En el marco de los treinta años de la publicación en castellano de la segunda edición de la Teoría pura del derecho y de los setenta y cinco años de la primera publicación en alemán de dicha obra, del profesor austriaco Hans Kelsen, el Programa de Derecho de la Facultad de Relaciones Internacionales y Ciencias Jurídicas y Políticas de la Universidad de Bogotá Jorge Tadeo Lozano, celebró, en octubre de 2009, el Congreso Académico Internacional Hans Kelsen: una Teoría Pura (...) del Derecho, del cual se originó el libro que lleva el mismo nombre. La relevancia que produjo dicho evento en el ámbito académico, así como el interés despertado para la generación de un espacio similar con otros autores de importancia para la ciencia jurídica, se establecieron como el punto de encuentro y la razón de producción de aquello que lleva el nombre hoy de jornadas Académicas Internacionales de Argumentación y Filosofía del Derecho que, adicionalmente, sirvieron para una modulación de actividades desarrollas en el Foro de Interpretación, Argumentación y Decisión judicial del año 2010, llevado a cabo en nuestra Universidad, con presencia del profesor portugués Boaventura de Sousa Santos. Our pains can be more or less intense, our mental imagery can be more or less vivid, our perceptual experiences can be more or less striking. These degrees of intensity of conscious experiences are all manifestations of a phenomenal property I call mental strength. In this article, I argue that mental strength is a domain-general phenomenal magnitude; in other words, it is a phenomenal quantity shared by all conscious experiences that explains their degree of felt intensity. Mental strength has been (...) largely overlooked in favor of mental states’ type, representational contents, domain-specific phenomenology, or processes such as attention. Considering mental strength in our reflections about the mind illuminates debates about the relation of representational contents and phenomenal character, and it also helps address questions about the structure and functions of consciousness. Mental strength provides a unifying construct to model what is shared in the phenomenology of different types of conscious experiences. (shrink)

Arguably the most foundational principle in perception research is that our experience of the world goes beyond the retinal image; we perceive the distal environment itself, not the proximal stimulation it causes. Shape may be the paradigm case of such “unconscious inference”: When a coin is rotated in depth, we infer the circular object it truly is, discarding the perspectival ellipse projected on our eyes. But is this really the fate of such perspectival shapes? Or does a tilted coin retain (...) an elliptical appearance even when we know it’s circular? This question has generated heated debate from Locke and Hume to the present; but whereas extant arguments rely primarily on introspection, this problem is also open to empirical test. If tilted coins bear a representational similarity to elliptical objects, then a circular coin should, when rotated, impair search for a distal ellipse. Here, nine experiments demonstrate that this is so, suggesting that perspectival shapes persist in the mind far longer than traditionally assumed. Subjects saw search arrays of three-dimensional “coins,” and simply had to locate a distally elliptical coin. Surprisingly, rotated circular coins slowed search for elliptical targets, even when subjects clearly knew the rotated coins were circular. This pattern arose with static and dynamic cues, couldn’t be explained by strategic responding or unfamiliarity, generalized across shape classes, and occurred even with sustained viewing. Finally, these effects extended beyond artificial displays to real-world objects viewed in naturalistic, full-cue conditions. We conclude that objects have a remarkably persistent dual character: their objective shape “out there,” and their perspectival shape “from here.”. (shrink)

The author begins by distinguishing six fundamental issues on the metaphysics of individuality.

Introspection is a fundamental part of our mental lives. Nevertheless, its reliability and its underlying cognitive architecture have been widely disputed. Here, I propose a principled way to model introspection. By using time-tested principles from signal detection theory (SDT) and extrapolating them from perception to introspection, I offer a new framework for an introspective signal detection theory (iSDT). In SDT, the reliability of perceptual judgments is a function of the strength of an internal perceptual response (signal- to-noise ratio) which is, (...) to a large extent, driven by the intensity of the stimulus. In parallel to perception, iSDT models the reliability of introspective judgments as a function of the strength of an internal introspective response (signal-to-noise ratio) which is, to a large extent, driven by the intensity of conscious experiences. Thus, by modelling introspection after perception, iSDT can calibrate introspection’s reliability across a whole range of contexts. iSDT offers a novel, illuminating way of thinking about introspection and the cognitive processes that support it. Much research into morphogenesis focuses on discovering mechanisms and models able to generate or describe the forms we can observe in nature. These studies all provide insights, even though they do not directly touch upon what is the focus of this article: the understanding of form. To this end a conceptual scheme based on the following ideas is proposed: understanding , emerging , persisting , selection , and the relation concerning complexity versus uncertainty , in particular, the relation between form (...) and function. Studying the neural correlates of conscious awareness depends on a reliable comparison between activations associated with awareness and unawareness. One particularly difficult confound to remove is task performance capacity, i.e. the difference in performance between the conditions of interest. While ideally task performance capacity should be matched across different conditions, this is difficult to achieve experimentally. However, differences in performance could theoretically be corrected for mathematically. One such proposal is found in a recent paper by Lamy, Salti and Bar-Haim [Lamy (...) D, Salti M, Bar-Haim Y. Neural correlates of subjective awareness and unconscious processing: an ERP study. J Cognitive Neurosci 2009,21:1435-46], who put forward a corrective method for an electroencephalography experiment. We argue that their analysis is essentially grounded in a version of High Threshold Theory, which has been shown to be inferior in general to Signal Detection Theory. We show through a series of computer simulations that their correction method only partially removes the influence of perfor- mance capacity, which can yield misleading results. We present a mathematical correction method based on Signal Detection Theory that is theoretically capable of removing performance capacity confounds. We discuss the limitations of mathemati- cally correcting for performance capacity confounds in imaging studies and its impact for theories about consciousness. (shrink)

Dynamic Theodicy (DT) is a broad concept we bring up to designate some modern Philosophical Theology attempts to reconcile the necessary and perfect existence of God with the contingent characteristics of human life. In this paper we analyze such approaches and discuss how they have become incomprehensible because the metaphysical assumptions implicit in these explanations have lost their intrinsic relation to the natural human desire for salvation. In the first part we show Charles Hartshorne's DT-model, arising from the modal logic (...) of perfection, and the modern rational problems of this position in making infinite-necessary Being (God) and finite-contingent being (human) compatible. We note that at the heart of the contradictions in this DT account is a dialectical mode of thinking that makes it difficult to find a correct solution to this dichotomy, and to assume a human desire that could be considered related to lifelong goals. In the second part, supported by the proposal of Hans Urs von Balthasar's DT, we develop the concepts of bodily vulnerability, corporeal intentionality, and natural desire for salvation, which come from an Aristotelian-Thomistic thought. This theory is established in order to build an argument, following Alasdair MacIntyre’s ethical framework, on how to make possible the recovery of a metaphysical and anthropological desire that transcends natural aging and goes beyond death. We conclude that both human dependence and the virtues that arise naturally when human beings decide to seek the good of their transcendent condition, make it possible to recover the natural desire for salvation through divine and human love. Implementing corporate social responsibility (CSR) in supply chains is not a trivial task. In fact, many firms in recent years have publicly proclaimed that in order to keep their CSR commitments, they had to reduce reliance on external suppliers by vertically integrating their operations. Our aim in this article is to examine whether there is truly a relationship between a firm’s CSR performance and its level of vertical integration. Drawing on a multi-industry sample of 2,715 firm-year observations, and after addressing (...) endogeneity concerns, we demonstrate that firms with higher CSR performance tend to vertically integrate more (or, outsource less). We also demonstrate that this tendency is weaker for firms that have higher degrees of asset specificity or international diversification. Our core conclusion is that CSR performance and outsourcing are at odds, but firms can reconcile this tension by deepening their collaborations with suppliers. (shrink)

The article aims to point out some of the interpretive horizons of Twilight of the Idols, especially the status in relation to philological literary project regarding Will to Power and the philosophical status within the texts of 1888. Among others, the central hypothesis that will guide our interpretation is the 'heuristic of necessity': the question about desires and needs that cause or force an artistic, politic, etc. production and, moreover, a hypothesis that is found through the book. Finally, it is (...) also to point out that how Nietzsche operates with a semantic distance in relation to concepts that were previously elaborated by him, for example, the concept of ‘genius'. These assumptions help to fill a gap into the research-Nietzsche, regarding a text that didn’t receive its real significance in Brazil. (shrink)

Consciousness and confidence seem intimately related. Accordingly, some researchers use confidence ratings as a measure of, or proxy for, consciousness. Rosenthal discusses the potential connections between the two, and rejects confidence as a valid measure of consciousness. He argues that there are better alternatives to get at conscious experiences such as direct subjective reports of awareness (i.e. subjects’ reports of perceiving something or of the degree of visibility of a stimulus). In this chapter, we offer a different perspective. Confidence ratings (...) in general, and metacognitive measures in particular, may offer important advantages over subjective ratings. The arguments we offer here are supported by empirical, practical and socio-strategic considerations. However, we do not suggest consciousness and confidence are interchangeable. We recognize the limitations of confidence ratings in some experimental designs and for some research questions. Nevertheless, we also address a potential conceptual link between consciousness and confidence that stems from Rosenthal’s very own work on mental quality space theory. (shrink)

The need for ecological sustainability has been translated into different indicators such as the ‘ecological footprint’ and the ‘planetary boundaries’. Analysis of both concepts concludes that the planet is currently undergoing a period of ecological unsustainability. For this reason, ecologists argue that various limits are required in order to move to a path of sustainability. The implementation of such limits has mostly been analysed from the perspectives of environmental rights and environmental justice, however research in terms of freedom is (surprisingly) (...) still lacking. In what way do such limits have an impact on freedom? I will argue that there are two different ways to analyse the relation between freedom and ecological limits: on the one hand, freedom is often referred to as being in competition with ecological sustainability and the limits it is required to impose, and, on the other hand, the impact on an individual’s freedom due to ecological catastrophe if strict limits are not implemented. Accepting that freedom is an important topic regarding ecological challenges, I ask which conception of freedom is better suited to answer this challenge as well as the required implementation of ecological limits. I compare and confront the closely linked conceptions of freedom as non-frustration and the closely linked conception of non-limitation, as well as non-interference and the conception of freedom as non-domination. After presenting these conceptions I examine their relationship with ecological limits. The conclusion is that the conception of freedom as non-domination is better placed to justify ecological limits necessary to promote an ecologically sustainable future. (shrink)

There are those who believe that modern society's reliance upon law, politics and science to both regulate and emancipate society has reached a crisis point and can no longer provide answers to current social problems. To find the neural substrates of consciousness, researchers compare subjects’ neural activity when they are aware of stimuli against neural activity when they are not aware. Ideally, to guarantee that the neural substrates of consciousness—and nothing but the neural substrates of consciousness—are isolated, the only difference between these two contrast conditions should be conscious awareness. Nevertheless, in practice, it is quite challenging to eliminate confounds and irrelevant differences between conscious and unconscious conditions. In particular, there is an often-neglected confound that (...) is crucial to eliminate from neuroimaging studies: task performance. Unless subjects’ task performance is matched (and hence perceptual signal processing is matched), researchers risk finding the neural correlates of perception, rather than conscious perception. Here, we discuss the theoretical motivations for the performance matching framework and review empirical demonstrations of, and theoretical inferences derived from, obtaining differences in consciousness while controlling for task performance. We summarize signal detection theoretic modeling frameworks that explain how it is that we can derive performance-matched differences in consciousness without the effect being trivially driven by differences in criterion setting, and also provide principles for designing experimental paradigms that yield performance-matched differences in awareness. Finally, we address potential technical and theoretical issues that stem from matching performance across conditions of awareness, and we introduce the notion of “triangulation” for designing comprehensive experimental sets that can better reveal the neural substrates of consciousness. The concept of shared mental models refers to the shared understanding among team members about how they should behave in different situations. This article aimed to develop a new shared mental model measure, specifically designed for the refereeing context. A cross-sectional study was conducted with three samples: national and regional football referees (n = 133), national football referees and assistant referees and national futsal referees (n = 277), and national futsal referees (n = 60). The proposed version of the Referee (...) Shared Mental Models Measure (RSMMM) has 13 items that are reflected on a single factor structure. The RSMMM presented good validity evidence both based on the internal structure and based on relations to other variables (presenting positive associations with team work engagement, team adaptive performance, and team effectiveness). Such promising psychometric properties point to an optimistic outlook regarding its use to measure shared mental models in futsal and football referee teams. -/- . (shrink)

In this article I argue that, in spite of the apparently unshakable hegemony of the historical, philosophical and sociological arguments invoked by the canonical history of Europe and the world to demonstrate the uniqueness of the West and its superiority, there is room to think of a non-Occidentalist West. By that I mean a vast array of conceptions, theories, arguments that, though produced in the West by recognized intellectual figures, were discarded, marginalized or ignored because they did not fit the (...) political objectives of capitalism and colonialism at the roots of Western modernity. In the article I tackle specifically three topics: the conceptions of antiquity, modern science and a teleology of the future. Among many others who might be selected, I resort to three eccentric figures — Lucian of Samosata, Nicholas of Cusa and Blaise Pascal — to exemplify some of the paths that might guide us in the construction of a non-capitalist, non-colonialist inter-cultural dialogue. Such paths are here designated as those of learned ignorance, ecology of knowledge, wager on another possible world and artisanship of practices. (shrink)

Green republicanism can be described as a subset of republican political theory that aims at promoting human flourishing by ensuring a non-dominating and ecologically sustainable republic. An essential aspect of green republicanism is the promotion of post-productivism while preserving or expanding republican freedom as non-domination. Post-productivism implies the promotion of personal autonomy rather than the pursuit of permanent economic growth and the promotion of labour as an intrinsically positive human activity, which for green republicans will have three positive aspects: reduced (...) ecological impact, more time available for civic participation, and the extension of democratic decision-making and norms to the sphere of production. An important aspect in the definition of a post-productivist society is the way welfare schemes are designed. In this article, I will thus compare the existing welfare regimes with a participation income and with an unconditional basic income, and analyse how they promote green republican goals. I conclude that the current systems are one of the elements of the productivist society and that would not answer the green republican conditions. A green participation income could have a positive ecological impact and contribute to a shift to post-productivism but would face serious challenges from a republican perspective, namely in terms of the non-arbitrariness of its attribution. Finally, I conclude that depending on how it is defined, an unconditional basic income could contribute to post-productivism while being non-arbitrary thus obeying the green republican conditions.
