This paper suggests philosophical foundations for mixed methods research based on the philosophy of critical realism. In particular, it suggests that the critical realist idea of the primacy of ontology helps bridge the apparent paradigmatic gap between qualitative and quantitative research. It illustrates this foundational idea by showing why and how a multi-disciplinary team used a mixed methods approach to understand the significance of religion in prison through a multi-site study of religious conversion to Islam in prison and how this (...) gives a better account than a single method approach. ABSTRACT Critical realist thought has theorised convincingly that epistemic relativism is constellationally embedded in ontological realism which in turn necessitates judgemental rationality. In social science, judgemental rationality involves acting upon plausible decisions about competing points of view. However, the tools for doing this are, as yet, under-articulated. This paper addresses this absence by articulating triangulation and depth-reflexivity as two tools for doing judgemental rationality in empirical research. It draws on the experiences of a diverse team working on an international comparative (...) research project on conversion to Islam in prisons. It demonstrates how epistemic and relational gaps between researchers and research subjects can be bridged by mobilising the ‘laminated’ properties and personal attributes of a diverse research team that factors in attributes that are absent as well as those present. Medieval Muslim scholars unequivocally prohibited the torture of prisoners of war out of a concern for maintaining theoretical constructs about the boundaries of the Muslim and non-Muslim communities. Muslim scholars worried that the torturing prisoners of war would compromise values and ideals predicated on such constructs, and that the demands of citizenship trumped any benefit to the Muslim community that might accrue from torture.

This article documents and illustrates widespread patterns of abuse in American jails in general and for 9/11 Muslim detainees in particular. The purpose of this article is to illustrate that prison abuse depicted in the photographic images of the Iraqi prison is not an exception, rather it is an everyday experience for many prisoners in the US. While military guards of the Abu-Ghraib prison left clear evidence of their abuse, a lack of photos and documentation of abuses in (...) American prisons may reflect the guards' familiarity with concealing evidence. It does not imply, however, that abuse and torture is rare in American jails. (shrink)

“A Common Word Between Us,” an open letter from Muslim scholars to Christian leaders, is the most developed effort at Muslim-Christian reconciliation to date. Endorsed by well-known Muslim scholars from diverse sects and backgrounds, the letter emphasizes the central role of love of God and the Golden Rule in both religions and cites the catastrophic consequences of conflict. The signatories frame a norm of interreligious covenant for constructive collaborations, present their argument as an authoritative Islamic position, and (...) effectively reject the clash-of-civilizations narrative. Using game-theory models to articulate strategic challenges facing interreligious initiatives, this essay argues that a norm of interreligious covenant can potentially produce successful collective action in situations resembling both coordination and prisoner's dilemma games, depending on the success of norm entrepreneurship. Gramsci recognised the inestimable historical contribution of Muslim and Arab civilisations, writing on these in his newspaper articles, his pre-prison letters and the Prison Notebooks. The Islamic world contemporary with him was largely rural, with the masses heavily influenced by religion, analogous in some ways to Italy whose economy was still largely oriented towards a peasantry among whom the Vatican played a leading role. In addition to factors such as the politics-religion nexus, what Gramsci was also analysing, without saying (...) as much explicitly, was the upheaval caused by the disintegration and dismemberment of the Ottoman Empire, and the inter-imperialist rivalries over the spoils and the construction of new states from its ruins. Here he draws attention to the first hesitant and contradictory anticolonial stances being adopted among the traditional leaders, as well recognising the basis for more popularly-based movements. In both Catholic countries and, as Gramsci knew especially from the experience of his Comintern work, in parts of the Muslim world, these movements could at times assume a left and politically radical orientation. What emerges is a picture of conflicting hegemonies involving principally religion, class, the political ambivalence of many religious leaders, and a burgeoning nationalism contraposed to the supra-nationalist claims of religion. But the factor underlying everything is the potential of the masses who, if awakened from torpor and detached from European colonialism, were judged capable of rupturing previous imperially-determined equilibria. The contemporary Qur’anic studies have been marked by amazing development. Various methods and approaches to understand the Qur’an are offered by the scholars. One of the prominent figures in this field is Nashr Hamid Abu Zayd. Nasr Hamid Abu Zayd (1943–2010 M) is a highly controversial contemporary thinker. He is an Egyptian scholar who is accused of being apostate, because of his theory of qur’anic hermeneutic (the textual of Qur’an). This is reflected in his stances towards contemporary religious discourse and (...) the approach to reading religious texts, especially the Quran, which requires reading according to a hermeneutic mechanism. His books ‘Naqd al-Khitab al-Dini (Criticism of Religious Discourse)’ and ‘Al-Takfir fi Zaman al-Takfir (Thinking in the Time of Atonement)’ caused a great uproar in the early nineties of the last century. Abu Zayd was accused of criticising atheists because of their stances on the text. Therefore, this study aimed to discuss Abu Zayd’s position on contemporary religious discourse and his new approach to reading religious texts, and also aims to discuss why Abu Zayd’s theory has been string up Islamic world and ending by his expulsive from his native country. To deal with this problem, this article discusses Abd Zayd’s biography and some cultural framework of his people. The methodology of Qur’anic hermeneutic is the least his. Having examined the topic, the author finds that Abu Zayd believes that modem literary theory and criticism denote the way to understand and interpret the Qur’an ‘objectively’. Compromise is surprisingly common in the context of religious freedom. In Holt v. Hobbs, for example, a Muslim prison inmate challenged his prison’s no-beards policy on religious freedom grounds. He proposed, and was eventually granted, a compromise that allowed him to grow a half-inch beard rather than the full beard normally required by his beliefs. Some have argued that such a compromise is inconsistent with the purpose of religious freedom, which is to guard against interference with an individual’s religious (...) practices. Accepting a compromise, after all, may require a significant modification to one’s default practices. But this paper argues that compromise can be appropriate if the purpose of religious freedom is to foster the inclusion and acceptance of all people in a diverse political community. Moreover, the benefits of compromise may lend support to the inclusion-based conception of religious freedom as against the more traditional non-interference conception. (shrink)

American Muslims increasingly negotiate their relation to a government that is suspicious of Islam, yet which is legally obligated to recognize them as rights-bearing citizens. To better understand how the post-9/11 state is reshaping American Islam, I examine the case of Muslim American dissident Tarek Mehanna, sentenced to seventeen years in prison for providing material support for terrorism, on the basis of his controversial words (USA v. Islam’s distinctive approach to antisocial behaviour, repentance and forgiveness needs to be better known among social administrators, particularly in the probation service.

Medieval Muslim scholars were challenged with squaring their conceptions of prophetic infallibility with reports that Muhammad disobeyed revelatory commands from God. The manner in which they rehabilitated the prophetic image in these cases had corresponding repercussions in the fields of jurisprudence, theology, and legal theory. The present article uses the case of Q. 8:67 to demonstrate the intertwined nature of the Islamic sciences and the stakes involved when delimiting the prophetic ability to err and/or disobey God.

But their calculations are debatable. My view is that we should do bombings in conflict areas not in peaceful areas. We have to target the place of the enemy, not countries where many Muslims live. Q. What do you mean by “wrong calculation,” that the victims included Muslims? A. That was one them. In my calculation, if there are bombings in peaceful areas, this will cause fitnah [discord] and other parties will be involved. This is my opinion and I could be wrong. In lieu of an abstract, here is a brief excerpt of the content:One True Ring or Many?Religious Pluralism in Lessing's Nathan the WiseChristopher AdamoIn the Central Scene of Nathan the Wise, Nathan responds to Saladin's pointed question pertaining to the "true religion" with the famous parable of the three rings.1 As John Pizer notes, Lessing deliberately crafts ambiguous fables to cultivate the reader's capacity for autonomous exercise of hermeneutic skill.2 That Gotthold Ephraim Lessing's Nathan the Wise evokes a wide variety (...) of interpretations, therefore, should be no surprise.3 However, for Pizer, Lessing's use of fable additionally represents a "key to his Enlightenment ideals, the inculcation of the idea that individuals are responsible for their own actions and for their own maturation as social beings, as later articulated by Kant" (Pizer, p. 101). If the genre of fable itself, for Lessing, serves as a pedagogic tool to cultivate in his readers the rational autonomy as envisioned by Kant in the opening lines of "What is Enlightenment?," then might that suggest Lessing's ring-parable is best read as an Enlightenment-humanist response to the theological and political problem of the plurality of revealed religions?Several recent Lessing scholars have taken this line. In his study Lessing's Philosophy of Religion and the German Enlightenment, Toshimasa Yasukata approvingly reads the parable of the rings as illustrative of Lessing's view of a "true religion" that "transcends all of the historical religions and yet underlies the truth of each.... [A] religion based on real and universal humanity."4 Astrid Oesmann, in her article "Nathan der Weise: Suffering Lessing's 'Erziehung,'" develops a similar interpretation but then, based upon it, turns a critical eye toward such a project as it requires Nathan to suppress his Judaic identity—not merely in his confrontation with Saladin but additionally by suppressing his suffering [End Page 139] at the hands of a Crusader pogrom that took the lives of his wife and seven children.5 For both these commentators, Lessing's Nathan the Wise champions a vision of a universal religion based on reason alone, for good or for ill.With this interpretation of Lessing's Nathan in the background, I intend to highlight moments in Lessing's Nathan that invite a more pluralistic reading. Both readings above interpret the ambiguous ending of the parable in light of the teleological history of revealed religion constructed by Lessing in "The Education of the Human Race" thus, implying there remains a singular, genuine, ring, i.e., a "true" religion that even may be identifiable with one of the three in question. The reading developed here interprets the ambiguous ending of the ring parable in light of the final scenes of Nathan, focusing on Recha's rich genealogical origins and her universal regard among persons of diverse faiths. The question as to which is the correct [recht] ring gives way to the question of which bearer(s) possesses a genuine [echt] ring, a significant shift in focus and reflective of Lessing's "primacy of ethics" over explanation in an approach to the plurality of revealed religions.6 Second, though both an Enlightenment reading and the present reading move the focus of religion away from orthodoxy towards a primacy of ethics, the present reading would be better equipped to respond to a charge like Oesmann's that defusing inter-religious tensions in a multicultural polity can come only by the sacrifice of one's cultural and historical particularity as Jewish, Muslim, Christian.INathan the Wise is set in Jerusalem during the close of the Third Crusade (1189–1192). Plato first selected them as the four premier virtues, but they go back at least to Homer, for whom wily Odysseus exemplified prudence, warlike Achilles courage, old Nestor justice, Penelope and Telemachus, Odysseus' wife and son, temperance. And I offer them as central to living the morally good life required to "rebuild civilization" in an America that so fair and judicious a man as Cardinal George could call a "ruined society." To see the need for Thomas's solution, we must begin with the problem. Now, all societies depend upon the deep and fundamental ideas of the most important thinkers, prophets and sages, saints, and yes, even philosophers. So, ignorance of history makes it difficult to deal with present problems caused by those ideas.My first conclusion will be that a major cause of the current coarsening of our culture is the group of ideas of the French philosopher Jean Paul Sartre, even though most Americans have never heard of him, and most of those who recognize his name have not read his works carefully enough to see the connection. So let us begin with the theory and practice of Sartre and his long-time lover Simone Beauvoir, whose book The Second Sex was an intellectual spark for the women's liberation movement. Then we turn to some real-life examples of Sartrean influence on ourselves and American culture. The concubines, with whom the sultans lived a family life, were classified according to a certain hierarchy in the Harem. The first wives of the sultan and those who gave birth were called Kadınefendi. The other wives with a lower status than the Kadınefendi wives were called Ikbal Hanımefendi. According to Islamic law, marriage with a concubine is not like a marriage with a free woman. If a marriage is desired, the concubine must be freed. Until the 19th century, sultans (...) did not marry their concubines for a few exceptions. In the 19th century, the legal status of concubines in the Ottoman Empire became controversial. The countries of origine changed when the Ottoman Empire was unable to conquer new territory. Consequently, the enslavement procedure of prisoners of war disappeared. Instead, Caucasian immigrants, who had to leave their homeland mainly due to the Russian attacks, gave their daughters to the Ottoman palace so that they would not suffer misery and could reach important positions in the future. Among these were orphans from poor families as well as those from noble Caucasian dynasties. Even though the young women in the palace were called concubines, at least some of them were free/Muslim persons. This meant, that they could not be enslaved according to Islamic law. Although there was no problem for those who served in the palace, a remarkable situation emerged for the would-be spouses of the sultan. Could a woman from a free and Muslim family be the sultan's wife without a marriage bond? Was the limitation of the Kadınefendi numbers to four (in times of Sultan Abdülaziz) due to the Islamic law principle, that a man could marry maximum four wives? Was there a marriage ceremony (nikāh) for Kadınefendi wives? What was the situation of the Ikbal? Satisfactory answers to these questions have not been given yet. However, there are no official records it was claimed that lately sultans married especially their concubines who were Abkhaz descendants and included them among their wives in this way, because they were free and Muslims. Thus, the matter whether Sultan Abdülhamid II's wives were concubines or wedded became the subject of some research today. Memoires claim that almost all of Sultan Abdülhamid's wives were free and of Muslim origin. According to this, it was said that the wives of Sultan Abdülhamid could not have the status of the concubine and that their relationship should have been by marriage. On the other hand, considering that a maximum of four women can be married according to Islamic law, the marriage of the Sultan, who had thirteen wives, raised juristic questions. This problem was most clearly seen in the inheritance case filed by his heirs after the death of Sultan Abdülhamid. In this case, where it was claimed that Sultan Abdülhamid was married to nine wives, no objection was made to that claim. In this study, information about the wives of Sultan Abdülhamid and their legal status was tried to be determined through the documents related to their salaries during the 2nd Constitutional Era. Besides, the issue of nine wedded women, which emerged in the case of Sultan Abdülhamid's inheritance, was evaluated in terms of fiqh (Islamic jurisprudence). Sultan Abdülhamid was never accused of marriages contrary to Islamic law by his opponents during and after his reign. From this point of view, it can be said that there was no situation contrary to Islamic law regarding the Sultan's harem at that time. This might be due to three possibilities: Firstly, some wives have concealed the truth in the court, which is the weakest possibility according to the data obtained. Secondly, the talaq (divorcement) was hidden by Sultan Abdülhamid and his wives were not aware of it. This possibility has been found to be problematic when evaluated in terms of Hanafi fiqh. Instead of being killed by enemies, for the sake of honor, she chose to be killed by ritual suicide by her own vassals. Garasha's servants wanted to die with her according to tradition, but she let them run away. The servants testified about her death to Jesuit missionaries. According to the missionaries, Garasha chose to be killed by her vassals because it was honorable as the wife of Lord Hosokawa. We make the case that the Prisoner’s Dilemma, notwithstanding its fame and the quantity of intellectual resources devoted to it, has largely failed to explain any phenomena of social scientific or biological interest. In the heart of the paper we examine in detail a famous purported example of Prisoner’s Dilemma empirical success, namely Axelrod’s analysis of WWI trench warfare, and argue that this success is greatly overstated. Further, we explain why this negative verdict is likely true generally and not just (...) in our case study. We also address some possible defenses of the Prisoner’s Dilemma. (shrink)

Prison as a Torturous Institution Philosophers working on torture have largely failed to address the widespread use of torture in the U.S. prison system. Drawing on a victim-focused definition of torture, I argue that the U.S. prison system is a torturous institution in which direct torture occurs (the use of solitary confinement) and in which torture is allowed to occur through the toleration of sexual assault of inmates and the conditions of mass incarceration. The use and toleration of torture expresses (...) and reinforces the moral exclusion of those subjected to it, particularly African Americans. Importantly, this moral exclusion and the experience of torture may be created and reinforced through institutional practices independently of the intentions of individuals acting within those institutions. By prioritizing torture victims’ experiences and severing the link between torture and intention, my account forces a recognition that, far from being inconsistent with U.S. values, torture is deeply embedded within U.S. institutions. Money becomes the medium of all value. Solidarity and good will are invalidated. Relationships are conducted on a quid pro quo basis. Prisons are a feminist issue. This chapter offers an account of central issues and themes in feminist philosophical work on prisons, examples of important contributions, and future directions for feminist work in the field. It does so, however, in a way that consciously deploys a feminist methodology that resists the replication of hierarchical norms and structural violence in the very doing of theory and history. In this spirit, it emphasizes the record of struggle across the prison’s history, the resistance efforts (...) that live behind individual academic theories, the conceptual frameworks generated by groups bearing the brunt of carcerality, and it investigates alternative strategies of harm reduction developed across those communities. The chapter closes with an explicit exploration of prison abolitionism, which works not only to radically rethink punishment but also to shift the locus of voice and leadership. In so doing, the chapter aims to review, as much as to create anew, a feminist theoretical analysis of prisons. (shrink)

As these opening quotes acknowledge, the Prisoner’s Dilemma (PD) represents a core puzzle within the formal mathematics of game theory.3 Its rise in conspicuity is evident figure 2.1 above demonstrating a relatively steady rise in incidences of the phrase’s usage between 1960 to 1995, with a stable presence persisting into the twenty first century. This famous two-person “game,” with a stock narrative cast in terms of two prisoners who each independently must choose whether to remain silent or speak, each (...) advancing self-interest at the expense of the other and thereby achieving a mutually suboptimal outcome, mires any social interaction it is applied to into perplexity. The logic of this game proves the inverse of Adam Smith’s invisible hand: individuals acting on self interest will achieve a mutually suboptimal outcome. Prisoner's dilemmas can lead rational people to interact in ways that lead to persistent inefficiencies. These dilemmas create a problem for institutional designers to solve: devise institutions that realign individual incentives to achieve collectively rational outcomes. I will argue that we do not always want to eliminate misalignments between individual incentives and efficient outcomes. Sometimes we want to preserve prisoner's dilemmas, even when we know that they systematically will lead to inefficiencies. No doubt, prisoner's dilemmas can create problems, but they (...) also create opportunities to practice the cooperative norms that make market institutions possible in the first place. An ethical market culture, I argue, benefits from the presence of prisoner's dilemmas. I first consider standard approaches for solving prisoner's dilemmas. I then argue for the value of prisoner's dilemmas. Finally, I show the significance of this argument for advocating codes of business ethics. (shrink)

In the classic abolitionist text, Prison on Trial, Thomas Mathieson argues that imprisonment cannot be justified by appeal to any standard punitive aim: rehabilitation, deterrence, incapacitation, or retribution. The aim of this paper is to give prison an ‘appeal hearing’: to examine whether it can be justified by a set of punitive aims not considered by Mathieson. In particular, it asks whether imprisonment can be justified by the ‘communicative’ theory of punishment proposed by Antony Duff. Duff sees imprisonment as having (...) an important role in a properly ‘communicative’ system of criminal justice: to serve as the ultimate sanction for offenders who fail to comply with other forms of punishment; to shock offenders into repentance for their crimes; and to communicate to offenders in a symbolically appropriate way the seriousness of their offence. This paper argues that each of Duff’s rationales fails: using prison as an ultimate sanction violates the communicative principle of treating offenders as responsible moral agents; the evidence suggests that prison will impede rather than facilitate repentant understanding; and while prison might be able to express censure, it is not rationally connected to enabling a meaningful moral dialogue. As such, it concludes that this particular appeal hearing for imprisonment fails. (shrink)

The literature analysing Muslim perspective towards other religions is now quite extensive. However, when it comes to Muslim’s perspective towards Buddhism, the scholarship lags far behind. This article aimed to identify the Muslim views on Buddhism from a theological and philosophical framework. The Muslim views have a different category, on categorising Buddhism, the status of Buddha as a Prophet, and Buddhist as the People of the Book. Each view provides a different framework of Muslim perspective (...) towards Buddhism. From the theological view, one of the outlook is tolerance. Due to the rejection of Buddhist doctrine by most Muslim theologians, Muslims apply tolerance, which is subject to religious freedom stand on, ‘firm in principle, tolerant in attitude’. Tolerance encourages Muslims to adhere to the principles of truth, but does not erode the respect for other religion. While from a philosophical view, it considered Buddhism as a religion from God, as well as other religions. Thus, some Muslim inclusivists and pluralists recognise Buddhism. This research is qualitative. The method used in this research is descriptive-analytic, emphasising content analysis of the data from various books and articles covering Muslim view on Buddhism and the patterns of relations between Islam and Buddhism. Studies suggest the understanding of each framework to encourage Muslims to improve comprehensive interreligious dialogue with Buddhists.Contribution: Religious tolerance, inclusivism, and pluralism is a panacea to inordinate and incessant religious conflict, if given its proper place in Malaysia, it will breed harmony and peace in the society. This work would be of immense benefit to interfaith scholars and religious leaders across all strata of discipline. (shrink)

This article examines Thomas Hobbes’s notorious claim that “fear and liberty are consistent” and therefore that agreements coerced by threat of violence are binding. This view is to a surprising extent inherited from Aristotle, but its political implications became especially striking in the wake of the English Civil War, and Hobbes recast his theory in far-reaching ways between his early works and Leviathan to accommodate it. I argue that Hobbes’s account of coercion is both philosophically safe from the most common (...) objections to it and politically superior to the seemingly commonsensical alternatives that we have inherited from Hobbes’s critics. It is illegitimate to read any ontology about "race" off of biological theory or data. Indeed, the technical meaning of "genetic variation" is fluid, and there is no single theoretical agreed-upon criterion for defining and distinguishing populations (or groups or clusters) given a particular set of genetic variation data. Thus, by analyzing three formal senses of "genetic variation"—diversity, differentiation, and heterozygosity—we argue that the use of biological theory for making epistemic claims about "race" can only seem plausible when it relies (...) on the user’s own assumptions about race; the move from biological measures to claims about “race” inevitably amounts to a pernicious reification. We also excavate assumptions in the history of the technical discourse over the concept of "race" (e.g., Livingstone's and Dobzhansky's 1962 exchange, Edwards' 2003 response to Lewontin 1972, as well as contemporary discussions of cladistic "race", and "races" as clusters). We show that claims about the existence (or non-existence) of "race" are underdetermined by biological facts, methods, and theories. Biological theory does not force the concept of "race" upon us; our social discourse, social ontology, and social expectations do. We become prisoners of our abstractions at our own hands, and at our own expense. (shrink)

This paper provides a detailed discussion of the questions relating to the role of the researcher in relation to the researched when the researcher and the researched are both of Muslim origin. Issues relating to questions of objectivity, transparency, bias and interpretation are elaborated upon as part of the analysis of impacts and outcomes in relation to methodological process. It is argued that, ultimately, the subjective positions of researcher and researched are less important than the objective nature of the (...) research process. The intention of this paper is to convey, to other Muslim and non-Muslim social researchers engaged in research on Islam and Muslims, how to avoid or identify the range of risks and pitfalls that may emerge in operationalising and evaluating social research in a highly charged political, cultural and social research arena. This paper is trying to examine istinbat method which is used in those two forums considering their position in the theory of al-Sabit and al-Mutahawwil. By conducting a literature study, the author concludes that the outcomes of Muktamar NUat Lirboyo in 1999 using the istinbat Bayani method, belongs to al-Sabit category. Meanwhile, the outcomes of Bahtsul Masail Kiai Muda GP Ansor in 2017 which is using a combination of istinbat Bayani and istislahi, belongs to an al-Mutahawwil category. (shrink)
