Social and environmental problems attributed to current electricity sector restructuring structures are spelled out. The energy source choices and market power of large industrial and commercial users versus residential consumers are compared. An institutional analytic approach is used to reveal the best option to alleviate the social and environmental problems associated with electricity restructuring. Community aggregation emerges with great potential to achieve meaningful social and environmental improvement.

In arguments in support of capitalism, the following propositions are sometimes advanced or presupposed: the best life for the individual is one of consumption, understood in a broad sense that includes aesthetic pleasures and entertainment as well as consumption of goods in the ordinary sense; consumption is to be valued because it promotes happiness or welfare, which is the ultimate good; since there are not enough opportunities for consumption to provide satiation for everybody, some principles of distributive justice must be (...) chosen to decide who gets what; the total to be distributed has first to be produced. What is produced depends, among other things, on the motivation and information of the producers. The theory of justice must take account of the fact that different principles of distribution have different effects on motivation and information; economic theory tells us that the motivational and informational consequences of private ownership of the means of production are superior to those of the various forms of collective ownerships. In the traditional controversy over the relative merits of capitalism and economic systems, the focus has been on proposition. In this paper, I consider instead propositions and. Before one can even begin to discuss how values are to be allocated, one must consider what they are – what it is that ought to be valued. I shall argue that at the center of Marxism is a specific conception of the good life as one of active self-realization, rather than passive consumption. (shrink)

This paper addresses two puzzles in the semantics of connected exceptive phrases (EP): (i) the compatibility of EPs modifying noun phrases headed by the negative polarity item (NPI) determiner any and (ii) the ability of a negative universal quantifier modified by an EP to license strong NPIs. Previous analyses of EPs are shown to fail to solve these puzzles. A new unified solution to the two puzzles is proposed. The crucial insight of the analysis is to allow von Fintel’s (Natural (...) Language Semantics 1: 123–148, 1993; Restrictions on quantifier domains, PhD dissertation, 1994) leastness condition on EPs to be imposed at scopes non-local to the surface position of the EP. A general result is derived concerning the truth conditions of sentences in which an existential modified by an EP occurs in the scope of a downward entailing operator. The distribution of EPs is argued to depend on how the leastness condition interacts with other pragmatic strengthening conditions, such as the one imposed on any by Kadmon and Landman (Linguistics and Philosophy 16: 353–422, 1993). Critical Theory has traditionally been interested in engaging classical psychoanalysis rather than addressing postclassical thought. For the first time, this volume brings Critical Theory into proper dialogue with modern developments in the psychoanalytic movement and covers a broad range of topics in contemporary society that revisit the Frankfurt School and its contributions to psychoanalytic social critique.

Despite great advances in recent scholarship on the political philosophy of John Rawls, Rawls’s conception of stability is not fully appreciated. This essay aims to remedy this by articulating a more complete understanding of stability and its role in Rawls’s theory of justice. I argue that even in A Theory of Justice Rawls maintains that within liberal democratic constitutionalism judgments of relative stability typically adjudicate decisively among conceptions of justice and is committed to more deeply than to the substantive content (...) of justice as fairness. This essay thus emphasizes the continuity of Rawls’s thought over time and motivates the position that Rawlsian stability is as philosophically significant and distinctively Rawlsian as justice as fairness itself. This article uses concepts from sociology, history, and philosophy to explore the shifting relationship between moral values and business in the Western world. We examine the historical roots and intellectual underpinnings of two major business-society paradigms in ideal-type terms. In pre-industrial Western society, we argue that business activity was linked to society’s values of morality (the moral unity paradigm}-for good or for ill. With the rise of industrialism, we contend that business was freed from moral constraints by the alleged “invisible (...) hand” of efficient markets (the amoral theory of business). Armed with this understanding of the intellectual history of the moral unity and amoral business-society paradigms, we suggest that some variant of the moral unity paradigm may be recurring in post-industrial society. We propose a way forward by reframing the rationing conversation, distinguishing between the scale of the decision and its context avoiding the word “rationing.” We propose to (...) shift the terminology, using specific, descriptive words to defuse conflict and re-focus the debate towards substantive issues. These distinctions can clarify the real ethical differences at stake and facilitate a more constructive conversation about the clinical and social responsibilities of physicians to use resources ethically at the bedside and their role in allocating medical resources at a societal level. The essays in this provocative collection survey and assess institutional arrangements that offer possible alternatives to capitalism as it exists today. The point of departure agreed upon by the contributors is that on the one hand, capitalism produces unemployment, a lack of autonomy in the workplace, and massive income inequalities; while on the other, central socialist planning is characterized by underemployment, inefficiency, and bureaucracy. In Part I of the volume, various alternatives are proposed: profit-sharing systems, capitalism combined with some central (...) planning, worker-owned firms in a market economy into a centrally planned economy, as has occurred recently in Hungary. Part II provides a theoretical analysis and assessment of these systems. This book is the first to cover such a wide range of subjects as central planning, market socialism, and profit sharing. The publication of Political Liberalismhas allowed John Rawls to bring to the fore issues that remained in the background of A Theory of Justice. His explicit attention to the concept of ‘the reasonable’ is a welcome development. In a more recent publication, he affirms the importance of this concept, ‘while [granting] that the idea of the reasonable needs a more thorough examination than Political Liberalism offers.’ In this paper, I will present a critical exposition of the senses of the reasonable (...) on which justice as fairness relies. Rawls employs the term in four main contexts. I will outline these various senses and argue that in each case, a controversy in the secondary literature can be resolved by close attention to the concept of the reasonable. In three of these contexts, Rawls relies on what I will call a ‘strong’ sense of the reasonable, while in one he sometimes seems to rely on a ‘weak’ sense. I argue that justice as fairness is best served by relying on a strong sense throughout. (shrink)

La complejidad de una enfermedad terminal pone en evidencia la vulnerabilidad del ser humano ante el dolor y el sufrimiento, y acentúa la crisis subjetiva que acompaña no solo al paciente, sino también al médico que lo asiste. Revisamos la propuesta de un estudio posicionado en la ética del cuidado de quienes necesitan atención integral en el final de la vida. Nos referimos a la investigación titulada “Final de vida, cuidados paliativos y empatía. Manejo de la empatía como recurso fundamental (...) frente a la toma de decisiones al final de la vida” (1). Un extracto de dicho trabajo señala la importancia de que los médicos puedan ubicar el sufrimiento del paciente separado de ellos mismos, de manera que sostengan una resonancia empática que los posicione con capacidad para entrar en el mundo del paciente y su enfermedad, con firmeza personal y profesional. Definimos un espacio de reflexión acerca del sentido del sufrimiento, su correlato en la práctica clínica y un argumento fundamental al momento de proponer una legislación vinculada al final de la vida. Revisionists and traditionalists appeal to Acts 15, welcoming the Gentiles, for analogies directing the church's response to homosexual persons. John Perry has analyzed the major positions. He faults revisionists for inadequate attention to the Jerusalem Decree and faults one traditionalist for using the Decree literally rather than through analogy. I argue that analogical use of the Decree must supplement rather than displace the plain sense. The Decree has been neglected due to assumptions that Paul opposed it, that it expired, or (...) because Gentiles wanted non-kosher meat. I argue that Paul continued to observe the Torah and supported the Decree, that it has not expired, and that Gentile desire for non-kosher meat is not a firm obstacle. Affirming the plain sense of the Decree, I develop the analogy from Acts 15 to homosexual persons. (shrink)

During the later 1660s Thomas Hobbes clearly believed that he was being targeted by dangerous enemies but to date little evidence has been brought to substantiate Hobbes's claims. This article considers evidence suggesting that Hobbes was in fact in danger from clerical and lay enemies who regarded the elderly thinker as a dangerous ideological threat to church and state. What they did, and how Hobbes responded to their actions, helps us to understand the philosopher's place in the politics of the (...) period, but also helps to explain the timing, nature and purpose of some of his most important later writings. Hugo Grotius (1583-1645) [Hugo, Huigh or Hugeianus de Groot] was a towering figure in philosophy, law, political theory and associated fields during the seventeenth century and for hundreds of years afterwards. His work ranged over a wide array of topics, though he is best known to philosophers today for his contributions to the natural law theories of normativity which emerged in the later medieval and early modern periods. This article will attempt to explain his views on the law of nature (...) and related issues while simultaneously providing some broader assessment of his place in the history of ideas. (shrink)

The claim that corporations are not people is perhaps the most frequently voiced criticism of the United States Supreme Court decision Citizens United v. Federal Election Commission. There is something obviously correct about this claim. While the nature and extent of obligations with respect to group agents like corporations and labor unions is far from clear, it is manifest in moral understanding and deeply embedded in legal practice that there is no general requirement to treat them like natural persons. Group (...) agents may be denied rights to marry, vote, or run for public office. More generally the need to guard against discrimination, the core injustice in racism and sexism, has no direct application to the case of group agents. There is also something obviously incorrect about the claim that corporations are not people. The legal practice of treating some group agents as persons under law is ancient, found already in Roman law at the time of Justinian. In this essay I propose that reflection on this tension reveals that fundamental revision to the doctrine of legal personhood is needed. More specifically I propose that legal personhood be decomposed into at least two elements—standing and liability—and that legal systems reject the principle that an entity possesses one just in case it possesses the other. The import of this change ramifies broadly. Decomposing legal personhood not only enables a satisfactory account of the status of corporations and labor unions, who as such have liability but not standing, it also enables a satisfactory account of the status of those who as such have standing but not liability: severely mentally disabled persons, very young children, and non-human animals with phenomenal consciousness but lacking capacities to understand reasons and justifications. L’articolo esamina le qualità della democrazia deliberativa a partire dal ri­ferimento a espressioni storiche di questa: nelle istituzioni ateniesi del quin­to-quarto secolo a. C., nella Convenzione Federale statunitense del 1788, negli Stati Generali della Rivoluzione francese, in varie esperienze lo­cali odierne. Stabiliti tre modelli di democrazia e tre criteri per la deliberazione , la questione da affrontare è se la forma deliberativa di democrazia sia un buon sistema politico. La risposta è sì, purché si verifichino tre con­dizioni: intensità della motivazione (...) nei partecipanti, orientamento al bene pubblico della motivazione stessa, corretta informazione dei partecipanti. Ma si tratta di una conclusione ipotetica, che tiene conto della complessità e molteplicità dei fattori in gioco, e dunque del fatto che nessuna proprietà dei processi decisionali collettivi è desiderabile incondizionatamente.The article reflects upon strengths of deliberative democracy from an historical point of view: beginning with Athens’ institutions , pas­sing through States-General during French Revolution and U. S. Federal Con­vention , finally reaching today’s experience. Having established three different models of democracy and three criteria for the deliberative process , the issue is whether deliberative democracy works well as a po­litical system. We can surely say it does, although under some con­ditions: level of participants’ motivation, actions directed towards well-being and good information. Nevertheless, this is only a hypothetical con­clu­sion: there’s no perfect deliberative process, because of the complexity and plurality of the factors at play. (shrink)

In this article, I argue that the later Wittgenstein’s related conclusions regarding the importance of a non-theoretical understanding of human behaviour and the essentially therapeutic function of philosophy can be arrived at without subscribing either to the position that description and explanation are necessarily distinct activities or the idea that language is an inherently rule-based activity operating within determinate conceptual-cultural regimes. I aim to do so by bringing together two figures, A.R. Louch and Roy Harris, both of whom stand within (...) a post-Wittgensteinian tradition, but whose kindred yet hitherto unconnected departures from the orthodoxy of that tradition render their work not only distinctive but all the more compelling for it. I shall try to exhibit the affinity between Louch and Harris by means of an expository discussion of the former’s thesis regarding the role and form of explanation in the social and behavioural sciences, followed by an account of explanation in linguistic inquiry consistent with the latter’s ‘integrationist’ philosophy of language and communication. I will also claim that the thought of both Louch and Harris points towards a form of atheoretical empiricism in the investigation of human action, as well as a broadly therapeutic conception of philosophical and linguistic inquiry respectively. However, I will suggest that such a conception is not necessarily best served by the adoption of an overtly therapeutic rhetoric. (shrink)

In his different analyses of ancient Egypt, Hegel underscores the marked absence of writings by the Egyptians. Unlike the Chinese with the I Ching or the Shoo king, the Indians with the Ramayana and the Mahabharata, the Persians with the Avesta, the Jews with the Old Testament, and the Greeks with the poems of Homer and Hesiod, the Egyptians, despite their developed system of hieroglyphic writing, left behind no great canonical text. Instead, he claims, they left their mark by means (...) of the architecture and art. This paper explores Hegel’s analysis of the Egyptians’ obelisks, pyramids, sphinxes, etc. in order to understand why he believes that these are so important for understanding the Egyptian spirit. This analysis illustrates Hegel’s use of history and culture in the service of philosophical anthropology. (shrink)

Turing's World is a self-contained introduction to Turing machines, one of the fundamental notions of logic and computer science. The text and accompanying diskette allow the user to design, debug, and run sophisticated Turing machines in a graphical environment on the Macintosh.
