While increasing numbers of philosophers have argued for eliminating the retributivist elements of criminal justice systems, their arguments often fall short due to internal inconsistency. Some of the best known of these arguments — such as those provided by Derk Pereboom and Gregg Caruso — rely on the claim that there are moral grounds for rejecting retributivism. In defending this claim, these philosophers typically provide arguments seeking to undermine the type of agent responsibility that they believe is needed to justify (...) retributivism. This is usually followed by an assertion that since the excessive suffering caused by retributivist punishment cannot be justified, it is therefore immoral to preserve remnants of it in our criminal justice systems. This paper — which opposes the moral case against retributivism provided by Pereboom and Caruso, and favors non-moral reasons that recommend rejecting a retributivist approach — is divided into three parts. In part one, I discuss why Pereboom and Caruso are correct in thinking that free will skepticism undercuts the moral justification for retributivism. Part two sets out to explain why their moral case against retributivism fails insofar as it runs afoul of the folk intuitions that are called upon to defend Pereboom’s account of free will skepticism. In part three, I provide a non-moral case against the retributivism that is founded on considerations of self-interest and empathy. (shrink)

In his recent The Parmenidean Ascent, Michael Della Rocca develops a regress-theoretic case, reminiscent of F.H. Bradley’s famous argument in Appearance and Reality, against the intelligibility of relations and in favor of a monistic conception of reality. I argue that Della Rocca illicitly supposes that “internal” relations – in one sense of that word – lead to a “chain” regress, a regress of relations relating relations and relata. In contrast, I contend that if “internal” or grounded relations lead to a (...) regress at all, it is a kind of “fission” regress within the relata themselves, and that a chain regress for relations only arises, if at all, for so-called “external” relations, relations not grounded in their relata. In this way, I contend that Della Rocca pursues a regress for so-called “internal” or grounded relations that only arises, if at all, for so-called “external” relations, relations not grounded in their relata. I compare Della Rocca’s case against relations with Bradley’s reasoning in Appearance and Reality, and suggest in this context that Bradley may, perhaps, have the upper hand. (shrink)

Jones (1991) has proposed an issue-contingent model of ethical decision making by individuals in organizations. The distinguishing feature of the issue was identified as its moral intensity, which determines the moral imperative in the situation. In this study, we adapted three scenarios from the literature in order to examine the issue-contingent model. Findings, based on a student sample, suggest that (1) the perceived and actual dimensions of moral intensity often differed; (2) perceived moral intensity variables, in the aggregate, significantly affected (...) an individual''s moral judgments; and (3) some dimensions of moral intensity (namely, perceived social consensus and perceived magnitude of consequences) mattered more than others. This study investigates financial correlates of corporate philanthropy in Fortune 1000 companies using structural equation modeling. The results suggest that cash flow (one of the most discretionary types of organizational slack) has a significant impact on a firm’s cash donations to charitable causes, but monetary donations do not affect firm financial performance. These findings support the accepted view of corporate philanthropy as a discretionary social responsibility and the traditional thinking about firm giving in the business and society literature—that doing well (...) enables doing good. Contrary to some contemporary thinking, the findings imply no significant effect on profits from corporate generosity. (shrink)

Proofs are central, and unique, to mathematics. They establish the truth of theorems and provide us with the most secure knowledge we can possess. It is thus perhaps unsurprising that philosophers once thought that the only value proofs have lies in establishing the truth of theorems. However, such a view is inconsistent with mathematical practice. If a proof’s only value is to show a theorem is true, then mathematicians would have no reason to reprove the same theorem in different ways, (...) yet this is a practice they frequently engage in. This suggests that proofs can have a wide variety of values. My purpose in this chapter is to provide a survey of some of them. I will discuss how proofs can have practical value, for example, by helping mathematicians to make new discoveries or learn new mathematical tools, and how they can have abstract value, for example, by being beautiful or explanatory. I will also explore the relationships between different proof values. (shrink)

The key is the recognition that the “something else” of Phaedo 103e2-5 cannot be a sensible object because any such object which participates in Form ‘X’ can sometimes appear not to be x. It is argued that Plato has not written in a straightforward manner, but rather has written a series of riddles for the reader to solve. Despite our common self-conceptions, we philosophers have our myths, heroes, and guiding narratives. Our work may emphasize conceptual clarity and deductive arguments, but these more sober and discursive elements of our work always occurs within the context of a broader, often implicit, and frequently illusive orientation, within the scope of some particular vision of our vocation, our history, and our place within the contemporary world. These visions are meta-philosophical: they precede and frame philosophical work, and they engender the most intractable (...) philosophical disputes. Thus, for the sake of self-knowledge and rational discussion, we should constantly struggle to articulate and scrutinize these myths and narratives. Which predecessors do we continue to read? Why? What repeated stories and anecdotes generate our common and competing identities? What do past episodes in the history of philosophy mean, and how do they direct our current endeavors? Like every community, we philosophers sustain our collective work through stories, through the celebration of our heroes, and through repeated reference to paradigmatic arguments and texts. We should reflect upon these sustaining elements of our community, even if this requires modes of thought that lie beyond conceptual analysis, deductive argument, and the careful interpretation of canonical texts. -/- In this paper, I excavate and criticize the contours of one narrative that still guides us, the common celebration of Kant’s critical philosophy as a radical, farsighted, disruptive, irresistible, and irrevocable break with the religious and metaphysical dogmatism of its age. In Section 2, I briefly sketch two complementary versions of this narrative, the accounts provided by the Hegelian philosopher Eduard Gans and by the poet Heinrich Heine. Drawing various parallels with the French Revolution, these thinkers significantly overemphasize the skeptical, destructive, anti-metaphysical, anti-religious and historically discontinuous aspects of Kant’s critical philosophy, which they portray as the inauguration of a new and robust philosophical movement, one that rapidly vanquished its intellectually beleaguered and reactionary opponents. In Sections 2–4, I then turn to consider three of the more active and vociferous opponents of the Kantian movement: Basilius von Ramdohr, Friedrich Nicolai, and Ludwig Heinrich von Jakob. Contrary to the standard version of events, these men had little sympathy for metaphysics, religion, rationalism, and dogmatic certitude. In fact, they principally opposed the Kantian movement as the unwelcome resurgence of an outdated form of quasi-religious enthusiasm, as a form of philosophical Schwärmerei that threatened to appropriate the banner of reason and hinder the progress of enlightenment. -/- Drawing upon a wide range of late eighteenth-century German texts on the dangers and varied manifestations of Schwärmerei, I reconstruct Ramdohr’s, Nicolai’s, and Jakob’s vision of the Kantian movement. I argue that the charges of philosophical Schwärmerei highlight three meta-philosophical disputes that pitted these anti-Kantians against many proponents of the Kantian movement. These disputes involved: (a) the social role of the philosopher and her relation to the general public; (b) the place of internal and/or private experience within the open and polyphonic domain of public discourse; and (c) the merits of philosophical systematicity, technical neologisms, and more hermetic versions of semantic holism. -/- A consideration of these meta-philosophical disputes allows us to position Kant’s critical philosophy more accurately within its historical context, to highlight its significant continuities with the intellectual assumptions of the Berlin Enlightenment, those assumptions that largely inform Ramdohr’s, Nicolai’s, and Jakob’s attacks on the so-called Kantian movement. These continuities then reveal the meta-philosophical distance between Kant and “the Kantian movement”, between the texts of the critical philosophy and the projects of Karl Leonhard Reinhold and Johann Gottlieb Fichte. This challenges the traditional account. We often celebrate Kant’s critical philosophy as a radical break with the past, as the inauguration of new and fundamentally modern assumptions, which were then developed and elaborated by the post-Kantian Idealists. By contrast, I argue for a series of complex, ambivalent, and often unintended breaks: while occasionally celebrating his intellectual achievements as an epochal “Copernican Revolution”, Kant largely remains true to the guiding assumptions and philosophical values of his age, only occasionally deflecting them in minor but portentous ways. By contrast, while Reinhold and Fichte at least initially proclaimed their fidelity to the “spirit” – if not the letter – of Kant’s philosophy, they nonetheless managed to release a new and strange philosophical spirit, a potent, quasi-secularized, and post-Enlightenment form of Schwärmerei. Since philosophers generally agree that free will is understood partly by the relation it holds to moral responsibility, achieving a better understanding of free will requires that we have a clear idea of the sort of moral responsibility to which free will is thought to be connected. I argue that examining the substantive differences that exist between compatibilists and incompatibilists reveals a specific notion of moral responsibility that is best suited for philosophical debates regarding free will. Upon examination, it becomes (...) apparent that the primary substantive disputes between compatibilists and incompatibilists—as well as between libertarians and skeptics—have to do with the issue of whether retributivist reward or punishment is ever appropriate for certain kinds of agents. Drawing from this, I suggest that participants in the free will debate adopt a particular understanding of moral responsibility that can ground the propriety of retributivist justice. (shrink)

Modern history has looked on the United States of America as a country with a very distinct and proud national heritage and identity, though this was not always so. When founded in 1776, America was a nation that had not yet developed the identity and customs that would soon come to define the country nationally and internationally. The articulation of this distinct identity fell to the artist class and, in particular, first and second generation American painters. Painters such as Thomas (...) Eakins, Thomas Cole, and the Hudson River School of artists pulled from their natural surroundings to create art that would foster pride in the values of peace, liberty, and freedom. Strategies for protecting historically disadvantaged groups have been extensively debated in the context of genetic variation research, making this a useful starting point in examining the protection of social groups from harm resulting from biomedical research. We analyze research practices developed in response to concerns about the involvement of indigenous communities in studies of genetic variation and consider their potential application in other contexts. We highlight several conceptual ambiguities and practical challenges associated with the protection of group interests and argue (...) that protectionist strategies developed in the context of genetic research will not be easily adapted to other types of research in which social groups are placed at risk. We suggest that it is this set of conceptual and practical issues that philosophers, ethicists, and others should focus on in their efforts to protect identifiable social groups from harm resulting from biomedical research. In a departure from the traditional studies of corporate philanthropy that focus on board composition, advertising, and social networks, the authors investigate the financial correlates of corporate philanthropy. The research design controls for firm size and industry while observing firms from a variety of industries. The sample contains matched pairs of generous and less generous corporate givers. The authors find, as hypothesized, a positive relationship between a firm''s cash resources available and cash donations, but no significant relationship between corporate philanthropy (...) and firm financial performance, regardless of whether corporate philanthropy is measured as cash payouts or the aggregate contributions that charities actually receive, and regardless of whether financial performance is gauged using accounting measures or market measures. Whereas the link between available resources and corporate philanthropy is well accepted in the literature on corporate social responsibility, it has been rarely tested and never so definitively found as in this research. This response chooses as the sole topic for its concern the central question ‘how can Husserl's approach to consciousness be used to inform cognitive science?’ This paper is a response to the papers on phenomenology, in particular the one by Varela. The response makes brief comments on Husserl's phenomenology and the breadth of cognitive science is alluded to as well as its wide spectrum of phenomena. The authors are agreed that there could be a Husserlian cognitive science, but it would (...) take some compromises from both traditions. In general we find that there is some good neuroscience in Varela's approach, but he mixes the contradictory perspectives of natural science and Husserl's phenomenology without explaining or mentioning the major problems which could be entailed by this.
