Philosophical hermeneutics has become an unavoidable reference in the field throughout the twentieth century but has seldom been extended to draw conclusions in the area of political theory. Two intellectuals that have contributed to such a project are Charles Taylor and Gianni Vattimo, although they exhibit some important differences in key aspects of this enterprise, both at the level of the conceptual premises and at that of the prescribed policies and objectives. Here I examine these thinkers’ notion of tradition – (...) an essential feature of hermeneutical theories – its ontological underpinnings, and the place each of them assign to it in sociopolitical decision-making, especially in the context of multicultural societies. In the end, I argue for the superiority of Taylor’s model of understanding and employing tradition in current political and moral debates. (shrink)

This essay aims to recover the conflictive nodes in T. Hobbes’ theory regarding language, science and truth. Revisiting the diverse and contradictory readings that have arisen around these areas of his work we intend to point out the tensions inherent to Hobbes’ scientific project. No definitive answer is given to close the discussion; instead we aim to offer hints to identify the author’s positions that are hard to reconcile. En el presente trabajo se analiza la conexión existente entre la etapa marxista de juventud y la neoaristotélica de madurez en el pensamiento de Alasdair MacIntyre, enfatizando el problema que representa para él la posibilidad de criticar y justificar racionalmente una teoría moral. A través de una lectura comparativa de obras de ambos períodos se muestra cómo la incapacidad para dar una respuesta satisfactoria a esta preocupación temprana es una de las razones que llevan al abandono de la tradición marxista, (...) y cómo su formulación aristotélica madura busca superar esta dificultad, manteniendo constantes otros presupuestos y compromisos teóricos previos. Resumen: En este artículo se presenta la posición de dos filósofos asociados a la hermenéutica, Gianni Vattimo y Charles Taylor, respecto del status del conocimiento científico en el mundo contemporáneo. Mediante una somera exposición de los rasgos fundamentales de sus respectivas ontologías y epistemologías, se busca realizar una comparación crítica. En la conclusión, se defiende la superioridad del planteo de Taylor, en la medida que permite discutir la primacía del modelo científico natural sin abandonar una concepción realista del mundo y (...) de la categoría de verdad. This volume has 41 chapters written to honor the 100th birthday of Mario Bunge. It celebrates the work of this influential Argentine/Canadian physicist and philosopher. En el ámbito del derecho procesal penal, particularmente en el contexto del tránsito, existe una carencia de disposiciones legales que regulen el aspecto probatorio para demostrar infracciones por parte de las autoridades competentes. Específicamente, la falta de regulación sobre el uso de fotografías o videos como evidencia dificulta el proceso de aplicación de la ley, ya que ni el COIP ni la LOTTTSV ni sus reglamentos abordan adecuadamente cómo deben obtenerse pruebas mediante medios digitales. Esta laguna normativa plantea interrogantes sobre (...) qué aspectos pueden capturarse en contenido digital, cómo llevar a cabo dicho proceso y qué requisitos deben cumplir los dispositivos utilizados. Ante esta situación, se justifica la necesidad de realizar una investigación exhaustiva para determinar qué aspectos deben incorporarse en la normativa de tránsito con el fin de garantizar un debido proceso. El objetivo principal de esta investigación fue identificar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito, así como proponer recomendaciones para mejorar el marco normativo existente. Se buscó determinar qué aspectos deben ser incorporados en la normativa de tránsito para garantizar un debido proceso y una aplicación justa de la ley. Para abordar esta problemática, se llevó a cabo una investigación cualitativa con un enfoque descriptivo. Se empleó el método dogmático-jurídico analítico-sintético para analizar en detalle la legislación existente y las lagunas normativas relacionadas con la obtención de pruebas digitales en casos de infracciones de tránsito. Además, se realizaron entrevistas a expertos en derecho procesal penal y se recopiló información de jurisprudencia relevante. Este enfoque metodológico permitió una comprensión profunda de los desafíos y las posibles soluciones en este ámbito. Los resultados de la investigación revelaron importantes lagunas en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se identificaron problemas relacionados con la falta de claridad en los procedimientos de obtención de pruebas digitales y la ausencia de criterios específicos para la admisibilidad de dichas pruebas en los procesos legales. Además, se destacó la necesidad de establecer estándares claros y procedimientos adecuados para garantizar la integridad y fiabilidad de la evidencia digital en el contexto del tránsito. Esta investigación resalta la importancia de abordar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se recomienda la implementación de medidas específicas para mejorar la recopilación y admisibilidad de pruebas digitales, así como la revisión y actualización de la normativa existente. Esto contribuirá a garantizar un proceso legal justo y transparente en el ámbito del tránsito, fortaleciendo así el Estado de derecho y la confianza en el sistema judicial. (shrink)

The purpose of this paper is to explore the connection between expressivism and disagreement. More in particular, the aim is to defend that one of the desiderata that can be derived from the study of disagreement, the explanation of ‘crossed disagreements’, can only be accommodated within a semantic theory that respects, at the meta-semantic level, certain expressivistic restrictions. We will compare contemporary dynamic expressivism with three different varieties of contextualist strategies to accommodate the specificities of evaluative language –indexical contextualism – (...) truth-conditional pragmatics –, pragmatic strategies using implicatures, and presuppositional accounts. Our conclusion will be that certain assumptions of expressivism are necessary in order to provide a semantic account of evaluative uses of language that can allow us to detect and prevent crossed disagreements. Many organisations in rich countries actively recruit health workers from poor countries. Critics object to this recruitment on the grounds that it has harmful consequences and that it encourages health workers to violate obligations to their compatriots. Against these critics, I argue that the active recruitment of health workers from low-income countries is morally permissible. The available evidence suggests that the emigration of health workers does not in general have harmful effects on health outcomes. In addition, health workers can immigrate (...) to rich countries and also satisfy their obligations to their compatriots. It is consequently unjustified to blame or sanction organisations that actively recruit health workers. (shrink)

This paper critically examines Mitchell’s integrative pluralism. Integrative pluralism is the view that scientific explanations should primarily aim to integrate descriptions from different ontological levels. We contend that, while integrative pluralism is a fundamental strategy in contemporary science, there are specific reasons why one should not expect integration in the sense developed by Mitchell to be the optimal strategy and the one that scientists should always aim for. Drawing on some examples from contemporary biology, we argue that integration is sometimes (...) neither epistemically desirable, nor ontologically achievable. We conclude that integrative pluralism should thus be limited to a specific class of complex systems but cannot be generalised as the preferable research strategy without further information about the epistemic practices of the scientific community or the ontology of the system under investigation. Lyotard’s diagnosis of a ‘postmodern condition’ has been repeatedly interpreted as a disavowal of the universal aspiration of political action and judgment. This article challenges this interpretation by showing that postmodernity involves an attempt to reconsider universality in such a way that it involves dissensus rather than consensus. I proceed by reconstructing Lyotard’s critique of the idea of consensus as a ground of political action and judgment, which in his view is based on a certain model of production of scientific (...) knowledge. Then, I analyse Lyotard’s turn to Kant’s judgment of the sublime as an alternative to a consensus-based conception of universal judgments. In the judgment of the sublime, universality stems from the disagreement between the faculties, which arouses respect for universal ideas. Analogously, political judgments stem from the disagreement between heterogeneous discourses, which produces a universal call to invent new languages that make communication possible. (shrink)

El propósito de este artículo es desarrollar una relectura al mecanicismo moderno. Esto implica que una adecuada comprensión de este consiste, ante todo, en considerarlo como un proyecto antes que un sistema doctrinal consolidado. Para ello se toma como eje la filosofía de Leibniz, la cual, a diferencia del cartesianismo, identifica las inconsistencias que implica concebir el mecanicismo como un sistema filosófico completo, principalmente al pretender justificar mecánicamente el mundo natural, esto es, a partir de la figura, el tamaño y (...) el movimiento. Todo lo anterior no implica un rechazo completo del mecanicismo por parte de Leibniz, sino que permite concebirlo como un medio para desarrollar su filosofía, proponiendo una complementariedad entre la causa final y la causa eficiente. de este modo, el mecanicismo es reubicado como un problema metodológico para la ciencia natural antes que como un problema metafísico. This article aims to develop a second reading to the modern mechanicism. This implies that an appropriate understanding of mechanicism consists, above all, in considering it as a project, instead of a consolidated doctrinal system. To do so, we take Leibniz's philosophy as our building blocks, since unlike the Cartesianism, it does identify the inconsistencies implied when we conceive mechanicism as a complete philosophical system, mainly under the pretension to justify the natural world mechanically, that is, based on the figure, size and movement. It does not imply that Leibniz rejects entirely mechanicism, but allows us to understand it as a mean to develop his philosophy, proposing a complementary relationship between final cause and efficient cause. This way, mechanicism is re-posed as a methodological issue for the natural science instead of a metaphysical issue. (shrink)

We argue that microbiome research should be more reflective on the methods that it relies on to build its datasets due to the danger of facing a methodological problem which we call “epistemic misalignment.” An epistemic misalignment occurs when the method used to answer specific scientific questions does not track justified answers, due to the material constraints imposed by the very method. For example, relying on 16S rRNA to answer questions about the function of the microbiome generates epistemic misalignments, due (...) to the different temporal scales that 16S rRNA provides information about and the temporal scales that are required to know about the functionality of some microorganisms. We show how some of these exist in contemporary microbiome science and urge microbiome scientists to take some measures to avoid them, as they may question the credibility of the field as a whole. En este artículo me propongo analizar el significado que tiene la idea de formar éticamente a profesionistas para resolver «dilemas éticos». Partiendo de la base de las propuestas más significativas de la UNESCO para legitimar la pertinencia de la formación ética en la educación profesional en el siglo XXI, me interesa mostrar el sentido que adquiere el concepto de dilema ético y lo que significa aceptar su legitimidad, para de aquí invitar a una reflexión sobre los fundamentos básicos formales de (...) una pedagogía ética que todo docente que enseña ética a nivel profesional tendría que considerar para enseñar a los futuros profesionistas a enfrentar este singular problema de la razón práctica. This paper evaluates an argument for immigration restrictions that appeals to the costs that immigration imposes on the citizens of a recipient state. According to this argument, citizens have associative duties to protect each other’s interests, immigration can damage these interests in certain cases, and the associative duties between compatriots justify immigration restrictions in these cases. Call this: the partiality argument for immigration restrictions. I argue that the partiality argument is unsound. Immigration restrictions violate negative duties to refrain from interfering (...) with people’s liberties and these duties silence compatriots’ associative duties to one another. Furthermore, I argue that compatriots lack associative duties to one another in virtue of the fact that the relationships between compatriots reliably cause injustice to outsiders. (shrink)

El presente trabajo critica el rol constitutivo que tanto Gérard Genette como Jean-Marie Schaeffer le otorgan a la atención en la relación estética entre un sujeto y una obra literaria. A su vez, el análisis realizado es útil para resignificar el concepto de prefocalización criteriosa de Noël Carroll. A partir de análisis estructurales y narrativos de la obra de arte literaria, se argumenta que la atención estética no es necesaria en la relación estética. Por otra parte, se defiende que los (...) estados afectivos y estéticos generados por la lectura dependen de la relación entre el lector y ciertos elementos formales existentes en la obra. En concordancia, se propone una interpretación de la prefocalización criteriosa que resalta la importancia de la influencia de las elecciones del autor en la respuesta afectiva del lector. (shrink)

Resumo: A narrativa de Rousseau sobre a origem do Estado foi retomada nos últimos séculos por diversas tradições, fazendo-se notar no seio do iluminismo escocês e nos trabalhos de Engels. James Scott, em seu recente livro Contra o grão, de 2017, ecoa algumas teses de Rousseau. Dentre tantos pontos de convergência, três se destacam e serão analisados no decorrer deste artigo: i) de um lado, a variedade dos modos de ser e de se relacionar com a natureza dos povos sem (...) Estado, a idade de ouro dos bárbaros; de outro, a estratificação dos povos sob o Estado, o empobrecimento dos agricultores cerealistas; ii) as condições ecológicas raras e especialíssimas favoráveis à emergência do aparelho estatal, em oposição às dificuldades de se formar o Estado, em regiões de abundância naturais, donde se faz necessário estabelecer a hipótese de mudanças climáticas que alteram as condições de existência; iii) e, por fim, a importância dos grãos para o processo civilizatório, isto é, a afinidade entre economia agrária de cereais e Estado.: Rousseau’s narrative about the origin of the State was recovered in the last centuries by several traditions, being noticed in the heart of the Scottish Enlightenment and in the works of Engels. James Scott, in his recent book Against the Grain of 2017, echoes some of Rousseau’s theses. Among many points of convergence, three stand out and will be analyzed in the course of this article: i) on the one hand, the variety of ways of being and relating to the nature of stateless peoples, the golden age of the barbarians; on the other, the stratification of peoples under the State, the impoverishment of cereal farmers; ii) the rare and very special ecological conditions favorable to the emergence of the State apparatus, as opposed to the difficulties of forming a State in regions of natural abundance, which imposes the necessity to establish the hypothesis of climate changes that alters the conditions of existence; iii) and, finally, the importance of grains for the civilizing process, that is, the affinity between the agrarian economy of cereals and the State. En su más reciente libro, Cuestiones de Filosofía del Lenguaje: Pragmática, David Pérez Chico (2022) nos presenta una muy interesante selección de artículos sobre diferentes temáticas actualmente trabajadas en filosofía del lenguaje. Personalmente, considero que este libro es una lectura imprescindible para cualquier lector de habla hispana que quiera introducirse en las temáticas más contemporáneamente discutidas en esa disciplina. En este marco, en el presente artículo me propongo realizar un análisis crítico de cuatro de los artículos de la compilación que (...) trabajan la temática de las emisiones evaluativas, i.e., emisiones cuya extensión depende de parámetros contextuales semánticamente no estándares. This article presents the incidence of the symbol through Latin-American philosophical reflection. It is possible to think of a philosophical activity through the symbol, as a place of a multiplicity of meanings and senses. A new understanding of the symbol lead to re-discover it from the experience of the indigenous Andean communities and Latin American baroque art. The incidence of the symbol in the educational process is performed through an ethical perspective and hermeneutics that focuses on new alternatives for teaching (...) philosophy in the classroom. Siguiendo la aproximación de Peacocke a la naturaleza de los conceptos, este artículo presenta una teoría del concepto de primera persona en términos de su condición de posesión. Propongo que tal condición de posesión es cuestión de, necesariamente, estar dispuesto a realizar un juicio de orden superior con el contenido cuando uno tiene un pensamiento consciente con el contenido. Consecuentemente, intento motivar y defender esta concepción respondiendo a supuestos contraejemplos. Adicionalmente, proporciono una teoría de la determinación del valor semántico respecto (...) a cómo esa condición de posesión individúa el concepto de primera persona dando la condición que alguien tiene que satisfacer para ser su referente. Following Peacocke's approach to the nature of concepts, this paper presents a possession condition theory of the first-person concept. I propose that such a possession condition is a matter of, necessarily, one's being disposed to make a higher-order judgement with the content just when one has a conscious thought with the content. Accordingly, I try to motivate and defend this view responding to supposed counterexamples. In addition, I provide a theory of the determination of the semantic value as to how that possession condition individuates the first-person concept by giving the condition that someone has to satisfy in order to be its referent. This study investigates whether there is a relation between the semantics of linguistic expressions that indicate temporal distance and the spatial properties of their co-speech gestures. To this date, research on time gestures has focused on features such as gesture axis, direction, and shape. Here we focus on a gesture property that has been overlooked so far: the distance of the gesture in relation to the body. To achieve this, we investigate two types of temporal linguistic expressions are addressed: proximal (...) (e.g., near future, near past) and distal (e.g., distant past, distant future). Data was obtained through the NewsScape library, a multimodal corpus of television news. A total of 121 co-speech gestures were collected and divided into the two categories. The gestures were later annotated in terms of gesture space and classified in three categories: (i) center, (ii) periphery, and (iii) extreme periphery. Our results suggest that gesture and language are coherent in the expression of temporal distance: when speakers locate an event far from them, they tend to gesture further from their body; similarly, when locating an event close to them, they gesture closer to their body. These results thus reveal how co-speech gestures also reflect a space-time mapping in the dimension of distance. (shrink)

El objetivo principal de este artículo es mostrar el valor de una lectura de la filosofía política de Spinoza desde un enfoque republicano. Spinoza incorpora en su teoría política elementos del léxico, conceptos y problemas del republicanismo, retomándolos y transformándolos de acuerdo con los fundamentos metafísicos de su filosofía y con el contexto holandés de su tiempo. Podemos comprender mejor el sentido y el alcance de esa teoría si situamos a Spinoza en el marco de la tradición republicana. Tras una (...) breve caracterización del republicanismo holandés, el artículo muestra cómo están presentes en el Tratado teológico-político y en el Tratado político los temas y conceptos básicos del republicanismo. Se centra sobre todo en el concepto de libertad, clave de la propuesta de una república democrática. (shrink)

El objetivo de este artículo es ofrecer una interpretación, en parte novedosa, del pasaje 5.54-5.5423 del Tractatus en el que Wittgenstein examina las proposiciones que representan relaciones intencionales como el juicio. La idea fundamental será que estas proposiciones se consideran como proposiciones que tratan de complejos y, en consecuencia, deberían analizarse de conformidad con el parágrafo 2.0201, lo que me llevará a desarrollar paso a paso el análisis propuesto. Adicionalmente, argumentaré que la teoría de Wittgenstein así entendida excluye la posibilidad (...) de juzgar sinsentidos, a diferencia de la teoría de Russell del juicio como relación múltiple.
