr's research over the critical period from 1920 to 1927.

This paper investigates the link between the consumer perception that a company is socially oriented and the consumer intention to buy products marketed by that company. We suggest that this link exists when at least two conditions prevail: (1) the products sold by that company comply with ethical and social requirements; (2) the company has an acknowledged commitment to protect consumer rights and interests. To test these hypotheses, we conducted a survey among the clients of retail chains offering Fair Trade (...) products. The results show that socially oriented companies can successfully leverage their reputation to market products with high symbolic values. (shrink)

The aim of the paper is resurrecting the “Demarcation Problem”, which was considered dead in a paper written by Larry Laudan in 1983. I will go through the analysis of Imre Lakatos’ thought, which represents the most mature synthesis between the fallibilism of science and the rationality of the demarcation attitude. Lakatos’ philosophical trick is directed to acknowledge the inclinations of the contemporary philosophers, to grasp the best they can offer, and to propose a more suitable philosophy of science. This article analyses how the philosopher Piero Martinetti conceptualizes the survival of a person’s soul after death. Martinetti’s stance is strongly influenced by the philosophy of Plotinus. Martinetti shows that the relation between singularity and multiplicity is expressed in human beings as two different and complimentary perspectives: a fundamental identity in the atemporal dimension of the intelligible life of the spirit and a dynamic tension in the empiric order of the spatio-temporal becoming. Both dimensions express themselves in a finalistic way, (...) attracted from the One who operates in them as a force of harmonization and concentration. The One as Omnitudo realitatis is the cornerstone of Martinetti’s position in regards to the survival of the individual soul after death: a concentration that happens mysteriously, because it transcends the ability of the human mind to understand it – yet, it certainly happens. ≪One thing only we know: what is worth living will live.≫. We largely agree with Grimwade et al ’s1 conclusion that challenge trial participants may ethically be paid, including for risk. Here, we add further arguments, clarify some points from the perspective of economics and indicate areas where economists can support the development of a framework for ethically justifiable payment. Our arguments apply to carefully constructed and monitored controlled human infection model trials that have been appropriately reviewed and approved. Participants in medical studies perform a service. Outside the domain of research (...) participation, there is nearly universal agreement that workers providing a service should be compensated fairly, and that work involving more discomfort and risk should be compensated more generously. Accordingly, labour regulations impose floors, not caps on compensation. Caps, even if intended to protect against undue inducement, also raise concerns about illegal price-fixing that disadvantages workers. Such limits on payment for egg donors have successfully been challenged in court.i Moreover, caps on compensation may harm everyone at risk of infection, not just potential participants. Insufficient compensation may impede the recruitment of enough suitable subjects, for example, when representativeness of the subject sample is required. Delays in vaccine development not only prolong disruption of social, educational and economic activity but also lead to excess infections and deaths. Unlike paid CHIM participants, individuals exposed to such infection do not accept it voluntarily, are not compensated for it, and are unlikely to receive the level of medical supervision afforded to closely monitored CHIM participants. The seventeenth century saw dramatic advances in mathematical theory and practice. With the recovery of many of the classical Greek mathematical texts, new techniques were introduced, and within 100 years, the rules of analytic geometry, geometry of indivisibles, arithmatic of infinites, and calculus were developed. Although many technical studies have been devoted to these innovations, Mancosu provides the first comprehensive account of the relationship between mathematical advances of the seventeenth century and the philosophy of mathematics of the period. Starting with (...) the Renaissance debates on the certainty of mathematics, Mancosu leads the reader through the foundational issues raised by the emergence of these new mathematical techniques, including the influence of the Aristotelian conception of science in Cavalieri and Guldin, the foundational relevance of Descartes' Geometrie, the relation between geometrical and epistemological theories of the infinite, and the Leibnizian calculus and the opposition to infinitesimalist procedures. I discuss two competing theories of the progressive: the theory proposed in Parsons (1980, 1985, 1989, 1990) and the theory proposed in Landman (1992). These theories differ in more than one way. Landman regards the progressive as an intentional operator, while Parsons doesn't. Moreover, Landman and Parsons disagree on what uninflected predicates denote. For Landman, cross the street has in its denotation complete events of crossing the street; the aspectual contribution of English simple past (perfective aspect) is the identity function. (...) For Parsons, both complete and incomplete events of crossing the street can be in the denotation of the base VP; perfective aspect restricts its denotation to the events that culminate. I present a version of ParsonÕs theory that avoids the problems raised by Landman, in particular the problem posed for Parsons by creation verbs. The repaired version and Landman's theory still differ in the way they analyze uninflected verbs. From Brouwer To Hilbert: The Debate on the Foundations of Mathematics in the 1920s offers the first comprehensive introduction to the most exciting period in the foundation of mathematics in the twentieth century. The 1920s witnessed the seminal foundational work of Hilbert and Bernays in proof theory, Brouwer's refinement of intuitionistic mathematics, and Weyl's predicativist approach to the foundations of analysis. According to the theoretical framework relating hypnosis to attention, baseline attentional functioning in highly hypnotizable individuals should be more efficient than in low hypnotizable individuals. However, previous studies did not find differences in Stroop-like tasks in which the measure indicative of the Stroop interference effect was based on response latencies. This study was designed to determine whether subjects with different levels of hypnotic susceptibility show differences in baseline attentional functioning. To assess this hypothesis, high, medium, and low hypnotizable subjects performed (...) a Stroop task designed to evaluate accuracy performance, before being subjected to hypnotic induction. Results showed that the Stroop interference effect was smaller in high hypnotizable subjects than in low hypnotizable subjects, whereas it was not different between high, and medium hypnotizable subjects. This outcome supports the notion that baseline attentional functioning is related to hypnotic susceptibility. (shrink)

Para realizar esta tarea es menester trazar tres puntos sobre los cuales gira este texto: primero, se ubica al lector en la discusión entre (...) poesía y filosofía para comprender el contexto de la crisis entre estos dos factores de la educación en la antigüedad griega; segundo, se aborda la crítica establecida en el libro X sobre la falta de rigor que muestran los poetas en la búsqueda del conocimiento; finalmente se vislumbra o abre una posibilidad interpretativa acerca del interés que puede tener la proposición de una "poesía filosófica" en la obra de Platón.The following text will try to show that radicalization of the thesis expressed by Plato in the book X does not allow "to "estímate" the value that the Athenian philo-sopher knows that poetry possesses, since poetry might be a means for the reflexive exercise if it takes advantage of the sobriety that philosophy proposes. To carry out this task it is necessary to define three points on which this paper will be about: first, the author will inform the reader about the old discussion among poetry and philosophy to understand the context of the crisis between these two forms of teaching; Second, criticism established in the book X on the lack of rigor in the search of knowledge that poets have will be addressed. Finally, the paper glimpses or opens an interpretive possibility about the interest that the proposition of a "philosophical poetry" can have in Plato's work. (shrink)

In this paper we propose a semantic analysis of sentences of the form "In fiction x, p" based on this picture of context. We argue that the derived contexts for sentences in the scope of "In fiction X" are determined by three factors: what the beliefs of the author are taken to be, the conventions established for the fiction, and a defeasible presumption of reliability of the narrator. Smartphones abrangem várias funcionalidades – telefonia, e-mails, dispositivo de áudio e vídeo, interação por meio de aplicativos – que têm operado transformações nas formas como os sujeitos se movimentam, aprendem e habitam os centros urbanos. Inscrita no referencial dos Estudos Culturais, este artigo é resultado de uma pesquisa exploratória que problematiza os usos de smartphones e certos deslocamentos no entendimento sobre aprendizagem. Assim, dois movimentos de investigação se interligam, sendo o primeiro uma exposição sobre a emergência de smartphones, e o (...) segundo um exame das relações entre os sujeitos e um tipo de mobilidade operada por smartphones. Os resultados indicam um tipo de aprendizagem diante das telas ao estilo móvel, ensinando formas de ser sujeito na sociedade contemporânea. (shrink)

Can taxation and the redistribution of wealth through the welfare state be conceived as a modern system of circulation of the gift? But once such a gift is institutionalized, regulated and sanctioned through legal mechanisms, does it not risk being perverted or corrupted, and/or not leaving room for genuinely altruistic motives? What is more: if the market’s utilitarian logic can corrupt or ‘crowd out’ altruistic feelings or motivations, what makes us think that the welfare state cannot also be a source (...) of corruption? To explain the standard answers to the abovementioned questions as well as their implications I will first re-examine two opposing positions assumed here as paradigmatic examples of other similar positions: on the one hand, Titmuss’s work and the never-ending debate about it; on the other, Godbout’s position, in-so-far as it shows how Titmuss’s arguments can easily be turned upside down. I will then introduce and reinterpret Einaudi’s “critical point” theory as a more complex and richer anthropological explanation of the problems and answers considered herein. Through the analysis of these paradigmatic positions I will develop two interrelated arguments. 1) The way these problems are posed as well as the standard answers to them are: a) subject to fallacies: the dichotomy fallacy and the fallacy of composition; b) too reductive and simplistic: we should at least try to clarify what kind of ‘gift’ or ‘corruption’ we are thinking about, and who or what the ‘giver’, the ‘corrupter’, the ‘receiver’ and/or the ‘corrupted’ party are. 2) The answers to these problems cannot be found by merely following a theoretical approach, nor can they be merely based on empirical evidence; instead, they need to take into account the forever troublesome, ambiguous and unpredictable matter of human freedom. A significant body of research concludes that stable beliefs of perceived consumer effectiveness lead to sustainable consumption choices. Consumers who believe that their decisions can significantly affect environmental and social issues are more likely to behave sustainably. Little is known, however, about how perceived consumer effectiveness can be increased. We find that feelings of guilt and pride, activated by a single consumption episode, can regulate sustainable consumption by affecting consumers’ general perception of effectiveness. This paper demonstrates the impact that guilt (...) and pride have on perceived consumer effectiveness and shows how this effect rests on the ability of these emotions to influence perceptions of agency. After experiencing guilt or pride, consumers see themselves as the cause of relevant sustainability outcomes. The process of causal attribution associated with these emotions influences consumers’ use of neutralization techniques. Through the reduction in consumers’ ability to neutralize their sense of personal responsibility, guilt and pride positively influence perceived consumer effectiveness. The inability to rationalize-away their personal responsibility, persuades consumers that they affect sustainability outcomes through their decisions. The research advances our understanding of sustainable consumption and identifies a new avenue for the regulation of individual consumer behavior that has significant implications for the development of sustainable marketing initiatives. There is, however, little agreement on the meaning of trust, whose conceptualizations differ with respect to actors, relationships, behaviors, and contexts. At present, we know much better what trust does than what trust is. In this article, we present an extensive review and analysis of the most prominent articles on trust in market relationships. Using computer-aided (...) content analysis and network analysis methods, we identify key, recurring dimensions that guided the conceptualization of trust in past research, and show how trust can be developed as a multifaceted and layered construct. Our results are an important contribution to a convergence of research toward a shared and common view of the meaning of trust. This process is important to ensure the body of trust research’s internal theoretical consistency, and to provide reliable and common principles for the management of business relationships – a context in which opportunism and imperfect information may induce economic actors to cheat and stray from fair and ethically compliant behaviors. The article deals with the ambiguous relation between fear and expertise, and examines how it affects institutions’ legitimation. In contemporary societies the so-called expert systems can be considered as powerful trust creators. However their power can also cause fear, as their control over the majority of everyday life tasks can have a “disabling” effect on lay people. This double-edged role deeply influences the relation between citizens and institutions, the latter considerably relying on expertise in order to be perceived as rational (...) actors. Fear, therefore, can be considered as a central element in determining the legitimacy of institutions in modern societies. (shrink)

A growing body of literature documents the important role played by moral outrage or moral anger in stakeholders’ reactions to cases of corporate social irresponsibility. Existing research focuses more on the consequences of moral outrage than a systematic analysis of how appraisals of irresponsible corporate behavior can lead to this emotional experience. In this paper, we develop and test, in two field studies, an extended model of moral outrage that identifies the cognitions that lead to, and are associated with, this (...) emotional experience. This research contributes to the existing literature on reactions to corporate social irresponsibility by explaining how observers’ evaluation of irresponsible corporate behavior leads to reactions of moral anger. The paper also helps clarify the difference between moral outrage and other types of anger and offers useful insights for managers who have to confront public outrage following cases of irresponsible corporate behavior. Finally, the analysis of the causes of stakeholders’ anger at irresponsible corporations opens important avenues for future research that are presented in the paper. (shrink)

In Italian Sign Language (LIS), when past or future time adverbs are present, the signs for verbs exhibit the same manual configurations whether the sentence reports a past event or a future event. Facts of this kind, also observed for American Sign Language (ASL) and other sign languages, have led some authors (Friedman, among others) to conclude that these languages, on a par with spoken languages like Chinese, lack grammatical tense. Neidle et al. and Jacobowitz and Stokoe have challenged this (...) view for ASL and have argued that ASL sentences contain tense markers. I present some data showing that LIS verbs inflect for tense. I argue, moreover, that the apparent lack of tense inflection when LIS past and future time adverbs are present is due to the fact that these adverbs shift the s-point and that LIS past and future tenses are absolute tenses. I provide a formal account of the LIS tense system based on these assumptions. The account is implemented in Heim’s analysis of tense. (shrink)

This article addresses the modern concept of sovereignty as a multivocal and conflictual semantic field, arguing for the necessity to trace its genealogy based on the structural tensions that haunt its logical framework – as well as its representations – rather than on a linear historiographic reconstruction. In particular, the scrutiny I propose aims to examine a series of exchanges that have been characterizing this concept since the beginning: the global and the European, the maritime and the territorial, the colony (...) and the state, the imperial and the proprietary. The problematic balance between ‘imperium’ and ‘dominium’ is indeed assumed here as the turning point of the rise of a sovereign power that appears to be originally rooted in the very production and governance of the global space, thus giving up all possible Eurocentric narratives of modernity. To illustrate my argument, I focus on the frontispieces to three of Thomas Hobbes’s most important books, that is, his translation of Thucydides’ Peloponnesian Wars, De Cive and Leviathan. A thorough analysis of these images enables us to understand how these lines of force traverse the very heart of modern European political concepts, along with the mirroring effects that constantly bounce their normative construction of subjectivity back and forth from the periphery to the centre and, ultimately, from the market to the state. The publication of Guido Calabresi’s book “The Future of Law and Economics” has drawn a substantial amount of attention among law and economics scholars. We thought that the best way to devote special attention to this book was to devote a Special issue to it. This article situates Calabresi’s book among other reflections on the future of the discipline, introduces and explains the reasons behind this Special issue and discuss the organization and content of it. -/- We emphasize how Calabresi’s (...) historical-conceptual standpoint allows him to isolate the stakes of different future developments around the question of how could further appreciation of legal institutions that defy the standard economic assumptions help the field develop theoretically. Overall, the contributors all shared Calabresi’s attempt to restore the balance between Law and Economics and the need to better account for the “whole unanalysed experience of human race”, often neglected by the Economic Analysis of Law approach. Most disagreements are about the ‘how’. In any case, the search for the Law and Economics ‘not (yet) taken’ or for other “Law and … ” approaches is always open to the Future. (shrink)
