BackgroundPatient skepticism concerning medical innovations can have major consequences for current public health and may threaten future progress, which greatly relies on clinical research.The primary objective of this study is to determine the variables associated with patient acceptation or refusal to participate in clinical research. Specifically, we sought to evaluate if distrust in pharmaceutical companies and associated psychosocial factors could represent a recruitment bias in clinical trials and thus threaten the applicability of their results.MethodsThis prospective, multicenter survey consisted in the (...) administration of a self-questionnaire to patients during a pulmonology consultation. The 1025 questionnaires distributed collected demographics, socio-professional and basic health literacy characteristics. Patients were asked to rank their level of trust for pharmaceutical companies and indicate their willingness to participate in different categories of research.Logistic regression was used to determine factors contributing to “trust” versus “distrust” group membership and willingness to participate in each category of research.ResultsOne thousand patients completed the survey, corresponding to a response rate of 97.5%. Data from 838 patients were analyzed in this study.48.3% of respondents declared that they trusted pharmaceutical companies, while 35.5% declared distrust. Being female, inactive in the employment market, and not-knowing the name of one’s disease are factors related to declared distrust. Distrust-group membership is associated with unwillingness to participate in certain categories of trials such as pre-marketing and industry-sponsored trials.ConclusionDistrust in pharmaceutical companies is associated with a specific patient profile and with refusal to participate in certain subcategories of trials. This potential recruitment bias may explain the under-representation of certain categories of patients such as women in pre-marketing drug trials. (shrink)

Graeme Laurie stepped down from the Chair in Medical Jurisprudence at the University of Edinburgh in 2019. This edited collection pays tribute to his extraordinary contributions to the field. Graeme has often spoken about the importance of 'legacy' in academic work and has forged a remarkable intellectual legacy of his own, notably through his work on genetic privacy, human tissue and information governance, and on the regulatory salience of the concept of liminality. The essays in this volume animate the (...) concept of legacy as lens of analysis for the study and practice of medical jurisprudence. In this light, legacy reveals characteristics of both benefit and burden, as both an encumbrance to and facilitator of the development of law, policy and regulation. Overall, the contributions reconcile the ideas of legacy and responsiveness and show that both dimensions are critical to achieve and sustain the health of medical jurisprudence itself as a dynamic, interdisciplinary and policy-engaged field of thinking. My mother, born in Danzig in 1908 and raised in Frankfurt, died in 1993 in Ithaca, New York. She was Jewish, but she never attended a synagogue or celebrated Jewish holidays. My father, born in Leipzig in 1906 and raised in Jena, died in Ithaca in 1979. He was not Jewish. In the United States, they became members of the Society of Friends.My parents emigrated to the United States in May 1938 with my two older brothers, who were no longer allowed to attend nursery school because of their half-Jewish status. My grandmother stayed behind, at her own request, and my parents made every effort to bring her to the United States. But she died in Frankfurt in December 1940. This tragedy pervaded my childhood and still haunts me as I play her music with her annotations or set the table on tablecloths that she embroidered. I also photograph her things: the bandages that she knitted and labeled, letters that she wrote, and the childhood letters she saved of her only daughter, my mother.My mother saved things: keys to every cabinet and drawer, suitcases, and doors. All her eyeglasses. She dug up the dahlias in the fall, stored them in a baby bathtub, and replanted them in the spring. She was an enthusiastic gardener. She was a violinist and her mother a pianist. The albums of music are now crumbling and brittle. Her music friends continue to use her music. The tablecloths, dozens of them, are mended and stained. I use a large square damask tablecloth as a bed sheet.I am always amazed at the things they brought with them when they emigrated by ship: furniture, rugs, books, linens, letters, toys, photographs, dishes, pots and pans. Then I remember that they could not bring money, so they brought everything else: including a box of bandages, one labeled in an early script: “a clean breast cloth from the beginning of the 19th century.” The label is sewn onto the linen cloth.After my mother’s death, I went through boxes of photographs. I found one yellow Kodak envelope, labeled in my mother’s handwriting: “Helmut’s ‘Weltreise.’” In the envelope were photographs of Daddy’s trip to America in 1937 when he was searching for a job and a place to move with his little family. He traveled by boat through Cuba, Mexico, and the Panama Canal to California and back across the United States by train. In the envelope are snapshots of my father, looking very handsome, age 31, standing at the ship’s rail with an attractive young woman. The photograph is labeled on the verso, in his handwriting, “meine kleine Freundin, Patricia Hays”—this is not my mother. My mother was in Frankfurt, waiting to hear where they would go, and during that time she lost her third baby.My mother wrote letters almost every day, and she kept a carbon copy on onionskin of each of her letters. She started writing letters as early as 1913. Most of the letters are in German. I don’t speak or write German, yet I feel compelled to store these relics of times past. Drawing on diverse historical cases, this paper describes and examines various aspects of a modality of scientific appraisal which has remained largely unexplored, theory pursuit. Specifically, it addresses the following issues: the epistemic and pragmatic commitments involved in theory pursuit, including how these differ from those characteristic of theory acceptance; how the research interests of scientists enter into their pursuit decisions; some of the strategies for the refinement and extension of a theory's empirical abilities which typify theory pursuit; and the (...) need to distinguish between individual and community rationality in contexts of pursuit. The paper examines Johann Georg Hamann’s influence on Ludwig Wittgenstein’s late philosophy. Wittgenstein’s letters, diaries and Drury’s memoirs show that Wittgenstein read Hamann’s writings in the early 1930s and 1950s. Wittgenstein’s diary notes and the Cambridge lectures show that Wittgenstein’s discussion of Hamann’s views in 1931 corresponds to adopting a Hamannian view of symbols and rule-following. The view of language as an intertwining of signs, objects and meanings in use forms a common core in the philosophies of Hamann and Wittgenstein. (...) Summary Under the Iberian Union, the Portuguese discourse on empire had been both relatively muted and intertwined with Spanish debates. The Braganza Restoration presented a radical break from this tradition. A new network of preachers, theologians and jurists from the four corners of the Portuguese empire made the case for the recovery of independence. Instead of buttressing a common moral universe and the old pan-Iberian network of higher learning, the new network focused its energies on the establishment of the particularity (...) of the Portuguese imperial and missionary enterprises. The contribution explores the importance of networks in establishing intellectual independence and the strategies employed by the partisans of the newly independent Portugal. Figuring prominently in their decisions regarding which theories to pursue are scientists' appeals to the promise or lack of promise of those theories. Yet philosophy of science has had little to say about how one is to assess theory promise. This essay identifies several indices that might be consulted to determine whether or not a theory is promising and worthy of pursuit. Various historical examples of appeals to such indices are introduced.

I have three general reasons for supporting naturalism. First, by taking naturalism seriously we can keep our philosophies up-to-date with scientific inquiry. Second, naturalism can emancipate us from transcendental pseudo-questions and (...) instead help us to deal with the empirical problems of everyday life. Third, with naturalism, we can free ourselves from a priori theories of morals and aesthetics and thus view the active part that normative and aesthetic concerns play in human praxis. Even if I endorse naturalism, I do not subscribe to scientism. 1 Rather, I submit to a pragmatist view that stresses the role of philosophy (and science) in dealing with the questions of our life practices. Of the recent perspectives in the philosophy of music education my approach comes closest to the critical praxialism discussed in the MayDay group. 2All in all, I find a lot in common with the praxialist discussion (within or outside the MayDay group) and the kind of pragmatism that follows John Dewey's mature philosophy. 3 However, it seems to me that the naturalist bent of Deweyan pragmatism has not been thoroughly analyzed in our field. 4 One reason for this [End Page 141] might be the bad report that 'hard' or reductive naturalism has been given in connection with the experimental paradigm of music education research. 5 I want to argue that the critical potential of Deweyan pragmatism should not (and cannot) be separated from a naturalist approach. Taken together, critical and naturalist views can contribute to any philosophy, especially in fields that have a long tradition of leaning on otherworldly explanations.In what follows, I begin by outlining (in broad brushstrokes) the historical position of pragmatism and its status in present day philosophy. Next, I focus on the implications of Deweyan naturalist pragmatism and the possibility of maintaining a critical pragmatist attitude with naturalist presumptions in a pedagogical context. Across three studies, the authors examine the interactive effects of moral identity and the negative reciprocity norm in predicting revenge. The general argument is that moral identity provides the motivational impetus for individuals’ responses, whereas the normative framework that people adopt as a basis for guiding moral action influences the direction of the response. Results indicated that moral identity and the negative reciprocity norm significantly interacted to predict revenge. More specifically, the symbolization dimension of moral identity interacted with the negative (...) reciprocity norm to predict revenge when individuals were the targets of mistreatment, whereas the internalization dimension of moral identity interacted with the negative reciprocity norm to predict revenge when individuals were the observers of mistreatment. This article represents an attempt to organize, critique, and extend research findings on gender differences in business ethics. The focus is on two dependent variables—ethical judgment and behavioral intent. Differences in findings between student and professional groups are noted and theoretical implications are discussed. The new research provided for this article contains two benchmark studies undertaken with identical stimuli and identical measures. These studies were followed by two additional studies, using the same measures but different stimuli, as a partial replication (...) and extension of the first two. Findings suggest that little difference exists between the genders on behavioral intent for professional groups and only minimal differences for the ethical judgment measures. Student results, however, produced more substantial differences for behavioral intention. (shrink)

Many models of word recognition assume that processing proceeds sequentially from analysis of form to analysis of meaning. In the context of morphological processing, this implies that morphemes are processed as units of form prior to any influence of their meanings. Some interpret the apparent absence of differences in recognition latencies to targets (SNEAK) in form and semantically similar (sneaky-SNEAK) and in form similar and semantically dissimilar (sneaker-SNEAK) prime contexts at an SOA of 48 ms as consistent with this claim. (...) To determine the time course over which degree of semantic similarity between morphologically structured primes and their targets influences recognition in the forward masked priming variant of the lexical decision paradigm, we compared facilitation for the same targets after semantically similar and dissimilar primes across a range of SOAs. The effect of shared semantics on recognition latency increased linearly with SOA when long SOAs were intermixed (Exp. 1) and latencies were significantly faster after semantically similar than dissimilar primes at homogeneous SOAs of 48 ms (Exp. 2) and 34 ms (Exp. 3). Results limit the scope of form-then-semantics models of recognition and demonstrate that semantics influences even the very early stages of recognition. Finally, once general behavior across trials has been accounted for, we fail to provide evidence for individual differences in morphological processing that can be linked to measures of reading proficiency. This article explores and compares cross-gender interactions of first and third graders in one child care center. Three prevalent forms of interaction are discussed: teasing, disputing, and playing. The author argues that these three forms of interaction are related to the use of space: Teasing often occurs when space is constricted, disputing is often the result of invaded space, and playing requires shared space and varying levels of cooperation. By focusing on the relationship between space and interaction, important power asymmetries (...) appear. Since boys are more likely to initiate invasions and more likely to determine the rules and terms of the play, they maintain a greater amount of power and control. (shrink)

In this rewarding book, Laurie A. Finke challenges assumptions about gender, the self, and the text which underlie fundamental constructs of contemporary feminist theory. She maintains that some of the key concepts structuring feminist literary criticism need to be reexamined within both their historical context and the larger framework of current theory concerning language, representation, subjectivity, and value.

Critical ethical questions arise concerning whether studies among adolescents of new behavioral and biomedical HIV preventive interventions such as Pre-Exposure Prophylaxis should obtain parental permission. This paper examines the relevant regulations and ethical guidance concerning waivers of parental permission, and arguments for and against such waivers. Opponents of such waivers may argue that adolescent decision-making is “too immature” and that parents always have rights to decide how to protect their children. Yet requiring parental permission may put adolescents at risk, and/or (...) limit adolescent participation, jeopardizing study findings’ validity. This paper presents recommendations on when researchers and Institutional Review Boards should waive parental permission, and what special protections should be adopted for adolescents who consent for themselves, e.g., assuring adolescent privacy and confidentiality, screening for capacity to consent, and identifying adolescents who are at elevated risk from study participation. We also present a series of specific areas for future research to design tools to help make these assessments, and to inform researcher and IRB decisions. These recommendations can help ensure that research is conducted that can aid adolescents at risk for HIV, while minimizing risks and protecting these individuals' rights as much as possible. Recent research in philosophy of science suggests that the relationship which scientists have towards the artifacts of science, i.e. their theories, is considerably richer than many traditional accounts of scientific appraisal would lead us to believe. Problem-solving methodologists, in particular, advocating a pragmatic account of scientific theories, argue that traditional methodologies have tended to focus exclusively on one modality of appraisal--that of theory acceptance, and have advanced normative proposals which provide only for assessments of the empirical well-foundedness of scientific theories. As a result, it is held, these traditional accounts are unable to accommodate certain historical cases in which conceptual considerations have played a vital role in scientific appraisal, and in which the behavior of scientists clearly indicates something less or other than theory acceptance on their part. ;In this essay, a problem-solving methodology is adopted in the interests of contributing to this recent research in philosophy of science by critically assessing and further developing selected features of it. Two historical case-studies are presented. The first examines the theories of space and of motion advanced by Descartes and Newton, while the second explores atomism and affinitism in nineteenth-century chemical theory. These cases are used to establish: that conceptual considerations have figured significantly in the assessments which scientists make of their theories; that scientists do something more than accept or reject theories, they pursue them; and that in defending their decisions to pursue or not to pursue a theory, scientists typically do make reference to the promise, or lack of promise, of the theory. Specific normative proposals are developed which are intended to enrich our appreciation of scientific appraisal by providing an account of what it is to pursue a theory, of what it is for a theory to be promising, and of the role of conceptual considerations in supporting judgements of theory promise. This study considers two problems: the extent to which feminist opinions are distinct from feminist identity and the generalizability of these separate constructs across gender and time. Using pooled cross-sectional data from the six National Election Study surveys conducted from 1972 through 1992, the author employs a series of measurement and structural equation models to evaluate the validity and reliability of various feminist orientations and to estimate the relationships among feminist identity, feminist opinion, and individual characteristics associated with feminism. This chapter explores how to understand the contributions of experience, especially with respect to the role of cognitive science, in developing and assessing metaphysical theories of reality. Further, it develops a methodological basis for the idea that, independently of work in experimental philosophy focused on explications of concepts, contemporary metaphysical theories with a role for experiential evidence can be fruitfully connected to empirical work in psychology, especially cognitive science. While there are different ways to flesh out the connection between cognitive (...) science and metaphysics, one way to understand the methodological issue concerns the evaluation of Moorean facts about the manifest. The chapter deals with Moorean facts about experience, in particular, with features of the manifest image that are drawn from ordinary experience. Academic incivility can create divisiveness and affect learners’ sustainability towards degree attainment. Therefore, there is a need to empirically assess learner views on what constitutes academic incivility in higher education. To fill this gap, we developed the Incivility Indicators Instrument (i3), a multifaceted scale that measures the extent to which students view cumulative behaviors and dynamics as instances of academic incivility. To examine the reliability and factor structure of the i3, we conducted a two-part study with two samples of adults (...) in the United States who were enrolled in higher education programs. In study 1 (N = 342), we conducted an exploratory factor analysis (EFA) and found the initial three-factor structure. In study 2, we administered the instrument to a validating sample (N = 510) and examined the stability of the three-factor model and scores through confirmatory factor analysis (CFA). In this study, we describe the results of the study, provide implications, and discuss future directions. (shrink)

The term ‘phenomenology’ has become almost as over-used and emptied of meaning as that other word from Continental Philosophy, namely ‘existentialism’. Yet Husserl, who first put forward the phenomenological method, considered it a rigorous alternative to positivism, and in the hands of Merleau-Ponty, a disciple of Husserl in France, phenomenology became a way of gaining a disciplined and coherent perspective on the world in which we live. When this study originally published in 1977 there were only a few books in (...) English on Merleau-Ponty’s philosophy. It introduced the reader and suggested how his thought might throw light on some of the assumptions and presuppositions of certain contemporary forms of Anglo-Saxon philosophy and social science. It also demonstrates how phenomenology seeks to unite philosophy and social science, rather than define them as mutually exclusive domains of knowledge. (shrink)

This article analyses the representational stakes of queer of colour performance, by taking the case study of the Cocoa Butter Club: queer of colour cabaret night in London. Within a British landscape that has silenced queer subjectivities of colour at the intersection of race, gender and sexuality, I explore the potential of QPOC performance to redress historical erasure. To enact their presence, I argue that the Cocoa Butter Club’s performers showcase their collective disidentification from the scripts pre-assigned to their bodies (...) within the European imagination. By doing so, they disrupt hegemonic representations of queerness and racialised otherness, making room for a multitude of queer of colour becomings kept otherwise invisible from public view. Such disidentifications unleash ‘ghosts’ into the public space, spectres of elided subjectivities and unresolved coloniality within a city that likes to think of itself as a post-racial LGBT haven. Drawing on ethnographic material and interviews with performers, I analyse what happens when such queer of colour hauntings reach the audience’s gaze. I consider their unsettling effects in relation to the white gaze, as well as their empowering function in relation to desiring QPOC subjects, seeking reflections of themselves in spectatorship. To promote my work, in 1984, I exhibited at the Whole Life Expo in New York City. When I returned to my booth after a break, I noticed someone had left a pamphlet by Edward Wallerstein, who wrote "Circumcision: An American Health Fallacy." (...) Since I am naturally curious, I read it. Disturbed, I thought of tossing it. But, how could I be teaching a nurturing technique for newborns and avoid this topic? As a Jewish woman, how would I make the decision for my own future sons? Little did I know this one piece of paper would lead me on a path of inquiry that would change my life.One of the presenters at this conference was Dr. Robert Mendelsohn, an Orthodox pediatrician. Although Dr. Mendelsohn realized some parents would allow circumcision for religious reasons, he was honest enough to dispel every medical myth and explain the harm of removing normal functioning tissue. He also described possible complications from removing the foreskin, including infection, hemorrhage, and although rare, death.To learn more, I read whatever I could find on the topic. I attended midwifery and childbirth conferences to promote my work and prepare for when I became pregnant. I decided to ask about circumcision, but the conversations were awkward and I received little helpful information. I found that circumcision was a taboo topic; few people wanted to talk about it. Why? Doctors who perform circumcisions, nurses who recommend it, and parents who consent to it do not want to face the reality of the harm they cause. Instead of facing the pain, they avoid the topic, and the procedure continues. Most men do not want to discuss or think about their own circumcisions. I learned that we need to have compassion during these conversations.A Jewish ritual ceremony (bris) is performed on the eighth day after the boy's birth, and includes circumcision and prayers. At a bris, friends and relatives are invited to observe and celebrate. It is part of my heritage. I tried to talk to my relatives about the information I had found, but everyone refused to discuss it. This avoidance made my decision very difficult. Then, for the first time, I was invited to a bris; I didn't want to attend. However, I had been at the boy's birth, so I decided to go to offer support. During the circumcision, my reaction was intense: I wanted to take the baby and run. I felt like an accomplice. I wanted to grab people by the [End Page E2] shoulders and scream, "How dare you?" I vowed I would never attend another bris, and I made the decision to write publicly instead of anonymously.I still had doubts, because I didn't know one intact adult male. What if I were to have a son, keep him intact, and he developed a complication later in life? I have learned that doctors are not taught non-invasive solutions, so most circumcisions performed after infancy are unnecessary. A Jewish doctor recommended a circumcision for a seventynine year old man who had a persistent rash that would not respond to treatment. Our organization suggested that he apply topical acidophilus. After he followed the recommendation, the rash disappeared, so he canceled the circumcision.In 1985, I became pregnant. Like many women I spoke to, I didn't want to face the circumcision decision, so I prayed for a girl. Our childbirth educator shared about male circumcision, which led to conversations with my husband. These tense interactions ended in an impasse. Despite the numerous benefits associated with forgiveness, many individuals find it difficult to forgive. This is especially true in organizations, where forgiveness is rare and can be under-valued. Across two studies, we explore how to facilitate forgiveness within organizational contexts and in the aftermath of workplace unfairness. We examine whether individuals can reduce the “injustice gap” that can be created by violations and enhance forgiveness through expressive writing interventions—guided writing techniques that can be self-administered. Participants wrote about their reactions to (...) a fictional scenario or an actual workplace experience. Results indicate that expressive writing was associated with higher reported perceived resolution. Whereas negative emotions mediated this relationship in Study 1, positive emotions and perceived injustice mediated this relationship in Study 2. Perceived resolution also mediated the relationship between expressive writing and forgiveness. Theoretical, methodological, and practical implications are discussed. (shrink)

She finds in Hobbes's thought a 'turning point for honor,' in which honor is rejected as too dangerous, and fear and self-interest are put in its place as the chief means of peace and good order.

The right not to know is a contested matter. This can be because the inversion of the normal framing of entitlement to information about one's own health is thought to be illogical and inconsistent with self-authorship and/or because the very idea of claiming a right not to know information is an inappropriate appeal to the discourse of rights that places impossible responsibilities on others. Notwithstanding, there has been a sustained increase in this kind of appeal in recent years fueled in (...) large part by the rise and rise of the importance of personal autonomy in health care ethics, and by domestic and international health law. The right not to know has been acknowledged in at least two important international legal instruments. For example, the UNESCO Universal Declaration on the Human Genome and Human Rights, Article 5c provides: “The right of every individual to decide whether or not to be informed of the results of genetic examination and the resulting consequences should be respected.”. This article argues for the importance of conceptual clarity in the debate about the so-called right not to know. This is vital both at the theoretical and the practical level. It is suggested that, unlike many formulations and attempts to give effect to this right, what is at stake is not merely an aspect of personal autonomy and therefore cannot and should not be reduced only to a question of individual choice. Rather, it is argued that the core interests that (...) can be protected by the right not to know are better conceived of as privacy interests rather than autonomy interests. This not only helps us to understand what is in play but also informs regulatory, professional, and legal responses to handling information and taking decisions about whether or not to disclose information to persons about themselves.
