In this essay, Christoph Menke’s “aesthetics of force” converses with contemporary Chinese philosophy, especially with the field of Transcultural Research in the Zhuāngzǐ conducted in Taiwan. The starting point of the following reflections is that “the artist is able to be unable”. How can we philosophically describe a way of doing that retains self-awareness in the midst of self-forgetfulness? What Zhuāngzǐ discusses is an aesthetic cultivation of “contemplative perception” in the midst of doing. His language is able to describe and (...) interpret from within a way of doing that refrains from purposeful action. Menke’s approach corresponds with my reflections on Daoism and the book Zhuāngzǐ developed in recent years. Particularly important in this context is the exploration of relating aesthetics to ethical and political questions through an aesthetic transformation of subjectivity. Following the linguistic dynamics associated with the transcultural interweaving of texts, this essay connects Menke’s interpretation of Nietzsche and my interpretation of the Zhuāngzǐ. In so doing, I hope to set in motion a change in thinking on both sides. (shrink)

Social movements often impose nontrivial costs on others against their wills. Civil disobedience is no exception. How can social movements in general, and civil disobedience in particular, be justifiable despite this apparent wrong-making feature? We examine an intuitively plausible account—it is fair that everyone should bear the burdens of tackling injustice. We extend this fairness-based argument for civil disobedience to defend some acts of uncivil disobedience. Focusing on uncivil environmental activism—such as ecotage (sabotage with the aim of protecting the environment)—we (...) argue that some acts of uncivil disobedience can be morally superior to their civil counterparts, when and because such acts target people who are responsible for environmental threats. Indeed, insofar as some acts of uncivil disobedience can more accurately target responsible people, they can better satisfy the demands of fairness compared to their civil counterparts. It is proposed here that the Confucian li, norms of appropriate behavior, be understood as part of the dynamic process of moral self-cultivation. Within this framework li are multidimensional, as they have different functions at different stages in the cultivation process. This novel interpretation refocuses the issue regarding the flexibility of li, a topic that is still being debated by scholars. Courage is a basic virtue to any heroic society. It is the defining virtue of the aristocratic warrior in the Iliad. It came with a set of other related virtues, all functioning in a social setting unique to that heroic era. However, as society evolved beyond the heroics of war to the civility of settled city–states, courage would be reviewed and redefined. In fact the whole virtue complex would undergo fundamental changes. Still later, when from out of the cities philosophers (...) rose, they would, in their commitment to a higher justice or righteousness than what the city had to offer to date, submit courage to a third critique and transformation. The Zhuangzi is noted for its advocacy of many different perspectives—chickens, cicadas, fish and the like. There is much debate in the literature about the implications of Zhuangzi’s pluralist inclinations. I suggest that Zhuangzi highlights the limitations of individual, perspectivally-constrained, knowledge claims. He also spurns the ‘view from nowhere’ and is sceptical about the possibility of an ideal observer. For him, wisdom consists in understanding the epistemological inadequacies of each perspective. I propose that Zhuangzi’s philosophy offers significant insights to an (...) increasingly globalized world characterized by a plurality of ethical and value commitments. It does not assume there will necessarily be universal agreement or a standardized answer. Most importantly, it is a position that seeks to augment self-understanding and enrich the self in dialogue with and response to others. (shrink)

This essay focuses on the unity of several virtues in pre-Qin Confucians. Confucius maintains the proper application and coherence of such virtues as benevolence, wisdom, trustworthiness, straightforwardness, courage, and firmness. Further, Confucius takes benevolence and nobility as characteristic of human being. Particular attention is paid to the distinction and relationship between virtuous characters and virtuous actions.

Relationships with international students can be beneficial to higher education in terms of financial and human resources. For this reason, establishing and maintaining such relationships are usually pre-eminent concerns. In this study, we extended the application of the disconfirmation expectation model by incorporating components from subjective task value to predict the loyalty of international students toward their host countries. On a sample of 410 Vietnamese students enrolled in establishments of higher education in over 15 countries across the globe, we employed (...) structural equation model to construct the conceptual model. Our empirical findings revealed that while the roles of satisfaction and disconfirmation are still important as direct and indirect antecedents of international student loyalty, its most powerful predictors are the three components of subjective task value: attainment, utility and intrinsic. These insights result in a number of implications for actors on the higher ducation scene, such as heads of institutions and policy makers. (shrink)

This paper is a preliminary study of Bhāviveka’s Svātantrika-Mādhyamika justifications for taking non-existent things as the subject of an inference, based on his Dacheng Zhangzhen Lun. Bhāviveka’s treatment of inference is similar to that of Dignāga in that the subject is required to be existent. Bhāviveka also holds that, in a conventional sense, words refer to universals and to the existent entities that possess them, while the two are cognised together. However, in his inference for the unreality of unconditioned things, (...) he likens these things to a sky-flower that never arises and is unreal even conventionally. This paper first demonstrates how taking unconditioned things as the subject of an inference can be problematic for Bhāviveka. Then, it discusses Bhāviveka’s attempts to address the problems by subsuming the unconditioned things under the domain of conventional reality. The paper concludes that these attempts show his flexibility in terms of what is taken as conventionally real. (shrink)

A potencialidade na filosofia da educação antiga e medieval 1 Resumo: O texto aborda a potencialidade, na filosofia da educação antiga e medieval, como a capacidade de aperfeiçoamento da razão. A noção de paideia conduz essa reflexão, uma vez que perpassa o pensamento educacional desde a antiguidade clássica até a baixa Idade Média. Essa continuidade explicita a tradição da formação integral do homem que considerava os aspectos morais e políticos como uma totalidade indissociável. O encaminhamento teórico segue a concepção de (...) História Social de Braudel (1902-1985), já que o foco é a compreensão da herança teológica e filosófica, que exprime os fundamentos da educação. Para refletir sobre esse legado do conhecimento, três momentos foram estudados: a paideia grega na perspectiva aristotélica e platônica; a patrística, por meio do entendimento de Clemente de Alexandria (150-215 d.C.) e de Agostinho de Hipona (354-430 d.C.); e a escolástica, analisada nas concepções de Hugo de São Vítor (1096-1141) e Tomás de Aquino (1225-1274). Assim, nos autores apresentados, há a permanência da compreensão de que o aperfeiçoamento da razão significava a transformação em ato da potência essencial do homem: a razão. A principal finalidade da educação, portanto, era a formação da consciência de cada pessoa, pois entendia-se que esse era o principal meio para o êxito da vida em comum. Potentiality in the philosophy of ancient and medieval education Abstract: The text addresses the potentiality, in the philosophy of ancient and medieval education, as the ability to improve reason. The notion of paideia guides this reflection since it pervades educational thought from classical antiquity to the low Middle Ages. This continuity explains the tradition of the integral formation of man which considered the moral and political aspects as an inseparable totality. The theoretical approach follows Braudel’s conception of Social History since the focus is on understanding the theological and philosophical heritage, which expresses the fundamentals of education. To reflect on this legacy of knowledge, three periods were studied: the Greek paideia in the Aristotelian and Platonic perspective; patristic, through the understanding of Clement of Alexandria and Augustine of Hippo; and scholasticism, analysed in the conceptions of Hugh of Saint Victor and Thomas Aquinas. Thus, there is a continuing understanding in the authors presented that the improvement of reason meant the actualization of man's essential potency: reason. The main purpose of education was the formation of the conscience of each person, as it was understood that this was the main means for the success of life in common. Skill and Mastery: Philosophical Stories from the Zhuangzi presents an illuminating analysis of skill stories from the Zhuangzi, a 4th century BCE Daoist text. In this intriguing text that subverts conventional norms and pursuits, ordinary activities such as swimming, cicada-catching and wheelmaking are executed with such remarkable efficacy and spontaneity that they seem like magical feats. An international team of scholars explores these stories in their philosophical, historical and political contexts. Their analyses’ highlight the stories’underlying conceptions of agency, character and (...) cultivation; and relevance to contemporary debates on human action and experience. Demonstrating the limitations of the one-at-a-time approach, crowd initiatives reveal the surprisingly powerful role of analytic and design choices in shaping scientific results. At the same time, cross-cultural variability in effects is far below the levels initially expected. This highlights the value of “medium” science, leveraging diverse stimulus sets and extensive robustness checks to achieve integrative tests of competing theories.

Does ‘remembering that p’ entail ‘knowing that p’? The widely-accepted epistemic theory of memory answers affirmatively. This paper purports to reveal the tension between ETM and the prevailing anti-luck epistemology. Central to my argument is the fact that we often ‘vaguely remember’ a fact, of which one plausible interpretation is that our true memory-based beliefs formed in this way could easily have been false. Drawing on prominent theories of misremembering in philosophy of psychology, I will construct cases where the subject (...) vaguely remembers that p while fails to meet the safety condition, which imply either that ETM is false or that safety is unnecessary for knowledge. The conclusion reached in this paper will be a conditional: if veritic epistemic luck is incompatible with knowledge, then ‘remembering that p’ does not entail ‘knowing that p’. (shrink)

The term, "objectionable commemorations”, refers to a broad category of public artefacts – such as, and especially, memorials, monuments and statues – that are regarded as morally problematic in virtue of what or whom they honour. In this regard, they are a special class of public artefacts that are subject to public contestation. In this paper, we survey the general ethical and political issues on this topic. First, we categorise the arguments on offer in the literature, concerning the objectionable nature (...) of such commemorations. Using a sample of 11,357 firm-year observations from the Chinese stock market for the period of 2001–2011, we investigate whether and how religion can mitigate earnings management. Specifically, based on geographic-proximity-based religion variables, we provide strong and robust evidence to show that religion is significantly negatively associated with the extent of earnings management, suggesting that religion can serve as a set of social norms to mitigate corporate unethical behavior such as earnings management. Our findings also reveal that the negative association (...) between religion and earnings management is less pronounced for firms with closer distance to the regulatory centers than for their counterparts, implying the substitutive effects between religion and the distance to regulators on mitigating earnings management. The above results are robust to different measures of earnings management, various religion variables, and a variety of sensitivity tests. (shrink)

Tainted political symbols ought to be confronted, removed, or at least recontextualized. Despite the best efforts to achieve this, however, official actions on tainted symbols often fail to take place. In such cases, I argue that political vandalism—the unauthorized defacement, destruction, or removal of political symbols—may be morally permissible or even obligatory. This is when, and insofar as, political vandalism serves as fitting counter-speech that undermines the authority of tainted symbols in ways that match their publicity, refuses to let them (...) speak in our name, and challenges the derogatory messages expressed through a mechanism I call derogatory pedestalling: the glorification or honoring of certain individuals or ideologies that can only make sense when members of a targeted group are taken to be inferior. Using the presence of at least one client with net-income-increasing misstatement as a signal of low audit quality for an audit firm, this study examines the existence of the contagion effect of low audit quality and further investigates whether financial distress and investment opportunity as two firm-specific financial characteristics moderate the contagion effect of low audit quality. Using a sample of 7887 firm-year observations from the Chinese stock market over the period of 2007–2012, our study documents strong and consistent evidence (...) to show that other clients audited by low-quality audit firms have significantly higher discretionary accruals ; financial distress reinforces the contagion effect of low audit quality; investment opportunity strengthens the contagion effect of low audit quality; the contagion effect of low audit quality persists over subsequent years for clients, and both financial distress and investment opportunity reinforce the contagion effect of misstatement to future misstatement. Above results are robust to a variety of sensitivity tests and are still valid after using the change model to control for the potential endogeneity. It reflects the characteristics of the culture of East Asia and has had a tremendous impact on the culture(s) of the region. When Christianity was introduced into East Asia, it did not enter a religious vacuum. Because the people of East Asia have their (...) own culture, including their worldviews, values, and preunderstandings of religion, it is expected that they may interpret the Christian religion in a way significantly different from the Western interpretation of Christianity. One of these possible ways of reinterpreting Christianity is facilitated by the Mahāyāna Buddhist framework.This paper consists of an analysis of the Mahāyāna interpretation of Christianity made by Zhang Chunyi (1871–1955).1 Zhang was a rather well-known Sinologist who published several commentaries on Chinese classics, including Mozi, Laozi, and Zhuangzi. Though he had been well trained in Chinese classics, he was attracted to Christianity, with the hope that Christianity might contribute to the social reform of China. He even received baptism in an Anglican church in 1905. However, because of his in-depth study of Buddhism and his disappointment with the actual practices of the Christian churches at that time, he eventually converted to Buddhism during the 1920s. From that point, he formally promoted the slogan "Buddhicizing Christianity" (Fohua Jidujiao). His proposal for Buddhicizing Christianity includes a severe criticism of the "foreign" form of Christianity being "imported" to China mainly by the Western Protestant missionaries who, according to Zhang, preached a simplistic and even distorted "gospel" for they lacked the spiritual training (nei xue, lit., "inner learning") as well as the intellectual ability to understand sophisticated Chinese philosophy and genuine Christianity. Partially under his influence, some of his contemporary Chinese Christians were converted to Buddhism. In fact, he published at least eight books on interpreting and reforming Christian doctrines from the perspectives of Buddhism, Confucianism, and so on.2 He was probably the most prolific writer on the subject of his generation and one of the pioneers [End Page 67] in what is now called Mahāyāna theology. This brief outline of his rather unusual religious journey might have indicated the importance of the study of his Buddhist interpretation of Christianity. However, owing to mainly sociopolitical turmoil as well as the religious atmosphere at that time and in the subsequent decades, his Buddhist interpretation of Christianity has not been formally studied for decades.In recent years, more and more studies of Buddhist-Christian dialogue take place in the Chinese context.3 It is important to study previous cases of Buddhist-Christian dialogue, Mahāyāna theology, and so on. Some of these cases, including Zhang's, have been studied.4 This paper aims to examine Zhang's thought critically and to show that although Zhang advocated a Mahāyāna interpretation of Christianity before and after his conversion to Buddhism, his interpretations before and after his conversion to Buddhism are significantly different. Epistemological disjunctivism argues that one can have perceptual knowledge that p in virtue of being in possession of factive and reflectively accessible rational support, e.g., one’s ‘seeing that p’. A well-known challenge to this view is the so-called basis problem of epistemological disjunctivism, which argues that one’s ‘seeing that p’ cannot constitute the rational support for one’s knowledge that p, as ‘seeing that p’ is just a way of ‘knowing that p’. The basis problem is taken to be based on (...) the entailment thesis, viz, ‘seeing that p’ entails ‘knowing that p’. Mainstream solutions to the basis problem take an approach rejecting the entailment thesis. This paper purports to reveal a common defect of those extant solutions. That is, they all fail to address the basis problem in the central domain of discussion of epistemological disjunctivism, i.e., what Pritchard refers to as ‘paradigmatic cases’. Moreover, even if they succeed in rejecting the entailment thesis in paradigmatic cases, they would also backfire on epistemological disjunctivism. (shrink)

A prominent way of justifying civil disobedience is to postulate a pro tanto duty to obey the law and to argue that the considerations that ground this duty sometimes justify forms of civil disobedience. However, this view entails that certain kinds of uncivil disobedience are also justified. Thus, either a) civil disobedience is never justified or b) uncivil disobedience is sometimes justified. Since a) is implausible, we should accept b). I respond to the objection that this ignores the fact that (...) civil disobedience enjoys a special normative status on account of instantiating certain special features: nonviolence, publicity, the acceptance of legal consequences, and conscientiousness. I then show that my view is superior to two rivals: the view that we should expand the notion of civility and that civil disobedience, expansively construed, is uniquely appropriate; and the view that uncivil disobedience is justifiable in but only in unfavorable conditions. By examining fundamental Confucian concepts -- zhengming, ren, li, xiao, shu and dao -- the essay demonstrates that Confucian ways of thinking do not always fit neatly into categories such as 'moral' or rights'. This book explores the relevance of virtue theory to law from a variety of perspectives. The concept of virtue is central in both contemporary ethics and epistemology. In contrast, in law, there has not been a comparable trend toward explaining normativity on the model of virtue theory. In the last few years, however, there has been an increasing interest in virtue theory among legal scholars. 'Virtue jurisprudence' has emerged as a serious candidate for a theory of law and adjudication. Advocates (...) of virtue jurisprudence put primary emphasis on aretaic concepts rather than on duties or consequences. Aretaic concepts are, on this view, crucial for explaining law and adjudication. This book is a collection of essays examining the role of virtue in general jurisprudence as well as in specific areas of the law. Part I puts together a number of papers discussing various philosophical aspects of an approach to law and adjudication based on the virtues. Part II discusses the relationship between law, virtue and character development, with some of the essays selected analysing this relationship by combining both eastern perspectives on virtue and character with western approaches. Parts III and IV examine problems of substantive areas of law, more specifically, criminal law and evidence law, from within a virtue-based framework.
