Nowadays, consumer ethics represents a relevant field of review. There have been some attempts to conduct literature reviews; however, these have been few and incomplete. For this reason, this paper follows two main objectives: (1) to develop a performance analysis to measure the impact/perceptibility of academic production on consumer ethics (most cited authors, journals and themes) and (2) to visually present the scientific structure by themes of research in consumer ethics as well as its evolution along time. Using SciMAT software, (...) a comprehensive thematic review is discussed. 568 scientific papers (2569 keywords and 8642 citations) were retrieved from the Web of Science from 1995 to 2021 (May). Our results show three main periods with two main research themes (consumer and corporate social responsibility), which remain relevant themes at the time. Also, some new themes that promote ethical consumption have gained weight or appear over time, some of which are linked to the marketing field (such as experiences, satisfaction, attitudes or privacy among others). This article puts forward solutions to some of the ethical and legal dilemmas posed in the current discussion on how to program crash algorithms in autonomous or self-driving cars. The first part of the paper defines the scope of the problem in the criminal legal field, and the next section gives a critical analysis of the proposal to always prioritise the interest of the occupant of the vehicle in situations with conflict of interests. The principle of minimizing social damage as (...) a model for configuring self-driving cars is examined in the third section. Despite its apparent plausibility, within the framework of a liberal legal system that recognises humans as free agents who have rights and responsibilities, maximizing the function of social utility does not justify harmful interference into a person’s legal sphere. Therefore, in the fourth part, the author argues the need to program the crash algorithms of autonomous cars based on a deontological understanding of the system of justifications in criminal law. The solution to the dilemma lies in a prior analysis of the legal positions of all agents involved in the conflict, from a perspective of the principles of autonomy and solidarity as the core of the system of justifications. The necessity defense is barely accepted in contemporary Western case law. The courts, relying on the opinion held by the majority of legal scholars, have reduced its margin of application to practically zero, since in the framework of contemporary welfare states, there is almost always a “legal alternative.” The needy person who acts on their own behalf, regardless of whether they save an interest higher than the one they injure, does not show due deference to democratic legal solutions and procedural (...) channels. This article aims to contest this abrogative interpretation of the necessity defense and to outline the limits of its legitimate scope. Even in welfare states, there are actions in a necessity scenario that neither question the legal decisions of the democratically elected legislature nor make a mockery of established procedural channels. Faced with the inaction of liberal democracies to effectively tackle global warming, many climate activists engage in forms of protests that involve committing minor criminal offences. They seek to shape official decisions on climate policies by resorting to civil disobedience. Some of these activists, rather than accepting punishment, have successfully claimed to be acting in a justified manner by invoking the necessity defence. The aim of this article is to show that, within the framework of representative democracies guided by the (...) rule of law, the climate necessity defence must be rejected, since such protests do not meet the ‘non-legal alternatives’ requirement. This does not mean, however, that protesters should be punished as common offenders. Their acceptance of responsibility and political motivation should be taken into account as a mitigating factor at sentencing. (shrink)

In this paper we aim to think systematically about, formulate, and begin addressing some of the challenges to applying theories of moral responsibility to behaviors shaped by a particular subset of unsettling psychological complexities: namely, implicit biases.

Nursing is at the same time a vocation, a profession and a job. By nature, nursing is a moral endeavor, and being a ‘good nurse’ is an issue and an aspiration for professionals. The aim of our qualitative research project carried out with 18 nurse teachers at a university nursing school in Brazil was to identify the ethical image of nursing. In semistructured interviews the participants were asked to choose one of several pictures, to justify their choice and explain what (...) they meant by an ethical nurse. Five different perspectives were revealed: good nurses fulfill their duties correctly; they are proactive patient advocates; they are prepared and available to welcome others as persons; they are talented, competent, and carry out professional duties excellently; and they combine authority with power sharing in patient care. The results point to a transition phase from a historical introjection of religious values of obedience and service to a new sense of a secular, proactive, scientific and professional identity. Germany is joining a long list of European democracies that have modified or expressed a willingness to modify their citizenship laws to denationalize first and then prevent the return of or expel those citizens accused of having participated in terrorist activities abroad. The formal labelling of citizenship deprivation as an administrative measure outside the scope of criminal justice has prevented scholars of criminal law from undertaking a thorough scrutiny of its legitimacy. In this paper I seek to fill this gap. (...) Specifically, after demonstrating why deprivation of citizenship is a measure of a criminal nature, I argue against its legitimacy, either as a punishment or as a risk-based measure. Instead I propose that we should understand citizenship deprivation as a paradigmatic response from an illegitimate enemy criminal law. Notwithstanding the foregoing, I claim that states that choose to denationalize terrorists should do it within the framework of a process with the highest (criminal procedural) guarantees. (shrink)

Among the advocates of expressive theories of punishment, there is a strong consensus that monetary fines cannot convey the message of censure that is required to punish serious crimes or crimes against the person. Money is considered an inappropriate symbol to express condemnation. In this article, I argue that this sentiment is correct, although not for the reasons suggested by advocates of expressivism. The monetary day-fine should not be understood as a simple deprivation of money, but as a punishment that (...) reduces the offender’s capacity to consume for a certain period of time. Conceived in this manner, I argue that it is perfectly suitable to convey censure. However, the practical impossibility of ensuring that the person who pays the fine is the same person who has been convicted of the offense seriously undermines the acceptability of the monetary fine as an instrument of censure. Minimizing the risk of the fine’s hard treatment being transferred to third parties is a necessary condition for the monetary fine to be considered a viable alternative to lengthy prison sentences. In this paper, we present a new questionnaire for the assessment of self-control as an individual trait. We describe the process of construction of this assessment tool. We also report the results of relevant validation studies. The questionnaire has two independent versions, one based on self-reports and another one based on other-reports. The first version consists of five subscales, called Initiative and Persistence, Proactive Control, Switching and Flexibility, Inhibition and Adjournment, and Goal Maintenance. Seven samples of participants took part in (...) the validation study. The second version has not been split into subscales. Both versions obtained satisfactory indices of internal consistency, assessed with Cronbach’s alpha. The NAS-50 and NAS-40 scores were highly correlated with other measures of self-control, including Tangney, Baumeister, and Boone’s self-control scale. They also proved to be entirely independent of general intelligence. In conclusion, both versions can be regarded reliable and valid enough, and therefore suitable for the assessment of trait self-control for research purposes. (shrink)

Natalia Carrillo and Tarja Knuuttila claim that there are two traditions of thinking about idealization offering almost opposite views on their functioning and epistemic status. While one tradition views idealizations as epistemic deficiencies, the other one highlights the epistemic benefits of idealization. Both of them treat idealizations as deliberate misrepresentations, however. They then argue for an artifactual account of idealization, comparing it to the traditional accounts of idealization, and exemplifying it through the Hodgkin and Huxley model of the nerve (...) impulse. From the artifactual perspective, the epistemic benefits and deficiencies introduced by idealization frequently come in a package due to the way idealization draws together different resources in model construction. Accordingly, idealization tends to be holistic in that it is not often easily attributable to some specific parts of the model. They conclude that the artifactual approach offers a unifying view into idealization in that it is able to recover several basic philosophical insights motivating both the deficiency and epistemic benefit accounts, while being simultaneously detached from the idea of distortion by misrepresentation. Different proprietary databases have been used extensively in research to assess the environmental performance and environmental risk of companies. This study explores the convergent validity of the environmental ratings of MSCI ESG STATS, Thomson Reuters ASSET4 and Global Engagement Services. The study shows that the ratings have common dimensions, but on aggregate, they do not converge. On the environmental opportunity side, KLD environmental strengths, and ASSET4 and GES environmental performance metrics correlate highly and provide convergent scores for US companies from (...) 2003–2011. On the environmental risk side, KLD environmental concerns converge with the GES environmental industry risk and company emissions from the ASSET4 database. Further analysis confirms that industry-related risks are drivers of company-specific environmental performance. (shrink)

Noël Carroll denies and Robert Stecker affirms that it is a necessary condition of aesthetic experience that it should be valued for its own sake. I make use of their controversy to argue for the psychological impossibility of discharging very common practices of art evaluation and analysis without undergoing an aesthetic experience valued for its own sake. By way of supporting my thesis and also making progress in Stecker and Carroll’s dispute about aesthetic experience, I analyse their methodological assumptions and (...) develop further our understanding of negative, indifferent and unexpected aesthetic experiences. El aumento en la producción y consumo de frutas y hortalizas mínimamente procesadas de los últimos años ha con­tribuido a incrementar las toxiinfecciones alimentarias asociadas al consumo de productos vegetales frescos. Esto es debido a que los tratamientos desinfectantes llevados a cabo actualmente por industria de IV gama son insuficientes para garantizar la seguridad microbiológica de los productos finales, y además estos no reciben ningún tratamiento capaz de eliminar todos los patógenos antes de su consumo. Por lo tanto, es necesario (...) utilizar estrategias al­ternativas para reducir los microorganismos patógenos y alteran­tes en frutas y hortalizas. La bioconservación, mediante el uso de microorganismos o sus metabolitos, es una alternativa que, en combinación con las prácticas habituales, puede reducir o prevenir el crecimiento de patógenos en productos mínimamente procesa­dos, mejorando su calidad microbiológica. In this article I argue that a high capacity for courage, in the sense of the strength of character that enables one to face distress, angst or psychological pain, is required of Hume’s ideal critics just as the other well-known five characteristics are. I also explore the implications of my proposal for several aspects of Hume’s aesthetics, including the one brought into relief by Shelley’s interpretation of Hume along the lines of distinguishing between the perceptual and affective stages in aesthetic (...) appreciation. In philosophy of science, abstraction tends to be subsumed under representation, often being described as the omission of a target’s features when it is represented. This approach to abstraction sidesteps cognitive aspects of abstraction processes. However, cognitive aspects of abstraction are important in understanding the role of historically grounded epistemic criteria supporting modeling in science. Drawing on recent work on the relation between metaphor and abstraction, we introduce the concept of paths of abstraction, and use historical and contemporary examples to (...) point to their role in guiding the development of relevance criteria which support modeling strategies in science. The subject of the study is Bernardo Bertolucci's film "The Last Emperor", in particular, the coloristic of the film and the psychology of the image of the main character, which is largely revealed through the color palette and individual artistic details. The object of research is the language of cinematography, cinematographic artistic techniques. Despite the sometimes shocking images and plots, Bertolucci's films were highly appreciated by the international community and domestic film critics due to their artistic solution and topical issues (...) affecting the problems of class struggle and anti-fascist themes. The author of the article examines the image of the main character of the film, Aisingero Pu Yi, the last emperor of China and Manchukuo. The film is based on real historical events taking place in the first half of the 20th century, so the dramatic collisions of the character are not perceived by the viewer as some kind of abstract problem. Against the backdrop of the complex historical changes that China has faced, many questions of the formation and self-determination of the individual are being raised. The image of Emperor Pu Yi is revealed gradually through a comparison of two storylines and the color scheme of the film, since it is the color palette that helps to subtly and meaningfully convey the psychological content of the character. The main research methods are analytical and comparative-historical. The composition of the film and the dynamics of the change in the color palette of individual episodes are analyzed, which makes it possible to trace the evolution of the image. The author comes to the conclusion that it was the coloristic solution of the film that allowed the creators to convey the national color and historical atmosphere of China of a certain historical period and show a vivid image of the protagonist on the screen. Stroke continues to be a leading cause of disability. Basic neurorehabilitation research is necessary to inform the neuropathophysiology of impaired motor control, and to develop targeted interventions with potential to remediate disability post-stroke. Despite knowledge gained from basic research studies, the effectiveness of research-based interventions for reducing motor impairment has been no greater than standard of practice interventions. In this perspective, we offer suggestions for overcoming translational barriers integral to experimental design, to augment traditional protocols, and re-route the rehabilitation trajectory (...) toward recovery and away from compensation. First, we suggest that researchers consider modifying task practice schedules to focus on key aspects of movement quality, while minimizing the appearance of compensatory behaviors. Second, we suggest that researchers supplement primary outcome measures with secondary measures that capture emerging maladaptive compensations at other segments or joints. Third, we offer suggestions about how to maximize participant engagement, self-direction, and motivation, by embedding the task into a meaningful context, a strategy more likely to enable goal-action coupling, associated with improved neuro-motor control and learning. Finally, we remind the reader that motor impairment post-stroke is a multidimensional problem that involves central and peripheral sensorimotor systems, likely influenced by chronicity of stroke. Thus, stroke chronicity should be given special consideration for both participant recruitment and subsequent data analyses. We hope that future research endeavors will consider these suggestions in the design of the next generation of intervention studies in neurorehabilitation, to improve translation of research advances to improved participation and quality of life for stroke survivors. Student academic dishonesty is a pervasive problem for universities all over the world. The development of innovative practices and interventions for decreasing dishonest behaviour requires understanding factors influencing academic dishonesty. Previous research showed that personal, environmental, and situational factors affect dishonest behaviour at a university. The set of factors and the strength of their influence can differ across countries. There is a lack of research on factors affecting student dishonesty in Russia. A sample of 15,159 undergraduate students from eight Russian (...) highly selective universities was surveyed to understand what factors influence their decision to engage in dishonest behaviour. Ajzen’s Theory of Planned Behaviour was employed to explain dishonest behaviour among students. The explained variance in the engagement in academic dishonesty equals 48% in the model for the full sample, and reaches 69% in the model for one of the considered institutions. The major findings of this study were: subjective norms appeared to dominate as the strongest predictor of academic dishonesty across the Russian universities; perceived behavioural control, appeared to be positively related to the dishonest behaviour. In the majority of universities, this factor was found to be insignificant. This finding indicates a specific feature of Russian students’ an ethical decision-making process discussed in the last part of the paper. (shrink)

The purpose of the study is to develop methodological recommendations for strategic planning of the development of enterprises in the sphere of material and technical supply of agriculture on the basis of the theoretical provisions of strategic management. The article focuses on the specifics of the considered wholesale sector, certain aspects of the marketing strategy of enterprises in this area, the recommended parameters of the customer survey, the possibilities of using the balanced scorecard and the justification of the economic feasibility (...) of the planned activities. The scientific novelty of the work carried out consists in identifying the features of developing a strategy for wholesalers of agrochemical products and forming an appropriate methodological complex. As a result, various aspects of substantiating strategic directions of development were demonstrated using specific examples and the advantages of measures for their implementation were argued. Au début du xxe siècle, les pratiques physiques d’entretien s’organisent autour du culte de la force, tant dans les sociétés militaires que dans les gymnases de culture physique. Le choix d’une telle pratique permet alors de se conformer aux normes de la masculinité hégémonique. La gymnastique d’entretien pour les femmes se développe en marge mettant en avant des valeurs plus conformes aux attendus médicaux et sociaux, sous contrôle masculin. Dans les années soixante-dix la Gymnastique Volontaire offre des caractéristiques structurelles et (...) idéologiques proches de cette conception. La transformation est inéluctable d’un territoire masculin à un territoire féminin. Malgré la permanence d’une tutelle masculine au plus haut-niveau de responsabilités, le dynamisme de ces femmes au niveau local en fait les véritables actrices d’une pratique développée alors par et pour elles.
