As in Emerson’s nineteenth-century America, those who today pursue that word most ardently also tend—in their struggle to explicate history and culture—to shy away from the persistent instability of meaning with which the texts that they take as their objects of study are vexed. In other words, they are afraid of earthquakes. They are past the help of surgeon or clergy. But even these can understand pitchforks and the cry of fire! and I have noticed in some of this class a marked dislike of earthquakes.” 2It has become one of the methodological orthodoxies of the new contextualism, the increasingly prominent engine driving a continuing metamorphosis of what is perhaps no longer usefully called “Humanities,” to posit a relatively transparent, unproblematic relationship between a textual artifact and its larger cultural or historical context. It is precisely this complex relationship between text and culture—and the theoretical possibility of doing justice to it—that this review of four new publications on Walter Benjamin will revisit.The urgent promise to think through the complicated relationship between text and culture, between the idiomatic artifact and its historical formation, has yet to be fulfilled. How does one account for the singularity of a specific instance of signification, be it a literary text, a film, or a neon sign, articulating the relationship between it and the cultural paradigm that gave rise to it and to which it gave rise? How might one talk about a text’s historicity without forcing a hasty assimilation of it into a crudely mimetic model? One way out of the difficulty, of course, is to suppress the vicissitudes of language altogether, with an eye to hastening the assimilation of a text, seen primarily as illustrative or evidential material, into pre-established assumptions. An example of such a dissatisfactory answer can be found in the introduction to a recent programmatic publication, in which the editors triumphantly proclaim: “Thus, for example, although there is no prohibition against close textual readings in cultural studies, they are also not required.” 3 A marked dislike of earthquakes is at work here. What is more, the logic of such a statement goes as follows: because close reading is no longer necessary, it is dispensable, and therefore eventually no longer performed at all. One is tempted to invoke the famous language of Kafka’s chaplain in The Trial who reprimands Joseph K. for his failure to read closely: “You have not enough respect for writing and you are altering the story.” 4Such methodological difficulties only get worse when one considers the particular problem posed to scholarship by the case of Walter Benjamin, the German-Jewish critic, writer, and philosopher now widely regarded as one of the most significant theorists of our century. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

Although Walter Benjamin's writings are considered to be among the most powerful theoretical enterprises of the twentieth century, his ideas are resistant to cooptation by the doctrines of various critical programs. These essays engage this resistance by examining the ghostly in Benjamin's work. The contributors show that the haunting truths Benjamin offers point towards new forms of responsibility. These truths reside in a figurative elsewhere, a ghostly space that his texts delimit but never fully inhabit, and these essays seek to (...) do justice to the ghosts of Benjamin. Ausgehend von Heinrich Böll und seiner Anfang der 1960er Jahre eingeleiteten Distanzierung von der Institution Kirche, wird am Beispiel von Botho Strauß und Peter Handke, die seit den 1970er und 1980er (...) Mental health professionals who care for asylum seekers in Western European countries increasingly encounter problems for which standard diagnostic and therapeutic protocols and institutional healthcare policies offer no ready answers. In the following case vignettes some of these problems can be identified.

Dieser Wandel lat auch die Bildungsphilosophie nicht unberuhrt. In diesem Buch wird untersucht, welche Auswirkungen postmoderne Ideen auf Bildungsphilosophie und -praxis haben konnen. Im Zentrum der Auseinandersetzung steht die Kritik an der modernen Identitats- und Subjektkategorie und der Versuch, diese aus postmoderner Sicht neu zu bestimmen und gewinnbringend auf die Erwachsenenbildung zu beziehen.

Jennifer Hornsby has defended the Reasons-Knowledge Thesis : the claim that \-ing because p requires knowing that p, where the ‘because’ at issue is a rationalising ‘because’. She defends by appeal to the thought that it provides the best explanation of why the subject in a certain sort of Gettier case fails to be in a position to \ because p. Dustin Locke and, separately, Nick Hughes, present some modified barn-façade cases which seem to constitute counterexamples to and undermine Hornsby’s (...) way of motivating it by rendering their alternative Reasons-Explanation Thesis a better explanation of Hornsby’s datum. This paper defends and Hornsby’s argument for it against those objections. First, I point out that their supposedly intuitive verdict about the relevant barn-façade cases is not as intuitive as they think. Second, I point out that even if we share the intuition: we have strong reason to doubt the verdict anyway. And finally, I point out that since is independently implausible, the two problems can be tackled anyway. (shrink)

According to standard comparativist views, death is bad insofar as it deprives someone of goods she would otherwise have had. In The Ethics of Killing, Jeff McMahan argues against such views and in favor of a gradualist account according to which how bad it is to die is a function of both the future goods of which the decedent is deprived and her cognitive development when she dies. Comparativists and gradualists therefore disagree about how bad it is to die at (...) different ages. In this paper I examine two prominent criticisms of gradualism and show that both misconstrue McMahan. I develop a related criticism that seems to show that a gradualist cannot coherently relate morbidity and mortality. This criticism also fails, but has an instructive implication for how policy-makers setting priorities for health care investments should regard choices between life-saving interventions and interventions against non-fatal diseases in the very young. Over the last few decades, multiple studies have examined the understanding of participants in clinical research. They show variable and often poor understanding of key elements of disclosure, such as expected risks and the experimental nature of treatments. Did the participants in these studies give valid consent? According to the standard view of informed consent they did not. The standard view holds that the recipient of consent has a duty to disclose certain information to the profferer of consent because valid (...) consent requires that information to be understood. The contents of the understanding and disclosure requirements are therefore conceptually linked. In this paper, we argue that the standard view is mistaken. The disclosure and understanding requirements have distinct grounds tied to two different ways in which a token of consent can be rendered invalid. Analysis of these grounds allows us to derive the contents of the two requirements. It also implies that it is sometimes permissible to enroll willing participants who have not understood everything that they ought to be told about their clinical trials. (shrink)

Rule-following is a normative doing and therefore needs to be reconsidered in a metaethical framework. Rule-following will be discussed in the light of cognitivism and non-cognitivism. It will be shown that neither cognitivism nor non-cognitivism are sufficiently good accounts for conceptualizing rule-following, because they are held captive by a quasi-mechanistical picture of rule-following. This idea stems from Stanley Cavell´s and John McDowell´s approach to rule-following. McDowell appeals to the idea that we participate in “shared forms of life” and therefore are (...) able to follow rules correctly. I believe that his quietist view can be amplified by conceptualizing different modes of following a rule. We can also follow a rule e.g. ironically and still grasp the conceptual content of the rule adequately. (shrink)

Theodor W. Adorno's multifaceted work has exerted a profound impact on far-ranging discourses and critical practices in late modernity. His analysis of the fate of art following its alleged end, of ethical imperatives "after Auschwitz," of the negative dialectic of myth and freedom from superstition, of the manipulation of consciousness by the unequal siblings of fascism and the culture industry, and of the narrowly-conceived concept of reason that has given rise to an unprecedented exploitation of nature and needless human suffering, (...) all speak to central concerns of our time. The essays collected here analyze the full range of implications emanating from Adorno's demand that the task of critical thinking be to imagine a mode of being in the world that occurs in and through a language that has liberated itself from the spell of an alleged historical and political inevitability, what he once tellingly called a "language without soil." Adorno' s finely chiseled sentences perform a ceaseless gesture of thoughtful vigilance, a vigilance understood not in the sense of moralizing or ethical normativity but of a rigorous attention to the presuppositions of thinking itself. The volume's fresh readings conspire to yield a refractory and unorthodox Adorno, a suggestive and at times infuriating thinker of the first order, whose intellectual gestures sponsor politically conscious modes of theoretical speculation in a late modernity that may still have a future because its language and aspirations are without soil. Also included is an annotated translation of a seminal interview Adorno gave in 1969 concerning the relationship of Critical Theory to political activism. The study discusses the wooing of Agariste which was proclaimed at Olympia by Kleisthenes, the tyrant of Sicyon, inviting everybody who thought himself worthy to be his son-in-law. At the final banquet his favorite, Hippokleides, danced away his marriage by acting out a bizarre dance. However, his reaction was: „It does not matter to Hippocleides!“ (Hdt. 6,129,4). It will be proposed that Kleisthenes tried to dominate the competition and to establish an enduring hierarchy between himself and the suitors by taking (...) advantage of his position as Olympic champion, giver of the women, tyrant, and host. Thus, Hippokleides’ behavior could be understood as a self-confident rejection of Kleisthenes’ way of constituting individual status, a way which actually suspended the competition. (shrink)

Twenty years ago, the biopsychosocial model was proposed by George Engel to be the new paradigm for medicine and psychiatry. The model assumed a hierarchical structure of the biological, psychological and social system and simple interactions between the participating systems. This article holds the thesis that the original biopsychosocial model cannot depict psychiatry's reality and problems. The clinical validity of the biopsychosocial model has to be questioned. It is argued that psychiatric interventions can only stimulate but not determine their target (...) systems, because intervention and outcome are only loosely coupled. Thus, psychiatric interventions have in principle limited ranges which differ according to the type of intervention and according to the system to be stimulated. Psychosocial interventions face far more obstacles to be overcome than psychopharmacogical therapy. (shrink)

Over the past decade, clinical ethics has received growing attention in Germany as in most European countries. In the mid-1990s, most European countries made efforts to establish healthcare ethics committees and clinical ethics consultation services. The development of clinical ethics discourse and activities in Germany, however, was delayed and, consequently, is still in its natal phase. Until the end of the 1990s, the only institutionalized bodies of ethical reflection were the research ethics committees at university medical centers and at the (...) State Physician Chambers. In March 1997, the Catholic and Protestant hospital association in Germany recommended the implementation of HECs, modeled after the American HECs. Consequently, the establishment of clinical ethics consultation in the form of HECs started in Germany in denominational hospitals, followed by a small but increasing number of community hospitals. We argue that there is a conflict among classical theism's commitments to divine simplicity, divine creative freedom, and omniscience. We start by defining key terms for the debate related to classical theism. Then we articulate a new argument, the Aloneness Argument, aiming to establish a conflict among these attributes. In broad outline, the argument proceeds as follows. Under classical theism, it's possible that God exists without anything apart from Him. Any knowledge God has in such a world would be wholly (...) intrinsic. But there are contingent truths in every world, including the world in which God exists alone. So, it's possible that God contingently has wholly intrinsic knowledge. But whatever is contingent and wholly intrinsic is an accident. So, God possibly has an accident. This is incompatible with classical theism. Finally, we consider and rebut several objections. (shrink)

In this article an attempt is made to localize epistemological violence and to unravel and unmask power structures, including points of friction between the migrating individual and the local community. In addition, a new type of subject is presented, which, on the one hand, reveals the power structures inherent in the individual and in the society containing it, and on the other hand, through the extended model of existence, offers opportunities for a coexistence, which would be marked by solidarity and (...) fairness and would occur by way of interpersonal connections. Using examples of power structures in language courses, in universities, and in the loss of cultural values through migration, epistemic violence is tracked and presented not only theoretically, but also factually. Reinhart Koselleck is among the most original German theorists of history and historiography. His international reputation is due in part to his contributions as theorist and editor of the remarkable lexicon Geschichtliche Grundbegriffe (GG). The GG is an exceptional reference work that goes far towards realizing Koselleck's program and distinctive version of Begriffsgeschichte (the history of concepts, conceptual history). What is presented here is a translation in full of Koselleck's own entry on Krise (crisis). The first step in planning a lexicon of European political and legal concepts is to decide upon how it is to be organised. Among the principal alternatives are the formats of three German reference works on the history of concepts (Begriffsgeschichte) and the methods associated with John Pocock and Quentin Skinner. Although these German and Anglophone styles are often regarded as incompatible, on closer inspection, they turn out to be in many respects complementary, as Skinner has recently acknowledged. What would (...) such a format look like? Is it possible to overcome the difficulties inherent in attempting a lexicon combining continental and Anglophone political and legal concepts? (shrink)

Elizabeth Anscombe's paper ‘Modern Moral Philosophy’ 1 seems clearly to have failed in its task. Kurt Baier describes the paper as ‘widely discussed and much admired’ 2 and Peter Winch has called one of its three theses ‘enormously influential’ 3 within moral philosophy.

To examine the ethical issues involved in governmental decisions with potential health risks, we review the history of the decision to raise the interurban speed limit in Israel in light of its impact on road death and injury. In 1993, the Israeli Ministry of Transportation initiated an “experiment” to raise the interurban speed limit from 90 to 100 kph. The “experiment” did not include a protocol and did not specify cut-off points for early termination in the case of adverse results. (...) After the raise in the speed limit, the death toll on interurban roads rose as a result of a sudden increase in speeds and case fatality rates. The committee's decision is a case study in unfettered human experimentation and public health risks when the setting is non-medical and lacks a defined ethical framework. The case study states the case for extending Helsinki type safeguards to experimentation in non-medical settings. (shrink)

It pursues questions such as: What does it mean for something to "follow" something else? Does that which follows mark a clear break with what came before it, or does it in fact tacitly perpetuate its predecessor as a consequence of its inevitable indebtedness to the terms and conditions of that from which it claims to have departed? Indeed, (...) is not the very act of breaking with, and then following upon, a way of retroactively constructing and fortifying that from which the break that set the movement of following into motion had occurred? The book explores the concept and movement of afterness as a privileged yet uncanny category through close readings of writers such as Kant, Kafka, Heidegger, Bloch, Benjamin, Brecht, Adorno, Arendt, Lyotard, and Derrida. It shows how the vexed concepts of afterness, following, and coming after shed new light on a constellation of modern preoccupations, including personal and cultural memory, translation, photography, hope, and the historical and conceptual specificity of what has been termed "after Auschwitz." The study's various analyses—across a heterogeneous collection of modern writers and thinkers, diverse historical moments of articulation, and a range of media—conspire to illuminate Lyotard's apodictic statement that "after philosophy comes philosophy. But it has been altered by the 'after.'" As Richter's intricate study demonstrates, much hinges on our interpretation of the "after."
