This paper examines the shareholder primacy norm as a widely acknowledged impediment to corporate social responsibility and explores the role of business schools in promoting the SPN but also potentially as an avenue for change by addressing misconceptions about shareholder primacy and the purpose of business. We start by explaining the SPN and then review its status under US and UK laws and show that it is not a likely legal requirement, at least under the guise of shareholder value maximization. (...) This is in contrast to the common assertion that managers are legally constrained from addressing CSR issues if doing so is inconsistent with the economic interests of shareholders. Nonetheless, while the SPN might be muted as a legal norm, we show that it is certainly evident as a social norm among managers and in business schools—reflective, in part, of the sole voting rights of shareholders on corporate boards and of the dominance of shareholder theory—and justifiably so in the view of many managers and business academics. We argue that this view is misguided, not least when associated with claims of a purported legally enforceable requirement to maximize shareholder value. We propose two ways by which the influence of the SPN among managers might be attenuated: extending fiduciary duties of executives to non-shareholder stakeholders and changes in business school teaching such that it covers a plurality of conceptions of the purpose of the corporation. The cyborg that Donna Haraway appropriated in ‘Manifesto for Cyborgs’ as a metaphor for political action and theoretical inquiry has ceased to have the potency it did 20 years ago. While Haraway has turned from a central focus on technoculture to companion species, much important cultural work remains to be done, especially in networked and programmable media. Problems with the cyborg as a metaphor include the implication that the liberal humanist subject, however problematized by its hybridization with cybernetic mechanism, continues (...) as a singular entity operating with localized agency. In a word, the cyborg is not networked enough to encompass the emergent possibilities associated with the Internet and the world-wide web and other phenomena of the contemporary digital era. Instead I propose the idea of the cognisphere. As operational concept and suggestive metaphor, the cognisphere recognizes that networked and programmable media are not only more pervasive than ever before in human history but also more cognitively powerful. It is closely associated with what many researchers regard as a major insight: the idea that the physical world is fundamentally computational. While these scientists regard computation as a physical process, the cultural critic is apt to see it as an over-determined metaphor. The binary choice between seeing the computational universe as a literal description of the physical world and reading it as an over-determined metaphor misses a crucial aspect of contemporary cultural dynamics: the interaction between means and metaphor, technology and cultural presupposition. Taking this dynamic into account leads to a more complete understanding summed up in the aphorism, ‘What we make and what we are co-evolve together.’. (shrink)

The essay replies to comments by Finnis, Gardner and Endicott, on my book, Law as a Moral Idea. It is questioned whether Finnis is right to suggest that governance by law is a requirement of justice. It is suggested that Hart's positivism may have rested upon an unduly private conception of morality. Gardner's suggestion that Law as a Moral Idea falsely manufactures disagreement with Hart is rejected, principally by pointing out that Gardner focuses upon only one issue, where the book (...) already acknowledges that Hart might conceivably agree, and ignores other issues where the disagreement with Hart seems indisputable. In response to Endicott, it is acknowledged that 'politics' could be understood as a moral idea comparable to the idea of 'law', but denied that this robs either thesis of interest. The nature of doctrinal reasoning and law's justificatory force is then discussed. (shrink)

There were five kinds of cyber deterrence presented at the workshop on Landscaping strategic cyber deterrence, hosted at the Oxford Internet Institute. They were the well-studied areas of deterrence by ‘punishment’ and ‘denial’, and the novel concepts of deterrence by ‘association’, ‘norms and taboos’, and finally, ‘entanglement’. In the following workshop commentary, I present these five kinds of deterrence and explain them in light of recent developments in the academy and industry. I argue for analytical congruence between all three novel (...) concepts, since they aim to alter the behaviour of actors by adding a social cost in response to breaking norms and conventions. Throughout, I argue that we are beginning to understand how cyber deterrence works, both in theory and practice, and when all concepts are taken together, they become more than the sum of their parts. Finally, I point out an omission of the workshop, where computational modelling and simulation could be added to the landscape of strategic cyber deterrence. (shrink)

The purpose of this study is to reveal the function of the concept of Infāq, which is included in the terminology of the Qurʾān itself, in social assistance and solidarity. Poverty has always been one of the social problems from past to present. Although it is analyzed differently in each society via different criteria, poverty generally refers to the condition in which a person lacks the basic necessities for a minimum living standard. Unfortunately, millions of people starve for basic biological (...) and social needs such as nutrition, shelter, education, health, and even water. This is a shame for the humanity. There are both international and national charities working to reduce the misery and poverty. However, due to socio-economic and structural problems such as globalization, disproportion in income distribution, unemployment, overpopulation, economic crises, lack of social security systems, and wars, poverty rises gradually and it is still one of the major social problems needed to be solved. Islam which is the last one of Abrahamic religions and its holy book Qurʾān consider social cooperation and solidarity pretty important within the context of Infāq and hold the believers responsible for the organization of social life. Infāq is an umbrella concept in the Qurʾān, referring to all expenses and cooperation in the name of Allah and it is one of the main qualities of believers. Infāq, which includes other forms of cooperation such as obligatoryalms (zakāt) and charity (ṣadaqā), enables a person to share his tangible values with those who have worse life conditions than himself. In this way, the Quran aims to promote human relations and thereby enhancement and peace in the society. In other words, Infāq aims to eliminate social injustice which refers to social and economic inequalities, to protect the economically weak people against the difficulties in life, and thereby, to maintain economic and social stability. Helping the needy is a powerful path toward having spiritual peace, removing selfish feelings, and keeping emotional wellbeing. People with good mental health will be able to build more humane relationships with others. It is obvious that Infāq would play an important role inbuilding a sense of fellowship and trust. A wealth of person who shares his wealth with the poor will be deemed legitimate by the needy people. Thus, the needy people would be freed from negative feelings and behaviors such as jealousy, incapacity, hatred, bullying, and hostility, and feel a sense of fellowship and gratitude towards those who have better life conditions. One of the most important reasons for robbery, extortion, purse-snatching, and etc., which are currently occurring more frequently, is economic deprivation. Considering the fact that this kind of incidents takes place more frequently in poor countries than developed ones, it is obvious that Infāq has a strategic role in fulfilling the basic needs of the needy. Poverty might be linked to violence, which might end up with murder. Infāq which is divine cooperation approach would take an important role in fighting against criminal incidents that cause fear and indignation. Moreover, the Quran does not specify any certain economic condition to be able to do Infāq, and thereby, it makes people with various economic abilities become a part of the social cooperation. As everyone would take care of people who are relatively worse off, interindividual trust will be strengthen and circle of cooperation will be expanded. According to the Qurʾān, people’s all goods and possessions actually belong to Allah. People are just the trustees of this wealth. Allah grants as much wealth as He wills to whomever He wills. While the rich is responsible for sharing their wealth with the needy, the poor is responsible for bearing the troubles caused by poverty with patience and endeavoring to make money in a halal way. Unless Infāq is done in order to please Allah, it does not have any significance in the presence of Allah. The reason why people have different material living conditions is that both the poor and the rich are subject to test. Thus, they would get rewards for hereafter besides the sustaining of social unity and solidarity. Allah is the only warrantor of the tangible and spiritual wealth gained in return for Infāq. A recent decision by several Australian State politicians to support a parliamentary review of artificial water fluoridation has an intensified debate on the public health intervention. While there is a majority agreement among Australian dentists and other health professionals that adequate enamel fluoride is essential for dental health, the ethics of artificial fluoridation of public water supplies as a contemporary vehicle for facilitating adequate supply of fluoride to teeth is highly contested. Opponents of artificial water fluoridation insist that there are (...) many alternative sources of fluoride, that mandatory water fluoridation violates the ethical principle of autonomy and that water fluoridation is not only expensive and unnecessary but also may endanger health by causing fluorosis and, potentially, hypothyroidism and pathological bone fractures. In contrast, proponents of water fluoridation posit that mandatory water fluoridation facilitates health equity and that the benefits accruing to society from prevention of dental caries (beneficence principle) outweighs impairment of individual autonomy. This article utilizes Childress’ ‘justificatory conditions’ to evaluate the ethical appropriateness of artificial water fluoridation in Australia. The author concludes that there is insufficient ethical justification for artificial water fluoridation in Australia. (shrink)

Marx believed that what most clearly distinguished him and Engels from the nineteenth-century French socialists was that their version of socialism was “scientific” while the latters' was Utopian. What he intended by this contrast is roughly the following: French socialists such as Proudhon and Fourier constructed elaborate visions of a future socialist society without an adequate understanding of existing capitalist society. For Marx, on the other hand, socialism was not an idea or an ideal to be realized, but a natural (...) outgrowth of the existing capitalist order. Marx's historical materialism is a systematic attempt to discover the laws governing the inner dynamics of capitalism and class societies generally. Although this theory issues in a prediction of the ultimate triumph of socialism, it is a commonplace that Marx had little to say about the details of post-capitalist society. Nevertheless, some of its features can be discerned from his critical analysis of capitalism and what its replacement entails. (shrink)

The article considers the nature of legalistic, or formal, conceptions of the rule of law, focusing particularly on the work of Joseph Raz and Albert Venn Dicey. It asks how such apparently narrow conceptions are generated, and how far they can resist including broader social claims. It concludes that the rationale behind legalistic conceptions compels them to address issues of poverty and the literacy of the law's subjects. However, legalistic conceptions of the rule of law can still avoid sliding into (...) the wider non‐legalistic models advanced by writers such as T. R. S. Allan. (shrink)

Background: We were finding volunteers for functional magnetic resonance imaging studies with abnormalities requiring referral surprisingly frequently. The bioethics surrounding the incidental findings are not straightforward and every imaging institution will encounter this situation in their normal volunteers. Yet the implications for the individuals involved may be profound. Should all participants have review of their imaging by an expert and who should be informed? Methods: The normal volunteers that were imaged with magnetic resonance (MR) which were reviewed by a consultant (...) neuroradiologist. All participants completed a volunteer consent form in addition to a standard departmental MR safety screening form. The volunteer screening form requires the general practitioner details to be completed and asks the participant to consider closely the possibility and implications of finding an unexpected but potentially serious abnormality before signing. Results: 525 different individuals were scanned as normal volunteers, the mean age was 35-years and 330 were males. Of these 525, 46 had definite significant abnormalities (8.8%), mean age 50-years. Conclusion: We have found a high rate of incidental abnormalities amongst individuals participating in imaging studies at our institution. It is our current practice to inform the research study participant of the findings, counsel them and inform their primary care physician. We think that it is advisable for researchers utilising MR imaging of the brain to have access to trained neuroradiologists, a protocol in place to deal with this problem and take consent in a way that allows the participant to realise the possibility of an abnormal finding. The automatic verification of large parts of mathematics has been an aim of many mathematicians from Leibniz to Hilbert. While Gödel's first incompleteness theorem showed that no computer program could automatically prove certain true theorems in mathematics, the advent of electronic computers and sophisticated software means in practice there are many quite effective systems for automated reasoning that can be used for checking mathematical proofs. This book describes the use of a computer program to check the proofs of several celebrated (...) theorems in metamathematics including those of Gödel and Church-Rosser. The computer verification using the Boyer-Moore theorem prover yields precise and rigorous proofs of these difficult theorems. It also demonstrates the range and power of automated proof checking technology. The mechanization of metamathematics itself has important implications for automated reasoning, because metatheorems can be applied as labor-saving devices to simplify proof construction. (shrink)
