Under the influence of philosophers, psychologists, and students of government, a group of writers on the law became known in the 1930's as New Realists. They held a variety of views, but they joined in a very useful critical approach to the law. Reflecting, as he recognized, the influence of his father, Morris R. Cohen, Felix Cohen contributed his own philosophical and social observations to the work of that lively group.

In this book, Malcolm presents a new and radical interpretation of Plato's earlier dialogues. He argues that the few cases of self-predication contained therein are acceptable simply as statements concerning universals, and that therefore Plato is not vulnerable in these cases to the Third Man Argument. In considering the middle dialogues, Malcolm takes a conservative stance, rejecting influential current doctrines which portray the Forms as being not self-predicative. He shows that the middle dialogues do indeed take Forms to (...) be both universals and paradigms, and thus to exemplify themselves. The author goes on to consider why Plato should have been unsuccessful in avoiding self-predication. He shows that Plato's concern to explain how the truths of mathematics can indeed be true played an important role in his postulation of the Form as an Ideal Individual. The author concludes with the claim that reflection on the ambiguity of the notion of the "Standard Yard" may help us to appreciate why Plato failed to distinguish Forms as universals from Forms as paradigm cases. Fairness of access to assistive technology is important for its allocation on an equitable basis and for broader social justice and rights issues. Although the use of Daniels’s notion of “justice as fair opportunity” is helpful to the context of assistive technology, other aspects of Daniels’s broader conceptualisation of “just health” are not appropriate in this context. It is argued that fairness of access to assistive technology is crucial for the equitable attainment of the sustainable development goals; however, such access (...) will be achieved only by the sector developing a much stronger systems thinking and market shaping perspective. Susan Okin has written an important book on justice and the family. Animated by the experiences that contemporary feminism has sought to articulate, and guided by a principled hostility to the subordination of women that continues to disgrace American life, she argues that the current ordering of domestic life in the United States is unjust and that its alteration ought to be made a matter of public policy.Families, according to Okin, are not havens in an otherwise heartless world. Instead the (...) current division of domestic labor marks them as the centerpiece of a broader system of inequalities between men and women. Justice condemns those inequalities and commands their remedy through the transformation of our domestic practices. Because the division of domestic labor is so fundamental to injustice, we need in particular to ‘encourage and facilitate’ equal sharing by parents in the responsibilities of child-rearing, and in the more quotidian chores that provide the material foundation of modern domesticity. David Hume's relatively short essay 'Of the Standard of Taste' deals with some of the most difficult issues in aesthetic theory. Apart from giving a few pregnant remarks, near the end of his discussion, on the role of morality in aesthetic evaluation, Hume tries to reconcile the idea that tastes are subjective (in the sense of not being answerable to the facts) with the idea that some objects of taste are better than others. 'Tastes', in this context, are the pleasures (...) or displeasures that a person can take in the beauties of poems, paintings, and other artistic compositions (though Hume also wants to stress the continuities between tastes, so understood, and the bodily sense of taste). The position at which Hume arrives in the essay (despite some dialectical unclarity) is that some people – the 'true judges'– determine by their 'joint verdict' which works are meritorious. This solution continues to exercise a fascination, as does Hume's complicated route to it. This paper aims at foregrounding race and ethnicity discourse in Biblical Studies and beyond in order to undermine transhistorical and transcultural racism and ethnocentrism in religious discourse. It is my argument that matters of race and ethnicity should be approached as analytical categories in an interdisciplinary manner, albeit in a specific context, Hellenistic, Roman, Jewish, or Christian. In doing so, I first examine the works of Steve Fenton as well as Robert Miles and Malcolm Brown in order to look (...) closely at race and ethnicity discourse in the ancient Mediterranean world, especially from a sociological perspective. Then, I indicate how Jonathan Hall and Shaye Cohen examine Hellenic and Jewish identity, respectively, with a focus on ethnic identity in the Greco-Roman world. Finally, I consider how Judith Lieu and Denise Buell analyze early Christian identity as a racial or ethnic discourse in the Jewish, Hellenistic, and Roman matrix. Hence, I contend that identity in general and racial-ethnic identity in particular are by no means stable and static in essentialist terms, but rather they are fluid along the ostensible axis of fixed identity. In this paper, we provide an overview of how the outcomes of the Uruguay Round affected the application of pharmaceutical intellectual property rights globally. Second, we explain how specific pharmaceutical policy tools can help developing states mitigate the worst effects of the TRIPS Agreement. Third, we put forward solutions that could be implemented by the World Bank to help overcome the divide between creating private incentives for research and development of innovative medicines and ensuring access of the poor to medicine. Non-domestic companies are increasingly present on the London Stock Exchange. Such companies have specific governance requirements. They may seek to access capital in a more liquid market and to diversify ownership. The reputational ‘bonding’ to a prestigious exchange should be a statement to the market of a propensity to disclosure and a willingness to protect minority shareholders. Yet, many non-domestic companies retain tightly controlled shareholding structures and are based in emerging regions where national culture norms differ to the UK. We (...) hypothesise that non-domestic companies are likely to be less compliant with the principles of the UK Corporate Governance Code and suggest a correlation between lower levels of compliance and non-domestic companies from countries that demonstrate high power distance in the Hofstede cultural value framework. We find some encouraging signs of compliance with the reigning governance code principles in Board structures. However, we find only partial compliance in leadership and Board effectiveness measures in those companies from cultures high on the power-distance scale. Further, we include analysis into ownership characteristics and find companies from emerging markets are dominated by a single or controlling group of shareholders, which is likely to impact on attitudes to compliance and is particularly evidenced in terms of Board structures with no executive directors or led by an executive Chairman. Much of the prior research effort into the levels of compliance with the UK’s ‘comply-or-explain’ approach to governance has produced mixed results and focused on all companies. In our exploratory approach to analysing only the non-domestic subsample, we report some evidence linking cultural distance to lower levels of compliance with the UK standards. We develop a framework to guide future research into the context and cultural underpinnings of this sub-sample of companies, hypothesising that frequent market capitalisation-induced index changes may divert attention away from any potential compliance issues. On the one hand, our evidence is encouraging for governance regimes based on voluntary compliance disclosures such as the UK and similar European and international markets, as we report partial compliance with the principles of the current governance code. Our research may, however, be helpful in guiding future versions of the UK governance framework and other international governance regimes adopting the ‘comply-or-explain’ approach and in setting policy to improve disclosure. It contributes to the understanding of the specific context of non-domestic companies and any cultural tendencies to non-compliance. By demonstrating evidence of lower levels of compliance with key principles of the Code by non-domestic companies, we present a framework enabling lawmakers to further improve corporate governance codes. The UK Supreme Court in Montgomery v Lanarkshire Health Board adopts an approach to information disclosure in connection with clinical treatment that moves away from medical paternalism towards a more patient-centred approach. In doing so, it reinforces the protection afforded to informed consent and autonomous patient decision making under the law of negligence. However, some commentators have expressed a concern that the widening of the healthcare providers’ duty of disclosure may provide impetus, in future cases, for courts to adopt a (...) more rigorous approach to the application of causation principles. The aim would be to limit liability but, in turn, it would also limit autonomy protection. Such a restrictive approach has recently been adopted in Australia as a result of the High Court decision in Wallace v Kam. This paper considers whether such an approach is likely under English negligence law and discusses case law from both jurisdictions in order to provide a point of comparison from which to scope the post- Montgomery future. This article traces the circumstances, which led to Plato becoming a great philosopher. Gradual unraveling of the article brings out more of young Plato and how he became a part of Socrates' circle. Doing philosophy meant trying to understand how to live the life of a just person: getting rid of illusions about what we know or what we think we want, and coming to see what living well really consists of. That is the manifesto Socrates enunciates in his speech (...) to the jurors in the Apology. That is the theme Plato makes him elaborate and defends on a massive scale in the Republic, the longest and most complex of all his works. Fundamental in what he took from Socrates is the idea that philosophy is an inquiry, and inquiry best pursued in conversation with someone else. (shrink)

En faisant usage des intuitions de la philosophie de la science, l'étude compare les voies d'approches en recherche néotestamentaire et en philologie classique. La recherche néotestamentaire a mis en oeuvre une certaine méthode qui était en vogue en philologie classique durant le 19ème siècle, mais qui fut finalement rejetée par la plupart des philologues classiques. Il s'agit d'une méthode sceptique plutôt que critique, car elle rend toute prétention à la connaissance problématique ou même impossible. Son origine dernière se trouve dans (...) la méthode du doute systématique proposée par Descartes. Telle qu'elle est pratiquée aujourd'hui, cependant, la méthode sceptique est semblable à la philosophie de la science suggérée par le cercle de Vienne en les années 1920, mais que les héritiers de cette école regardent aujourd'hui comme trop simpliste. Des exemples concrets, tirés de la pratique courante de la recherche, montrent comment une méthode sobrement critique peut trouver place dans les études du Nouveau Testament, à condition seulement que les dangers de la méthode sceptique soient clairement aperçus.
