In this article we introduce the reader to the reasons that led to this collection: an interdisciplinary exploration aimed at renewing interest in Luigi Einaudi’s search for «good government», broadly understood as «good society». Prompted by the Einaudian quest, the essays – exploring philosophy of law, economics, politics and epistemology – develop the issue of good government in several forms, including the relationship between public and private, public governance, the question of freedom and the complexity of the human (...) in contemporary societies. The common thread of these essays is that problematic but indissoluble knot that tells us something deeply human: our being torn between homing and roaming, institutional and individual, law and freedom, real and ideal. Italian Abstract: L'opposizione buon governo/mal governo è stato considerata uno dei grandi temi, se non il più grande, della riflessione politica di tutti i tempi. In questo libro mi propongo di qualificare teoreticamente il senso e il modo in cui Luigi Einaudi riattualizza il mito del buongoverno alla luce della portata dirompente dell’economico per la modernità e dei suoi effetti sul giuridico, il politico e l’etico. Il baricentro del liberalismo di Luigi Einaudi o del buon governo (...) va ricercato non tanto in una specifica teoria del liberalismo ma, piuttosto, nella "visione dell'uomo" di Einaudi riflessa dalla sua azione di economista-giornalista nella sfera pubblica, che testimonia di una cura costante per quel «bene supremo che è la libertà dell’uomo», nelle sue forme più «concrete», affinché ciascuno di noi possa «continuamente rompere la frontiera del noto, del già sperimentato, e muovere verso l’ignoto ancora aperto all’avanzamento materiale e morale dell’umanità». -/- English Abstract: The opposition good government/bad government has been considered one of the major issues, if not the major, of the legal and political reflection of all times. In this book I endeavour to provide a historical-theoretical account of the meaning and manner of Luigi Einaudi’s revisitation of the “myth of good government”, highlighting its contemporary relevance in the light of the momentous significance of economy for modernity, as well as its effects on the sphere of law, politics and ethics. I argue that the core of Einaudi’s liberalism and good government is to be found not so much in a specific theory of liberalism but, rather, in Einaudi’s “vision of the human”, reflected by his action in the public sphere as journalist-economist: a constant care for that “greater good that is the freedom of man” in its most “concrete” forms, so that every single man can “constantly break down the frontier of the known, of the already experienced, and move towards the unknown still open to the material and moral progress of mankind”. The book presents an interdisciplinary exploration aimed at renewing interest in Luigi Einaudi’s search for “good government”, broadly understood as “good society”. Prompted by the Einaudian quest, the essays - exploring philosophy of law, economics, politics and epistemology - develop the issue of good government in several forms, including the relationship between public and private, public governance, the question of freedom and the complexity of the human in contemporary societies.

I will argue here that Einaudi's thought reveals an awareness that the question of freedom has to do with two inter-related problems: the relation of individuals or communities with their respective limits and the question of going beyond these limits. Limits are to be understood here in the meaning of the foundation or conditions of possibility both of institutions (economic, political and juridical) and of thought and human action.

The article deals with some implications of radical uncertainty for participatory democracy, and more precisely for Participatory Technology Assessment. Two main forms of PTA are discussed. One is aimed at involving lay citizens and highlighting public opinion. The other is addressed to stakeholder groups and organisations, not only in terms of interest mediation but also of inclusion of their insight into a problem. Radical uncertainty makes 'intractable' many environmental and technological issues and brings into question traditional and new approaches to (...) policymaking. Its consequences are explored from the viewpoint of new science, deliberative democracy, and network governance. Radical uncertainty calls for a rethinking of the aims of public deliberation, and a reinterpretation of the divide between opinion- and position-oriented PTA. To look for a public opinion, understood as a shared principled view, can prove misleading, as can thinking of stakeholder participatory arrangements in the usual way. When facts and values overlap, and are deeply controversial, the only opportunity for mutual understanding may be to look for practical, 'local' answers, based on different positional insights. Moreover, radical uncertainty also affects interest determination and pursuit, and may enhance the opportunity of joint, inclusive, non-strategic issue definition and solution-devising. This vision of public deliberation is consistent with the idea of network governance. However, fragmentation can affect the effectiveness and legitimacy of participatory policies. Trying to handle fragmentation from the top, as many suggest, is unlikely to be successful. A more promising endeavour is to foster deliberative settings which, although positioned at the level of 'local' and often contingent networks and commonalities, are open to include 'Otherness' – other contexts, other problem definitions, other concerns. In this paper we compare the strategies applied by two successful biological components of the ecosystem, the viruses and the human beings, to interact with the environment. Viruses have had and still exert deep and vast actions on the ecosystem especially at the genome level of most of its biotic components. We discuss on the importance of the human being as contraptions maker in particular of robots, hence of machines capable of automatically carrying out complex series of actions. Beside the (...) relevance of designing and assembling these contraptions, it is of basic importance the goal for which they are assembled and future scenarios of their possible impact on the ecosystem. We can’t procrastinate the development and implementation of a highly inspired and stringent “ethical code” for human beings and humanoid robots because it will be a crucial aspect for the wellbeing of the mankind and of the entire ecosystem. This article aims to provide a semiotic analysis of environmental law and youth protests. More precisely, drawing on speech act theory this article regards both as types of communication and teases out the inherent voice and message, specifically with regard to the interests of future generations. The argument unfolds in three steps. First, the article looks into speaker and speech of environmental law and argues that it speaks, as legislation does, in the first-person plural voice of a ‘we’. Second, the (...) article examines a speech of Greta Thunberg through the lens of Stanley Cavell’s theory of passionate utterances. This interpretation will unlock the political stakes of Thunberg’s speech as she claims standing with those responsible for enacting environmental law. Finally, the consequences of this reading will be analysed by relating message and voice of environmental law. As youth protests question ordinary forms of political representation, new ways of safeguarding the interests of future generations are called upon. (shrink)

En jetant la sonde de l’interrogation philosophique au lieu de soi, Jean-Luc Marion nous donne une approche organique et originale à la pensée d’Augustin, en entrecroisant entre eux deux plans herméneutiques : sur le premier, l’on poursuit un itinéraire de rapprochement au cœur de la confessio augustinienne permettant de réduire le vaste univers sémantique d’Augustin à un noyau génétique unifiant; sur le second plan, le parcours philosophique de l’auteur se développe ultérieurement, tendant à désarticuler un bloc théorique d’ontologie et métaphysique (...) et atteignant ainsi par une voie phénoménologique une idée de philosophie finalement affranchie de la présupposition du caractère central de la question de l’étant et du fondement. En tout cas, même si l’on ne veut pas donner trop d’éclat à la critique anti-ontologique et antimétaphysique caractérisant l’approche à la pensée augustinienne proposée dans cet ouvrage, l’acquis spéculatif de celle-ci ne semble pas diminuer. Un parmi les mérites principaux de ce livre est d’avoir restitué à la confessio sa dignité théorique, en y apercevant un lieu phénoménologique originaire où la relation entre moi et Dieu se noue; une relation dont le caractère paradoxal, autrement insoutenable, est résolu par le primat du don et de l’amour. Ce sont tous ces traits originaux qui nous mènent à dire qu’Au lieu de soi n’est pas seulement un livre sur Augustin, car il est plus qu’un livre sur Augustin. (shrink)

This article analyses the use of the term “‘political oeconomy” in the Wealth of Nations, considered by many the founding text of the discipline of Political Economy. It shows that Adam Smith could not accept the use of the term “political oeconomy” that had been made by other authors to indicate the subject matter of his scientific inquiry, devoted to the nature and causes of the wealth of nations; he used the term “political oeconomy” as a synonym for economic policy, (...) especially in the fourth book of the Wealth of Nations. In order to understand this statement, it is necessary to keep in mind the methodological and epistemological perspective developed by Smith; in his view, the inquiry into the nature and causes of the wealth of nations would have to discover the almost unchangeable rules that presided over the choices of the legislators in the field of public economy and in the management of public resources. By contrast, the term “political oeconomy” was used by Smith exactly to indicate the policies really adopted in these fields, policies which frequently altered the system of natural liberty. Substantial evidence supports the perspective that the people of Ancient Greece had a language for and some use for drugs, both for the purpose of medicine and poison; however, the question remains whether Ancient Greek civilization held a concept approximating what we today call drug addiction. This article explores the textual evidence for the use of two drugs, nepenthes and cannabis, in Ancient Greece. While the existence of nepenthes remains in doubt, the use of cannabis is well documented. Either drug (...) or both drugs may have been used in the rites of the Bacchic and Orphic mysteries, which might explain why there are so few references to these drugs in the Ancient Greek literature. The discovery of incommensurability by the Pythagoreans is usually ascribed to geometric or arithmetic questions, but already Tannery stressed the hypothesis that it had a music-theoretical origin. In this paper, I try to show that such hypothesis is correct, and, in addition, I try to understand why it was almost completely ignored so far.

Luigi Giussani, a high school religion teacher throughout the 1950s and 1960s, grounded his teachings in the vast body of experience to be found in Christianity's two-thousand-year history. He told his students, “I'm not here to make you adopt the ideas I will give you as your own, but to teach you a method for judging the things I will say.” Throughout his life, education was one of Giussani's primary intellectual interests. He believed that effective education required an adequate (...) background in the Christian tradition, presented within a lived experience that underscored the capacity of the faith to answer universal questions. What he proposed was a process that allowed one to sift through tradition, critically examining it and comparing it against the ultimate criteria for judgment: the desires of the heart. In Giussani's view, the primary concern was to “educate the human heart as God made it.” In The Risk of Education he states that fear leads students to associate this process of criticism with negativity or doubt. Yet, without an education in criticism, students cannot develop conviction. At a time when young people are abandoning the church and questioning the value of faith, Giussani's method of judging and verifying Christianity as an experience seems a necessary intervention. In The Risk of Education he argues that, ultimately, education and the Christian message reveal themselves through human freedom. (shrink)

The early writings of Jean-Jacques Rousseau were dismissed by his contemporaries as the paradoxes of a madman. Later critics, weighing the early works against such classics as the Confessions and Emile, were convinced that the views of the young Rousseau could not be reconciled with those of his more famous period. In this stimulating book Professor Einaudi argues that the denigrators of Rousseau's early work were wrong: the early and later views can be reconciled. Indeed, full understanding of the (...) mature Rousseau can be gained only through appreciation of the writings completed between 1737 and 1756. In developing his argument, the author refers not only to such well-known early works as the Discourse on the Arts and Sciences and the Discourse on Inequality, but also to the less familiar writings of the same period—the essays on political economy and the state of war, the letter to Voltaire on the Lisbon earthquake, the fragments on history and education, the Discourse on Wealth, and Rousseau's replies to his critics. Rousseau's reputation has steadily grown until he is today regarded by many as the most important thinker of the eighteenth century. His views on a variety of topics—man and society, private and public life, economics and government, war and peace—seem astonishingly relevant to the problems of the twentieth century, and for this reason he is now read with a thoroughness and sympathy that were seldom accorded him in his lifetime. This major contribution to the current Rousseau revival is the first full-length study in English to take into account the insights of recent European scholars, such as Starobinski, Derathé, and Vossler. Following the murder of George Floyd, the Black Lives Matter-movement (BLM) took to the streets to protest against institutional racism. In these protests, one could often hear the slogan “No Justice, No Peace”. Drawing on legal theory, speech act theory and phenomenology, this article investigates what kind of justice and peace are called upon and how the slogan functions as a claim addressed to the legal order. First, the article shows that the rule of law provides a comprehensive normative framework (...) to evaluate what went wrong during the arrest of George Floyd. Second, the article maintains that the slogan should be understood as a passionate utterance in the sense of Stanley Cavell. Finally, drawing on a responsive phenomenology of legal order inspired by the work of Bernhard Waldenfels, the article concludes that the slogan is an extraordinary claim questioning the legal order, showing its contingent origins.
